FINAL Town of Ithaca Town Board Minutes December 30 , 1993 At the year end meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Hall , 126 East Seneca Street , Ithaca , New York , there were : PRESENT : Shirley Raffensperger , Supervisor John Whitcomb , Councilman Catherine Valentino , Councilwoman Karl Niklas , Councilman Frank Liguori , Councilman David Klein , Councilman ALSO PRESENT : John Barney , Esq . ; Town Attorney Joan Lent Noteboom , Town Clerk Daniel Walker , P . Macera , Ithacare EXCUSED * Patricia Leary , Councilwoman Agenda Item No 3 - Report of Town Officials a . Supervisor - The Supervisor thanked the staff for the flowers for the outgoing Town Board members , and then made her final Supervisor ' s Report as follows : This is my last report as Town of Ithaca Supervisor and I ' d like to take this opportunity to express my thanks to you - First to the Town Board - I believe that we have accomplished much of what we set out to do four years ago and some other things . too . First the Comprehensive Plan , which you know has been a priority for me for many years . The Plan we have now is a good one and one that will be a framework for land use planning improvement in the future . David Klein served as chair of the Comprehensive Planning Committee , guiding a very complex process to a successful conclusion . My congratulations to him . Pat Leary has been instrumental in many initiatives for the Town , ranging from a taxi cab ordinance , through transportation planning , to the ethics law . The Board and the Town ha-s benefitted from her consistent representation of her constituency and she will be missed in the years ahead . TB Minutes 12 / 30 / 93 Page 2 . Frank Liguori brought to the Town Board unique experience and expertise . He has represented the Town well on the SJS . which he has chaired , and has , as chair of the Town Public Works Committee , guided the Town to establishing a capital improvement program , long needed . Add to that his work on investigating new Town Hall possibilities and his work in establishing the Ethics Board , etc . , etc . - and you know we ' ve kept him busy . I am most grateful for all that hard work , all done in a cooperative spirit . Without Karl Niklas making and seconding motions , we would never have gotten all those resolutions on and off the floor . For that , his editorial eagle eye , and above all , his sense of humor , my thanks . The enormous body of work accomplished by the Codes and Ordinance Committee , which he chaired , making much - needed strategic revisions to the Zoning Ordinance , was a remarkable accomplishment and most essential . Karl ' s work on the Comprehensive Planning Committee , including statistical help on the survey , was a very valuable contribution to the Comprehensive Plan . The Board is fortunate to have Karl continuing next year . Cathy Valentino and I have the longest legislative history together , going back to 1976 , when we stunned the Town Board - I ' ve been told - the first two women to serve . Cathy is always willing to fill in , to make a meeting . help with a project - my sincere thanks , and for her work on the Codes and Ordinances Committee , the television franchise negotiations . the Ethics Committee , and most especially her work on the Youth Recreation Committee , where she has brought important negotiating and tough skills . John Whitcomb chaired the newly created Conservation Advisory Board , leading it to the completion of an Open Space Report , and , incidentally garnering several awards from the NYS Association of Conservation Commissions including a Special Achievement Award and an educational award , all this while serving as Deputy Supervisor . a member of the Comprehensive Planning Committee and various other committees . My thanks to him and my best wishes for his success as Supervisor of the Town of Ithaca . I have enjoyed working with a most cooperative and expert Town staff - an important component in all of the Town Board accomplishments I have listed - the Planning Staff with the Comprehensive Plan . the Cornell GEIS , the Open Space Plan , the Agriculture Report . etc . Engineering supporting all those activities , plus a large water and sewer extension accomplished in the past four years , improvements in mapping systems , in general . water and sewer administration and more ; Zoning and Building TB Minutes 12 / 30 / 93 Page 3 . Inspection in the work on codes and ordinances , zoning enforcement and building inspection systems . Our personnel policies have been clarified and improved ; a new accounting system is underway with financial management systems improved , and an innovative and effective records management program has been initiated and implemented , making an immeasurable improvement in Town Hall procedures , thanks to Town Clerk Joan Noteboom , our Highway Department continues to provide excellent services to Town residents ; our Parks Department , under the management of Rich Schoch , continues to receive rave revues from Town users - to all of you my sincere appreciation . And a thank you to John Barney , who keeps us all in line and , we hope , legal - all that with humor and grace . I ' m goring to take this opportunity to make a very few recommendations to the Town Board for the future . First , that you proceed to obtain a new Town Hall - the present facilities are inefficient and inconvenient - for the Town staff and the public we serve . Second , that you consider initiating the necessary procedures to establish the term for the Town Supervisor at four years . This option has been available for some time and I believe would better reflect the scope of the Supervisor ' s responsibilities . And last , and I know this will be the case . I wish for John Whitcomb the same fine level of cooperation and support I ' ve had from staff , Town Board members , and Town residents . b . Town Engineer - Mr . Walker thanked Supervisor Raffensperger for the opportunity to work with her and with the Town Board the last four years . Many challenges have been faced and accomplished , and Supervisor Raffensperger will be missed . C . Highway 'Superintendent - No report at this time . d . Town Build. ing / Zoning Officer - No report , Mr . Frost echoed the thoughts and sentiments of the Town Engineer to the Supervisor . f . Town Clerk / Receiver of Taxes - Mrs . Noteboom noted the sending of the tax bills went very well . The new tax bill is very easily read and comments have been favorable . The only problem was the County did not sort them by bill number , and they had to be sorted by hand . Mrs . Noteboom thanked Supervisor Raffensperger for giving her the opportunity to come to the Town of Ithaca , it has turned out to be a wonderful experience , and she is very please to call Ithaca her home . TB Minutes 12 / 30 / 93 Page 4 . Attorney Barney expressed his second to what all the Town Board members and staff feel . that Supervisor Raffensperger will be a tough act to follow in Town Hall . He told Supervisor Raffensperger he has really enjoyed working with her over the last four years . It was a wonderful opportunity to work with someone of her caliber and class . Thank you , you have done an excellent job . Agenda Item No . 4 - Report of Town Committees There were no reports given at this time . Agenda Item No . 5 - Town Board Minutes , 12113 / 93 Motion made by Councilman Niklas , seconded by Councilman Klein approving the minutes of the 12 / 13193 minutes as written . Carried unanimously . Agenda Item No 6 - Financial Report , November 1993 Motion made by Councilwoman Valentino . seconded by Councilman Niklas adopting the Financial Report for the month of November 1993 as the official report for the said month . Carried unanimously . Agenda Item No . 7 - Town of Ithaca Warrants Ms . Alario mentioned there were not many bills as it had only been two weeks since the approval of the last abstract . No unusual items on the abstract . Motion made by Councilman Klein , seconded by Councilman Niklas authorizing the payment of the vouchers as numbered and listed on the abstract . Carried unanimously . Agenda Item No . 8 - 1993 Budget Amendments Ms . Alario pointed out that the large transfer in the amendments is for the money being encumbered for a storage tank . Motion made by Councilman Niklas , seconded by Councilman Liguori approving and adopting the budget amendments as attached . Carried unanimously . Agenda Item No . 9 - Transfer to Capital Reserve Fund Supervisor Raffensperger stated she . Ms . Alario . and John Whitcomb met to discuss the amount projected as fund balances . it seems appropriate to make a transfer of funds to the Capital Reserve Fund as explained in previous meetings . TB Minutes 12 / 30 / 93 Page 5 . Ms . Alario explained last month the Town received additional funds in Sales Tax revenues , and Mortgage Tax which gave the Town some funds to reserve . Motion made by Councilman Niklas , seconded by Councilman Liguori approving and authorizing that $ 250 , 000 be transferred from General Part - town Fund to General Townwide Fund to fund the Capital Reserve Fund . Carried unanimously . Agenda Item No . 10 - 1994 Insurance Proposal Coverage Supervisor Raffensperger mentioned this coverage is the same as in the past with the addition of the insurance discussed covering pieces of equipment that are loaned to the Town . Motion made by Supervisor Raffensperger , seconded by Councilman Niklas ratifying the insurance coverage and related premiums submitted by the Becker Wells Agency . Councilman Klein asked if the premiums listed were the actual charges , and if these were the result of several solicitations ? Supervisor Raffensperger said these figures are the best projection of the charges , if a change needs to be made it can again be brought before the Town Board . The Town every three years solicits bids from various insurance companies . Ms . Alario said the premiums are a little lower for next year . Councilman Whitcomb asked if this includes coverage for the water tanks ? Supervisor Raffensperger said they were not included in the proposal , it is something the Town could add if they wished to . Councilman Klein asked if there is a concern about the water tanks ? Supervisor Raffensperger said coverage for the tanks has been discussed for several years , it is very expensive and maybe should be looked at by the Town Engineer to see if the coverage is necessary . Mr . Walker said the Town ' s history of loss on the water tanks has been non - existent . The Town has general liability that covers personal injury . This coverage is for damage to the tanks . The biggest liability would be for vandalism , etc . The motion was carried unanimously . TB Minutes 12 / 30 / 93 Page 6 . Agenda Item No . 11 - 1994 Official Newspaper Motion made by Councilman Liguori , seconded by Councilman Klein designating the Ithaca Journal as the official newspaper for the Town of IthELca for 1994 . Carried unanimously . Agenda Item No . 12 - 1994 Depository for Town Funds Motion made by Supervisor Raffensperger , seconded by Councilman Niklas designating Tompkins County Trust Company as the official depository for all monies coming into the hands of the Town Supervisor , Town Clerk , and the Receiver of Taxes for the year 1994 . Carried unanimously . Agenda Item No . 13 - Official Bonds , Town Officers and Employees Motion made by Councilwoman Valentino , seconded by Councilman Klein that the Faithful Performance Bonds for the Town Officials and Town employees for the year 1994 be approved as per the attached resolution listing . Carried unanimously . Agenda Item No . 14 - Town Clerk ' s Annual Report Mrs . Noteboom reported on her written report for the year 1993 . ( see attached ) . Motion made by Councilman Niklas . seconded by Councilman Liguori accepting the Town Clerk ' s Annual Report as the official report of the activities of revenues and disbursements for the Town Clerk in 1993 . Carried unanimously . Agenda Item No . 16 - Hazardous Materials Response Plan Mr . Frost explained the plan originally came from the City of Corning that was used by the City of Ithaca . The Town of Ithaca made revisions to compliment its needs . As part of the plan there is an introduction providing information of phone numbers and contact people in the event of an emergency . There is general incident information . There are protective action procedures and an evacuation plan . This plan provides any user of the document a sense of what to do in the course of an emergency . There are instructions as to reporting how incidents are -handled and resolved . There is also a basic operating procedure for the fire department . While putting this together it helped to identify the different groups involved for emergency response for hazardous materials . TB Minutes 12 / 30 / 93 Page 7 . The City of Ithaca had the best plan , and Cayuga Heights is using that plan . Reference is made to other documents that will be kept in a master file for reference and as guides in a general emergency management plan . Communication has been made to State agencies about the plan . Individuals from the NYS Disaster Preparedness Agency will be coming to have a meeting with all involved agencies . There will be a training session . Supervisor Raffensperger thanked Mr . Frost for his good job on this plan . Motion made by Councilwoman Valentino , seconded by Councilman Niklas approving the Hazardous Materials Response Plan and directing the Town Building / Zoning Officer to submit the report to the State of New York Department of Labor , Public Employee Safety and Health Bureau as required . Councilman Klein said he felt the report was very through , and asked what procedures have to be adopted to share this plan with staff ? Mr . Noteboom said the Emergency Preparedness Plan to be discussed later in the meeting will actually involve the plan staff . The Hazardous Materials Plan is a component part of that . The Town will have a general plan that will have all these components . Mr . Frost has done a great deal of work in that direction . Mr . Frost stated there will be training by his assistant who has various cert -ifications , and the Fire Department . The Building , Engineering , and Highway Departments will have training in how to activate the plan , as well as follow up training . Mr . Noteboom said Mr . Frost has already provided the Highway Department with booklets for the trucks and the base station so the men can call in with information and receive information as to how to proceed over the radio . Mr . Frost is moving along very well with training . Motion called and carried unanimously . Persons To Be Heard The Supervisor asked if there were any persons who wished to be heard by the Board ? No one wished to be heard at this time . TB Minutes 12 ! 30193 Page 8 . Agenda Item No . 17 - Pickup of Holiday Trees Mr . Noteboom stated January 10 , has been picked as the day for holiday tree pickup . Motion made by Supervisor Raffensperger , seconded by Councilman Niklas approving January 10 , 1994 as the day the Town Highway and Parks Departments will pick up holiday trees for the residents of the Town . Councilwoman Valentino asked if people would be notified to have their trees by the curb ? Mr . Noteboom said it is being advertised in the paper . The Ithaca Journal has also called for the date . The chipper will be taken around the town and the trees thrown right in it . Councilman Niklas asked if people have been notified that the tinsel and metal objects must be taken from the trees as it may harm the environment , and birds may become entangled in it ? The Town Clerk said she will call the radio stations and the papers to make those requests . Motion carried unanimously . Agenda Item No 18 - Public Hearing Date Rezoning Danby Road Mr . Walker said the Town Planning Board met and held a public hearing to receive public input on the rezoning of a parcel on Danby Road from Industrial to a Special Land Use District . R15 . The applicant has provided a drawing of the elevations and the site plan . The .Planning Board has made a recommendation that the rezoning of a portion of the parcel be made for the Ithacare development , and that the Town Board set a public hearing regarding the rezoning . The special land use district had some modifications at the Planning Board meeting that dealt with public space set aside and the sewer which had been stricken from the Special Land Use District as they will be dealt with during subdivision process . There are some very specific guidelines concerning the building height , because the building would be on a slope and would exceed the 30 foot general building height considerations . The legislative document has very specific language referring to one building and elevations . At this time there is enough information for the Town Board to set a public hearing . TB Minutes 12 / 30 / 93 Page 9 . Attorney Barney said there have been meetings with representatives of Ithacare about the Special Land Use District as proposed . and it has been agreed to by the Planning Board and Ithacare . Councilman Niklas asked if there was any wording in the document concerning the legacy of use , if Ithacare were to leave the site is there any specification that this rezoning is specifically designated for some kind of rehabilitation for elderly ? He was concerned about rezoning this specifically for Ithacare and in the future Ithacare having reason to leave and the Town would be left with a rezoned piece of property . Attorney Barney said this is rezoned specifically for programs such as Ithacare ' s . It is for assisted living accommodations . particularly the elderly . Councilman Niklas asked if " assisted " were defined further ? Attorney Barney responded , no . the Planning Board started to talk about that but Ithacare offers such a range of services from what is considered minimal assistance to almost nursing home care . Trying to define what assisted care meant would be a monumental task . Councilman Niklas stated if Ithacare left the site the nature of the entity could change . Attorney Barney said at that point if anyone came to take over the site they would still have to have an assisted living care facility , and more likely someone would come to the Town for a rezoning of a different or modified facility . Councilman Niklas said it is speculation that at that time they would be required to ask for a review in the zoning . Is there any phraseology that says " principally " or " exclusively " ? Attorney Barney said there is only one multiple family dwelling being permitted with between 40 and 160 units . That use is to provide assisted living accommodations . People that can occupy it would be either be those over the age of 54 requiring assisted living accommodations , and people under 55 years for aid to services . Mr . Macera . .Executive Director . Ithacare said the discussions underway with Ithaca College would result in the restrictions of the deed to many of the issues being raised by Councilman Niklas with regards to the inter - generational relationship that will exist with Ithaca College , such as senior housing , and support services . TB Minutes 12 / 30 / 93 Page 10 . Councilman Niklas asked if the Town Board would be privy to the deed ? Mr . Macera said there should not be difficulty sharing the deed with the Town once Ithacare and Ithaca College have consummated an agreement . Councilman Niklas asked if the deed would be signed after the rezoning ? Mr . Macera Said it would be difficult to say , until the deal is closed there is no necessary requirement that the deed be finished in any point and time leading up to the final consummation and financing package . Councilman Niklas said it may be interesting if the deed is after the fact of rezoning . Mr . Macera said there is no doubt the deed would be finalized after the rezoning . Councilman Niklas said that is interesting , but irrelevant because the rezoning is what is of concern to the Town . Mr . Macera understood and was only trying to inform the Board of additional information to suggest that some of the concerns the Board is raising to use , are also included in the deed . Mr . Walker stated because of the nature of the approvals needed in the sequence of events for Ithacare to move ahead at different stages they have come in with rezoning requests prior to any subdivision requests . One of the conditions that staff will be recommending to the Town Board is that rezoning first be conditioned on the final subdivision approval of the parcel , and any other conditions the Board is concerned with as far as restrictions can be added at that time . Councilman Niklas said for the record he does not oppose this , he is concerned with what happens after , if ever . Ithacare leaves the site . The Town for one reason or another over many years inherited these rezonings where the stated objective did not come to fruition , and the Town is left with a " ticking time bomb " . Councilman Niklas said he is content with what he has heard from the Town Attorney , Town Engineer , and the Town Planning Board that this will not be an example of that . TB Minutes 12 / 30 / 93 Page 11 . Councilman Whitcomb said this would not necessarily be the case with a Special Land Use district as it might be with an Industrial or Commercial Zone , then you may inherit a " ticking time bomb " . A Special Land Use District specify ' s the use , it could not be changed without rezoning . Councilwoman Valentino asked if the age use description is constitutional ? Attorney Barney said that was reviewed and it was concluded that the present state of the case law shows there is no problem . There is no guarantee as Judges change , philosophy changes . Presently the elderly zoning enforcement is being upheld in the courts . Councilman Klein said if this land is rezoned as a Special Land Use District and the project does not come to fruition is there a sunset clause: , that it would revert to its old use after a year ? The multiple residence zone on South Hill that is now College Circle is exactly what Councilman Niklas meant . It was rezoned twenty some years ago for multiple residence , it never happened . If the Town rezones this land and then it doesn ' t go through how will this end up . Attorney Barney said at the present it would stay that way until the Town Board chooses to rezone it . The Special Land Use District is part of the Comprehensive Plan . There is room for saying this type of use , in this type of area is an appropriate use . Attorney Barney said he has a conceptual problem in saying the Town is now rezoning to allow an Ithacare type activity because that is in accordance with the Comprehensive Plan , but if it doesn ' t go through the Comprehensive Plan says that it has to be rezoned back to what , an industrial zone . The Town doesn ' t go back to an industrial zone without a site plan , etc . Councilman Niklas mentioned in fairness , this is a policy decision the Board hCas to make . Councilman Niklas felt the Board ' s consensus was that a sunset provision should seriously be considered in general . Especially for a specific case , not when the Town takes the initiative , but where the Town is responding to a developer of a particular provider of services like Ithacare . Mr . Walker said he felt there was protection on this particular site as there are specifics as to the building , and use . If Ithacare did not work out and someone else came in five years and said they wanted the same type of facility but they didn ' t like the building , they would have to come back to the Town Board . TB Minutes 12 / 30 / 93 Page 12 . Attorney Bai- ney asked if in this situation when you are rezoning from industrial to a very precisely defined zone , do you want an automatic reversion to a light industrial zone if the project doesn ' t go through ? Councilman Klein said the site in the Comprehensive Plan was left partially as industrial , partly as higher density residential . It seems that conversion should be consistent with the Comprehensive Plan . Supervisor Raffensperger said the Planning Department could be asked to make a report on that to the Board at the public hearing . Supervisor Raffensperger recalled the Board has talked in the past about the need to have a sunset clause for rezonings . If you are going to rezone and it is not being done " plan specific " , that ' s fine . If you can say that area ought to be commercial whatever commercial is there , that is legitimate . But if the Board and the public are influenced by a site specific plan it is legitimate to have a reversion if the plan doesn ' t come to fruition . Councilman Niklas agreed , and said if that is the feeling of the Town Board that the Town Attorney should be encouraged to build that into this situation even though there are so many safeguards . The Town needs a consistent policy . Supervisor Raffensperger said the question is whether it is appropriate for Special Land Use Districts . You can say it is appropriate for other rezonings and should always be done . A Special Land Use District is a different item . Attorney Barney said the thing that worries him with an automatic reversion is the environmental review has been done for this particular project . A reversion to anything other than industrial may cause a problem with the environmental review . Councilman Klein said the Town will be working on the Zoning Ordinance in the next few years and changing land uses in hopes of creating institutional zones , it would seem that this would be an institutional zone . How the various SLUD ' s hold themselves to the new Zoning Ordinance with so many land uses , or planned developments will have to be determined . The Town m-ay move away from SLUD ' s . The SLUD ' s came about because Zoning Ordinances have no provisions for this type of development , so the Town created it . The new Zoning Ordinance may incorporate it in a more specific manner . The reversion would now have to be industrial so if Ithacare did not move forward it would revert to industrial because it could not go to R - 30 without environmental review . As the Town changes the zoning there may be a different way that will operate . TB Minutes 12 / 30 / 93 Page 13 . Councilman Liguori said he felt the Board was trying to build a case for a specific kind of thing . whether Ithacare may somehow default . The likelihood of it failing after substantial investments are made is very remote . In which case reversion would take away from Ithacare an investment that is valuable to them . Councilman Liguori said he liked what Attorney Barney said . you are not rezoning for Ithacare but for a concept of a facility of what Ithacare is proposing . Councilman 'Whitcomb said it is also use specific and design specific . It is not like a general change from residential to multiple residence where someone could build any design and twenty years from now do what they want . Sunset clauses should be considered in the future . Attorney Barney said there has been a provision which has not normally been put in , that any significant revision to the site plan must come back to the Town Board . Normally once this Board approves something on a preliminary basis the Planning Board has the authority from that point on for approval . In this instance because it is a large building and a different concept , staff felt this was necessary . A time frame could be incorporated in the approval that the Town Board would automatically review the status of the project to determine if the zone is still an appropriate zone after a year or so . Mr . Macera said he did not feel that would be a problem . However , it may be a double edged sword because the requirement for financing will necessitate that Ithacare show evidence of site control . If the issue of zoning indicates there is a restriction based on a time frame it will show that Ithacare has to move faster rather than slower . As long as a time frame would not interfere with Ithacare ' s plans , and if there were a problem with completion it could be extended there should be no problem . Supervisor Raffensperger said then the understanding is that there will be a second resolution at the time of the public hearing that a time frame be allotted for the Town Board to make sure the Ithacare project progresses as planned . — Motion made by Councilman Whitcomb , seconded by Councilwoman Valentino authorizing the Town Clerk to advertise for a Public Hearing to be held on January 13 , 1994 to consider the rezoning request from Industrial District to Special Land Use District to allow construction of an adult independent living care facility . Walker explained a certificate of substantial completion has been prepared as the work is almost done with only a few minor items to be completed . A retainage will be held until final completion . Because of moving the location of the water main the water service connections were longer than originally planned which resulted in an increase to the Town of $ 10 , 846 . There was a relocation of the water main to avoid future DOT work at Shady Corners creating additional costs to the contractor of $ 2848 . Mr . Walker recommended this additional amount be allowed and paid to the contractor . There was approximately $ 1000 in additional demobilization and mobilization costs because of a problem with approvals at the City end of the line along Route 13 . The City will be charged for these expenses because of their lack of work . The total fo :r the change order is $ 14 , 714 . 06 . Brian Barry has been with the Highway Department for ten years and has met the stipulations set for him . Mr . Noteboom recommended Mr . Barry be promoted to Motor Equipment Operator . Motion made by Councilman Niklas , seconded by Councilwoman Valentino appointing Brian Barry as Motor Equipment Operator effective January 10 , 1994 with an increase in salary from $ 9 . 15 to $ 9 . 65 per hour . Additional 1 - Ratification of Acceptance Resignation Town Planner Supervisor Raffensperger said this was discussed at the last meeting , but there was no resolution of the Town Board ratifying the acceptance of the resignation . Motion made by Supervisor Raffensperger , seconded by Councilman Niklas to hereby ratify the acceptance of the resignation of Floyd Forman as Town Planner , and ratify the memo relating to that resignation . Carried unanimously . Agenda Item No . Additional 2 - Emergency Preparedness Plan Mr . Noteboom explained two days ago the County called a meeting of all the Highway Superintendents . They had met with the NYS Emergency Management representatives and there was concern raised that a number of towns did not have this plan in place . The plan has to be in place by December 31 , 1993 or the Town would no longer be eligible for funding in the future for State emergency / disaster funds . The NYS Emergency Management Office was not happy with the way the legislation was written . They provided the Town with a generic plan which will comply with the law . The Hazardous Materials plan that Mr . Frost worked so hard on is actually a component part of this plan , a4; well as snow removal , flooding , etc . The Town will have to move along on this plan to make it more specific to the Town . Mr . Noteboom recommended the adoption of this plan to meet the State requirements and meet the deadline . Mr . Frost talked with the NYS Disaster Commission and they have the Town recorded as having the Hazardous Materials Plan and starting this plan . BASIS Disaster planning is based on the New York State Defense Emergency Act: , the regulations and orders of the State Defense Council and the State Civil Defense Ccumission ; the Emergency Plan for the Natural Disaster of the State of New York ; and the National Plan for Natural Disaster. Emergency preparedness allows the Town or village) of _ Ithaca to prepare and react to emergency situations to save e an property if the jown ( town or village) is threatened or hit by a disaster and major emergency . The Town ( town or village) Board shall have the primary responsibi ity to see that everything possible is done to prepare for any disaster and to provide for the safety and security of the camunity during a disaster . MDBILIZATIM Designate Emergency erations Center ( E . O . C . ) - The Emergency Operation.. Center forte town or village will be in theiiighwaX Garage , 106 5even Mile Drive , Ithaca (name , place & location) . Once the supervisor mayor or next in lined declared an emergency exists , the Emergency Operations Center will be staffed on a twenty- four hour basis until the declared emergency subsides . The Emergency Operations Center will forward all warnings , directives , information , etc . , to various local departments as appropriate . This will be done through the use of department representatives , telephones ( located in the Emergency Operations Canter) , radios in the Police , Fire , Highway and Civil Defense Departments and in the offices of cooperating agencies . Each member assigned to the Emergency Operations Center will be familiar with this plan , particularly with the section pertaining to each responsible person ' s service duties . r Essential Emergency Operations Records - The Town Supervisor town or village supervisor or mayor) , and the Town Clerk ( town or village clerk) , functioning at the Emergency Operations Ceiter , are responsible for the maintenance and availability of records , documents , plans and other materials required to discharge their and others ' functions during an emergency . To cope with the effects of an emergency , appropriate steps will be Laken at the Emergency Operations Center to mobilize fully the available personnel , resources , facilities , supplies and materials in the Town ( town or village) of Ithaca according to the guidelines set forth in this plan . Each department head in the Town ( town or village) _ of Ithaca is responsible or assuring maxima e rectiveness an uti ization of all personnel and equipment of the d artment to accomplish the ( town ' s or village 's responsibilities . Each department head >.j.TY retain control of the assigned department and implement orders received from the Emergency Operations Center . 3 . The Town ( town or village ) of Ithaca should seek the cooperation and aid of any or all surrounding cccran.nities in the event of an emergency or disaster . Arrangements for mutual aid should be made prior to any emergency or disaster . 4 . The Town ( town or village) of Ithaca show ld contact the County Civil Defense Office regarding any major emergency or disaster situation . Civil Defense assistance should be requested when local or mutual aid resources are exhausted . All requests for County Civil Defense assistance of any nature by any Department will be approved by the Town Supervisor (mAyur , supervisor or other designated personTand will be made to the County Director of Civil Defense by direct phone contact or by the Civil Defense radio network . 5 . riilitary Assistance requests will be made by the supervisor (mayor or supervisor) of the Town of Ithaca town or viiilage) to the Tompkins name County E xecutive who will forward e request to the Tompkins (mine) County Civil Defense Office to the State Natiirai Disaster Ccmuission . 61 The American Red Cross is recognized as the agency responsible for mass care to persons iTediately following a disaster . local Red Cross chapters can extend natural disaster relief assistance to individuals and families and the Red Cross can assume administrative and financial responsibility in providing such assistance . American National Red Cross has been assigned this responsibility by the Congress of the United States . The Red Cross chapter responsible for the Town ( town or grillage) of Ithaca is American Red Cross of Tompkins County , 201 W . RFSPONSIBILITITS & FUNCTIONS The responsibili ties and functions listed below recognize only basic duties . The supervisor (mayor or supervisor) of the Town town or village) of Ithaca as responsi le or the conduct of disaster operations urithin the Town ( town or village) of Ithaca The Su ervisor (mayor or supervisor) of the Town town or village) of Ithaca shall use any and all aci ities , equi�1t , supplies , personnel , and other resources of the Town ( town or village ) of Ithaca in suc a runner as may be necessary or appropriate to cope with the disaster . The Su ervisor (mayor or supervisor ) shall direct the activities o a agencies within the Town ( town or village) of Ithaca against the ects of emergency in conformance With the approved plans for the rescue and relief of the people , the recovery and the rehabilitation of the com mity of the Town ( town or village ) . The Su ervisor mayor or supervisor) will utilize services o the Emergency Operations Center and its staff for implementation of necessary measures to achieve emergency operations . 2 . The Town ( town or village) Board as the elected body of t e peop e , s ll take all appropriate steps to prepare for any disaster or Emergency and shall generally be respo:� ible for the implementation of this and other Emergency preparedness plans . 3 Town ( town or village) Clerk is responsible for the maintenance an availability of essential records , documents and other materials , required during the Emergency . 4 . The Emergancy Coordinator appointed by the mayor or supen71sor directs the implementation *of the comprehensive plan for th.e Emergency Operations Center , under the direction of the Town Su ervisor ( town or village , supervisor or mayor ) . so , under the T rection of the Town Supervisor ( town or village , supervisor or mayor) the Emergency Coorlinawr coordinates the Emergency operations of the Emergency Operations Center , prepares estimates of the situation , advises the Supervisor (mayor or supervisor) of operational priorities an recommends requests for assistance from Tompkins (nine) County Civil Defense . S . The Fire Chief and Fire Officers will be responsible for the direction o a action to contain and extinguish fires resulting f-ram emergencies and the rEroval of trapped and injured persons fran damaged buildings and flooded areas . The local Fire Chief may call upon the Tom kins (name) the County Fire Coordinator or the CInnty Civil Defense , under mutual aid , for advice and/ or assistance concerning fire related emergencies , relief operations , and coordination of emergency shelter and feeding operations . 6 . The Local Police may designate a Traffic Control Officer to be part of the Emergency Operations Center for the purpose of controlling traffic and population movements . The local police will direct all action to maintain order , prevent looting , and help alleviate panic ; direct injured to medical installations , and assist handicapped persons by obtaining transportation and directing them to the nearest Emergency Operating Center . The Police Chief may call upon the Tompkins (name) County Sheriff ' s Department and / or New York State Police for advice and/ or assistance . 7 . The Local Su erintendent / Director of } li hways i h s responsible for the maintenance o streets and bridges and all official trucks , cars and equipment . The superintendent will direct action to check , restore and maintain essential public facilities and services , such as streets , bridges , public buildings and other vital commmity services , calling upon all Public Works and Engineering _ Services of Tompkins (name) County for such assistance . The Highway Director will work in conjunction with the New York State Electric & Gas Corporation , the New York Telephone Company , the local water and sewer board and any other local utility in the restoration of the various essential services . 81 'Che Building Inspector of the lown _( town or `n1��—will responsible ors ety inspection of damaged domes and businesses before evacuees are allowed to reocct p such buildings . 9 . The Public Information Officer under the direction of the _ supervisor _(mzmayor or supervisor) of the _ Town or village) of Ithaca directs rEie local dissemination of emergency information , the issuance of news reports to the public and notifies the County Civil Defense office on the status and development of Emergency measures , using all media of public cour=icati.on . 10 . The CammzIIications Officer or Staff supervises , directs , arranges an restores carQnmications or al emergency purposes using available canrnrLication means and methods . The Medical Officer or Staff directs all action to render health and medical services to the ccan-unity . The officer or staff should alert hospitals and ambulances in the area regarding anticipated medical needs . 12 . The Supply Officer (Resources & Production). . carries out measures necessary to the Emergency handling of all local rescrirces . 13 . The Manpower Officer directs the assignment of persormel to the pious emergency services as requested . 14 . The Transportation Officer carries out measures necessary to the ut-_i ' nation o '= transportation modes for support and rescue operations . 15 .
