Town Board Minutes
September 13 , 1993
At the regular meeting of the Town Board of the Town of
Ithaca , Tompkins County , New York , held at the Town Hall , 126 East
Seneca Street , Ithaca , New York there were present :

Agenda Item No . 3 - Report of Town Officials
a . Supervisor ' s Report - The 1993 budget process is well underway .
Department requests have been filed ; it appears areas of most
concern as to increases are in state retirement payments and the
cost of health insurance . In some areas , worker ' s compensation
charges have increased substantially . The tentative budget will be
presented to the Town Board on October 4 , with the budget public
hearing to be set for November 4 .
The Bolton Point Commission approved

The Supervisor attended , September 13 , a meeting of elected
officials from the City and various Towns concerning a proposal to
develop a watershed management plan for Six Mile Creek and to apply
for a grant to implement such a plan . The group sponsoring this
initiative is the County Water Quality Steering Committee . The
group explored various funding systems to initiate the program , no
commitments were made .
b . Engineer ' s Report - Mr . Walker reviewed his written report with
the Board , ( see attached ) . The Engineering Department received an
emergency request from the daughter of Mrs . McFord on Pitman Lane
for sewer service to Mrs . McFord ' s residence . The residence is on
a very steep rocky bank . Water service was provided there several
years ago . Mrs . McFord has a septic tank built under the house and
it has been failing . The Health Department has been involved with
the issue . Mr . Walker is working with the City to bring a sewer
lateral to the property . The costs would be provided by the
landowner , the Engineering Department would only provide technical
assistance .
Councilman Whitcomb asked if the problem with Deer Run is related
to the problem as discussed earlier about Mrs . Wilson ?
Mr . Walker explained that the problem Mrs . Wilson has is due to
excess run off flowing from the drainage ditch . The run off was
higher than designed because of the final pavement being placed on
White Tail Drive allowing water to bypass the catch basins . The
developer intends to complete the paving on that portion of the
road this fall .
Councilwoman Valentino asked when the transportation meetings were
that Mr . Walker referred to in his report ?
Mr . Forman said he would forward a copy of the meeting schedule to
the Board .
c . Highway Superintendent ' s Report - There has been communication
between the developer ' s of Briarwood and Deer Run to inform them of
what has to be done . Forest Home Drive drainage has been
completed , the retention wall will be completed this week , and the
bridge walkway will be opened this week . Councilman Liguori asked
if the bolts on the bridge have been tightened ? Mr . Noteboom
assured him they had . ( See attached report ) .
d . Building Inspector / Zoning Officer ' s Report - ( See attached
report ) . Activity at It }iaca College and Cornell University has
contributed significantly to the value of construction for 1993 .

The Safety Committee prepared a hazardous materials plan by order
Of the New York State Department of Labor . The plan is a copy of
the plan from the City of Corning . The Town is hoping to pass a
very similar plan .

Agenda Item No . 4 - Retort of Town Committees
Councilman Whitcomb said that lie , Councilman Liguori , and Mr .
Walker expect to meet with representatives from Forest Home later
this month .
Councilwoman Valentino said most people should have received their
recreation surveys and returned them . At the next meeting , they
will be looking at how other municipalities through inter - municipal
cooperation developed a system for funding . This will be the most
interesting , but most difficult of the tasks to be completed .
Councilwoman Valentino has received many calls about the FCC rules
concerning the cable franchise and the new rates . People have been
asking if there is a freeze on rates . American Community
Cablevision is complying with the law at present . The rate freeze
is not simple . It is a sliding scale used for the number of
programs , how many are satellite , etcetera , which set the amount
charged . In that framework if they are charging under the old
rate , under the present regulations they are allowed to increase it
some . ACC has also been given approval of not having to notify the
municipalities because FCC ruled some of the changes have a large
impact on the Cable Commission .
Councilwoman Leary had understood it was not just a freeze , but a
roll back of prices .
Councilwoman Valentino said that it could be depending on how the
formula works . The guidelines and rules have not been received .
Every cable company and municipality is stalled until the FCC
guidelines are received . It is hoped that more help from the State
Cable Commission will be received .
Agenda Item No . 6 - Persons To Be heard
Jim Skaley , 124 Sapsucker Woods Road said he wrote a letter to the
Supervisor concerning issues of zoning enforcement on his street .
Mr . Skaley asked the Board to reconsider their law regarding owner
occupancy on the street . The law has effected the value of the

properties as there have been several properties put on the market
as a result of not complying with the law . This has lowered the
actual market value . The banks , when refinancing look at the
lowest market value which has an impact on the property owners .
There are multiple residential zones nearby . The properties on the
street really qualify as multiple residence opposed to the criteria
that is listed in the special land use zone . Mr . Skaley asked for
a rezoning or whatever it would take to change this particular
zoning requirement .
Councilman Whitcomb asked how many of the properties are on the
market for sale , and if so how many have sold ?
Mr . Skaley responded that there are at least two presently , there
have been others up for sale continuously over the last three
years . One or two have been sold over the last few years , one or
two have been reacquired by Mr . Lucente and then resold at a lower
price than paid .
Supervisor Raffensperger noted that another resident from 226
Sapsucker Woods Road has submitted a resolution . The Supervisor
asked the Town Clerk to enter into the record this resolution
voicing the same concerns as Mr . Skaley .
The Supervisor pointed out that in Mr . Skaley ' s presentation and
the resolution it was mentioned that the area is zoned a Special
Land Use Zone , it is the Supervisor ' s understanding that the area
has always been an R - 15 zone . Many years ago the Town brought a
lawsuit against Mr . Lucente at the time the homes were first built
and felt they did not meet the requirements of the Zoning
Ordinance . Mr . Lucente won the lawsuit because the Zoning Law is
to be construed strictly against the municipality . At the time the
owner occupancy requirement was imposed Mr . Lucente addressed the
Board and asked to have changes in the building . The Town in order
to protect the residential character of the area responded by
permitting those changes to four - complexes , but also required owner
occupancy for a way of guaranteeing the maintenance on the
buildings . '
Attorney Barney said the case originated when Mr . Lucente started
building those , the ordinance defined family as " not more than
seven unrelated people " . Mr . Lucente started construction and it
was discovered by the Zoning Officer he was building seven bedroom
apartments with the intention of renting them out . The Town Board
changed the Zoning Ordinance to reduce the number of unrelated

people who qualified as a family to three . The court held that Mr .
Lucente had acquired enough of a vested interest in his investment
for the change . There have been a number of problems over the
years , such as garbage . The ownership requirement was a subtle
clear way of encouraging people to live there so there would be an
interest in how they were maintained .
The Supervisor pointed out the ordinance also states that if the
owner does not want to abide by the owner occupancy regulation . the
building can be used as a two family .
Mr . Frost said the zoning map which has been changed recently does
show the zone as a special land use zone , the ordinance that made
that happen shows it should be zoned R - 15 . There is an error in
the map .
Mr . Skaley said the question is the reality today , as opposed to
what was happening in 1968 .
Supervisor Raffensperger mentioned the Town Board has discussed the
difficulties in enforcing the owner occupancy restrictions and the
Board appreciates the materials and the point of view presented ,
and will consider them .
Councilman Klein was a member of the Planning Board when the owner
occupancy requirement was instituted . Then the Planning Board felt
they were making an improvement to the situation . Maybe since it
has been several and there have been problems with the sale of
these properties it would be appropriate to refer the matter to the
Planning Board for their consideration .
Attorney Barney felt the decision to refer the consideration to the
Planning Board should be made after an Executive Session because
there are issues subject to litigation arising from the problems .
The Board may wish to explore all the ramifications before transfer
to the Planning Board ,
Mr . Desch addressed the Board and stated the South Hill Trail looks
great . He! congratulated and thanked the Board .

Motion made by Councilwoman Valentino , seconded by Councilman
Liguori approving and adopting the Town Board minutes for August 9 ,
1993 as written as the official minutes of said meeting . Carried
unanimously .

Agenda Item No . 8 - Financial Reports July / August 1993
Ms . Alari. o reported in July there were large anticipated
expenditures having an effect on cash flow . It did not mean a cash
flow problem , this is the time of year when large expenditures are
made . Balance sheet reports have been added for the Lighting
Districts and the Fire Protection Districts so the Board can see
the cash flow in those smaller funds .
The August report shows that in addition to the sales tax revenue
the Town received the Cable franchise money , and an unanticipated
worker ' s compensation refund of over $ 9000 .
Councilman. Whitcomb asked if the worker ' s compensation refund was
based on the Town ' s experience or the overall experience of the
fund ?
Mrs . Punger responded that it is based on the entire group in the
state insurance fund .
Motion made by Councilman Klein , and seconded by Councilman Liguori
approving and adopting the Financial report for the month of July
1993 . Carried unanimously .
Motion made by Supervisor Raffensperger , seconded by Councilman
Whitcomb approving and adopting the Financial report for the month
of August 1993 . Carried unanimously .
Agenda Item No . 9 - Town of Ithaca Warrants
Ms . Alario asked the Board to approve the late submission of
payment of $ 425 to Northeast Appraisal Services for the appraisal
of the QuiCk property .
Motion made by Councilman Whitcomb auditing and approving the
payment of the Town of Ithaca Warrants , with the addition of
payment to Northeast Appraisal Services of $ 425 . 00 . Seconded by
Councilman Klein . Carried unanimously .
Agenda Item No . 10 - Bolton Point Warrants
Motion made by Supervisor Raffensperger auditing and approving the
payment of the Bolton Point Warrants as presented . Seconded by
Councilman Liguori . Carried unanimously .

Agenda Item Additional # 1 - Bolton Point Budget Transfers
Motion made by Supervisor Raffensperger , seconded by Councilman
Whitcomb approving the Bolton Point budget transfer of $ 10 , 500 to
cover the revetment proiect at the Raw Water Plant . Carried
unanimously .
The transfer is for the repair of the flood damage that took place
in the spring at the plant .
Agenda Item No . 11 - 1993 Bud et Amendments
Ms . Alario stated the budget amendment was to account for revenues
received for Records Management not expected in 1993 , and an
increase of the expenditures for materials and shelving for the
vault .
Motion made by Councilwoman Valentino , seconded by Councilman Klein
approving the budget amendment for Records Management to increase
A3060 SARA Grant $ 11189 ; increase A7510 . 200 Equipment $ 200 ;
increase A7510 . 400 Contractual $ 1 , 939 ; and decrease A7510 . 100
Personal Services $ 1000 . Carried unanimously .
The Highway Department has had more vehicle maintenance than was
anticipated in the original budget . The Department does not expect
to be spending as much on road repair as budgeted , and would like
to transfer monies to increase the vehicle maintenance portion of
the budget
Motion made by Councilman Klein , seconded by Councilman Liguori
approving the Highway Budget amendment of an increase to DB5130 . 460
Vehicle Maintenance of $ 10 , 000 , increase DB5130 . 461 Tools , Parts ,
and Supplies of $ 1 , 000 ; and a decrease in DB5112 . 453 Permanent
Improvements of $ 11 , 000 . Carried unanimously .
The GEIS Study had revenues that were not budgeted for and have
been received . The amendment accounts for those revenues and
increases the appropriation account by the same amount .
Motion made by Supervisor Raffensperger approving the budget
amendment for the GEIS study by an increase in revenue B2771 GEIS
Study by $ 30 , 000 ; increase in appropriation B8020 . 420 GEIS Study by
$ 300000 . Seconded by Councilman Klein , carried unanimously .

Agenda Item No . 12 - Records Management Disposition Listing
The Records Management Officer stated the cellar in the Town Hall
has been sorted to dispose of those records found last year which
would be ready for disposition in 1993 . Now there is storage only
in the front and back room of the cellar . The Town Justice ' s
records are in the front and marked appropriately . The attic will
be done within the next couple of months . Other departments are
cooperating and submitting records for disposition . The vault
should be started next month . The steel shelving will be ordered ,
a fire proof door will be added , the room will be painted . The
inner vault will hold all the vital and permanent documents .
Mrs . Noteboom also reported that since June between 50 to 60
original deeds , easements , and contracts have been found which
previously could not be located .
Motion made by Councilman Liguori , seconded by Councilwoman
Valentino authorizing and approving the disposition of the records
as presented to the Town Board . Carried unanimously .
Agenda It .° m No . 13 - Public Hearing Date Local Law Records
Management
Mrs . Noteboom explained she has written a Local Law establishing
Policies and procedures for Records Management in the Town .
Attorney Barney has reviewed it and approved it .
It is recommended by SARA that the Town adopt either an ordinance
or local law establishing the Records Management program , from that
would be developed a Policies and Procedures Manual ,
The Local Law before the Board would set up and explain the
program . Next month the Records Management Procedures and Policies
Manual will be presented for approval . It would be used by all
departments and specifically outlines how the records are to be
kept by using a color coded system .
Mrs . Noteboom presented a letter from the State Education
Department requesting the Town send a copy of the Local Law and the
Procedures and Policies Manual to them . They have heard about the
Town ' s program and think it is excellent . The State wishes to use
our material for training in records management seminars .
Motion made by Councilwoman Valentino , seconded by Councilman
Whitcomb authorizing the Town Clerk to advertise for a Public
I-Iearing to be held at 7 : 00 p . m . , October 4 , 1993 to consider a " A
LOCAL LAW ESTABLISIIING POLICIES AND PROCEDURES FOR RECORDS
MANAGEMENT WITHIN THE TOWN OF ITIIACA " .

Members of the Board congratulated Mrs . Noteboom on the request for
our local law and manual by the State Education Department .
Agenda Item No . 14 - Capital Reserve Fund / Capital Improvements
The Supervisor explained that Attorney Barney has provided
information on a system the Town could use to set up a Capital
Reserve Fund . The Town has been notified by the Town auditors that
the Town should accrue a quarter of revenues for sales tax that
will be received in February 1994 , but the funds are collected in
1993 . The° Town will have an additional quarter of sales tax
revenue coming received above what was anticipated in 1993 . This
is a one time occurrence . The Supervisor recommends the monies be
put in a Capital Reserve Fund . If the monies were used in one year
it would cause inequities in the tax rate for that year . The Town
will also receive this year funds from the additional 1 % sales tax
sharing from Tompkins County . The Town should not use funds for
regular budget purposes that are only received for a short period
of time , or if it is not known if they will continue .
Councilman Liguori asked if the funds use would be limited to
Capital Projects ?
Supervisor Raffensperger said that yes , it would be a Capital
Reserve Fund to finance the acquisition or construction of Town
buildings .
Attorney Barney explained the law states the fund should be set up
for a specified type of purpose . If the Town had in mind a
particular idea for a new town hall , a Capital Reserve Fund could
be set up to acquire it which in itself would be subject to a
permissive referendum . When it was purchased it would not be
necessary to have a permissive referendum , or it can be set up for
a type of capital project to acquire a building or construct . The
resolution before the Board is not subject to permissive
referendum , but when the funds were expended out of the fund the
resolution authorizing the expenditure would be subject to
permissive referendum . To have a Capital Reserve Fund just for
capital purposes is to broad .
The Supervisor explained this would not commit the Town Board to
putting any funds into it . The accrual of the fifth quarter funds
will net the Town approximately $ 350 , 000 . Sales tax revenues are
never known . In addition , the 1 % will bring into the Town
approximately $ 50 , 000 a quarter , or approximately $ 200 , 000 a year .
That is a limited source of revenue for two years . These are the
best estimates which can be projected . Knowing that these funds

were self limiting amounts of money , it seems wise to set up the
Capital Reserve Funds so that future Town Board ' s could decide
whether or not they wished to put the funds into it .
Councilman Klein asked if the funds could be used for any item such
as architectural and attorney expenses for a capital project ?
Attorney Barney said the funds could be used for " soft " costs such
as he mentioned . The expenditures are subject to a permissive
referendum if it is an expenditure that was a direct expenditure by
the Town . That generally means something financed for more than
five years .
Councilwoman Valentino felt it was a very sound idea . It cleans up
the budget process .
Councilman Liguori asked if there were a difference between a
Capital Reserve Fund and a Capital Improvement Fund ? The law
allows for something other than a Capital Reserve Fund which may be
more flexible .
The Supervisor said a fund could be set up for machinery purchases
and if there is any money left over at the end of the year it would
go into that . There once was a Capital Reserve Fund for parks
which funded the initial park development in the Town .
Councilman Whitcomb said the Capital Reserve Fund is where the
money is kept for the Capital Improvement Fund or Project .
Councilman Whitcomb asked if there were an emergency , and funds
were needed for current expenditures could the Town by resolution
redesignate the monies in the Capital Reserve Fund .
Attorney Barney understands this would be a Capital Reserve Fund
which could not be tapped by transfer .
Supervisor Raffensperger mentioned the Town wisely did this with
the Federal Revenue Sharing . Many municipalities put those funds
in the General Fund and counted on it . When those funds were
withdrawn there were problems in the other municipalities . The
Town of Ithaca used it for Capital Improvements , when the funds
were withdrawn by the Federal government the Town had to stop many
capital improvement projects but did not find themselves short in
day to day funds .
Attorney Barney said that once the fund is set up the Town would be
limited to using it for a Capital Improvement it can not be used
for other purposes .

Supervisor Raffensperger said this would be the gradual
accumulation of funds .
Attorney Barney said there is a provision in the law that says when
the capital expenditures for the purpose it was intended has a
surplus remaining , that remaining amount can be transferred to a
Capital Reserve Fund as long as it is the same tax base .
Supervisor Raffensperger said the funds being discussed are
primarily sales tax revenues which are required to be used in the
part - town portion of the budget until the part - town portion of the
tax is brought down to ( - 0 - ) zero , which the Town has done since
the Town took the sales tax revenues directly . Once that is done
the monies can be used in the townwide portion of the budget .
Motion made by Councilman Klein , seconded by Councilwoman Valentino
directing the Supervisor to establish a Capital Reserve Fund to
finance the cost of acquisition or construction of town buildings ,
including a new Town Hall as per the attached prepared resolution .
Carried unanimously .
Agenda Item No . 33 1. 994 SPCA Contract
Pam Stonebraker of the Tompkins County Society for the Prevention
of Cruelty to Animals addressed the Board . Ms . Stonebraker said
that the number of dogs impounded for the Town of Ithaca was down
in 1992 , and is currently down for 1993 . However , this is a
temporary condition . There is a migration of rabies that has an
effect on dog control . As people become more aware of rabies they
become more responsible with their animals . When people become
used to the rabies they tend to become less responsible .
Ms . Stonebraker presented graphs of the trips to the Town , and the
number of dogs impounded to the Board . The SPCA expects the number
of trips to the Town for dog control to equal the amount in 1992 .
Dogs impounded for the year are also expected to remain about the
same as 1992 .
The SPCA is requesting $ 15 , 939 for 1994 representing a 3 . 5 % amount
over 1993 . The increase is needed to pay for the Town of Ithaca ' s
share of increasing expenses . The SPCA is presently showing a
deficit balance and is expecting a deficit next year . A review of
expenses from 1991 to 1992 showed they had increased by 6 % .
Supervisor Raffensperger felt the request for the increase of 3 . 5 %
over last year ' s amount to the SPCA seems to be a very modest one .
The Supervisor asked his . Stonebraker if the SPCA is running at a
deficit all the time , how do they make it up ?

Ms . Stonebraker said through depleting savings funds , endowments ,
and benefit fund raising . The monies raised through fund raising
pays for human services .
Ms . Stonebraker said in one municipality the question has been
asked what happens to people who are issued appearance tickets for
not licensing their dogs , and they do not show up for court . This
municipality requested the SPCA arrest the person who did not
appear . Research has shown that the animal control officers are
unable to arrest an individual . This did bring up a point in the
contract , there is wording that states the SPCA would cease and
impound all unlicensed dogs whether on or off the owners premises .
The services provided for years have not included the service of
going onto private property and taking the dog . The SPCA would
like to change the wording in the contract to state what services
are actually provided . The contract should reflect the SPCA ceases
dogs that are lost , abandoned , or homeless as described in the
Agricultural and Markets Law . The SPCA would be happy to accompany
an officer who was serving a search and seizure warrant to get the
dog if it were the court ' s desire , but the SPCA would not be
actually executing the warrant .
The SPCA ' s Attorney will write the new contract for the Town
Board ' s and the Town Attorney ' s review .
Councilwoman Valentino asked how many municipalities currently
contract with the SPCA ?
Ms . Stonebraker responded six , they are the City of Ithaca ; Town of
Groton ; Town of Ulysses ; Town of Lansing ; Town of Caroline ; and the
Town of Ithaca .
Agenda Item No . 5 - Re ort of Tom kins County Board of
Representatives
Beverly Livesay told the Board the Forest home Bridge Sidewalk will
be completed in about a week . The designs for the development of
the Forest Home Bridge are being done so that it can be completed
next summer . The question is whether it will be able to funded in
the budget
Supervisor Raffensperger asked flow the Town can find out the
anticipated year of construction as the Town of Ithaca may have a
substantial responsibility for a portion of the deck and
approaches '?
Ms . Livesay said the design is set

constraints are so serious as to not allow the construction .

As a result of the change in the Federal law for cable television
regulations the County Board is exploring reactivating the County
Cable Commission , The County will be calling any individuals
interested in being involved . Ms . Livesay is the contact person
for this on the County Board ,
Supervisor Raffensperger said the Town is referring all questions
concerning the solid waste issue to the County . Many calls are
detailed about the formula used to determine the fee . The Town
staff is not informed enough to interpret the County legislation .
Ms . Livesay stated the formula is not in the legislation . the
legislation provides that such a formula will be established . This
was done to be able to change the formula when needed . The County
is presently looking at which of the fees should be continued .
There has been a proposal to cut the annual fee in half and put the
other half on the property tax representing a 6 . 5 % increase in the
County tax .
Supervisor Raffensperger asked if that would mean the tax exempt
properties would pay less ?
Ms . Livesay said that they would not pay at all unless they paid an
in lieu of tax , and that is problematic . Ithaca College has the
attitude of not paying anything . and Cornell University does make
some exceptions by pilot contributions . Cornell also is saying
they wish to be treated the same as Ithaca College .
Councilwoman Valentino asked if Ithaca College and Cornell
University are currently in the formula that is being used for the
fee ?
Ms . Livesay said that they were . There are so many issues of
trying to be fair to everyone . There does riot seem to be a happy
way to deal. with all these issues . The tipping fee will have to be
set in October . The recommendation from the Solid Waste Committee
is to go to $ 100 . 00 per ton through 1995 .
Agenda Item No . 15 - Famil and Medical Leave Act
Mrs . Punger told the Board the Family and Medical Leave Act became
effective August 5 , 1993 , The Personnel Committee would like to
add the basic benefits to the Personnel Manual . This would outline
who was eligible with specific details coming from the Personnel
Office . The Personnel Committee would like to recommend that
medical certification with 30 days advance notice when possible be
made a part of the policy this area is at the discretion of the
employer .

Agenda Item No . 16 - Salary Ranges for 1994
Mrs . Punger reported the Personnel Committee reviewed the proposed
salary ranges for 1994 . There are two ranges they recommend
changing because they reviewed the requirements of the duties of
the position and set a salary limit to meet the requirements .
The Deputy Town Clerk position is one where this individual is the
first contact point with the public by telephone or in person .
There are above the ordinary requirements for starting this type of
position . The individual needs more experience than just a basic
receptionist .
The Parks and Open Space Assistant was thought at first to be a
laborers position , but the person needs to be knowledgeable about
plants , and the person works without supervision to accomplish
certain tasks .
Supervisor Raffensperger said this is not supporting any changes in
any individual salary , this is just changing the ranges .
Motion made by Councilman Whitcomb , seconded by Councilman Liguori
approving the recommended salary ranges for the year 1994 including
the change for the Deputy Town Clerk position and the Parks and
Open Space Assistant position . Carried unanimously .
Agenda Item No . 20 - Public Hearing , " LOCAL LAW AMENDING THE TOWN

The Supervisor opened the public hearing at 7 : 00 p . m . , the Town
Clerk had proof of posting and publication . The Supervisor asked
if any member of the public wished to speak concerning this issue .
Supervisor Raffensperger explained the Town Board has considered
this issue several times and a minor change was made at the last
meeting necessitating the public hearing .

Mr . Forman said the Town Board at last month ' s meeting felt the
area should be zoned Light Industrial , the other alternative was to
have it zoned residential . The reason the issue is being discussed
again is the wetland area at the front of the property . The Town
Board wanted to insure that before a site plan was brought before
the Planning Board no portion of the wetland would be filled . The
Town Attorney has made revisions to the Local Law providing that
stipulation .
Mr . Albern asked if the change meant that the wetland could be
filled if site plan approval was given ?
Attorney Barney said that was true . Supervisor Raffensperger noted
that the rezoning request was made by the owners .

The Personnel Committee reviewed the current job description for
the Highway Superintendent and felt that some areas should be

degree which were compared to the duties in this position to the
County and the City . The Personnel Committee felt the change not
requiring the degree was more in keeping with the duties and
responsibilities of the position .

Superintendent as recommended by the Personnel Committee . Carried

Agenda Item No . 18 - Assistant Building Inspector / Zoning Officer
Job Description
The Supervisor explained a new job description was recommended by
the Zoning Officer and the Personnel Committee for the Assistant
Building Inspector / Zoning Officer position .
Mrs . Punger said the job function item was amended to reflect the
responsibilities of the individual in the absence of the Building
Inspector / Zoning Officer . The item two years experience in
enforcement of government regulations and knowledge of health and
fire codes was added . Special skills were also amended .
Mr . Frost suggested that it be added to the list of meetings
attendance to include the Zoning Board , Planning Board , and Town
Board .
Motion made by Councilwoman Valentino , seconded by Councilman Klein
approving the changes to the job description for the Assistant
Building Inspector / Zoning Officer as recommended by the Personnel
Committee . Carried unanimously .
Agenda Item No . 19 - Appointment Assistant Building
Inspector / Zoning Officer
Mr . Frost said six people were interviewed out of 46 applications
for the position . The individual he is recommending is a code
certified inspector . The Town would not have to pay for education .
The gentlemen has an Associates Degree in fire technology , with a
background in fire safety . Mr . Frost was very enthusiastic about
the individual ' s potential , but will reserve final judgement until
after the probationary period . The individual seems to have a high
level of integrity and is willing to begin work on Wednesday .

Agenda Item No . 23 - Set Public Hearing " LOCAL LAW AMENDING THE
TOWN OF ITHACA ZONING ORDINANCE ALLOWING THE TOWN OF ITHACA
PLANNING BOARD TO REDUCE CERTAIN PARKING REQUIREMENTS
Attorney Barney said this proposal was discussed at length by the
Codes and Ordinances Committee . The Local Law would allow the
Planning Board in certain circumstances to reduce when giving site
plan approval the number ` of parking spaces that would otherwise be
required by the ordinance . The discussion at the Town Board level
was the size of the project that would be eligible . The second
question is . once that waiver is given will it be forever or at
what time can the Town demand the parking waived be reinstated .
The COC recommended the project must be 20 . 000 square feet of floor
area before it is eligible for the waiver , and that the waiver can
be rescinded anytime during the first five years and once the
waiver is in place for five years after completion of the project
there would be no ability to rescind it unless there was a change
in the overall project . In the course of redrawing the Local Law
completion was defined .
Motion made by Councilwoman Valentino . seconded by Councilman
Whitcomb authorizing and directing the Town Clerk to advertise for
a Public Hearing to be held at the next regular Town Board meeting
on October 4 . 1993 at 7 : 15 p . m . to consider the referenced titled
Local Law . Carried unanimously .
Agenda Item No . 24 - CAB Recommendation Source of Taxes to Support
Local Schools
Supervisor Raffensperger recalled this issue came before the Town
Board months previously , and the Board asked to have changes made
in the resolution .
Councilman Whitcomb explained previously the Town Board seemed to
be in favor of shifting the school tax from a property tax to a
local income tax as Governor Cuomo proposed . There was concern
that when one set of taxes is removed another set replaces it .
Language was added in the present resolution to address the
previous concerns of the Board . When the farmers were surveyed the
biggest complaint they had was the property tax on farmland .

Supervisor Raffensperger said while many people endorse the concept
of partial replacement of the school property tax with an income
tax it does not see to be realistic to think that it would
completely replace it .
Councilman Whitcomb said the resolution before the Board tonight is
endorsing the State initiative to change at least partially the
source of revenue .
Councilman Liguori felt this was focusing on a single perspective ,
the impact on landowners , we are all landowners . There are a great
many ramifications . It is not appropriate for the Town Board to
adopt this type of resolution without some public input such as a
Public Hearing to give all interested people a chance to be heard .
Supervisor Raffensperger said the resolution is an extremely
directed one , the Town Board could instruct her to pass the
resolution of the Conservation Advisory Board along to the proper
authorities with a cover letter which could be more limited in the
Board ' s expression of interest in the State of New York pursuing
the possibility of replacing at least a part of the resources
available to schools from a property tax to an income tax .
Councilwoman Valentino said she supports the concept because she
sees something beyond conservation . We live in a community where
the wage scale is low compared to the cost of living and the
property taxes . When you talk about affordable housing there are
a lot of aspects that go beyond subsidized housing and other
concepts . Something that would give relief to people to be able to
afford a house is if the property tax were lower . If the tax
portion of their commitment to the schools where based on their
wage it would work . This is something the State needs to look at ,
maybe it should be apportioned as to the formula but we should
encourage the State to look in this direction .
Councilman Whitcomb said the purpose of the resolution was not to

ns s that the State look at abolishing all property taxes , but to
encourage them to move ahead and show local support for the concept
the Governor has proposed .
Supervisor Raffensperger said the resolution does say it endorses
the concept of replacing the school property tax with an income
tax .
Councilwoman Leary said she felt it was important to have this come
from the whole Town Board because it is such an important community
issue . The impact of having it passed by the Town Board in a
community like ours where so much of the property is tax exempt and
a worry to other taxpayers is important .

Motion made by Councilman Whitcomb endorsing the forwarding of the
CAB resolution to the appropriate State authorities with a cover
letter from the Supervisor indicating Town Board support for
replacing all or part of the school property tax with an income
tax . Seconded by Councilwoman Leary .
Councilman Liguori said the public has a right to give input on
this issue . It is not the normal kind of decision for a Town
Board , the public may feel the same way .
Supervisor Raffensperger noted that Councilman Liguori ' s objection
was not to the substance of the resolution but that there should be
a public hearing on it .
Councilman Whitcomb said he had no problem with holding a public
hearing .
Attorney Barney suggested individuals from the school board should
be invited . Attorney Barney sits on a school board and this
proposal was looked at by them . The school board felt now there is
a convoluted shortchanging of school aid to upstate communities .
If you say the state administers it using the formulas for aid it
would not be welcomed . A smaller school district setting up a
bureaucracy to collect its own income tax would not work . The
school board feels administratively it would not work .
Councilman Klein pointed out that when individuals fill out there
New York State tax return they say what school district they are
in , that must plug into the school aid .
Attorney Barney said that is for each school district being able to
have their average per capita income determined which is one of the
ways aid is received .
Councilwoman Leary stated that trying to figure out the
administrative aspects will hog down the principal of the
resolution .
Councilman Liguori said the concept is based solely on the
principal that it will preserve open space .
Supervisor Raffensperger said the Town Board resolution on the
floor and being considered does not endorse that particular
concept .
Councilwoman Leary thought it was not necessary to have a public
meeting because it would be another delay , if the school district

representatives were invited it would create a level of detail that
the Town Board does not have the expertise to deal with . There are
a lot of issues that the Board passes as elected representatives
which do not have public hearings this would only be an expression
of the sentiment of the Town Board .
The Supervisor called the motion . Motion carried with all members
voting aye with the exception of Councilman Liguori voting nay .
Agenda Item No . 25 - Location Road Mancini Subdivision
Mr . Walker explained this project received approval in 1991 one of
the conditions of the approval was the acceptance of the road .
Mr . Walker showed the locations of interest about the road on a
map . The major concern of traffic is the intersection on Route 13
and Five Mile Drive . One of the intents of the Planning Board
would be to recommend that this road be made one way in / off of
Route 13 riot allowing traffic coming up that way . This would
eliminate traffic congestion of Route 13 .
Supervisor Raffensperger asked how much of the road has already
been built "
Mr . Walker showed the Board the location on the map . None of the
roads have been fully built to Town standards . The intention is to
have before the road is actually accepted as a Town road that one
of the road would be completely constructed . The culdesac will be
under 1000 feet .
The Supervisor explained that the Board was being asked to accept
the location of the roads . not to accept the roads because they
have not been constructed to Town standards .
Motion made by Supervisor Raffensperger , seconded by Councilwoman
Valentino accepting the location of the proposed roads as shown on
the Final Subdivision Plat for Lands of Mancini Within the Town of
Ithaca Light Industrial District as prepared by T . G . Miller
Associates Incorporated .
Councilman Liguori noted he will abstain from voting on this issue
as he has a potential conflict of interest because he works part
time for T . G . Miller Associates Incorporated .
Motion carried , all in favor with the exception of the absentia
vote by Councilman Liguori .

Agenda Item No . 26 - Snow and Ice Removal Contract
Attorney Barney explained there are two small changes that he
wishes to make in the contract . The Board reviewed a copy of the
changes .
Motion mane by Supervisor Raffensperger , seconded by Councilman
Whitcomb approving and authorizing the execution of the Snow and
Ice Removal Contract with Tompkins County by the Town Supervisor
with the assistance of the Town Attorney . Carried unanimously .
Agenda Item No 27 - Sale of Surplus Equipment
Mr . Noteboom told the Board there are some surplus items he wishes
to include in the County auction . The 1982 Dodge Aries . Viking
cinder spreader , and an overhead door from the garage .
Motion made by Councilman Whitcomb , seconded by Councilman Liguori
approving the placement of the described surplus items in the
County auction for sale . Carried unanimously .
Mr . Walker explained the Diazo Blue Line Copier can also be placed
in the County auction as it is not safe to use . It must have
ventilation to operate and in the Town Hall it can not be
ventilated properly . This does not mean that someone else would
not be able to purchase it and use it .
Councilman Whitcomb suggested that instead of placing it in the
auction it could be sold for a higher price directly to a buyer .
Mr . Walker said there would requirements to be met in that
instance .
Supervisor Raffensperger pointed out the approximate value was
$ 150 , it would not be worthwhile advertising for bids to sell it .
Motion made by Councilman Liguori , seconded by Supervisor
Raffensperger declaring the Diazo Blue Line Copier as surplus
property to be placed in the County auction for sale . Carried
unanimously .
Agenda Item No 28 Change of Employee Status Highway Secretary
Mr . Noteboom said Gail Kroll has done a fine job , she is organizing
the files and keeping up with the Records Management . Mr . Noteboom
recommended the permanent employment and salary increase for Mrs .

Superintendent ' s of Highways Annual Meeting at a cost not to exceed
$ 500 . 00 . Carried unanimously .
Agenda Item No . 30 - Inlet Valley Water and Sewer Improvements
Contract No . 4 , Change Order
Mr . Walker said the change order is for guiderail installed after
the job was completed . The location of the sewer was changed to
avoid fiber optic cable . This is additional work the contractor is
entitled to payment for in the amount of $ 6066 . 25 .
A change of approximately $ 40 , 000 for the installation 782 feet of
water main on Glenside Drive to reinforce the water system . A 12
inch water main is needed to complete the water main on Trumansburg
Road . Two new items were added because the original 12 inch water
main did. not include any work within the Cayuga right - of - way .
Mr . Walker recommended these changes be made in the contract .
The total amount for the change orders is $ 79 , 093 . 65 , the money is
available in the Capital Projects Budget .
Supervisor Raffensperger mentioned the Town Attorney has advised
the changes are proper within the description of the original
project .
Motion made by Councilman Liguori approving the Work Directive
Change and authorizing the Town Engineer and the Town Supervisor to
execute the changes for the Inlet Valley Water and Sewer
Improvements , Contract No . 4 of the 1989 Capital Improvement
Program . Seconded by Councilwoman Valentino .
Councilman Klein asked if these changes were discussed before , and
is a problem with changing the original project cost by more than
10 % ?

Attorney Barney said if the change is within the general scope of
the project , or if site conditions change and the alternatives are
either to increase the existing bid or re - bid the change portion as
a different job it is allowed . The larger the deviation from the
contract price the more risk there is in doing it , but the
particular changes such as the guideraiI change is clearly a change
in the conditions . The large item increase for Trumansburg Road is
a matter of practicality . The contractor is already on site and it
would be very expensive and time consuming to re - bid the project .
Also , if it were re - bid it may delay the completion of the project
substantially . There isn ' t a great deal of law in the area of
change orders .
Motion carried unanimously .
Agenda Item No . 31 - Acceptance Archaeological Survey Grant
The Town requested $ 3000 to work with Cornell University to see if
the Iroquoian Town of Coreorgonel is in Inlet Valley . There was
also $ 2000 budgeted . The grant only gave the Town $ 1500 . The
project is being scaled down and the landowners have been asked to
make a contribution to the project .
The Planning Department is asking that the grant be accepted and
approval of the budget for $ 4500 , $ 2000 for each of two students
and $ 500 for worker ' s compensation and social security . The two
students would be temporary Town employees .
Motion made by Councilwoman Valentino , seconded by Councilman
Liguori accepting the grant from the Preservation League of New
York State and New York State Council on the Arts for the amount of
$ 1 , 500 .
Councilwoman Leary asked why it is necessary to know if the
Iroquois town is there ?
Mr . Forman said those areas have received subdivision requests from
two developers . If the Iroquois town is there the developers would
be able to work around the site to preserve it . SEQR would require
that it be looked at before site plan approval because of the
historical implications .
Councilman Liguori asked what would happen if they found no
artifacts ?
Mr . Forman responded then there would be not problem with
developing on any portion of the site as it related to that .

Councilwoman Leary asked if the two students had to be Town
employees %' If there were archaeological sites all over the Town ,
would we hire people to investigate every time someone wants to
develop it ?
Mr . Forman said these people are under the supervision of Professor
Baugher of Cornell . They are graduate students who will be working
with the students to help Professor Baugher on site .
Councilwoman Leary asked why the Town is paying for them , why can ' t
the class do it on their own , why are we involved ?
Mr . Forman. said the class is doing it on their own , the money is
just for the two graduate students . Approximately 20 students will
be doing it as field research .
Supervisor Raffensperger said that the Town does not really have to
fund this , it is seen as a joint effort that has a positive effect .
Supervisor Raffensperger reminded the Board that they voted to
permit the application for the grant .
Councilman Liguori said if there is something there it will be
publicized .
Motion accepting the grant carried unanimously .
Motion made by Supervisor Raffensperger , seconded by Councilwoman
Valentino appointing Sue Pacek and Kathleen Quinn as temporary
part - time employees of the Town through January 31 , 1994 , at a rate
Of $ 10 . 00 per hour for tip to 200 hours each , at a total cost of
employment not exceed $ 4 , 500 . Carried unanimously .
Agenda Item No . 32 - 1994 Water Rate Schedules
The Supervisor said the Commission approved rate schedule for water
was put on the agenda so that a public hearing could be set for
October . Supervisor Raffensperger asked to defer it and set the
public hearing for November .
The Board has received material on the proposed change in the water
rate including the Commission approved water rate , water rate
information provided by the Supervisor about 1993 / 1994 rates as
proposed for Bolton Point that has been approved and must be
approved b ;y the Town of Ithaca , and examples of the impact . The
Supervisor reminded the Board this is the third year of the phase
in to flatten the rate . The Bolton Point rate is now proposed to
be a flat rate of $ 2 . 50 per one thousandth gallon .
The Board agreed to defer the Public Hearing until November .

The Supervisor reminded the Board that the September 27 , is the
deadline for items to be placed in the Fall Newsletter . The
newsletter- will attempt to summarize the major portions of the

Agenda Item No . 35 - Report of Examination Office of the State
Comptroller
The Supervisor was happy to announce the Town of Ithaca received
only two minor comments on the Report of Examination . The
Supervisor and the Assistant Budget Officer have prepared a draft
response to the audit report . The response dealt with tine
Repurchase Agreement . Ms . Alario has written to Tompkins County to
see they provide us with all the agreements and confirmations . Ms .
Alario has reviewed tale Procurement Policy with the Town staff .
When three quotations are not available , it will now be written on
the purchase order . The quotes were received previously , they were
just not written on the purchase order .
Motion made by Councilman Whitcomb , seconded by Councilman Klein
approving the response to the Report of Examination prepared by the
Town Supervisor and Assistant Budget Officer and instructing the
forwarding of the response to the State of New York Office of the
State Comptroller . Carried unanimously .
Agenda Item No . 36 - Appointment School Crossing Guard
Motion made by Supervisor Raffensperger , seconded by Councilwoman
Valentino ratifying the appointment of Susan Lajza as part - time
crossing guard for the DeWitt Dfiddle School at an annual salary of
$ 2600 effective September 8 , 1993 . Carried unanimously .

Federation Annual Conference
The Supervisor explained two members of the Planning Board and two

Supervisor Raffensperger said at the August meeting the Town Board
approved the attendance of the Assistant Town Planner at the

has been discovered the State of Vermont does not grant tax exempt
status for states other than Vermont .
Motion made by Councilman Liguori , seconded by Councilwoman
Valentino authorizing the expenditure of additional funds not to
exceed $ 20 . 00 for the attendance of the Assistant Town Planner at
the American Planning Association Northeast Regional Conference .

Motion made by Supervisor Raffensperger to go into Executive
Session to discuss property acquisition and potential litigation .

CAPITAL IMPROVEMENTS PROJECTS
1989 Water and Sewer Improvements - Inlet Valley Phase II
'The contractor has completed pressure testing of the
:installed water and sewer mains . Installation of water
;service taps is being completed and flushing and chlorination
prior to final acceptance will be done after the service taps
are done . Completion of the interior plumbing on the meter
pit is pending delivery of the meters . Restoration work is
continuing and has been hampered by the recent rain .

Development Review
The Town Engineer has provided development review services
for the following projects :
1 . Mancini Subdivision , Site utility plan and road plans
Compliance Review and Coordination
Several projects have been approved for construction and the
Engineering staff has been inspecting work as required .
Projects currently in progress include :

2 . Cornell Tennis Facility Construction Site Review ,
drainage and erosion control

Sewer
The Final Payment for the construction of the Kline Road/Fall
Creek siphon bypass by Stevers Construction has been made .
Judd Falls Road Reconstruction
The Design Review Committee met September 21 and discussed
development of a comprehensive plan for transportation in the
Forest Home area . The FHIA will be meeting and will be
presenting a list of considerations that the entire community
is in agreement with , for the design review committee to
discuss . The project is now scheduled for construction
during the 1994 construction season .
The drainage and slope stabilization work on Forest Home
Drive has been completed by the Highway Department . The work
crew did an excellant job on this project .
South Hill Trail
The Town Engineer has continued to assist the Planning and
Parks Departments by reviewing and approving the trail design
and providing engineering services for construction .

TOWN OF ITHACA HIGHWAY SUPERINTENDENT ' S REPORT FOR SEPTEMBER 1993
Town Board Meeting , October 4 1993
In September the Highway crews worked 947 . 25 hours on General
Repairs , including 2 . 75 over time hours . Also during September
work was completed on Forest Home Drive . The total man hours
worked in September on this project was 293 . 5 for a grand total
( August and September ) of 634 man hours . South Hill Trail work
continued with 366 . 25 man hours worked during September . This
includes 1 . 75 overtime hours .
The Town and County worked together to repair the Forest Home Drive
Bridge Walkway . During September this project used 162 . 5 man
hours , 2 of which were overtime .
Mowing continued in September , with 91 total man hours worked and
135 . 5 man hours worked on machinery .
The Town Highway Department assisted the Engineering Department
repair sewers on Trumansburg Road . 56 man hours were worked on
this project .
Along with the Brush pick up , which is slated for the week of
October 18 , the following projects will be worked on in October .
14 Continue working on South Hill Trail ,
2 . Work on patching roads .
3 . Prepare for the snow season .
4 . Work on various other road repairs .

PARKS AND OPEN SPACE MANAGER ' S REPORT , SEPTEMBER 1993
Town Board , October 4 , 1993
1 . Park and trail mowing required 60 man hours in September as
some slow down in growth occurred .
2 . South Hill Trail construction activity by Parks staff took 133
man hours . Clearing of the City section and Burns Road
entrance was accomplished , some tree planting was done , and
gravel was spread on the upper grade and spur connection .
3 . Several lawn restorations were completed for a total of 52 man
hours . Jobs included the Schafrik residence , two water line
breaks , and improvements to lawns at Troy and Tudor Parks .
4 . Routine maintenance tasks , totaling 221 man hours , completed
our work effort in Parks for the month .

RE: Planning Department Activity Report.
The following is a synopsis of Planning Department activity for the period September 11 ,
1993 through October 1 , 1993 :
Planning Board
Development Review
The Planning Board held two meetings during this period : September 14, and September
21 ,
On September 21 , the Planning Board gave final subdivision approval , for a six lot
subdivision for lands owned by Earland Mancini, located in the Light Industrial District
on Elmira Road .
Comprehensive Plan
On September 21, after further discussion of the Plan, the Planning Board determined
that the Comprehensive Plan would have no significant negative environmental
impacts, and following that determination, adopted the Comprehensive Plan,
Cornell GEIS
On September 114, the Planning Board determined that all changes required to be made to
the GEIS for the purpose of determining whether the document was ready for public
review, had been made . A Public Hearing on the GEIS has been scheduled for October 19.
Codes and Ordinances Committee ( CO C)
The COC met on September 29 . The Committee listened to Professor Patricia Pollak from
Cornell, concerning innovative housing ideas for senior citizens . Among the ideas
discussed were elder cottages, shared living residences and match-up home sharing. The
Committee also discussed projects on which wetlands were located, and whether wetland
area should be included in determining the maximum number of units for a cluster
subdivision .
Miscellaneous
Staff continues to supervise construction of the South Hill Trail and is working towards
substantial completion of the project during the fall . Staff is also working on a nature
guide for the Trail .
A member of the Planning Department is attending a regional conference of the
American Planning Association.
Staff is continuing to work with Professor Sherene Baugher from Cornell on the Inlet
Valley Archaeological project.
Staff continues to work with the MPO Planning Committee to develop a budget, work
program, and transportation plan for the Policy Committee ' s approval .
Staff met with individuals requesting assistance with development projects .
Planning department staff members attended a seminar on co - housing sponsored by
Eco -village at Cornell University .
Planning and Engineering staff members met with representatives of Ithacare concerning
their proposal to rezone and develop a site just south of NCR, on Danby Road .
The Town Supervisor and Town Planner met with faculty members and administration
from Cornell University concerning. possible expansion of Wilson Laboratory through
the addition of a " B Meson Factory" . Cornell and Stanford are finalists for the
Department of Energy project.

Resolution No . 255
RESOLVED , that pursuant to Section 6 - c of the General
Municipal Law , as amended , the Town Board of the Town of Ithaca
does hereby establish a Capital Reserve Fund to finance the cost of
acquisition or construction of town buildings , including a new Town
Hall ; and it is further
RESOLVED , that the Supervisor of the Town is hereby directed
to transfer moneys as designated by this Board out of surplus funds
of the Town into this reserve fund from time to time ; and it is
further
RESOLVED , that the Supervisor of the Town is hereby directed
to deposit moneys of this reserve fund in a separate bank account
to be known as the " Town Building Reserve ' Fund " ; and it is further
RESOLVED , that the Supervisor of the Town is authorized to
invest , from time to time , the moneys of this reserve fund pursuant
to Section 6 - f of the General Municipal Law ; and it is further
RESOLVED , that no expenditure shall be made from this reserve
fund except upon resolution of this board pursuant to Section 6 - c
of the General Municipal Law , which resolution shall be subject to
permissive referendum to the extent required by law .

It should be understood that the Town Board is not obligated to
grant any such leaves described above . The decision to grant or
withhold leave beyond the basic benefits provided by the Family
and Medical Leave Act ( see paragraph below ) and whether , if
granted , such leave will be paid or unpaid , is solely at the
discretion. of the Town Board .
FAMILY AND MEDICAL LEAVE ACT OF 1993
Employees who have worked for the Town for at least one year and
for 1 , 250 hours over the previous twelve months are eligible for
up to 12 weeks of unpaid , job protected leave a year * for
( 1 ) care of the employee ' s child ( birth or placement for adoption
or foster care ) ; ( 2 ) care of the employee ' s spouse , son or
daughter , or parent , who has a serious health condition ; or
( 3 ) for a serious health condition that makes the employee unable
to perform his / her job . Medical certification is mandatory .
Thirty days advance notice when leave is " foreseeable " is
required . Consult the Personnel Department for detailed
requirements and benefits .
* Year is defined for leave purposes as any twelve month period
beginning from the last date any leave was used , ie : leave ends
April 30 ; therefore , earliest date family or medical leave can
begin is April 30 of the following year .

HIGHWAY SUPERINTENDENT
JOB FUNCTION
Supervise the construction , improvement , repair , care and maintenance of
designated highways of the Town of Ithaca . Programming and planning of work
projects for work crews , liaison with the public , and record keeping are
the three key areas of responsibility . The position requires independent
thinking and direct supervision to maintain cost control and safety in all
operations .
JOB STATUS
This position is exempt from the overtime provisions of the Fair Labor
Standards Act . Attendance at Town Board meetings is often required .
SUPERVISED BY
Town Board and administratively by the Town Supervisor .
SPECIFIC MAJOR DUTIES
Direct supervision of the Town Highway crews in the accomplishment of all
assigned tasks including work planning , arrangement for support services ,
response to emergencies .
Maintain inventory of all highway fixed assets and highway infrastructure
characteristics to support application for State and Federal aid and for
financial control
Report monthly to the Town Board the activities of the department .
Respond to constituent inquiries relating to highway infrastructure
including drainage , paving , snow and weed control , parks care and
maintenance .
Capital planning of resources needed to accomplish the objectives of the
department .
Work closely with other Town departments and with counterparts in City of
Ithaca , Tompkins County , other towns and villages to share equipment ,
resources , locate utilities and clarify maintenance jurisdictions .
HIGHWAY SUPERINTENDENT EDUCATION & WORK REQUIREMENTS
Associate Degree in construction technology and two years public works
experience serving in a supervisory or administrative capacity or an
equivalent combination of training and experience . Experience as heavy
equipment operator , mechanic or construction craftsperson . A valid NYS
driver ' s license and clear driving record is required . Class B NYS driver ' s
license , or equivalent , required by end of six - month probationary period .
OTHER REQUIREMENTS
Must be , or become within six months , an elector of the Town of Ithaca .
Must possess thorough knowledge of the practices , techniques , tools ,
equipment , materials and safety precautions of highway construction , snow

10 Remove and Replace approximately 200 LF of Guide Rail on east side
of Rte 13 in from Station 13 - 19 + 50 to 13 - 22 +00 and Station
13 - 14+00 to 13 - 14+ 50 . Guide rail removal was required for
installation of sewer main outside of shoulder of road .
Additional payment for Removal and Replacement of Guide Rail is
justified because the guide rail was installed by NYSDOT after the
contract documents were prepared , and the Contractor ' s bid was
based on a site condition without guide rail .
This additional work will be compensated for by new pay Item 27
with a Lump Sum Amount of $ 6 , 066 . 25 . No change in contract time
is allowed for this item .

WHEREAS . the Town of Ithaca has received a grant of $ 1 . 500
from the Preservation League of New York State and New York State
Council on the Arts for the purpose of funding part of the cost of
an archaeological survey in Inlet Valley to confirm whether of not
the Iroquoian townsite of Correorgonel is located in the area of
Inlet Valley ; and
WHEREAS , the survey will be a joint effort between the
Planning Department and Professor Sherene Baugher , Visiting
Professor in the Department of City and Regional Planning and
Department of Archaeology at Cornell University . The survey will
be completed during the Fall 1993 semester at Cornell as part of a
field course in archaeology ; and
WHEREAS . the Planning Department will provide basemaps , aerial
photographs , and other data for the site , provide onsite guidance ,
act as liaison with property owners , and administer the grant .
Cornell University will provide Professor Baugher ' s expertise ,
student workers , and the tools and equipment necessary for the
excavation work ; now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca hereby
accepts the grant from the Preservation League of New York State
and New York State Council on the Arts for the amount of $ 1 . 500 .

WHEREAS , the Town of Ithaca has received a grant of $ 1 , 500
from the Preservation League of New York State and New York State
Council on the Arts for the purpose of funding part of the cost an

WHEREAS , Professor Baugher has recommended that Sue Pacek and
Kathleen Quinn be hired to be her assistants during the course of
the archaeological survey ; now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca hereby
appoints Sue Pacek and Kathleen Quinn as temporary part - time
employees through January 31 , 1994 , at a rate of $ 10 . 00 per hour
for up to 200 hours each , to be charged to Planning Department
Account Number 8020 . 110 ; and be it further
RESOLVED , that the total cost of employing Ms . Pacek and Ms .
Quinn not exceed $ 4 , 500 .

Examination for the period January 1 , 1992 through December 31 ,
1992 from the New York State Office of the State Comptroller ; and
WHEREAS , pursuant to General Municipal Law , Subdivision 4 ,
Section 35 requires that the report be studied by all appropriate
officials and that the Town Board may in its discretion prepare a
written response to the audit findings within ninety days from the
date of presentation of the Report of Examination to the Town
Board ; and
WHEREAS , the Town Board has studied and discussed the said
Report of Examination , and
WHEREAS , the Town Supervisor and the Assistant Budget Officer
have prepared a response to the Report of Examination ; now
therefore be it
RESOLVED , that the Town Board of the Town of Ithaca hereby
approves of the response to the Report of Examination prepared by

instructs the forwarding of said response to the State of New York
