Item 2 Report of Tompkins County Legislature and Ithaca Common Council — None Item 3 Persons to be Heard and Board comments— None Item 4 Tompkins County Presentation of the County Wayfinding and Interpretive Signage Project Jenifer Tavares and Thomas Knipe presented a Powerpoint presentation regarding the proposed grant to establish unified signs throughout the county. (Attachment #1) Key takeaways are that this is for more than just the "Welcome to the Town of Ithaca" signs, includes locations within the county that are very important to the entire community and were prioritized by the committee and include the colleges, natural resources such as waterfalls, trails and state parks, and other areas people who travel to Ithaca want to find. There are additional signs in the city which have been broken into districts and are color coded such as East Hill, West Hill, Commons and the like. The goal is to make tourists more comfortable and enhancing the experience as they travel and visit throughout the county. Ms. Tavares went over the budgeting of the project stressing that it is dependent on a number of factors and may be broken into two phases. The cost sharing is shared by the municipalities and the colleges and depending on the type of sign. The committee also removed the installation costs hoping that some municipalities would be able to contribute in-kind services. She did not want too much focus on the numbers because it will depend on grant monies and other funding sources such as TCAD, DIA etc. The review committee ran many, many scenarios on cost sharing with a variety of outcomes but the approximate for the town would be $62K. 1 Ms.Tavares wrapped up the presentation by saying they are looking for a letter of commitment saying we will support the project with a cash amount up to$35K. Questions from the Board Mr. Levine asked if that number is based on the attractions the signs are pointing to rather than the location of the sign and Ms. Tavares responded that it includes half of the 4 gateway signs and the Rec Way Trail and East Shore Park although there are other signs for destinations in the Town but they are in other columns in the spreadsheet. Mr. Levine then asked if the payment over three years is fine with them and Ms. Tavares responded that they are not sure, but they did think two would be workable and they could figure out ways if needed for the three. Mr. Knipe added that they envision the County Tourism Grant funded by the mortgage and room taxes to play the largest cash role in the project and the Strategic Tourism Board will decide on the commitment level but its assumed around $150K and that might allow some flexibility. Ms. Hunter asked about the room tax money and what that is annually and Mr. Knipe responded that it is about $23M with 16 different programs that are funded out of that and the Strategic Tourism Implementation program is focused on this project and has dedicated funding for this to allow the other programs, dozens and dozens of arts and cultural programs and the Convention and Visitors Bureau that are supported through that main budget. Mr. Howe noted that the Planning Committee was supportive of this and he asked if this moves forward, there would be many decisions to be made and he asked if the town would have representation on those decisions in the way of a committee membership and Ms. Tavares responded absolutely. Mr. Engman noted that the town has an Economic Development Committee and he thought this certainly helps to give people a feeling of confidence when they come into the community and it might add to the attraction of the community and most of us know how difficult it is to get around here and this can really help and although the dollar figure might not be ready now, it is important for everyone in the community and he believes the town will benefit. Ms. Hunter had one additional comment requesting that the committee look at a Watershed Sign and Ms. Tavares responded that she could bring that back to the committee. TB Resolution No. 2015- 069:Support for Consolidated Funding Application and Commitment to Provide Town Share of Grant Match Funds for County Wayfinding and Interpretive Signage Project Whereas, in 2013,the Tompkins County Chamber of Commerce received a$63,000 grant from the Tompkins County Tourism Program to develop a plan to create a more comprehensive and coherent signage system throughout Tompkins County, and 2 Whereas,the program includes a comprehensive gateway and municipal signage program; standard NYS DOT signage; signage "districts" designated to help visitors, parents, and our transient residential population navigate through Ithaca and Tompkins County; and vehicular directional signage to parks,trails, and other important destinations, and Whereas,the Town of Ithaca recognizes the importance of visitors,tourists, students, parents, to the local economic landscape, including benefits to local farms and businesses, and the sales tax revenue generated by these visitors, and Whereas,the proposed plan includes gateway signage to the Town of Ithaca, and numerous Town assets, including the South Hill Recreation Way Trail and the East Shore Park, and Whereas,the State of New York has announced the availability of funds through the 2015 State of New York Consolidated Funding Application (CFA), and Whereas,the Tompkins County Chamber of Commerce has been working with numerous stakeholders, including the County, City, Cornell University, Ithaca College, and other municipalities to pull together a local funding contribution match to the state CFA application, and Whereas,the Town Board is interested in supporting this grant so as to enhance navigation and wayfinding in the Town and throughout the community, and Whereas, pursuant to the New York State Environmental Quality Review Act (SEAR) and its implementation regulations at 6 NYCRR Part 617, it has been determined that the wayfinding signage project is a Type II Action because the Action involves the "installation of traffic control devices on existing streets, roads and highways" and signs that "guide traffic" are considered by both federal and state regulations as traffic control devices,therefore the project is not subject to SEAR, now, therefore, be it Resolved,that Town of Ithaca Town Board hereby confirms its intention to commit funds in an amount not to exceed $35,000, contingent upon an award of funds from the 2015 CFA, with the final funding formula to be determined based on stakeholder participation and total project costs. Moved: Rod Howe Seconded: Eric Levine Vote:Ayes—Howe, Levine, Leary, Hunter, Engman and Goodman Item 5 Presentation of final plans for front offices renovation (Attachment 2) Grace Chiang and Lisa Parrish from Chiang&O'Brien presented the final plans for the front of house renovations and reviewed the steps taken to get to this point. She added that she has looked at the estimates and the budget and they felt they were on budget with the caveat that 3 two additional workstations have been added to the project so the furnishing budget is larger than what was originally anticipated. There were no questions from the Board. Ms.Terwilliger stated that as one of the people most affected, she felt this was the best plan and she was happy with the drawings and thought the management group have worked really hard to get to this point with compromises and battles and the additional costs for the stand-up desks is necessary because they are very good for those of us who have back issues and she hoped the board would agree with that. TB Resolution 2015-070: Authorization of plans and specifications for obtaining bids for the renovation of front offices at Town Hall Whereas the Town Board has budgeted for the renovations of the Front Offices of Town Hall in its 2015 Budget, and Whereas the designs and plans for the said renovation have gone through a stringent review process over the past 3 years, and Whereas Chiang&O'Brien have presented the final diagrams and conceptual drawings and the next step is to prepare bid documents and open the bidding process, now therefore be it Resolved that this Board authorizes Chiang& O'Brien to finalize bid documents and let the project out to bid. Moved: Bill Goodman Seconded: Eric Levine Vote: Ayes—Goodman, Levine, Engman, Howe, Leary and Hunter Item 6 5:30 p.m. Public Hearing Regarding a Proposed Local Law to Override the Tax Levy Limit Established in General Municipal Law 3-C Public hearing was opened at 6:25 p.m. There was no one wishing to address the board and the hearing was closed. TB Resolution 2015-071: Adopting a Local Law to Override the Tax Lew Limit Established in General Municipal Law§3-c. Whereas, municipalities of the State of New York are limited in the amount of real property taxes that may be levied each year under the tax levy limit established in General Municipal Law§3-c, and Whereas, subdivision 5 of General Municipal Law §3-c expressly authorizes a municipality to override the tax levy limit by the adoption of a local law approved by vote of at least sixty percent (60%) of the governing body, and 4 Whereas, at its meeting on June 8, 2015, the Town Board of the Town of Ithaca reviewed and discussed a proposed local law to override the tax levy limit and adopted a resolution for a public hearing to be held by said Town on July 13, 2015 at 5:30 p.m. to hear all interested parties on the proposed local law entitled "A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW§3-C"; and Whereas, notice of said public hearing was duly advertised in the Ithaca Journal; and Whereas, said public hearing was duly held on said date and time at the Town Hall of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local law, or any part thereof, and Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that adoption of the proposed local law is a Type II action because it constitutes "routine or continuing agency administration and management, not including new programs or major reordering of priorities that may affect the environment," and thus this action is not subject to review under SEQRA. Now,therefore, be it Resolved, that the Town Board of the Town of Ithaca hereby adopts said local law entitled "A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW§3- C", a copy of which is attached hereto and made a part of this resolution,and be it further Resolved, that the Town Clerk is hereby authorized and directed to file said local law with the Secretary of State as required by law. Moved: Pat Leary Seconded: Eric Levine Vote: Ayes—Leary, Levine, Hunter, Howe, Engman and Goodman Item 7 Consider a resolution of appreciation for Hollis Erb Mr. Engman read the resolution into the record and added that Ms. Erb has been an absolute wonder in the town and magnificent in her dedication. TB RESOLUTION 2015-072:RECOGNITION OF HOLLIS ERB'S DEDICATED YEARS OF SERVICE Whereas, Hollis Erb has served the Town of Ithaca with dedication for nearly 10 years; and Whereas, Hollis was appointed to the Planning Board on June 11, 2007, and has demonstrated diligence, exceptional communication skills and attention to detail throughout her continuous 5 eight years of commitment to the Board, including acting as the Board's Vice Chair since 2010; and Whereas,the Town of Ithaca is grateful for Hollis's civic dedication as an active, participating member of the town's Agricultural Plan Steering Committee between 2009 and 2011,the Energy Action Plan Advisory Committee between 2012 and 2014,the town's Comprehensive Plan Committee between 2008 and 2012, and the Town of Ithaca representative to the City of Ithaca's Comprehensive Plan Committee,through which Hollis has promoted inter-municipal cooperation and provided excellent advice on ways to improve both municipalities' plans and regulations; and Whereas,the Town of Ithaca has greatly benefited from Hollis's thoughtful consideration, enthusiasm and desire to serve our municipality in order to make it a better place to live; and Whereas,the Town of Ithaca is indebted to Hollis for her invaluable contributions to the community; Now,Therefore, Be It Resolved,that the Town Board of the Town of Ithaca, on behalf of the Town and its citizens, expresses its sincere appreciation, admiration and gratitude to Hollis Erb for her distinguished and steadfast service to our community. Moved: Rod Howe Seconded: Tee Ann Hunter Vote: Ayes—Hunter, Howe, Leary, Levine, Engman and Goodman Item 8 Discuss and consider contract with Solar Tompkins for the HeatSmart program and authorization for the Supervisor to sign such contract TB Resolution 2015-073: Approval to Engage the Services of Solar Tompkins for HeatSmart Program Whereas the Town of Ithaca recognizes climate change as a pressing issue to which we must respond by reducing energy consumption and greenhouse gas emissions and Whereas according to the U.S. Energy Information Administration, residential space and hot water heating in New York accounts for 66%- 75%of energy consumption in single-family homes; approximately one-third for domestic hot water and two-thirds for space heating and Whereas energy efficiency improvements such as air-sealing, improved insulation and sustainable technologies such as air-source and ground-source heat pumps can reduce energy consumption and greenhouse gas emissions by 25%-85%while making the home more comfortable and saving the owner money over the long term and 6 Whereas Solar Tompkins has developed a new program called HeatSmart Tompkins, which will use the Solar Tompkins model to educate the public about energy efficiencies that can be achieved with air-sealing, insulation and heat pumps for space and water heating; will identify qualified local installers who use best management practices; and will help homeowners identify incentives and financing options; and will help homeowners achieve cost reductions through volume pricing and Whereas the Town of Ithaca wishes to encourage homeowners to make these sort of energy efficiency improvements and to take advantage of on-bill financing and other State incentives and Whereas Solar Tompkins has proven to be an effective program model for educating the community about energy conservation options, incentives, and financing methods and has been very successful in stimulating the Solar market in Tompkins County—including the installation of$12 million in solar energy infrastructure on 400 homes and creation of over 50 full-time living wage jobs and Whereas Solar Tompkins is a non-profit organization that has served and will continue to serve the public interest by increasing the quality and value of the housing stock; educating the community and achieving energy efficiency and greenhouse gas reductions; and strengthening the local economy and creating local jobs and Whereas Solar Tompkins will provide specific services to the Town of Ithaca as detailed in their Proposal of Services Now,therefore be it Resolved that the Town of Ithaca will contract with Solar Tompkins for HeatSmart programming in the Town of Ithaca in the summer and fall of 2015 and Further Resolved that the Town Supervisor is authorized to sign the contract with Solar Tompkins upon advice of the Attorney for the Town. Moved: Tee Ann Hunter Seconded: Eric Levine Vote: Ayes—Hunter, Levine, Engman, Leary, Goodman and Howe Item 9 Discuss and consider authorization of funding for right-of-way activities for Phase 1 of the Gateway Trail project TB Resolution 2015 - 074: Authorization of funding for right-of-way activities for Phase 1 of the Gateway Trail project 7 Whereas, in 2007 the Town of Ithaca accepted the grant and executed an agreement with NYSDOT for the design phases of the Gateway Trail project; and Whereas, design work has been progressing on phase 1 (Home Depot parking area to Stone Quarry Road) of the project and is expected to be completed summer 2015; and Whereas, once designs are completed and approved by NYSDOT, the next stage of the project is acquiring the necessary rights-of-way; and Whereas, funding outside of the grant is necessary to complete the right-of-way elements; and Whereas,the Town of Ithaca desires to continue to advance this project by providing the entire right-of-way costs for phase 1 of the Gateway Trail project; Now,Therefore, be it Resolved, that the Town Board thereby authorizes the Town of Ithaca to fund the entire right- of-way costs for phase 1 of the Gateway Trail project, up to a maximum of $5,000; and it is further Resolved, that the $5,000 is hereby appropriated from the unappropriated fund balance of the General Fund and made available to cover the right-of-way costs for phase 1 of the Gateway Trail project. Moved: Rod Howe Seconded: Tee Ann Hunter Vote: Ayes—Howe, Hunter, Goodman, Engman, Leary and Levine Item 10 Discuss and consider authorization to apply for Parks Development Grant to replace two playground structures TB Resolution No. 2015—075 :Authorization to Apply for Parks Development Grant to Replace two Playground Structures Whereas,the Town of Ithaca has playground structures in Grandview and Hungerford Heights Parks that were constructed over 20 years ago,contain chromated copper arsenate (CCA) treated wood, are not compliant with the American With Disabilities Act, and are scheduled to be replaced in the next several years according to the Town's 5-Year Capital Improvement Plan; and Whereas,the New York State Office of Parks, Recreation & Historic Preservation has announced the availability of funding under the Environmental Protection Fund Municipal Grant Program through the Consolidated Funding Application (CFA)for park development, including the "development and planning of parks and recreational facilities to preserve, rehabilitate or 8 restore lands, waters or structures for parks, recreation or conservation purposes", with playgrounds listed as an example of eligible projects; and Whereas, assistance toward the cost of the projects shall not exceed 50%of the total project costs; and Whereas,the Town estimates a total cost of up to$96,000 for the demolition of the existing structures and the layout and construction of two new playgrounds at Grandview and Hungerford Heights Parks; and Whereas, grant applications are due by July 31, 2015; and Whereas,the new playground structures in Grandview and Hungerford Heights Parks are replacing existing structures in the same locations, and are classified as a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act (SEAR), because the Action involves the "replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes, unless such action meets or exceeds any of the thresholds in section 617.4 of this Part" and the "purchase or sale of furnishings, equipment or supplies, including surplus government property, other than the following: land, radioactive material, pesticides, herbicides, or other hazardous materials",thus the demolition and construction of the playgrounds are not subject to review under SEAR; now,therefore, be it Resolved,that the Town Supervisor is hereby authorized and directed to file a CFA application for funds from the New York State Office of Parks, Recreation & Historic Preservation under the Environmental Protection Fund Municipal Grant Program, in an amount not to exceed $48,000, and upon approval of said request to enter into and execute a project contract with the State for such financial assistance to the Town of Ithaca for the replacement of two playground structures. Moved: Eric Levine Seconded: Bill Goodman Vote:Ayes—Levine, Goodman, Engman, Leary, Howe and Hunter Item 11 Discuss and consider approval of the 2015 Amendment to the Municipal Cooperative Agreement for the Greater Tompkins County Municipal Health Insurance Consortium TB Resolution No. 2015—076:Approval of the 2015 Amendment to the Municipal Cooperative Agreement for the Greater Tompkins County Municipal Health Insurance Consortium 9 Whereas, the Town of Ithaca is a Participant in the Greater Tompkins County Municipal Health Insurance Consortium (the "Consortium"), a municipal cooperative organized under Article 47 of the New York Insurance Law, and Whereas, the municipal participants in the Consortium, including this body, have approved and executed a certain Municipal Cooperation Agreement (the "Agreement"; effective date of October 1, 2010) and Amendment (2014)that provides for the operation and governance of the Consortium, and Whereas, Article 47 of the New York Insurance Law (the "Insurance Law") and the rules and regulations of the New York State Department of Financial Services set forth certain requirements for governance of municipal cooperatives that offer self-insured municipal cooperative health insurance plans, and Whereas, the Agreement sets forth in Section Q2 that continuation of the Consortium under the terms and conditions of the Agreement, or any amendments or restatements thereto, shall be subject to Board review on the fifth (5th) anniversary of the Effective Date and on each fifth (5th) anniversary date thereafter (each a "Review Date"), and Whereas, by motion 005-2015, adopted on May 28, 2015, the Consortium's Board of Directors recommends approval of the 2015 amended agreement based on review of the document by the Municipal Cooperative Agreement Review Committee, the New York State Department of Financial Services, and the Consortium's legal counsel, and Whereas, the Municipal Cooperative Agreement requires that amendments to the agreement be presented to each participant for review and adopted by its municipal board, Whereas, the Town of Ithaca is in receipt of the proposed amended Agreement and has determined that it is in the best interest of its constituents who are served by the Consortium to amend the Agreement as set forth in the attached 2015 Amended Municipal Cooperative Agreement, now therefore be it Resolved, that the Town of Ithaca approves and authorizes the Town Supervisor to sign the 2015 Amendment to the Municipal Cooperative Agreement of the Greater Tompkins County Municipal Health Insurance Consortium, and Resolved, further, that the Clerk of the Town of Ithaca is hereby authorized to execute this Resolution to indicate its approval, transmit a copy thereof to the Board of Directors of the Greater Tompkins County Municipal Health Insurance Consortium, and take any other such actions as may be required by law. Moved: Tee Ann Hunter Seconded: Eric Levine Vote: Ayes—Hunter, Howe, Levine, Leary, Engman and Goodman 10 Item 12 Discuss and consider authorization to apply for an Empire State Development Grant for an Economic Feasibility Study and a Strategic Plan for the Elmira Road Corridor TB Resolution No. 2015—077:Authorization to Apply for an Empire State Development Grant for the Purpose of Having an Economic Feasibility Study Conducted and a Strategic Plan Prepared for the Elmira Road Corridor Whereas,the Elmira Road corridor within the Town of Ithaca serves as a key gateway into the greater Ithaca community for tourists,visitors, residents, and commuters alike;that it contains two premier state parks, Buttermilk Falls State Park at the north end and Robert H.
