Persons to be Heard and Board comments—None 4. 5:30 Public Hearing regarding a Local Law amending the Town of Ithaca Code, Chapter 271 entitled "Zoning: Special Land Use Districts" to modify the requirements for seasonal camping facilities at the La Tourelle Resort Mr. Engman opened the public hearing at 5:32 p.m. There was no one wishing to address the board at this time and the hearing was closed. There were no questions from the board. Mr. DePaolo noted that he would be abstaining due to his working relationship with Mr.Wiggins. Minor changes were made to the SEQR form. TB Resolution No. 2015 -035: SEAR: Proposed Local Law Amending Chapter 271 of the Town of Ithaca Code, Entitled "Zoning: Special Land Use District" to Modify the Requirements for the Seasonal Camping Facilities at the La Tourelle Resort Whereas, this action is the adoption of a local law amending Chapter 271 of the Town of Ithaca Code, entitled"Zoning: Special Land Use Districts"to modify the requirements for the seasonal camping facilities at the La Tourelle Resort; and Whereas, this is an Unlisted action for which the Town of Ithaca Town Board is acting in an uncoordinated review with respect to the enactment of the proposed local law; and Whereas, the Town Board, at a public hearing held on April 13, 2015, has reviewed and accepted as adequate the Short Environmental Assessment Form (SEAF)Parts 1, 2, and 3 for this action, along with other application materials; now, therefore, be it Page 11 Resolved, that the Town of Ithaca Town Board hereby makes a negative determination of environmental significance, in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed based on the information in the SEAF Part 1 and for the reasons set forth in the SEAF Parts 2 and 3, and, therefore, an Environmental Impact Statement will not be required. Discuss and consider Complete Streets Policy SEQR was moved and seconded for discussion. A minor change was suggested by Ms. Brock and Mr. DePaolo suggested changing the second paragraph in Part to read "....consideration during the design, construction..." to make it clearer that the town will not necessarily be doing the design or construction since most times it will be the developer that will do that. Change approved by the board. TB Resolution No.2014-037: SEAR Proposed Adootion of Town of Ithaca Complete Streets Policy Whereas, this action is the Proposed Adoption of a Town of Ithaca Complete Streets Policy; and Whereas, this is an Unlisted Action for which the Town Board is acting as Lead Agency in an environmental review with respect to the enactment of this policy; and Whereas, the Town Board, at its regular meeting held on April 13,2015, has reviewed and accepted as adequate the Short Environmental Assessment Form (SEAF),Parts 1, 2, and 3 prepared for this action by Town Planning staff; now, therefore, be it Resolved, that the Town Board of the Town of Ithaca hereby makes a negative determination of environmental significance in accordance with Article 8 of the New York State Environmental Conservation Law,6 NYCRR Part 617, and Chapter 148 of the Town of Ithaca Code for the above referenced action as proposed,based on the information in the SEAF Part 1 and for the reasons set forth in the EAF Parts 2 and 3, and, therefore, an Environmental Impact Statement will not be required. Moved: Rod Howe Seconded: Tee Ann Hunter Vote: Ayes—Howe, Hunter, Levine, DePaolo, Engman, Leary and Goodman Mr. Engman noted that Mr. Levine had some concerns about Section 4, Exemptions in conjunction with (b): Any exceptions to this policy must be approved by the Town Board for Town projects, or by the Planning Board for any other projects that come before it, and be documented with supporting information that indicates the basis for the decision. Such documentation shall be publically available. Exceptions may be considered for approval when: (b) The activities are ordinary maintenance activities designed to keep assets in serviceable condition(e.g.,mowing,cleaning, spot repair and surface treatments such Page ( 3 as chip seal)or other interim measures that do not change the existing shoulder, guiderails or road footprint. Mr. Levine thought it might become cumbersome for the town board to consider all of the part (b) activities. Mr. Engman suggested adding"or the Public Works Director, or the Public Works Committee or the Town Supervisor, for work described in 4b." to the introductory paragraph were it states who would be doing the approval to address that concern. Discussion followed on which of the three stated it should be. Mr. Levine added that he was concerned about things that are so small and that Public Works can take care of in a day or very inexpensively, do we really need to add a review level and he wanted some type of diminutive threshold. Mr. Engman suggested adding"or for emergencies" to his addition. Mr. DePaolo thought the types of projects that are going to trip the review would be very large projects and we would have months of notice and he didn't see why we need to have this caveat. Mr. Engman agreed but said the only one he would worry about would be the "surface treatments"and that might be when we should be thinking about the policy and whether changes should be made but maybe the Public Works Committee would be thinking about that. Mr. Levine was also concerned about the lack of emphasis on how expensive a project might be and Mr. Engman suggested adding a letter(e)saying"the proposed work is considered prohibitively expensive as determined by the town board."He noted that there is a reference to cost in (c)for the director of Public Works to make a determination but this would also allow the Town Board to make the determination. Mr. Goodman thought we could add the Town Board to (c). Ms. Hunter asked if the costs being considered were those borne by the developer or the town; she didn't know if she would want to exempt the Town Board from considering the costs to developers. Ms. Brock quoted NYS Highway Law which requires the town to consider Complete Streets if state or federal monies are being used. It isn't really looking at costs by themselves,but costs in conjunction with adding sidewalks or other aspects of Complete Streets such as the need and appropriateness of adding or requiring them. Mr. Goodman thought the Planning Board made those determinations during site plan reviews. Ms. Hunter thought the term"prohibitive"was very subjective. Mr. Goodman thought the requirement to document the request to find it prohibitive would cover the concerns here. TB Resolution No.2014-038: Adopt Complete Streets Policy Requiring the Town to Consider Complete Streets Factors Whereas, the Town Board of the Town of Ithaca is interested in encouraging the development of transportation facilities that encourage more use by pedestrians and bicyclists; and Whereas,"Complete Streets"is an approach to the design and construction of streets, roads and highways that takes into account not only the needs of automobiles but also the needs of pedestrians and bicyclists; and Whereas, the Town's Public Works Committee has reviewed the Complete Streets legislation adopted by New York State and various municipalities within New York and has recommended that the Town consider similar legislation; and Page 14 Whereas,at its March 9, 2015 meeting the Town Board discussed a draft Complete Streets ordinance and decided to consider adopting it as a Policy; and Whereas,pursuant to the New York State Environmental Quality Review Act("SEQRA")and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that adoption of this Complete Streets Policy is an Unlisted Action for which the Town Board, acting as lead agency in an environmental review with respect to the adoption of this policy, made a negative determination of environmental significance on April 13,2015, after having reviewed and accepted as adequate a Short Environmental Assessment Form Parts 1,2 and 3 prepared by the Town's Planning staff; now, therefore,be it Resolved, that the Town Board of the Town of Ithaca does hereby adopt the attached"Town of Ithaca Complete Streets Policy"and instructs Town Staff to begin implementing the same. Moved: Bill Goodman Seconded: Eric Levine Vote: Ayes—Howe,Hunter, Levine, DePaolo, Engman, Leary and Goodman TB Resolution No.2014-039: Setting a public hearing regarding a Local Law Amending the Town of Ithaca Code,Chapter 230 entitled "Streets and Sidewalks,"Amending the Town of Ithaca Code, Chapter 234 entitled "Subdivision of Land," and Amending the Town of Ithaca Code, Chapter 270 entitled "Zoning," to add References to the Town of Ithaca Complete Streets Policv Be It Resolved, that the Town Board of the Town of Ithaca will hold a public hearing at the Town Hall, 215 North Tioga Street, Ithaca, New York on the 111h day of May, 2015 at 5:30 p.m. for the purpose of considering a proposed Local Law amending the Town of Ithaca Code, Chapter 230 entitled"Streets and Sidewalks," amending the Town of Ithaca Code, Chapter 234 entitled"Subdivision of Land,"and amending the Town of Ithaca Code, Chapter 270 entitled "Zoning," to add references to the Town of Ithaca Complete Streets Policy. Resolved, that at such time and place all persons interested in the proposed Local Law may be heard concerning the same; and it is further Resolved, that the Town Clerk of the Town of Ithaca is hereby authorized and directed to publish a notice of such public hearing in the Ithaca Journal and to post a copy of same on the signboard of the Town of Ithaca. Discuss and consider approval of a request for funding from the Ithaca Area Waste Water Treatment Plant for GHD to enter into an Engineering Services Agreement for Enhanced Primary Feasibility Study for the implementation of a new contamination removal process with significant reductions in the amount of energy use. Page 15 TB Resolution No.2015-040: Approval of Request for Funding for Eneineering Services Agreement for Enhanced Primary Feasibility Study fCity of Ithaca Capital Proiect 420,1) Whereas the Ithaca Area Wastewater Treatment Plant requires constant upgrading to meet the rigorous water quality and clean energy standards embodied in its long range planning goals, and Whereas NYSERDA funded a long term pilot of a new enhanced primary treatment technology developed in New York State by Clear Cove Systems, and Whereas in order to understand the facility improvements and preliminary cost estimates for implementing a full scale system and improvements to ancillary systems a study must be conducted, and Whereas GHD Engineers has submitted a proposal for performing the study for an amount not to exceed $128,650, and Whereas the funding supplied by this resolution will be placed in accounts for City of Ithaca Capital Project 420J, and Whereas the SJC hereby recommends an amount not to exceed $128,650 to fund the proposed agreement with GHD Engineers set to expire December 31,2015, authorizing funds from Capital Reserve Account and establishing CP 420J, and Whereas the SJC hereby recommended this Capital Project 420J be contingent upon action by all wastewater partners and their respective attorneys committing their percentage of reimbursement shares to the Joint Activity Fund allocated per the Joint Sewer Agreement as follows: Municipality Percentage Project Cost City of Ithaca 57.14 $73,510.61 Town of Ithaca 40.88 52,592.12 Town of Dryden 1.98 2,547.27 $128,650.00 now therefore be it Resolved that the Town Board of the Town of Ithaca hereby approves the funding request in an amount not to exceed $52,592.12 for the study by GHD Engineers as detailed above and submitted to the Board for review and further Resolved, that the Ithaca Town Board hereby authorizes the Town Supervisor to execute the attached agreement with GHD contingent upon approval by all Ithaca Area Wastewater Treatment Plan owners, and subject to the approval of the Attorney for the Town.. Consider authorization to award Marcy Court Reconstruction Project Mr. Weber noted there are additional tasks in this project from what was originally budgeted and those are to repair/replace approximately 150 feet of damaged drainage infrastructure that was not known until recently and they will be paid for out of the Stormwater Fund; the additional costs are included in the $309,000 bid. Mr. Goodman asked if this type of project would be looked at in conjunction with the Complete Streets policy and Mr. Weber responded that he has already talked to staff and will be submitted two estimates in the future for this type of work, one as replacement in kind and the other to comply with Complete Streets. TB Resolution No. 2015- 041: Authorization to Award Contract and for Establishment of Cavital Project Fund for the Town of Ithaca Marcv Court Reconstruction Protect Whereas, at the November 10, 2014 Town Board meeting, the Town Board adopted a 2015 Ithaca Town Budget which included monies for the reconstruction of Marcy Court and identified the maximum amount of $300,000.00 to be expended by the Town of Ithaca for this improvement, and Whereas, at its regular meeting on March 9, 2015, the Town Board authorized the issuance of up to $800,000 in new general obligation serial bonds, pursuant to the provisions of the Local Finance Law, to finance the estimated cost for the 2015 Road Improvement Program, and Whereas, at its regular meeting on March 9, 2015, the Town Board determined approval, construction and implementation of the Improvement is a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, because the Action constitutes "repaving of existing highways not involving the addition of new travel lanes", "replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site," and thus approval, construction and implementation of the Improvement are not subject to review under SEQRA,and Whereas, additional drainage work was added to the roadway project to replace damaged drainage pipe that the road project was connecting to,and Whereas, on April 7, 2015 the Director of Public Works/Highway Superintendent received bids for the Town of Ithaca Marcy Court Reconstruction Project, matching the existing length and width, and other related ancillary facilities, and Whereas, the additional drainage work increased the project cost above the budgeted amount by $10,000, and Whereas, the Director of Public Works has reviewed the bids and qualifications of the bidders and determined that the low bid is from the lowest responsive and responsible bidder and Page 17 recommends that the bid of$309,000.00 made by Edger Enterprises, 330 East 14`h Street, Elmira Heights, NY 14903 be accepted, now, therefore,be it Resolved, that the Town Board of the Town of Ithaca authorizes the award of the contract for the Town of Ithaca Marcy Court Reconstruction Project to Edger Enterprises, subject to final approval of the contract documents by the Town Engineer and Attorney for the Town, and be it further Resolved, that the Town Supervisor is authorized to execute such contract upon such approval; and be it further Resolved, that the Director of Public Works is authorized to approve change orders to such contract upon receipt of appropriate justification provided that the maximum amount of such change orders shall not in the aggregate exceed $10,000.00 without prior authorization of this Board, and provided further that the total project cost, does not exceed the maximum authorized cost of the project, and be it further Resolved, that the Town Board of the Town of Ithaca hereby establishes the Town of Ithaca Marcy Court Reconstruction Capital Project Fund to record all necessary and appropriate budgetary and cash transactions for this project, and be it further Resolved, that the Town Finance Officer is directed and authorized to transfer $309,000 to this capital project fund from the sale of the 2015 Public Improvement (Serial) Bonds for the reconstruction of Marcy Court and $10,000 from Stormwater reserves for the additional drainage work. Resolution in support of April as Fair Housing Month TB Resolution No.2015 - 043: Support for Fair Housing Month—April Whereas this year marks the 47th anniversary of the passage of the U.S. Fair Housing Law,Title VIII of the Civil Rights Act of 1968, as amended,which enunciates a national policy, together with the New York State Humans Rights Law, of Fair Housing without regard to race, color, creed, sex, disability, familial or marital status, national origin,age,blindness, hearing impairment, sexual orientation, military status, use of a hearing service or guide dog, and handicap, and encourages fair housing opportunities for all citizens; and Whereas the Town of Ithaca is committed to highlighting the Fair Housing Law,Title VIII of the Civil Rights Act of 1968,by continuing to address discrimination in our community, to support programs that will educate the public about the right to equal housing opportunities, and to plan partnership efforts with other organizations to help assure every American of their right to fair housing. Now, therefore be it Resolved that the'Town of Ithaca does hereby declare that April,being Fair Housing Month, begins a year-long commemoration of the U.S. Fair Housing Law in the Town of Ithaca and urges all citizens to wholeheartedly recognize this celebration throughout the year. Report of Town Officials Ms. Ritter reported that the town has received an application for the expansion of the Claire Bridge house which will require a modification of their PDZ. They would like to add a third facility that provides a level of care between the two levels already provided to age in place.The Planning Committee will be looking at it this week. Ms. Ritter reported that Amabel is moving forward and will be going in front of the Planning Board this week and then they will come to the Town Board with a request for•a rezoning from low-density residential to medium-density residential. Ms. Ritter also reported that the East Hill Plaza shurette will be starting in early June and if anyone is interested in participating; please keep your calendar flexible. Ms. Ritter thought there would be subgroups talking with different stakeholders and then a larger meeting to talk to all stakeholders together. Mr.Weber reported that there were 72 overtime snowplowing or salting events compared to 53 for last year. 12.Report of Town Committees and Intermunicipal Organizations 13. Review of Correspondence Mr. DePaolo asked about a letter asking for an exemption to the sewer portion of the water/sewer bill for irrigation. Mr. Engman responded that he was going to bring that up,but it is very complicated in that the sewer fees are based on water consumption and there isn't an easy way to break those out. Swimming pools, the brewery and a few others have asked over the years and we have always denied them because we can't do it. Mr. Engman also noted that we have sent a packet of information to the Dryden Town Supervisor in another attempt to get payment for the sustainability intern from last year and he added that they are also in arears for payments on sewerage conveyed to the treatment plant from July-January 2014. Mr. DePaolo asked if anyone from the Lansing area was familiar with the local law they are proposing to zoning and they made a Negative Declaration of Environmental Impact for it. Ms. Brock spoke as a citizen at the meeting there saying they should do a full EIS but they declined and the law was passed. She added that as an adjoining municipality the town gets notice but there is not weight to the comments; they don't have to follow or address any comments or Page ( 12 concerns expressed. Ms. Terwilliger added that in the future she will scan and email the notices to the board as she receives them and Mr. DePaolo asked if there were staff that looked these over to see if we should be interested or involved. Some discussion followed and Ms. Hunter asked if others thought we should consider and comment on land use activities in adjoining municipalities and if so,what mechanism should we use. Mr. Engman thought if a board member had a special interest in a particular one they should bring it to the board and advocate for it and then go from there. Ms. Ritter added that we do get an opportunity to comment on a project being developed within 500 feet of our border and that holds more weight. This topic brought up the City's comprehensive planning and the thought that the board might want to invite Hollis Erb to report to the board as our liaison before she moves. Mr. Goodman stated that he was going to the presentation next week and then the board might want to discuss and consider whether we want to provide comments. The board was interested in getting someone from the city to do a presentation to the board, in particular their land use map. Ms. Hunter asked about preparations for the Emerald Ashe Borer and if we have given any thought to proactively planting some trees. Mr. Engman noted that we have an inventory of our parks and trails that will be a start but we don't know much yet. Large sections may be decimated and we need to know what kind to plant if that is what we need to do. The inventory will be a start. Ms. Hunter reported that the kickoff meeting for the Intermunicipal Organization(IO)Watershed Management Update was held and different committees were formed. The Watershed Committee will look at the goals and vision statement of the restoration and protection plan and reviewing the public input portion of the update and the technical committee is the more science based people who will be doing the actual update and reviewing submissions. She thinks they have a good representation from all around the lake and invitations will be going out for those committees. Anyone is welcome to the meetings. 14. The policy will involve the consideration of multi-modal transportation facilities during the design, construction, reconstruction, operation and maintenance of the existing and future town-wide connected network of streets, bridges,sidewalks and pathways. There may be environmental impacts related to land disturbances that would be necessary to build and upgrade bike and pedestrian facilities, along with potential stormwater impacts related to increased impervious surfaces in some areas. These potential impacts will be evaluated and addressed on an individual basis, as individual projects will be required to go through separate environmental review processes. All projects will be mitigated by the installation of proper stormwater management controls and practices, as required by the Town of Ithaca Stormwater Management Law and the NYS Department of Environmental Conservation Stormwater Management Design Manual. The benefit to the health,safety, and welfare of the general public is expected to outweigh potential environmental impacts, as the Complete Streets Policy will result in a connected sidewalkipathway system, well-designed and marked streets, safe passages for the aged and people with disabilities and more accessible streets for all users of the system. We responded to approximately 72 overtime snow plowing/salting events. • Stone was stockpiled for 2015 projects. • Christmas tree collection was completed in January. • Sign work, cold patching, pothole repairs, and shoulder patching were performed in between snow removal events. • Brush and limbs were trimmed back at various locations in Town. • Responded to a large number of plugged culverts throughout Town which were cleared out, repaired or replaced. • Our night crew ended their shift for this winter on March 20th. • Reviewed applications and scheduled interviews for Seasonal Workers. The first three Workers start April 13th. • Sent crews for Dig Safely New York Training. • Bids for 10-Wheel Dump Truck, (2) Medium Duty Dump Trucks,Grasshopper Mower, Planning vehicle, mini-excavator, sidewalk maintenance vehicle, and Utility vehicle were prepared and accepted. Our new Grasshopper Mower and sidewalk maintenance vehicle were delivered. Received delivery of two crew trucks from 2014 Fleet Replacement. • Several staff members attended a Ditch Management Seminar sponsored by Tompkins County Soil and Water Conservation. • Annual hearing tests at the Ithaca College Clinic began. Parks, Trails, and Preserves: • Weekly site inspections were performed. • Winter maintenance of the new Hanshaw Road Walkway was provided. • Hazardous tree removals at various park and trail sites and various locations in Town proceeded as weather allowed. • Met with representatives from the Cal Ripken League to discuss some field modifications. • Miscellaneous parks and grounds maintenance supplies were delivered and stored in the Annex. • The compost pile was turned monthly. • Removed trees along the proposed Gateway Trail. • New playground equipment was specified and ordered for Troy Park. Water: • Responded to 23 water main breaks. • Responded to 4 frozen water service complaints. • Ice buildup in the Christopher Tank resulted in damage to the roof of the tank. • New hydrant markers were put up on Coddington Road. First due Eng. Co. 906 arrived and confirmed th there was no fire.The pwoer to the vacuum pump was secured.There was a light smoke condition in pt of the building and PPV was set up with the electric blower off 9 to evacuate the smoke. The smoke head that had activated was cleared and the fire alarm system was restored to normal condition. It appeared that the vacuum pump had overheated and the electric motor casing had melted and was smoking. A staff member used a dry chem extinguisher on the motor.There was no damage, other than the motor itself. The vacuum pump was a GAST model 1023-Q-G 302X 230V. During the course of Fire Dept operations it was noticed that a"Fire Door"had been removed in the lab. l believe this door should be replaced. 3/11/2015 FIRE SAFETY VIOLATIONS 207 KING RD W OPEN Desc: IFD Incident Number 15-0949, Fire on top portion of metal chimney.
