The Supervisor opened the Public Hearing at 5 : 31 p . m . The Town
• Clerk had proof of Posting and publication .
The Supervisor read a letter from Frances Wilson , Trumansburg Road ,
( see attache (l ) .
The Supervisor asked for public comment .

Celia Dowers , 1406 Trumansburg Road addressed the Board and thanked
them for working on this proposal it is now better than first
considered. , Mrs . Bowers stated that the problems discussed at the
last Public hearing still exist . The Board is not keeping to the
Comprehensive Plan , liquor is not appropriate at that location ,
the property is near a fire station and hospital , and there are
emergency vehicles all the time on the road . Cornell has announced
that the medical school is going to be cooperating with Tompkins
Community hospital which will mean more medical facilities needed
in the area . The proposed building could be properly used for the
expansion of these medical facilities offices for which it is
zoned . Where is a worry about incremental use , possibly not with
this owner and "Town Board , but once zoning is changed you are
setting a precedent . Selling the kitchen equipment for someone
else to use is not a major burden on the owner . Mrs . Bowers urged
the Board not to vote in favor of this proposal .
Jane Schafrik , 1491 TTumansburg Road spoke to the Board . Mrs .
Schafrik stated she had three major concerns over the rezoning .
She feels uncomfortable with changes or different allowed uses
before the Comprehensive Plan goes into effect . 'There is great
concern over anyone who buys a piece of property and starts to
renovate it extensively before permission is granted for the uses
it is being renovated for . Does this put the Town Board and the
Planning Board in a position of pressure to approve the use ? It
seems that a line should be drawn , the Boards should not be put
under pressure just because someone has invested in a piece of
groper t v .
Mrs . Schafrik stated she has no concerns over the apartments or
business offices . Anyone who had children attending the Mayer
School can tell you picking up the children in the afternoon was a
nightmare as there is no traffic light . It is almost impossible to
cross the road . 'That would happen for catered private parties on
the property . Mr . Chiaschi is asking for a maximum of 30 functions
a year , 30 functions could mean two weekend nights for fifteen
weeks in the summer . Every weekend day in the summer there would
be traffic problems . There would also be the noise problem , even
though the functions are supposed to cease at 7 : 00 p . m . Mrs .
• Schafrik said she has never been to a wedding that stopped on time .
Mrs . Schafrik said she was not 100 % opposed to the use , but that
these are serious concerns that should be considered . Giving
permission after the fact is uncomfortable to her .
The Supervisor mentioned that the "Town of Ithaca does not issue
liquor licenses , there should not be any confusion that the Town is

approving that issue . The renovations to the building at present
are of a general nature , and are not specific to the change in
zoning being proposed .
Aethna Grover , 1486 Trumansburg Road said her main concern is the
serving of alcohol , There is no one on the Board that has to drive
the road twice or more a day , and there has been many people who
drive recklessly through the area . They have to go slow going up
the hill , but as soon as the top of the hill is reached they start
passing . It is a 55 mph speed zone . There is too much traffic now
and it will be even worse with 100 to 150 guests leaving that
location after having been drinking .
William Ilooton , Trumansburg Road said he did not feel there should
be any zoning changes . The owner bought it knowing what the zoning
was . Traffic is terrible and no more is needed ,
The Hoard discussed the various speed limits within that area . The
Supervisor noted that this area is one in which the Town has an
application submitted to the New York State Department of
Transportation for a reduction in the speed limit .
Mrs . Bowers stated the West Hill Neighborhood Association wrote the
NYSDOT asking for a reduction of the speed limit from the Town line
to the City line because of the number of driveways that enter into
the road , and the reply from them was that " there had not been
enough people killed there vet " .
The Supervisor said that she had received correspondence from the
NYSDOT about the request and they said they would not lower the
speed limit anymore than 45 mph . The Supervisor wrote back to them
and pointed: out that it is 55 mph , not 45 mph . NYSDOT then said
they would again investigate . The Highway Superintendent recently
corresponded with the NYSDOT about all the requests for speed limit
reductions . the Town is awaiting a response .
Andrea Bouie , Director of the Massage School who will be renting
the first floor of the building and one of the apartments , stated
that she feels the catering business will have no effect on their
• business or the apartments . She has no problem with the catering
business being there .
L' he Supervisor closed the Public Hearing at 5 : 45 p . m . Mrs .
Raffensperger reminded the Board that at the last meeting several
changes were made in the Local Law which necessitated the
additional Public Bearing .

'1• he primary change had to do with on premise catering functions .
The new restriction is that " no such functions will occur or
continue between the hours of 7100 p . m . and 7100 a . m " . The second
change was " that regardless of the hours the function ends there
will be no amplified music outside the building " . and " all
functions are to be for private groups and functions " .
Councilman Klein addressed the revision on Page 2 , Paragraph A .
that states , there will be no more than 30 such functions per
year of which no more than 10 will be weekday evenings " . That was
appropriate with the hours of operation until 10100 or 11. 100 p . m .
Since the proposed draft prohibits any function past 7100 p . m . that
may be too restrictive . Councilman Klein asked that item be
amended .
The Supervisor said that Councilman Klein could make an amendment
at the proper time if he wished .
Councilwoman Leary said that a comment was made about the plans for
the Tompkins Community Hospital and their plans with Cornell
University . This is the first Councilwoman Leary had heard about
expanding the facility , and asked if this was just Mrs . Bowers
assumption . The hospital has not notified the Town that they will
be expanding .
Mrs . Mowers responded that she had read about it in the newspaper ,
and that when any University uses other facilities for teaching , it
can he expected that they will look for expansion because more
People will be needing housing . There . will be more hospital
related traffic .
The Supervisor stated that the only proposal that is before the
Town in relation to the Cornell expansion is the housing of five
interns on the hospital grounds .
Councilwoman Leary thought that the changes made last meeting
addressed the major concerns of the neighborhood and was
disappointed that no ' expression of satisfaction with any of those
. . changes seemed evident . it appears that no matter what the Board
dial the neighborhood is opposed to the project because it will
increase traffic and alcohol consumption . Councilwoman Leary said
she was happy with the changes made .
Mrs . Schafrik asked what recourse there would be if the functions
continue past the allotted time and the music is loud outside ?

The Supervisor explained that it would be an ordinance enforced by
the Sheriff just as the noise ordinance is .
Attorney Barney said that it would be subject to the Zoning
Ordinance also with a fine and possible prison term .
Mr . Hooton said there was a noise problem because of the amplified
music when Cornell University owncd it . The Sheriff was called and
nothing was done .
The Supervisor noted that Cornell University owned it before the
Noise Ordinance was adopted . Those were some of the reasons why
the Noise Ordinance was adopted .
Councilwoman Leary pointed. out that this is not fraternity houses ,
this is a business person with an established reputation . There
are a great many safeguards in the proposed Local Law there
shouldn ' t be major problems .
Attorney Barney said the proposed Local Law expressly provides for
no amplified music outside the building which was not the case when
Cornell University owned it .
Councilman Whitcomb recalled that at the last meeting the proposal
was about to die when someone suggested that if the caterer was
unable to obtain an on premises liquor license he would be unable
to obtain an off premises license .
The Supervisor recalled that the caterer would have to get single
liquor licenses for each off premise function . This was considered
to be a major concern and cost by the Planning Doard .
Councilman Whitcomb thought that would impede the caterers ability
to conduct off premises functions considerably . That is why the
Board developed these compromises .
Mr . Chiaschi said that the caterer would have to have seating for
50 people and a k tchen to show the ABC Board . If he had an off
premise catering he would use the same license . but would get a
• daily catering permit . With not having the liquor license at all
he would not be able to get a catering permit .
Councilman Whitcomb said that if the caterer were prohibited by
this ordinance from having on premises functions , would be able to
obtain the off premise license ?
Mr . Chiaschi said that no he could not get the license .

Mr . Barney said that the consequence would the caterer could not
have an off premise license and would have to contract that part of
the function to another business .
Mr . Chiaschi said that would be a major blow to the business .
The Supervisor allowed KryS Cail to address the Board .
Krys Cail said that she is very interested in the relationship
between the lessee and the other restaurants that have liquor
licenses . Does the individual who is intending to use this space
have liquor licenses in any other establishment in Tompkins County ?
Mr . Chiaschi responded no , if he did he would not have the need for
the means to obtain a license .
Ms . Cail said that she felt it is very difficult to separate
individuals and individual needs from the permanent use of a
building ' or premises . She is very interested and concerned about
uses of other future leases . If an original occupant did not make
a go of their venture , could a case be made in court that the 7 : 00
p . m , time limit was to early to close an establishment that has a
liquor license and make a profit . If as a juror it was mentioned
that this use was allowed but there was a stipulation that it
stopped at 7 : 00 p . me it might seem to be an unreasonable burden .
Most of what is planned there is very positive . Ms . Cail was not
overly concerned about the traffic implications . The traffic light
at the hospital has a very good impact on the flow of traffic . The
alcohol is a concern , not necessarily in this configuration . More
information is needed about the implications of what having an
alcohol license at the premises in the future means .
Attorney Barnev said that it is very difficult to predict what the
court would do with any issue in the future . The opportunity that
is being given by the legislation has a number of uses . There are
functions without alcohol . You could rent apartments and offices .
If it were taken to court asking for an amendment because the
business was not making it , and the Town chose not to amend it and
• said these were the parameters at that time , there should not be
too much difficulty sustaining the 'Towns position . The Town has
developed a legislative history of the reasons for considering the
alcohol at all . It is really an accommodation to allow off
Premises uses of alcohol in conjunction with a business being able
to serve it off premises .

Councilwoman Leary Pointed out that it states in the Local Law that
any of them references to the catering either on premise or off
premise is preceded by the statement " only as long as it is owned
by the same landowner " . This is another safeguard ,
Supervisor Raffensperger stated that she was originally very
opposed to the on premises catering , She has come to feel that the
compromises the Board made , such as no amplified music outside and
the functions being discontinued by 7 : 00 p . mo met most of her
concerns .
Agenda Item No . 4 - SEQR , " LOCAL LAW TO _AMEND THE ZONING ORDINANCP.
PROVISIONS RELATING TO THE SPECIAL LAND USE, DISTRICT ( LIMITED MIXED

Motion made by Councilman Klein , seconded by Councilman Liguori
adopting a Negative Determination of Environmental Significance in
accordance with the New York State Environmental Quality Review Act
for the Proposed Local I ., aw .
Councilwoman Valentino asked. that the record show she is abstaining
from voting on this issue due to a possible conflict of interest ,
Supervisor Raffensperger , aye ; Councilman Whitcomb , aye ;
Councilwoman Valentino , abstain ; Councilman Liguori , aye ;
Councilwoman Leary , aye ; Councilman Klein , aye . Motion carried .
Agenda I tem No . 5 - Adoption , LOCAL_ LAW TO AMEND TIIE ZONING
ORDINANCE PROVISIONS RELATING TO THE SPECIAL LAND USE DISTRICT
( LIMITED MIXED USE ) AT T1113 FORMER CORNELI , UNIVERSITY STATLER WEST
COMPLEX TO ALLOW ADDITIONAL USES
Motion made by Councilman Klein to amend the proposed Local Law ,
on Page 2 , Number 2 , ( ii ) , ( A ) to read from ; " there will be no more
than 30 such functions per year of which no more than 10 shall be
on weekday evenings " ; to " there will be no more than 30 such
functions per. year " . Seconded by Supervisor Raffensperger .

Councilman Whitcomb stated that at the last meeting he did not
think the on premises catering was an appropriate use . IIe was
convinced that on premises catering was needed because of the
problems with the liquor license for the off premises catering .
However , he still felt it is not an appropriate use of the property
and. since he felt that he was unable to convince the Board of that
at the last meeting he would not be able to do so now . For the
record , Councilman Whitcomb said he was opposed to the Local Law .
Roll call vote called . Supervisor Raffensperger , aye ; Councilman
Whitcomb , nay ; Councilwoman Valentino , abstain ; Councilman i , iguori ,
aye ; Councilwoman Leary , aye ; Councilman Klein , aye . Motion
carried .
A-Lenda Itcm No . 6 - Hasbrouck Apartments
Town Engineer , Daniel Walker explained that Ilasbrouck Apartments is
a Cornell University residence facility which is in the process of
being expanded by 92 units , from 246 units .
The flealth :Department has been concerned with the sewer capacity
because of history of overflows in the Kline Road area , lake
Street . One of the conditions before expansion was that the
capacity problem had to be corrected .
The Kline Road bypass is currently under construction and. will be
operational by August 9 . Mr . Walker is satisfied this arrangement
meets the sanitary sewer requirements and recommends the acceptance
of these arrangements as meeting the conditions for approval .
There was also concern about water pressure and fire code
compliance . In conversations with the Building Officer the
sprinkler system is constructed and the tests have shown it will
meet the fire codes .
Cornell is also offering to fund two additional fire hydrants to be
installed on the transmission main owned by Bolton Point .
Motion made by Supervisor Raffensperger , seconded by Councilman
Liguori that as the Town Engineer has accepted arrangements by
• Cornell University to provide adequate water and sewer service to
the Hasbrouck Apartments to serve the proposed expansion the Town
Board accepts these arrangements as meeting the condition set by
the Final Approval of the Planning Board and that the issuance of
Certificates of Occupancy is authorized pending all requirements
for such issuance having been met to the satisfaction of the Code
Enforcement Officer / Duilding Inspector .

Councilman Liguori asked if the existing water were from the
Cornell system , and will it tie into Bolton Point just for fire
hydrants ?
Mr . Walker responded that the existing water is from the Cornell
system , and the fire hydrant is not up to full standards within the
complex although the sprinkler system has been designed to function
properly with the existing pressure from their own water . There
are provisions in the future to upgrade the whole system .
Safeguards that are used presently meet the standards .
Councilwoman Valentino asked how Cornell pays for using hydrants ?
Mr . Walker responded that is a flat charge each year . The details
have not been agreed upon , but Cornell has agreed to fund that .
This could be added to the resolution as an amendment for the
satisfactory completion of an agreement with Cornell for an annual
fee paid for hydrant use .
Supervisor Raffensperger amended the resolution to include , " the
satisfactory completion of an agreement with Cornell for an annual
fee paid for hydrant use " . Councilman Liguori approved the
amendment .
Motion called with amendment . Carried unanimously .
Agenda 1 tem No . 7 - Regues_t_ To _NYS_DOT _ for Speed Limit Reduction
Trov Road and Bundy Road
The Supervisor explained that Ward A . 11ung. erford , Tompkins County
highway Manager wrote asking that the Town Board approve a request
to a lower maximum speed limit on Troy Road from Coddington Road to
East King Road , and on Bundy Road .
Motion made by Councilman Liguori , seconded by Councilman Klein
approving the request for a reduced speed limit on Troy Road from
Coddington Road to East King Road , and on Bundy Road , and that the
Town Clerk is instructed to complete the TE Form along with a
certified copy of the resolution to Ward IIungerford for submission
• to the NYSDOT .
Cotncilman Whitcomb questioned why Mr . IIungerford cut the Troy Road
change off at King Road rather than extend it a few more yards to
the 'Down line . The density of houses on the upper end of Troy Road
is not significantly less than on the lower end , and the upper end
Of "Trov ( toad beyond King Road had an incline coming into the
intersection ,

Councilwoman Valentino asked what the speed limit is there ?
The Supervisor responded that the speed limit is 55 mph , when
making the request you only ask for a reduction not a set speed
limit .
Councilman Whitcomb surmised the State would lower it to 45 mph
since all the roads around that area are that speed limit .
Councilman Liguori approved an amendment to the resolution stating
that the speed limit be reduced on Troy Road from Coddington Road
to the Town line . Amendment seconded by Councilman Klein .
Councilman Whitcomb wondered if the amendment would make it less
likely for the State to approve a speed limit reduction if they
didn ' t like the amendment to the upper end , or would they exercise
latitude themselves and change the boundary as they saw fit ?
The Supervisor mentioned that another time the Board was worried
about that possibility it was broken in to two sections . A request
was made for one section and another separately .
Motion called and carried unanimously .
Additional Agenda item - - Request of Bicycle Group , Rt . 89
The Supervisor explained that the bicycle group represented by
David Nutter has been involved with NYSDOT on the Route 89 issue .
Mr . Nutter has been going to the meetings and done an excellent job
negotiating with DOT on the problems on Route 89 ,
Mr . Nutter contacted the Supervisor and asked if she could receive
Board authorization to write a letter to NYSDOT encouraging them in
their review of the 55 mph speed limit on Route 89 to consider a
transition speed zone . The speed limit goes from 30 mph in the
City to 55 mph in the Town .
Motion made by Councilwoman Valentino authorizing the Supervisor to
correspond with Harry Carlson , Regional Director of Transportation ,
New York State Department of Transportation asking that a
• transition speed zone be placed on Route 89 between the City speed
limit of 30 mph and the Town speed limit of 55 mph . Seconded by
Councilman Liguori . Carried unanimously .

discuss potential litigation and land acquisition . Carried
unanimously .
The Board moved into J ? xecutive Session at 6 : 17 p . m .
Motion made by Supervisor Raffensperger , seconded by Councilman
Whitcomb that the Board move back into regular session at 6 : 35 p . m .
Addi_ tienal Agenda ._ Item - Forest home Bridge Walkway
Councilwoman Leary asked if it would be possible that the walkway
on the Forest home Bridge he opened even though the repairs are not
completed. with a caution notice erected ?
The St.ipervisor explained that she has received correspondence that
Tompkins County has promised to complete repairs and have the
bridge walkway reopened by August 15 .

As there was no further business to come before the Board ,
Si-ipervisor Raffensperger made a motion to adjourn . Seconded by
Councilman Whitcomb . Carried unanimously .

SEQR - Local Law to Amend Zoning Ordinance
Special Land Use District - 1251 Trumansburg Road
Resolution No . 214
WHEREAS . this action is the consideration of the proposed
" LOCAL LAW TO AMEND THE ZONING ORDINANCE PROVISIONS RELATING TO THE
SPECIAL LAND USE DISTRICT ( LIMITED MIXED USE ) AT THE FORMER CORNELL
UNIVERSITY STATLER WEST COMPLEX TO ALLOW ADDITIONAL USES " ; and
WHEREAS , this is an Unlisted Action for which the Town of
Ithaca Town Board has been legislatively determined to act as Lead
Agency in environmental review ; and
WIIEREAS , the Town Hoard , at their July 26 , 1993 special
meeting , has reviewed the proposed Local Law , and the Short

WHEREAS , the Town Planner has recommended a Negative
Determination of Environmental Sig-nificance in for the proposed
action ; now therefore be it
RESOLVED , that the Town Board hereby makes a Negative
Determination of Environmental Significance in accordance with the
New York State Environmental Quality Review Act for the proposed
" LOCAL LAW TO AMEND THE ZONING ORDINANCE PROVISIONS RELATING TO THE
SPECIAL LAND USE DISTRICT ( LIMITED M I XED USE ) AT THE FORMER CORNELL

therefore an Environmental Impact Statement will not be required .

Resolution No . 215
WHEREAS , the properly advertised Public hearing has been held
for the purpose of considering the adoption of a " LOCAL LAW TO
AMEND THE ZONING ORDINANCE PROVISIONS RELATING TO THE, SPECIAL LAND
USE DISTRICT ( LIMITED MIXED USE ) AT THE FORMER CORNELL UNIVERSITY
STATLER WEST COMPLEX TO ALLOW ADDITIONAL USES " ; now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca does
hereby approve and adopt said Local Law ; and be it further
RESOLVED9 that the Town Clerk is hereby authorized and
directed to file said Local Law as required by law .

WHEREAS , the 'Town Engineer has accepted arrangements by
Cornell University to provide adequate water and sewer service to
the Hasbrouck Apartments to serve the proposed expansion ; now
therefore be it
RESOLVED , that the 'Town Board accepts these arrangements as
meeting the condition set by the Final Approval of the Planning
Board and that the issuance of Certificates of Occupancy is
authorized pending all requirements for such issuance having been
met to the satisfaction of the Code Enforcement Officer / Building
Inspector ; and be it further

AMENDMLNT :
RESOLVED , that the Town Board accepts these arrangements upon
the satisfactory completion of an agreement with Cornell University
for an annual fee paid for hydrant use .

• Request for Speed Limit Reduction - Troy Road , Bundy Road
Resolution No . 217
WHEREAS , Ward A Hungerford , Tompkins County Highway Manager
has been contacted by residents on Troy Road and Bundy Road asking
that the speed limit be reduced on Troy Road from Coddington Road
to East King Road , and on Bundy Road ; and
WHEREAS , Mr . Iungerford is in support of reducing the speed
limits on these roads and has communicated such to the Town
Supervisor in a letter dated July 14 , 1993 ; now therefore be it
RESOLVED , the Town Board of the Town of Ithaca does hereby
approve the request for a reduced speed limit on Troy Road from
Coddington Road to East King Road , and on Troy Road from Last King
Road to the "Town of Ithaca town line , and on Bundy Road ; and be it
further
RESOLVED , that the Town Clerk is hereby authorized and
directed to complete and forward the TE Form and a certified copy
of this resolution to Ward Iungerford , Tompkins County IIighway
Manager who will submit both to the New York State Department of
Transportation for their review and determination .

Transition Speed Zone - Rt . 89

BE IT .RESOLVED , that the Town Supervisor is hereby authorized
and directed to correspond with Harry Carlson , Regional Director of
Transportation , New York State Department of Transportation asking
that a transition speed zone be placed on Route 89 between the City
of Ithaca speed limit of 30 mph and the Town of Ithaca speed limit
of 55 mph .
