Call to Order : The Supervisor called the meeting to order at 5 : 30 p . in Aee_pda Item No . 3 - Report of Town Officials • a . Town Supervisor - The Policy Committee of the Ithaca Tompkins County 'lransportation Council , also known as the MPO , met June 8 with David 1_loyd , the new Director . Mr . Boyd has been meeting with Policy committee members individually to orient himself as to the special transportation concerns of each municipality . The Supervisor discussed the Town ' s interest in plans for improved circulation in the eastern areas of the Town , in cooperation with 1 1 i TB Minutes 7 / 12 / 93 Page 2 . • A9enda Item No . 3 - Cont ' d the "Town of Lansing and the Village of Lansing , the Town of Dryden and Cornell Universitv , Tompkins County Planning has been asked to make an initial environmental and engineering evaluation of possible routes between Rorrte 34 and 366 ( for the '[' own of Ithaca , the Forest Ilome bypass ) ; that evaluation is underway . The Policy (: OnlmiItee members of the MPC) presented the concept to NYS DOT ; as reported before , representatives of NYS1)0 ' I ' expressed the opinion that such a road would he a local improvement , not eligible presently frar state funding . Its inclusion in the MPO ' s long range plan might change that status . Mr . Boyd was provided with information concerning the concept and the Supervisor is confident that he will follow up with Tompkins County Planning . This organization gives the community , for the first time , a structure for intermunicipaI transportation planning . The Supervisor is confident Mr . Boyd will not allow the efforts to die by inaction and lack of follow up , as they have in the past . The Supervisor provided a copy of a letter to Harry Carlson , NYSI )OT from Mr . 130Yd , addressing possible solutions to the guardrail and related problems on Route 89 . ' [ ' his is for the Cloards information only but also indicates I I I e type of assistance the MPO can provide locally . The Supervisor attended other meetings , the results of which are reflected i. n several agenda items - Park Lane Extension , PILOT PTOPosaI for Ellis hollow Elderly , and Personnel and Public Works matters . h . Town Engineer - Mr . Walker reported on his written report , ( see attached ) . c . highway Superintendent - Mr . Noteboom reported on his written report , ( see attached ) . The highway has stockpiled approximately 2000 tons of gravel salvaged from the Inlet project . Councilman Wllitco it, b thanked the highway Superintendent for having his report submitted in the Town Hoard packets before the meeting . d . Building Inspector / Zoning Officer - Mr . Frost reviewed his an- ittell report and the financial report for the first six months of the year with the Board , ( see attached ) . • e . '] ' own Planner - Mr . Forman commented on r ' Irs written report , ( see attached ) . f . Receiver of Taxes - Mrs . Noteboom reviewed her written report with the Board , ( see attached ) . The Supervisor thanked Mrs Noteboom for the efficiency with the Tax Collection process this Year . 1 1 • 1 f TB Minutes 7 / 12 / 93 Page 3 . • Agenda Ttem No . 4 - Report of Town Committees There were no committee reports . Agenda Item No . 1. 6 - Conservation Board Appointment The Supervi ;sor explained that there is a letter from the Chair of the Conservation Board recommending the appointment of Cheryl Smith , 104 Skyview Road to the Conservation Board for a term of office to commence immediately through December 31 , 1994 . Motion made by Councilwoman Valentino appointing Cheryl Smith as a member of the Conservation Board for the term of office referenced . Seconded by Councilman Niklas . Carried unanimously . Agenda _ item No 17 - Revisions to PILOT , In Lieu of Taxes Agreement , Ellis hollow The Supervisor explained the amendatory agreement reflects that F_ llis hollow Associates will pay an amount of either $ 20 , 000 or a sum that represents 10 `,K of the net rents received . The Supervisor and Town Attorney met with the Attorney for Ellis hollow Associates and the Manager . Phis is an agreement they would like to see the Town proceed. with . The County has stated they will agree to the results of any negotiations with Ellis Hollow Associates . Attorney Barney explained there is a cost to the Town in that the payment in Lieu of Taxes will be somewhat less , but that is the problem Ellis Hollow Associates is having . Motion made by Councilman Niklas authorizing the Town Supervisor to sign the agreement with such modifications as deemed appropriate by the Town Supervisor and the Town Attorney , with the understanding that the pas t due taxes for the faci 1 i t wi 11 be paid . Seconded by Councilwoman Valentino . Councilwoman Valentino mentioned that it did not look to be much of a reduction . Supervisor Raffensperger said it would be more than the $ 20 , 000 , but a great deal more than has been paid in the last five years which is zero . This is a reasonable arrangement to make based on • the Ellis llollow Associates financial standing . Councilman Liguori asked how many more years the original agreement is in force , and if at that time the low rent part of the agreement discontinues ? Attorney Barney said it continues for the life of the mortgage which is insured for the length by FIIA through HUD . A regulatory agreement was signed to get reduced interests rates and is the basis for allowing the Town and other taxing entities to allow a tax exemption . It is not known what will happen at the end of the mortgage . Motion carried unanimously . Agenda Item No . 18 - Revised Personnel Manual The Supervisor said these revisions have been reviewed by the Board previously . All revisions have been marked within the document . There is an error in the revised version under " death of immediate family " , the top paragraph shall be omitted as there was a change approved by the Board on this issue a year ago . The Personnel Committee has reviewed each revision separately . Motion made by Councilman Niklas , seconded by Councilman Liguori approving the revised Personnel Manual . Carried unanimously . Agenda Item No . 1. 9 - 1. 994 Salary Pool The Personnel Committee has recommended approval of a salary pool for 1994 of 4 % over the 1993 base salaries . This provides a pool that will he used for various percentage increases for varying employees . It does not mean each employee will receive 4 `b . The Personnel Committee discussed this thoroughly . there was regret expressed that the Town cannot provide more than a 4 % pool because Of the current economic climate . however , it does exceed the rate of inflation . Motion made by the Supervisor approving the 1. 994 Salary Pool at 41,% . Seconded by Councilman Niklas . Carried unanimously . Agenda Item No . 20 = Status , Salary Change - Sharon Lewis Deputy Clerk The Town Clerk stated Ms . Lewis was hired in December to work at the front desk answering phones and helping Mrs . Poole . The other Department heads have complimented her efforts , she is doing an excellent job . The Town Clerk asked that Ms . Lewis be approved for regular employee status , and that she be given a salary increase from $ 6 . 50 to $ 7 . 25 per hour . Motion made by Councilwoman Valentino , seconded by Councilman Niklas approving the status change and increase In salary for Sharon Lewis , Deputy Town Clerk from $ 6 . 50 to $ 7 . 25 per hour . 1 1 1 TB Minutes 7 / 12 / 93 Page 5 . • Agenda Item No . 21 - Status . Salary Change - Timothy Cighmey , Highway Laborer Mr . Noteboom reported that Mr . Eighmey has been with the Town for six months and is a very aggressive employee who is always looking for things to do and as he learns more is becoming more valuable to the Town . Mr . Noteboom asked that Mr . F_ ighmey ' s status be changed to that of regular employee and that he receive a salary increase from $ 6 . 00 to $ 6 . 50 per hour . Motion made by Councilman Niklas approving the regular employee status for Timothy Eighmey with a salary increase from $ 6 . 00 to $ 6 . 50 per hour retroactive to July 4 . 1993 . Seconded by Councilman Whitcomb . Carried unanimously . Agenda Item No . 23 - Ratification of employment , Richard Tenkate Hhw� Laborer Mr . Noteboom stated Mr . Tenkate is presently hired , he worked his first week on the South I I i I I frail cutting brush . It was a good test of his character and he is still with the Town . Mr . Noteboom asked for ratification of his employment at a salary of $ 6 . 00 per hour . Councilman Whitcomb asked if this position was a replacement ? Mr . Noteboom responded , yes . Motion made by Councilman Whitcomb ratifying the employment of Richard Tenkate as Laborer in the Highway Department at an hourly wage of $ 6 . 00 per hour with a six - month probationary period . All benefits applicable to a regular . full - time employee apply . Seconded by Councilman Niklas . Carried unanimously . Agenda Item No . 22 .. - Change Status , ,... Salary Increase - Mary Bryant . Administrative Secretary Mr . Walker explained that as of the first of the year Mrs . Bryant took over the responsibilities of the secretarial work in the Planning and Ungineering Departments . Mr . Walker recommended that Mrs . Bryant be given permanent status and that her salary be adjusted from $ 25 . 000 to $ 255500 . ' Hie Supervisor mentioned that Mrs . Rryant bas icIv assumed the responsibilities of Mrs . Fuller when she retired . Motion made by Councilman Niklas , seconded by Councilman Klein approving the regular employment status of Mary flryant , Administrative Secretary with a salary increase from $ 25 , 000 to $ 25 , 500 effective July 1 , 1993 . Carried unanimously . 1 1 1 1' B Minutes 7 / 12 / 93 Page 6 . ® Agenda Item No . 24 - Deputy Highway Superintendent Job Description The Supervisor explained that the Personnel Committee has made a recommendation of approval of the Deputy Highway Superintendent job description . It was discovered that the appointment was made a few years ago but there did not seem to be an approved job description . Motion made by Councilman Niklas , seconded by Councilwoman Valentino approving the job description for Deputy Highway Superintendent . Councilman Whitcomb said he felt the description was very well written . Councilman Whitcomb asked if the Town presently had an Acting Deputy Ilighway Superintendent ? The Supervisor responded no , the Town has an Acting Ilighway Superintendent . Councilman Niklas stated that the Acting Highway Superintendent then has a demanding role . Motion carried unanimously . Agenda Item No . 25 - Appointment Planner 1 Mr . Forman said that Louise Raimondo has been hired , and started today to f i 11 the vacant Planner I pos i t ion . Ms . Raimondo has been an Environmental Planner with the City of Rochester , and also at Wisconsin . Ms . Raimondo has a masters degree in Environmental Science . Ms . Raimondo ' s degree and broad skills will be a definite benefit to the Town . Mr . Forman asked for ratification of approval of appointment of Ms . Raimondo . Councilman 'Whitcomb made a motion appointing Louise Raimondo , as Planner I effective July 12 , 1993 at an annual salary of $ 22 , 000 with a six - month probationary period and all benefits granted to a full - time regular employee . Seconded by Councilman Niklas . Carried unanimously . Councilman Niklas asked if Ms . Raimondo would be the liaison for the Codes and Ordinances Committee ? Mr . Forman responded , yes . Agenda Item No . 26 - Safety Committee Report Mr . Frost reported that some electrical work was performed in the Town Hall during the month to comply with the Department of Labor inspection on the building . The Department of Labor gave the Town 1 1 1 TH Minutes 1 / 12 / 93 Page 7 . • Agenda Item No . 26 - Con t ' d until July 6 to make some electrical changes . More electrical outlets will be installed to increase accessibility and to reduce the use of extension cords . The Department of Labor report also includes the preparation of a hazardous materials plan before December 1993 . That plan would include for example , if the Highway Department were to come upon " hazardous liquids " going down the road a plan of what they would do and how they would respond . The City of Ithaca officials will be meeting with the Town and Fire Chief Wilbur to look at a disaster plan to deal better with things such as flooding . The City of Ithaca also had in the Department of Labor inspection comments about their hazardous materials , so an overall plain will be looked at with the City . As part of the Records Management Program if there were a fire any materials in the vault that received water and smoke damage can be frozen to try to salvage them . Mr . Frost has made arrangements with Ithaca College to provide freezer space if necessary in a disaster situation . Depending on the time of year will determine how much freezer space Ithaca College would have , so Mr . Frost is also negotiating with Cornell University for additional space . The Supervisor appreciated the way that Mr . Frost so quickly met the requirement of the Department of Labor concerning the electrical violations as the Department of Labor did not give the Town very much time to comply . Agenda Item No . 21 - "Town Justices Mandatory _1' raini _ Seminar Tile Supervisor explained this item is authorized each year so the Town Justices to attend the mandatory seminar . Motion made by Supervisor Raffensperger authorizing Justice Merton Wallenbeck and Justice Warren Blye to attend the mandatory training seminar at the St . Lawrence University in Canton at a cost not to exceed $ 750 . 00 each . Seconded by Councilwoman Valentino . Carried unanimous 1 ,71 The Supervisor reported that Justice Wallenbeck is ill , and wished him well . The Supervisor is somewhat concerned that Justice Blye • is having to cover for Mr . Wallenbeck . Mrs . Wallenbeck is continuing to act as Court Clerk for Mr . Wallenbeck ' s cases . Agenda Item No . 28 , Tompkins Cou n ntY—Sow and Jce Removal Contract - - m _ . C011rt 1louse Lease - — - ----- - Attorney Darney reported that the County Attorney and he have reached consensus , and the County Attorney has been sent the 1 1 1 i TB Minutes 7 / 12 / 93 Page 8 . • Agenda Item No . 28 - Cont ' d revised agreements . The Town is waiting for a response from the County Attorney , The Supervisor mentioned this agenda item will be scheduled for the August meeting . Agenda Item No . 29 - Annual Duel Contract Flids Mr . Noteboom said that through the bidding process no bids were received . Mr . Noteboom is investigating the prices for a Town containment system . Attorney Varney said that the bids could be readvertised . Mr . Noteboom sent a letter from Agway to Mr . Barney outlining what the reasons they did not bid basicly it was because of what Andree Petroleum stated last year . Starr Oil Company has just changed ownership and they would have had a cash flow problem if they had taken the bid , because they pay for the fuel immediately upon receiving it . They felt they would not have been competitive if they had bid. . Supervisor R. affensperger mentioned whether the Town could use the County contract . The County contract can only ; be used if the Town were to buy in bulk , using Town above ground storage tanks . Mr . Noteboom is looking into the cost and installation of those tanks and what the pay back would be on the Town having their own tanks . Mr . Noteboom stated he hopes to have that information ready to present to the Public Works Committee next week . Councilman Niklas said that there must be some way of avoiding a " catch 22 " situation when no bids are received . Attorney Barney said that it qua 1 i f ies as an emergency , or shut the vehicles down . Negotiations may be attempted with the present company to extend the contract . Mr . Noteboom said that lie has spoken to Andree Petroleum , the present contract holder and there is no problem with them • continuing with the present pricing and contract . Councilman Whitcomb said lie would like to have the bids readvertised . Councilman Whitcomb is not in favor of the Town installing tanks because the environmental regulations are now very strict . 1 1 1 YH Minutes 7 / 12 / 93 I' age 9 . Aeenda Item No . 29 - Con t ' d Councilman Niklas asked if the circumstances will bids would be rcce° ived if readvertised . change so that 1lie Supervisor responded Ihat contacting the suppliers and telling them we have not received bids could make them feel their bids are more competitive than thev felt originally . Attorney Barney said the problem is drawing the bid specifications in a way that protects the Town to pricing over the life of the one year contract . The supplier gives its a price and that price is not a price they intend to honor for a year because the price of oil products is so volatile . The Town attempted to try and tie the specii' icatiors to some extrinsic source . Mr . Noteboom and Attorney Harney worked extensively on figuring an extrinsic measure to tie in a price when the price goes up at the rack , Ihen our supplier work . could agree . It may be Ilrat a shorter term of the contract would C; ounci ] mail Niklas asked if there were any national statistics the supplier coi.rld use of the pricing ? Attorney lSarney said there are an inordinate amount of statistics on pricing , none of which are in and among themselves reliable . Councilman Klein asked why Agway did not 1 ) id . Mr . Noteboom said that they informed him they would not submit a bid , and he asked them to send a let Ter as to why . The letter basicly indicated they do not like to bid against the rack pricing They would rather hid based on the retail pricing . Attorney Bartley and Mr . Noteboom will review the bid specifications and see if they can be modified based on the average retail price , hnt the Town will not know what that price would he without an extensive monitoring system of the prices Councilman Klein said the I' ublic Works Committee discussed the issue of a seli containment system , and Mr . Walker and Mr . Noteboom said they lilted the system now because of the control for authorization of buying the fuel . There is now an effective tracking system . If the Town had the tanks , there may be more • potential for abuse and a more extensive record keeping system . Mr . Noteboom said he would gather the information . The tanks also have that kind of system with those kind of primps , the systems can he compared . 1 1 1 iB Minutes 7 / 12 / 93 Page 10 . • Agenda Item No . 29 - Cont ' d The Supervisor noted that Mr . Noteboom is committed to bringing the information for our own tanks to the Public Works Committee and the Board . Councilman :Liguori made the suggestion that the present contract with Andree Petroleum be extended on a month to month basis . Motion made by Councilman Liguori authorizing the continuation of the Annual Puel Contract with Andree Petroleum beyond the contract termination date of August 10 , 1993 on a month to month basis , and authorizing the Acting Highway Superintendent and the Town Attorney to review the bid specifications and advertise for submission of bids if deemed appropriate . Seconded by Councilman Klein . Carried unanimously . Agenda Item No . 30 - Fall Brush and Leaf Pick - up Superintendent Noteboom stated the dates he has chosen for the brush pick - up are October 1. 8 through October 22 , and for the leaf pick - up from through November 1 to November 12 , if the leaves fall and it doesn ' t snow . Motion made by Councilman Niklas that October 18 to October 22 will be the dates when the highway Department will pick up brush for residents , and November 1 to November 12 will be the dates when they will pick - up leaves . Seconded by Councilman Liguori . Carried unanimously . Agenda Item No . 32 - Schickel Water District Negotiations Mr . Walker explained he has the completed 90 % of the design for a water and sewer extension in the Schickel }load area , the water is the most critical . The basic water service in the area which would give marginal pressure 1) 11t wouI d serve the three existing Properties would cost a ]) oilt $ 40 , 0006 To maintain good water Pressure ( over 40 pounds of pressure ) in that area there would have to be a PItB plant at the intersection which would add $ 35 , 000 to the project . Without the PRB plant the pressure would be up to 20 pounds . CLArrently the two houses that have " town water " have booster pumps installed which could work for the low pressure • situation . Mr . Walker did not feel that would be a good situation . As a phased operation the extension could be completed , deal with the low pressure on a short term basis and increase the pressure with a change in the PRB at a later date . The third property is presently being sold and the new owner has discussed with Mr . Walker wanting sewer provided to the property , and he would consider contributing to the water line and the sewer . Fx tend ing the sewer to the three existing douses would cost about $ 30 , 000 . 1 1 1 I FR Minutes 7 / 12 / 93 Page 11 . • Agenda Item No . 32 - Cont ' d The purchaser of the property is planning on building a house on the corner lot , he would be paying approximately a $ 6000 for a septic system . The new owner would rather put in a sewer . The fourth lot ownership at present is a legal question . Councilman Liguori asked if the Town had the extra $ 30 , 000 . Mr . Walker responded there is money in the budget of $ 40 , 000 to $ 60 , 000 available for repairs and minor extensions . Councilman Liguori said the major cost would be installing the lower pressure water extension and the sewer , would it prove to be more beneficial to do the pressure change now ? Mr . Walker said that if the pressure change is done it would be able to serve the big parcel that could be subdivided which would be an advantage to the owner of that parcel . The Supervisor noted that the larger parcel is presently owned by Citizens Savings flank . It malces sense that the Town will provide water to those properties the Town is obligated to , if they wish to have water of sufficient pressure to serve the other large parcel the owner of that property should participate . Councilman Liguori asked if water could be extended to the large parcel with the lower pressure extension ? Mr . Walker said the lower part corner of the large parcel could be served with the lower pressure extension , but not the back part . Councilman Liguori asked if it would work if it were pumped in the btui lding ? Mr . Walker mentioned that would not he acceptable to the Ilealth Department . The three properties currently served by the Town have a existing low pressure condition which would be acceptable , not preferable , for pumping to serve the larger parcel the higher pressure would be necessary . Mr . 1" rost interjected that the minimum requirement is 20 P . S . I . , • but if there are pumps in the individual homes then the Town is technically obligated to maintain those pumps to maintain the pressure . Mr . Walker said lie thought that was not quite correct , the Town must maintain 20 P . S . I . at the hydrant . 1' i TB Minutes 7 / 12 / 93 Page 12 . • Agenda Item No . 32 - Cont ' d The Supervisor recalled that the residents who are receiving " public water " are in a Town of Ithaca district . they are receiving spring water , there has been discussions with the Board of Ilealth concerning the adequacy of that water . There is little choice as to whether the Town will provide water to the present three lots . At this point the Town does not have an obligation to provide water to serve the large parcel . Motion made by Councilman Liguori authorizing the Town engineer to design and draw plans for the extension of the water main to Schickel Road at an estimated construction cost of approximately $ 40 , 000 , and that the Town engineer is further directed to continue negotiations with the owners of the properties within the Schickel Water District as to whether the work to provide enhanced pressure to vacant properties should also be done at the time of the extension of the water main . Seconded by Councilman Niklas . Mr . Walker explained that to extend the water main it will require an easement across one property that currently has water . This owner is interested in having sewer provided . It would be a benefit to extend the sewer for the Town while doing the easement . Councilman Klein asked if the $ 40 , 000 expense for the extension of the water main would be borne by the Town , with no contribution from the landowners ? The Supervisor responded , yes . Mr . Walker said that the only contribution the •.l ' own might receive is the value of the lot if it were taken out of service , it would be beneficial to have an agrecment with the landowner to release the lot . Attorney flarney explained there is one lot that has a restrictive covenant on it which says that as long as it is used for water supply purposes the ' Gown owns it . If the Town decides not to use the lot for water supply purposes the title probably reverts to whoever succeeded Mr . Schickel . They would get the lot free and clear . • Motion called by the Supervisor and carried unanimously . Motion made by Councilman Niklas that the Town P_ ngineer is directed to investigate the financial feasibility of extending sewer service t. o serve the three lots presently within the Schickel Water District . Seconded by Councilman Liguori . Carried unanimously . 1 1 TB Minutes '7 / 1. 2 / 93 Page 13 . Agenda Item No . 34 - Memorandum of Understanding , NYSDN:C Mr . Walker told the hoard the Town has occasionally need to go into the streams to do emergency repairs to clear log jams , clear gravel , and repair retaining walls . In lieu of getting a stream entry permit from the DEC each time , D1, C will enter into a Memorandum of Understanding with the Town that will allow the work . It is beneficial for the Town to have this . Motion made by Councilman Niklas authorizing the Supervisor to sign the Memorandum of Understanding between the NYS DEC and the Town . Seconded by Councilman Liguori . Carried unanimously . Mr . Noel Desch interjected that in about 1980 the Town Board passed a Memorandum and they could be compared . Mr . Walker said that the Memorandum has to be executed each year . Agenda Item No . 33 - Change Order_No . 1 , Inlet Valley Water and Sewer Improvements Mr . Walker explained that the project came upon water in areas that were not expected , a sewer line had to be relocated to avoid guiderails . To allow the work to proceed effectively and safely the Town needed to allow placement of special material to keep the road bank from caving in . A manhole was needed to stabilize the streambank . These resulted in a change order . The total impact of the Change Order raises the contract $ 4639 . 00 , and the 'Town Engineer recommends this Change Order ., Councilman Niklas made a motion approving the Work Directive Change and authorizing the Town Engineer to execute the same for the Inlet Valley Water and Sewer Improvements , Contract No . 4 of the 1989 Capital Improvement Program . Seconded by Councilwoman Valentino . Carried unanimously . Agenda Item No . % - Rezoning Elmira Road / Seven Mile Drive W . F . Alberti , P . E . addressed the Board representing the owners of the properties on Elmira Road / Seven Mile Drive . Mr . Albern showed the Hoard three drawings of proposals for rezoning . Mr . Albern • said that when the Board was approached previously concerning this matter , they requested changing the zoning so that the light industrial follows a common stream , natural barrier to remove the commercial overlapping . The Roard at that time referred the matter to the Planning Hoard . The Planning Board suggested this was the route to take . Since that time another alternative has arisen . 1 1 YB Minutes 7 / 1 ? / 93 Page 14 . • Benda Item No . 7 - Cont ' d Mr . Albern showed the Board the alternative plan on the map . In the new alternative the park would be north of the light industrial . It would have the wetlands as part of the park , assuming the Board did want one large park rather than several small ones . Mr . Albern explained that the owners of the properties would agree to either proposal . Supervisor Raffensperger asked to see the proposals next to each other so that they could be compared . The Town Board if it were to allow the rezoning would not make a recommendation ' as to the location of the. park . (:' ouncilman Niklas asked if the Planning Board has seen the most recent alternative ? Mr . Albern responded , no . Mr . Dorman stated the Planning Board ' s recommendation was the proposal of the light industrial change . Mr . Forman explained the proposals by indicating the comparisons on the maps . Councilman Niklas said that he did not wish to consider another alternative that has not been reviewed by the Planning Board . Supervisor Raffensperger said the Board could refer the new alternative to the Planning Board . The Supervisor asked for comments on the first proposal which the Planning Board did look at , this proposal was to rezone and have light industrial on Seven Mile Drive . The Supervisor walked the properties with the Town Planner , before the Board proceeds they may wish to look at the property . The Supervisor ' s inclination was to riot wish to see an extension of the light industrial on another road . Several years ago the Town did a great deal of rezoning from light industrial in that area on Five Mile Drive to residential . The Board may wish to think about whether it should be extended to another road . Motion made by Councilman Niklas referring the proposed rezoning Plan # 2 for Elmira Road / Seven Mile Drive to the Planning Board for their review and comments . Seconded by Councilman Liguori . • Councilman Whitcomb asked when the Planning Board would be able . to review this proposal ? Mr . Forman responded that he would make sure since the owners have been waiting , that the Planning Board wouI d review it in time for the next Town hoard meeting . Mr . Attorney Barney said that as a practical matter , it would have to go beyond to one more meeting unless what is drafted as a proposed Local Law turns out to be what the Planning Board recommends and what the Town Board adopts . There are maybe two or three possibilities . Councilman Niklas asked Mr . Alberti if they could wait out the delay . Mr . Alberti responded that he hoped that the hoard would not delay . Councilman Liguori asked if the Pub lic flea ring could be set subject to confirmation of the Planning Hoard . Mr . Forman said that lie had brought the Town Board alternatives that the Planning Board had not seen that should have been . Ile was not sure i t would be acceptable to do the R - 30 on the second proposal . Mr . Forman said he recommends the proposal that uses the light industrial because he feels the ' Gown needs those sites . Mr . Albern said that access on the light industrial proposal would be very difficult without some work on the wetlands . Mr . Dorman said that there is 50 feet between the property line and the wetlands . The Supervisor said that if the Town Board approves the Light Industrial proposal tile, primary access to Seven Mile Drive must be considered . Councilman Liguori suggested setting two Public Iearings , The Supervisor said that since the property owners and Mr . Alberti have been very cooperative , it is reasonable that two public • hearings be set and then either piece of legislation could be adopted . Agenda Item No . 31 - Judd Falls Road Reconstruction Project The Supervisor explained that at the last Town Doard meeting two Board members volunteered to meet with the Forest Home Improvement Association to discuss the Judd Falls Road reconstruction project . The Supervisor asked Councilman Whitcomb , and Councilman Liguori if they would like to make a report on the progress made during those meetings . Councilman Whitcomb stated that he and Councilman Liguori met with Forest Home , the Engineering Department , and the Highway Department . There have been two meetings and a consensus was reached on the road width and the paving . They have yet to meet a consensus on the regrading . A meeting has been scheduled for July 28 , at the site when the marks the surveyors have made on the curb to show the exact depth of cut on the curb level can ne seen to get perspective on what it would look like . This is the largest hang - up of the project . Cornell University in the meantime has indicated that it will not proceed its end of the road reconstruction this summer , since the projects were to be coordinated , anything agreed upon will not be done until next summer . The Supervisor said that the project being delayed to next summer was indicated at the last meeting . The Supervisor asked for comments from the Forest Nome Improvement Association . No one wished to make any comments . AgendaItcm _No . 5 - Report of_ - the Tompkins County Board of Representatives Timothy Joseph addressed the I[ oard . Mr . Joseph stated that he did not have much to report , but that he would answer any questions . Councilman Whitcomb asked what the status was on the reconstruction of the Forest [ Tome Bridge ? Is there hope that any activity will occur this year ? Mr . Joseph responded that it is still in Committee . 1 1 1 i I I TB Minutes 7 / 12 / 93 Page 17 . • Agenda Jtem No . 5 - Cont ' d The Supervisor commented that funds wcre taken out of the County Budget this year for the project . Mr . Joseph agreed that it was taken out of the budgct and some members of the Board were very upset with this . Councilman Whitcomb mentioned that it is an unsafe condition presently . The Supervisor said that there was a cost overrun on the Buffalo Ili 11 Bridge . Mr . Joseph said there was not a cost overrun on that bridge , it was just very expensive to fix . The delay on Forest Ilome Bridge was not about ;something else being more important . It was because of issues of ownership that were thought to have been resolved and was raised a couple of months ago . The Public Works Committee response was there is a lack of clarity about who owns the bridge , and the rest of the Board directed them to clear it up expeditiously . The Public Works Committee then presented a resolution that they pulled before a vote . A clear explanation was never made as to why it was pulled . The Supervisor said she believcs the resolution was pulled because of a deficiency in the title , the resolution had to do with maintenance of the bridge and not ownership . The hulk of the resolution reflected a reiteration of the past policy of maintenance of the bridges by Tompkins County . The resolution was however titled 9 " Ownership of Bridges " which made some representatives concerned . Councilman Niklas asked if it were scheduled for the next County meeting , and if not its reemergence should be encouraged . Mr . Joseph was reviewed his agcnda and said that it is not on , but that he will inquire about it doing the committee reports . The Supervisor noted that she receives copies of all agendas for the County Committee meetings . • Councilman Whitcomb asked if there were any correspondence recently from the Town Board to the County Board regarding this bridge ? Supervisor Raffensperger stated the correspondence has been about the repair of the pedestrian bri. dve which Councilman Liguori followed up on . 1 1 1 TB Minutes 7 / 1. 2193 Page 18 . • Agenda Item No . 5 - Cont ' d Mr . Walker ;said he followed up with correspondence with the County Senior Engineer to which the Town has not yet received a very positive response . They said they had to rework the design . Councilman Liguori asked that Mr . Joseph look into the design work that is being stalled for the walkway on the bridge . The Supervisor told Mr . Joseph that the Town Board authorized funds in December 1992 to participate in the repair of the walkway . since then there have been a series of promises that the work will begin in the next two weeks . Councilman Liguori gained the impression that there had " been a delay " . The Senior Engineer could not explain the delay , he was also curious . Councilman Liguori asked the Senior P. ngineer to call the Town Engineer , and Mr . Walker received the same reply . Mr . Walker said that he called the Senior Engineer and talked to his assistant . The Assistant said it was on his desk and not the Senior P. ngineers . Basic ) y . there is no approved design because there is a problem about something they bad and they do not know when it will. be done . Councilman Niklas said that it is to the mutual advantage of the Town and County to settle this , there is a question of liability . The Supervisor said she has contacted the other two County representatives for the Town and maybe Mr . Joseph and they can push this issue . The Loard asked Mr . Joseph to push this issue and inquire into this matter as soon as possible . The Supervisor asked Mr . Joseph if it were true that the County Board passed a new law cutting in half the solid waste fee ? Mr . Joseph said that was not true , Frik ) . erner the Chair of the Solid Waste (: ommittee made a presentation talking about the various methods that could be used to fund solid waste . Ile supports a particular combination of financing that would cut the fee in half . • It is a plausible financing system and perhaps someday it will happen . Nothing would happen this year , the idea would be for 1994 . 1 1 1 TB Minutes 7 / 12 / 93 Page 19 . Agenda Item No . 35 - Custodial Agreement Attorney liarney explained that by law when the Town deposits money with the bank , the bank once the amount of FDIC insurance coverage is exceeded for funds over $ 100 , 000 must pledge collateral to secure those funds . One way of doing that is for the bank to turn over to another bank stocks , treasury notes , and certain kinds of securities . The other bank holds those as custodian . The agreement before the Board was drafted by Ms . A1arJo from an Audit & Control model which has been modified to meet the Town ' s needs . Motion made by Councilman Niklas approving and adopting the Custodial Agreement between the Town and the Tompkins County Trust Company and the First Chicapo Bank of New York ; and authorizing the Supervisor to execute the agreement . Seconded by Councilwoman Valentino . Carried unanimously . Agenda Item No . 7 = Reconvened Public iiearing , Conveyance of Property Adjacent to the Frandsen Subdivision The Supervisor reopened the Public Hearing at 7 : 00 p . m . The Town Clerk had proof of posting and publication . The Supervisor explained that this is the third Public hearing the Town has held on this matter . The Supervisor has given to the Town Board several pieces of correspondence received from members of the Eastern Heights Neighborhood Association . The first is a petition which the Association has presented with 1. 83 signatures . There are two headings to the petitions but are however similar . There is a summary by eastern Ileights Neighborhood Association of a meeting between representatives of the Association , Supervisor Raffenspers; er , John Barney , John Whitcomb , Daniel Walker , and Richard Schoch . The Supervisor stated she has received information that Mrs . Quick has been called by people who are interested in this matter . The statement has been made to her that there is an impression in the neighborhood that Mrs . Quick has already received compensation . The Supervisor wished to inform the members of the public that the Quick ' s have received no compensation for any of the land involved . Earl Thomas , 101 Park Lane addressed the Board . Mr . Thomas • presented a map to the Board that provides in detail the area discussed . Mr . Thomas pointed out it was a map that he received from the Parks Department with the exception he has drawn in the line of ttie land that is proposed to be transferred to Mr . oil Frandsen . That land lies on top of the present sled hill , the sled hill would have to be moved if the transaction took place . Moving it would not be easy as there is 12 feet of stone at the left hand barrier of the sled run . 1 1 1 i 1 1 1 1 7' B Minutes 7 / 12 / 93 Page 20 . • Agenda Item No . 7 - Cont ' d Mr . Thomas said that Bob Kohut wrote the written transcript of the summary of the meeting . Mr . Thomas is representing him . The Supervisor stated the summary of the meeting was agreed to by her , she received copies of it and commented on it . Those comments were incorporated in the summary . Mr . 1' homas reviewed the summary of' the meeting with the Board , ( see attached ) . Mr . Barney stated that at the moment there does not appear to be any insurance coverage . It is still being investigated but he is riot hopeful. . Mr . "Thomas said they do still not know what the Towns monetary obligation would be if the land transfer did not take place . The Supervisor said she had talked to the Quicks about that . The people from Fastern Ileights do understand that if an amount were known that it would not be made public . The Supervisor said that she has received a letter from the Quicks that the Town Board will discuss in Executive Session . The Eastern Heights Association questions the equity of the transfer of four lots for two . Johanna Gettinger has suggested that it is really not four for two , it is six lots for two . The answer from the Town was " four lots at the end of the road will be the last to receive services presumably that makes them less valuable . MT . Thomas asked Mr . Walker if he knows of other instances where a 1400 foot spur had utilities installed piecemeal , would it make any sense to put the utilities in part way and then put it to the park land at a later time ? The Supervisor said that since she had a discussion with the landowner she would answer the question . There is no doubt that the present intention is to do it in • piecemeal fashion because of the substantial cost of doing it all at once . Mr . Thomas said that the person the Supervisor talked to has a great financial advantage if this transfer takes place so that is what he would say . The Supervisor responded that is Mr . Thomas ' s interpretation that it is a great financial advantage to the person she talked to . 1 1 L TB Minutes 7 / 1. 2 / 93 Page 21 . • Agenda Item No . 7 - Cont ' d Attorney Barney noted that the 'Town has done piecemeal utility work in the past . Eastwood Commons was installed in increments to avoid the substantial cost all at once . T is not an unheard of procedure . Mr . Walker stated that piecemeal installation of utilities is very common , Deer Run which was a very large development was done in 800 foot sections . handy Blooding , 121 Park Jane addressed the Tloard that the petition represents 99 of the 138 homes in the neighborhood which is between 70 and 75 % . This does not take into account people on vacations , or the homes known to be vacant . These are the people who use the part: regularly . Mr . Blooding read the two versions of the petition . Mr . Thomas said that the different version was a result of different wording and was a s1ip . The intention of the two different versions were the same . Johanna Gettinger , 1. 11, Joanne Drive wrote a letter to the Supervisor and it is hoped it will be entered into the record , ( sec attached ) Ms . Gettinger said that she was here to express the values being considered in the relative properties in the trade . Mrs . Gettinger reiterated some of comments in her letter . Two lots should be an equal exchange of two lots . Mr . Frandsen gains the additional use of two lots which are his but if the Town does not grant a turn around Mr . Frandsen would have to use his last two lots for the turnaround . By virtue of the fact that the Town gives two lots , and grants the turnaround Mr . Frandsen gains the use of six lots for the trade . The question of the liability for exceeding the easement has never been answered satisfactorily . The Supervisor stated that the '. ' own has never had any choice as to who ' s liability it is . When it comes to the matter of assigning responsibility the discussion has been what employee or official of the Town was directly responsible for going over the easement that had been authorized . The Supervisor has said and will continue to • say that there are no records in the Town that load or give the answer to that question . There is no question the liability is the Town of Ithaca ' s . Mrs . Gettinger said that J � astern Heights thinks the question was never really answered , but that we understand the liability is the Town of Ithaca ' s . I 1 1 TB Minutes 7 / 12 / 93 Page 22 . • Agenda Ttcm No . 7 - Cont ' d The Supervisor interjected , and that she does not have the answer as to who was responsible . The Supervisor said that she would not read the entire letter of her response to Mrs . Gettinger ' s . The Supervisor said that the Board has discussed the question of two lots or four lots . maps were sent to Eastern 1 [ eights indicating that the Planning Board in its subdivision approval some years ago had approved a turn around on Town General Purpose ( , and for Mr . Frandsen former subdivision . The question as to whether the Town is really advantaging Mr . Frandsen to the extent of si. x lots was one that logically did not follow because that turn around already had been on town land in a 1980 ' s approvaJ . Mrs . Gettinger asked if it were normal for a Town to give Town land for a turn around ? The Supervisor said she did not know why the Planning Board did that . Mr . Walter said that it was because it would allow a parking area at the end of Brian Drive to give access to the park . The developer would help build a Parking area to be used by Town residents . Mr . Thomas said that if this proposal goes through TIrian Drive will be extended. to 1400 feet in violation of the subdivision safety regulation that limits cul - de - sac ' s to 1000 feet . The Planning Board has the power to rule otherwise , but if they do it will be ironic in view of the fact that the Park Lane lixtension no one wants was ;justified by alleged safety considerations . There has been no environmental impact done on Drian Drive . It has been routed through an extensive wetland , so wet as there must be a question of the feasibility of building houses there . Giving a developer park land establishes without later recourse that Brian Drive will be allowed to reach its full 1400 feet . The park land being worthless for development otherwise . The key feelings in Jiastern iJeights about this matter is that • posting park signs constitutes a promise by the Town to a potential home buyer that the park will remain as is . Giving away park land to pay an alleged debt is no solution , especially in an unequal exchange . No evidence has been offered , only opinions that the "Town has sole l iabi l i ty for the excess used in bui Id ing the Park Lane I ( xtcnsion . I1. is appalling that the mistake of this magnitude was made without publicly available records of who authorized what , ft is understood that the 'I ' own Conservation hoard has filed a resolution asking that all of the General Purpose Land now marked as Eastern Heights Park be designated as park land to avoid spoiling the uses for which It has been designated . Ts that a matter of record ? The Supervisor responded that each Board member has a copy of that resolution . David Blanpied , 2215 North Triphammer ] toad , addressed the Board and said that lie and his wife own the thirteen plus acres which adjoins the part. land , Quick ' s , and I' randsen ' s property . Mr . Blanpied asked if the Supervisor received a copy of a letter which he sent . The Supervisor responded that she had received Mr . Blanpied ' s letter . The Supervisor closed the Public Hearing at 7 : 36 p . m . The Supervisor commented that no member of the present Board or any member of the staff was involved in the genesis of this situation . They all have however , done the very best they could in attempting to find a solution to it . The Supervisor has been advised by the Town Attorney that it is the 'Town of Ithaca that has sole responsibility as the Town of Ithaca supervised the construction of the road . Councilman Niklas said that it is obvious that this issue will require some very careful thought on behalf of the present Town Board who has inherited this problem . It is also clear from this meaning that there is some documentation , as the Supervisor has received a letter from the Quick ' s to the Town , and the potential for litigation is to be discussed . Motion made by Councilman Niklas that the Town Board defer discussion of this issue until after the Executive Session . Seconded by Councilman Liguori . Mr . Thomas asked if that meant there may be a vote on this issue • after the P. xecutive Session ? The .Supervisor said that would be possible , but is very unlikely . Councilman Niklas stated that it has always been the Roard ' s policy to be open with the kind of procedure of voting . The Supervisor noted that the Town Board may wish to authorize her to make investigations , but no decision . Attorney Barney felt that the Board should not tie there hands . i t should not be anticipated that a decision would be made that would be adverse to what the Eastern Ile ights Association is talking about , but the Board should wait until they have the information from the Executive Session and then make a determination at that point of the direction to he taken . If the direction is one that perhaps is not as hopeful as indicated , then take it into a public session and do it at the next meeting . If it is a different direction the Board may wish to make a decision and implement them . It would be better to say that no decision should be made tonight that the public would be unhappy with . The Supervisor said that the group here tonight has some confidence that the Board will not play fast and loose with this issue as they have not done in the past . Agenda Item No . 11 - Public Ilea riny , Modify Local Law No . 4 of . 1992 , 11: thics Rules The Supervisor opened the Public clearing at 7 : 30 p . m . The Town Clerk had proof of posting and publication . The Supervisor explained the modification is a simple change to the l., ocal Law as recommended by the 1? thics Board . 1 t TB Minutes 7 / 1. 2 / 93 Page 25 . • Agenda Ttem No . 11 - Cont ' d Attorney Varney stated that the current Local Law requires or suggests a recusal from any vote that may in any way effect Town officials in a pecuniary manner . The Ethics Board ' s interpretation meant that would mean if the Board were to raise taxes it would require a refusal from voting because it would effect the Board member . There are a number of items that Boards vote on that have general applications but also impact upon the Boards themselves . The 1 ( thics hoard suggested that the State law which says an individual should recuse himself from voting when there is a contractual obligation being discussed upon which it would have a direct benefit to the official or his / her family be used . Attorney Harney while drafting the law went beyond the contracts and also covered direct interest in zoning matters , or direct interest in Planning Board matters . This law removes the absolute prohibition if there is any kind of pecuniary benefit , but still retains a requirement that officials or employees recuse themselves from voting; in contracting matters , and direct interest matters . Councilman Niklas asked if the members of the 1! thics Board reviewed this Local Law . The Town Clerk stated that the l ;: thics Hoard members were each sent a copy of the proposed Local Law for their review . Mrs . Simpson called the Clerk and told her that the Local Law did reflect the suggestions of the Ethics 11oard . Robert Aronson , Chairman of the l? thics Board approached the Board and said that Attorney Barney has explained the proposed Local Law very clearly as to the intent of the Ethics Board . The Ethics Board intended to remove any possible ambiguity from the law as it had been written , as they wanted all officers and employees at risk to be absolutely clear as to what their limitations were . It was concluded sifter review of the State Law and the Towns Local l . aw that the State Law was the much clearer piece of legislation and should be incorporated into and substitute for the language of the Towns Local. Agenda item No . 37 - Ratification of SARA Grant The Town Clerk explained that the Town has received its third grant from SARA for an Archival Records Program , The funds will be used for minor remodeling of the vault , equipment , and training expenses . The money will be used to make the vault the archival records storage area . A disaster plan will be completed , and supplies will be stored at another location in the event of a disaster such as flood , or fire . A Records Management Procedures Policies Manual will also be developed through a Local Law so that everyone in the Town will be using the same procedures and policies . Mr . Frost mentioned that during a heavy rain recently that the vault may be secure from an entry standpoint , but 1t does not appear to be either fire safe and certainly not water tight . Councilman Niklas stated that the Town Hoard received a letter dated July 8 , from the Town Attorney including a draft for a proposed T . ocal T . aw which would permit the Town Planning Board to waive up to 20 `A of the total parking requirements for certain projects in certain areas . Tt is important that the COC members involved in the discussion approved the spirit of this proposed legislation . There is one member who is in absentia . There were two issues that were raised that require some guidance regarding policy , and the COC was not prepared to submit this Proposal to the other Boards of the Town until there was guidance from the Town Hoard. The first is how large a facility should be used in terms of square footage that would trigger the Planning Board abilities to exercise this option . "There is a difference of opinion as to whether the trigger should be for a fairly large building facility or a small building facility . The '.[ ' own Attorney and Town Planner will debate the merits of either because it is there debate that has essentially provoked this matter being brought to the Town Jtoard . T is the sense of the rest of the COC to specify a value without guidance from the Town Board . • The second issue is the question of a Sunset Provision . 'There is a concern as to whether there should be any time limit whatsoever . In other words the '.I ' own would be permitted to exercise at its discretion , or the developer at his / her rebuilding work would put back into place the missing 20 `,17 parking . TR Minutes 7 / 12 / 93 Page 30 . • Agenda :item No . 15 - Cont ' d Mr . Forman said that he can alleviate the second concern as Mr . Barney has phrased it requiring that if someone comes hack with significant change of use , subdivision of the project , etc . they would still. have to meet the parking requirements or may not got it approved . Mr . Forman agrees with Mr . Harney on that issue . The significant disagreement is on size with Mr . Barney . Mr . Forman explained that we are talking about when the Town deals with a 20 , 000 square foot project being 100 parking spaces . This would be land that a developer would have to leave set aside that if there were a reason could be made into parking . The question is what the size threshold should be . Mr . Forman suggested that it be 110 more than a maximum of 10 , 000 square feet so that if there is a 50 space parking lot the developer could be required to put in 40 spaces and the remainin ,p, spaces could be set aside as a grassy area . Should within a certain period of time the Planning Board feels the parking was not adequate the additional 1. 0 spaces would come into use . Mr . Forman does not see the necessity of going to something 20 , 000 square feet which requires a minimum of 100 spaces . The Town is covered because the land is set aside as green space and the developer may not have to put the land into parking . Why go to a 100 lot parking , how many places in the Town beyond East lli. tl Plaza have, 1. 00 spaces . There is no utility of 100 spaces . Mr . Barncy said that the question is how much discretion does one want to give the Planning Board and under what circumstances ? If there is a problem with the parking requirements now , Mr . Forman is right in most uses a 20 , 000 square building would require 100 spaces . It is not exactly that correlation because it depends if it is a retail use . The test is one space for each 200 feet of retail floor , a restaurant is one space for every five seats , an office building is one space for every 200 feet of occupied area . The tests arc different for which use . The provision is really only Telated to a multi use facility rather than a single use . At what point does it mane sense to say that there are so many different uses it is quite unlikely that there will ever be a need for the number of parking spaces that the law would otherwise require . Attorney Barney said there would have to be a very large • project before you would wish to deviate from the requirements of the ordinance . If the ordinance is considered wrong then it should be changed to one parking space for every 300 feet of retail space . Change the parking requirement itself , not do it through a i mechanism where the Planning 1loard can vary it each time . The Supervisor asked that whatever the number square feet is , is authority for the Planning hoard to reduce the number of parking places or not reduce the number ? TB Minutes 7 / 1. 2 / 93 Page 31 . • Agenda Item No . 15 - Cont ' d The Attorney said that is correct , they are not required to reduce the number it is discretionary . It has to meet the criteria . Councilman Niklas said that the COC envisions that could be provoked from either the Planning Board or an applicant . The Supervisor asked if the reduction is to be used for green space or may it be just not created ? Councilman Niklas responded that it is specifically not to be used for parking , and not to use the foot plan of the actual structures on the site , Councilman Niklas suggested to adjourn discussion of this topic until. the regular meeting of the Town Board on August 9 , as the Public llearing for 8 : 00 p . m . is of a more pressing nature . The Board concurred . Agenda Itcm No . 12 - Public Ifearing , Consideration of a Local law to Amend t: he _Zoning Ordinance Relating to Special Land Use District , former Cornell University Statler West Complex The Supervisor opened the Public ] Tearing at 8 : 00 p . m . The Town Clerk had proof of posting and publication . Mr . Joseph C: hiaschi told the Board he had previously discussed his rectuest for rezoning at the June meeting and would be available during the Public ] Tearing and subsequent discussion to answer any questions . Mr . Forman outlined the rezoning for the board . The changes to the present law for this special land use district would allow going from two to seven dwelling units , off premises catering with limited hours , and on site catering with limitations for days and hours that functions could he held at the site . Ceclia Bowers of 1406 ' Yrumansburg Road addressed the Board . Ms . Bowers presented a letter from Krys Cail , President of the West ilil. l Neighborhood Association , see attached ) . • Ms . Bowers said that the letter Presented was the minimum letter from the We :: t TIill Neighborhood Association , a great many members were polled . For some reason it was not known that this was being addressed a . the Planning Board stage . Almost everyone who was polled felt that since the kitchen was in place and because Mr . Chi. aschi is a developer who has done very good things with other buildings the Association would not oppose with a couple of exceptions the use of the kitchen i. f it were limited to the current size and limited to provide food in other locations only . TB Minutes 7 / 12 / 93 Page 32 . • Agenda ftem No . 1. 2 - Cont ' d Everyone Ms . Bowers talked to felt very negative about any alcohol being served on the site at any time . There is a fire station opposite and a hospital up the road . There is enough traffic on the road , there is a great deal of emergency traffic . One of the problems with banquets is that everyone arrives at one time . There is parking at this facility already , but there is also going to be offices and apartments which the neighborhood does not oppose . Those parking spaces will be utilized for those uses . The Association is vcry concerned that if there is a banquet parking will take place on the Trumansburg Road . This will be difficult to stop by the owner . Another problem will be the noise , the neighborhood opposed the Kyong Project with unity and great force , if the Trumansburg Road is to kept as a residential neighborhood we cannot allow major large retail. commercial cases of property along that road . No one has any objection to apartments or office space . Someone pointed out that the building was advertised as having commercial space to rent recently . The neighborhood is unanimous in not wanting on site catering , if the kitchen is proposed it is preferred it be l imi ted to that kitchen , and that size kitchen for a I I times . Fveryone Mrs . Dowers has spoken to expressed pleasure that Mr . Chiaschi had. purchased the building . The Supervisor asked for anyone else to come forward to speak on this item . Public clearing closed at 8 : 13 p . m . Councilman Niklas said that for the record he opposes on site catering with off site catering being allowed along with the apartments and office space . It is a good idea to leave the option open for subsequent consideration the on site catering to see how off site catering works . Councilman Niklas said he has a great deal of respect for Mr . Chi aschi and his abilities but the Town has no guarantee that he will continue to be the owner of the property . • Councilman Whitcomb said that at the June meeting the Town Board had a split vote on whether to allow on site catering , the Planning Board also had a split vote during their considerations . Councilman Whitcomb said that he did vote for on site catering last month because there was no opposition at the time and it seemed to be as residential neighborhoods go an isolated site . There was no strong feeling on the Board one way or , another . i TR Minutes 7 / 12 / 93 Page 33 . • Agenda Item No . 12 - Cont ' d The Supervisor said that she has been concerned with the on premises catering . One of the difficulties is the amount of residential land around the property , if it were developed all of those residences would have concerns . The problem is looking at years in the future and trying to determine the impact on residences that may be there . Councilwoman ) . eary noted that in the future potential home owners would be aware the on site catering was there and it would be their decision whether to purchase property there . It is not like there is an established neighborhood who had assumed there would never be development of this nature . Councilman Niklas said that a curious note is the extreme difference in traffic where he lives now and previously . Sounds that never would have bothered him living on 9611 are noisy in a very quiet environment . Councilman Niklas would be concerned with how sound would carry . Councilman Liguori said he did not believe the parking issue is really a problem . "There is so much land right in the vicinity of the building . It is inconccivahle that people would part: on Trumansburg Road and walk down the lane . There will be some increase in traffic . Mr . Chiaschi said the difference from the road to the building is approximately 300 feet . On both sides North and South is probably another 300 to 400 feet . J ' he back is around 300 feet . Mr . Chiaschi said that if there is enough complaints from neighborhoods of any nature concerning a liquor license the license will be revoked . Mr . Chiaschi stated he has had a liquor license for the last 35 years and never had a problem . The Local Law has been drafted to strict limitations of what can be done . Most of the time there will be no functions during the week and only on the weekends . Mr . Chiaschi said he would like to see the Local Law passed but that presently he has more pressing concerns about the building . [larking would be no problem . Parking can be limited with green space set aside , Mr . Chiaschi said he does not like to • downgrade neighborhoods , in fact he has upgraded several . Councilman Klein reiterated :from previous meetings that this is a reasonable reuse for an existing building that does pose some difficulties in terms of its viability . The law is drafted with controls and would make it hard contrary to the letter received to make this into functions such as referenced rock concerts . That is extending beyond what the local law would allow . Attorney Barney said when it comes to rock festivals , the noise ordinance would. play a significant role . 1 1 1 TB Minutes 7 / 12 / 93 Page 34 . • Agenda :item No . 32 - Cont ' d Councilman Klein said that he does not think Mr . Chiaschi would be able to sell tickets to events , a wedding reception is a private party , there could be no advertised public events . Coing back to Attorney Barney ' s previous question , on 2c . the comment that all the land in a special land use district is owned by the same owner . Attorney Barney explained this discussion is on one special land use district that includes the school ( Broome Developmental District ) , have always been there . Because Mr . Chiaschi is becoming the owner of the entire special land use district that you may be giving him some privileges that economics will probably govern . Since he would have an ownership interest in the office portion he would not want to run an off catering or on catering service in such a way that would cause an economic reversal of the other areas . This would not be beneficial to Mr . Chiaschi . Councilman Klein asked if that would be clear for just one landowner . Councilman Whitcomb stated that he thought the sec tion referred to Mr . Chiaschi as the owner , then the second time he read it he interrupted it as regardless of who owned the property . Councilman Niklas suggested that it might be advantageous to finer tune what is meant in the local Law by " groups of people " . Some people have spoken of private parties Such as wedding receptions and retirement parties , this would disavow the idea the Doard is approving rock concerts , and functions selling tickets . This qualifier may be acceptable to the community and Mr . Chiaschi . Mr . Chiaschi said that he meant the functions to only be of those he has suggested such as weddings . Councilman Niklas said that he is trying to find phraseology that would make the on site catering less distressing to the residents . Tf that type of wording were included Councilman Niklas said he may be more willing to vote favorably on this issue . Mr . Chiaschi said he would not do something to spite himself , why would he invest $ 15o , 00o into four apartments if he thought that • the functions downstairs would drive them out . Councilman Niklas said he is trying to find a compromise that would make this acceptable to the community . Mr . Chiaschi said he felt that had already been done . Councilman Niklas said that it has not been resolved because there is opposition from the community . CAPITAL IMPROVEMENTS PROJECTS 1989 Water and Sewer Improvements - Inlet Valley Phase II The contractor is nearing completion of water and sewer installation on Rte . 13 and Enfield Falls Road . Construction is proceeding well and the project is approximately 60 % • complete . The contractor will begin work on the watermain crossing of the Cayuga Inlet at Buttermilk Falls Road in mid-July . A minor change in the alignment of the crossing has been proposed due to changes in the banks and channel bottom which occured during the heavy runoff this Spring . These modifications have been reviewed by NYSDEC and are acceptable to the fisheries section . Change Order Number One has been requested to cover additional work required due to changed conditions on the site . 1993 Capital Improvement Program The Town Engineer is continuing to evaluate and prioritize the list of potential Capital Improvement Projects which has been distributed to the Town Board for comments . A prioritized list will be presented at the August Town Board Meeting . ADMINISTRATION Development Review The Town Engineer has provided development review services for the following projects : 1 . Site Plan Review TOWN ENGINEER ' S REPORT July 7 , 1993 Page 2 70 Briarwood- Park , Compliance review on roads and public utilities Excavation and Fill Permits • 16 Jim Hilker , Burns Road Safety Committee The Town Engineer has served with the Building Inspector and Town Clerk on the safety committee which has addressed the items of concern raised by a PESH inspection of the Town Hall . Areas addressed in June included the Town Hall electrical system and development of a safety manual . Fire safety improvements identified by the Building Inspector ' s fire safety inspection are also being addressed . Town Hall Facility During recent heavy rains several leaks were identified in the Town Hall roof . The Town Engineer has identified the problem areas and has solicited estimates for repairs to be completed this month . SARA The Town Engineer is continuing to work with the Records Management Officer on improvements to the engineering records management system for paper correspondence files , report files , map files and electronic files . The Engineering Department staff are working on bringing the filing system up- to - date . Watershed Management The Town Engineer has been meeting with the Watershed Regulations committee reviewing proposed watershed regulations intended to protect public water supplies . MPO The Town Engineer has been participating as a member of the planning committee of the Metropolitan Planning Organization which is working to develop a coordinated transportation planning program in the County . • PUBLIC WORKS Mapping The Town of Ithaca Engineering Department is continuing to work with Tompkins County Planning , the City of Ithaca , NYSEG , and Cornell University on the joint mapping project . TOWN ENGINEER ' S REPORT July 7 , 1993 Page 3 Delivery of Town maps is behind schedule and a late July delivery is now expected . Meetings regarding data format and map maintenance procedures have been scheduled monthly . Issues that require policy clarification include availability and interchange of data , public access requirements for data , • and what format of database is most appropriate for the development of a Geographic Information System . Wager The Town is continuing to monitor the water quality in the Schickel Road Water District . Plans for extension of a watermain to the district have been developed and a construction schedule is being developed for Town Board Approval . Sewer Construction of the Kline Road / Fall Creek siphon bypass by Stevers Construction started the middle of June with a substantial completion anticipated for early August . The project is moving ahead on schedule . Flood Control Project The Town shares maintenance responsibility for the portion of the Cayuga Inlet Flood Control Project located within the Town of Ithaca . This includes the Coy Glen grade control structure and the stop log system across the railroad tracks . The annual inspection was held June 15 , 1993 with NYSDEC and the Army Corps of Engineers . Maintenance identified included replacement of the asphalt sill across the railroad track , regrading of the access roads , and removal of accumulated gravel from the grade control structure . The Town Highway Department assisted the NYSDEC maintenance section with repairs and cleanout by providing equipment and trucks for removal of the gravel . The gravel was stockpiled at the Highway facility for use as select fill by the Town . Drainage The Town Engineering Department assisted the Highway Department in improvement of the drainage ditch on Salem Drive . The Town Engineer is continuing to review existing information regrading drainage regulation in the Town . The Public Works Committee will discuss this as an agenda item at • a future committee meeting and a recommendation to the Town Board is anticipated . Current and future development plans are being evaluated carefully for impacts on watersheds and drainage . TOWN ENGINEER ' S REPORT July 7p 1993 Page 4 Judd Falls Road Reconstruction The Judd Falls Road reconstruction plans have been redone with a significant amount of additional field data as a result of comments from the FHIA . The design review • committee has met twice to review the revised design . The project .is now scheduled for construction during the 1994 construction season , with the exception of the drainage work on Forest Home Drive which will be completed in late July or early August . This work will include repair of the unstable retaining wall above the walkway . Cornell University will also postpone the repair work on the Plantations Road underpass until next Summer . South Hill Trail The Town Engineer has assisted the Planning and Parks Departments by reviewing and approving the trail design and providing engineering services for construction . Park Lane The Town Engineering staff has prepared the maps for the consideration of the transfer of Town lands related to the acquisition of Park Lane . A subdivision map for the Quick property has been developed for the Park Lane portion of the property . Other areas of Permanent Improvements worked on this month were : Chase Lane , Schickle Drive , and Salem Drive received new culvert piping . The total man hours worked in Permanent Improvements during June is 500 . 5 with 24 of those hours were overtime work . The Town has spent 801 . 5 hours on paving so far in 1993 . 27 . 5 of those hours were worked during overtime . Also during June the Highway crews worked on various areas around the Town repairing roads , cleaning ditches , and working with the DEC to clean out the Flood Control Inlet . We have removed approximately 1 , 500 tons of gravel from the Inlet . Work has begun on the South Hill Trail . To date , 87 . 5 man hours have been worked on this project by the Highway crew . All in all , during June there was a total of 1 , 147 . 75 mans hours worked on General Repairs . In June , 18 mans hours were spent on water maintenance , 29 . 5 man hours on sewer maintenance , 64 mans hours on mowing , and 174 man hours on equipment maintenance . The following i;; a synopsis of Planning Department activity for the period June 5, 1993 through July 9, 01993 : Plan jing Board Development Review The Planning Board held four meetings during this period : June 8, 15, 22 and 29 . The June 8 and 22 meetings were principally devoted to the Comprehensive Plan. The Planning Board Public Hearing Notices, as well as the decisions rendered by the Planning Board at the June 15 and 29 meetings, are attached . Comprehensive Plan The editor has just finished her review of the Comprehensive Plan, and it will now be sent back to the Planning Board for its July 13 meeting. After that meeting, it should be possible to have some idea when a public hearing can be held . Cornell GEIS Recently, Cornell submitted a proposal for a Special Land Use District (SLUD ) for the orchards area . The Supervisor, Planning Board Chairperson, Town Attorney and I met with Cornell to discuss their SLUD proposal and offer some suggestions for change. The revised proposal will be sent to the Planning Board for its comment. Codes and Ordinances Committee (CO 1 The COC met on June 16 . The Committee discussed a proposal to allow the Planning Board to waive up to 20 % of the required parking in Commercial or Light Industrial Districts and also had a discussion concerning changes.. to the Sign Ordinance. Planning Committee The Planning Committee met on June 23, and discussed the Comprehensive Plan, the Cornell GEIS and the implications of extending water and sewer to portions of West Hill • not now served . Town Clerk • Aynaa. a3y MEMORANDUM OF UNDERSTANDING BETWEEN • THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION OF THE STATE OF NEW YORK , hereinafter referred to as the DEPARTMENT and the Town of Ithaca hereinafter referred to as the Town of Ithaca FOR THE PERIOD � OF JANUARY 1 , 19 _ to DECEMBER 31 , 19 - Resolution No . WHEREAS the Department of Environmental Conservation of the State of New York is responsible for the protection of the water resources of certain classified waters in New York State as set forth in Title 5 of Article 15 of the Conservation Law and , WHEREAS this Memorandum of Understanding between the Department of Environmental Conservation of the State of New York and the Town of Ithaca establishes an agreement of cooperation etween the parties ereina tee r mentioned for the administration of this responsibility insofar as the _ Town of Ithaca is concerned , THEREFORE , BE IT RESOLVED that the Supervisor is hereby empowered to sign the attached Memorandum of Understanding in behalf of the Town of Ithaca and BE IT FURTHER RESOLVED , that this Memorandum of Understanding shall take effect immediately upon its acceptance by the Department of Environmental Conservation , Attest : Town Clerk Waters covered by this Memorandum 10 All waters in the Town of Ithaca classified C with a standard of ( T ) and higher by the Department of Environmental Conservation . Works covered by this Memorandum All Town of Ithaca public works that will change , modify or disturb the course of , or necessitate the removal of sand , gravel or other material from any of the above waters . PERMITS 1 . No permit shall be required for the following works undertaken where the State does not own fishing rights or where the stream is not on other lands owned by the State : a . Stream crossings , provided the disturbance of the bed or banks is limited for fifty ( 50 ) feet above and below the crossing . b • Channel clearing or realignment of streams that involves less than one hundred ( 100 ) lineal feet of stream in any mile of length . Notification Notification shall be given to the local permit agent 24 hours before undertaking work covered by this Memorandum for which no permit is required . Standards of Performance All work :shall meet the following standards : a • The project shall not obstruct the upstream or downstream movement of fish . ( Culverts and the floors of box culverts and bridges shall be , as nearly as possible , flush with the stream bed . ) b . Sufficient flow of water shall be maintained at all times to sustain aquatic life downstream . c . Any culvert , box culvert or bridge floor shall be designed to provide a V or dish - shaped channel , to concentrate flow during periods of low water and facilitate the movement of fish . d • Disturbance of the stream bed shall be kept at an absolute minimum , and the stream bed shall be returned as nearly as possible to its original condition , or better . ( Where possible , in modifying a stream bed , the center line shall be 8 to 12 inches lower than the toe of the channel bank , ° to concentrate the flow of water . ) e • Where work necessitates disturbing banks , they shall be • returned to original condition or they shall be graded to a 1 vertical to 3 horizontal slope , and rip - rapped or planted with suitable grasses , trees and shrubs so as to prevent erosion . All tree and brush removal shall be kept to a minimum . — - 3 - f . Any dike or cofferdam required to facilitate construction shall be erected in such a manner that stream flow will not be • sufficiently reduced to endanger fish life downstream and such dike or cofferdam shall be erected of materials that will not contribute substantially to the turbidity or siltation of the stream . g . During the project , care shall be taken to prevent or reduce to a minimum any damage to any stream from pollution by debris , sediment , or other material , or from the manipulation of equipment and / or materials in or near such streams . Water that has been used for washing or processing , or that contains oils or sediments that will reduce the quality of the water in the stream shall not be directly returned to a stream . Such waters will be diverted through a settling basin or filter before going directly into the stream . h . If water is taken from a stream for construction purposes and an impounding structure is necessary , such structure shall be erected in a manner causing the least possible disturbance to the stream . i . In all cases involving work in a stream , every effort should be made to return the stream to the highest possible standard for aesthetic value , water quality and fish habitat . 2 . All ,- other work falling within the jurisdiction of Conservation Law , Title 5 of Article 15 shall be carried out only after complying with Part 608 of Codes' , Rules and Regulations of New York State and obtaining the necessary permits for the proposed work . NOTE : Emergency Work - See : Part 608 . 8 ( Codes , Rules and Regulations of the State of New York ) NOTE : Excavation or fill of navigable waters is not covered under this Memorandum , and a permit is required . See : Part 608 . 4 ( Codes , Rules and Regulations of the State of New York ) NOTE : Construction , reconstruction or repair of dams and docks may require a permit . See : Part 608 . 3 ( Codes , Rules and Regulations of the State of New York ) Review of Public Works Plans • I . It is understood by both parties that the Town of Ithaca will keep the Department of Env ironmenta onscrvation informe , through the local permit agent , of all plans and specifications of proposed works that are covered by this Memorandum , and shall make such plans available on request at the Town of Ithaca offices . The local permit agent may make suc recommen ations as may be pertinent for the preservation of water quality that will be - 4 - consistent with the best interests of the public . All such recommendations shall be within the framework of acceptable • engineering practices . 2 . It is further understood by both parties that the local permit agent , upon such notice from the T,,,,n of Tf inrn will complete his review and make known his recommendations , so as to facilitate the project . Rescission of Memorandum of Understanding If the required notification is not furnished or if in the opinion of the Department of Environmental Conservation , the Town of Ithaca fails to conform to one or more of the above standards or the recommendations of the permit agent , the DEPARTMENT may unilaterally rescind this Memorandum of Understanding . Such rescission shall be effective upon receipt of written notice by the Town of Ithaca It is the intent of this Memorandum of Understanding , through the mutual cooperation of both the Department of Environmental Conservation and the Town of Ithaca to facilitate Town of Ithaca public works projects , preserve to t e fullest the quality o t e water resources , and remain consistent with the best interests of the public .
