Call to Order—Meeting called to order at 4:36p.m. Rod Howe was absent and Pat Leary attended via Facetime 2. Review of Draft Agenda for Regular Meeting 3. Committee Reports a. Budget—Mr. Levine reported that they reviewed the revised 5-year capital plan which is a discussion item for tonight. They also reviewed outstanding long-term debt and noted that Mr. Solvig has sent budget worksheets to department heads. They also reviewed a draft Procurement Policy and Green Purchasing addendum which will be discussed at the August Town Board meeting. b. Planning—Mr. DePaolo reported that Chainworks submitted some preliminary PDZ language and they hope to have one, unifying document that can be referred to by both the city and the town and they are going to the City as the next step. He added that the plan is to have a joint meeting with the City and Town Planning Committee to discuss areas of mutual interest and concern so the Project Team doesn't have to bounce back and forth between the two. There is no August meeting scheduled. c. Public Works—Mr. Engman reported that they discussed drainage issues, monitoring the City's Stormwater plan and briefly discussed Complete Streets local legislation. The federal and state level now has Complete Street laws and that means that when you do a road, you consider pedestrians and cyclists in addition to simply getting cars from one place to the other. This is a preliminary discussion at the committee level but something to think about. The committee reviewed progress on different projects underway. The Winner's Circle and Route 79 repair was found to be too expensive due to asbestos so that is changing and will be rebid. The bus tour of projects is scheduled for Friday, August 22" at 9a.m. Other boards and committees will be invited. Ms. Hunter asked about a resident on Bundy Rd who had phoned her about the slope of the ditch in front of her house and an estimate she got from repairs from the Town that she felt was very high. Mr. Weber explained that the resident has a failed culvert and she thought it was the Town's responsibility but it is not. They worked up two remediation plans and sent her an estimate for them. Mr. Weber will send Ms. Hunter the written estimates. Adopted 8/11/2014 TB July 28, 2014 pg 1 d. Personnel and Organization—Mr. Weber reported that the committee got an update on the plan revisions for the front offices, reviewed and recommended a change to the floating holiday voting process, reviewed initial information from the Health Care Consortium regarding a possible Platinum Plan offering and this will play into union negotiations, there will be more details at the next meeting. The committee also continued discussion on health insurance policies for retirees, noting that it would be for future employees. They also continued looking at having written policies for exempt employees regarding the additional time which is similar to comp time for hourly employees. The Town does not have a policy right now and we are looking at parameters and possible limits. Ms. Drake added that the employee satisfaction survey has gone out to all staff and a Project Assistant was recommended for Codes to help with data entry associated with Municity. e. Codes and Ordinances—Mr. Goodman reported that they continued with the sign law and they are getting close to a final draft. He added that he hopes to have a draft of a local law regulating backyard campfires at the next meeting to review and then bring to the Board. f. Other Intermunicipal—Mr. Engman reported that he has been trying for months to meet with the City to start on the Fire Contract and Mr. Levine responded that it won't be until August at the earliest. Mr. Goodman added that Chief Parsons was on the radio this morning talking about budgets and the possibility of closing some stations if their budget is decreased at all. 4. Consent Agenda TB Resolution 2014 - 131: Adopt Consent Agenda Resolved, that the Town Board of the Town of Ithaca hereby approves alid/or adopts the following Consent Agenda items: a. Whereas, William Gilligan's term on the Ithaca Board of Fire Commissioners as a Town of Ithaca representative expired on June 30, 2014; and Whereas, Mr. Gilligan wishes to be reappointed to the said position; and Whereas, the appointment to the position is made by the City of Ithaca Common Council based upon a recommendation from the Ithaca Town Board; now, therefore be it Resolved, that the governing Town Board hereby recommends and requests that the City of Ithaca Common Council re-appoint William Gilligan as a Town of Ithaca representative to the Board of Fire Commissioners for a three-year term commencing July 1, 2014 through June 30, 2016. Adopted 8/11/2014 TB July 28, 2014 pg 3 5. Discussion Items Renwick Drive Encroachment—Mr. Weber explained that a garage extends into the road by about 2.5 feet and has been there for many years. The house is being sold and this is to make it legal. He noted that they reviewed the encroachment and did ask for a stipulation stating that vehicles could not be parked in front of the garage so they would not impede traffic or access etc. TB Resolution No. 2014- 132: Approval of Encroachment License for 8 Renwick Drive to Permit Encroachment of Garage into Renwick Drive Whereas, Philip and Jody Gabler are the owners of real property located at 8 Renwick Drive, Ithaca,New York 14850, Tax Map Parcel No. 17-3-34 (the "Premises"), as more particularly described in a deed to Owner from Theresa D. Goodrich dated January 2, 2009 and recorded January 6, 2009 in the Tompkins County Clerk's Office as Instrument Number 536149-001, and Whereas, Renwick Drive is a 50-foot-wide Town road, and Whereas, a portion of the garage on the Premises encroaches approximately 2.5 feet into Renwick Drive, as shown on a survey of the Premises entitled"Survey Map No.8 Renwick Drive Town of Ithaca, Tompkins County,New York"prepared by T.G. Miller P.C., dated November 9, 2006 and amended June 19, 2014 (the "Survey Map"), and Whereas, the garage has existed in its location since 1935, and Whereas, the Town Engineer and the Superintendent of Public Works have determined that there is enough room on Renwick Drive for vehicles to pass safely and for the Town to perform road maintenance without disturbing the garage, and Whereas, the Town is amenable to entering into an encroachment license to permit the continued encroachment of the garage, now, therefore,be it Resolved, that the Town Board of the Town of Ithaca hereby approves the attached Encroachment License to permit the continued encroachment of the garage, and authorizes the Town Supervisor to execute the Encroachment License on behalf of the Town, subject to the approval of the Attorney for the Town. Moved: Eric Levine Seconded: Rich DePaolo Vote: Ayes—Levine, DePaolo, Hunter, Leary, Engman and Goodman Discuss Capital Projects—Mr. Solvig reviewed the handout. Ms. Hunter asked if this was just a review at this point with approval coming through the normal budget process and Mr. Solvig responded that it was,but the Budget Committee would like to get as many questions the Board has answered now rather than later. Adopted 8/1 1/2014 TB July 28, 2014 pg 4 Ms. Hunter asked about what amount will be coming out of user fees for the monies allocated for water and sewer improvements. Mr. Solvig responded that he had not calculated that out. Ms. Hunter went on to say that she is not in favor of spending money on the town hall reconfiguration, given our constraints. She stated that it is nice to have plans, but she did not see a cost benefit for that and it is not needed now. She went over some of the line items and Mr. Weber explained the drywell issue which is failing and was also identified as a possible source of a mold problem in the front of the building. The $100K this year was the re-commissioning of the HVAC system. Discussion followed on the water and sewer projects and it was noted that these are estimates of the costs of the projects and we did have an outside evaluation done and we are using that as a guide. Much of the infrastructure was done at the same time 40+years ago so they go out at the same time; now we are looking at different options and specific fixes for specific areas to get better results and efficiencies in energy costs. Mr. DePaolo asked if we are trying to recoup the costs for the projects through the life of the improvement or the life of the bond and Mr. Solvig responded that we try to keep the length of the bonds as short as possible. Mr. DePaolo asked about the comment regarding saving money from community payments and wondered if it was a foregone conclusion that that was happening and Mr. Solvig responded that in order to make projections, some assumptions have to be made. Mr. DePaolo asked about the estimated cost of the emergency generator and whether any research had been done on the actual needs and cost of one. Mr. Weber responded that he had not researched it further and the $I OOK was an estimate. Mr. Engman responded that he thought the City or the County had just done a similar analysis and that might help us. Mr. Weber will check it out. Discuss and consider approval of the draft 2014 Comprehensive Plan Final GEIS Tabled Item from July 11, 2014 Meeting Ms. Ritter noted that we have just received comments from Ms. Brock and some have already been addressed but there are a few that the Board should discuss. The Board focused on the comments distributed for the last meeting and decided to look at Ms. Brock's at the end if there was time or push to the next meeting. Minor adjustments were made and significant comments and discussion from the Board are below: Pg 1 and throughout there are references to substantive comments and he asked who makes the decision on which are non-substantive. Mr. Tasman responded that all comments are considered substantive unless they are editorial in nature. Adopted 8/1 1/2014 TB July 28, 2014 pg 5 Pg 7 Renaming the neighborhoods to TND Medium Density and TND High Density; the Board and committees know what this is but does the public? Discussion followed and the term is throughout the GEIS and the Plan and defined in a number of places and a generally accepted term. Board decided to leave it. Bottom of Pg 13, top of Pg 14—Doesn't acknowledge that we know there will be growing pains etc. Mr. Tasman thought we had in the preceding paragraph(s). Ms. Hunter did not think that we answer the question; we have in conversations, but not here. Discussion followed. All the benefits will not materialize overnight; that point needs to be made. Mr. Tasman will draft language. Pg. 15 Last sentence talking about nodes; have we precluded nodes; shouldn't be saying this will be better when we don't know. Discussion followed. Take out the sentence referring to nodes since this compares 1993 to the new Plan and the node is not in the 1993 Plan. Pg 20 Regarding the golf course. Why is this response different from the comment regarding the athletic fields? Discussion followed and there are different areas of the spaces that have different uses. Natural/Open is predominantly passive and athletic fields are not. This has been a point of concern throughout the development of the Plan and the key will be through zoning because there is no classification named"Open Space"because any space can be "open space"; every character district is going to have some type of open space depending on its characteristics. Ms. Ritter added that the response is going to be modified to denote the ends of the fields and the golf courses and will be addressed during zoning. The problem is also the perception that by putting it in"Campus"the college can do whatever they would like with it. Ms. Ritter said that it has been a problem, along with Ag Districts and what the concept is for that but the restrictions will have to come through the zoning. Mr. Engman stated that since a number of people have a problem with this one, it should be fixed and Planning should draft something. Bottom pg 20 in response to comments regarding takings and legalities. Remove those because there are always reasons for upzoning or downzoning and it is not germane to the Comp Plan. Agreed Pg 22 response to 1-19 Inlet Valley Delete answer 1-20 and refer it to 1-19, it is not substantive. Pg 28 regarding traffic Make it clear that we do not have control over State and County roads. Pg 29 regarding traffic studies Discussion on perception and the accepted standards. Delete first paragraph of the response and stick to the accepted standards that are used. Pg 32 regarding Route 96 traffic Instead of referring back to general traffic,be more specific to Route 96. Pg 32 response saying Route 96 is safe for bicyclists. Discussion—in the town end of it it might be but it certainly isn't now. The response should acknowledge that it is not ideal now,but we hope that that will change. It should not infer that it is safe now; it is steep and narrow in places. It was noted that bicycles are vehicles and have every right to be in the road as traffic. Adopted 8/1 1/2014 TB July 28, 2014 pg 6 Pg 48 Second paragraph Regarding housing prices and the means to buy and the values and assumptions etc. Remove the reference to values. Pg 51 12-7 Eliminate the first sentence. There was disagreement on whether the plan was encouraging or directing or promoting growth. By eliminating the first sentence, it removes the inference and concentrates the answer on the Plan. Pg 54 12-11 Response - Discussion on whether parts should be changed. The key is it is hard to respond to the Minority Report in the GEIS because it doesn't address the DGEIS. First paragraph: put a period after the second "minority report" and change "polemic" to "commentary" Proposed substitution for 2"^ paragraph. The Minority Report is a commentary on the Comprehensive Plan as a whole and offers few comments specific to the DGEIS." Agreed. Pg 56 Throughout there are legal statements that shouldn't be there. Ms. Brock has comments on this section and staff will revise. Ms. Leary spoke to the section discussing housing and wanted the desire for diversity and the fact that diversity doesn't just mean low-income or subsidized housing. Pages 25 or 26 have possible responses that could have that added. Members thought the concept came across very clearly in the Plan itself. Ms. Ritter stated that she would like to review Ms. Brock's comments and see what has already been addressed tonight and come back with any that need discussion by the Board.
