June 7 , 1993
At the regular meeting of the Town Board of the Town of
Ithaca , Tompkins County , New York , held at the Town Hall , 126 East
Seneca Street , Ithaca , New York there were present :

Pledge of Allegiance : The Supervisor led the assemblage in the
4 Pledge of Allegiance .
Call to Order : The meeting was called to order by the Supervisor
at 5 : 36 p . m .

Agenda Item No . 3 - Report of Town Officials
a . Town Supervisor - Brian Wilbur , the newly appointed City of
Ithaca Fire Chief , Deputy Chief Tom Dorman , and Fire Commissioners
Stu Grinell and Lyman Baker met with the Supervisor to discuss some
possible organizational changes within the Fire Department . Those
proposals will be discussed with various groups within the
department , then finalized . Chief Wilbur has offered to make a
presentation to the Town Board at an upcoming meeting . The
Supervisor was most appreciative of the communication efforts of
the Mayor ' s office preceding the Chief ' s appointment and the
Chief ' s willingness to keep the Town of Ithaca involved and
informed as to Fire Department policies and practices .
The Eastern Heights Civic Association on May 20 met with a number
of Town officials and staff to explore the history of and the
present situation concerning Park Lane Extension . Because several
matters came up at that meeting the Supervisor recommended that
once again the public hearing be adjourned and rescheduled for July
12 .
The Assistant Budget Officer , Sally Alario added that the
independent auditor ' s report was left in each Board members mailbox
for them to review . If there are any questions , the Board can
contact Ms . Alario .
b . Town Engineer - Written report presented and reviewed with the
Board , ( see attached ) .
C . Highway Superintendent - Mr . Noteboom reviewed his written
report with the Board , ( see attached ) . Mr . Noteboom mentioned that
the paving was completed on June 1 and 2 .
d . Building Inspector / Zoning Officer - Mr . Frost reported on his
written report , ( see attached ) .
e . Town Planner - Mr . Forman presented his written report to the
Board , ( see attached ) . Mr . Forman thanked Wilma Hornback for all
her help , and wished her the best upon leaving the employ of the
Town .
f . Receiver of Taxes - Mrs . Noteboom explained her report , ( see
attached ) . The tax collection will be turned over to the County on
Wednesday , June 9 . The Receiver explained her negotiations with
Tompkins County Trust Company for the return of service charges on
the checking account .

Agenda Item No . 4 - Report of Town Committees
Councilwoman Valentino reported that the American Community
Cablevision Franchise expired in February , but under the law they
must maintain the agreement . The new agreement has not been
negotiated because of the change in the law that allows
municipalities to regulate fees . The Town Attorney has filed a form
with the State with our intent to regulate those fees . It is not
known at this time exactly what the regulations are . Information
will be forthcoming .
Attorney Barney reported that the Town was sued by an individual
arrested for inadequate brakes following an automobile accident .
Judge Blye imposed a $ 300 bail when the individual was unable to
give a residence address . The individual spent a couple of days in
jail until bail was raised . The man brought a lawsuit against the
Town , the papers were very difficult to understand , and he harassed
the Town Clerk ' s office to gain information . The Judge appointed
an attorney to represent and translate what the man was trying to
do . The Town made a motion to dismiss the case , the case was
dismissed . Judge Blye may still be sued personally , but the
Attorney General has the responsibility of representing him .
Agenda Item No 5 - Report of Tompkins County Board of
Representatives
No representative was present .
Agenda Item No . 6 - Persons To Be Heard
Noel Desch asked the Board what the schedule was for the work on
the Coddington Road walkway along the shoulder ?
Mr . Walker :responded that is a County project . Meetings have been
held about future plans , but there are no plans to construct this
year .
The Supervisor stated that the lighting district in that area is
set to be completed . NYSEG is waiting for equipment , it should be
finished before the start of school in the fall .
Ken Maye , Highway Mechanic addressed the Board . Mr . Maye stated it
was a privilege and an honor to address the Board as he was asked
by the Town Highway workers to do so . Mr . Maye read a letter to
the Board about the Highway workers support of Deputy Highway
Superintendent , Fred Noteboom being appointed as Highway
Superintendent , ( see attached ) .

Mr . Maye empathized the point that the Highway workers would
support anyone who was appointed as Highway Superintendent . The
letter was created during a meeting after the Supervisor spoke to
the highway employees . At that meeting the men expressed feelings
about the last year or so , the workers respect Fred Noteboom and he
is a good man . The letter was signed by everyone at the department
voluntarily , and they were more than willing to sign it .
H . Taraszkiewicz approached the Board and stated he had a complaint
against the Town and the Town Engineer . He owns a house on the
Eastern Heights Road and the Town Engineer went to his neighbor and
meddled in private affairs that had nothing to do with the Town .
This caused a court hearing . Mr . Taraszkiewicz said that he wanted
to know what would be done because he sustained court damages . Mr .
Walker caused more problems than there actually was . The neighbors
sued him and it became a conspiracy against him .
The Supervisor explained that she and Mr . Walker have met over the
incident . Mr . Walker received a call from a resident in Eastern
Heights saying there were drainage problems in the neighborhood and
asking for the assistance of the Town . Mr . Walker investigated the
situation and made a recommendation for the way in which the
overall problem could be solved . Mr . Walker encouraged the three
neighbors involved get together to work out a mutually agreeable
allocation of costs and effort in solving the problem .
For reasons unknown to the Town , the neighbors do not seem to be
able to work cooperatively . Two of the neighbors have taken Mr .
Taraszkiewicz to small claims court for him to pay for some of the
drainage improvements . Mr . Taraszkiewicz perceives what the Town
views as assistance to residents as meddling in private affairs .
The Town could not anticipate that this would go to court . The
Supervisor has determined the assistance given by the Town Engineer
was appropriate . The problems occurred with the inability of the
parties to work out a cooperative agreement .
Mr . Taraszkiewicz said that the Engineer designed the system that
cost $ 4000 and that aroused the neighbors to install that kind of
system . Mr . Taraszkiewicz hired a contractor to show that getting
the water to the road would only cost $ 200 . How did the Town
Engineer design a system that cost $ 4000 , if that is what the Town
Engineer does the he Town will go bankrupt .
The Supervisor said she assumed the court made some kind of
determination of the appropriateness of the solution , and that she
would not second guess what happened in court .

Mr . Taraszkiewicz said that whatever happens in Court , he can not
stand the :interference from the Town . The Town had no right to
interfere . The ditch was 4 feet deep , two feet wide , with three
feet of gravel ; does anyone have that kind of drainage ? No one in
the neighborhood has that kind of drainage .
Councilman Liguori asked who made the determination that it would
cost $ 4000 ?
Mr . Taraszkiewicz said that the neighbors involved hired a
contractor who quoted that amount . The neighbors did not have the
money so they asked him for it . He just bought the house . The
neighbors had the house for fourteen years and did nothing to it .
They knew about the problem and no one told us , they trapped us
into buying it .
Supervisor Raffensperger stated that Mr . Walker ' s estimate of the
of the solution did not come to $ 4000 . The Town does not know all
the circumstances or for what that estimate was given . Mr .
Taraszkiewicz feels it was inappropriate for the Town to have
" meddled " . The Supervisor said Mr . Walker had tried to help solve
the problems as the other residents asked him to do . The Town is
as willing to assist Mr . Taraszkiewicz as any other resident .
Mr . Taraszkiewicz said that he does not have any problems , the only
problems he has is that water is coming from the road and flooding
the house , that is the Towns problem and the neighbor is suing him
for it .
Supervisor Raffensperger responded that she did not believe that
any water involved in the lawsuit is coming from the roadside , it
is coming from the foundation drains .
Mr . Taraszkiewicz said yes , but where does the water come from to
the foundations ?
Councilman Niklas that it would seem inappropriate to resolve this
issue this evening . If Mr . Taraszkiewicz has legal recourse he
should seek legal representation . Councilman Niklas advised Mr .
Taraszkiewicz to have his attorney deal with this the appropriate
way by contacting the Town Attorney ,
Mr . Taraszkiewicz said he would have an attorney .
Councilman :Klein asked if the $ 4000 work had been done ?

Mr . Taraszkiewicz responded that it had not been done , he would not
pay a cent of it because he just bought the property . He is
involved in this as an innocent man the Town is helping to destroy
people .
Councilman Liguori asked if the small claims case has been heard
yet ?
Mr . Taraszkiewicz said that the result is not in yet and no matter
what happens he was very upset about it . The Town should not
encourage people with this kind of problems .
The Supervisor responded that the Town did not encourage anything
but cooperation between the parties .
Mr . Taraszkiewicz said no one invited him to look at the property
if I was involved I should have been there .
The Supervisor noted that Mr . Taraszkiewicz was contacted by the
other neighbors and asked to cooperate , and that for whatever
reason he felt that was an inappropriate request .
Mr . Taraszkiewicz said that any letters he received he turned over
to the real estate people because they sold him the house . The
neighbors knew the problem but they do not answer the complaints
sent by his attorney .
The Supervisor said this is a matter that is presently before a
small claims court and it is inappropriate for the Town to comment
any further on it at this point .
Mr . Taraszkiewicz said he would get the court transcript to prove
that Mr . Walker was with the plaintiff all the time . The Court
would not even let him speak .
The Supervisor said that the Town would be interested in seeing the
court transcript , and thanked Mr . Taraszkiewicz for addressing the
Board .
Agenda Item No . 14 - Ethics Disclosure Statements Announcement
The Supervisor announced that the annual Ethics Disclosure
Statements are available for public inspection in the office of the
Town Clerk . Anyone may come in and ask to review those .

Agenda Item No . 15 - Modification of Ethics Local Law No . 4 / 1992
The Supervisor explained that the Ethics Board has recommended a
modification to the ethics legislation having to deal with
pecuniary interest .
Attorney Barney explained that the item came up when members of the
Ethics Board read section 7 of the Local Law which states that
" whenever an official is called upon to vote on , advise on , or
otherwise take discretionary action on a matter before the Town and
either the performance or non performance of such action provide a
pecuniary or material benefit to himself , herself . . . . . " . The
problem is that approximately ` 90o of the action the Town Board
takes may involve a pecuniary benefit or non - benefit to members of
the Town Board . Setting a budget , raising taxes or lowering taxes ,
technically effects the Board Members personally .
The Ethics :Board felt that this needed to be more limited in scope .
The Ethics Board reviewed the State law which deals strictly with
contracts between a municipality and the individual involved . Mr .
Barney felt. that was more restrictive than was necessary . The
proposed legislature Mr . Barney drafted includes contracts and
certain actions taken by Boards , ie . Zoning Board , Planning Board .
Motion made by Councilman Niklas , seconded by Councilman Liguori
setting a Public Hearing for July 12 , at 7 : 30 p . m . in order to
consider modifications to Local Law No . 2 of the Year 1979 and
Establishing Revised Ethics Rules Applicable to Town of Ithaca
Officers and Employees . Carried unanimously .
Supervisor Raffensperger said that the Board would - have sufficient
time to review the proposed changes before the Public Hearing .
Councilwoman Valentino asked if these changes were the only ones
suggested by the Ethics Board ?
Attorney Barney said these were the only changes suggested in the
Ethics Law , the Ethics Board did suggest a change in the disclosure
form to make clearer that an interest is more than a contractual .
A contract can be oral or implied as well as written . The changes
will be made: in the form before next year ' s disclosures are filled
out .
Agenda Item No . 17 - Annual Fuel Bid Specifications and
Advertisement
Mr . Noteboom stated that the form is the same as last year with a
few small changes on fuel pricing . The Town Attorney assisted on
those changes .

Motion made by Councilman Liguori , seconded by Councilman Niklas
accepting the Fuel Bid Specifications and Advertisement to be
placed by the Town Clerk .
The Public Works Committee did discuss the specifications .
Motion carried unanimously .
Agenda Item No . 18 - Highway Utility Trailer
Mr . Noteboom explained the notes included from the Public Works
Committee meeting regarding the trailer .
The Highway Department is requesting permission to purchase a
twenty ton tilt bed trailer with air brakes . The old trailer can
no longer has brakes , it is unsafe .
The new trailer would give greater flexibility in moving equipment
saving maintenance costs on other vehicles . When equipment is run
on the road to locations it adds wear with no actual use .
The Supervisor said the purchase of a reconditioned trailer was
reviewed and recommended by the Public Works Committee .
Councilman Liguori asked if there was any value to the old trailer .
The old trailer will be taken to the County auction in September ,
it is not known what value it will bring .
Councilwoman Valentino said she noticed on the prepared notes that
there were some very good prices on new trailers , why is a new
trailer not being considered ?
Mr . Noteboom explained that a the new trailer would have to be
picked up in Syracuse , the factory reconditioned trailer as
proposed was guaranteed to be just like a new trailer . Everything
is redone on the reconditioned trailer . The warranty is a year on
either reconditioned or new . The reconditioned trailer would have
new tires , all new wood , springs , a total recondition .
Councilman Klein said that there was discussion at the Public Works
Committee meeting regarding the procurement of prices on this
trailer . Councilman Klein wanted to make sure the Town Attorney
endorses the methodology of acquiring this trailer since it is very
difficult to bid .
Attorney Barney said if it were new the bidding would not be
difficult . Under an expenditure of $ 10 , 000 there is no problem ,
and this equipment is used .

Motion made: by Councilman Liguori , seconded by Councilman Niklas
authorizing the Acting Highway Superintendent to purchase a twenty
ton utility trailer with GVW 39 , 040 equipped with tilt bed and
airbrakes from Bradco Supply Company for $ 8 , 500 . Carried
unanimously .
Agenda Item No . 20 - Capital Improvement Priorities
At the last meeting the Town Engineer was instructed to bring back
to the Board a proposal for bonding a combination of projects .
The Town Engineer explained two projects that do not need bonding
which he would like to proceed with , ( Schickel Water District and
Glenside improvements ) .
Mr . Walker explained that Glenside has an old water main with
certain areas needing to be upgraded , there are funds available in
the Capital Project .
The Supervisor noted that even if this is not described in the
projects for Capital improvements authorized by Audit and Control
the understanding is that if there is money left from the Capital
improvement project it can be transferred into the water budget and
used to service the debt . This would free up other funds already
budgeted for the interest and principal payments . Whatever is
determined as the proper way to fund it , the project is feasible .
Mr . Walker said that the Glenside project is estimated to cost
about $ 40 , 000 . If the project can be made as part of the change
orders of the existing contract it will simplify the process .
Assistant Budget Officer , Sally Alario asked if this would still be
kept within Capital Projects ?
Mr . Walker said that it would not exceed the change over
limitations of the capital projects . It is the same general work
area .
Attorney Barney asked if it would cause it to exceed the bond
limit ?
Mr . Walker :responded no , there is existing Bond monies available ?
The contract prices for the Inlet Valley Project , 3 & 4 have been
significantly under the estimated cost .
Councilman :Liguori asked if under the Towns water district law ,
does anyone ' s assessment get changed ?

Supervisor Raffensperger responded no . The monies not spent on the
bonding could be used to pay the interest and principal on the bond
debt limit .
Attorney Barney said that an amount for a Capital Project is
authorized at a public hearing , you cannot go over that amount
without another public hearing .
The Supervisor said she and the Town Engineer need to explore what
the Town is permitted to do , either way it seems that the funds are
available . One way would not be convenient as it would have to be
bid . The Supervisor and Town Engineer are requesting authorization
from the Board to proceed to look at providing the improvements to
the Glenside area at a cost of approximately $ 40 , 000 .
Motion made by Councilman Niklas , seconded by Councilman Liguori
authorizing the Town Supervisor and the Town Engineer to proceed to
investigate a project to provide water to the Glenside area of the
Town at a cost of approximately $ 40 , 000 . Carried unanimously .
The Supervisor stated the Town needs to address negotiations with
the landowners in the Schickel Water District for a share of the
cost to extend public water to that district .
Motion made by Councilwoman Valentino , seconded by Councilman
Whitcomb that the Supervisor and Town Engineer are to negotiate
with the landowners in the Schickel Water District for a share of
the cost to extend public water to the Schickel Water District ,
The Town Supervisor and Town Engineer are to report to the Town
Board results of those negotiations at the July meeting . Carried
unanimously .
Mr . Walker explained that the Schickel Water District project is
his highest priority this year .
Agenda Item No . 24 - Appointment Dog Enumerator
The Town was very fortunate to have had some very good applicants
for this position . Lyman Baker has applied and it is the
Supervisor ' s recommendation that he be appointed at the same rate
as previous enumerators . Mr . Baker would be paid $ 1 . 50 per dog
enumerated and $ . 28 per mile . Mr . Baker understands that this to
be done in sections .
Motion made by Supervisor Raffensperger , seconded by Councilman
Niklas appointing Lyman Baker as the Town of Ithaca Dog Enumerator
at a fee of $ 1 . 50 per dog enumerated , and $ . 28 per mile with the
enumeration to commence no later than July 1 , 1993 and ending no
later than November 1 , 1993 . Carried unanimously .

Agenda Item No . 25 - Ratification of Appointment Planning Secretary
Town Planner , Floyd Forman reported that the interviewing committee
selected Starr Hays . Ms . Hays has started to work on a part time
basis . She! has been very helpful and cooperative , she will start
full time on June 25th after Wilma Hornback leaves .
Motion made by Councilwoman Valentino ratifying the employment of
Starr Rae Hays as Secretary to the Planning Department , effective
May 24 , 1993 , on a part - time basis until June 25 , and regular ,
full - time after that date . Starting salary is $ 7 . 00 per hour . Six
month probationary period applies with all benefits applicable to
the status of the position . Carried unanimously .
Agenda Item. No . 26 - Employment Engineering Aides
The resolution adopted at the May meeting approving Engineering
Aides for the summer needs to be modified based upon the budgeted
line items that should have been used .
Motion made! by Council Niklas ratifying the employment of three
temporary Engineering Aides , two at salaries of $ 8 . 00 per hour , and
one at a salary of $ 7 . 00 per hour budgeted to accounts F8340 . 101 ,
$ 2700 ; and G8120 . 101 , $ 2700 with benefits limited to the temporary
status of these positions . Seconded by Councilman Klein . Carried

Agenda Item No . 27 - Appointment & Additional Compensation Acting
Highway Superintendent
Motion made by Supervisor Raffensperger that the Town Board of the
Town of :Ithaca hereby appoints Fred Noteboom as Acting
Superintendent of Highways ; and further that Fred Noteboom be
granted a temporary salary adjustment equal to approximately one -
half the difference between the compensation for his present
position and the 1993 salary of the Highway Superintendent or an
annualized salary rate of $ 28 , 750 to continue until such time as
the Town Board shall determine . The adjustment shall be
retroactive to May 14 , 1993 . Seconded by Councilman Niklas .
Carried unanimously .
Agenda Item No . Additional 1 - Needs Assessment Plan
Mark Kaplan , Town Representative to Joint Youth Commission
approached the Board . Mr . Kaplan asked for the Board ' s support on
a proposed needs assessment for the youth in the town . The needs
assessment would be targeted at the undeserved youth , those who may
be considered at risk , or need more support than the usual . The
assessment is hoped to accomplish the development of qualitative
information that will allow the Joint Youth Commission to make
plans that have impact on the community .

A consultant would be hired to conduct a comprehensive approach to
answer what is needed . The first stage would be the meeting of
several focus groups , the second stage will consist of follow up
questions to the youth of the community , and then a concept mapping
stage . That report will be generate a series of recommendations .
The Commission using that information will develop a plan for the
next several years . The cost would be about $ 3500 .
Nancy Zahler reported funding would be made available from County
dollars set aside for the Town of Ithaca and the Village of
Lansing . This activity would be 100 % reimbursable .
The Supervisor noted this sounds like the type of thing the Town
Board has discussed being done .
Councilwoman Valentino said the Town of Ithaca is very well served
by our Joint Youth Commission . The members who serve spend a great
deal of time and are very dedicated .
Motion made by Councilwoman Valentino that the Town of Ithaca
requests the Tompkins County Youth Bureau appropriate up to $ 1780
from the balance left in the Town ' s County Youth Service account to
hire Sharon Brisolara as a consultant to conduct the proposed needs
assessment and to pay for the related expense as outlined in the
attached budget . Councilman Niklas seconded the sentiments made by
Councilwoman Valentino as well as the motion . Carried unanimously .
Agenda Item No . Additional 2 Recreation Task Force Survey
There has been a Task Force put together from the City Youth
Bureau , Town of Ithaca and surrounding municipalities to work on an
idea of dealing with the recreation programs in a differently than
directly contracting with the City . It would be a system of
recreation where all parties are equal partners in the decision
making . A specific amount of activities would be moved away from
the City and to the neighborhoods .
The committee has been working on a survey . The survey being
distributed through NYSEG did not work out . Another form of
distribution would be through the Pennysaver as a folded insert
within the Ithaca School District location . The incentive for the
return of the survey would be prizes awarded from a drawing . Some
prizes will be passes to recreation activities and others from
businesses in the community .
However , there would still be costs involved for printing and
distributing . The Committee is asking that the Town pay one third

of the printing and distribution . One third would be paid by the
City with the City offering free passes and prizes to youth
facilities . The County will also put up one third . The Town ' s
contribution would be $ 750 . 00 .
Councilman Whitcomb asked how this would effect the project
discussed in Addition Item No . 1 ?
Councilwoman Valentino responded that it would help because the
information. will be shared . Some of the questions are different
compared to, the Joint Youth Commission ' s needs assessment . With
both things being done the information received will be much
better .
Supervisor Raffensperger pointed out that the Needs Assessment is
geared to the under serviced youth , this survey will poll
recreation needs of children who are probably involved with some
recreation services .
Councilwoman Valentino stated the City passed a resolution which is
similar to the one for the Town showing their Common Council is
committed to this concept . The resolution is being circulated to
all municipalities in the County so that all will feel they are
included and can commit to the concept .
Councilwoman Valentino said she is requesting funding , and the
Town ' s support of the concept .
Motion made by Councilwoman Valentino , seconded by Councilman
Niklas that the Town Board confirms its support for the efforts of
the Inter - Municipal Task Force to develop a plan for inter -
municipal :recreation for the greater Ithaca area , up to and
including the County , and that the Town ' s participation in the
Recreation Needs Survey shall not exceed $ 750 . 00 .
The Supervisor stated there are more than sufficient funds in the
budget to cover the cost . At budget time monies were included to
support efforts to insure the Town was not put in a position of
having to participate solely through the City programs and not
having funds to develop programs jointly with other municipalities .
Motion carried unanimously .
Agenda Item No . 19 - Drew Subdivision Water Extension Petition
Frank Davenport , Vera Circle addressed the Board . Mr . Davenport
stated that he and other residents came to enlighten the Board

about a serious water problem in the western portion of the Town by
presenting a petition , ( see attached ) . The residents requested
that the petition and the comments be officially entered into the
minutes , that this issue be assigned as a priority to accomplish ,
and that it be reported on in Town to citizens communications on a
quarterly or semi - annual basis .
Selma Hathaway , 100 Vera Circle spoke to the Board . Ms . Hathaway
stated that her house was new nine years ago . Two years ago all
the basement pipes had to be replaced because of the glacier dust
in them . Mrs . Hathaway showed the Board a sample of the " stuff "
that had come out of the pipes .
The Supervisor stated that over the years previous Town Boards have
heard the same concerns . This Town Board has discussed the
problems in that area including the possibility of extending water .
There has been a preliminary report from the Town Engineer . The
Town Board with the petition in hand should ask the Town Engineer
to investigate the area encompassed within the petition and to give
the Town Board an idea of the cost for providing water and possibly
sewer to the area .
The Town Board is presently undergoing an overall examination
regarding the requests for extensions of water , sewer , and
infiltration projects . At the July meeting there will be a list of
those projects in a priority manner for the Town Board ' s approval .
The Planning Board will be consulted on that list . Then the Town
will proceed within the confines of the ability to pay for the
projects to set up a package to bond the completion of these
projects .
Tim Beam , 286 Hayts Road told the Board that their water is salt
water it cannot be consumed . All drinking water is brought in .
It would be very beneficial for his family to have the water
extension .
Molly Davenport , 118 Vera Circle asked that when the Town Engineer
does the preliminary findings could the residents be told how many
Town residents do not have public water ?
Motion made by Councilman Liguori , seconded by Councilman Niklas
authorizing the Town Engineer to complete a study to determine the
cost of providing water , and possibly sewer to the area encompassed
within the presented petition for the Town Board meeting in July .
Councilman Niklas stated that because he is a resident on Vera
Circle he can verify that the water is unpalatable . It has sulfur

and sediments . For the record , Councilman Niklas said he would
abstain from voting and discussions unless it is for information

Motion called , all in favor with the exception of Councilman Niklas
who abstained .
The Supervisor told the residents that the Town would keep in
contact with them regarding this matter , and thanked the residents
for coming .
Agenda Item No 7 - RECONVENED PUBLIC HEARING , Conveyance of
Property Adjacent to the Frandsen Subdivision , Consideration of
Change of Status General Purpose Land
The Supervisor opened the Public Hearing at 7 : 00 p . m . The Town
Clerk had proof of posting and publication .
Supervisor Raffensperger recommended that the Town Board adjourn
the Public Hearing to receive additional information before
proceeding .
No members of the public wished to speak during the Public Hearing .
Motion made by Councilman Niklas , seconded by Councilman Liguori
that the Public Hearing be adjourned until 7 : 00 p . m . July 12 , 1993
at the regular Town Board meeting . Motion carried unanimously .
Agenda Item No 21 - Extension Service Area , Wastewater Treatment
Plant
The Town Engineer explained that the Town of Dryden is one of the
members of the Joint Sewer and they have a limited service area
that drains into the Ithaca Area Waste Water Treatment Plant .
Dryden and the Monkeyrun Districts are served by the SJS . Dryden
has created. a proposed water and sewer district which has been
approved by Audit and Control . They need to buy additional
capacity from the Waste Water Treatment Plant to serve the new
area . Under the regulations of the SJS the members have a certain
amount of capacity allocated to them . There is a certain amount of
reserve capacity that each member owns , and they are obligated to
sell to the other members reserve capacity when there is a need .

A written request has been received from the Town of Dryden to
approve this . The proper approach is for the SJS to accept it and
then recommend it to the other municipalities for approval of the
sale .
Mr . Walker asked the Board for a general consensus of approval .
There is capacity in the plant and Dryden has the funding available
to purchase it . They are asking for an additional 100 , 000 gallons
per day . Mr . Walker recommended that the Board approve by
consensus Dryden Is plan .
Councilman Liguori said that the amount they are requesting is a
small percentage when the plant has a capacity of 10 , 000 , 000 per
day .
The Supervisor explained that what the Town needs from the SJS is
their recommendation that the Town proceed to approve this . It
seems inappropriate that the individual towns approve this before
a recommendation from the SJS .
The Town Board instructed Councilman Liguori to inform the SJS that
a favorable consensus was reached on the proposal from the Town of
Dryden for the purchase of excess capacity for the Turkey Hill
Sewer District and the Town of Ithaca looks forward to receiving a
recommendation from them .
Motion made by Councilman Liguori authorizing the Town Clerk to
advertise for a Public Hearing to be held on July 12 , 1993 at 7 : 45
p . m . in order to consider the out of district portion of the Turkey
Hill Sewer District in the Town of Dryden , and the sale of excess
sewer capacity for said district . Seconded by Councilman Niklas .
Carried unanimously .
Agenda Item No . 28 - NYS Employee ' s Retirement System Standard
Work Day , Record Keeping Procedures
The Supervisor explained this item deals with the elected and
appointed officials participating in the New York State Employee ' s
Retirement System . The Town has not in the past met the
requirements of the record keeping and standard work day for the
retirement system . The resolution ( see attached ) sets up the
system and sets days for retirement reporting , and the standard
workday for elected officials as ( 6 ) hours / day , and appointed
officials as ( 7 . 5 ) hours / day .
The Supervisor moved the resolution so the Town could proceed to
set up the system and notify elected officials of their rights .

The Supervisor explained that elected officials are supposed to
keep an accounting of the hours worked in a sample month . The
sample should include all hours spent actually performing their
duties , but should not include the status of being on call .
This will not go into effect until January 1 , 1994 , so that present
incumbents do not feel imposed upon . There has been some criticism
from Audit and Control of some of the procedures that have been
used in the past . The Town wants to improve those as of 1994 .
Motion was carried unanimously .
Agenda Item No . 10 - Judd Falls Road Reconstruction Proiect
Mr . Walker explained that as part of the Highway Superintendent ' s
original approved paving plan reconstruction of Judd Falls Road was
included . At the Town Board meeting where the list was approved
the Town Board asked the Highway and Engineering Departments to
prepare a design for approval prior to the completion of the work .
The reconstruction of Judd Falls Road has been scheduled by the
Highway Superintendent for several reasons . The pavement is in
very poor condition and is past due for resurfacing . A ten year
paving plan was set up and this project was scheduled as a project
in 1986 . No work has been done on the road since 1986 when it was
due for paving due to the conditions of the road .
The concrete curb and gutters are in extremely poor condition
resulting in drainage problems along the shoulder of the road
because of settling of the curb section .
The road base at the north end of Judd Falls Road near the Forest
Home Drive intersection is in very poor condition and has resulted
in a great deal of maintenance work . This leads to safety problems
and does not. deal with the maintenance problems over a long period
of time .
The grade of that intersection is steeper than the normal design
standards . The drainage system near the intersection of MacIntyre
Place consisting of several catch basins and drainage pipes need
repair because of settlement of the curbs . Water doesn ' t get to
the inlets because they are actually higher than the low points of
the road . There is a standing water problem on Forest Home Drive
between the end of Judd Falls Road and the point that was repaired
several years ago when there was a major slide . Presently there is
a wooden walkway along Beebe Lake . When the slide was repaired a
manhole was installed to make provisions for drainage .

The sight distance at the Judd Falls Road , Forest Home Drive
intersection has been a concern of the Highway Superintendent for
several years because of the high banks .
Cornell University has scheduled repair of the pipe arch underpass
of the Plantations Road which will require excavation of the road
down to the top of the pipe . The road will be closed .
Coordinating the work with Cornell will save both parties money
because Cornell will have to repave upon completion of their work .
The original design considerations which are normally used would be
to mill the existing asphalt pavement . Milling is grinding off the
material so that it can be salvaged for recycling for road base
fill . This is necessary to correct the depressions in the road
that have created the drainage problems . The existing curb and
gutter sections would be replaced with granite curb which is an
extension of the curb Cornell installed . Granite curbing would
also enhance the neighborhood .
The original proposal was to take an existing road which was 21
feet wide and increase it to 22 feet face to face of the curb .
This would be a standard eleven foot lane width which is the Town ' s
highway standard .
It was also proposed to regrade and improve the road base at the
Forest Home Drive end of Judd Falls Road to flatten the road grade
from a current maximum slope of 13 % to a more susceptible slope of
70 . Considerable fill at the intersection up to two feet , and
three feet on Judd Falls Road would be needed .
Original plans called for regrading of Forest Home Drive to improve
the drainage and increase the slope on Judd Falls Road with two
feet of fill on Forest Home Drive , on the north side across from
the intersection , this would probably require a retaining wall .
Original plans also called for catch basins at the intersections at
Forest Home , Judd Falls , and the outlet to replace the 15 "
corrugated pipe that is there now .
For the site distance problems it was proposed to cut back the
banks on the southeast and southwest corners of Forest Home Drive
and the Judd Falls Road intersection to improve the site distance
and to allow flatter road grades . This requires a reinforced
concrete retaining wall . Cutting back the bank would allow for
installation of sidewalks in the future . That would be a major
project .
The design process was made because of the concerns of the Town
Board , the Highway and Engineering Departments , and because the

Town is highly sensitive to the residents who live along this area .
There has been a coordinated design process with members of the
Forest Home Improvement Association . A meeting was held prior to
the final field survey this spring to insure that the Town would
have any information needed to address their concerns . Their main
concern was pedestrian safety because of vehicle speed and the
proximity to the vehicles as people walked along a narrow path on
the shoulder .
Safety concerns for vehicles backing out of driveways were concerns
that are impacted by vehicle speed and site distance problems , and
preservation and enhancement of the neighborhood was also very
important to them in the historic neighborhood .
Town staff developed preliminary designs and met with Forest Home
representatives and walked the length of the project to discuss
structure locations and the impact on the driveways . That
information was used to design flattening the grades and reducing
the amount of cut on the road to minimize the amount of impact on
the driveways , because it would have made some of them very steep .
As the process was developed over the past month there have been
two meetings to review the designs and review the efforts to
minimize the impact .
The final design is a road width reduced to 20 feet face to face of
the curb . The curb on the west side of the road will be moved one
foot further east . Moving the road is necessary because of an
existing gravel path that the residents made themselves and use .
Moving the curb over a foot will gain a little space to have
separation from pedestrians and cars . There will be a maximum curb
reveal of six inches for the entire length of the project . That is
a safety consideration for pedestrians walking along the curb , so
if they step off it is not such a high fall . The maximum design
slope has been increased from 7 % which was fairly steep , to 7 . 9 % .
This will decrease the length of the major cut when the regrading
is done to 300 feet .
There originally was a maximum cut of four feet in the center line .
The center line of the road is humped because of the paving and
patching process over the years . Now there will be a maximum cut
of two feet at the center line , and a maximum cut at the curb line
of one foot because of the crown of the road . That is one foot
from the top of the road to the existing lawns . The areas done
would easily blend into the lawn . It will not disturb any of the
stone walls in that area .

The maximum cuts at driveways have been limited to one half foot so
that the slope of the driveways is not increased . The maximum fill
on the Forest Home Drive intersection is now one foot in the center
line and approximately eight inches on the north boundary . Field
investigations showed that will make it a very gradual slope into
the existing parking areas along the roadway . The site distance
cuts have been eliminated from the plans .
Mr . Walker felt the project is a low impact one , and asked that the
Board approve the design .
The Supervisor said that the Forest Home Improvement Association
asked to make a statement .
Lars Washburn , President of the Forest Home Improvement Association
addressed the Board and thanked them for their support of the
Association ' s concerns in the past and the opportunity to speak
this evening .
In 1994 the bicentennial of the settlement of Forest Home will be
celebrated . Those who have chosen to live in Forest Home value the
historic character , sense of community , and the traditional
concepts of designing in harmony with nature . These values are
shared by the many visitors who come to enjoy the scenic areas
around the neighborhood .
Town policy calls for the preservation of existing neighborhoods ,
and Forest Home strongly supports the Town ' s commitment to the
community at large .
Last year the Town came to Forest Home with a proposal for changes
to Judd Falls Road . This evening Forest Home Association comes to
present the community response to the proposal as it now stands .
Ruth M . Mahr , 103 Judd Falls Road read a prepared statement to the
Board , ( see attached ) .
Bruce Brittain , Chair Forest Home Traffic Committee explained their
evaluation of the engineering staff proposal .
Mr . Brittain passed out a hand out , ( see attached ) .
Agenda Item No . 11 - Public Hearing Modification of Allowed Uses in
Special Land Use District No . 4 , 1261 Trumansburg Road
The Supervisor opened the Public Hearing at 7 : 30 p . m . , and stated
the Town Clerk has proof of posting and publication . The
Supervisor postponed the public hearing until the conclusion of the
discussion on the Judd Falls Road reconstruction project .

Mr . Brittain began by recalling that the Judd Falls Road rebuilt
project was discussed last spring . Forest Home and Town
representatives discussed the project and could not come to an
agreement . At that time it was decided to spend this past year
working jointly to come to a mutual agreement .
Bob Mooney and Mr . Brittain arranged a series of meetings with
Forest Home and Town representatives . Discussions ensued on what
mutual agreement meant as well as clarification on the points where
there was agreement and disagreement . This was done before any
design work was done . The meetings were cordial but not
productive . Mr . Walker threatened Forest Home with the use of
imminent domain , and briefly described projects such as removal of
some of the stone walls , eight foot wide sidewalks , cutting banks
back , concrete retaining walls . The proposal presented tonight by
the Town Engineer is essentially the same as the proposal that was
unacceptable at that time .
The single biggest change this spring has been the mapping of the
existing conditions that fluctuated greatly and only recently
seemed to have stabilized . Several time this spring Mr . Brittain
has tried to get back toward an agreement since matters were not
being addressed . Mr . Walker told Mr . Brittain that the Town would
build whatever he designed and " that allowing Forest Home ' s input
was an obstruction of government " . That is an exact quote .
Mr . Walker said he did not feel that was exactly what he said , but
that he did mention obstruction .
Mr . Brittain presented the Forest Home ideas of the engineering
aspects of -the proposal .
A road such as Judd Falls serves both the motorist and effects the
community in which it passes . Mr . Brittain presented information
based upon the motorists perspective . The first question that
needs to be addressed is whether Judd Falls Road is too steep .
Page 2 of the handout compares roads within Forest Home . It is not
true that other roads in Forest Home are too steep and dangerous .
It is that Fall Creek Valley is cut 100 feet into the surrounding
plateau you cannot cross Fall Creek without going downhill and then
uphill . Any car that is on Judd Falls Road has either just been
on , or about to be on Pleasant Grove Road or Warren Road both of
which are steeper , and both which were recently rebuilt by Tompkins
County to a steeper grade .
Another question to be asked is whether Judd Falls Road is steeper
compared to other roads ? The answer is no , based on a sampling of

other roads in the area . Page 3 of the handout shows that many
roads are steeper including ones that were built or rebuilt by the
Town .
Is the Judd Falls Road , Forest Home Drive intersection dangerous ?
Page 4 of the handout shows no . That intersection has a very good
safety record when compared to other intersections .
Is there a general feeling among the public that this is a
dangerous or poorly designed intersection ? Page 5 , the answer is
no . A residence survey showed there were no complaints about the
intersection .
Is the stop sign in compliance ? Recent traffic counts Forest Home
has taken in the community indicate that the Judd Falls Road
approach to the intersection has substantially better stop sign
compliance , ( ie . fewer people running the stop sign ) , than most
other intersections in the area . From an engineering perspective ,
Mr . Brittain sees no reason to rebuild Judd Falls Road .
If Mr . Walker ' s proposal were followed what would the likely result
be ? Mr . Walker has recommended widening the pavement making it
smoother and lowering the grading . Cars will go faster , there will
be reduced stop sign compliance at the intersection , and likely an
increase in the number of accidents .
Steve Veder of the NYSDOT has statistics that show that repaving a
road such as this does lead to an increase in accidents . It is
important that other measures be taken to attain driver
attentiveness when a road is smooth and repaved . A major headache
for motorists going through Forest Home or any densely settled
residential area is constantly being on the look out for children ,
pets , people crossing the street , and cars backing , into traffic .
Mr . Walker ' s proposal does not address any of those concerns .
Looking at the road from a residents perspective documents that too
much traffic is detrimental . Judd Falls Road already gets about
ten times what is considered maximum acceptable upper limit for
traffic in a residential area . From an engineering perspective any
rational solution would involve a drastic reduction in the amount
of traffic on Judd Falls Road . Instead this proposal widens the
road , removes road side trees , shows decreases between the buffer
and the walkway , and includes road cuts to make driveways steeper
and less useable .
From the Forest Home perspective an ideal solution would be to
eliminate all through traffic , but Forest Home realizes they are
going to have to compromise . Since the road already serves the
motoring public well , it is used without undue delays , it is not

steep or dangerous in comparison to other roads , and the road and
traffic it carries do a tremendous service to the community any
compromise would have to result in a decrease in traffic to the
area . Forest Home is already beyond its compromise position .
A major project has other aspects that need consideration besides
engineering , Planning and long term transportation . How does
rebuilding Judd Falls Road in order to accommodate more traffic fit
into the plan ?
There are environmental concerns such as changing of land contours
and the loss of trees .
There are historic concerns . Forest Home has been designated one
of New York State ' s historic districts . Funds from this project
come from the State . It is understood that rebuilding projects
that effect the character of a historic district would have to be
approved by the State Commissioner of Parks and include historic
preservation .
There are scenic and aesthetic concerns . The New York State scenic
roads program was supposed to guard against this sort of piecemeal
degradation of the visual character of the Town .
The community issues both in Forest Home and the greater Ithaca
area are opposed to the proposed plan as evidenced on the petition
on Page 1 of the handout . There were over 3000 people who signed
the petition last spring against this proposal .
Fiscal constraints are a concern , is this the best use of the
Town ' s limited resources ?
It is up to the Town Board to look at the whole picture and to
bring balance to the process .
George Hascup spoke to the Board about the alternate proposal that
would be of benefit to motorists and residents that Forest Home
believes would satisfy the mutual agreement being sought .
Mr . Hascup , 115 MacIntyre Place said he is an architect and
performs site planning at Cornell University has designed roads for
the City of Ithaca . Mr . Hascup presented some alternatives to the
Board .
The road works and there has been sensitive repair at the steep
slope at the end of Judd Falls and Forest Home Drive , why fix it ?
There are more important priorities that could be invested in .
Most important is to face the safety issue and reopen the
pedestrian walkway of the bridge .

The concrete cribbing is deteriorating very rapidly . There are
physicists who are trying to measure this movement . It is not a
simple engineering problem to repair the wall . The investment
proposed for the granite curbing would be better spent on
stabilizing the slope on the waterway / walkway . The most difficult
curb left is the small S curve near the wooden foot bridge . There
is erosion there .
If something has to be done to repair Judd Falls Road a lower
impact would work . The drainage works fairly well and needs
minimal maintenance . The eighteen foot paving has served the area
well . The concrete 18 inch curbs provide a natural buffer if
cleaned the drainage would work better . A simple resurfacing of
the area would be adequate as was done with the washburn problem at
the bottom of the slope . That was accomplished quickly and does
not show where it was completed . It is not a long term solution ,
but a twenty five year solution of granite with a deep cut is not
needed at this time .
The granite curb is not needed , the soft curbs blend in with the
neighborhood . The knifed edged granite is not appropriate and is
sharp and dangerous . The last resort with granite would be to keep
the 18 foot paving and put in the soft edge curbs . They are much
more rural and in keeping with the area . To make this kind of
investment in granite which would last hundreds of years means
three specimen trees would be lost .
Mr . Hascup said that he is involved with the Cornell University 25
year plan . Even though there are fiscal restraints there is a
complete orchard satellite campus planned for the next 25 years .
There are linkages planned to Judd Falls Road . There will be
extensive development in the medical school . Cornell is planning
extensive development . Alternative bypass routes are still worth
discussing given the future of the road with the plans described .
To complete this proposal now is not the best alternative . It
would be better to maintain it and pave it in a simple way . Let
time bring forward what is appropriate .
Supervisor Raffensperger mentioned that in the comments made it is
important to note that if the Town Board at this time had the
ability to build a bypass around Forest Home it would be done .
The Town of Ithaca , Dryden , and Lansing through the Metropolitan
Planning Organization took to the State a joint request that the
State look at a bypass to the east of Forest Home and to the east
of the Lansing development . The State said that they would take it
under consideration , but that they considered that a not too
important local improvement ' . At least the three municipalities

have attempted to bring it to the attention of the State and there
was agreement locally that it was something that could be
supported . These entities will continue to pressure the State to
include this in the overall plan in this area for transportation .
Councilman Whitcomb asked Mr . Walker what precipitated him to
target this area for improvements this year ?
Mr . Walker responded that this project has been on the list for
reconstruction since 1984 - 1986 . It was targeted for construction
last year because of the coincidence of Cornell replacing the road
surface of the Jug Handle area . The road surface will be excavated
to replace the foundations of their structure under the Town road .
There is concern for structure failure . Cornell has to close the
road to do this work . Paving a road is better when it is started
at one intersection and completed at another .
Supervisor Raffensperger pointed out that she and Councilman
Liguori went to a meeting with the Forest Home Improvement
Association. last year in which they discussed their concerns with
the plan as it was developed at that point . The plan was at least
as extensive a plan as outlined in the original plan that went to
the community this year . Last year , because of the concerns of
Forest Home , Councilman Liguori and the Supervisor recommended that
the Town riot proceed but work with Forest Home so that the
reconstruction of the road could be completed this year .
It has been on the regular paving plan since at least 1986 , and
each time it has been postponed .
Councilman Liguori asked the Attorney if the Board accepts the
request by Forest Home and just does repaving , in the face of the
Town Engineer suggesting there are needed safety improvements ,
would the Town accept a new liability and can the Town make Forest
Home take some of that liability ?
Attorney Barney responded that the Town cannot make Forest Home
accept the liability . Mr . Barney was not sure the Town takes on
any greater liability either way . Through Board and budgetary
processes there are constantly areas of the Town needing attention .
If the Town Board decided not to go with the Engineer ' s
recommendation there would be no difference from anything else
which had action .
Councilwoman Valentino said she has felt that not just in Forest
Home , but anywhere in the community where roads are widened we
begin to deteriorate the character of those neighborhoods .
Councilwoman Valentino has never been convinced that a wider road
is a safe road . A good point is made when it is said that 18 foot

is actually safer . Councilwoman Valentino travels that road and it
does keep some drivers who would go faster going slower . That is
what needs to be looked at .
Supervisor Raffensperger felt there was some confusion as to the
actual pavement width on Judd Falls Road .
Mr . Walker noted that the paved service varies from approximately
eighteen and one half , to about nineteen and one half , to twenty
feet depending where one is because settling gutters resulted in
paving almost to the curb . The face to face distance between the
two curbs which was originally designed as part of the road surface
being continuous is twenty one feet . The proposal is twenty feet
face to face of the curb .
Councilman Liguori said that Forest Home is requesting less than
that .
Councilwoman Valentino said she felt the actual surface the people
drive on is closer to 18 feet because there is a swale for
drainage . People do not ordinarily drive there .
Mr . Walker said the difference is people will notice a visual
barrier such as a curb . People drive very close to the edge of the
pavement now because they look to the side and see the curb and
drive very close to it . The impact of putting vertical curbs six
inches high on a twenty foot wide road will keep the effect the
same because there is a visual barrier of concrete which they drive
further away from . There is now a concrete curb and gutter section
that has dropped considerably causing the drainage problems .
There is more maintenance because of that section , when the crew
sweeps the road to take off the road salt there is a hard form of
sand and grit after winter that has to be chipped out ahead of the
sweeper because of the drop between the edge of the pavement .
Mr . Noteboom said that this problem covers most of the gutter line
of Judd Falls in the lower section .
Councilman Klein asked if that gutter section can be reset , granite
curbing is expensive ?
Mr . Walker said the gutter could not be reset , if it were moved it
would be in pieces .
Councilman Klein asked if that kind of system could be replicated ?

Mr . Walker said that the cost of using that kind of concrete would
be the same as the granite curbing , maybe 200 less . That
possibility has been investigated in conjunction with the curbing
job on Mitchell Street last year . The cost was not much different .
Councilman Liguori asked if it would be appropriate for the Town
Engineer to examine what Forest Home is asking for and report back
to the Board as to what it would do in terms of increasing or
decreasing safety ?
Councilman Niklas said that if that were a motion he would second
it , it is obvious that compromise is trying to be reached and there
is one recommendation from the Engineer and several others from
Forest Home . It would be nice to be able to consider the comments
by Forest Home , and therefore he would hesitate to vote on the
matter this evening .
Mr . Walker stated that if the Town Board makes no decision tonight
the project would not happen this year . The window of opportunity
to save over 10 % of the cost by working with Cornell University
will be lost .
Councilman Niklas said he understands the debate is over a change
of 5 . 5 % in the grade . Currently it is 13 % and the Town Engineer
has recommended 7 . 9 % . Is there room for compromise ? The Forest
Home people this evening have said there is no room for compromise ,
that they were already beyond their tolerance .
The argument that is heard from the Forest Home Association is that
the road is a difficult road to drive which keeps people awake , and
consequently if it were improved it would be more manageable to
drive which would increase the possibility of accidents . What data
is there to support that speculation ?
Mr . Brittai. n said that the State has data that indicates that
accident rates go up when a road is improved .
Councilman Niklas said that then the argument is to never improve
a road .
Mr . Noteboom said that one of things that the Forest Home
Improvement Association would like is that the road be closed , and
if the drainage problems are not addressed in that area it will in
time effectively be closed . The slippage of the bank is due to the
drainage problems , if the Town doesn ' t control the drainage
problems there will be more slippage of that bank .

Councilman Niklas said that his point was that the compromise that
has to be dealt with is what benefits the neighborhood versus what
benefits the Town in general .
Supervisor Raffensperger felt it was true that the Town Board has
to consider , and Forest Home has considered , the responsibility to
the Forest Home community because it is valued ; and the
responsibility to the community at large that uses the road whether
Forest Home likes its use or not because there is presently not any
alternative . Both Forest Home and the Town Board have tried to
balance those two interests . All the people who use that road are
not in attendance this evening , most of Forest Home is , the Board
has a responsibility to look at the various interests .
Every time the staff discussed this with the Forest Home
representatives a report was asked for , at the end of the process
about a week ago it was the Supervisor ' s impression that while the
Forest Home community was not going to be delighted with any work
done there , that there was a consensus , not unanimously , that most
of it was acceptable .
Mr . Brittain interjected that the Forest Home representatives were
misled .
Mr . Walker asked Mr . Brittain how they were misled ?
Supervisor Raffensperger recently spoke to one representative from
Forest Home who had been at the meetings who was unable to attend
this evening . He gave her a much more optimistic viewpoint of what
was discussed , even those who disagree with what the Town is
proposing will say that the Town has made an honest effort to meet
many of the concerns that the Forest Home people have . Now an
evaluation of how far the Town can go and still utilize taxpayers
money in a positive way , one that isn ' t just a cosmetic covering
over of the drainage and other problems .
Councilman Liguori asked Mr . Noteboom is something can be done
without rebuilding the road ?
Mr . Noteboom , noted that the Forest Home people are saying yes , but
there are failures in certain portions where the curbing is
dropping down and it will not drain well and cleaning it will not
be the solution because the grade is no longer there to support the
draining . That is the idea behind grading the whole road , to get
the drainage that is needed .
Councilman Niklas asked the amount of money that would be lost if
the decision is postponed until the July meeting ?

Mr . Walker responded that the Town would lose anywhere from 5 % to
100 of the proposed cost because a larger part of the paving and
grinding work . The total budget estimate of the project now is
$ 110 , 0006 There was $ 100 , 000 in the budget , the additional
drainage of heavy stone fill to alleviate pressure on the slope
adds the $ 1. 0 , 000 . The loss would be between $ 5000 and $ 10 , 000 .
Councilman Klein asked if the project would be completed by the
Town Highway Department ?
Mr . Walker said that the Town forces would do the regrading work ,
the Town would contract with an asphalt company to grind the road
surface , the County ' s paver would be used under a shared services
program . The granite curb will be contracted with the Town doing
the excavation work .
The Supervisor asked for individuals to speak who had not had a
chance to comment .
Carl Sundel. l , 310 Forest Home Drive said that he understood the
main concern of the Town was liability and danger . The Town should
concern itself more with the liability and danger of the walkway on
the Forest Home Bridge .
The Supervisor said the Town has allocated funds for the repair of
the pedestrian bridge and is waiting for the schedule from Tompkins
County as to when it will be accomplished . The money has been
allocated since last November . Because of the flooding this spring
the County has continued to postpone the work on the bridge , they
hope to start work by the end of June . The Town has heard varying
dates for the County to work on it . It is a County project and the
Town is participating by contributing funds because the Town wants
it done .
Connie Hascup , 115 MacIntrye Place said that she was very glad to
have attended this evening because she understands the dangers and
difficulties of the erosion and drainage , but there was one
statement that shocked her . The Town has a responsibility to the
community of Forest Home also to the Town at large , but the
responsibility to the Town at large is basicly to the automobile
versus the pedestrian . How much of peoples lives has to be
compromised for the sake of the automobile , the traffic ?
Councilman Whitcomb reminded the Board of their commitments to the
members of the Forest Home community . A year ago when a design
plan could not be agreed upon , the Board decided to postpone it
until an agreement could be reached . In March 1993 there was a
resolution that came before the Board asking for approval of

funding for this project . The question was asked at that time
whether there had been an agreement with the Forest Home community
as to the design standards of the project . The answer was no , they
were working on it . Again in May the question of funding came up ,
and the question was asked again if an agreement had been reached
with Forest Home .
The minutes of the May meeting show that the Board made the
commitment that they would not proceed without the agreement of the
Forest Home community .
Supervisor Raffensperger felt that the Board at previous meetings
assured the Forest Home community that the Board would do
everything they could to work with Forest Home to come to an
agreement .
The Supervisor stated she has told the Forest Home representatives
and will say it publicly now , that the Town Board does not have the
right to give to any group a veto over the decisions of the Town
Board . The Supervisor hoped that the Town Board would not do that .
The Forest Home community knows that she and many members of the
Board have made every effort to work cooperatively with the Forest
Home community in all kinds of projects .
Councilman Klein said that the drawings presented look rather
advanced , the Board does not have much of an option to discuss the
design . The Board is seeing that the Town is ready to complete
reconstruction . The plans are reflective of the Engineering
Departments work . The issue has been discussed within the paving
program for the year and the design has been raised several times
since . The Board has not seen any final design results until this
meeting . Councilman Klein recognized from Mr . Walker ' s discussion
that the Engineering and Highway Departments have moved from a more
major project to a lesser project .
There have been discussions of redoing the granite curb and redoing
the pavement , and replacing the concrete gutter . Even if it is as
costly as granite it would be a softer design solution . Those
options and dollar amounts have not been presented . The Board is
in a difficult situation , there is the community to deal with the
effect . Councilman Klein was not pleased that the Board has not
seen the options , even though the options presented tonight are
showing sensitivity to the community .
Supervisor Raffensperger said that the Board did review the plans
last fall .
Councilman Niklas made the point that he did not see the compromise
other than the Town Engineer backing off from the original designs .

Councilman Niklas asked the Forest Home representatives where they
were willing to compromise . The argument on one issue is the 5 . 10
grade , is there room for compromise on that issue ? If most of the
argument by Forest Home as heard is " status quo " , if the Forest
Home community cannot tolerate any deviation other than what they
wish , where: is the compromise from Forest Home / .
John Coggin , 132 Judd Falls Road said that the Forest Home
Communities. compromise is that six years ago they were looking at
a one way road with a 14 foot bed , and an enlarged sidewalk that
would be safe for pedestrians , bicyclers , and joggers who use the
area in profusion . There would have been smooth traffic flow . If
you remove any impediment as nature intends them to traffic you
will have more traffic in a short period of time . You are not
solving any problems just prolonging it . It is not saying " status
quo " or not , most of the residents would go with the " status quo "
with a one lane bridge and a walkway across the bridge . The
" status quo " is compromise .
Councilman Liguori stated that is not compromise , compromise is
moving towards each other . This is the Town and Forest Home moving
in a new direction , this is a waste of energy .
Councilman Liguori doubted whether there could be found a
resolution to this problem within this year .
Motion made: by Councilman Liguori that the Town do a normal
repaving of Judd Falls Road and continue to see if there is some
opportunity for improvements of the drainage and safety problems .
No second to the motion .
Councilman Whitcomb said he has seen many times at Cornell where
they will go through and repave a street and six months later they
are digging it up and putting in drainage . That would be throwing
money away . The project should be delayed until there is a design
resolution .
Councilman Liguori asked Councilman Whitcomb if he felt a
compromise would be reached this evening ?
Councilman Whitcomb did not see how it could be done tonight , this
problem is not new , a year ago an agreement could not be reached .
Supervisor :Raffensperger pointed out that it was just postponed .
Councilman Whitcomb said that it was postponed until a couple of
months ago and then it was hurried to get a design . Councilman
Whitcomb said he did not have a great deal of sympathy for people

who say , " if we can ' t do it tonight we are not going to do it at
all " . It has been worked on a year , and it is unfortunate that the
time has not been used productively .
Supervisor Raffensperger stated the time has been used
productively .
Councilman Whitcomb said he did not see where we are any closer to
an agreement than last year .
Mr . Walker said that he does not understand who the " we " is , the
Town has gone one way and Forest Home the other way . Forest Home
keeps walking away from the issue . Mr . Walker stated that if the
Town Board wants to postpone the reconstruction he as an Engineer
could not recommend repaving over the surface that is there . At
the very least the center profile has to be removed because it is
too high . Repaving to the existing curb line that is there now and
getting the drainage to work results in a flush roadway with the
yards and most areas and no curb visible because of the condition
of the curb . If the Board wishes the Town Highway Department to do
that , Mr . Walker will not guarantee the work and will not stand
behind the work .
Councilman Niklas said that the Board has an earlier motion by
Councilman Liguori which is now in the context of the loss of
between $ 5000 and $ 10 , 000 by delaying the reconstruction .
Councilman Niklas said that the illusive compromise should be
sought . He did not mean by compromise that the Town continues to
lower the recommendations but that there are obvious differences of
opinion . There must be come middle ground . The only other
alternative is vote to approve this .
Supervisor Raffensperger stated she would move a resolution that
would probably not be liked by the Board .
Motion made by the Supervisor that the Town Board approve the
reconstruction proposal for Judd Falls Road as recommended by the
Town Engineer and the Acting Town Highway Superintendent with the
exception that the Board ask them to reevaluate the use of the type
of curbing that has been described in the project .
Councilwoman Leary asked if the curbing referred to means softening
the curbing ?
Supervisor Raffensperger said yes . Her concern about the curbing
is the sharpness , safety for bicycles and cars , and the appearance
on a narrow road .

Councilwoman Valentino asked if the surface would be flat to that
type of curbing .
The Supervisor responded that it would mean it would not be squared
off in such an evident way , it would be a more softened look for
that type of neighborhood .
Mr . Walker asked if the Board wished him to change the design ,
replace in kind the material that is proposed . Specifically the 18
inch curb and gutter section and the 18 foot of asphalt pavement as
it stands now for a total width of 21 feet ?
Supervisor Raffensperger made another motion that the Town will
proceed with the basic design as presented as a compromise by the
Highway and. Engineering departments with the exception that they
redesign the curb section of the road in order to meet the concerns
for safety ;and appearance by Forest Home community for the curbing .
Seconded by Councilwoman Valentino .
Councilman Klein asked what the time frame for construction will
be , how long would it take ?
Mr . Walker explained that it would fit in with what Cornell
University is doing with their paving . There is a proposed four
weeks of road closing due to their schedule . Grinding will take a
day , the excavation and drainage work will take approximately one
week . The drainage can be completed along with the excavation of
the slope and replacement of the base .
Councilman Klein pointed out that asphalt plants are open until
October or November , the window of opportunity is there .
Mr . Walker stated that there are school buses that traverse that
area . It has to be done while the public schools are closed
because the buses cannot travel the upper bridge because of the
weight limit .
An individual from the audience interjected that the buses use the
bridge now . Mr . Walker said they are not supposed to be using it .
Councilman Whitcomb asked what impact the resolution proposed by
the Supervisor made on the slope ?
Mr . Walker responded that the road profile would stay the same , the
curb would be modified from a vertical concrete curb to a curb and

gutter section basicly identical to what is there now . Mr . Walker
said he would rather it be a vertical concrete curb , but the curb
and gutter section could be used .
Councilman Whitcomb asked if the resolution plan made by the
Supervisor would require modification of the slope ?
Mr . Walker said the profile would be the same as the proposed
design , 7 . 9 % . The width would be 21 feet overall instead of 20
feet which is the existing width . The visual appearance would be
a foot and one half of concrete on either side .
The Supervisor stated that the Board must somehow draw this item on
the agenda to a close .
Councilman Whitcomb said that he was sorry , but that he was
reluctant to rush into a compromise solution that he did not fully
understand , and that he would vote against the Supervisors motion ,
but would vote for Councilman Liguori ' s motion of postponing the
discussion until July in the hopes that a compromise solution can
be reached and studied .
The Supervisor pointed out that was not Councilman Liguori ' s
motion , however it could be a motion if that were Councilman
Whitcomb ' s pleasure .
Vote called on the motion made by the Supervisor . Councilman
Klein , nay ; Councilwoman Leary , nay ; Councilman Liguori , aye ;
Councilman Niklas , nay ; Councilwoman Valentino , nay ; Councilman
Whitcomb , nay ; Supervisor Raffensperger , aye . Motion defeated .
The Supervisor called for any other resolutions .
Motion made by Councilman Whitcomb to postpone the consideration of
the reconstruction of Judd Falls Road until the July meeting of the
Town Board , in the interim every effort should be made by the Town
Staff to reach an acceptable compromise with the Forest Home
Improvement Association for the design of reconstruction . Seconded
by Councilman Liguori .
Councilman Niklas asked that the motion be amended to include that
at the July meeting whatever proposal is reached as a compromise as
it is represented by Town Staff shall be voted on . Seconded by
Councilwoman Valentino .
Councilman Niklas remarked that this is doing a general disservice
to the Town . Taxpayers stand to lose $ 5 , 000 to $ 10 , 000 because of
this delay if this motion is passed .

Mr . Walker commented that if a redesign process is to be done , he
would like to have one to two Board members at the meetings that
are held with the Forest Home Improvement Association . Mr . Walker
asked that Councilman Whitcomb and Councilman Liguori be the Board
representatives .
Councilman Whitcomb and Councilman Liguori agreed and volunteered
to be at the meetings .
Bill Goldsmith , 117 Judd Falls Road said that he has spent many
hours cooperating with the Town Board and he felt that on behalf of
everyone in. Forest Home he could thank the Board . The compromise
is between the needs of through traffic and residents . We do not
need to compromise , we need to cooperate . There is not a lot of
difficulty doing that if all parties sit down and look at the
plans .
The Supervisor asked for a vote on the motion . All in favor of the
motion and amendment with the exception of Supervisor Raffensperger
who voted nay .
Agenda Item: No 11 - Public Hearing Modification of Allowed Uses
in Special Land Use District No . 4 , 1252 Trumansburg Road
Postponed Public Hearing reopened at 8 : 37 p . m .
The Supervisor explained the Board had a letter from Mr . Ciaschi
regarding the rezoning , ( see attached ) .
There are two resolutions of the Planning Board , making or not
making recommendations on elements of the proposal by Mr . Ciaschi .
Town Planner , Floyd Forman described this as a change to Special
Land Use District No . 4 . This district encompasses the Mayer
School and Broome Developmental Center . The request is for
additional apartments at the Mayer School and allowing off site and
on site catering services . There is a SEQR as well as a proposed
Local Law . The SEQR is recommended for approval as having a
negative determination of environmental significance . The proposed
Local Law shows limits to the hours that the catering service would
be allowed and the number of days the catering service and function
room would be allowed .

Councilman Niklas asked for a summation of the principle argument
that resulted in three members of the Planning Board voting against
the catering .
Attorney Barney stated it was inconsistent use with residential
zoning .
The Supervisor asked for anyone wishing to speak during the Public
Hearing .
Mr . Ciaschi asked to be heard and presented pictures showing the
building and property . The kitchen is perfect for a catering
service . The grounds were shown for outdoor catering
possibilities .
The Supervisor said that the Board actually has a number of
alternatives to consider . The first item to consider is whether to
permit additional multi family dwellings in the facility . That is
a use the Planning Board has recommended unanimously . The second
question has to do with the catering . The possibilities are off
premises catering and for on premises functions with catering .
Mr . Ciaschi said that he felt it would be a shame to not to at
least have catering , but that it would be even better to have
catering with functions .
Councilman Whitcomb asked how far away the nearest residence was ?
Mr . Ciaschi said that William Lower has a building approximately
200 feet away .
The Supervisor asked if any other member of the public wished to be
heard . The Supervisor left the Public Hearing open so that Mr .
Ciaschi could continue to interject during Board ' s discussion .
Mr . Ciaschi said that he has spoken to Mr . Lower and that he is not
opposed to the proposed rezoning .
Councilman Liguori asked if any hours and times of the week for the
catering operation had been decided ?
Mr . Ciaschi responded that it would be on Saturdays and Sundays
from early spring to late fall . It would be held 20 to 30 days per
year . The times would be 3 : 00 p . m . to 11 : 00 p . m . Most wedding
receptions last approximately four to five hours .

Councilman Whitcomb said that he was not as concerned about the
future residents of the building itself as he is about the
neighboring residents . The people who would rent from Mr . Ciaschi
would be aware of the catering functions . If there is no existing
neighbor near who objects , that is an argument in favor of Mr .
Ciaschi . It is unsure what controls would be in place to control
noise levels .
Supervisor Raffensperger asked to explore with the Board their
attitudes on the various options that have been suggested .
Councilman Niklas said that this was a school and it had catering
abilities .
Attorney Barney mentioned that schools are consistent with other
residential areas . They are allowed in any other R - 15 zone , but
schools do not usually have rock bands for wedding receptions .
Councilman Niklas said that is why he is not opposed to catering
off premises .
The Supervisor asked if most of the Board members consider the
extension of the multiple family use to be acceptable ?
Attorney Barney said that there would be no limit to the number of
dwelling units other than the building code limits .
Councilman Klein asked how many apartments would be there .
Mr . Ciaschi_ responded that the maximum would be four . He had
applied for seven in case the offices on the second floor do not
rent .
Councilwoman Valentino said that she may have a possible conflict
in voting on this issue as Mr . Ciaschi rents property to an
organization that she is involved with , she will abstain from any
voting .
The Board came to a consensus that the multiple dwelling aspects of
the proposed changed was not a problem including the potential for
seven units .
Supervisor Raffensperger asked the consensus of the Board
concerning off premises catering . The food would be prepared there
but taken off premises for serving .
Councilman Klein asked if there would be any time restrictions
imposed on that option ?

Attorney Barney responded that in the proposed Local Law it shows
no activity between 10 : 00 p . m . and 7 : 00 p . m . Sunday through
Thursdays , unless the night before a holiday ; and no activity
between midnight and 9 : 00 a . m .
Councilman Niklas thought those times were consistent with the
noise ordinance .
Mr . Ciaschi said that for off premises catering there cannot be any
restrictions . The caterers come and go , it takes all day to
prepare .
The Attorney explained that the restrictions are for late at night .
The objective is to guarantee an eight hour time frame at night
when people will not be disturbed .
Councilman Klein noted that trucks will not be able to come back to
the facility after a late night off site job .
Councilman Niklas mentioned that would mean not unloading trucks
late at night so that the noise level would not disturb people .
The Supervisor summarized that in general the Board felt that off
premises catering with some restrictions as to the times the
activities take place is appropriate .
The on premise catering is the last consideration . How does the
Board feel about on premises catering ?
Supervisor Raffensperger said that she has some concerns about this
because of the residential nature of the surrounding land even
though it is not presently developed . The Town does have
development proposals for those lands adjoining the facility for R -
15 residential . One of the things the Board is required to
investigate is the compatibility of uses .
Councilman Niklas said the Board has an obligation that the proper
ambiance and the environment for development of the neighboring
properties is adhered to .
Supervisor Raffensperger said that on site catering was the area
the Planning Board failed to make a positive recommendation on , it
failed on a tie vote .
Councilwoman Leary said that the on site catering did not bother
her as it is far enough away with the set back on the land from
those residential areas .

Councilman Liguori asked how far away the property was from
potential future single family residences ?
Mr . Forman said the potential developments are Cayuga Cliffs
adjacent to the property , approximately 150 feet .
Councilman Niklas said that was pretty close with the potential for
development .
Councilman Klein said that the noise level would be lower as that
development. would be behind the property .
Councilman Whitcomb asked if the area behind Mr . Ciaschi ' s property
would be a cluster development ?
Mr . Forman said that any development would take place in that area
as it is the least steep portion .
Councilman .Niklas asked if the owners of those properties that have
not yet been developed been notified of the requested zoning
change ?
Mr . Forman said that the adjacent property owners were notified
about the change , he has received no word from them .
Supervisor Raffensperger said that some of those properties are in
the process of being sold .
Councilman Klein said that the noise will be somewhat limited to
the summertime .
Councilman Whitcomb pointed out that is when most people are out in
their yards .
Councilman :Klein said that the restrictions built in are adequate .
The facility is there , it is a sound structure and this proposal is
an incentive to get it improved and extend its use . Councilman
Klein said that he is more concerned with site development , how
much parking would be available for catering of 100 people .
Mr . Forman said that is a concern that will be dealt with in site
plan review to make sure there is adequate parking .
The Supervisor said the County raised the question of the
aesthetics where parking is concerned . And estimate is that under
the present requirements 90 to 95 parking spaces are necessary for
the proposed banquet facilities proposed . There are presently only
28 parking places . This will be a substantial impact on the site
to provide parking for on site catering .

Mr . Ciaschi said that until he knows what the Board will approve
there is no sense to making lawn area into a parking lot .
Mr . Forman said that site plan development would work on staying
away from using the front for parking and putting it more to the
back or sides .
Mr . Walker said that one other site plan consideration is that
Cayuga Cliffs owns the right of way to the potential town road
through the property .
Councilman Niklas mentioned that all of these things are to be
considered in the site plan proposal . The parking restrictions
that may be imposed would come from the site plan approval process
and the size of parties that could be catered on site would be
mostly based on the parking spaces .
Supervisor Raffensperger said the Planning Board obviously had
concerns about the on site catering , it is not known if that was
related to the parking requirements and what it would do to the
site .
The Supervisor asked that the Board consider approving those
elements for the off site catering and the multiple residence up to
seven , and when the Planning Board looks at this if they wish to
make a recommendation to consider a rezoning they could do that .
The Supervisor has concerns over the Planning Board ' s lack of
approval for the on site catering .
Attorney Barney said that would reflect a significant change in the
Local Law he drafted so that another public hearing would be
necessary .
Councilman Niklas said that he likes the suggestion of the
Supervisor as it would not close off the possibility of off site
catering , but would for the present limit the on site catering .
Then the Planning Board could make a recommendation for on site .
This is not closing the door , it is just not opening it presently .
Councilwoman Leary recommended that the Town Board give more
guidance to the Planning Board as to their ideas and
recommendations .
The Supervisor said that the Board doesn ' t need to because it is
only the Town Board that can rezone .

The Supervisor said that is correct , the Town Board has made too
many changers in the Local Law to approve it tonight without another
public hearing .
Mr . Frost gold Mr . Ciaschi that he has some current approved uses
that can be dealt with to the extent of going to more than two
apartments .
Mr . Ciaschi said that he has approval for two apartments and can do
them . Everything is in order to do the four apartments on the
third floor . It is being subcontracted and they will not start
just to do it piece meal . It will cost more for them to have to
come back . Is there anyway that the apartments could be approved ?
Councilman Niklas said the alternative is to vote for the proposal
as is with no change .
Mr . Frost asked for direction as to if there were a change use in
the overall. building code review for whatever was allowed . There
is more than a weeks worth of time for code review .
Mr . Attorney sensed there would be no problem in getting the number
of apartments wanted . It still has to go before the Planning Board
for site plan . Do the site plan review , and by the time that is
completed -the Town Board will have a chance to act and will
encourage the Planning Board to act with the assumption that the
apartments are allowed .
All Town Board members voted aye on the motion with the exception
of Councilwoman Valentino who abstained . Motion carried .
Attorney Barney asked that the Public Hearing would be held with
the changes discussed , but leaving the limitations which are in the
Local Law with the exception of reducing the 50 events per year to
30 and the 20 to 10 ?
The Supervisor said that was correct .
Mr . Forman said that 150 parking spaces were a lot . A function of
150 people would need a great deal of parking .
Mr . Ciaschi said the room for functions would probably not hold 150
people . Most wedding functions range in the 100 to 150 range .
Attorney Barney said that was an absolute numerical limit . If the
building code or fire code requires a smaller number it would have
to be adhered to .

Mr . Frost said the building code would require 15 square feet per
person in the assembly area . There would be problems if it exceeds
300 occupants .
Mr . Ciaschi said that the two rooms that would be used are
approximately 1800 square feet for each room .
Councilman Niklas said the parking cannot exceed the legal capacity
of occupancy of the assembly rooms . So why don ' t we give the Town
Attorney instructions that the parking cannot exceed the legal
capacity limit of the rooms for fire code .
Mr . Frost said that presuming there were two rooms used there is
the capacity to meet the footage requirement per person for 240
parking spaces .
The Supervisor suggested that the 150 be left as it is . The Town
Attorney has received enough guidance to compile the local law for
the Public Hearing .

Agenda Item No . 22 - Set Public Hearing Rezoning Elmira Road / Seven
Mile Drive
The Supervisor explained that the Town Board has discussed
postponing this public hearing because other proposals have been
advanced for the use of the property . The description of the
rezoning has not been completed so it is to early to set the public
hearing . This issue will be postponed until next month .
Councilman Klein asked if the alternatives were from the developer .
Supervisor Raffensperger responded yes , that it included more
residential zoning that may have to go back to the Planning Board
for their recommendation . The Conservation Board will also be
reviewing this issue .
Agenda Item No . 23 - Ellis Hollow Senior Citizens Apartments Pilot
Agreement
The Supervisor explained action may be taken on this item after the
Executive Session .
Agenda Item No . 29 - Water and Sewer Billing Refund
Motion made by Councilman Niklas authorizing a refund in the amount
of $ 27 . 40 to the owners of the property located at 104 Ridgecrest
Road for a water and sewer billing because of change in ownership .

Councilman Niklas said that the Board would be giving the Planning
Board guidance if the Board says that right now they do not approve
of on site catering , but if the Planning Board looks at the site
plan and approves then it is alright .
Attorney Barney said that has problems because the Planning Board
is constrained at looking at the site plan based on what the Town
Board is authorizing .
Councilwoman Leary asked that if the Town Board approves the on
site catering can the Planning Board say they do not want it ?
Attorney Barney said they can refuse to approve the site plan .
There is a provision in the Local Law which governs special
interest groups which prohibits any special uses until the Planning
Board is satisfied .
Councilwoman Leary said that if we gave the Planning Board the
leeway they can figure out the details , at least the Town Board is
making a statement that it is alright .
The Supervisor pointed out that the Town Board will have rezoned it
for that purpose . It is not known if the Planning Board considered
the impacts of off site and on site catering . We could ask them
for an additional recommendation on that .
Attorney Barney said that he asked the Planning Board if they would
accept off site rather than on site , and it did not change their
opinion in any way .
Councilman Niklas asked if the Town Board approves on site catering
does the Planning Board still have the option of refusing the site
plan ?
Councilman Klein said that would have to be done within reason .
Attorney Barney said the Town Board approving the rezoning says it
is a permitted use , Mr . Ciaschi would have to complete a reasonable
plan . The Planning Board cannot arbitrarily say no .
Motion made by Supervisor Raffensperger that the Town Board
approves the up to seven additional dwelling units and the off site
catering for the rezoning of the property located at 1251
Trumansburg Road . Seconded by Councilman Niklas .
Councilwoman Leary asked if adoption of the resolution shows that
the Town Board does not approve on site catering ?

property located at 1251 Trumansburg Road to allow for up to seven
multiple dwelling units , off premises catering , and on premises
catering no more than thirty functions a year of which no more than
five to ten would be on nights other than weekends , and limitations
of times nd hours as presented in the Local Law proposed by the
Town Attorney . Seconded by Councilwoman Leary .
The Supervisor announced the Public Hearing was still open and
asked if any member of the public wished to speak . No one came
forward to speak .
Mr . Ciaschi said that probably 700 of the parking area will not be
used during the week .
Supervisor Raffensperger said that the resolution should be
modified o include setting a Public Hearing for the July meeting
to include what the motion for approval encompasses .
Amendment made by the Supervisor to include the advertisement for
a Public Hearing to be held on July 12 , at 8 ; 00 p . m . to consider
the rezoning with the changes as discussed . Amendment approved and

Councilman Whitcomb said that he had looked over some of the Tort
Claims and Lawsuits listed on the disposition listing and that they
looked very interesting . One of them was mentioned not to long
ago , the Town may not wish to dispose of those . Councilman
Whitcomb asked if these were originals or duplicates ?
Mrs . Noteboom explained that they are the originals and unless the
Town Attorney has copies these would be irretrievable .
Supervisor Raffensperger suggested authorizing the disposition of
all those records other than the tort claims until it can be
reviewed what kinds of records are available to be retained .
The Town Clerk stated these documents are in a book labeled by the
previous Town Clerk as Tort Claims . The cases have been settled
and according to the MU - 1 Schedule they are ready for disposition .
When the disposition list is presented to the Town Board it does
not mean that the records have to be disposed of , the purpose of
the listing is so the Board can pick any items they wish to have
kept for historical or other reasons . Those items would be
retrieved from the list and filed accordingly .
Councilman Niklas said that the Board could authorize disposal with
the proviso that if any Town Board member has a compelling reason
each case can be reconsidered .

Councilman Whitcomb stated the intent of the Wetlands Policy was
not to provide an ordinance for the Town , but to provide guidelines
for the Planning Board as they requested .
Supervisor Raffensperger has recommended that the Town Board adopt
the Town of Ithaca Wetlands guidelines .
Motion made by Councilman Whitcomb that the Town Board upon
recommendation of the Planning Board adopt the Town of Ithaca
Wetlands Policy . Seconded by Councilman Niklas .
Councilman Niklas said his understanding is that if this is
approved at some point in time the Town Board will investigate an
ordinance for wetlands .

The Supervisor said that the Conservation Board recommended that be
done .
Attorney Barney said that the Planning Board discussed there is a
need of allocation of some resources to have staff alert and
knowledgeable in wetlands regulations .
Councilman Liguori felt it is a very good document but disagreed
with the word " least " on Page 11 , paragraph 2 where it says , " the
applicant , staff and Town officials should strive to agree on a
plan that is the least environmentally damaging " .
Councilman Niklas suggested that the word be changed to " minimize " .
Councilman Liguori said that he would agreed to " minimize " . The
word minimize means there could be alternatives . There is no
alternative: to the word least . The least always say that you do
nothing .
Amendment to the motion made by Councilman Liguori to change the
sentence on Page 11 , Paragraph 2 to say , " the applicant , Town
staff , and Town officials should strive to agree on a plan that
minimizes environmental damage ' Amendment approved by Councilman
Whitcomb and Councilman Niklas .
Motion with amendment carried unanimously .

WHEREAS , the Town Engineer and the Acting Town Highway
Superintendent have presented a design proposal for the
reconstruction project for Judd Falls Road ; and
WHEREAS . the Town Board , Town Engineer , Acting Highway
Superintendent , the Forest Home Improvement Association , and
members of the Forest Home community have reviewed and discussed
said design. proposal and have been unable to reach an acceptable
compromise for said reconstruction design ; now therefore be it

consideration of the reconstruction of Judd Falls Road until the
July 1993 meeting of the Town Boards and be it further
RESOLVED , that in the interim every effort shall be made by

Site restoration has been completed by the County Highway
Department .
Drainage
Numerous requests about localized drainage problems have
been received by the Town Engineering Department due to the
wet Spring . In most situations other than road ditches the
Town has little authority to actually perform any corrective
measures . The Town Engineer is reviewing information
previously prepared by former Town Staff regrading drainage
regulation in the Town . The Public Works Committee will
discuss this as an agenda item at a future committee meeting
and will probably be making a recommendation to the Town
Board . Current and future development plans are being
evaluated carefully for impacts on watersheds and drainage .
Judd Falls Road Reconstruction
The Judd Falls Road reconstruction plans have been completed
and are being presented to the Town Board for approval . The
Highway Department will be working with Cornell University to
coordinate repaving from Forest Home Road to Tower Road .
Cornell will be excavating to repair the underpass for the
Arboretum Road . The Engineering and Highway Departments have
had several meetings with the Forest Home Improvement
Association during the design process to address resident
concerns .

Park Lane
The Town Engineering staff has prepared the maps for the
consideration of the transfer of Town lands related to the
acquisition of Park Lane . A subdivision map for the Quick
property has been developed for the Park Lane portion of the
property .

TOWN OF ITHACA HIGHWAY SUPERINTENDENT ' S REPORT FOR MAY 1993
Town Board Meeting , June 7 , 1993
During the first two weeks of May , the Highway Department conducted
its annual brush and weed pick - up . Between the Highway and Parks
Department crews , 778 . 5 man hours were worked . The total cost of
the project was $ 9 , 235 . 87 .
The Highway crew also worked on water maintenance projects located
at the Trumansburg Water Tank and the Christopher Circle Water
Tank . The total number of man hours worked for these projects were
115 .
In May the Highway Department prepared for its summer paving road
work projects . Paving began on May 24 , 1993 . Fairway Lane ,
Lexington Drive: , and Christopher Circle were the roads paved during
May . Lexington Drive had a base and top coat applied . Fairway and
Christopher Circle will have the top coat applied in June ( the base
coat was applied in May ) . The total man hours worked on paving in
May is 573 . 5 and the total cost is $ 52 , 484 . 090
This month saw the return of our Department secretary , Gail Kroll ,
from maternity leave , and we welcome her back . The Highway
Department had a laborer resign , and we are in the process of
filling that position . We have hired a truck driver and two
laborers for the summer to assist us with the many . projects we have
planned .
Some of the projects slated to be worked on in June include :
1 . Work to begin on Schickel Road .
2 , Salem Drive drainage work .
3 . Road work on the hospital entrance .
4 . Forest Home Bridge Walkway to be worked on .
5 . The Highway Department , along with the Parks Department , will
be working on the South Hill Trail .
6 . Town - wide ditching .

16 The Park; Department contributed 200 man hours during spring
leaf and brush pick up the first two weeks in May .
2 . Park and trail mowing commenced May 10 , 1993 . Water tank and
pump station mowing was begun late in the month . Bostwick
Road Cemetery was mowed prior to Memorial Day . A total of 92
man hours was spent mowing in May ,
3 . Numerous lawn repairs and seeding jobs were completed ,
requiring 55 man hours . The majority of these were the result
of water breaks during this past winter .
4 . A variety of routine maintenance tasks , totaling 97 man hours ,
took up the balance of May for Parks .

The following is a synopsis of Planning Department activity for the period May 8, 1993
through June 4, 1993,
Planning Board
Development Review
The Planning Board held four meetings during this period : May 11 , 18, 25, and June 1 .
The May 11 and 2.5 meetings were principally devoted to the Comprehensive Plan,
The Planning Board Public Hearing Notices as well as the decisions rendered by the
Planning Board at the May 18 and June 1 meetings are attached.
Comprehensive Plan
At the May 11 and 25 meetings, the Planning Board continued its review of the
Comprehensive Plan . The Planning Board finished its initial review of Chapter 3 and is
proceeding with a review of Chapter 4. The Planning Board is deciding whether it wants
a Future Land Use Patterns Map as part of the Plan; and if it does, what form the map
should be in . The Planning Board is also considering the comments made at each of the
three meetings and the letters received, as they make changes to the Plan they deem
appropriate .
Cornell GEIS
The Planning Board at its June 1 , meeting voted unanimously, with conditions, that the
DGEIS was now complete with respect to its scope, content and adequacy for the purpose
of commencing public review.

Conservation Board (CB )
Planning staff is assisting the CB with its recommendation to the Town Board on a policy
concerning site development or subdivision in any area with potential wetlands. The
Planning Board has recommended that the Town Board approve the proposed Wetland
Guidelines with. some modifications .
Codes and Ordinances Committee (COC)
The COC did not meet since the last Town Board meeting. It is scheduled to meet next
on June 16 . The Committee has recently been discussing a proposal to allow the
Planning Board to waive up to 20 % of the required parking in Commercial or Light
Industrial Districts .
Planning Cgm mittee
The Planning Committee met on May 26, and discussed the Comprehensive Plan and the
Cornell GEIS.
Miscellaneous
Staff continues to prepare construction drawings and do clearing work on the South Hill
Trail .
Staff continues to work with the MPO Planning Committee to develop a budget, work
program, and transportation plan for the Policy Committee's approval.
Staff met with individuals requesting assistance with development projects .
The Planning Department is continuing to work with Mark Wysocki, who teaches
Meteorology at Cornell, on the proposed Veterinary Incinerator and smoke stack project.
Andy Frost, John Barney and I were among the participants in a round table discussion
with the Executive Director of the Legislative Committee on Rural Resources and staff
members from the Department of State to discuss Planning and Zoning issues that need
assistance at the State - level . The Committee was in Ithaca on June 21
Starr Hays is the new Planning Department Secretary. She is presently working part
- time until the end of this month, when Wilma Homback will be leaving. We wish
Wilma all the best: and thank her for all her help.
Antoine Bryant is in the department' s summer intern under the CMTAS program.
The Planner I search Committee will be interviewing candidates later this week to fill the
vacant position.

We at the TohFn of Ithaca Highway and Parks Departments would like
to take this opportunity to express our feelings and opinions on
the replacement of our Highway Superintendent .
We feel the Superintendent position could best be filled from
within the ranks of our departments . Our reasoning for this
opinion is that this person would be familiar with our policies ,
equipment , personnel_ , roads , and general day - to - day operations .
This person would have an acquired knowledge of all aspects related
to the position .
We at the Highway and Parks Departments feel that we have such a
person . For the past year , Deputy Superintendent Fred Noteboom has
demonstrated his ability to lead motivate , and supervise . We have
found him to be a leader who deals with daily problems both within
the departments and with the public on a fair and non - bias basis .
His degree of professionalism , knowledge , respect , and courtesy are
a level we at the Highway and Parks Departments would like to
reflect in our daily work relationships with the public . Because
he has demonstrated a high degree of work ethics and motivational
skills , he has earned the respect of his co - workers and peers .
Therefore , we! are respectfully conveying our support of Deputy
Superintendent Noteboom as an applicant for the position of Highway
Superintendent .
In summary , we feel at the Highway and Parks Departments that
Deputy Superintendent Fred Noteboom portrays and reflects the image
we would like to set forth . This is not to be misunderstood that
we would not be in full support of anyone chosen as our Highway
Superintendent .

enter into an Annual Fuel Contract for gasoline and fuel to be used
in the town motor vehicles , now therefore be it

directed to advertise for sealed bids for unleaded plus gasoline
and diesel fuel as outlined in the bid forms and specifications as
per the attached prepared by the Acting Highway Superintendent , and
be it further

Ithaca at the: Town Offices , 126 East Seneca Street , Ithaca , New
York , no later than 10 : 30 o ' clock a . m . , on July 6 , 19930
Such bids shall be on forms supplied by the Town of Ithaca . The
specifications for the bid may be examined and obtained at the
Office of the Town Clerk at the Town Offices as above .
Bids are to be mailed or given to the Town Clerk in an envelope
plainly marked " Sealed Bids for Gasoline and Diesel Fuel " at 126
East Seneca Street , Ithaca , New York 14850 . Bids will be opened

REQUIREMENTS FOR UNLEADED PLUS GASOLINE AND DIESEL FUEL
TOWN OF ITHACA
The following are the requirements for unleaded plus gasoline and
diesel fuel . Bidder must indicate whether each requirement is met .
All specifications not met must be explained in detail . The Town
Board of the Town of Ithaca reserves the right to reject any or all
bids , particularly if specifications are not met completely .
Bidders shall use the Bid Form included and shall bid on all items .
A separate Bid Form and requirements sheet must be completed for
each bid package . If additional services / products will be offered ,
detailed specifications and prices must be submitted for these
additional items .
Awards will be made to the lowest responsible bidder . The
conformity with specifications , product reputation and reliability
and vendor location shall be taken into consideration .
GENERAL REQUIREMENTS : YES NO
Vendor pumps are located within a 5 - mile radius
of the Town of Ithaca Highway Department located
at 106 Seven Mile Drive , Ithaca , New York .
Access to vendor pumps is available 24 hours a
day , 365 days a year for all Town vehicles .
Vendor pump :Location can accommodate vehicles as
large as tandem axle dump trucks with snow plow
equipment attached .
Vendor will provide a 250 - 350 gallon skid tank
with pump for diesel fuel to be installed at
Town of Ithaca Highway Department and to be
refilled as necessary
Vendor will supply diesel fuel both at the
vendor site and in a vendor - supplied skid tank
at the Town of Ithaca Highway Department
Vendor will supply a separate key / card for each
Town of Ithaca vehicle to provide easy tracking
of fuel usage .

Vendor will supply an estimated 9000 gallons of
seasonally blended diesel fuel at the vendor site .
Vendor will ;supply an estimated 1000 gallons of
seasonally blended diesel fuel to vendor - supplied
skid tank at Town of Ithaca Highway Department .
Vendor will ,supply an estimated 8000 gallons on
unleaded plus gasoline ( minimum 89 octane ) at
the vendor site .

PETITION TO TOWN BOARD OF ITHACA

Fellow Citizens Of The Town Of Ithaca
We come before you tonight to present a petition , to
enlighten you ., a serious water problem in the western
portion of the town , and to appeal for your timely action
and resolution of this situation .
We are not insinuating that this is a new problem , but it
appears to be rapidly degrading .
As we discussed this matter among ourselves , thinking that
perhaps our problems were of an individual nature , it was
discovered that it was widespread throughout the
neighborhood . As we further communicated with families
outside our immediate neighborhood , it became apparent that
this problem affects most of the families in the western
section of the town .
Two years ago in the area known as Drew Park , another house
was built and the well proved to be unsatisfactory . In an
effort to correct this , the well was subjected to a procedure
known as " Fracking . " This procedure resulted in the immediate
and severe degradation of at least ( 4 ) four wells and perhaps
more . The water became permanently black with a high

concentration of solid matter , known as glacial dust . This
glacial dust is so persistent that it actually plugged inside
house plumbing to the extent that there was no water flow and
plumbing had to be replaced . Even though expensive and costly
filtration and chemical treatment systems have been installed
the water remains black and non - palatable .
All drinking water is now carried to these homes .
One resident , retired , on a fixed income , lost her water
supply completely and found it necessary to drill a new
well . Two new " wells were required in order to obtain
an adequate supply of water . In the meantime she found it
necessary to visit local state parks to shower .
Outside the Drew Park area the situation is no less severe .
Our conversations showed that many families have an
inadequate supply , or is too odiforous to be used for
drinking and water again has to be obtained from other
sources .
We have a major commercial business in our area that is also
desperate for a good supply of water . Eastern Artificial
Insemination , Inc . , is a highly respected neighbor of ours
and I am sure that the Town feels the same way . At any rate
this should be a major consideration when determining a
resolution to the problems we present here tonight .
Another maijor consideration must be the health and welfare
of all residents . The water table is in a state of

degradation . Where a short time ago there was an adequate
supply , there is now a shortage ; where the water was clean
it is now full of sediment ; sweet has become salty , and who
can say what the next characteristic is going to be that it
will show . Are the odors within the homes harmful when you
are forced to live with them for an extended prolonged
period of time . The odors become an every day part of the
household to those living there , but if you happen to drop
in , a stranger from the fresh air , it is obvious that
something is unusual about this home . Another question on the
minds of residents : With flow diminishing , will bacteria grow
more rapidly ?
Can anyone? say for sure that these odors , and this water have
no effect on the long term health of the occupants ? As you
all have read , good water supplies throughout the country are
becoming unfit for consumption .
There is one neighbor of ours , after living in her home for
near twenty years , and now wishing to retire to a smaller
home , has had prospective buyers actually walk out after
seeing the? complex and expensive water purification system
required to provide palatable water . The point is , that many
more of us may be faced with a similar financial disaster
when we attempt to market the investment we have made in the
Town Of Ithaca .
All Town residents pay taxes at the same rate , and most of

the Town is provided with munincipal water , sewers , . and
natural gas . It is time that these services be extended to
encompass the entire town , and the cost be shared by all .
No one is naive enough to think that this can be done
without an increase in taxes . By the same token , it is a

certainty that the tax base in the a �.rn part of the town
will also increase as the area becomes more desirable to live
in .
Although , water is our primary reason for being here tonight ,
it seems that with costs rising as rapidly as they are , there
would be a realized cost savings , if provisions for all
utilities Hiere considered at the same time .
Doing this petition , and sharing our problems together , has
been a rewarding and enlightening experience for all of us .
Where before it was " The Poole Road people , " or " The Bundy
Road people , " " The Hayts Road peoples " it is now the
residents of the mot side .
We found that many hours had already been expended over the
years to inform the Town of this mounting problem . Phone
calls have been made , many petitions submitted , and
discussions held .
Seemingly this effort was for naught , with no follow - up from
the administration . Therefore , we respectfully submit that
this petition and our comments be made part of the otticial
minutes of this meeting . We further request that this

issue be assigned a place on the towns priority list for ,
" Things to accomplish , " and that it be reported on in Town to
Citizens communications on a quarterly or semi - annual basis
so that we may monitor the progress of the issue at hand .

Judd Falls Road in Forest Home .
The following resolution was unanimously approved at a meeting of the
Forest Home Improvement Association held on February 10 , 19924
Whereas the residents of Forest Home are committed to the preservation of
the historic character and physical integrity of their community , and
Whereas said character and integrity are in large part defined by the
winding roads of modest width which respect the natural lay of the land ,
and
Whereas Judd Falls Road is already very close to houses on both sides, and
Whereas Judd Falls Road already carries too much traffic for a residential
community , and
Whereas traffic on Judd Falls Road already travels too quickly, and
Whereas there are more pressing roadway projects elsewhere in the Town ,
including the need for an appropriate alternate route around Forest Home ,
Now be it therefore resolved that the Forest Home Improvement
Association opposes any construction work on Judd Falls Road within Forest
Home other than simple resurfacing and minor drainage repair and
maintenance, and opposes any change in grade or widening of the roadway. -

ALTERNATE PROPOSALS
o If the Town wants to help commuters and residents alike, then, instead
of rebuilding Judd Falls Road, put the budgeted time and money into the
planning and construction of an alternate route around Forest Home .
o If the Town wants to spend money in Forest Home on a safety issue,
then reopen the walkway on the downstream bridge.
o If the Town is concerned about drainage, then clean and maintain the
existing drainage facilities on Judd Falls Road and Forest Home Drive.
o If the Town wants to spend money on roads in Forest Home, then
eliminate the shifting concrete cribbing which supports a short section
of Forest Home Drive near Beebe Lake.
o If the Town is concerned about the pavement on Judd Falls Road, then
patch or repair the worst sections, as was done on the washboarding
last year.
o If the Town wants to repave Judd Falls Road, then grind down the old
pavement within the existing curbs, and repave with the existing grade
and 18 ft. width. Less than 15% of the existing curb - and - gutter
sections would need some attention - - cleaning, repairing, or resetting.
o If the Town feels a need to install granite curbing on Judd Falls Road ,
then maintain the existing grade and 18 ft . pavement width , and install
the curbing sloped instead of vertically. Sloped curbing would mean
less damage to tree roots , and would preserve the historic rural village
character of Forest Home. .

STANDARD WORKDAY AND RECORD KEEPING PROCEDURES
FOR ELECTED AND APPOINTED OFFICIALS ON NYS RETIREMENT
Resolution No .
WHEREAS , New York State requires municipalities to set a
standard work day, to report elected and appointed officials
participating in New York State Retirement , and
WHEREAS , a standard work day must be at least six hours per
day and be :representative of actual hours worked with , for elected
officials only , a consideration of such factors as the official
duties of the office and the need to be available to the public
outside normal working hours , and
WHEREAS , New York State recommends that officials keep and
submit a loci of hours worked during an average month each year , now
therefore be it
RESOLVED , the Town Board of the Town of Ithaca does hereby
set the following days and requirements for New York State
Retirement reporting :
Standard Work day for Elected Officials :
Standard Work day for Appointed Officials :
All Town officials , elected or appointed effective January 1 ,
1994 and participating in the New York State Retirement System ,
will keep and submit to the Town Clerk a daily log of hours worked
during an average month each year .

traffic circulation problems ( i . e . it should be part of a
long - term plan for managing traffic in this area ) ; and

protection and preservation .
The present proposal satisfies neither of those criteria ;
therefore , in its present form , it does not merit expenditure of
taxpayers ' dollars .

traffic . This increase has been driven in large part by growth in
Cmployme11L at Cornell to the south and by residential developments to the
north) and east of Forest Home . Our problem was compounded by CornelI ' s

Prospect . The prospect is for more of the same . CCSpite the I ecession ,
growth at Cornell continues . I luck of this growth will take place directly
south of Forest Home . The corner of Judd Falls and Tower Roads has been
designated as a building site . An expanded incinerator facility will import
waste materials for incineration at Cornell . The vet school is in the midst

of an expansion . Piannea aiso is an expanded green house faci iity .
For reasons of community preservation ; topography , and safety ; routing
most of this traffic through Forest Home does not make sense : it neither
presents a lono - term viable solution to transportation needs in the area nor
is it consistent with Town poiicv of neighborhood preservation .
Nevertheless ; we are alarmed when we look at individual construction
projects ; because they seem to add up to just that : increasing the pressure
of traffic on the Forest Home neiahborhood . This is what we see when we

look at the Pine Tree Road / Judd Falls Road intersection : this is what we see
when we view improvements on Pleasant Grove Road ; which exceed those
that were described to us . Our concerns are further enhanced by the
continued dispute over the downstream bridoe despite broad community
su000rt for retention of a one - lane bridoe : and then are not stifled when we
are told by the Town enoineer that next vear ' s construction clans include
CaiaweiI Road improvements and shavina the corner at the Pond 'House on
Forest Home Drive - - a corner that reminds people that this is a
neiahborhood - - not a hiahway .

Our position . We are not self - centered . Our community is an ever rarer
piece of Americana . it is treasured by residents and non - residents alike .
Visitors to the area come to see us . we have lust received 'historic

designation from the State of New York . 'we are an asset to the Town .

.we are nQt obstructionist . Our position has been consistent . We
want to work with the Town , Cornell , and the County to find a
long - term viable solution to traffic circulation problems here
that is consistent with the preservation of our neighborhood . This
is important not only to us , but to the Town , and to future
generations . This proposal does not meet those criteria . Let ' s sit
down and go to work on one that does .

Picture yourself orl a beautiful summer day on the grounds of a landmark
building , overlooking " Cayuga Lake , listening to classical music be 'ing
played while celebrating the wedding of close friends or family .
Unfortunately , this is not possible .
As Town Board members , you can make it possible by approving my request to
add catering as one of the uses under Article II , Section 2 of the Town of
Ithaca Zoning Ordinance . Primarily , this type of business does on - site
preparation for off - site functions , but I would also like to allow them to
use the setting of the building and grounds suggesting the following as
guidelines :
- Functions would be primarily weddings occurring in the spring and
ummer months ; approximately four months out of the year .
Functions could only be held on Saturday or Sunday between the
hours of 3 to 11 p . m , with a strict curfew enforced .
- Approximately thirty functions or less would be held annually .
Of course , I would be willing to work with Mr . Barney on these guidelines
and only offer these suggestions as to better explain my idea of what I
would like to occur there .
Please appreciate my position that in order to make this a viable project ,
I need to take advantage of the equipment and conditions , and historic
nature and the unique setting of the building which currently exist .
First , it would be economically detrimental for me to remove the fully
equipped kitchen which was previously used by the Mayer School . The
kitchen is valuable only as a kitchen , not as the dismantled sum of its '
components . The walk - in coolers aren ' t worth anything without a kitchen to
put them in .

Secondly , the setting ` is ideal and - I can ' t see where a low - key wedding or
ther function would be inconvenient to nearby or on - site residential
tenants . Even if the designated residential units were fully occupied ,
there are several buildings in the City of Ithaca which successfully house
mixed - use activity . For example , the Lehigh Valley House has dinner and
bar activity every night , holds receptions , has bands play on an average
of every two to three weeks , and has apartments located above . Being the
owner , I know there has never been a complaint from the tenants above
concerning noise or traffic . There are many other such establishments with
high activity and .mixed use ( offices , apartments , catering , etc . ) that
work well together . I ' m sure that if the commercial uses in these
buildings were such that the tenants could not reside there , the Landlord
would find himself slowly losing money and would be forced to make
changes . However , each year the apartments are rented , and the businesses
continue to flouri :3h .
I cannot stress strongly enough , the the functions that I envision being
held at this historic building will be low - key and in - keeping with the
setting and the ambiance of the building . I am in no way suggesting that
you approve a restaurant with lunch and dinner activity ; or a nightclub
with loud bands and disruptive patrons . 1 purchased the building because
it is a beautiful , historic landmark and I have no intention of ruining
it , I merely want to make it financial feasible to save it . I am willing
to work on the wording of the amendment with the Board and Mr . Barney so
that the best interests of the Town are met , as well as the economic well -
heing of the building .
I sincerely hope you will give serious and thoughtful consideration to
