As Deputy Town Supervisor, Councilperson Goodman is hereby afforded all duties and responsibilities of said position as prescribed by Section 42 of Town Law, General Municipal Law, and the Public Officer's Law of the State of New York. Moved: Pat Leary Seconded: Rod Howe Vote: Ayes—Leary, Howe, Engman, Goodman, Levine, DePaolo and Hunter Item 4 Persons to be Heard Two representatives of the radio station currently broadcasting using the EcoVillage tower (Item #5)gave an overview of the station and the history. They have been using this facility for the past 6 months or so and they were not aware they were in violation until notice was given to the Board of EcoVillage. They are excited about their station and the number of listeners already tuning in. Mr. DePaolo asked about the status of the lease and whether they were in jeopardy of being forced off the air. Neither the representatives nor Mr. Goodman knew the length of the lease but Mr. Bates stated that his determination is that as long as they are actively pursuing a resolution to this violation, he would not be pushing for them to cease operations. Mr. DePaolo wanted to have more information because he was concerned about setting a precedent for others if we allow this as a use in an Ag Zone and the fact that it is a PDZ changes TB 01-13-2014 Minutes Pg. 1 that. Mr. Goodman thought it would be fine to put it on the Public Committee agenda and then back to the Town Board at the study session to set a public hearing for the February meeting. Item 5 Consider Referral of a Revised Development Concept for 619/617 Five Mile Dr. and Request for Rezoning from Low Density Residential to Medium Density Residential to the Planning Committee for Review and Comment Sue Cosentini explained that they are requesting a rezoning from Low Density Residential to Medium Density Residential. She explained that they had been looking at a cohousing community not unlike EcoVillage but they came up against legal and financial hurdles so they are looking at something similar, will all the components of cohousing except for the cohousing central building. They are doing a very sustainable and green development but with fewer common components. Mr. Engman asked if the she had any questions before the Board referred it to the Planning Committee and Mr. DePaolo thought it might be good if they heard the questions the Board would want answered at the committee meeting. He stated that his biggest question is their request to rezone the adjacent parcel that may or may not be coming up for sale and for which they may or may not be able to purchase since it is under a sealed-bid process and he wondered if the Board has done this in the past; rezoning parcels in anticipation of the potential of a sale of property and why not wait until you own it. Roy Andrews explained that because the parcel is landlocked, it makes sense to do it now because it is the only use for it as it borders a cemetery on the other side. Mr. DePaolo then asked about the road leading to the parcel and who owns that and Mr. Andrews responded that the it is owned by the State, the current property owner and their parcel. Ms. Hunter asked what the plans are for the other parcel if they do get it and Mr.Andrews explained that they would combine the lots and do a cluster subdivision on that with another 5 lots or so. He added that they are not looking for the maximum amount that would be allowed on the combined lot size given that they plan a slip pond and open space for that additional parcel area. He went on to say that their interest in the property hinges on the pedestrian access that will be available through the Black Diamond Trail and the City has started a sidewalk on the inlet which hopefully will continue. Mr. Engman asked if they have talked to the state about the current curb cut of the current driveway and whether they would approve the increased use of that driveway to this development. Mr. Andrews stated that they are showing two access points and prefer the other from the inlet so they have not talked to the State yet. TB Resolution No. 2014 - 002: Referral of a revised development concept and request to rezone 619 and 617 Five Mile Drive from Low Density Residential to Medium Density Residential to the Planning Committee for review and consideration Whereas Susan Cosentini of New Earth Living appeared before the Board on October 15, 2012 to present a proposal for a 27-unit cooperative housing development and pocket neighborhood on TB 01-13-2014 Minutes Pg. 2 a parcel at 619 Five Mile Drive with a request to rezone the property to allow for said development; and Whereas the Board referred the concept and rezoning request to the Planning Committee for review and consideration; and Whereas the Planning Committee at their meeting on May 23, 2013 discussed the development proposal and recommended that the applicant initiate preparation of language for a Planned Development Zone for the committee's review and consideration; and Whereas the proposed "Amabel" development has since been modified (see attached material) and is now proposed as a 27-unit clustered subdivision/pocket neighborhood located on 619 and (a portion of) 617 Five Mile Drive with internal roads and driveways, rather than a cooperative housing development (previously proposed with shared parking and a community building); and Whereas the current low density residential zone would not allow the number of units proposed for the Amabel project; now therefore be it Resolved that the Town Board hereby refers the revised Amabel development concept and request for rezoning to the Town Planning Committee for review and consideration. Moved: Rod Howe Seconded: Tee Ann Hunter Vote: Howe, Hunter, Leary, Levine, Goodman, Engman and DePaolo Item 6 Report of Tompkins County Legislature and Ithaca Common Council—None Item 7 Annual Approval of the Town's Board and Protocol Manual TB Resolution No. 2014—003: Approval of The Town's Board Protocol and Procedures Manual Whereas the Town Board has adopted and approved the use of the Board Protocol and Procedures Manual and Whereas the Manual is to be reviewed and reaffirmed annually, now therefore be it Resolved, the Town Board of the Town of Ithaca does hereby reaffirm and approve the use of the Board Protocol and Procedures Manual as the rules of its procedures for the Town Board as authorized by Town Law Section 63. Ms. Drake noted that we used to designate Historic Ithaca as our historian and then moved to appointing an individual. Ms. Terwilliger will research the appointment periods for the various appointments and report back to the Board. Ms. Terwilliger will also notify Ms. Johnson-Kelly about providing a report. TB Resolution No. 2014 - 004a: Reappointment of Paulette Terwilliger as Town Clerk of the Town of Ithaca Be it resolved the Town Board hereby re-appoints Paulette Terwilliger as Town Clerk of the Town of Ithaca for a term continuing until the 1" day of January next succeeding the next biennial Town election to wit,January 1, 2016. These second meetings are commonly called study sessions which begin at 4:30 and are held in a smaller meeting room. Mr. Levine proposes the funds allocated for that go through the Recreation Partnership because we are not getting what it states we should be in the contract. Discussion followed with Ms. Hunter stating that those funds also cover Stewart Park and Cass Park operations, not just the Rink and Pool and she does not want to see that jeopardized. Mr. Levine responded that there used to be two or three different prices and City residents get discounts and the contract says we should pay the same as City residents but we don't. We don't get anything special for the $110K we are giving. Mr. Engman stated that he would check with the Youth Bureau and wouldn't sign the agreement until the Board gets more information. Ms. Hunter asked about the status of the TCAT contract and Mr. Engman responded he hasn't heard from anyone yet and Mr. Goodman stated that he talked to Ms. Dotson who said we should be hearing from them soon to schedule something. Mr. DePaolo asked whether it would be in the best interest of the town to consider in-house counsel. He made a point of making sure Ms. Brock knew this was not in any way a reflection on her services but should we consider the difference between going with an in-house option and perhaps look at it at the committee level; Personnel or Operation. Mr. Levine requested that he be invited to those discussions since he is an in-house counsel for his employer. Mr. Engman responded that we have looked at this before and to him, the break point is $150K because of the benefits that go along with staff. He went on to say our average has been $116K a year for all legal services but we have been keeping an eye on it. Mr. DePaolo responded that the City Attorney is paid for $87K for 40 hours and we are paying hourly full rate which if you multiply it out is significantly more. He again made it very clear it is not personal or a reflection on the service we get and if the primary concern is cost then the Budget Committee could look at it. Ms. Leary noted that it is also a question of flexibility and whether we have enough work for a full time person as well as the added advantage of someone who works with other municipalities and has a broader perspective of our issues. Ms. Hunter noted that an in-house attorney would not necessarily have to be full time either. Mr. DePaolo was concerned about#11 dealing with taxing fiberoptics at private properties. Mr. Goodman thought it referred to a recent court case saying that they could not. Mr. Engman didn't understand the implications of the resolution and Mr. Goodman thought it might have to do with easements associated with the running of them through someone's land. Mr. Engman noted that there will be additional information at the Annual Meeting session and we can reserve the right to pull it at that time when a vote is called for at the final session where they are called individually. Ms. Leary asked about the waiver of the notice or application for asbestos removal. Other than the fact that it costs the municipality money, why are we getting a waiver? Where do the funds go? Mr. Engman thought it was to waive fees for when a municipality is forced to accept a property for some reason and a municipality, like a private homeowner, has to have an inspection through the State and the cost is approximately$4,000. He thought the question for the Association would be where the monies go and what do these fees support. Why are we taking taxes through one taxing entity to give to another taxing entity? Pursuant to the provisions of Section 284 of the Highway Law, we agree that moneys levied and collected in the Town for the repair and improvement of highways, and received from the State for State Aid for the repair and improvement of highways, shall be expended as follows: HIGHWAY: 1. Ms. Hunter stated that she was against this resolution because she would like to see a procurement policy and she read from Town Law where it is required to have one. Mr. Solvig stated that we do have one but it is very out of date and we are in the process of revising it. Mr. DePaolo wanted to suggest some language that would require Mr. Weber to report what happens after a bid like a summary of what was purchased and how much in a summary form. He thought we might see it at a committee level but it would be nice to see it at the Board level also. Mr. Weber responded that he does report what was purchased in his bi-monthly report and any bid that comes in over the budgeted amount comes back to the Board for approval. He was unclear what else is wanted. Ms. Hunter responded that she would like to see the bid specifications. Mr. DePaolo thought that we have abdicated the review of the bids to Mr. Weber and that is what is at issue. Mr. Engman responded that we could make sure the announcement goes out to the Board and Ms. Hunter added that she would like to know that the Board is discussing what is put in the specifications, such as a truck; who decides what is put on the truck etc. This could be done at the committee level but the Board should know that it is being discussed so they could have the opportunity to comment. Mr. Engman asked what other board members felt because he did not feel the need to review specifications that staff, who are qualified and hired to do that, submit. Mr. DePaolo stated that he simply wants to add language requiring what seems to be happening in the bi-monthly report and/or see a bit more detail including what the specifications were, what the bids received were and why the award went to one vendor versus another. He was not asking to go through specifications to determine which bid was accepted,but he would like to see a summary. Mr.Weber added that many purchases, especially vehicles and the like, are made through the State site (OGS) and the specifications are set by them. Ms. Hunter stated that she does not want a lot of detail but simply a summary with some detail on what is going on other than we bought this. Mr. Solvig stated that it seems that what Mr. DePaolo is requesting is easily done but asked Ms. Hunter if she is asking to see these specifications before the award is made and she responded yes. Mr. Solvig went on to say that that would significantly slow things down and those specifications are detailed and not in layman terms. Ms. Hunter responded that she isn't TB 01-13-2014 Minutes Pg. 15 interested in that level of review but would like a brief presentation about when a bid is going out,what is in the specifications and an opportunity to ask questions. She did not think that in the capital planning process they went to that level of detail and it would be nice to have a 10 minute presentation on items being put out to bid. Mr. Goodman stated that this resolution really applies to vehicles, tools and equipment and the big projects go through a public interest order process so the information is given to the Board then as well as through the Public Works Committee minutes. He suggested that the Town Clerks office send out the notices and the bid results to all board members and see how that works. Mr. Engman agreed and thought the SAC group could discuss the crucial points in the timetable for these purchases and see if we could get that information out to the board and look at it again after we see how that works. Mr. Engman agreed but noted that this study might show where it could be placed and then we could ask for the bigger contribution and their involvement. Ms. Ritter said we could ask and they are aware of this but it is a small piece. Mr. DePaolo thought it might set a precedent if we don't ask and we should at least ask. He said everything he has heard from the administration is that they want this but they haven't opened a checkbook and it would be nice to approach them. Mr. DePaolo said he would ask Anthony Hopson what the best approach might be and say that it might be advantageous if they were to help pay the matching funds the Town has committed to via this resolution. The modifications spell out the Easement's terms, which were lacking in the 1994 deed. They allow the owners of the property and its heirs to have continued use of the surface of the Easement area, provided that they do not construct buildings, fences, walls, or other structures, or plant trees, shrubs or other vegetation, or change the grade or install underground pipes within the Easement area without the written permission of the Director of Public Works. They may, however, maintain the portion of the building that exists within the Easement area. The Department of Public Works has determined that the building will not negatively impact the Town's ability to provide and maintain slope stability, proper drainage grade, and proper sight distance and line of sight for Park Lane. The modifications also allow the Town to have full right to enter at all times upon the Easement area and to survey, construct, repair, remove, replace, reconstruct, inspect, improve and maintain a suitable slope or grade, and to plant, maintain and remove vegetation, to provide proper slope stability, drainage grade, sight distance and line of sight.
