Town Board Meeting Minutes
May 10 , 1993
At the regular meeting of the Town Board of the Town of
Ithaca , Tompkins County , New York , held at the Town Hall , 126 East
Seneca Street , Ithaca , New York there were present. :

Pledge of Allegiance : The Supervisor led the assemblage in the
Pledge of Allegiance .
Call to Order : The meeting was called to order by the Supervisor
at 5 : 33 p . m .
Agenda Item No . 3 - Report of Town Officials
a . Town Supervisor - Supervisor Raffensperger reported that the
Town has been audited in the past month , by internal auditors and
auditors from the State . The independent audit will be available
for review in June . It is not known when the report will be ready
from the State .

The Supervisor attended a meeting on April 21 of local officials
called by representatives on the Tompkins County Board to discuss
1994 sales tax distributions . In addition to the City functions
the County Board has agreed to pick up , Tompkins County will also
take over some Town and Village expenditures , such as any human
service appropriations and transportation related subsidies . This
will provide some relief to the Town budget in 1994 , the
appropriations for the covered items in 1993 were in excess of
$ 20 , 000 .
The Town received sales tax distribution for the first quarter 1993
on May 4 , amounting to $ 333 , 728 . 12 . The Town is still running
somewhat ahead of 1992 receipts , but David Squires from the County
has warned the Town that the State has altered tax collection and
distribution methods to an extent that it is difficult to project
any general trends .
The City of Ithaca and the Town of Lansing have been particularly
hard hit by recent flooding and have applied to the State for
federal relief funds . They have been presently unsuccessful as the
funds are for individual landowners and not municipalities . The
Town has some isolated problems which will be better assessed as
the waters recede .
Dan Walker , Floyd Forman , and the Supervisor visited the site of
the Therm spill last week and the cleanup measures are substantial .
Mr . Walker is maintaining contact with the City of Ithaca and DEC
on this matter . John Whitcomb attended a meeting on the Therm
spill .
Deletions on the Agenda : No . 20 , snow and ice contract , and No . 22
audit report .
Additions on the Agenda : A resolution from the Bolton Point
Commission authorizing payments between meetings of certain
regularly occurring bills and a resolution authorizing employment
of a secretary for the Zoning Board of Appeals .
b . Town Engineer - The Town Engineer reported on his written
report , ( see attached ) .
C . Highway Superintendent ' s Report - The Deputy Highway
Superintendent reported on the written report , ( see attached ) . The
Supervisor asked when the brush and leaf pick - up would be
completed . Mr . Noteboom responded hopefully by Wednesday , May 12 .

Councilwoman Valentino stated she had received calls from residents
asking if they could still pick up mulch at the Town barns for
gardens and lawns ? Mr . Noteboom said that they can between the
hours of 6 : 30 a . m . to 3 : 30 p . m . , Monday ' s through Friday ' s .
The Superv :isor said there was a sign posting the hours , it is not
feasible to leave the facility unsecured for people to drive into
times other than operating hours .
Councilwoman Valentino said that Mr . McConnell had said that there
would be an attempt to make the pick up piles more accessible for
people who can not get the mulch at the times allotted .
Mr . Noteboom said that it has been discussed and he is looking into
the possibilities of finding a way for more convenient pick up .

Assistant Budget Officer Report - Ms . Alario reported that the
Board has received reduced copies of the abstracts . Vouchers will
no longer be presented to the Board at the meetings for review as
all vouchers are listed on the abstract . The vouchers are
available if there are any questions . The State auditor informed
the Town this approach to reviewing of the warrants is legal .
Councilman Whitcomb thanked Ms . Alario for improving the system in
this way .
Agenda Item No . 4 - Report of Town Committees
Councilman Whitcomb reported on his fact finding meeting on the
Therm spill . The attendees were concerned citizens , City officials
etcetera . Individuals had questions for the Department of
Environmental Conservation ( DEC ) and others involved with the spill
clean up . The meeting to answer these questions will be held for
May 20 , 5 : 30 p . m . at the South Hill School . Representatives of the
DEC will be attending to answer questions and report on the status
of the clean up .

Councilman Liguori reported that the Town Engineer is preparing a
proposal for the SJS Sewage Treatment Plant for possible diversion
of Cayuga Heights sewage flow in the Kline Road sewer project .
Agenda Item No . 6 - PERSONS TO BE HEARD
Noel Desch asked what prompted the Attorney General getting
involved in the Therm ?
Councilman Whitcomb said he did not know how the Attorney General
became involved but he has promised to make sure the spill is taken
care of in the proper manner .
Agenda Item No . 10 - Investment Policv
Ms . Alario reported the Investment Policy presented is the format
that is recommended by Audit and Control . There were several
changes made in December 1992 which the Town received in February .
The new Policy has those changes incorporated into it .
Supervisor Raffensperger said in the past the Town had a Town of
Ithaca policy and since the State Auditor came the Town has
understood the wisdom of using exactly what Audit and Control
recommends . If the Town can go to the States form and say this is
why something was done it makes it much easier .
Motion made by Councilwoman Valentino , seconded by Councilman
Liguori adopting the Town of Ithaca Investment Policy and
authorizing Tompkins County Trust Company as the financial
institution for deposits with a maximum amount on deposit of
$ 9 , 000 , 000 .
The Supervisor pointed out that the authorized amount for deposit
is approximately $ 1 , 000 , 000 more than is needed , but will be a
safety net .
Motion carried unanimously .

Agenda Item No . 17 - Financial Report , December 1992
Ms . Alario reported that the Town ended 1992 in good condition .
Motion made by Supervisor Raffensperger , seconded by Councilman
Liguori adopting the Financial Report for December 1992 as the
official Financial Report for the month indicated . Carried
unanimously .

Motion made! by Councilman Klein , seconded by Councilman Liguori

Agenda Item No . 19 - 1993 Highway Paving Schedule
Deputy Highway Superintendent Noteboom presented the list of roads
slated for paving this summer . The expenditures for this paving
have been approved at previous meetings .
Motion made by Councilman Liguori that the Highway Department set
the schedule to pave Lexington Drive , Christopher Circle , and
Fairway Drive during the week of May 24 to 28 . Judd Falls Road
reconstruction is scheduled to start on July 6 , and should be
completed by August 27 . Seconded by Councilwoman 'Valentino .
Councilwoman Valentino asked if the improvement will be made to the
surface that is already there and will it change the width of the
road ?
Mr . Noteboom said that on Judd Falls Road there will be new curbing
and changes to some of the utilities ( manholes , etc . ) .
Mr . Walker explained there will be a slight change of grade on Judd
Falls Road in the steep section just before the Forest Home Road .
Councilman Whitcomb said he had called Mr . Walker to ask if the
Forest Home Association had been consulted about the design of the
Judd Falls reconstruction . Mr . Walker had said the details were
not yet complete and that Forest Home representatives would be

involved . Councilman Whitcomb reviewed the March 1993 minutes
where the approval of funding was discussed , the Board had agreed
with the Forest Home Association because of the nature of the work
to be done that they be included .
The question that prompted a reply during the March meeting by Mr .
McConnell was , " does the approval of funds commit the Town to any
specific design criteria for that reconstruction " . The answer was
no , the Forest Home Association would concur with any work .
Councilman Whitcomb said is concern was that since the design is
not yet done and July is rapidly approaching , that there be time to
come to some kind of consensus with the Forest Home Association
before the work is done ?
Mr . Walker stated that there was a meeting with the Forest Home
representatives on a preliminary basis . There main concern was the
width of the road , they did not want the road any wider . Currently
there is a concrete curb and gutter section which makes the asphalt
width approximately eighteen to nineteen feet . The plans call for
a granite curb so that the actual asphalt width can be a little
wider , about twenty one feet . This width is face to face and curb
to curb . Forest Home was comfortable with maintaining the existing
width between the curbs . A meeting is tentatively scheduled for
May 14 , to explain that design criteria ,
Councilman Whitcomb asked if the approval of the dates on the
resolution commit the Town to any specific design ?
Mr . Walker said the design is far enough along so that the Town and
Forest Home know what is planned . The worst case scenario would
might be a slight narrowing of the road which would not change the
design .
Supervisor Raffensperger recalled at the end of last year she and
Councilman Liguori attended a meeting with Forest Home and
discussed their concerns about the designs . It was her
understanding that the agreement reached was that the Town would
make every effort to take into account the Forest Home
Association ' s concerns , but the design is one that the Town must
approve .
Councilman Klein remembered that in the minutes of March , the Town
Board reserved the right to approve the final design . The other
paving jobs - are set , before the Judd Falls Road project commences
the Board is to approve the design ,

The Supervisor responded that in June the Town Board can look at
the plans and approve it . The Town will make every effort to have
the concerns of the Forest Home Association within the plans .
Mr . Walker said that he would have the plans at the Public Works
Committee meeting on May 27 they can review them and make a
recommendation to the Town Board at that time .
Motion approving the Highway Paving Schedule , carried unanimously .
Agenda Item No 7 - Presentation Tompkins County Summer Youth
Programs
Philip Dankert , Chair of the Joint Youth Commission spoke to the
Board . Mr . Dankert said that the 1993 Summer Youth Employment
Program Proposal was a concept started last year . A decision was
made that projects would be alternated between the Town of Ithaca
and the Village of Lansing . Last summer there was a very
successful project within the Town , and it looked like the Village
would not have enough projects to keep the youth busy this summer .
The latest word is that the Village will be able to have a
sufficient number of projects .
Mr . Dankert asked if there were any questions concerning the
proposal ?
The Supervisor said that the discussions are related to the Youth
Conservation Corp that the Town Board approved last year as the
first part of the program . The Town had the Corp last year and
made a commitment for the Village of Lansing to utilize the Youth
Corp . The funds have been budgeted for in 1993 .
Nancy Zahler , Director County Youth Bureau said the resolution for
the proposal before the Board is for the Town to have two different
but related. programs . The main one is the Conservation Corp . The
other component would provide summer employment opportunities where
ten town youths would be hired based on their individual interests
and career goals then placed by the City of Ithaca Youth Bureau to
job slots apart and different from the Conservation Corp . These
are the same components approved as last year and contained in the
same resolution . The budget and expense for them is detailed
separately on the attachment to the resolution .
The Supervisor reflected that last year the Town was involved in
the Youth Employment effort , and because the Town had no money in
the budget at that time the County paid all of those costs . There
are sufficient funds in the budget this year for the Town to
participate: . Last year Town of Ithaca youth were used in the
programs .

With great pleasure , Councilwoman Valentino made a motion that the
Town of Ithaca appropriate $ 16 , 395 . 50 to contract with the City of
Ithaca to hire up to a total of 14 youth in accordance with the
proposal as presented for the Summer of 1993 . Also , that the Town
submit applications to the State and County for 50 °% reimbursement ,
and authorizing the Supervisor to execute a contract with the City
of Ithaca for the services . Seconded by Councilman Klein .
Councilwoman Valentino said that she felt the Town should be doing
more of these kind of programs for the youth in the community .
Councilman Liguori said that he thought the Village of Lansing
would do it this year ?
The Supervisor explained there are two programs . One is the Youth
Conservation Corps . The Village of Lansing will use them this year
because the Town of Ithaca had them last year . Then there is a
separate program which is a subsidized summer job program for
teenagers who are residents of the Town .
Mrs . Zahler mentioned that the Conservation Corps as it was run
last year used youth from both the Town and Village working in the
Town , with the Town and Village sharing the cost . For 1993 the
proposal is that the Town continue to share the costs , the youths
come from both municipalities , but the work projects would be
primarily in the Village of Lansing . If the youth complete the
projects in the Village of Lansing , and the Village doesn ' t have
other work the Town could use them for any projects they have .
Supervisor Raffensperger stated that with these programs all the
supervision and insurance is outside the Town ' s responsibility .
The City of Ithaca does the hiring , supervising , and absorbs the
risk .
Councilwoman Valentino stated this program is a very good example
of intermunicipal cooperation .
Motion approving the 1993 Summer Youth Employment Program Proposal
carried unanimously .
Agenda Item No . 21 - Contract Stuart Brown Associates
The Supervisor remarked that at budget time the Board discussed the
extent to which the Town would need to use Stuart Brown Associates
for finishing the Comprehensive Plan work . The budget includes
funds for Stuart Brown Associates to proceed to complete the SEQR
portion of the Comprehensive Plan when that point in the process is
reached .

The agreement is less extensive than previously with Stuart Brown
Associates . One change is that the cost has gone up $ 5 . 00 per hour
this was expected to happen on a yearly basis . The system for
submitting monthly payments is the same . There are lists of tasks
that are considerably less extensive than they have been to include
the possibility of the Town receiving a grant for the SEQR work . If
the Town had sufficient funds in the budget there may be other
planning work that Stuart Brown Associates would be used for with
the approVELl of the Town Board .
Councilman Klein asked if the budgeted amount basicly will cover
the services of the grant ?
Supervisor Raffensperger responded that if the Town does not
receive the: grant from the New York Planning Federation the Town
staff will have a greater lead in working on sections of the SEQR .
The Town is attempting to do some of the capital planning talked
about in the past . With the combination of the budgeted amounts
and the Town staff , it is hoped the Town will receive a grant to
accomplish all tasks .
Motion made by Councilman Klein authorizing and directing the
Supervisor to sign the contract with Stuart I . Brown Associates ,
Incorporated as per the proposed and attached contract terms .
Seconded by Councilman Whitcomb . Carried unanimously .
Agenda Item No . 23 - First Quarter 1993 Investment Report
Ms . Alario explained that the total interest earned on all the
Town ' s investments was $ 38 , 393 . 95 . This is the first quarter in
over two years that the interest rates stayed the same during the
whole quarter .
Motion made by Supervisor Raffensperger adopting the Quarterly
Investment Report for the months of 1 / 1 / 93 to 3 / 31 / 93 as the
official report for those months . Seconded by Councilman Liguori .
Carried unanimously .
Agenda Item: No . 25 - Summer Help Highway Department
Mr . Noteboom stated that with the past bad weather there has been
difficulty in having projects develop that were not planned , as
well as having to put off many projects that were planned . The
Highway Department is requesting some additional laborers and a
truck driver to help with the extra work . The money to pay for the
additional help would come from additional CHIPS monies not

anticipated , and from reimbursement from the Federal Relief Fund
for the 1993 Blizzard . Also , the Highway crews will receive some
reimbursement from other departments for work done for them , such
as water and sewer projects .
The Supervisor explained it is still a mystery as to why we will be
receiving additional CHIPS monies from the State . Senator Seward
and Senator Luster have notified us of over $ 4000 more than
expected .
The necessity for the need of this additional help is more than
clear with the emergency repairs the Town has had . There will be
more repairs needed when the waters recede and an assessment can be
made of the damages . The Supervisor recommended that the
resolution approving the additional highway summer help be adopted .
Motion made by Councilman Liguori authorizing the solicitation and
hiring of two laborers and one truck driver / laborer for a period to
start no earlier than June 1 and extend no later than September 30 .
Seconded by Councilwoman Valentino .
Councilman Whitcomb asked Councilman Liguori if the Public Works
Committee had reviewed this request ?
Councilman Liguori replied that they had and reached a consensus
that the additional help was needed .
The Supervisor reported that in 1989 and 1990 the Town employed
some temporary laborers in the summer . It makes the crews more
useful and the Town doesn ' t have to add permanent full - time
employees . This will probably not be the last time the Board is
asked to consider summer time workers as opposed to adding
permanent employees .
Councilman Klein asked how these positions would be filled ?
The Supervisor said an attempt would be made to fill the positions
by advertising them . It has been discovered that the Town cannot
get people from temporary agencies with the driving skills
necessary .
Patricia Punger explained that the driver would have to have a
special CDL license to drive a larger truck , and the temporary
agencies do not handle that under their insurance . It also would
be quite expensive through a temporary agency . The short duration
of time makes it less likely to be an unemployment liability .

The Supervisor explained that in the past we have attempted to hire
from temporary agencies because it relieves the Town of the
insurance and fringe benefit responsibilities .

Agenda Item No 8 - Town / City Youth Bureau Recreation Programs
Sam Cohen , Director of the Ithaca Youth Bureau addressed the Board
about the relationship the Town and City have regarding recreation
programs through the City of Ithaca Youth Recreation Department .
Others present to speak were Mayor Benjamin Nichols , City of
Ithaca ; John Wilson , Coordinator of the recreation department ; and
Holly Beermann , Town of Ithaca Representative to the Youth Bureau
Board .
Mr . Cohen said that he wished to make sure the Board was fully
informed as to what is happening with the recreation programs that
are serving the Town of Ithaca . Mr . Cohen presented a summary to
the Board concerning the position the Town and City are in
regarding recreation , ( see attached ) .
Mr . Cohen said that they have been working very closely on the
program with Councilwoman Valentino who is the Board ' s
representat: ive . The handout presented by Mr . Cohen related to the
on going discussions with Councilwoman Valentino and the
Supervisor .
The present: partnership between the Town and City will continue
until the point is reached where a recommendation can be made for
a greater Ithaca comprehensive recreation system , or a County
comprehensive recreation system . That could take a great deal of
time . Everything will be done to cement what is in place now to
make sure the Town ' s interests are met .
Supervisor Raffensperger mentioned that at the end of last year the
Town Board was interested in proceeding with a system which could
provide a cooperative effort for many years to come with the City .
The development of that kind of a structure would take time , until
then the positive aspects between the municipalities should be
continued .
Mr . Cohen outlined the agreements for this year . Low seasonal
rates at the pool , free playgrounds , freeze on fees , the cost to
the Town was lowered by $ 26 , 000 in 1993 from 1992 , and the fact
that a subcommittee has been created to work on short term issues .

There is a group working on the long term concerns and issues . A
result of the group ' s efforts is the creation of a summary of all
the recreational activities in the greater Ithaca area . The group
is also working on a comprehensive survey about recreation . This
will help to form the basis for the long term decisions .
The survey will be completed very shortly . An individual is
working on the distribution through NYSEG or through the Ithaca
school district .
Councilwoman Valentino said that the NYSEG distribution system
would be wonderful because NYSEG would mail it out with their
billings . The return from that survey should be very good as it
would be very simple for people to return it .
All the other municipalities in the area are participating in the
task force to determine the long range cooperative programs .
Mr . Cohen said that once the survey is complete alternative funding
and administrative structures can be done to determine all
combinations to recommend to the municipalities .
Any municipality who has any part of their population in the Ithaca
School District is part of the task force . They also are trying to
determine if they should go Countywide .
Councilwoman Valentino said it should be looked at as development
of neighborhood with locally based recreational programs and
neighborhood parks . The point would be localized programs .
Mr . Cohen asked for feedback on the types of programs the Board
would like to see in this program , and other comments about the
present programs .
Mayor Benjamin Nichols stated that in the interest of developing
this cooperative agreement each portion should include the
involvement of the Town of Ithaca in the decision making process .
The City is committed to working with the Town . If there are any
questions or concerns it is necessary to hear them as soon as
possible . From discussions with other municipalities there is a
sense that it is highly unlikely that a County program would
develop . It would probably be a program within the Ithaca City
School District area , that is the place where young people relate
to one another .
The Supervisor said that if there could at least be cooperation
within the Ithaca School District progress would have been made .

Supervisor Raffensperger was appreciative that there seems to be a
different kind of attitude for those who have participated in the
program , it is nice there is a feeling of being partners in the
process .
John Wilson stated that the Town of Ithaca ' s contribution entitles
Town residents to pay the same fee for the programs as the City
residents . The program depends on the Town residents to augment
the number of participants for the various sports programs . The
numbers indicate that the City and the Town comprise approximately
90 % of the programs , with 60 % being the Town ' s average .
Mr . Wilson presented the summer brochure to the Board . The
philosophy of the program is that it should be accessible to all .
Programs should be fun and a learning experience . Life serving
programs are emphasized rather than self serving programs .
There is a registration fee for the programs and they are kept as
affordable as possible . The non - resident / resident fee at Cass Park
Pool was kept at the same rate so that it is assessable to all .
How long the City can continue to do that is not known .
Supervisor Raffensperger noticed that even though it does not
directly affect the Town there will be a continuation for one more
year to provide access with a triple fee to children who are not in
the area . The Town is very supportive of that concept .
Agenda Item No . 9 - City of Ithaca Summer Job Programs
The Supervisor explained the Town participated in this program last
year when the Records Management Officer had a young man help with
the Records Management Program . There is no cost to the Town of
Ithaca .
The students would work from July 5 to August 13 for a total of 120
hours . They are young teens and are appropriate for the kind of
work needed in the Records Management area .
The Records Management Officer has requested that the Town Board
authorize two persons to work in the Town Hall under her
supervision on the Records Management Program .
Motion made by Councilwoman Valentino , seconded by Councilman Klein .
approving the participation of the Town of Ithaca in the City of
Ithaca Summer Youth Employment Program for two candidates to work
in the Town Hall under the supervision of the Town Clerk on the
Records Management Program . Carried unanimously .

Agenda Item No . 26 - Highway Fund Expenses Schickel Road
Mr . Walker explained that Schickel Road was acquired by the Town in
the 1960 ' s . The maintenance of the road was limited to the first
few hundred feet . Since that time another house has been built , to
obtain access to that house it would be 350 feet from another
direction . There needs to be approximately . 06 miles of the road
reconstructed . The work entails putting gravel and crushed stone
on the road with an oil treatment .
The Supervisor pointed there is a responsibility to do the work as
it is a Town road .
Motion made by Supervisor Raffensperger approving the agreement for
the expenditure of Highway moneys for Schickel Road as prepared by
the Highway Superintendent . Seconded by Councilman Klein .
Councilman Klein asked that if the Town ever extended water on
Schickel Road would the road be destroyed ?
Mr . Walker said that no , the water would be along the ditch line .
Motion carried unanimously .
Agenda Item No . 27 - Appointment Agriculture Committee Officers
Cristiann Dean , Acting Chair of the Agriculture Committee has
notified the Town Board of the Committee ' s recommendation of
Officers .
Motion made by Councilman Klein appointing the following
individuals as officers of the Agriculture Committee : Christiann
Dean , Chair ; Elsie McMillan , Vice - Chair ; and John Bokaer - Smith ,
Secretary . Seconded by Councilman Whitcomb , carried unanimously .
Agenda Item No . 28 - Coddington Road Community Center Summer
Program
The Supervisor explained this is a program the Town has supported
for a number of years . The Town budgeted total for the Center for
1993 was $ 8400 . 00 , the yearly contract with them allocates $ 5400 ,
leaving $ 3000 for the summer program . The Center has asked that
the Town contribute $ 2260 to the summer program .
The program is very good and is very well run . The children seem
to really enjoy the program .
Motion made by Supervisor Raffensperger authorizing support to the
Coddington Road Community Center Summer Program for a six week
period in the summer at a cost to the Town of $ 2260 . Seconded by
Councilwoman Valentino . Carried unanimously .

Agenda Item No . 29 - Summer Intern Programs
Mr . Walker ,, Town Engineer explained that usually the Town has two
engineering students working for the Town . There is very good
assistance and output from the students . The Town is attempting to
hire the students through the Civitas program although there are
more restrictions on this program than previous ones with Cornell .
One of the students who worked last year has expressed an interest
in returning . If funding cannot be acquired through the Civitas
program there is a budgeted amount of $ 4000 for the summer interns .
Motion made by Councilman Liguori approving the hiring of two
student engineering aides on a temporary basis at a total cost not
to exceed the budgeted $ 4000 charged to account A1440 . 100 .
Seconded by Councilwoman Valentino . Carried unanimously .
Councilman Whitcomb explained that last summer the Conservation
Board utilized a student intern for the Open Space Report . There
are other projects outlined in the Annual Report which could be
done by a :summer intern . There is money within the CB budget for
such a position . The person would work under the supervision of
the Planning Board .
Motion made: by Councilman Whitcomb authorizing the creation and
funding for a summer internship for the Town ' s Conservation Board
not to exceed $ 1600 , or fifty ( 50 ) percent to be paid from account
B8020 . 107 . Seconded by Councilman Liguori . Carried unanimously .
Mr . Forman , Town Planner said that there is some work to be done in
the Planning Department to update some of the departments records .
They are also requesting $ 1600 , with hope for funding from Civitas .
Motion made by the Supervisor authorizing a summer internship for
the Planning Department to assist with ongoing projects . Funding
for the internship will not exceed $ 1600 and shall be paid from
account B8020 . 110 . Seconded by Councilwoman Valentino , carried
unanimously .
Agenda Item No . 30 - Election Districts and Polling Places
The Supervisor stated this has been an enormous project .
Presentations were made to the Board by Tompkins County asking our
recommendations , which they promptly ignored . So the Town now has
the " pleasure " of trying to work out election districts in the
Town . This Is constrained by the fact that the Town has 2 . 5 County
representatives with no leeway within their districts . The Town
also has a very high population for a municipality .

George Frantz , Assistant Town Planner has been working very hard
along with Deputy Town Clerk , Betty Poole on attempting to develop
a reasonable list so that the Town did not have to add a great deal
of election districts .
The Town could have justified at least two more districts but that
has happily been have avoided .
Mr . Frantz explained the work done and the problems in establishing
the districts and polling places to be approved by the Board .
The Supervisor explained the reason it has been become so complex
is that there is no flexibility within districts in the County
election districts .
One of the problems during the Presidential elections is that there
are an enormous amount of registrants who do not vote again for
another three years . The Ithaca College voting population this year
was larger than ever before .
The next time a census is done the County Board of Representatives
will have to do a complete review of the districts .
The districts must be divided by geographical boundaries such as
the middle of the road , a municipal or water boundary .
During the work the Town tried to change districts and where people
voted as little as possible to avoid confusion .
Councilman Whitcomb asked when the districts would have to be
revised again ?
The Supervisor responded presumably not until the next census . If
the Town discovers that it has too many districts with very high
numbers or some districts drop off the Town could change them with
the permission of the County before the census .
Motion made by Supervisor Raffensperger designating the list of the
Election Districts and Polling Places as the official Designated
Polling Places for the year 1993 , and further that all polling
places are in compliance with the law and are accessible to the
handicapped . Seconded by Councilman Klein . Carried unanimously .

Agenda Item No . 14 - Adjourned PUBLIC HEARING , Consideration of
Resolution Authorizing Conveyance of Property Adjacent to the
Frandsen Subdivision in the Town of Ithaca and to Consider the
Change of Status of Town of Ithaca General Purpose Land to Town of
Ithaca Park. Land
The Supervisor sent a memo to each Board member explaining the
Eastern Heights Association had contacted her and requested the
Town Board adjourn the Public Hearing once again so that they can
obtain legal representation . The Supervisor advised the Eastern
Heights Association that no response from the memo came from the
Board members rejecting the readjournment .
The Supervisor opened the adjourned Public Hearing at 7 : 00 p . m . ,
and the Town Clerk had proof of posting and publication .
Motion made by Councilwoman Valentino , seconded by Councilman
Whitcomb readjourning the Public Hearing referenced until June 7 ,
1993 , at 7 : 00 p . m . during the regular meeting of the Town Board .
Councilman Liguori said he did not understand the strategy of what
the Eastern Heights Association was doing .
The Supervisor explained that the Eastern Heights Association wants
legal representation , they question the possibility of the Town
providing compensation to the Quick ' s with land , they would prefer
that tax monies be used as compensation . They expressed the
opinion that. they were not convinced that the Town had any legal
liability . It seems clear to the Town from the legal advice
received that there is no question whatsoever that the Town has a
legal liability . It may be to everyone ' s advantage of outstanding
if the Eastern Heights Association did had counsel who could
discuss the situation with the Town Attorney for clarification . It
is a very complicated issue which has gone on a long time . There
is a lack of understanding for the position the Town is in .
The Supervisor asked for a vote on the motion to readjourn the
Public Hearing . Motion carried unanimously .
Agenda Item No . 31 - Utility Easement Christopher Circle Water Tank
Site
Mr . Walker told the Board that the power supply into the
Christopher Circle pump station and tank site sits in the middle of
the site on an electric pole . The Highway and Engineering
Departments have been clearing the site of brush for use as a chip
storage site , and temporary staging area for work in the northeast .

To better use the site existing guide wires must come down that
hold the electric pole in place . NYSEG has agreed to move that
guide wire outside the work limits , but in order to do that an
extension of the easement is necessary for the existing power

execute an easement with NYSEG for the Christopher Circle Water
Tank Site , and directing the Town Clerk to send to NYSEG the
notarized easement , a certified copy of this resolution , and a copy
of the Town Board minutes empowering the Supervisor to sign the
easement . Seconded by Supervisor Raffensperger . Carried
unanimously .
Agenda Item No . 32 - Records Management Disposition Listing
The Town Clerk explained the list of records that have reached
their disposition dates and are ready to be discarded . The process
is taking much longer than anticipated because each folder must be
looked at page by page . In this batch there were found some
original contracts , easements , and agreements for roadways and
water / sewer items . Even though the boxes have been marked by
previous employees as to what they are some things are not in the
box while other items are .
It will take longer to finish this phase of the program . The
chance cannot be taken that what the box is labeled is the
contents . Each item is marked as a final document and then are
refiled for placement in the vault .
Motion made by Supervisor Raffensperger , seconded by Councilman
Whitcomb authorizing and directing the Records Management Officer
to dispose of the records as described according to the procedure
developed by SARA . Motion carried unanimously .
Councilman Whitcomb thanked the Town Clerk for completing the
Records Management Program so that the Town can finally find
something where it is supposed to be .
Agenda Item No . 36 - Rezoning Request Elmira Road / Seven Mile Drive
Mr . William R . Albern , P . E . addressed the Board and explained that
the current zoning on the property is light industry , commercial ,
R5 , and R30 . The light industry overlaps everything . The request
is that the light industry be filled in along the creek as a
natural buffer between a light industry and an R - 30 . Another
question , but not before this Board this evening , is whether the
Town wants one 8 acre park , or would the Town want three small
parks .

The present zoning makes it very difficult to do anything with the
property . It is basically a break even proposal between what
exists and the change . The significant change would be that the
commercial area would become light industrial . There would be no
additional commercial area on the site . There would be a buffer
for the residential area because you would be changing the
residential area . Now the residential area borders the light
industrial and the commercial area .
Councilman Whitcomb said that he was not sure why the line was
drawn as it was in 1955 , but one reason may be that the people who
lived on Seven Mile Drive were concerned about traffic coming from
the industrial area and spilling onto Seven Mile Drive . That would
be a concern .
Mr . Forman said that it can come out on Elmira Road to Seven Mile
Drive .
Councilman Whitcomb asked where the wetland areas were on the
property .
Mr . Albern showed on the map the location of the wetlands . He
further explained there is a portion owned by the Bank which will
be filled in through a permit .
Town Engineer , Daniel Walker stated he had a request to use that
area for a fill deposit for a water / sewer project . That request
was denied because it was off the project site . The fill for that
would exceed 2500 yards which put it into a Planning Board and
Zoning Board of Appeals approval process . The applicants geologist
is preparing information . It may be appropriate to combine that
fill request with the subdivision process so that the Planning
Board knows the whole picture .
There is a nationwide permit to fill wetlands on the site up to one
acre . The total wetlands are 1 . 3 acres . There are also
considerations in the development of drainage patterns because
there is no outlet . They also need a Town permit to fill and that
has not been granted up to this point .
Councilman Whitcomb asked what time frame the owners of the
property are anticipating ?
Mr . Albern said the owners wished to proceed as soon as possible ,
but that it will be completed in stages . Layout of lots cannot be
determined until the zoning issue is addressed and what kind of
park is desired . It is hoped that work could commence this fall .

Councilman Whitcomb stated that the usual procedure in matters such
as this is for the Town Board to refer the issue to the Planning
Board .
The Supervisor explained that if the Town Board feels the proposal
is something that they may consider it is referred to the Planning
Board for a recommendation . The purpose for it coming to the Town
Board is in case the proposal is so undesirable that they would not
consider it no matter what the Planning Board may recommend .
Motion made by Councilman Whitcomb to refer the rezoning of Parcel
No . 33 - 1 - 1 . 2 to the Town Planning Board for their recommendation
regarding the rezoning request . Seconded by Councilman Liguori .
Carried unanimously .
Councilman Whitcomb commented that he would personally prefer an
eight acre park as opposed to the three small parks .
Agenda Item No 39 - Set Public Hearing for Modification of Allowed
Uses in Special Land Use District No . 4 , 1251 Trumansburg Road
The Supervisor explained the Town Board received two resolutions
from the Planning Board on this matter . The first recommendation
is that the Town Board approve the modification of allowed uses by
inserting a permission for residential apartments with no numerical
limit . The second recommendation which was not adopted would have
recommended catering services . This was defeated on a tie vote of
the Planning Board .
What the Town Board is considering is setting a Public Hearing for
whatever modifications the Town Board wished to consider at a
Public Hearing .
Joseph Ciaschi , owner of the property addressed the Board . Mr .
Ciaschi commented that the apartments passed and the catering
portion was defeated by the Planning Board . Mr . Ciaschi said that
he wished to continue to expound the catering use to the Board as
it was a very good use . The kitchen is beautiful and there is a
dining room . There is an individual who wishes to use the facility
for catering . The reason the Planning Board turned it down is that
they felt it would be inconvenient to the apartments there or
nearby . There is not much of anything nearby .
One Planning Board member asked the other what would be necessary
to have this pass . Even a contract could be drawn showing limited
times , limited catering use .

One particular party interested in using the facility would use it
year round for kitchen purposes . No functions on the premises .
They also do a great deal of weddings , most functions are catered .
Thirty functions a year would be on premise , taking place on a
Saturday or a Sunday during the hours of 4 : 00 p . m . to 8 : 00 p . m . to
10 : 00 p . m . , this would be seasonal , May through October .
This is not a great deal to ask for , an agreement for that use
could even be drawn up by the Town Attorney . Most of the rest of
the use would be offices with four apartments on the fourth floor .
The Planning Board was concerned that the people in the apartments
would not want to have the noise from the weddings such as bands ,
etcetera .
Why waste the kitchen that is there , it would cost approximately
$ 75 , 000 to replace . There is always talk about recycling , recycle
this building . Mr . Ciaschi does not propose to put a catering
service there and push the tenants out .
Supervisor Raffensperger asked if the Planning Board discussed both
the possibility of catering with events taking place on site , and
the possibility of allowing the preparation of foods in the
kitchens and delivered off site .
Attorney Barney said that most of the discussion revolved around
the prospective tenant Mr . Ciaschi has . The tenant has a need for
a liquor license , in order to have one they need a location that
holds at least 50 people . The discussion was that there would be
on premises functions with discussions of limiting the number of
people , and the number of occasions but at least allowing the
catering to occur so that they could get the liquor license . There
was not a lot of discussion about catering for off premises events . .
Mr . Ciaschi said the best scenario would be a compromise of at
least getting a catering kitchen and not having the functions
there , but if they had 30 functions at the location it would mean
they would do 100 to 150 functions elsewhere year round .
The Supervisor asked Mr . Forman about the adjacent land uses , there
was a rezoning for multiple uses ?
Mr . Forman said there is approximately 200 feet between the garage
to those apartments .
The Supervisor asked the Board if they wanted to set a Public
Hearing only for the rezoning that has been recommended by the
Planning Board , or a Public Hearing to consider uses not
recommended by the Planning Board ?

Councilman Klein suggested that the Public Hearing be set for the
uses Mr . Ciaschi has asked for . What he is asking for is not
unreasonable , there are some regulations that will need to be in
place in terms of the operation of the catering . It is difficult
when you have older buildings to find viable uses for them . This
appears to be a viable use , although the Comprehensive Plan has not
been approved by the Planning Board an element in the plan would
allow for flexibility in encouraging adaptive reuse of buildings
that are structurally sound and capable of reuse .
Councilman Liguori asked where the on site catering would be held ?
Mr . Ciaschi said that if the weather was nice it could take place
outside , or the large dining room in the lower level adjacent to
the kitchen .
Motion made by Councilwoman Valentino directing the Town Clerk to
advertise for a Public Hearing to be held on June 7 , at 7 : 30 p . m .
to consider the proposed Modification of Allowed Uses in Special
Land Use District No . 4 , 1251 Trumansburg Road , and that the Public
Hearing include the consideration of said modifications including
residential apartments and permission for catering services .
Seconded by Councilman Klein . Carried unanimously .
The Supervisor explained that this Public Hearing would probably
not be the first on this issue because of the requirements that
would need to be stipulated for the proposed catering services .
Agenda Item No . 11 - Lease / Purchase Agreement Street Sweeper
The Supervisor explained that the Board wished to know the legality
of the Town entering into a lease / purchase agreement for the
purchase of equipment .
Attorney Barney responded that it can be done and is subject to
ordinary bidding requirements and a permissive referendum . You
usually pay double digit interest in these arrangements , it may be
wise to consider some alternative financing such as a bond .
The Supervisor explained that the information received from the
Highway Superintendent states the interest on the lease / purchase is
7 % which seems very low .
Mr . Noteboom said the information given to him by the Highway
Superintendent shows the interest over the life of the contract is
only $ 5800 which seems phenomenal .

The Supervisor explained this has not been done before and the
Board has been cautious in exploring the possibility . It is too
late to do the legal research for determining the Town ' s ability to
buy this sweeper as it is almost time to use the equipment . The
Town will probably have to rent one this year . It is possible the
Board would not like to make a hurried decision about the
lease / purchase agreement , but rent the sweeper and do more
research . The Board may also wish to consider the ability to
include this piece of equipment in the 1994 highway budget .
Councilman Liguori also felt that the Town should be cautious about
these kinds of agreements , and look into doing this over a longer
period - of time .
The Supervisor said that she wished to make sure the Town could buy
out the remaining lease balance at any time without any prepayment
penalty . It was discovered that would be the case . If the Public
Works Committee would follow up more thoroughly on the options
available a decision may be made that is more comfortable to all .
Councilwoman Valentino said that she was not convinced the Town
should buy the street sweeper . She was intrigued when the Highway
Superintendent talked of working out an arrangement with other
municipalities so there would be full utilization of the sweeper .
Councilwoman Valentino asked for information regarding those
possibilities .
Councilman Whitcomb said that whether it is leased or purchased it
is a decision to make once it has been determined whether you need
it at all . Councilman Whitcomb asked to see some sort of break
even analysis as to whether it is cost effective to own it , or to
rent it year to year .
The Supervisor said the material presented by the Highway
Superintendent suggests that it is cost effective to buy the
equipment .
Councilman Whitcomb said that he is not sure he can comprehend all
the numbers as presented .
Supervisor Raffensperger asked if the Town Board wished to refer
this matter to the Public Works Committee for additional
recommendations concerning a different length of lease , and the
possibility of being able to rent it or trade it with other
municipalities .
Councilman Whitcomb said that he wants to make sure the Town can
recoup the costs of this through the Town ' s use or through renting
it to others .

Councilwoman Valentino pointed out that when you rent it out to
other users you have to think of the depreciation on the equipment
and the added maintenance .
The Supervisor asked Mr . Noteboom if he had a consensus from the
Board of the additional information needed , and asked Councilman
Liguori to add this item to the agenda of the Public Works
Committee .
Mr . Noteboom said that he did understand what was needed by the
Board .
Councilman Klein said the key to making this affordable is to
receive a commitment from other municipalities , if that works the
Town will have it for a long period of time to provide service .
The Supervisor stated there is no doubt the Town has seen a need
for more use of a sweeper , especially in the Northeast area of the
Town where there is a requirement for what is called suburban
services . The Supervisor receives many phone calls asking that the
streets be swept , there is a lot of dust on the roads . Each year
there are more requests asking to do a better job in the sweeping .
Agenda Item No . 24 - Capital Improvement Priorities
The Supervisor asked Mr . Walker to explain to the Board what he
wishes them to do in the next month concerning the list of
priorities .
Mr . Walker explained that he has put together a list of possible
public works projects . Priorities have been listed and reviewed by
the Public Works Committee .
Mr . Walker reviewed the listing with the Board , ( see attached ) .
Most of the projects deal with water and sewer . When considering
the Capital Projects other things need to be considered like the
Town Hall and Highway Department facilities which have a shortage
of space , and the need for salt storage . Town parks and recreation
programs have been expanding . There is a temporary office trailer
which has relieved some of the pressure on the water , sewer , and
parks departments but it is not a long term solution .
The water and sewer projects have been listed according to the
evaluation for immediate need due to high maintenance cost ,
capacity problems , pressure problems , and the like .
Mr . Walker asked the Board to review the listing and give him their
recommendations and comments within the next few weeks . After
reviewing the comments Mr . Walker will take them to the Public

Works Committee to reorganize the list into a hard and fast
priority list .
There have been two requests for water and sewer that are
considered low priority in Mr . Walker ' s estimation . Under water
there has been a request for Troy Road which would cost
approximately $ 100 , 000 , and another just received from residents on
Danby Road to extend water service to the Danby Town line .
The Superv : sor asked that Mr . Walker do the initial evaluation as
to the cost of such a project and his recommendation as to priority
for the Dariby Road request .
The Supervisor stated it was important that the Board recognize
these are water and sewer improvement plans . The Town has to
address in the future things like drainage , roads , facility
planning and the capital needs for those projects .
Mrs . Raffen. sperger asked that the list be reviewed to understand
the standards and criteria used to set those priorities , and then
let Mr . Walker know the extent that they do or do not agree with
the specific listing . It is important the Town Board understand
that however desirable , there is a limit as to the Town ' s ability
to finance all projects . Millions of dollars would be needed , a
million dollars in capital improvements costs the Town
approximately $ 110 , 000 per year depending on the size of the
project , the legal costs , and interest rates on the bonds .
Councilman Whitcomb asked at what rate the Town is currently paying
for bonds ? How many bonds are retiring each year , so if there were
an ongoing ;program for capital improvement how much could be done
yearly without an increase in the budget appropriation ?
The Supervisor said that it would vary from year to year . They are
currently 20 year bonds and some of them will be paid off in the
next five years . There is a schedule of payment in the annual
budget .
Councilman Klein asked if the Town has the ability to refinance any
of the bonds if the interest is high compared to the bond market
today ?
The Supervisor responded that some municipalities have been
refinancing . The Town does not have any bonds at tremendously high
interest rages that would make it worthwhile to refinance because
of the cost involved . It takes several months to get in the market
and it is hard to evaluate where interest rates will be at that
time .

Mr . Forman said that the Board may wish to think about the
Coddington Road sewer extension stopping at East King Road instead
of extending to the Community Center , ( from troy Road to East King
Road ) .
Agenda Item No . 33 - Planning Board Agricultural Representative
Motion made by Councilman Whitcomb appointing Mr . James Ainslie ,
245 Hayts Road as the Agricultural Representative on the Planning
Board for a term of office commencing May 10 , 1993 and expiring
December 31 , 19970 Seconded by Councilman Liguori . Carried
unanimously .
The Supervisor asked Councilman Whitcomb and Councilman Liguori who
served on the Interviewing Committee for this appointment to
continue to serve to fill a vacancy forthcoming on the Planning
Board .
Councilman Whitcomb and Councilman Liguori said that they would
continue to serve on the Interviewing Committee .
Agenda Item No . 34 - NYS Department of Transportation Speed
Limits , ( East Shore Drive
The Supervisor said the Town wrote to the NYSDOT because there were
so many requests for speed limit changes . Their response was that
they still are looking at a speed limit reduction on Rt . 96 by the
hospital . That reduction was asked for some time ago , DOT said
that the speed limit of 45 mph as it presently exists was alright ,
it however does not have a 45 mph limit . The Town pointed that out
to them and they will reevaluate that request .
There have also been some questions about no parking signs that
went up on Route 79 , Mr . McConnell was going to evaluate those .
The DOT turned down the lower speed limit for Game Farm Road which
was requested by Cornell , Town of Dryden , and the Town of Ithaca .
A letter was received from DOT concerning East Shore Drive near the
Boynton Middle School . The letter indicates that before DOT will
change the speed limit for a school speed zone there has to be a
marked cross walk , the cross walk has to be supervised and perhaps
have flashing beacons . It is a confusing letter because the Town
has not found anything in the regulations that permit us to mark
that cross walk without DOT permission on a State highway .
This item was brought to the Town Board to ask if the only way to
obtain a reduced speed limit is by having a crossing guard , does
the Town Board wish to pursue this issue .

The Boynton School Principle felt rather dubious about it as they
are middle school students .
The Town will pursue whether or not DOT will permit the Town to do
anything less than the flashing beacons and crossing guards to get
a reduced ;speed limit and a cross walk . These young people need to
be in one place , now they scatter which makes it more dangerous .
Councilman Whitcomb asked what the cost was for employment of a
crossing guard ?
The Supervisor responded approximately $ 2400 . 00 per year for
salary , and with a small additional amount for miscellaneous
expenses .
The Supervisor felt she needed direction from the Town Board about
whether they felt providing a crossing guard for middle school
students was necessary or whether it would be in the interest of
safety to ask for a slightly reduced speed limit and for a cross
walk . It is not the money , but it is very difficult to find
crossing guards . Many organizations within the Town are asked to
help find them on a continual basis .
The Supervisor said that she would contact the DOT and get
clarification of the correspondence .
Agenda Item No . 35 - Stipulation for Cayuga Heights Lawsuit
Attorney Barney explained that the stipulation states the Town
would receive 100 sewer units in exchange for ending the lawsuit
against the Village of Cayuga Heights . The Town is also
undertaking good faith negotiations to see if the '.Down can relieve
Village sewerage use and some of the flow by having a diversion to
the City . It was also agreed to continue the monitoring of the
infiltration and take corrective steps as budgeted in two
locations .
The Supervisor explained that Councilman Liguori was very helpful
in the negotiations with Cayuga Heights and will have part of the
responsibility of beginning the negotiations with SJS to provide
the diversion . The stipulation reflects the direction of the Town
Board in this matter and does relieve the Village of Cayuga Heights
and the Town of Ithaca from the necessity to spend many thousands
of dollars to sue each other with the same taxpayers money . The
Town has already gone through a certain amount of that process but
because of various court decisions the Town is back at the
beginning .

Attorney Barney mentioned that the Village is not looking into the
infiltration in their area , that is the major problem with the
plant , but in effect that is their problem . They are asking that
the Town monitor our own infiltration , which we are doing anyway .
Councilman Klein stated the Town video taped the Northeast sewers
for infiltration and did an engineering study .
The Supervisor said there are Town manholes that have to be worked
on .
The Village focused on the one section of sewer that was not video
taped . There are some manholes between Sapsucker Woods and Salem
Drive that are in a very wet area and the mortar has disintegrated .
They are scheduled for repair this summer .
Motion made by Councilman Liguori approving and agreeing to the
Stipulation Discontinuing Action in the matter of the Town of
Ithaca ( Plaintiff ) , Village of Cayuga Heights ( Defendant ) , and
Rocco Lucenti ( Plaintiff ) . Seconded by Supervisor Raffensperger .
Carried unanimously .
Agenda Item No . 37 - Newsletter
The Supervisor asked the Board members if they had a chance to look
at the proposed Newsletter ?
Councilman Klein asked if there would be a map of the election
districts .
The Supervisor stated one will be made for distribution , but it is
the Board of Elections responsibility to notify each voter of their
district and where they vote .
The Supervisor said there is room for one small item if there were
anything a Board member would like included .
Councilwoman Valentino asked that the fact the playgrounds are
going to be free for Town of Ithaca children , and that the Town was
able to negotiate no increase in fees for the recreation programs
this year be included .
Councilman Klein asked that mention be made under the item for Dog
Enumeration that compensation will be given to the individual
conducting the enumeration .
Councilman Whitcomb said that vacancies on the Conservation Board
should be listed .

Councilman Klein said that under the paving schedule where it does
mention the reconstruction of Judd Falls Road that it should be
mentioned that the Town Board will be reviewing the final plans at
the June meeting .
Supervisor Raffensperger suggested that a summary of the Summer
Youth Employment be given saying there are jobs available .
Agenda Item No . 5 - Report of Tompkins County Board of
Representatives
Representative Livesay reported that the youth consolidation of
services is something that the County Board is very eager to work
on . There is supposed to be some input on the State level for
this , but what will materialize is not known . There was an
initiative this year to ask for funding for consolidation it
sounded very good but only a few municipalities were chosen in the
State . This is a serious issue , the Governor talked about
consolidation and that it is a possibility but may not be the best
option . The County programs that are currently underway are the
Youth Services transportation , and the Human Services funding .
The Supervisor said that she had reported to the Board the Town ' s
saving for the County having taken over those functions . Not just
for the City , but for the Town and Villages also .
Agenda Item No . 38 - Wetlands Policy
Councilman Whitcomb stated that several months ago the Town Board
asked the Conservation Advisory Board to review regulations
involving wetlands and provide some recommendations to the Planning
Board as to how to cope with land that was brought to the Town for
consideration of subdivision or other development if they suspected
some wetlands on the property .
Through many meetings and much work the Conservation Advisory Board
has come forward with the proposed Wetlands Policy . The first nine
pages are a summary of the existing State and Federal regulations
that control wetlands . Candace Cornell did a great deal of work in
researching and summarizing those regulations . In addition
starting on page 9 is the policy and guidelines the Conservation
Board is presenting .
It has been divided into two sections . One for the person who owns
a piece of land and is concerned about wetlands even if they are
not interested in developing at present but who wishes to do a
preapplication consultation . These are the guidelines the Town
would use following such a request .

The second is post application what happens after an applicant
brings in a site plan , what does the Town staff do , and how do they
respond ?
The CAB is recommending that all the maps be used to locate the
soil types . Then visits would be made to proposed sites by staff
or Board members who are knowledgeable on wetlands identification
to verify the accuracy of the application and identify the wetland
and its proximity to the project . They would then communicate with
the Planning Board and the CAB there assessment of wetland
indicators proximity to the best of their ability .
One problem the CAB had was that unless you are a trained Wetlands
Delineator what is your opinion worth . They did not want the Town
to incur any liability by some employee or Board member of the Town
who says yes or no there is a wetland and then find out later they
were wrong . The policy would provide some guidance to the
applicant if there is suspicion of a wetlands that they would have
to contact the appropriate State of Federal agency depending on the
type of wetland involved .
Under B1 the Town Staff would advise the applicant to contact the
Army Corp of Engineers and the DEC to comply with any State and
Federal Wetlands regulations , they can refer back to the summary of
regulations to confer .
The CAB is also recommending that certain key Town staff be trained
in the identification of basic wetlands and that they keep current
with them .
Page 12 , advise local realtors that the Town of Ithaca intends to
abide by the State regulations and that they should tell
prospective buyers to have environmental assessments done on
questionable lands .
For the future , the CAB is recommending that the Town enact a
municipal ordinance of its own under the Home Rule authority .
Right now there is a great deal of confusion that could be
clarified if the Town had its own ordinance as long as it were at
least as restrictive as the State and Federal regulations .
Lastly there is a section that defines all terms used in the
document .
Councilman Klein asked what constitutes the size of wetlands in the
document ?

Councilman Whitcomb said that the Federal guidelines are zero , but
in effect they will grant a permit for anything less than an acre
unless there are extenuating circumstances , the State is 12 . 4
acres . First there was a threshold in the document , thinking that
if it were less than an acre there wasn ' t much point in worrying
about it . In talking with officials at the Army Corp of Engineers
they pointed out some circumstances where a wetland may be part of
an overall larger wetland that they would be concerned about . It
also depends on the type of permit asked for , there are between 34
and 36 nation wide permits . All anyone has to do is telephone the
Army Corp of Engineers and explain the situation that exists and
they will help .
Supervisor Raffensperger recalled that the purpose of the document
was to get the information organized and a system set up to help
people who make applications who have wetlands . The Planning Board
had problems a few times on development of proposals they approved
in good faith and then found out there were wetlands involved . The
Planning Board did not have enough information to tell the
developer who they should go to , what conditions were affected .
The Town Board and the Zoning Board of Appeals should have the
information .
This is an excellent document that has compiled the information as
never before .
Councilman Liguori said the document is actually offering a service
to the owners of land who wish to develop .
Supervisor Raffensperger suggested that it would be sufficient to
say that the Town would provide to local engineers , surveyors ,
etcetera a copy of the Town of Ithaca guidelines under the Public
Information Section .
Councilman Whitcomb said that he would have that part changed .
Councilman Whitcomb said it was up to the Town Board as to whether
they wanted to approve the guidelines , or have the Planning Board
review them . There is a small amount of urgency as the Planning
Board does not know when they may again be faced with an issue
concerning wetlands .
Attorney :Barney said he was puzzled about the section on
" requiremennts of the applicants " , it talks about after receipt of
all necessary permits . On one hand the Town is saying it accepts
it if all the State and Federal permits are obtained , then it says
it has to meet all the State and Federal requirements .

Also , the section about a Wetlands Delineator , if that is a
condition of the Town taking action saying there is no
certification process defined for who is a competent evaluator it
puts someone into a problem situation . They get the permits and
then they would have to hire someone to say it is alright . There
is a problem with the interplay with the processes of the Town
Board and Zoning Board approval .
Councilman Whitcomb asked if the document could be sent to the
Planning Board as is and then have them work on the changes as
discussed ? In the meantime , Councilman Whitcomb will speak to
Candace Cornell about the changes the Town Board has discussed .
Supervisor Raffensperger asked Councilman Whitcomb to report back
to the Conservation Board that the Town Board feels they have done
an excellent job in putting together a summary of these
regulations .
Councilman Liguori asked if approval by the Town Board on this
policy would commit the Town to developing its own regulations ?
The Supervisor responded that is the recommendation of the
Conservation Board , which does not mean it will be done .
Councilman Whitcomb said that the local ordinances he has seen are
actually more simplified because they consider the vagueness of
some of the State and Federal regulations and they address those at
a local level . It depends on how the ordinance is written . A good
ordinance would address the vagueness of the State and Federal
regulations without taking away their authority .
Motion made by Supervisor Raffensperger directing the Town Attorney
and the Town Planner to make the appropriate language changes in
the proposed Wetlands Policy as discussed by the Town Board , and
that after the appropriate language changes the Planning Board
review and make recommendations , and further that the Town Board
congratulates and thanks the Conservation Advisory Board for their
excellent preparation and time consuming efforts in researching the
material contained within the Wetlands Policy . Seconded by
Councilwoman Valentino . Carried unanimously .
Agenda Item No 40 - Records Management Officer Attendance at
Seminar
The Records Management Officer explained there will be a conference
of the New York Association of Local Government Records Officers in
Buffalo on June 6 - 9 . Mrs . Noteboom would like to attend some of
the sessions on Tuesday , June 8 as they are for Disaster
Preparedness and Recovery Plans .

Motion made by Councilwoman Valentino appointing Roberta Komaromi
as part - time Secretary to the Zoning Board of Appeals . Payments

for each set of meeting minutes transcribed therefrom , charged to
account B8010 . 100 . Regular meeting attendance is mandatory .
Benefits are limited to those granted to part - time positions
working less than 20 hours per week . Seconded by Councilman

The Supervisor explained that payments between meetings are
necessary for Bolton Point to avoid interest and penalties on some
monthly billings . The attached resolution allows payments of these
billings for the listed companies as long as they are described on
the next abstract .
Motion made by Supervisor Raffensperger approving the payments
between Town Board meetings for SCLIWC billings as listed as long
as they are included in the next monthly abstract . Seconded by
Councilman Liguori . Carried unanimously .

Subject: Seven Mile Drive Subdivision
Dear Mrs. Raffensperger:
As we have discussed with Floyd Forman , Town Planner, the owners of an 80 acre parcel , tax map 33-3 -
1 . 2, on the east side of Seven Mile Drive wish to subdivide the property for private dwelling units.
Much of the property is zoned R-30 and the owner ' s expect to develop the property within those
parameters . However, at the south end, some of the property is zoned commercial and some is zoned
Light Industrial . On the east side of the property the Light Industrial area extends north of a creek that
could be a natural separation between an R-30 zone and an LI zone. On the west side, the R-30 zone
extends south of the .same creek. Please see attached Sketch A for the Current Zoning .
This is to request that the zoning be changed so that the creek becomes the natural separation between the
R-30 and the LI zones. The areas to be exchanged are of the same magnitude in size. At the same time
a Commercial area that overlaps from the present motels to the property could be restricted to the motels.
Sketch B indicates the Requested Zoning .
Your advice is also requested on another matter with the project. What size park does the Town desire?
The project could include easily include either three small parks or one large park of about 8 acres. If
the Town wishes a large park, it would be most appropriate to locate it immediately north of the creek
if the above zoning is changed. The park would then act as a buffer between the industrial and residential
areas .
Mrs. Raffensperger, the developers need the direction from the Town before they can proceed. They are
prepared to proceed with or without the zoning change and with three small or one large park. What does
the Town wish? Yow- soonest action to allow the developers to proceed will be greatly appreciated.
Except for the period of June 10th to 30th , I am available to answer any questions.

Earl Thomas , representing the Eastern Heights Civic Association ,
contacted me yesterday to request that the Town Board delay the
public hearing , scheduled for May 10 , concerning the conveyance
of property to Frandsen , that conveyance related to the Town ' s
problems with title to Park Lane Extension .
The request was that the Town Board adjourn the public hearing
until June 14, 1993 so that the Eastern Heights group might
obtain legal representation . They wish to pursue at least these
two questions : 1 ) does the Town in fact have a liability in the
matter and 2 ) is the land proposed to be conveyed actually park
land because the Town has posted it as such and allowed its use
for recreation ?
My recommendation is that we adjourn the public hearing until
June and , unless I hear objections from you , will so inform Mr.
Thomas on Monday morning , May 10 so that the Association will
not need to schedule representation at the meeting that evening .

This project list has been developed throughout the past year as an
apparent needs inventory , and is based on specific requests from Town
residents and needs that have been identified by the Engineering
Department . These projects have been prioritized according to the
preceeding criteria ,
PRIORITY MAINTENANCE AND UPGRADE PROJECTS
SEWER
16 West Hill Trunk Sewer $
Provide replacement for existing sewer main from hospital and
Biggs . This sewer is an old clay tile which is a source of
infiltration and does not have adequate capacity to serve _ the
existing facilities on West Hill . Would include provisions
for relieving overloaded Meadow Street sewer in City . Could
be coordinated with proposed Cayuga Cliffs development to
reduce Town cost .

2 . Danby Road Sewer Replacement :
Replacement of portion of existing sewer main from the
monitoring station at the City Line to the manhole which
serves the sewer from Ithaca College . This is an old sewer
line which has capacity problems due to a very flat grade and
infiltration problems .. Has caused sewage spills during wet
weather peak flow conditions .

10 Glenside Road Water Main Replacement :
Replacement and upgrade of existing 4 " cast iron watermain
between the new 12 " main at the upper end of Glenside to the
existing 6 " main on Floral Ave . The area has had many low
pressure and water quality resident complaints ,. and fire flow
is not adequate . This could be accomplished as an add on to
the 1989 W&S contract # 4 as it is in the service area .

2 . East Shore Drive Water Main Replacement :
Replacement and upgrade of existing 6 " Cast Iron Watermain
originally installed as part of McKinney Water District .
Main has high frequency of repairs when operated at full
pressure . Soils are corresive in areas weakening pipe .
Replacement main would be sized to work as a transmission
main to provid BP water to West Hill by gravity .

3 . Trumansburg Road Watermain Replacement :
From the Cliff Street pump station to Lake Side Nursing
Home . This would be a 12 " Watermain to replace the existing
6 " Cast Iron watermain which is the sole source for the West
Hill service area . Installation of this main would complete
the link between the pump station and the Trumansburg Road
Water Tank which was started with the Westhill 12 " main that
runs up Bundy Road ,

16 Trumansburg Road Sewer :
Woolf Lane to Indian Creek , and from Dubois Road to the West
Hill Fire Station . The project will complete a . sewer service

project should be coordinated with construction of the
Tillotz subdivision , and the southern portion should be
coordinated with any development of the Cornell Lands and the
Kyong Parcel . Residents have petitioned the Town Board to
consider this project . Water is available in this area .

26 Westhaven Road Sewer
Sewer service for the north end of Westhaven Road to
Mecklenburg Road to the City Line was requested by resident
petition . The Remainder of Westhaven Road had sewer service
installed in 19870 Residents have requested the service
because most of the septic systems are approaching 20 years
of age which is a normal life expectancy .

16 Trumanburg Road Water Main at Indian Creek
This is approximately 1100 ' of 12 " watermain between Dubois
Road the existing 12 " main just north of the Indian Creek
crossing . It was intended that this main would be installed
by the developers of the proposed Indian Creek Project .
Several residents in this section have requested service , and
completion of this link will allow improved fire flow to the
area . Could be completed as addition to 1989 W&S Contract 4 .

IPDuring the past year much work has been done to forge a new partnership
for recreation services to children and families in our area . This seems a good time
to review what has happened , and to look at short- and long - term plans for the
future . At the Youth Bureau, we want to be sure we have a partnership everyone
feels good about, that we have a chance to hear and discuss your thoughts on
anything new or different we might be doing, and to make any possible changes
early on .
Cathy Valentino has worked with Youth Bureau staff and other inter-
muncipal representatives to put the following changes in place for this contract year:
1 ) Very low seasonal rates at Cass Park pool : residents of the Towns of Ithaca,
Enfield and the city are eligible for season passes at $ 10 for children 12 and under;
$ 15 for students 13- 17; and $20 for adults . ( Daily admission rates are : $ . 75 for 12 and
under; $ 1 . 50 for 13- 17; and $2. for adults . )
2) Free playground programs: access to four different free 6- week morning
playground programs for 5 to 12 year olds, (at Cayuga Heights, Fall Creek, Belle
Sherman and South Hill schools ) .
3 ) Freeze on fees for all recreation programs: all 1993 program fees remain at the
1992 level .
4) 1993 contract its less than in 1992: because of efficiences in staffing, operation and
maintenance, and increased revenues, the 1993 contract was some $26, 000 less than
the previous year .
5 ) Sub-committee established for ongoing planning: a standing committee of the

larger Inter- Municipal Recreation "Task Force will continue to work on details of the
partnership .
Under the leadership of the county planning department, the Inter- Municipal
Recreation Task Force has launched a major initiative towards establishing a long-
range plan for a new system for recreational services for the nine municipalities
served by the Ithaca School District . It has representation from all interested
municipalities . Members have called in experts from the NYS Division of Parks
and Recreation and Ithaca College, and have decided to take a comprehensive
approach . An inventory of all municipal recreation facilities and programs is nearly
complete . With the help of IC Recreation chairman Ronald Havard, an in- depth
survey of residents ' recreation needs and interests is about ready for distribution.
That data will assist the committee as it looks at various models for program
delivery, and financial structures that can support a joint system . The culmination
of the task force 's work will be a recommendation to municipal boards and councils .
In the context of this long- term work that will obviously take the task force
past 1994 budget preparation time, we have discussed the following as possible
elements in a 1994 agreement with the Town of Ithaca ( and any other contracting
municipalities ) :
1 ) Continuation of free playground programs and low seasonal pool passes .
2) Establishment of more neighborhood and locally based recreation programs .
3) Continuation of triple fees for non- contracting municipalities to provide access
for one more year while a new system is developed .
4 ) Ongoing work to contain expenses, keeping contract costs as low as possible
and fees for individual programs accessible.
5 ) Better reporting of cost allocations for programs .
These goals will be reviewed with the Youth Bureau Advisory Committee
and with Common Council ' s Budget and Administration Committee this week, to
insure that key decision makers are involved in every step of the process .
We very much appreciate your continuing to work with the city in our
mutual efforts to provide wholesome, quality programs for our communities .

RE: Planning Department Activity Report.
The following is a synopsis of Planning Department activity for the period April 10,
1993 through May 7, 1993 :
Planning Board
Development Review
The Planning Board held three meetings during this period : April 20, April 27 and
May 4 . The April 20 and 27 meetings were principally devoted to the
Comprehensive Plan . At the May 4 meeting, the Planning Board approved a two
lot subdivision on Enfield Falls Rd . near the Town line . The Planning Board also
made a minor modification to the approved site plan for the South Hill Retail and
Office Complex next to NCR and made a recommendation to the Town Board
concerning a request for rezoning Special Land Use District 4 at the former Mayer
School on Trumansburg Rd . The request for rezoning is on the May Town Board
Agenda to set a public hearing for the proposal .
Comprehensive Plan
Following the three neighborhood meetings , the Planning Board has begun a
review of the Plan . The Planning Board has been focusing on Chapter III, the Goals,
Objectives and Recommended Actions . The Planning Board will also consider the
comments made at each of the three meetings and the letters received, as they make
changes to the Plan they deem appropriate .
During this period, Town officials - met with members of the Cornell Administration
on the Comprehensive Plan . They offered comments on the draft Plan and said
they would follow up with written comments .

Cornell GEIS
Town officials and Town staff attended a conference at Cornell on Generic
Environmental Impact Statements . The conference facilitator was Rosemary
Nichols, Executive Director of the New York Land Institute .
Conservation Advisory Council ( CAC)
Planning staff is assisting the CAC with its recommendation to the Town _Board on a
policy concerning site development or subdivision in any area with potential
wetlands .
Codes and Ordinances Committee ( COO
The COC met on May 5 . The Committee spent most of the meeting discussing a
proposal to allow the Planning Board to waive up to 20 % of the required parking in
Commercial or Light Industrial Districts. The COC also discussed changes recently
made to the Real. Property Maintenance Law.
, Planning Committee
The Planning Committee met on April 28, and discussed the Comprehensive Plan
and the Cornell GEIS.
Agriculture Committee
Planning staff met with the Agriculture Committee on April 22 . The Committee
spent most of the meeting discussing the Comprehensive Plan.
Miscellaneous
Staff continues to work *on construction drawings for the South Hill Trail .
Staff is continuing; to work on revisions to the Town' s election districts .
Contract with Stuart Brown Associates was revised by staff and is being submitted to
the Town Board for approval .

Staff continues to work with the MPO Planning Committee to develop a budget,
work program, and transportation plan for the Policy Committee 's approval .
Staff met with individuals requesting assistance with development projects .
The Department is in the process of interviewing individuals for summer intern
positions and also for Department Secretary. We will be interviewing shortly for
the Planner I position.

'The contractor has started sewer construction on Rte . 13 and
Enfield Falls Road . Wet conditions have slowed construction
Some , but construction is proceeding well .
1993 Capital Improvement Program
The Town Engineer has prepared a list of potential Capital
Improvement Projects which has been reviewed by the Public
Hforks Committee . This list is being distributed to the Town
Board for comments prior to a discussion by the Board at the
June meeting .

Development Review
The Town Engineer has provided development review services
for the following projects :

3 .. Ehrhart Propane Gas .Subdivision And Site Plan Review
Compliance Review and Coordination
Several projects have been approved . for construction and the
Engineering staff has been inspecting work as required .

PUBLIC WORKS
Mapping
The Town of Ithaca Engineering Department is continuing to
coordinate work on documenting and protecting monuments set
for the GPS mapping project for Tompkins County , the City of
Ithaca , NYSEG , and Cornell University . Some of the mapping
products for the City have been delivered and Town Maps are
now scheduled for completion in June of 1993 . Meetings
regarding data format and delivery are ongoing .

Water
One new home is being constructed which is served by the
Schickel Road Water District , and the Town has provided an UV
disinfection unit for that property . The one existing home
in the district was issued a boil water notice pending
installation of a UV unit by the Town . The Town is
continuing to monitor the water quality . Extension of a
watermain to the district is a high priority .
Sewer
The City of Ithaca has bid the Kline Road/Fall Creek siphon
project and an award to Stevers Construction is pending .
Construction is scheduled to start in June with a substantial
completion anticipated for early August .
Mitchell Street Walkway
Completion work has been delayed due to the wet weather
conditions , and the work will be completed as soon as
possible .
Drainage
The heavy snow fall and resulting runoff from snow melt and
Spring rains have resulted in numerous requests for
assistance in correcting localized drainage problems . One
area of particular concern is the Northeast where the flat
topography has resulted is significant areas of standing
water for extended periods of time .
Judd Falls Road Reconstruction
Survey of Judd Falls Road and Forest Home Road has been
completed and plans for the reconstruction are being
prepared . The Town will be working with Cornell University
to coordinate repaving from Forest Home Road to Tower Road .
Cornell will be excavating to repair the underpass for the
Arboretum Road . The Engineering and Highway Departments are
coordinating with the Forest Home Improvement Association to
address resident concerns .
Park Lane
The Town Engineering staff has prepared the maps for the
proposed transfer of Town lands related to the acquisition of
Park Lane ,

HIGHWAY SUPERINTENDENT ' S
REPORT FOR APRIL 1993
April ' s weather was the primary controller of the work done by
the highway department . With melting runoff from heavy late season
snowfall and an exceptional amount of rain , the ditches ran full
for most of the month . On several occasions , there was more water
than they could handle . For that , the highway crews spent the
majority of their time keeping culvert pipes and ditches open
( 303 . 5 hrs . ) , cold patching potholes ( 1225 hrs . ) . fixing shoulder
wash outs ( 24 hrs . ) , and replacing damaged culvert pipes ( 21 . 5
hrs . ) . Because of the heavy amounts of subsurface water , Culver
Road experienced some severe heaving . which required subsurface
drain tile installation to correct . This work required 120 . 5
hours .
The next largest concentration of work was on vehicle
maintenance . One truck broke its rear springs ( 64 hrs . ) . one truck
had the cinder spreader removed and the dump box put on for summer
hauling ( 48 hrs . ) . Various repairs and maintenance required an
additional 111 . 5 hours .
The last snow fall of the season ( I hope ) occurred on April
22nd and 23rd . Snow also fell on the 12th of April . Salting and
plowing for these storms required 178 hours .
The remainder of the time this month was spent attempting to
get started on our summer work and helping other departments with
various tasks . This work included : surveying Judd Falls Road ( 17
hrs . ) . repairing a water service leak on Brandywine Road ( 24 hrs . ) .
placing voting machines for village elections ( 7 . 5 hrs . ) , sign
maintenance and inventory ( 60 . 5 hrs . ) , hauling stone for road
repairs ( 39 . 5 hrs . ) . blading and shaping the upper half of Schickel
Road ( 4 hrs . ) , general clean up in the back yard at the highway
facility ( 10 hrs . ) , and attendance at a " Basics of A Good Road "
seminar given by the Cornell Local Roads Program ( 18 hrs . )
Work in May will concentrate on brush and leaf pickup for the
week of May 3rd. and then move into preparing roads for paving ,
hopefully prior to 1 June . We also hope to get some drainage and
pipe replacement done on Salem Drive . Ridgecrest Road . and
Sapsucker Woods Road . Two people will receive training on
" Hazardous Wastes Disposal and Handling " and the " Right to Know "
requirements .

PARKS AND OPEN SPACE MANAGER ' S REPORT

TOWN BOARD - MAY 109 1993
1 ) A final spring snow storm required 20 man hours to clear the
walks , bikeways and parks .
2 ) Parks staff contributed 40 man hours assisting highway doing
tree trimming work with the City of Ithaca ' s crew at West King
Road , Sandbank Road , and the Honness Lane portion of East Ithaca
Recreation Wall .
3 ) Spring cleanups at all park and trail sites were completed
during April . This effort required 92 man hours in preparation for
the grounds maintenance season beginning in May .
4 ) As the ground began drying out during the last week of April ,
several lawn repairs and tree planting jobs were performed per
Engineering Department work, : orders . Thus far , a total of 22 man
hours have been spent . Numerous other jobs remain to be started
once spring leaf and brush pickup is finished .
5 ) Various routine maintenance tasks , totaling 308 man hours ,
took up the majority of our effort in April .
MAY PARKS PROJECTS :
1 ) Assist with spring leaf and brush pickup May 3 thru 7 ( or
until finished ) .
2 ) Begin lawn mowing rotation at all sites .
3 ) Complete lawn repairs and plantings for Engineering .
4 ) Mitchell Street walkway landscaping .
5 ) Install cookstoves and benches at several park sites .
6 ) Resume South Hill Trail clearing and install drainage pipes as
specified .

Approval of 1993 Summer Youth Employment Program

WHEREAS , the Joint Youth Commission serving the Town of
Ithaca , Village of Lansing and the Village of Cayuga Heights has
reviewed the enclosed proposal to address the needs of youth in the
Town of Ithaca ; and
WHEREAS , the Commission considers providing work experience
and community service opportunities for teenagers an important and
appropriate use of Town funds ; and
WHEREAS , there are 50 % matching funds available from the State
and County to support such programs ; and
WHEREAS , the City of Ithaca Youth Bureau is available to
provide professional planning , employment , and supervision services
under a contract with the Town ; now therefore be it
RESOLVED , upon recommendation of the Joint Youth Commission ,
that the Town of Ithaca appropriate $ 16 , 395 . 50 to contract with the
City of Ithaca to hire up to a total of 14 youth in accordance with
the attached proposal for the Summer of 1993 ; and be it further
RESOLVED , that the Town of Ithaca submit applications to the
State and County for 50 % reimbursement totaling $ 8 , 197 . 75 ; and be
it further
RESOLVED , that the Supervisor be and hereby is authorized to
execute a contract with the City of Ithaca for the approved
services .

Summer Intern for the Town Conservation Advisory Board
Resolution No . 140
WHEREAS , the Town of Ithaca Conservation Advisory Board has
expressed a need for additional support staff to assist with
various ongoing projects related to protection of the natural
environment ; and
WHEREAS , the Town of Ithaca has in the past sponsored various
internships in cooperation with universities and colleges to the
benefit of both ; and
WHEREAS . it is desirous to continue to promote cooperative
ventures between the Town of Ithaca and various educational
institutions ; and
WHEREAS , it is an expressed goal of the Town to promote and
protect the natural environment to the greatest extent practicable ;
now therefore be it
RESOLVED , that the Town Board will create and help fund a
summer internship for the Town ' s Conservation Advisory Board for a
college student in order to assist with ongoing projects . The
Town ' s portion of funding costs for said internship shall not
exceed $ 1600 . 00 or fifty ( 50 ) percent , and shall be paid from

Summer Intern for Planning Department
Resolution No . 141
WHEREAS , the Town of Ithaca Planning Department has a need for
additional support staff to assist with various ongoing projects ;
and
WHEREAS , the Town of Ithaca has in the past sponsored various
internships in cooperation with universities and colleges to the
benefit of both ; and
WHEREAS , it is desirous to continue to promote cooperative
ventures between the Town of Ithaca and various educational
institutions ; now therefore be it
RESOLVED , that the Town Board will create and help fund a
summer internship for the Town ' s Planning Department for a college
student in order to assist with ongoing projects . The Town ' s
portion of funding costs for said internship shall not exceed
$ 1600 . 00 , or fifty ( 50 ) percent and shall be paid from account
B8020 . 110 .

RESOLVED , that the Town Board of the Town of Ithaca does
hereby designate the attached list by Districts of Polling Places ,
as the official Designated Polling Places for the year 1993 ; and be
it further

WHEREAS , New York State Electric and Gas has to complete some
work at the Water Town of Christopher Lane ; and
WHEREAS , the work to be completed by NYSEG requires an
easement from the Town of Ithaca ; and
WHEREAS , the Town Attorney has reviewed and approves the
execution of said easement by the Town of Ithaca ; now therefore be
it
RESOLVED , the Town Board hereby authorizes the Supervisor to
execute said easement with NYSEG ; and be it further
RESOLVED , the Town Clerk is hereby directed to send to NYSEG
the notarized easement , a certified copy of this resolution , and a
copy of the Town Board minutes empowering the Supervisor to sign
said easement .

the attached listing of outdated and duplicate copies of records
are eligible for disposition according to the Records Retention and
Disposition Schedule MU - 1 ; and
WHEREAS , the Supervisor , Town Clerk , and Department Heads have
reviewed and approved disposition of said records ; now therefore be
it
RESOLVED , the Town Board does hereby authorize and direct the
Records Management Officer to dispose of the records as described
in the attached listing according to the procedure developed by
SARA .

Town Board that Mr . James Ainslie of 245 Hayts Road , Ithaca be
appointed as the Agricultural Representative on the Planning Board ;

WHEREAS , the owners of an 80 acre parcel , Tax Map No . 33 - 3 - 1 . 2
on the east: side of Seven Mile Drive wish to subdivide the property
for private dwelling units ; and
WHEREAS , part of the property is zoned R - 30 , and part is zoned
LI ; and
WHEREAS , the owners are requesting that the zoning be changed
so that the creek on the property becomes the natural separation
between the R - 30 and LI zones ; and
WHEREAS , the Town Board has reviewed the proposed rezoning of
said parcel. ; now therefore be it
RESOLVED , that the Town Board does hereby refer the rezoning
of Tax Map No . 33 - 1 - 1 . 2 to the Town of Ithaca Planning Board for
their recommendation concerning said rezoning request .

WHEREAS , the Conservation Advisory Board ( CAB ) has prepared a
Wetlands Policy for the Town of Ithaca ; and
WHEREAS , the CAB has presented the proposed Wetlands Policy to
the Town Board for their approval and adoption ; now therefore be it
RESOLVED , that the Town Board hereby directs the Town
Attorney and Town Planner to make the appropriate language changes
as discussed by the Town Board ; and be it further
RESOLVED , after the appropriate language changes , the Town
Board hereby requests the Town Planning Board review and make
recommendations on the proposed Wetlands Policy ; and be it further
RESOLVED , the Town Board hereby congratulates and thanks the
CAB for their excellent preparation and time consuming efforts in
researching the material contained within the Wetlands Policy .
