HomeMy WebLinkAboutTB Minutes 1992-12-31 Town of Ithaca Town Board Fleeting Minutes December 31 , 1992 At the year end close out meeting of the Town Board of the Town of Ithaca, Tompkins County, New York, held at the Town Hall , 126 East Seneca Street, Ithaca, New York, there were : PRESENT: Shirley A. Raffensperger, Supervisor John Whitcomb, Councilman Catherine Valentino, Councilwoman Karl Niklas , Councilman Frank Liguori , Councilman Patricia Leary, Councilwoman David Klein, Councilman ALSO PRESENT : John Barney, Town Attorney Joan Lent Hamilton, Town Clerk Daniel Walker, P . E . ; Town Engineer Scott McConnell , Highway Superintendent Floyd Forman, Town Planner Sally Alario, Assistant Budget Officer EXCUSED: Andrew Frost, Building/Zoning Officer Pledge of Allegiance : The Supervisor led the assemblage in the Pledge of Allegiance . Call to Order: The meeting was called to order by the Supervisor at 10 : 10 a. m. Agenda Item No . 1 - Report of Town Officials a . Town Supervisor - The Supervisor read a prepared statement, ( see attached) and thanked the Town Board for their cooperation and support during 1992 . The year end reports of the Town Officials will be presented to the Town Board in January. b. Town Engineer - No report. C . Town Highway Superintendent - No report. d. Town Building Inspector/ Zoning Officer - Mr. Frost was on vacation, no report. e . Town Planner - Mr. Forman reported on his written report, see attached. Attorney Barney told the Town Board he appreciated working with the ; , Town Board in 1992 , and thanked them . Town Board Minutes 12/31/92 Pg . 2 Agenda Item No . 2 - Report of Town Committees Councilwoman Valentino reported the Ethics Committee is planning one more meeting to discuss recommendations to the Town Board of individuals to serve on the Ethics Board. Many individuals have come forward requesting appointment. Councilwoman Valentino thanked Councilman Liguori for his help . There were six people the Committee are considering. Recreation in 1993 will be interesting as serious negotiations begin with the City of Ithaca. Councilwoman Valentino will be attending a meeting in January with the City to discuss restructuring of payment for recreational services, including where recreational services may be moved away from the center of the City in order to benefit more children . A meeting has also been scheduled with Ithaca College as they wish to help in the restructuring . The Cable Committee has been working on the negotiations for the new franchise . This should be interesting with the changes in the Federal laws , allowing municipalities who have franchises to again regulate rates , etcetera. Councilman Niklas stated Codes and Ordinances had a productive meeting on December 15 with the Town Planning Board . The COC received constructive suggestions that the Committee will be working on. Councilman Niklas thanked John Barney, Floyd Forman , John Czamanske , Andrew Frost, Catherine Valentino, Eva Hoffman, Harrison Rue , Pete Scala, and Candace Cornell for their continued and diligent work with and on the COC . Councilman Niklas also thanked the Town Board for receiving recommendations from the COC with open minds . Councilman Klein reported the Comprehensive Planning Committee looked at the final Draft Comprehensive Plan. It will be ready in January to pass along to the Planning Board. There may be an addendum to it concerning slightly different viewpoints . Councilman Klein requested that the Town Board formalize the extension of the Comprehensive Planning Committee through the end of February 28 , 1993 . Motion made by Councilman Klein authorizing the continuation of the Comprehensive Planning Committee with the Chairman and members as now appointed through February 28, 1993. Seconded by Councilman Niklas, motion carried unanimously. Town Board Minutes 12/31/92 Pg. 3 Agenda Item No . 2 - Cont ' d Councilman Klein thanked the Planning Staff for all their hard work with the Committee on the Comprehensive Plan. Councilman Whitcomb presented a written report on the Conservation Advisory Council , see attached . The report includes the Council ' s 1993 Priorities Work/Plan. The Automated Data Processing Committee met to review the offer from IBM relative to the termination of the System 36 lease . IBM would allow the Town to buy out of the lease for $3000 less than it would cost to pay the lease off. The Town could pay off the lease for $25 ,000, or buy it outright for $22 , 000 and IBM would take the equipment back. The ADP Committee recommends that the Town not take this offer. The IBM would let the Town keep the System 36 and the $3000 could be used for training or whatever else we wanted . The ADP Committee feels there is a use for the System 36 in wordprocessing and possibility the Records Management Program . Councilman Whitcomb is preparing another letter to the Vice President of IBM showing the Town ' s dissatisfaction with their offer. Agenda Item No. 3 - Report of Tompkins County Board of Representatives No members of the Tompkins County Board of Representatives were present. Councilwoman Valentino voiced concern that there are three representatives on the Board from the Town of Ithaca and it has been sometime since they have attended the Town Board meeting . The continuity between the County, Town, and City is not being maintained . Supervisor Raffensperger stated that various members of the County Board of Representatives have contacted her to express their regret in not attending the Town Board meetings . In the last several months the County Board of Representatives has been extremely busy with crucial issues . Councilwoman Valentino felt that since the County did have a very busy year it is very important that the Representatives attend the meetings as many of the issues directly affect the Town of Ithaca and the decisions made by the Town Board . Town Board Minutes 12/31/92 pg . 4 Agenda Item No . 3 - Cont ' d Councilman Niklas mentioned that it could be possible for each Board member to communicate with the representatives if the information needed was an explanation of what has taken place . Councilman Niklas agreed with Councilwoman Valentino that it would be helpful to have them attend the meetings. Councilman Klein felt that if the Representatives carne on a regular basis it would give the opportunity to have a sense of what is going on . The Supervisor will write a letter to each of the Town of Ithaca ' s County Representatives inviting them to attend the Ithaca Town Board meetings , along with a schedule of the meetings . Agenda Item No . 4 - Official Newspaper Motion made by Councilman Niklas, seconded by Councilman Klein designating the Ithaca Journal as the official newspaper of the Town of Ithaca for 1993 . Carried unanimously. Agenda Item No . 5 - Depository of Town Funds Motion made by Supervisor Raffensperger, seconded by Councilman Liguori designating Tompkins County Trust Company as the official depository for the Town of Ithaca for 1993 . Carried unanimously. Agenda Item No . 6 - Official Bonds Motion made by Councilman Whitcomb approving the Town Officials and Town Employees bonds in the amounts indicated on the attached resolution . Seconded by Councilwoman Valentino, carried unanimously. Agenda Item No. 7 - 1993 Town Board Meetings Schedule The Supervisor explained there is a 1994 Reorganizational Meeting scheduled. It was included as there will be elections for Supervisor and Town Board members in November. New York State Audit and Control recommends when there is an election, there be an early January meeting for reorganization for appointments to various boards by the new Town Board, as opposed to the outgoing members . Motion made by Councilwoman Valentino approving the prepared scheduled meetings of thc.! Town Board for the year 1993 . Seconded by Councilman Niklas . Carried unanimously. Town Hoard Mil,ute5 12!31/92 Pg . 5 Acenda Item No . 8 - _ Appointments to Southern Cayuga Lake Int.eriunicipal Water Commission motion made by Councilman Whitcomb appointing Shirley Raffensperger and Lawrence Eabbroni as Town of Ithaca representatives to the Southern Cayuga Lake Intermunicipal Water Commission- Seconded by Councilman Niklas. Carried unanimously. Agenda Item No . 9 - Appointments Conservation Advisory Council Motion made by Councilman Whitcomb adopting the prepared resolution appointing Candace Cornell as Chairperson, Phillip Zarriello as Vice Chairperson, and Celia Bowers ; Candace Cornell ; Richard Couture , acid Eva Hoffman to the Conservation Advisory Council for two yaar terms to begin January 1 , 1593 . Seconded by Councilwoman Valentino . Carried unanimously. Agenda Item_ No . 11 - Chair Board of Zoning Appeals The Town Board received a recommendation from the Board of Zoning Appeals that Edward Austen be appointed to serve as Chairman of the Zoning Hoard of Appeals for the year 1993. Motion made by Councilman Niklas approving the recommendation and appointing Edward Austen as recommended by the Planning Board as Chair of the Zoning Board of Appeals for the year 1993 . Seconded by Councilman Liguori . Carried unanimously, Motion made by Supervisor Raffensperger approving the recommendation of the Zoning Hoard of Appeals that Robert mines be .re-appointed to the Zoning Hoard of Appeals with a term of office from January 1 , 1593 to December 31 , 1998 . Seconded by Councilman Niklas . Carried unanimously. Agenda Item No . 10 - CAC ' s Lead Paint Notice Councilman Whitcomb explained that the Conservation Advisory Council has not expended all of its budgeted funds for 1992 , The City of Ithaca some time ago printed a lead paint brochure and placed them in all the paint stores in the City and the Town of Ithaca for � esidents to pick up and learn tips about lead Lased paint.. The City would like to conduct a second printing and felt that since many Town residents also use the brochure that another 10 ,000 be printed with the help of the Town of Ithaca . Councilman Niklas approved of the Town ' s participation but zequested on the front page and the last printed page the Town receive credit for being a participant . Town Board Minutes 12131192 Pg . 6 Agenda Item No . 10 - Cont ' d Attorney Barney asked if it has been reviewed for i.ts content, and if the CAC is comfortable with the brochure . The Board requested time to review the brochure during the meeting. After review of the brochure Councilman Hiklas made a motion approving the Town of Ithaca ' s participation in the development and distribution of said pamphlet with the following conditions: 1 . The Town of Ithaca ' s financial participation shall not exceed 5300 . 00 . 2. The Town of Ithaca shall be added to the section of the pamphlet stating disclaimers . 3 . The section stating the stores available for information and purchase of non-lead paint shall not be limited to any specific store . Motion seconded by Councilwoman Valentino . Carried unanimously. Agenda Item No . 12 - Chai_ - Planning _Board_ Motion made by Councilman Klein appointing Carolyn Grlgorov as Chairperson of the Planning Board for the year 1993 . Seconded by Councilman Niklas . Agenda Item No . 14 - Town Justice ]Reports and Dockets Motion made by Councilman Liguori approving the Town Justice Report and Rockets of Justice W aj:ran Blye for the year 1992 . Seconded by Councilman Niklas. Town Board Minutes 12/31/92 Pg. 7 Agenda Item No . 15 - Representative Tompkins County Youth Bureau Deleted . Agenda Item No . 15 - Government Access Channel Cable Television Representative The Supervisor explained there is a Committee of Government Access Channel Cable Television and the Town of Ithaca has the right to appoint a member to that. There has never been a representative to the Town on this committee . Pauline Layton serves as a Public Access Producer is a resident of the Town and has written and asked to be appointed to the committee by the Town Board as the Town ' s representative . Motion made by Shirley Raffensperger appointing Pauline Layton as the Town of Ithaca' s voting representative on the Public Access Volunteer Committee . Seconded by Councilwoman Leary. Carried unanimously. Agenda Item No . 16 - Computer Service Contracts The Town Engineer explained that the Automated Data Processing Committee reviewed the service contracts for the Town ' s computer equipment for frequency of maintenance . The service contracts are costing approximately $4000 . 00 per year. The ADP committee could only find two repair calls in 1992 at a cost of approximately $300. 00 . The service contracts do not include routine cleaning, etcetera; just repairs . The ADP Committee is recommending that the budgeted amount in the line item be left and that the service contracts be terminated . The budgeted amount would cover most repairs needed within a year' s time . A review of the amount for computer repair will be completed in June to determine if it is necessary to reinstate the service contracts . Motion made by Councilman Niklas authorizing the discontinuance of the service contracts on the Town ' s computers as recommended by the ADP Committee . Seconded by Councilman Liguori . Carried unanimously. Agenda Item No . 17 - Town Board Meeting Minutes 12/7/92 Motion made by Councilman Niklas approving and adopting the December 7 , 1992 Town Board Meeting Minutes as the official minutes for said date with no amendments. Seconded by Councilman Liguori . Carried unanimously. Town Hoard Minutes 12131 /92 Pg . 8 Agenda Item No . 1B - Approval Curb Side Christmas Tree Pick Up The Highway Superintendent reported that the Town has not previously picked up discarded Christmas trees after the holidays and they end up in ditches , culverts , and on the roads . Many residents have no way of disposing of the trees properly. The Parks Iepartment has suggested it {could be in the Town ' s best interest , and a benefilt, to residents if a Christmas tree pick up day were scheduled . The Parks Department has volunteered their staff to accomplish this , Mr. 14CConnell pointed out this would be an added service to the residents of the Town . The trees would be chopped into chinas which would he available to the Town residents at the Highway garage . An advertisement has beers prepared informing the residents of the pick up . Councilman Viklas suggested advertising the trees should be bare of any ornamentation , or wires . Hotion made by Councilwoman Valentino approving January 11 , 1993 as the date for roadside collection of Christmas trees by the Town ' s Highway and Parks crews, and that an advertisement he place in the Ithaca Journal on January 4 and January 9 , 1993 notifying the residents of the pick up . Seconded by Councilman Hiklas . Carried unanimously. Agenda Item No , 19 - Budget Amendments Sally Alario explained the first budget amendment is for every fund and reflects the normal year end amendments for accounts which have surpassed their budgets. Motion made by Councilman Liguori approving the budget amendments as presented by the As&istant Budget. Officer. ( See a,t,tached) . Seconded by Councilman Niklas , carried unanimously. The second amendment is a transfer Concerning Cornell, GEIS . The amendment increases both lines, revenues and expenditures items . Motion made by Supervisor Raffensperger approving said budget amendment. Seconded by Councilman Niklas . Carried unanimously. The third amendment iE for the Highway Department to take advantage of a discount on the purchase of a computer . Motion made by Councilwoman! ValeDtino authorizing the budget amendment , Seconded by Councilman Klein . Carried unanimously. Town Board Ainutes 12 /31 /92 Pg . 9 Agenda Item No . 20 - 1993 Insurance Proposal Councilman Klein asked it bids are requested on the Cost of the coverage for the Town each year. Sally Alaria explained that a Request for Proposal was done ,last year . Another will be done in 1994 . Periodically we Solicit bids from other` insurance agencies . The proposal is only a 4 . 5% increase over what was actually expended in 1992. Attorney Ba,rMley told the Town Board there is an advantage with the Town having a continued relationship with only one agency in terms of continuity regarding claims. It is not a relationship that should supex7sede reasonable cost, and that is why the Town periodically asks for bids from several agencies . MQrJon made by Councilman Liguori ratifying the insurance costs and coverage submitted by Becker Wells Agency, Incorporated as per the attached correspondence . Seconded by Councilman Niklas . Carried unanimously . Agenda Item No . 21 - Resolutions of Appreciation Motion made by Councilwoman Valentino expressing appreciation to James L. Baker fox: his exemplary and valuable service to the Town of Ithaca and the community as a member of the Town of Ithaca, Planning Board since January 18 , 1977 . Seconded by Councilman Klein . Carried unanimously. Motion made by Councilman Niklas expressing appreciation to Joan Reuning for her distinguished , impartial and highly competent service to the Town and community as a member of the Town of Ithaca Zoning Board of Appeals from January 1978 until her resignation in 1992 . Seconded by Councilman Liguori . Carried unanimously. Agenda Item No . 22 - Aepoointment Deputy Town Clerk/Receptionist Motion made by Supervisor R affensperger and seconded by Councilwoman Valentino appointing Sharon hewi$ as regular full-tame Deputy Town Clerk at a salary of $6 , 50 per tour . Carried unanimously. The Town Attorney administered the Oath of Office to Ms . Lewis . Agenda Item No . 23 - Re-appointment and Administration of Oaths of Office Motion made by Councilman Niklas and seconded by Councilwoman Valentino reappointing Joan Lent. Hamilton as Town Clerk, Receiver Town Board Minutes 12/31/92 Pg. 10 Agenda Item No. 23 - Cont ' d of Taxes; Betty F . Poole, Deputy Town Clerk/Deputy Receiver of Taxes ; Scott McConnell , Highway Superintendent; Fred Noteboom, Deputy Highway Superintendent; and Daniel Walker, P . E. , Town Engineer. Seconded by Councilman Niklas, carried unanimously. Attorney Barney noted each individual must take the Oath of Office within thirty days. The Oaths will be given at the annual luncheon to be held today. Agenda Item No . 24 - Town of Ithaca Warrants Motion made by Councilman Niklas approving the Town of Ithaca warrants for payment. Seconded by Councilman Liguori . Carried unanimously. Agenda Item Additional - Frandsen Agreement Attorney Barney explained that during the construction of a road on Park Lane Extension the easement area that was extensively given the Town was exceeded . This has created discussions between the owner of the land, Mrs. Quick; the developer, Mr. Frandsen; and the Town of Ithaca. An agreement has finally been reached which provides that instead of the Town paying monetary compensation to Mrs . Quick for exceeding the easement, the Town will provide to Mr . Frandsen some lands off the end of Brian Drive , then Mr. Frandsen will provide lands to Mrs . Quick which adjoin her property. The Town now has an agreement with Mr. Frandsen , authority is now needed for the Town Supervisor to enter into the agreement on behalf of the Town . There are a number of contingencies in terms of the Town surrendering the land, for which a Public Hearing will have to be held . The agreement is contingent upon the Town Board going through the necessary process and obtaining the necessary approvals to carry out the Towns portion of the agreement. If the Town is unable to obtain those approvals , the monetary settlement issue would be addressed. Supervisor Raffensperger stated she was made aware of this situation in 1990. It has been discussed in Executive Session as it was possible litigation, the Town Board during Executive Session authorized the Supervisor to proceed to negotiate a settlement. Fawn Board Minutes 12/31 !92 Pg. 11 Agenda Item Additional - Cont ' d The Supervisor explained that the Town has some general purpose land next to land that Mr. Frandsen owns . Mr. Frandsen would receive that land in exchange for giving land to the Quick ' s which is adjacent to their property . This enables the Town to provide compensation to the Quick ' s for the land that was taken . The other choice is monetary . The Town has two resources , the tax lever and general purpose land. The proposed Town land is not park land, and consists of four lots . Motion made by Councilman Niklas authorizing the Town Supervisor to execute the agreement in substantially the form presented to the 'own Board by the Town Attorney. Seconded by Councilwoman Valentino . Carried unanimously. Councilman Niklas congratulated the Town Supervisor and the Town Attorney for negotiating this arrangement without expense in terms of dollars and cents to the taxVayers of the Town . The Supervisor is hoping this will resolve the problem, as the Town has been unable to open the road because of this matter, The Quick ' s are due Borne compensation for what happened . This is a reasonable resolution, to the problem . If the public comes to the Public Hearing and are very much opposed to the agreement, the Town Board will teen have to decide . The people have to understand that the Town has limited resources to resolve this matter, either the land or tax monies . Superintendent Mr-Connell pointed out that even with this land transfer there is still Vark land and general purpose land that separates it from the Town of Dryden, this land would be subject to approval before Connection with any development . Councilwoman Valentino stated that some residents in the area are concerned with the Perigrine Development in the Town of Dryden which borders this land creating a problem with the access road . The Supervisor staters stye feels this will not occur as there is land between as Mr. McConnell, has explained . Agenda Item - Additional - Executive Session Motion made by Supervisor Raffensperger that the Town Board move into executive session to discuss personnel matters , and possible property acquisition . Seconded by Councilman Liguori . Carried unanimously. Moved into executive session at 11 : 14 a . m. i Notion made by Councilman Niklas to return to open session, seconded by Councilman Liguori .
