Town Board Meeting Minutes
October 5, 1992
At a regular meeting of the Town Board of the Town of Ithaca,
Tompkins County, New York, held at the Town Hall , 126 East Seneca
Street, Ithaca, New York, there were :

Pledge of Allegiance : The Supervisor led the assemblage in the
Pledge of Allegiance .
Call to Order: Meeting was called to order at 5 : 35 p . m.
The Supervisor reported there are two additions to the agenda.
One to consider a reduction in speed limit on Game Farm Road, and
a petition received from residents requesting street lights be
installed on Judd Falls Road from Route 366 to East Hill Plaza; and
on Maple Avenue from Maplewood to Judd Falls Road . The Town
Engineer will respond to these residents outlining the requirements
for a petition.
Agenda Item No . 3 - Report of Town Officials
Town Building Inspector/Zoning Officer' s Report: (Copy attached ) .
A financial report was included and one will be presented to the
Board on a quarterly basis . The Building Inspector explained the
various fees collected . Hotels, motels, and apartment complexes
must now obtain operating permits by January 1993. Applications
for these permits have recently been sent out.

Town Planner ' s Report: On September 29 , the Comprehensive Planning
Committee held an informational meeting . The Planning Board has
been spending a great deal of time with Hospicare . Staff attended
the American Planning Association ' s Upstate New York Fall
Conference .
Highway Superintendent ' s Report: (Copy attached ) . The Parks did
mowing and tree/brushing cutting. Completed the South Hill Trail
chipping, and shimming and preparation work on Honness Lane
Recreationway to prepare it for oil and stone . Mitchell Street
Walkway is scheduled for October. Fall planning includes lawn
repairs , wood chipping, and furniture staining.
The Highway Department worked on paving and placing shoulders on
newly paved roads. Mitchell Street sidewalk base has been
installed from the City line to the caretakers house in front of
the cemetery. The sidewalk should be completed by early November.
Brush pick up starts October 13, and the first two weeks in
November will be leaf pick-up.
The State contract price for salt this year is $20. 28 per ton
delivered to the Highway Barns, two years ago the price picked up
was $32 . 00 per ton. The difference is based on the Town purchasing
salt through the State contract.
Research has been done on the price of putting vinyl decals with
the Town logo on the doors of the Town vehicles. The
Superintendent explained the prices and options to the Board.
The Town Board approved the design of the new decals for the Town
vehicles . Motion made by Councilman Klein authorizing the purchase
of thirty decals for the town vehicles at a cost not to exceed
$500. 00, subject to the final approval of the Public Works
Committee . Seconded by Councilman Liguori . Carried unanimously.
Town Engineer ' s Report: ( Copy attached ) .
Chase Farm will need follow up review for the final site plan
approval . There are some old water pressure situations that need
to be addressed .
Councilman Klein stated that Jane Scharfik was very unhappy with
the repairs to her property, she indicated they had not heard from
the Town in a long time . Councilman Klein further stated this was
contrary to what had been heard at the Public Works meeting .
Mr. Walker had not known that there was anything left to be done
except for the planting of some trees this year . Mr. Walker

recently received a letter from Mrs . Scharfrik and is responding to
her complaints . Councilwoman Valentino asked about the fill being
placed on Maple Avenue . Fir. Walker explained this fill is from the
Judd Falls Road reconstruction project and will be graded off by
the end of the week and seeded .
Agenda Item No. 4 - Report of Town Committees
Councilman Klein reported that on September 29 there was an
informational meeting on Chapters 4 , 5 , & 6 of the Comprehensive
Plan. The Committee members listened to public comment rather than
addressing any specific concerns . Approximately fifty people
attended, along with the majority of the Planning Board, and good
representation of the Town Board.
The CPC meets next Tuesday, and will review the comments received
and address any modifications based on those comments .
Councilman Liguori reported a slight change of policy concerning
the use of salt on roads during the winter. At the Public Works
Committee meeting the Highway Superintendent reported he had
attended a school at Cornell and that a report given at the school
showed the use of pure salt as opposed to using a mixture of salt
and grit shows the same results in terms of removing ice and snow.
The Highway Superintendent requested permission to a trial whereby
half of the material this year would be pure salt, and half salt
with grit. He would compile information and give a report to the
Board on the results of what the savings might be .
Councilman Whitcomb asked if there were any differences in safety
while waiting for the snow and ice to melt, the grit may give more
traction than plain salt.
Mr. McConnell responded that safety was one of things they are
unsure about. Some reports state that the abrasive qualities of
salt itself should not be ignored.
The intent is to take the grit out of the salt so that the trucks
can go farther on the same truckload, and the cost per mile would
decrease . There will not be any additional amounts of salt used.
The trial would not be continued if it was found to not be working .
Councilman Whitcomb feels it is worth a trial , but suggested it not
be tried on the most dangerous roads .

The trial would be accomplished by rotating the trucks , doing
certain route one way one month, and at the same time the other
way. We are now running three cinder routes and four plow routes .
It could be broken down to thirds or one isolated route, then
switch it and keep track of the usage .
Attorney Barney pointed out that if it is not a recognized safety
arrangement a smaller area be used until we are satisfied there is
no problem with safety.
The Highway Superintendent said the smallest trial area would be a
third. The County and State Highway Departments use just salt .
The trial will be done this winter, if it is found that pure salt
is not working there will be a return to the normal combinations .
Councilwoman Valentino reported the negotiations are continuing
with the American Community Cablevision for the new franchise .
Groton is also in the process of negotiations . Problems and
concerns were discussed, as well as the length of the contract, and
extensions for service to areas not presently receiving cable . No
further meetings have been scheduled until the contract with Groton
is completed.
Councilwoman Valentino has also been meeting with individuals in
the City concerning the recreation contract. The Supervisor and
Councilwoman Valentino attended a meeting which they thought would
be a meeting to discuss the costs the Town of Ithaca may wish to
exclude . It was their indication that the City may react favorably
to leaving out the costs of the Cass Park facility in the new
contract. However, that was not the case and the City was locked
into the numbers with the Town participating in all the programs .
The 1993 Town Budget reflects the number the City is requesting.
It was clearly pointed out to the City that the Town of Ithaca is
not interested in having this kind of arrangement with the City
next year when the Town has no say. The City' s fees keep
increasing every year to the children, and some of the fees are out
of the price range of many families in the Town. We are getting
complaints from families that the prices are too high . The end
result will be the Committee , City of Ithaca, Town of Ithaca, and
other interested municipalities looking into a new structure of how
recreation services will be dealt with in 1994 . This would involve
a partnership with the City with intensive negotiations concerning
the costs, such as debt service .

The Youth Commission met with the Village of Lansing. The Village
passed two resolutions. The first resolution related to the
restructuring with the possibility the Town of Ithaca providing
their own youth programs. The other resolution dealt with the
proposed Community Center located in the Village of Lansing.
Councilman Whitcomb reported the Automated Data Processing
Committee has been reviewing the computer situation in the Town
Hall . The major problem is the System 36 . IBM has not been
cooperative in trying to help make that system work for us, or to
trade it for equipment which would more adequately meet our needs .
The staff has developed an interim plan which will meet our needs
until the System 36 lease is completed.
Councilman Whitcomb requested assistance from the staff, and
permission of the Town Board to chronicle the series of events that
have occurred since April 1986 when the System 36 went on line .
Then he would correspond with the President of IBM and seek his
help in this matter. The computer industry as a whole is anxious
for business, and someone at the head of a corporation, if they
were aware of the treatment we have received would not respond to
that.
The Town Board agreed attempting this form of communication with
IBM was worth the effort.
Mr. Walker explained that IBM representatives came to the Town Hall
and attempted to show what the System 36 software would do. The
Staff was not convinced it would accomplish what the Town needs.
IBA! intimated we could trade our lease for other equipment. IBM
did submit prices for Personal Computers. The retirement of the
lease on the System 36 would cost $20,000 at once or to finish the
lease . Even with the return of the System 36 to IBM the Town would
still owe the money on the lease .

Agenda Item No . 6 - PERSONS TO BE HEARD

Agenda Item No . 14 - NY Planning and Zoning Institute Conference
Mr. Forman reported the referenced conference is being held on
November 8 - 11 , 1992 in Niagara Falls . The Planning Department is
requesting the attendance of three persons for three days at a cost

not to exceed $2000, and that the Town Attorney be able to attend
as a registrant of the Town at his own expense .
Motion made by Councilwoman Valentino approving the attendance of
employees from the Planning Department, Planning Board, and the
Town Attorney at the said conference as described by the Town
Planner at a cost not to exceed $2000 . 00. Seconded by Councilman
Whitcomb. Carried unanimously.
Councilman Whitcomb asked if these costs were the same as the past
and if these would be new Planning Board members attending. Mr.
Foreman responded that the prices are comparable to the past and
that two new Planning Board members have expressed an interest in
attending .
Agenda Item No . 15 - DeWitt Middle School Crossing Guard
The Supervisor explained at last months meeting we were in a
transition stage of hiring a new crossing guard for the DeWitt
Middle School . Janice Smith has started work and is doing a good
job. The prepared resolution is asking for the ratification of the
appointment of Mrs . Smith to this position.
Motion made by Supervisor Raffensperger ratifying the appointment
of Janice Smith as the DeWitt Middle School Crossing Guard as
outlined in the attached resolution. Seconded by Councilman Klein.
Carried unanimously.
Agenda Item No. 16 . - Town Hall Telephone System
The Supervisor told the Board there has been discussion about
reorganization of the telephone system in the Town Hall . There
have been some small things accomplished on the roll over of the
telephone system. Some alternatives have been discussed, including
creating another line to the Zoning Department and the roll over
only of two lines in planning and zoning. The need for having
answering machines on these phones has been reviewed . During these
discussions the 1993 Budget was reviewed to see if the funds for
this could be used in another way.
In the 1993 Budget there is a half-time position for a secretary
for the Engineering Department which is badly needed, and also some
contractual time for assistance with the budget and tax collection
as we have had for some years.
The Supervisor suggested that the Town hire a Deputy Town Clerk as
a receptionist to answer all of the phones in the Town Hall . The

estimate of the average number of calls received is 120 a day.
Presently everyone answers the phones and are interrupted in their
work. An entry level receptionist could be hired to answer phones
relieving the secretarial staff who have other skills to do their
other work. For the same amount of money as the additional
secretarial position for Engineering in the budget, and the cost of
new telephone lines this could be done to create a more efficient
system.
Space is a problem, however Pat Punger, Personnel Manager has
stated she would not mind being moved to the upstairs office to
accommodate the space needs .
All staff would know that they would have to inform the
receptionist of their whereabouts , such as when they were out of
the building and expected to return .
The system we are using now had a separate line to the Zoning
Department which is not working, if you get a busy signal it rolls
to another line . This system presently adds to the fragmentation
of the workday.
The telephones would have to be reset to ring to the receptionist,
and the need for answering machines would still be there .
In general the idea will be for one person to answer the phones,
other staff will still be obliged to answer the phones from time to
time when the receptionist is on another line .
The Town Board authorized the Supervisor and staff to continue to
pursue the hiring of a Deputy Town Clerk Receptionist and the
necessary phone equipment.
Agenda Item No . 17 - Deputy Town Clerk/Deputy Receiver of Taxes Job
Title and Description
A recommendation has been made by the Personnel Committee to change
the title and job description of Betty Poole, Deputy Town Clerk.
Mrs . Poole is very much involved in the tax collection. The Town
Clerk feels there is a need for the change in title and job
description.
Motion made by Councilman Whitcomb supporting the recommendation of
the Personnel Committee that the Deputy Town Clerk job title and
description be changed as outlined in the attached resolution and

job title and description. Seconded by Councilwoman Valentino.
Carried unanimously.
Agenda Item No . 18 - Administrative Secretary to the Planning,
Engineering, and Zoning Departments Title and Description
A recommendation has been made by the Personnel Committee to change
the title and job description of the referenced position title .
The retirement of Nancy Fuller in December creates a need to change
some of the descriptions of this position.
Motion made by Supervisor Raffensperger supporting the
recommendation of the Personnel Committee that the job title and
description of the Administrative Secretary to the Planning,
Engineering, and Zoning Departments be changed as outlined in the
attached resolution and job title and description . Seconded by
Councilman Liguori . Carried unanimously.
Agenda Item No . 19 & 20 - Readoption and SEAR of Local Law No. 19
of 1992
The Supervisor presented the staff recommendation of a negative
determination of environmental significance for Local Law No . 19 of
1992 . Motion made by Supervisor Raffensperger, seconded by
Councilwoman Valentino. Carried unanimously.

Councilman Whitcomb, seconded by Councilwoman Valentino. Roll call
vote carried unanimously.
Agenda Item No. 22 - Interviewing Committee Zoning Board of Appeals
The Supervisor asked for two volunteers from the Town Board to
serve on the Interviewing Committee to fill a vacancy on the Zoning
Board of Appeals. Councilman Liguori and Councilwoman Valentino
volunteered.
Motion made by Councilman Klein appointing Councilman Liguori and
Councilwoman Valentino to serve on the Zoning Board of Appeals
Interviewing Committee . Seconded by Councilman Whitcomb . Carried
unanimously.
Agenda Item No . 23 - 1993 Elected Officials Salaries
The Supervisor presented the recommendations for the 1993 Elected
Officials Salaries and stated they reflect an increase of
approximately 5% .

Motion made by Councilwoman Valentino and seconded by Councilman
Liguori approving and adopting the 1993 Elected Officials Salaries
as presented. Carried unanimously.
Agenda Item No . 25 - Southern Cayucia Lake IntermuniciRal Water
Commission 1993 Tentative Budget
The Bolton Point budget was explained in the attached Budget
Message , the contingency has been reduced to $60,000 and the
estimate of share of the joint account (water sales ) have been
reduced . The employees at Bolton Point will be required to
contribute 5% of the cost of health insurance .
Motion made to set a Public Hearing for the purpose of adopting the
1993 SCLIWC Budget for November 5, at 7 : 15 p. m. by Supervisor
Raffensperger, seconded by Councilman Whitcomb. Carried
unanimously.
Agenda Item No . 26 - Public Hearing Sewer Benefit Levy
The Supervisor explained the need for the increase of $16 . 00 to the
Sewer Benefit Levy because of the additional cost of the 1989 Sewer
Extension Debt. The Town is beginning to meet contractual
obligations with the City for the cost of the inter-municipal
sewers .
Motion made by Councilman Whitcomb, seconded by Councilwoman
Valentino setting the Public Nearing to consider the 1993 Sewer
Benefit Levy for November 5, at 7 : 00 p . m. Carried Unanimously.
Agenda Item No. 30 - Judd Falls Road Sidewalk Assessment
The Supervisor explained the assessment figures for the Judd Falls
Road sidewalk which need to be approved.
I-lotion made by Councilwoman Valentino approving the assessment
figures as outlined in the attached resolution with the amendments
as added by the Town Attorney. (See attached amended resolution ) .
Seconded by Councilman Liguori .
The Town of Ithaca is paying for the improvements with the property
owners reimbursing the Town over a five year period at six percent
interest. Motion as amended, carried unanimously.

'Agenda Item No 31 - Town Board Meeting Minutes 9/8/92
There were no additions or corrections to the minutes . Motion made
by Supervisor Raffensperger, seconded by Councilman Whitcomb
approving the minutes of 9/8/92 as written . Carried unanimously.
Agenda Item No 32 - Records Management Disposition Listing
Motion made by Supervisor Raffensperger, seconded by Councilman
Liguori approving the disposal of the records as presented by the
Town Clerk in the attached resolution. Carried unanimously.
The Department Heads and Supervisor have reviewed the records on
the listing and have approved disposal of them.
Agenda Item No 33 - Town of Ithaca Agricultural Committee
The Supervisor explained the Agricultural Committee of the
Conservation Advisory Council has presented their report. A
portion of the report suggested a permanent Agricultural Committee
be established separate from the Conservation Advisory Council .
The attached resolution describes the formation of such committee
outlining the number of members and the Chairwoman Pro Tem.
Motion made by Supervisor Raffensperger approving the formation of
a permanent Town of Ithaca Agriculture Committee as outlined in the
attached resolution. Seconded by Councilman Whitcomb. Carried
unanimously.
Agenda Item No . 34 - Special Town Board Meeting , Open Space Report
Councilman Whitcomb said the Open Space Report has been approved by
the Conservation Advisory Council . The CAC has recommended the
Town Board hold a Public Informational Meeting at the Women ' s
Community Building at 7 : 30 p. m. on October 19, 1992 . This meeting
would be to explain the changes made on the document from the
document released last December. There is an Executive Summary
which outlines the Open Space Report, this summary was sent to all
the radio and television stations, and to the newspapers.
Councilman Whitcomb also requested a box advertisement be placed in
the newspaper.
Motion made by Councilman Whitcomb authorizing and directing the
Town Clerk to advertise for a Special Town Board meeting to be held
at the Women ' s Community Building as described above , and for the
placement of two box advertisements not to exceed a cost of
$300. 00. Motion carried unanimously.

Agenda Item No . 35 - Town of Ithaca Warrants
Motion made by Councilwoman Valentino authorizing the payment of
the vouchers on the Town of Ithaca warrant. Seconded by Councilman
Liguori . Carried unanimously.
Agenda Item No . 36 Bolton Point Warrants
Motion made by the Supervisor authorizing payment of the Bolton
Point warrant, seconded by Councilman Klein . Carried unanimously.
Agenda Item No. 36A - Additional Item, Game Farm Road
The Supervisor reported the Town has received a request from the
Department of Public Safety at Cornell University to support
reducing the speed limit on Game Farm Road .
Motion made by Supervisor Raffensperger supporting the reduction of
the speed limit to 45 mph, and the signing for the speed limit on
Game Farm Road . Seconded by Councilwoman Valentino . Carried
unanimously.
Supervisor Raffensperger pointed out the difficulty in sending to
the State Department of Transportation the numerous requests for
action on speed limits. The Highway Superintendent is attempting
to develop an area wide request.
Agenda Item No. 7 & 8 - Public Hearing Water Rates
The Public Hearing was opened at 7 :00 p .m. Town Clerk had proof of
posting and publication. No members of the public were present for
comment. Public Hearing closed at 7 : 01 p. m.
Recommendation from the Town staff for a negative determination of
environmental significance on the adoption of the amendments to the
water rates was reviewed by the Town Board .
Motion made by Supervisor Raffensperger approving and adopting the
negative determination of environmental significance . Seconded by
Councilman Klein . Motion carried unanimously.
Motion made by Councilman Klein, seconded by Supervisor
Raffensperger setting forth the SCLIWC Agreement to Change the
Water Schedule submitted to the Town Board with such changes as may
be approved by the Town Attorney in the course of arranging for the
execution of the agreement.

Councilwoman Valentino feels that the crater rates for consumption
should either be the same for all the users, or that the consumers
who use the least amount should have a lower rate , not a higher
rate .
The Supervisor explained this is the second year a 3 year attempt
been made to bring the Bolton Point water rate to a flat rate ,
because there was such a big difference between small users and
large users originally. It was not fair nor wise to to institute
a flat rate in one year. This is the second step and the
difference has been slowly reduced. The difference used to be
about S . 75 between high and low. The difference is now around
S. 30. Next year there will be a flat rate . notion adopting the
amendment. Carried unanimously.
Agenda Item No. 10 - SEQR Local Law Collection of Water Rates and
Charges Relating to Water Services
A recommendation was received by Town Staff of a negative
determination of environmental significance in accordance with the
NYS Environmental Quality Review Act in regards to the Local Law.
Motion made by Councilwoman Valentino adopting the SEQR for the
referenced Local Law. Seconded by Councilman Liguori .
The Town of Ithaca with this Local Law will again have increments
of $ . 10 per ten thousand gallons above the Bolton Point rate in
order to support the maintenance and repair portion of the budget.
Motion as stated. Carried unanimously.
Agenda Item No. 36B - Village of Lansing Community Recreation
Center
The Town Board reviewed the resolution adopted by the Town of
Lansing . The changes made to the Town of Ithaca ' s resolution are
the names, and that the Town of Ithaca is making a commitment not
to exceed $22 ,000, and the Village of Cayuga Heights not to exceed
$8,000. Mayor Anderson, Cayuga Heights spoke with the Supervisor
and agreed on these amounts .
Councilman Klein noted that the Village of Lansing wishes to have
the Community Center up and running by November 1993. They still
have to develop design and construction documents. The Village of
Lansing in order to have a referendum needs thirty days, they
cannot set the Public Hearing until all the municipalities sign
their pledges. Councilman Klein was confident with the
accountant' s projections, that the Community Center would succeed.

The Community Recreation Center already has approximately $100,000
in pledges . They are committed to pledging $400,000. Councilman
Klein feels this is a low risk venture for the Town of Ithaca. The
pledge to be made by the Town of Ithaca would only be utilized if
the Community Recreation revenues fell short for operation.
Attorney Barney was concerned that the resolution stated the Town
was pledging immediately full faith and credit. Under the law the
Town of Ithaca cannot commit to appropriate funds for more than one
year at a time unless the bonding process is used. The Attorney
requested a few amendments to the resolution as written . That the
second resolved be changed to read, "that the Town of Ithaca will
consider subject to negotiations and execution of a mutually
accepted agreement Article 5 G of the General Municipal Law and
subject to all other requirements of the law, an amount not to
exceed $22,000 per year, etcetera" . Amendment to the third
resolved "that the Village of Cayuga Heights will provide an
additional $8 ,000, etcetera" . The final resolve amendment, "that
the Town of Ithaca, if an acceptable agreement is reached,
etcetera" .
Attorney Barney felt that the Village of Lansing is looking for an
expression stating the Town of Ithaca is willing to set aside
appropriated monies to this center if the need arises in the
future .
Motion made by Councilman Klein adopting the attached resolution
concerning the Community Recreation Center - Village of Lansing
with the amendments as stated by the Town Attorney. Seconded by
Councilwoman Valentino . Carried unanimously.
Agenda Item No . 9 - Public Hearing Local Law Collection of Water
Rates and Charges Relating to Water Services
Public Hearing was opened at 7 : 15 p. m. Town Clerk has proof of
posting and publication. No members of the public wished to
comment. Public Hearing closed at 7 : 17 p . m .
The Supervisor signed a Certificate of Necessity in order that
residents of the Town can be informed of their water rates before
they use the water.
Motion made by Councilwoman Valentino approving the Local Law to
amend the water rates for the Town of Ithaca. Seconded by
Councilman Liguori . Roll call vote carried unanimously.

Agenda item No . 11 - Public Hearing Local Law Ethics
Public Hearing opened at 7 : 30 p. m. Town Clerk has proof of posting
and publication . No members of the public wished to comment .
Public Hearing closed at 7 : 32 p. m.
The Attorney explained there was some question on the Town Ethics
Law as to whether a person who served as an officer of a political
party was excluded from serving on the Ethics Board. The intent of
the Town Board was not to exclude people who were "only" members of
a political committee . The Local Law expands the definition that
mere membership in a committee of a political party does not
exclude them from serving on the Ethics Board .

Agenda Item No . 12 & 13 - Local Law Chase Pond Rezoning, SEAR
Floyd Forman, Town Planner said that Hospicare addressed the Board
in September and requested the rezoning of the Chase Pond site to
Residence Districts R15 and R30 . Hospicare wishes to place a
hospice on this location . The Planning Board and the Planning
Department have recommended this rezoning take place .
The zoning of the adjacent properties are R30 and R15 . If the Town
Board rezones this property Hospicare will go to the Planning Board
tomorrow evening for preliminary subdivision approval . After this
approval the Planning Board will looking at the site plan for
Hospice itself .
The Planning Board will look at the Manos parcel of two and one
half acres in the future . There was no wish to hold up the
Hospicare .
The R15 will not be going through a site plan, but a preliminary
and final subdivision approval at some point in time . The Planning
Board will also begin to look at the road and culdesac tomorrow
night. The approval of the plan, concerning public roads, will be
sent back to the Town Board prior to final subdivision approval .
Attorney Barney pointed out there was a suspicion that Mr. Hanos
might not react favorably to the rezoning .

Agenda Item No . 24 - Town of Ithaca Tentative Budget
The Supervisor presented the Budget Officer' s 1993 Tentative Budget
to the Town Board . The Board reviewed line item appropriations and
revenues brought to their attention by the Supervisor.
Correction noted on page one of Tentative Budget. On Real Property
Taxes, number will read $814 , 097 ; In Lieu of Taxes, $14 , 734;
Appropriated Fund Balance , $85, 882 ; and on page 24 , column Townwide
Tax Rate should read $1 . 168 . With those corrections the Budget
Message by the Town Supervisor is correct, ( see attached) .
Agenda Item No . 21 - West Haven Road Lighting District
Mark Morse representing the people on West Haven Road provided the
Board with a petition and a listing of those individuals who are in
support of the establishment of a Lighting District on West Haven
Road . There are sufficient signatures necessary to meet the
requirements . A Public Hearing needs to be held for the Town Board
to consider the lighting district .
Mr. Morse addressed the Board and indicated the interest on the
road is to create a lighting district to enhance security and to
help traffic as there has been an increase of families with small
children . Of homes visited for signatures only two persons were
against the lighting district.
Motion made by Councilwoman Valentino adopting the order to set a
Public Hearing for 8 : 10 p.m. , November 5, 1992 to consider the
establishment of a lighting district on West Haven Road . Seconded
by Councilman Whitcomb, carried unanimously.

Lake Intermunicipal Water Commission agreement which provides water
to a substantial portion of the mown of Ithaca; and
WHEREAS, a part of the agreement established the rates at
which compensation was paid to the Southern Cayuga Lake
Intermunicipal water Commission for water consumed within the Town
of Ithaca; and
WHEREAS, those rates may not be changed without the formal
agreement of all of the parties to the intermunicipal agreement
creating the Southern Cayuga Lake Intermunicipal water Commission;
and
WHEREAS , the Commission has explained to the various member
municipalities the need for an increase in the compensation payable
to the commission ; now therefore be it
RESOLVED , the Town Board hereby agrees to the increased water
rates set forth in the proposed Southern Cayuga Lake Intermunicipal

Order to Construct said sidewalks at a special meeting of the Town
Board held on August 24 , 1992 ; and
WHEREAS, it is necessary to establish the Amortization of
Costs for said sidewalks so that the property owners can be charged
over a five year period on their property taxes for said sidewalk

WHEREAS , the Agricultural Committee of the Town of Ithaca
Conservation Advisory Council has presented their report Planning
for Agriculture in the Town of Ithaca to the Conservation Advisory
Council , the Town of Ithaca Planning Board and Town Board; and
WHEREAS, the Agriculture Committee solicited input from
representatives of various segments of the agricultural community
in preparing its report; and
WHEREAS, the report outlines the contributions agriculture
makes to all residents of the Town of Ithaca and recommends actions
to foster a healthy agricultural sector in the Town; and
WHEREAS, one of those recommendations is the establishment of
a permanent Town of Ithaca Agricultural Committee in order that
there might be a mechanism for the agricultural sector in the Town
to inform the Town of their concerns , of state and national
legislation that influences agriculture , and to be available to the
various Boards of the Town as a resource in decision making; now
therefore be it
RESOLVED, that the Town of Ithaca hereby establishes a Town of
Ithaca Agriculture Committee . Members of the Committee , not to
exceed eight in number, will be appointed by the Town Board.
Officers of the Committee will be appointed by the Town Board, upon
recommendation of the Agricultural Committee . Christiann Dean is
hereby appointed Chairwoman Pro Tem, in order that a meeting of
persons interested in serving on the Agriculture Committee may be
convened . Recommendations for appointment to one year terms should
be forwarded to the Town Board for action. The Committee once
appointed, shall recommend to the Town Board a list of officers,
Chair, Vice-Chair and Secretary.

Game Farm Road - Speed Limit

WHEREAS , the Department of Public Safety at Cornell University
is petitioning for a reduction of speed limit on Game Farm Road as
the road is presently unsigned for speed; and
WHEREAS , said road is in the three part jurisdiction of the
Town of Dryden, Town of Ithaca, and Tompkins County; and
WHEREAS , the road is a narrow rural road narrowed again by a
bridge , crossed by a bicycle/pedestrian pathway, used by State and
University farm equipment, and used by joggers and bicyclists ; and
WHEREAS, said road is also intersected by two 45 mph zoned
roads ; Ellis Hollow and NYS Route 366 ; now therefore be it
RESOLVED, that the Town Board of the Town of Ithaca does
hereby support and request the reduction of speed limit to 45 mph,
and the signing for speed on the Game Farm Road.

Community Recreation Center - Village of Lansing
Resolution No . 271
WHEREAS, a Community Recreation Center has been proposed to be
constructed and located in the Village of Lansing; and
WHEREAS, a study was prepared entitled "A Demand and Financial
Analysis for the Proposed Cultural and Recreational Center for the
Village of Lansing, New York" in April of 1992 by the University of
Michigan, Support Facilities Research Laboratory which concluded
that there is sufficient demand in the community for such a
facility and that construction and operation of the project is
financially feasible although an initial shortfall of revenue to
cover operating costs may occur under the current proposal; and
WHEREAS, under the current proposal , the Village of Lansing
would own the facility and finance the entire cost of the project
construction through bonded indebtedness of the Village of Lansing;
and
WHEREAS , the Community Recreation Center, Inc . , a private not-
for-profit corporation, is prepared to donate funds in the amount
of at least $400,000 to be held by the Village to help defray the
operating costs of this project; and
WHEREAS , the above-mentioned study and report as well as other
investigations, indicate that the residents of the Town of Ithaca
will benefit from this project as well as the residents of the
Villages of Cayuga Heights and Lansing , and the Town of Dryden and
Lansing; and
WHEREAS , the Village of Lansing has requested cooperation and
assistance from the Village of Cayuga Heights and the Towns of
Lansing, Dryden, and Ithaca in the management of the project and in
providing a financial guarantee for the initial period of operation
of the project; and
WHEREAS , the Village of Lansing has requested further
assistance and advice on how to proceed with this project from the
Town of Ithaca and, in connection therewith, has formed an Advisory
Board comprised of representatives from each of the five above-
mentioned municipalities; now therefore be it

RESOLVED, that the Town of Ithaca has determined that it is in
the best interests of the Town of Ithaca to cooperate and assist
the Village of Lansing in development of the Community Recreation
Center; and be it further
RESOLVED , that the Town of Ithaca will consider, subject to
negotiation and execution of a mutually acceptable agreement under
Article 5-G of the General Municipal Law and subject to all other
requirements of law, providing an amount not to exceed $22 ,000 per
year as its pro-rata share of any operating shortfall for the
facility beginning in fiscal year 1994 , or the beginning of the
first fiscal year after completion of the facility for a ten year
period; and be it further
RESOLVED, Town of Ithaca monies are to be appropriated from
Townwide Funds and with the expectation that the Village of Cayuga
Heights will provide an additional $8,000 per year, on the basis of
the percentage anticipated use of the facility by residents of the
Village of Cayuga Heights ; and be it further
RESOLVED, the Town of Ithaca, if an acceptable agreement is
reached, would pay such monies only if a deficit exists in the
operating account of the Community Recreation Center and such Town
of Ithaca funds would be expended only after private contributions
from the Community Recreation Center, Inc . have been exhausted.
This commitment to be subject to approved contractual relations
having been entered into among the various municipalities and the
Community Recreation Center, Inc .
