Town Board Meeting Minutes
July 13, 1992
At a regular meeting of the Town Board of the Town of Ithaca,
Tompkins County, New York, held at the Town Hall, 126 East Seneca
Street, Ithaca, New York, there were :

Agenda Item #17 - Chase Farm Associates Construction Easement
A letter from John Barney, Town Attorney stated the Town of Ithaca
has taken both a construction easement and an easement for
emergency vehicles at the Chase Farm Subdivision. At this time
there is not a continued need for the construction easement,
although the Town would retain the right for access of emergency
vehicles.
Steve Bowman from Citizens Savings Bank addressed the Board and
explained the property had been foreclosed on and the new owners
wish to have the easement released so that large construction

vehicles will not be using the road.
Motion made for the release of the easement as outlined by the Town
Attorney and the Town Supervisor by Councilman Niklas . Seconded by
Councilman Liguori . Carried unanimously. (See attached. )
Mr. Bowman told the Board that Citizens in the future would be
interested in changing the easement for the emergency vehicles to
another location in the context of the complete development.
Agenda Item #3 - Report of Town Officials
a. Town Supervisor Report - The NYS Department of Transportation
has notified the Town of a reduction of the speed limit to 30 mph
on Warren Road, between Forest Home Drive and the Village of
Lansing. The school zone on Warren Road is presently 30 mph and
the Town may wish to request a reduction for that area. The
Highway Superintendent feels that request would be viewed upon
favorably by the State.
The Town has spent a great deal of time preparing the details of
the walkway/bikeway, and sidewalk that Tompkins County bid for the
Pinetree Road, Judd Falls Road relocation.
The Town has been notified of a Records Management Grant from New
York State in the amount of $3, 349 . 00, less than expected, but
still a help to the Town . The entire project is going well and has
already improved the Records Management of the Town.
Motion made by Councilman Liguori requesting the NYS Department of
Transportation reduce the speed limit in the designated school zone
on Warren Road. Seconded by Councilman Niklas.' Carried
unanimously. (See attached. )
b. Town Engineer Report - Water and sewer improvements on the West
Hill are still continuing. All major items are done, and we hope
to finish soon. Inlet Valley Phase I is officially complete, and
we are requesting to finalize the contract and pay the contractor
including the retainage . Inlet Valley Water and Sewer Phase II
bids were advertised today, with the bids received by July 31, and
approval to award the contract at the August Town Board Meeting.
There is a resolution prepared through Public Works requesting the
purchase of safety equipment recommended by OSHA and PESH.
The water and sewer agreements have been reviewed by the City and
Town. The Troy Road water tank has been drained and inspected,
there were two spots where a projectile had hit the tank which have
been repaired.

Valve and hydrant maintenance is being completed with an average of
one or two every other week. Mork on the sewer inventory and the
planning of maintenance on manholes is continuing. There was a
sewer break as a result of the contractor damaging a sewer lateral
and not notifying the Town.
Work is being done on the Mitchell Street walkway and relocation
with the County. Work on the sidewalk should begin the first week
of August.
The summer interns from Cornell are extremely capable and have
proven to be a big help to the Engineering Department.
c. Town Highway Superintendent ' s Report - Superintendent McConnell
reported most of the work done in June was in preparation of the
paving schedule . The Parks are well into their summer maintenance
and team work schedule . Work has begun on the South Hill Trail the
Parks Department has helped with some man hours and equipment.
Councilwoman Valentino asked Mr. McConnell about the gate across
the Highway Department' s entrance no longer allowing access for
people to get mulch for gardens and flower beds. Mr. McConnell
explained we are still allowing the pick up between 6 :00 a.m. to
4 : 00 p.m. , Monday through Friday. We are in the planning stage of
developing a pick up area outside the gated area, where there will
be a pile of wood chips, compost, drop off leaves and brush. There
has been a security problem with people entering other areas.
d. Town Building Inspector/Zoning Officer Report - Mr. Frost
notified the Board there were two Fire Works Display Permits
issued.
There were fifteen building permits issued for the month of June
including six single family residences, and one two family
residence . Thirteen certificates of occupancy were issued. Eight
new complaints were investigated regarding building and zoning
Local Laws . Performed 129 field visits, including 85 building code
inspections, 34 inspections to laws in zoning, and performed 7 fire
safety inspections, etc .
The two Zoning Board meetings heard 70 cases, all cases were
approved.
e . Town Planner Report - The Comprehensive Planning Committee at
their last meeting reviewed portions of the synthesis chapter and
the intended future Land Use Map. Staff is continuing to update
the Inventory Chapter of the Comprehensive Plan.

Agenda Item #3 - Cont' d
The Planning Board discussed the proposed Cayuga Cliffs Subdivision
on West Hill and offered guidance to the developers as to how to
proceed.
Staff met with Cornell on the GEIS , the Planning Board is scheduled
to vote on the adequacy of Cornell ' s Draft Environmental Impact
Statement on July 21 .
Staff has been starting to field check many of the streams of
inclusion into the Stream Corridor EPOD, and has also submitted
criteria for inclusion of these streams to the COC Chairman .
The Town of Ithaca has finally completed all the easements that for
the South Hill Trail . The Town now has title to the entire area of
the Trail . The Youth Conservation Corp, who have been working on
the trail , are working out very well . A portion of the trail being
worked on is now posted for no admittance because there are some
hazards of stumps from the clearing of shrubs and trees.
Agenda Item #4 - Report of Town Committees
Councilman Klein reported the CPC has a meeting on July 14, they
have been reviewing the 2010 map. Cathy Brown of Stuart Brown
Associates has been working on Chapters 5 and 6 . There has been
significant progress within the last two months, which will allow
the informational meetings to begin soon.
Councilman Niklas mentioned there was an interesting article in the
Ithaca Journal on July 4 on the EPOD debate .
Councilwoman Valentino reported she has a meeting on July 14 with
the people from Cable Access for discussions on the franchise
agreement. On July 15 she will meet with Barbara Lukens to
continue work on the franchise .
She attended a meeting with the City Committee that is looking at
the recreational facilities. The committee is looking at the area
of the Ithaca School District to see if there is a way to realign
the youth recreation. Councilwoman Valentino feels the committee
is overly optimistic that we will have a budget and a new structure
ready by this Fall .
Councilman Whitcomb reported the Agricultural Sub-Committee of the
CAC has completed its work on the draft agricultural report. The
report will be forwarded to the CAC for its review and comment,
hopefully on July 16 . The CAC will forward it to the Comprehensive
Planning Committee and/or Planning Board after its review.

The Open Space Report Draft is nearing completion with hopes that
the CAC might act on that at its next meeting . Should that happen
the CAC will be looking to the Planning Committee for when and if
to schedule public information meetings.
Agenda Item #5 - Report of County Board of Representatives
No report.
Agenda Item #6 - Persons To Be Heard
Noel Desch congratulated the Board on acquiring a 30 mph speed
limit on Warren Road.
Mr. Desch asked what provisions have been made to inform the public
about the COC ' s preparations for the Planning Board hearing on
August 4th? Councilman Niklas responded that this is all
contingent upon the COC ' s July 22nd meeting. Advertisements will
be placed in the Ithaca Journal on the Friday and Monday preceding
the meeting, not just legal advertisements. The meetings on July
29th and August 4th are tentative based upon what is accomplished
at the July 22nd meeting.
The COC wants the Planning Board to review the current draft
legislation for input, then the public will have access and
participate in those deliberations.
Mr. Desch asked if each individual landowner would be notified of
the meetings, and requested that this happen?
Councilman Niklas said the newspaper advertisements are an
efficient way of letting all people including landowners know this
is available for public scrutiny. The Town would notify each
individual property owner when the Town Board places the issue as
an agenda item and holds a Public Hearing, because then the
boundaries for the EPODS will be defined.
The COC will hold a committee meeting on July 22nd. Tentatively,
it is planned to hold a public information meeting at NCR at 7 :00
p.m. on July 29th. The Planning Board has as an agenda item for
its August 4th meeting a Public Hearing concerning EPODS.
Agenda Item #11 - Annual Fuel Contract Bids
The Town has received only one bid for the contract. The
Supervisor and the Highway Superintendent recommended that the Town
again advertise for bids to permit additional businesses who have
traditionally bid to do so .

Motion made by Councilman Niklas authorizing the Town Clerk to
again advertise for bids on the annual contract to purchase diesel
fuel and unleaded plus gasoline for the Town fleet. Seconded by
Councilwoman Valentino. Carried unanimously.
Agenda Item #12 - Highway Mechanics Position
Superintendent McConnell explained Art Westmiller is retiring at
the end of the month. Earlier this year the Board approved a
position for an individual to be trained by Mr. Westmiller before
he left. This individual did not work out, a laborer has been
working with Mr. Westmiller and would like the opportunity to learn
this position . The Superintendent is requesting authorization to
offer him the position officially upon Mr. Westmiller' s retirement,
and to advertise for the position of laborer he will be vacating.
The position would pay $8 . 00 per hour with the usual six months
probation with consideration of a pay adjustment at that time .
Motion made by Councilman Niklas, seconded by Councilman Liguori
authorizing the appointment of the position as described and
prepared by the Highway Superintendent. See attached resolution .
Carried unanimously.
Agenda Item #13 - Safety Equipment Required by PESH
Daniel Walker, Town Engineer explained to the Board there are items
which are becoming more of a concern for the safety of our
employees and for liability the Town may have due to fines imposed
for not having the proper safety equipment. There are four
different types of equipment needed for entering confined spaces
and working in trenches . The confined spaces dealt with are sewer
manholes, water meter pits, water tanks, large storm sewers . These
areas must have an atmosphere capable of sustaining life . Mr.
Walker explained each type of equipment as listed on the attached
resolution . Motion made by Councilman Niklas, seconded by
Councilman Liguori authorizing purchase of safety equipment as
outlined by the Town Engineer. Carried unanimously.
Agenda Item No. 13a - Snow & Ice Removal With Tompkins County
The Supervisor received three copies of a contract with the
Tompkins County Public Works for Snow & Ice Removal . They have
asked the Town to sign the copies and return them by Friday, July
17 . The Supervisor is requesting approval of the contract
contingent upon the approval of the Town Attorney. We have
discussed the necessity of negotiating this contract with Tompkins
County.

The Town needs to clarify some of the insurance provisions
included. Motion made by Supervisor Raffensperger authorizing the
Supervisor to sign the Snow & Ice Removal Contract after
consideration and approval of the Town Attorney. Seconded by
Councilman Niklas . Carried unanimously.
Agenda Item #15 - South Hill Trail Design
George Frantz, Assistant Planner presented the final drawings of
the South Hill Trail and explained there are no substantial changes
from the plans of 1989 , only detail changes . Mr. Frantz explained
changes in the types of signs on the downhill section, as well as
the changes he outlined at previous recent Town Board meetings. He
proposed that whenever one of our trails intersects the
recreationway we construct a pass through allowing about 18 inches
so that one person may pass, but a bicycle could not.
Councilman Whitcomb stated the City CAC is very concerned about
bicyclists using the recreationway and they have a draft resolution
by the Common Council prohibiting such vehicles from the trails.
These barriers for bicycles will also have signs prohibiting them.
Councilman Niklas hopes that our contribution to the sign pollution
will be minimized. Mr. Frantz pointed out that all signs intended
for the trail are going to be metal signs, 12" X 12" , with a dark
brown background with white lettering.
None of the proposed changes in the South Hill Trail will limit the
accessibility of the trail by the handicapped.
Supervisor Raffensperger stated the South Hill Trail can be
completed within the budget as adopted in 1989 . All changes in the
trail from the original plans in 1989 have been described in detail
by Mr. Frantz . Mr. Frantz again described the change in the Burns
Road area of the trail which involves a change in the grade .
Motion made by Councilman Niklas approving the final design plan
for the South Hill Trail as described in the prepared resolution .
Seconded by Councilwoman Valentino . Carried unanimously.
Agenda Item #7 - Cultural and Recreation Center
Village of Lansing, Mayor Ted Wixom and Andrew Sciarabba gave the
Board a design proposal for construction of a community and
recreation center by the Village . There had been an ice rink
proposed previously, but it did not materialize as there was
considerable concern with what to do in the non ice seasons . The
private group behind that proposal came to the Village of Lansing
and asked them to consider it again. The Village ascertained it

was not previously successful due to the lack of involvement by the
community. There is no question now that the ice time would be
adequately used. The problem comes from what to do in the non ice
times of year. The plans as presented tonight include community
rooms to allow space for meetings.
The users would come from a larger area than the Village of
Lansing. It would be a family center for the northeast located in
the Village of Lansing, the Village of Lansing is asking the
contiguous municipalities of the Town of Ithaca, Town of Dryden,
Town of Lansing, and Cayuga Heights for their help.
The Village has spoken to all the Mayors and Supervisors of these
municipalities and has made three presentations .
Location of the center would be at the corner of Warren Road and
Route 13, which is an excellent location in terms of traffic .
The single major problem in making this center a reality is
finances. The facility should be paid for by the users, not tax
dollars. There are other facilities which are self sufficient in
Lysander, and Whitestown .
The financial analysis comes close to the proposed center being
self sufficient. The Town of Ithaca ' s participation would require
the potential commitment of money, more as an insurance policy
rather than a flat amount.
The main ingredient of meeting the goal of the center ' s being self
sufficient is the management of the facility as a separate
enterprise .
A feasibility study shows that the ice rink/community center would
generate revenues but not enough to carry itself including the debt
service . The private contributions have amounted to $300,000 in
pledges, with the probability of raising a total of $500,000.
The budget and operating numbers have been worked on for many
years . The Village hired an architect to see if the project could
be done within the parameters established in the study. The project
will cost probably $2 million to $2 . 5 million .
The operating numbers with realistic bonding figures for
construction, even with the cost of $2 million, show a positive
cash flow, and with a $2 . 4 construction estimate a negative cash
flow only in the early years.
The private donations will be used first, not taxpayer dollars.
They are confident the project will work without taxpayer dollars,

however some people feel if the numbers have been misinterpreted
more money would be needed to guarantee the cash flow. That is why
they are asking each municipality to guarantee the cash flow with
contributions of $15,000 per year maximum to be shared equally by
the five municipalities.
There will be a Supervisory Board with ten members . Five from a
representative of each of the municipalities, and the other five
will be people in the community who have expertise in professional
management.
The Town would be asked for the $15 ,000 maximum only when the
private donations were used, and only in equal amounts of the other
municipalities.
Councilman Niklas stated if the $15,000 did have to be used it
would fail to meet the criteria of not expending taxpayer dollars.
Mayor Wixom told the Board that joint management and ownership of
the facility is the goal . The Village of Lansing would do the
bonding and discussions would continue concerning joint ownership.
Supervisor Raffensperger asked what benefit a municipality who
contributes would get, compared to a municipality who does not
contribute? Mayor Wixom replied there would have to be
negotiations, however one of the things a municipality would
receive would be part ownership and management, and priority use of
the facility.
The Supervisor asked what decision making time frame from each of
the municipalities is being considered? Wayne Wixom replied that
the Village would like to have the center operational by the Fall
1993, with the bonding referendum done Fall 1992 .
Councilwoman Valentino stated the Intermunicipal Youth Commission
is meeting to discuss the needs assessment in our community with
the recreation dollars we have . This proposal will be reviewed by
them to see if it fits into the needs assessment. The Youth
Commission has had people request more activities which are not
centrally located near the city.
The Supervisor stated the Town has made a commitment to the
Intermunicipal Youth Commission to make a needs based assessment
for the Town, including the reassessment of our contractual
obligations. We need to let them proceed with that and integrate
this proposal into their discussions.
The Supervisor directed Councilwoman Valentino to inform the
Intermunicipal Youth Commission that we are anxious for them to

consider this proposal along with the rest of the proposed services
by the Town of Ithaca. We will then get back to the Village of
Lansing concerning this proposal .
Agenda Item #8 - Public Hearing, Consideration of "A Local Law to
Establish and Change Fees Collected by the Town Clerk"
Public Hearing opened at 7 : 00 p. m. Town Clerk has proof of posting
and publication. The Supervisor asked for public comment, no
persons wished to be heard.
This is a revision of the fees schedule concerning the fees for
Purebred Dog Licenses to be retained by the Town of Ithaca, along
with a charge for the Noise Ordinance . Public Hearing closed at
7 :05 p. m.
Motion made by Councilman Niklas, seconded by Councilman Whitcomb
approving the adoption of a local Law amending Local Law #12 of the
year 1992, "A Local Law to Establish and Change Fees Collected by
the Town Clerk" . No discussion. Roll call vote, carried
unanimously.
Agenda Item #16 - Ratification of Temporary Employment, Highway
Department
Superintendent McConnell explained that Scotty Saraceni retired
from the Highway Department last December. He has experience with
mowing equipment and is looking for temporary employment to
supplement his retirement income . The Town is in need of a part
time mower operator so we can concentrate on that with minimal
supervision . Mr. Saraceni has been in this temporary position
since June 25, and Supervisor McConnell is requesting ratification
of this position.
The Supervisor stated there are sufficient funds in the budget to
pay this position .
Motion made by Councilman Niklas, seconded by Councilman Liguori
ratifying the temporary part time position of Scotty Saraceni to
the Highway Department. Carried unanimously.
Agenda Item #14 - Report of Automated Data Processing Committee
Daniel Walker reported the committee had met with representatives
of IBM and Corning Data Services to discuss the state of the
contracts for the System 36 . They did not offer any enthusiastic
ways to modifying the system to meet our needs. Their response was
that they would be glad to show us that the System 36 will work.
They will be conducting a demonstration in the next month.

The ADP was authorized to expend $2500 .00 for a Personal Computer
for the Town Clerk, and were able to get a PC to meet the Town
Clerk' s needs with additional software for $1700. 00 .
The System 36 does work, the software is not being utilized because
a great deal of time was spent trying to make things happen that
didn ' t.
Councilman Niklas asked if our obligations to pay were contingent
upon the softwares obligation to work, and if it is not working,
isn ' t it a way out of the contract? Mr . Walker responded that IBM
and Corning Data feel it was not their fault the system was not
working to meet our needs .
The Supervisor suggested we have IBM come in and demonstrate to
prove that the equipment and software are what we need.

Motion made by Councilman Niklas, seconded by Councilman Whitcomb
approving the Town Board Meeting Minutes of 6/8/92 with the
correction on Page 3, Paragraph 6 , change all CAC ' s to CAC ' s.
Carried unanimously.
Motion made by Councilman Niklas, seconded by Councilman Liguori
approving the Town Board Special Meeting Minutes of 6/22/92 as
written. Carried unanimously.
Agenda Item #19 - Financial Reports
Supervisor Raffensperger thanked and congratulated the Assistant
Budget Officer, Sally Alario for bringing the Financial Reports up
to date so quickly.
Motion made by Councilwoman Valentino approving the Financial
Report ending April 30, 1992 as presented. Seconded by Councilman
Niklas. Carried unanimously.
Motion made by Supervisor Raffensperger, seconded by Councilman
Niklas approving the Financial Report ending May 31 , 1992 as
presented . Carried unanimously.
Agenda Item #9 - Amendment to Local Law No. 1 of the Year 1984 With
Recent EPA and DEC Regulatory Changes
Supervisor Raffensperger opened the Public Hearing at 7 : 15 p. m.
Town Clerk has proof of posting and publication.

The Town Board has reviewed this local law recommended to the Town
by the SJS and various Attorney' s . No persons wished to speak at
the public hearing. Public Hearing closed at 7 : 17 p . m.
Councilman Niklas moved the adoption of a local law amending Local
Law No. 1 of the Year 1984, EPA and DEC Changes . Seconded by
Councilman Klein . Roll call vote carried unanimously.
Agenda Item #20 - Pine Tree Road, Judd Falls Road Walkway/Bikeway;
Judd Falls Road Sidewalk
The Supervisor explained this involves sidewalks along the
commercial area along Judd Falls Road on the east and west side .
The Town had several options in providing for the funding for this
sidewalk. The Town could have set up a sidewalk district or
provided for them under Town Law, Section 200A. Attorney Barney
has recommended using Town Law, Section 200A. The cost to
construct sidewalks in this area would be less than $13,000. Some
of the participants within this project would like to pay all of
the money up front, and some do not find that convenient. Under
Section 200A the Town is able to provide some leeway to the
participants concerning payment. A Public Hearing should be held to
explain and discuss this project' s construction and funding .
Motion made by Councilman Niklas to hold a Public Hearing on August
10, 1992 at 7 : 00 p. m. to hear public comment on said sidewalk
project. Seconded by Councilwoman Valentino .
The Town of Ithaca will be providing up front a portion of the
funding for this project for the property owners who do not wish to
pay the construction costs all at once. It would probably be
limited to five years, with Section 200A limiting the interest rate
to 6% .
The Town has discussed this project with the majority of the
landowners this project would effect. The County is putting the
base sidewalk and gravel in. The landowners would only be paying
for the surface coat. It. will be discussed at the Public Hearing if
a landowner did not pay. The Town is taking a small risk because
in order to have the contractor proceed the Town has to tell him to
proceed within the next few days . Once the Town Board passes this,
the landowners are required to participate by law. Cornell
University is very willing to have this project go through and are
willing to pay anyway that is convenient to the Town. A gravel
walk (crushed stone compacted) will be constructed in front of the
cemetery portion of the project. The various landowners will be
responsible for the maintenance of the sidewalks in front of their
properties once construction is completed. Motion carried
unanimously.

Part of the alternative of the Tompkins County bid was a
walkway/bikeway from the intersection of Snyder Hill Road to Ellis
Hollow Road. None of the construction was included in the base
contract except for an area where Old Pine Tree Road will remain,
and the pavement will not be destroyed. It is designed to be ten
feet wide, with several hundred feet paved, the rest of it will not
be constructed under the County base bid.
The Town has talked to the contractor, and Cornell is looking for
support for this section. The Supervisor is requesting
authorization to enter into an arrangement with the contractor to
build the sub-base course with compacted gravel . The entire cost
of the walkway/bikeway as it was bid was approximately $32 ,000 most
of which is for the asphalt surface . The cost to have the
contractor while he is already there and mobilized build the sub-
base, and place the gravel will be less than $8,000 . It is prudent
for the Town to approve the basic construction of the sub-base
while the road is done . The Town does not have $32 ,000 to do the
complete walkway/bikeway, however we do have the funding to build
the base because Cornell will subsidize at least half of it for an
amount up to $4500. 00 .
Motion made by Councilman Niklas authorizing the Supervisor to
proceed with the basic construction of a sub-base Walkway/Bikeway
on Pine Tree Road for a cost not to exceed $7 ,000 from the Town of
Ithaca. Seconded by Councilwoman Valentino. Carried unanimously.
Councilman Whitcomb made the point that we should finish the
construction of the surface of this area within a timely manner to
insure no loss on construction of the sub-base . Supervisor
Raffensperger stated it would have been wonderful to be able to
complete the project, however we do not have leeway of $46 ,000 in
the present budget to complete the entire projects, sidewalks and
bikeway this year.
Agenda item t#10 - Public Hearing Amending Local Law No . 1 of the
Year 1984, To Establish Revised Pollutant Limitations
Public Hearing opened at 7 : 30 p. m. The Supervisor told the Board
this Local Law has to do with levels permitted for inspection of
industrial facilities concerning Pollutant Limitations. To bring
the standards more up to date . This has been previously discussed
and materials given to the Board. Public Comment was received by
Noel Desch stating this Local Law is long overdue . Public Hearing
closed at 7 : 34 p. m. Motion made by Councilman Niklas approving the
local law amending Local Law No. 1 of the Year 1984 to establish
revised Pollutant Limitations. Seconded by Councilman Liguori.

Agenda Item #21 - Town Hall Furnace
Daniel Walker told the Board during the normal spring cleaning and
inspection of the furnace it was discovered the heat exchanger is
cracked to the point where fire can be seen when the furnace is
hot. The Town has received a quote of $4180. 00 to replace the
existing furnace with two furnaces, which is reasonable with the
size of the building. We are in the process of obtaining further
inspections and costs of replacement. Mr. Walker will follow the
Town Procurement Policy to received further estimates of
replacement.
Councilman Klein recommended that a set back thermostat be
installed to insure the proper efficiency and temperature during
the nights and weekends.
Motion made by Councilman Niklas authorizing the Town Engineer to
secure estimates and secure replacement of the furnace for an
amount not to exceed $4, 500, with said furnace to be equipped with
a set back thermostat. Seconded by Councilman Whitcomb. Carried
unanimously.
Agenda Item #22 - Refund of Arrears Payment, Water and Sewer
Supervisor Raffensperger explained there has been a communications
problem over a billing to Peter Hess from Bolton Point. The amount
in dispute is $5. 76 .
Motion made by Supervisor Raffensperger authorizing the refund of
$5. 76 to Peter Hess for the billing error on his water and sewer
bill . Seconded by Councilman Whitcomb. Carried unanimously.
Agenda Item #23 - SARA Grant
The Town of Ithaca received notification June 24 that the Town will
receive a Records Management Grant in the amount of $3, 349.00. The
Supervisor accepted the grant for the Town by July 10, 1992 as
required. The Supervisor requested the Town Board ratify the
acceptance of the grant.
Motion made by Councilman Niklas, seconded by Councilwoman
Valentino ratifying the acceptance of the Records Management Grant
in the amount $3, 349 . 00 by the Supervisor. Carried unanimously.

The Supervisor presented two additional billings which were not
received in time to be put on the warrants. Mr. Walker explained
there is a bill for final payment to Bat-Con Incorporated for
Contract #2 , Inlet Valley Phase I , Water and Sewer Project in the
amount of $50, 940. 33 . Mr. Walker assured the Board all work has
been performed to the Town ' s specifications or better on this
project. Mr. Walker recommended the final payment, as well as the
release of the retainage .
Motion made by Councilman Niklas authorizing final payment to Bat-
Con Incorporated for Contract #2, Inlet Valley Phase I , including
the return of the retainage as described by the Town Engineer.
Seconded by Councilwoman Valentino . Carried unanimously.
Floyd Forman, Town Planner explained the bills received for
services rendered by Althoff, Zoghlin, Bansbach and Asandrov, P. C .
Attorney At Law in the amount of $171 .00, and to Larsen Engineers
in the amount of $5987 . 23 for the GEIS review. These funds will be
reimbursed to the Town from separate items to be paid by Cornell
University.
Motion made by Supervisor Raffensperger authorizing payment of said
billings for the GEIS review. Seconded by Councilman Niklas.

Agenda Item - Additional - SCLIWC Budget Transfer
Supervisor Raffensperger presented a resolution asking for the
transfer of funds to purchase a new boiler at Bolton Point. Motion
made by Supervisor authorizing approval of said transfer in the

unanimously.

WHEREAS , the Town of Ithaca seeks to have the cost of such
construction allocated among the owners of the various parcels upon
which said sidewalks shall be constructed, in accordance with the

WHEREAS, Peter Hess of 131 West Haven Road, Ithaca, New York
was charged and subsequently paid an arrears amount of $5 . 76 on the
water and sewer billing he never received, and
WHEREAS , Mr. Hess has corresponded with the Southern Cayuga
Lake Intermunicipal Water Commission following the instructions as
outlined by SCLIWC to resolve this matter, and
WHEREAS, Mr. Hess has written to the Town Board explaining the
problem and procedures he has followed to resolve this matter with
no satisfaction, now therefore be it
RESOLVED, the Town Board has reviewed said letter and does
hereby authorize a refund be paid to Peter Hess of 131 West Haven
Road, Ithaca in the amount of $5 . 76 for the said arrears payment.

Government Records Management Improvement Fund (LGRMIF ) Grant in
the amount of $3, 349 for an Inactive Records Project; and
WHEREAS, the Supervisor accepted this LGRMIF Grant before the
deadline of July 10, 1992 as required; now therefore be it
RESOLVED, the Town Board of the Town of Ithaca does hereby
ratify the acceptance of the LGRMIF Grant awarded to the Town for

the equipment account of the SCLIWC Operating Fund to meet the need
of purchasing a new boiler; and
WHEREAS , in conformity with Town Law and good bookkeeping
practices accounts should not be over appropriated, now therefore
be it
RESOLVED , that the Treasurer of the SCLIWC is hereby
authorized and directed to make the following budget transfer from
encumbered balances to offset any shortages in said budget for the
purchase of a new boiler; and be it further
RESOLVED, that the SCLIWC Bookkeeper be sent a certified copy
of this resolution so that said budget transfer can be recorded .

work to the Town' s plans and specifications according to the Town
Engineer; and
WHEREAS , the Town Engineer recommends all payments including
retainage to Bat-Con Incorporated be made ; now therefore be it
RESOLVED , the Town Board hereby authorizes and directs final
payment to Bat-Con Incorporated be made including all retainage in
the amount of $50, 940. 33; and be it further
