REPORT OF TOWN OFFICIALS Superviso:r ' s Report Supervisor Raffensperger noted that Agricultural District # 2 , which is on West Hill is up for review . The Agricultural District Committee will meet to review the districts boundaries sometime in November . We will be notified of the date . The Town Clerk has a map showing the boundaries and available for public review in the Town Hall . The Supervisor went on to report that the Association of Towns Meeting will be held in New York City , February 16th to the 19th . Town Board members who wish to go should let Jean Swartwood , Town Clerk know , staff members should check with the Planning Board and ZBA to see if they have members who wish to attend . We will determine the attendees who will be authorized to attend at our December 9th meeting . The Supervisor went on to say that the lower bridge in Forest Hone is closed for repairs . Also , the Board members have received notice of a Wetlands Conference to be held , Saturday , November 23rd at Cornell . She suggested that the Board might wish to authorize attendance of anyone , perhaps up to five persons , as the cost is only $ 10 ., 00 per person and then determine who wishes to go after r Town Board Minutes 2 November 7 , 1991 the meeting . She suggested the Board members check in with the Town Clerk who will send in the registrations . RESOLUTION N0 , 258 Motion by Supervisor Raffensperger , seconded by Councilman Niklas , RESOLVED , that the Town Board of the Town of Ithaca hereby authorize the attendance of five persons at the Wetlands Conference to be held Saturday , November 23rd at Cornell . (Raffensperger , Whitcomb , Leary , Klein , Liguori , Valentino and Niklas voting Aye . Nays - none ) . Town En ineer ' s Re rt Town Engineer Dan Walker reported that it had been a busy month . The contractors are going crazy in Inlet Valley and anticipate having all the water and sewer pipes in the ground within the next two weeks . We anticipate the first water services to be on line the first of December and sewer by the first of the year . We are still trying to finish West Hill with final restoration and tree planting in the next week . He went on to say that he had been working with the County trying to get the Mitchell Street/Ellis Hollow sidewalk in place . Construction was taking most of his time and the time of his staff . Town Highway Superintendent ' s Report Town Highway Superintendent Scott McConnell reported that October was a ver, productive month for the Highway Department . A total of 2010 . 75 hours were worked , of which 302 . 25 were overtime . Work on Park Lane Extension required 455 . 25 hours . Left to be done prior to opening for traffic , is to place the signage and finish the ` erosion protection in the ditches , then we are waiting for the legal pra�.ess of right-of-way ownership . The 206 hours required on Rose Hill were spent milling off 3 -4 " of pavement , overlaying with binder and top coat of asphalt and placing shoulders . Brush pickup used 192 hours . This is a record short time , possibly due to the problems with Newsletter distribution . Spring brush pick-up and the drop-"off point at the Highway barn may have also helped lessen the load . Working for the Engineering Department required 134 hours . Setting G . P . S . monuments for the county wide mapping by NYSEG required 70 . 5 hours . The other 63 . 5 hours were spent placing a hydrant and replacing services on Williams Glen Road . Repairing the base material and placing 3 " of binder asphalt on Whitetail required 183 . 5 hours . This job was done in cooperation with the developer of the Deer Run development . A great deal was accomplished and I am especially grateful to all the Highway crew for their efforts and willingness to work long hours . The reliability of the equipment has been a contributing factor also . In November , we will do leaf pick-up beginning on November 11 . The remainder of the month , we will be concentrating on preparing for the winter months and routine road repairs . November 4 , Dan Walker and I inspected the decking on the downstream Forest Hcme bridge . It was determined that the deck is a hazard and possible liability and should be closed until repairs can be made . Major repair are scheduled to be done this month . Our plan is to attach two 4 feet -0_ wide tracks of diamond plate steel for the entire length of the bridge . This will provide solid decking on the wheel tracks for the length of the bridge . As soon as the County can erect their hanging scaffolding , we will do this repair , hopefully within a week or two . Town Board Minutes 3 November 7 , 1991 The Highway Superintendent continued , reading the Parks and Open Space Manager ' s Report , as follows : Park and trail mowing required 49 man hours in October . A final mowing will be done the first week of November , after which our mowing equipment will be serviced , winterized and stored . The remining play structures were sealed with preservative . Don spent 26 man hours accomplishing this project . We will plan on resealing our newest structure at Grandview Park next spring . Several fall tree and shrub plantings were done for a total of 106 man hours . Jobs included : replacements at Grandview Park , new plantings at Troy Park entrance ; a large birch tree at the Corrente property on Tnunansburg Road ( to replace a tree killed by the sewer installation ) ,, and coniferous tree screening at the new Troy Road water tank . We will be putting a high priority next spring on planting five to six large diameter shade trees around each play structure at Grandview, Troy and Hungerford Heights Parks . We have received numerous requests from park users for such plantings to help shade the play areas during the heat of summer . The three Parks employees participated in the Town ' s brush pick-up , October 21-22 for a total of 67 . 5 man hours . The volume of material chipped up was dramatically lower than last fall due , in part , to our spring pick-up and the availability of our year-round drop-off site at the Highway facility . Separating brush from leaves also helped speed up the collection process . Numerous routine maintenance projects totaling 273 man hours , took up the balance of our time in October . Jobs included : leaf blowing of all trails and lawns ; chipping drop-off brush several times , weekly site inspections and garbage removal ; dead tree removals at Tareyton Park ; installed mileage marker signs as requested by users of Game Farm bikeway ; spread new pea gravel under Hungerford play structures4 ditching along Honness Lane bikeway ; and installation of safety fencing at the Honness Lane entrance to the path . November Parks projects include : final park and trail mowings , Town leaf collection November 11 - 22 , final leaf blowing at all parks and open space sites , installation of walk/entrance to Eastern Heights Park from our right-of-way at the top of John Street , snow removal equipment preparation , continue yard waste management at barns and park lawn fertilizing . Supervisor Raffensperger remarked that she had not included the difficulty with the Newsletter and Jean Swartwood has been trying to discover what has happened to an undetermined percentage of our Newsletters which were not delivered . She has been told a number of theories fr(xn the Post Office including twice at least , being told they are probably in New Jersey . We have instructed the Post Office that if they are found we do not want them mailed , we want our money back as much of the material was dated . She went on to say that -the other item she had not mentioned , and Jean Swartwood just reminded her , was that we had a contact from a resident on Hackberry Lane who wishes to discuss having a lighting district . There are presently only two houses on Hackberry Lane so we will have to get back to them and discuss the implication of that . Building Inspector/ Zoning Officer ' s Report Building Inspector/ Zoning Officer Andrew Frost reported that for the month of October he had issued 18 building permits and 29 certificates of occupancy . Investigated seven complaints for the month with a total of 66 for year . 94 field visits were made . Town Planner ' s Report Town Board Minutes 4 November 7 , 1991 Town Planner Floyd Forman presented the following synopsis of Planning Department activity for the period October 4 thru November 7 , 1991 : Comprehensive Plan Planning staff in cooperation with the Comprehensive Planning Committee (CPC) and Stuart I . Brown Associates continued work on the comprehensive plan . On October 14 , the Comprehensive Planning Committee held an informational meeting at the Women ' s Community Building to present the inventory chapter and inventory maps to the public for their review and comment . Since the meeting , staff and the consultant have focussed on developing and revising the policies for the plan . The Comprehensive Planning Committee held two meetings during this period , on October 8 and 14 . Planning Board The Planning Board met on October 15 and November 5 . The October 5 meeting focussed on the Planning Board ' s role in the comprehensive plan and :how to keep the Board informed about the plan ' s progress . The major focus of the November 5 meeting was the proposed Cornell Tennis Facility . The Planning Board adjourned for 30 days their decision on a recommendation regarding Special Approval to the Zoning Board of Appeals for the Cornell Tennis Facility , The Planning Board felt it needed more information in order to make its recommendation . Some of the issues discussed at the meeting included : building height and mass , location of the building on the site , lighting , parking and traffic . The Planning Board also discussed a minor modification to the roadway of the Deer Run Subdivision . Conservation Advisory Council Planning staff worked with the Conservation Advisory Council (CAC) on the Open Space Inventory Map . Codes and Ordinances Planning staff continues to work with Andy Frost and John Barney to support the efforts of the Codes and Ordinances Committee (COC) . The Committee net on November 6 . The major focus of the COC continues to be consideration of revisions to the Town of Ithaca Zoning Ordinance and other land use regulations . Staff prepared the following recommendations for changes to the Zoning Ordinance : regulations to change the minimum density requirements for business zones , development of a section on landscaping and screening and revisions to the section on special permits . Later this evening , the Town Board will vote on whether to set a public hearing for a local law changing the Zoning Ordinance to provide for minimum density requirements in business districts . COC also discussed other land-use related environmental protection mechanisms which the Town of Ithaca could consider in the coming months , namely , EPOD . Miscellaneous Staff attended October 21 County reapportionment meeting and assisted the Supervisor with a review of various draft proposals . REPORT OF TOWN COMMITTEES CAC Town Board Minutes 5 November 7 , 1991 Councilman John Whitccanb reported that the CAC had approved the Open Space Inventory in concept and sent it back to the Open Space Committee for some finalization which included creating some maps and putting it in it ' s final format . The Open Space Index and Report will be presented to the CAC at the November 14th meeting for it ' s final approval . and then will be forwarded to the Town Board for it ' s consideration at the December meeting . He went on to say that he had also attended the New York State Association of Conservation Councils annual meeting in Rochester recently and brought back with him several interesting things which he was in the process of writing up and would share with all the Town Boards sometime in the future . CPC Councilman Klein remarked that the CPC was anxiously waiting to see the policies part of the Goals and Objectives . Town Attorney Barney stated that they had received notice today that the Lawsuit that was brought by Mr . Van Buren against both the Town and the County for the claimed defects in his title because the taxes were not accessed and levied correctly back in 1932 has been discontinued . seconded by Councilman Klein , In the Matter of The establishment of the Burleigh Drive Lighting District in the Town of Ithaca , County of Tompkins , New York A resolution having been duly adopted by the Town Board of the Town of Ithaca on June 10 , 1991 , directing the Town Engineer to supervise the preparation of a map , plan and report for providing the facilities , improvements , or services in a portion of the Town of Ithaca , wherein a lighting district , hereinafter described , was proposed to be established , and said map , plan and report having been duly filed in the Office of the Town Clerk , and an order having been duly adopted by said Town Board on July 8 , 1991 , reciting the description of the boundaries of the proposed district , the maximum amount proposed to be expended for the improvement , the proposed method of financing to be employed , the fact that a plan , map and report describing the same are on file in the Town Clerk ' s Office for public inspection , and specifying that said Town Board shall meet at the Town Hall , 126 East Seneca Street , Ithaca , New York , on the 12th day of August , 1991 , for the purpose of conducting a public hearing on such proposal to establish the park district with the specified improvements and to hear all persons interested in the subject thereof concerning the same , and. said hearing was , by subsequent order , adjourned to September 9 , 1991 , and a hearing having been duly held by said Board on September 9 , 1991 , at the Town Hall , and it having been duly resolved and determined following such hearing that the notice of hearing was published and posted as required by law and otherwise sufficient , that all the property and property owners within the proposed district were benefited thereby , that all property and property owners benefited were included within the limits of the propose district , and that it was in the public interest -to establish said lighting district , and it having been then and there further duly resolved that the establishment of such district as proposed be approved , subject to permissive referendum in the manner provided in Article 7 of the Town Law , and a certificate of the Town Clerk having been filed pursuant to subdivision 4 of Section 209-e of the Town Law , certifying that no petition vras filed requesting such a referendum , and the permission of the State Comptroller not being required pursuant to Section 209-f of the Town Law it is hereby , ORDERED , that a lighting district be established in the said Town of Ithaca , Tompkins County , New York , to be designated as the Burleigh Drive Lighting District of the Town of Ithaca and to be the following description and boundaries : COBM' NCING at the intersection of the center line of Burleigh Drive with the easterly boundary line of the Village of Cayuga Heights , which point is just north of the northwest corner of Town of Ithaca tax parcel No . 72-1 - 1 . 199 ; BOND RESOLUTION REGARDING SCLIWC ZEBRA MUSSELS CONTROL PROJECT At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Hall , 126 East Seneca Street , in Ithaca , New York , in said Town , on November 7 , 1991 , at 5 : 30 o ' clock , P . M . , Prevailing Time . Town Board Minutes 9 November 7 , 1991 The meeting was called to order by Supervisor Raffensperger and upon roll being called , the following were PRESENT : Councilman David Klein Councilwoman Patricia Leary Councilman Frank Liguori Councilman Karl Niklas Councilwoman Catherine Valentino Councilman John Whitcomb Supervisor Shirley Raffensperger RESOLUTION N0 . 262 The following resolution was offered by Councilwoman Valentino , who moved its adoption , seconded by Councilman Niklas , to wit : BOND RESOLUTION DATED November 7 , 19910 A RESOLUTION AUTHORIZING THE ISSUANCE OF $ 300 , 000 JOINT SERIAL BONDS OF THE VILLAGE OF LANSING , THE VILLAGE OF CAYUGA HEIGHTS , AND THE TOMS OF LANSING , ITHACA AND DRYDEN , ALL IN THE COUNTY OF TOMPKINS , NEW YORK TO PAY THE COST OF WATER SYSTEM IMPROVE201ENTS FOR ZEBRA MUSSEL CONTROL . WHEREAS , the Town Board of the Town of Ithaca , Tompkins County , New York , in conjunction with the Villages of Lansing and Cayuga Heights , and the Towns of Lansing and Dryden has determined and agreed to participate in the provision of a joint water project for zebra mussel control and to contract joint indebtedness therefor in accordance with Section 15 . 00 of the Local Finance Law pursuant to a Supplement to Agreement of Municipal Cooperation for Construction , Financing and Operation of an Inter Municipal Water Supply and Transmission System dated as of October 15 , 1991 (the " Intermuni.cipal Agreement Supplement " ) , and WHEREAS , the project hereinafter described has been determined to be a Type I Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act , the implementation of which as proposed , it has been determined will not result in any significant environmental effects ; and WHEREAS , all other conditions precedent to the financing of the capital project hereinafter described , have been performed ; and WHEREAS , it is now desired to authorize the financing of such capital projects NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca , Tompkins County , New York , if the within resolution in substantially identical form is adopted , approved and made effective by the other participants in the aforedescribed Intermunicipal Agreement Supplement , as follows : Section 1 . For the specific object or purpose of paying the cost of water system improvements for zebra mussel control consisting of the purchase and installation of a sodium hypochlorite chemical feed system at the Raw Water Pump Station at Bolton Point , in the Village of Lansing , together with approximately 400 linear feet of 6-inch carrier pipe containing 1 -inch chemical feed and sample lines , chlorine defuser rings , a protective shroud mounted on the intake screen structure and other incidental improvements and expenses necessary in connection therewith , there are hereby Town Board Minutes 10 November 7 , 1991 authorized to be issued $300 , 000 joint serial bonds of the Town of Ithaca , 'Tompkins County , New York , together with the Towns of Dryden and Lansing and the Villages of Lansing and Cayuga Heights , all of the County of Tompkins , New York , pursuant to the provisions of Section 1 of Article VIII of the Constitution of the State of New York as amended and of Title lA of the Local Finance Law. Section 2 . The maximum estimated cost of the water system improvements for zebra mussel control is $ 300 , 000 , which improvements are hereby authorized at said cost , and the plan for the financing thereof is by the issuance of the $300 , 000 joint serial bonds authorized to be issued pursuant to this bond resolution . The total amount of joint indebtedness to be contracted for said improvements is $300 , 000 and the amount initially estimated to be allocated and apportioned to the Town of Ithaca is $ 155 , 607 Section 30 For the purposes of Section 15 . 10 of the Local Finance Law relating to the allocation of joint indebtedness , the amount of joint indebtedness to be apportioned and allocated to each of said Towns and Villages , shall be in the same proportion as the consumption of water in each of the Towns of Dryden , Ithaca , and Lansing and the Villages of Cayuga Heights and Lansing shall bear to the total consumption of water for the entire joint water distribution facility , which is estimated to be , and for purposes of determining gross indebtedness of each of said municipalities in their respective debt statements pursuant to Section 15 . 10 of the Local Finance Law and therefore the amount to be allocated for the purpose of` ascertaining each of the respective municipalities ' debt contracting powers , shall be as follows : Dryden $ 11 , 922 ( 3 . 9740 ) Ithaca $ 155 , 607 ( 51 . 869 % ) Lansing (Town) $ 30 , 591 ( 10 . 197 % ) Cayuga Heights $ 36 , 201 ( 12 . 067 % ) Lansing (Village ) $ 65 , 679 ( 21 . 893 % ) Nothing in this section shall be deemed to be in conflict with or to supersede the provisions of Section 6 of this resolution relating to the annual apportionment of the amount of principal and interest on the bonds herein authorized to be issued as among said Towns and said Villages , nor the manner of collection and payment of the amounts of annual debt service provided to be apportioned annually by said Section 6 . The Supervisors of said Towns and the Treasurer; of said Villages are hereby authorized and directed to act jointly to make application to the State Comptroller for the allocation. and apportionment of said joint indebtedness in accordance: with the provisions of this section and to perform all acts and furnish all information required in connection with such application . Section 4 ,_ It is hereby determined that the period of probable usefulness; of the aforesaid specific object or purpose is forty years , pursuant to subdivision 1 of paragraph a of Section 11 . 00 of the Local Finance Law . It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years . Section 5 . The chief fiscal officer of the Town of Ithaca to whom is hereby delegated the power to authorize the issuance of and to sell such joint bond anticipation notes , shall file an executed copy of each such bond anticipation note with the finance board of each of the aforesaid municipalities prior to the issuance of the bond anticipation note or notes authorized by such certificate . Section 6 . The faith and credit of said Town of Ithaca , Tompkins County , New York ; said Town of Dryden , Tompkins County , New York ; said Town of Lansing , Tompkins County , New York , said Village of Lansing , Tompkins County , New York , and said Village of Cayuga Heights , `.Pumpkins County , New York , are hereby jointly pledged for the payment of the principal of and interest on said joint bonds as the same become due and payable . The principal of said joint bonds and the interest thereon shall be apportioned annually among said Towns and: said Villages in accordance with the Intermunicipal Agreement Supplement hereinabove referred to in the recitals of this resolution , on the ratio which the consumption of water from the system in each of said municipalities bears to the full consumption from the entire inter-municipal water distribution facility , such ratio to be annually determined in accordance with the aforesaid Intermunicipal Agreement Supplement , the share of said principal and interest to be borne by the aforesaid Towns , shall be annually assessed , levied and collected within said Towns as follows : a ) From the several lots and parcels of land in each of the Water District Nos , 1 , No . 2 , No . 3 and No . 4 of the Town of Dryden , in the manner provided by law . b) From the several lots and parcels of land in the Town of Ithaca Zebra Mussel Control Project Water Improvement Area in proportion as nearly as may be to the benefit which each lot or parcel of land therein will derive therefrom . c ) From the several lots and parcels of land in each of the following Water districts , being McKinney Water District , Lansing Water District No . 2 , Berg Warner Water District , Cima Water District No . 5 , Cima Water District No . 6 and Lansing Water District No . 7 , No . 9 , No . 10 , No . 11 , No . 13 , No . 14 and No . 15 , in the Town of Lansing at the same time and in the same manner as other Town charges . Town Board Minutes 12 November 7 , 1991 The Village of Cayuga Heights shall annually levy and collect a tax sufficient to pay the share of said principal and interest to be borne by said Village , as the same may become due and payable , and the Village of Lansing shall annually levy and collect a tax sufficient'. to pay the share of said principal and interest to be borne by said Village , as the same may become due and payable . If not paid from the aforesaid sources , all the taxable real property in said Town of Dryden , and all the taxable real property in said Town of Ithaca , and all the taxable real property in said Town of Lansing , and all the taxable real property in said Village of Cayuga Heights , and all the taxable real property in said Village of Lansing shall be jointly subject to the levy of an ad valorem tax , without limitation as to rate or amount sufficient to pay the principal of and interest on said bonds as the same become due and payable . Section 70 The validity of such joint serial bonds and joint bond anticipation notes may be contested only of : 1 ) Such joint bonds are authorized for an object or purpose for which said Towns and said Villages are not authorized to expend money , or 2 ) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with , and an action , suit or proceeding contesting such validity is commenced within twenty days after the date of publication , or 3 ) Such joint bonds are authorized in violation of the provisions of the Constitution . Section 8 . Upon the adoption of this resolution by each of the aforesaid Towns and the aforesaid Villages , and the publication thereof with the notice provided for herein , the Clerks of each such Town and each such Village shall file with the Clerk of each of the other Towns and of the Villages a certified copy of this resolution and printer ' s affidavit or affidavits , as the case may be , of publication thereof with the required notice or notices , as the case may be . Section 9 . Pursuant to Section 15 . 00 (m) of the Local Finance Law, the powers and duties of advertising such joint bonds for sale , conducting the sale and awarding the bonds , are hereby delegated to the Supervisor of the Town of Ithaca , Tompkins County , New York , who on her own behalf and on behalf of the chief fiscal officers of the Towns of Dryden and Lansing and the Villages of Cayuga Heights and Lansing shall advertise such bonds for sale , conduct the sale , and award the bonds in such manner as she shall deem best for the interests of the aforesaid Towns and Villages , provided , however , that in the exercise of these delegated powers , she shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds . The receipt of said Supervisor shall be a full acquittance to the purchaser of such bonds , who shall not be obliged to see to the application of the purchase money . All other matters except as provided herein relating to the joint serial bonds herein authorized. including the date , denominations , maturities and interest payment dates , within the limitations prescribed herein and the manner of execution of the same shall be determined by the Supervisor of the Town of Ithaca on behalf of the chief fiscal officers of the Towns of Ithaca , Dryden and Lansing and the Villages of Lansing and Cayuga Heights . Such bonds shall contain substantially the recital of validity clause provided for in Section 52 . 00 of the Local Finance Law , and shall otherwise be in Town Board Minutes 13 November 7 , 1991 such form and contain such recitals , in addition to those required by Section 51 . 00 of the Local Finance Law , as said Supervisor shall determine consistent with the provisions of the Local Finance Law . Such joint serial bonds shall be in fully registered form and shall be signed in the name of each Town and Village by the manual signature of each respective chief fiscal officer and a facsimile of the corporate seal of each Town and Village shall be imprinted thereon and shall be attested by the manual signatures of each respective Town or Village Clerk . It is hereby determined that it is to the financial advantage of each of the Towns and Villages not to impose and collect from registered owners of such joint serial bonds charges for mailing , shipping and insuring bonds transferred or exchanged by the fiscal agent , and , accordingly , pursuant to paragraph c of Section 70 . 00 of the Local Finance Law, no such charges shall be so collected by the fiscal agent . Section 10 . This gives the Town Planning Board some opportunity to exercise discretion and also permit some insulation from surrounding contiguous properties from commercial activities . He felt this was a reasonable request and he understood that the builder representative on COC had no objections . Supervisor Raffensperger asked if this matter had been to the Planning Board? Town Planner Forman replied yes and the Planning Board sent a positive recommendation . Councilman Klein asked , what was the specific change on this ? Councilman Niklas replied , actually quite a bit . In fact , virtually what you see is new. Town Attorney Barney replied , the two acre tract is present law as well as the yards the main thing that is new, is the building coverage , item 3 and 4 . ( Raffensperger , Whitcomb , Leary , Klein , Liguori , Valentino and Niklas voting Aye . Nays - none ) . PRESENTATION BY TOMPKINS COUNTY ENGINEERING DEPT ON THE EAST HILL PLAZA. SAFETY IMPROVEMENTS Town Board Minutes 15 November 7 , 1991 Jim Kazda stated that he had brought some graphics with him , noting that Snyder Hill Road was on one end and Maple Avenue on the other . The main focus of the project has been the Mitchell Street/Pine Tree Road /Judd Fall Road/Ellis Hollow Road intersection . Nothing has been finalized , the Tompkins County Public Works Ccnmittee has reviewed ,sane of the drawings . Therefore , this is not , in any way , the design of the project itself . Maple Avenue caning down to an intersection proposal is to add a turn lane onto Maple Ave as well as a turn lane on Judd Falls to go up to Maple . There is a proposed bikeway/ sidewalk and one of the things we still need to work out with the Town is a detail for tying the bikeway into the bikeway that is to the top of the hill . The whole area is to be curbed with storm sewer and a sidewalk . We have tried to maintain a planting strip between the edge of the roadway and the bikeway or walkway . We haven ' t really decided how the different intersection areas would fall although we have kind of made some provisions . When we get to Mitchell/Judd Falls/Ellis Hollow and Pine Tree the proposal is to "S " curve . There is a possibility that Judd Falls may continue to move to the east and we may end up eliminating the green space between the bikeway and the roadway in order to provide that movement . Because of parking facilities for the tennis area Cornell has asked us whether or not we can slide it down in order to accommodate their parking and Town zoning . We are working very closely with the Cornell staff . There are turning lanes on each of the roadways . Right now we are still unsure of what our recommendation is going to be to the Tompkins County Public Works Committee as far as controlling the intersection . Current analysis is that if Judd Fall /Pine Tree was uncontrolled as an intersection , that the majority of movements through that intersection would be either a Class B or Class A in the level of service . The only two movements below that would be a left hand turn lane fran Judd Falls and a left: turn lane from Mitchell . Councilman Niklas asked for an explanation of Class B and Class A . Mr . Kazda replied , the level of service is an indication of how quickly , easily , comfortably you can pass through or over a roadway or intersection . Class A being your best class . Councilman Whitcomb remarked , you are saying uncontrolled intersection . Certainly that doesn ' t mean the absence of stop signs . Mr . Kazda replied , uncontrolled for Judd Falls and Pine Tree with control on Mitchell and Ellis Hollow . Our concern is again , how the roadway would function with respect to the size of the intersection . We plan on a traffic light in the future at the intersection . We may also need , in the future , to install a traffic light at Maple Avenue . He went on to note that the area had a wetlands which provides us with a natural resource to protect . We are proposing to fill between the roadway and the bikeway and as it is Cornell ' s property they seem to be agreeable . The main reason we separated the bikeway and the roadway is to minimize the amount of fill required through the wetlands . The Snyder Hi =ll intersection has been difficult for sane time and we propose to provide a turn at the bottom and flatten the area out . Councilman. Klein asked what was the basic width of the pavement ? Mr . Kazda replied that the pavement width is a 10 ' driving lane on two lanes with an 11 ' wide lane in the center for a turning lane . Also , there is a 2 ' paved area to the curb . Councilman. Klein questioned the landscape for the area . Town Board Minutes 16 November 7 , 1991 Mr . Kazda replied that they were trying to keep the visual impact as pleasing as possible . They will be doing landscaping in a limited nature . Funding for landscaping , bikeways and walkways is not a priority from the County Highway system . A benefit district is possible . Councilman Whitcomb remarked that even though the bikeway and walkway is in the design there are no funds to fund them , at the present time ? Mr . Kazda replied , nothing has been finalized . They are all County funds , no state or federal funds . Councilman Whitcomb asked what the price of the project was ? Mr . Kazda replied $ 800 , 000 , including design work . Councilman Whitcomb asked what the surface of the bikeway would be? Mr . Kazda replied that the bikeway is an asphalt surface , the sidewalk is concrete . Councilman Whitcomb noted two driveways , by the gas station , coming onto Judd Falls Road . He asked why this was necessary? Mr . Kazda replied , we have started to look at some of the curb cuts from Maple but have not gone any further , it is not final . Roger Farrell , Eastwood Terrace , asked how long would it take the County to do the project and how about inflation ? Mr . Kazda replied that the way the current project is scheduled , design will be completed by March 1992 , bidding in April , construction beginning in May , completion in October or November of 1992 . Eva Hoffmann , 4 Sugarbush Lane stated that she thought it was wonderful to see the bikeway and pedestrian walkway and she hoped it would happen . There has been a great increase in bicycles and pedestrians . She agreed it would be nice to have landscaping , however , whatever is planted on the western side of Pine Tree Road , it should be landscaped very carefully , so that the views of South and West Hill are not obstructed . Councilman. Whitcomb asked if this was an isolated project or was it part of a larger overall comprehensive plan to improve the traffic flow through the East Hill area ? Mr . Kazda replied , this project has been tied up for twenty years awaiting the resolution of traffic from around the City of Ithaca . This right. now is an isolated project to resolve local issues of an area that has developed beyond its capabilities , at this point . Councilman. Niklas remarked that in the thirteen years he had been here he had been driving through the current Andree intersection a great deal. and in recent years a four-way stop sign was put there . It made a tremendous difference , it improved the intersection greatly . He stated that he would like the County to consider whatever Signage is put on that intersection very carefully because it does receive a great deal of traffic . Councilman Whitcomb stated that he would like to underscore the concern that several have expressed on the access and egress from the Andree ' s Gas Station on to Judd Falls Road and he urged Mr . Kazda to do whatever he could to restrict and improve the safety of that acce.c:s to and from the gas station . Town Board Minutes 17 November 7 , 1991 Supervisor Raffensperger asked what the next stage of the process was ? Mr . Kazda replied , once the County Public Works Committee reviews the design and approves the concept we will probably begin our discussions with the business along the area . Also , we are planning to have a public comment session with the local community . Supervisor Raffensperger requested that the Planning Board be given a similar presentation . SET DATE FOR PUBLIC HEARING TO CONSIDER AMENDING LOCAL LAW N0 . 1 , 1983 , (EAST HILL PLAZA FIRE LANES ) . Building Inspector/ Zoning Officer Andrew Frost stated that the Town has a local law that requires a fire lane to run around the parameter of East Hill Plaza and the law basically says a thirty foot distance from the exterior wall of the building outward is the fire safety lane . The Fire Department , months ago , voiced concern that in the back of the building , if they were to approach the building and attempt to access the roof of the building , in the area approximately by Warehouse Carpet Outlet and the Rite-Aid , access with cars parked in the area in back of the building would be difficult . They requested , during the time East Hill Plaza was repaving and restriping their parking area that an access lane , rather than running thirty foot along the outside of the building , that there would be a strip approximately thirty foot wide running perpendicular to the building . That way equipment could have access and distance to raise an ladder . RESOLUTION N0 . 268 Motion by Councilman Niklas ; seconded by Councilman Klein , RESOLVED , that the Town Board of the Town of Ithaca will meet and conduct a public hearing at 8 : 30 P . M . , on December 9 , 1991 to now M� Erllmz�=n Town Board Minutes 18 November 7 , 1991 consider amending Local Law No . 1 , 1983 (East Hill Plaza Fire Lanes ) . Raffensperger , Whitcomb , Leary , Klein , Liguori , Valentino and Niklas voting Aye . Nays - none ) . WORK PERMIT TO CONSTRUCT MITCHELL STREET WALKWAY Town Engineer Dan Walker noted that the Mitchell Street Walkway as originally designed had some questions of safety raised by the County Highway Department do to the problem of getting some easements . From Maplewood down to Vine Street there are a lot of children that come up Maplewood and go down to the school . The County recognizes that and we are in the process of getting a work permit for Monday for that portion of it , which they have accepted . It will probably cost of total of $ 1 , 500 . Supervisor Raffensperger stated that she was going to try to get some funds from the County . One of the Representatives had discussed this with her and said there might be some funds in contingency that they could contribute to that section of it since it was not part of the original design . The Town Engineer went on to say that the section from Maplewood going up to the cemetery , the first section of it , has a stone wall along the cemetery which limits how far back we can go . The stone wall is basically on the right-of-way line . The County has come up with the need for drainage in this area and the aspect of separation. of traffic from the pedestrians because we would have about a five foot wide area between the edge of the shoulder and the edge of the walkway which does not provide very much visual separation. or any kind of separation for the pedestrians . They are hesitant -to grant us a work permit , at this point , do to the proximity . Originally we had designed this to run through the cemetery on the opposite side of the large trees , the cemetery has refused to grant us an easement to do that . We could go public domain but. then we would have to pay fare value . The cemetery has put a value of $30 , 000 to $ 50 , 000 on that walkway area . We have not moved to walkway to the road side of the trees . This would require us to have a little bit of a retaining wall between two feet and four feet high to protect the roots of the trees . It puts us within four feet of the shoulder with a shallow ditch and a little bit. of a slope downwards . The County has expressed a lot of concern about that . One of the suggestions that the County has made to us is that may be a shift in the road would be appropriate , about ten feet . Councihnan. Niklas asked why the County was concerned about the retaining wall . Town Engineer Walker replied that there was poor site distance there . Their concern is basically the concern we have , right now people are walking on the shoulder . There is a rise on the curve and it is very difficult to see over the rise . There is not much separation between traffic lanes and pedestrians , even with a five to seven foot separation between the edge of the pavement and the edge of the sidewalk . The County has proposed that the County would be willing to shift the road ten feet and provide some grade modifications to make better site distance and moving it away from the bank to provide additional room for the walkway . Councilman Niklas asked how much would this cost? The Town Engineer replied , in their initial discussions they stated that they would do all the road relocations . There is nothing in Town Board Minutes 19 November 7 , 1991 writing yet . There have also been some discussion of the County giving the Town the road so that they wouldn ' t have to worry about the walkway . Today , they talked about fixing it up , allowing us to have the walkway and still keep the road . Right now , the Town does the plowing and the County does the sanding . There is a wet spot in the road and the County has been concerned about this for several years along with the site distance . In order to get a safer walkway along the road they are considering some improvements to the road also . Supervisor Raffensperger asked , when would the shifting of the road occur? Town Engineer Walker responded , they were talking that if the Town assists in doing the survey and design work , they are talking construction next spring . He went on to say that he wanted to ask the Board for authorization to go ahead and assist in the survey and design of this . It was the consensus of the Board to proceed with the design and survey work . PUBLIC HEARING TO CONSIDER THE ADOPTION OF A LOCAL LAW SETTING A FEE FOR TEE REQUIRED FIRE SAFE'T'Y INSPECTIONS Proof of posting and publication of a notice of public hearing to consider the adoption of a local law setting a fee for the required fire safety inspections having been presented by the Town Clerk , the Supervisor opened the public hearing . Building Inspector/ Zoning Officer Andrew Frost stated that the Town had passed. Local Law No . 10 in 1991 that provided for some increase in fees and in the process also required fees for operating permits and use permits . We did not provide authority for use permits that would include commercial establishments , areas of public assembly , etc . We have conducted these inspections in the past and have not received any fees for it and this law would provide for us to collect these fees . As no one in the public wished to speak , the Supervisor closed the public hearing . Councilman. Niklas remarked that inspection could be interpreted a number of ways . He asked if it means that it is $ 25 . 00 to inspect and complete the process or does it mean it is $ 25 . 00 every time you go out: to take a look? Suppose it is not quite right and you say look , this needs to be fixed up , does that mean you just charge $ 25 . 00 ? Building Inspector/ Zoning Officer Frost replied that his initial response would be that the $ 25 . 00 would cover basically the use permit and. as many inspections as were required to comply . Councilman. Klein remarked , every time you go back that is another inspection . Town Attorney Barney remarked that technically we could charge every time that we go out there . Mr . Frost has interpreted this as being a process fee rather than a pure inspection fee . But , if you had somebody who had you go out there six times you could cone back and say you now owe more money . Sometimes it is good to be a little bit vague because it allows for a degree of flexibility . If the Town Board would like a number of inspections included he could change the law . Town Board Minutes 20 November 7 , 1991 LOCAL LAW N0 . 17 - 1991 Motion by Councilman Niklas ; seconded by Councilman Valentino , LOCAL LAW NO . 17 - 1991 A LOCAL LAW AMENDING THE TOWN OF ITHACA ZONING ORDINANCE REGARDING THE ADDITION OF FEES FOR CERTAIN INSPECTIONS Section 1 . The Zoning Ordinance of the Town of Ithaca as re-adopted , amended , and revised , effective February 26 , 1968 , and subsequently amended , be further amended as follows : 1 . The title to Section 76-A is amended to read "Fees for Use Permits , Operating Permits , and Inspections " . 2 . Section 76-A is further amended by adding a new subparagraph 3 reading as follows : " 3 . The fees for other inspections by the Building Inspector or Zoning Enforcement Officer required by State law or other regulation , such as required annual inspections of areas of public assembly , shall be $ 25 . 00 per inspection " . Section 2 ., In the event that any portion of this law is declared invalid by a court of competent jurisdiction , the validity of the remaining portions shall not be affected by such declaration of invalidity . Section 3 ., This local law shall take effect upon its publication as required by law . The Supervisor called for a roll call vote . PUBLIC HEARING TO CONSIDER THE ADOPTION OF AN INCREASE IN THE WATER BENEFIT LEVY BY $ 16 . 00 FROM $ 64 . 00 TO $ 80 . 00 PER UNIT Proof of posting and publication of a notice of public hearing to consider the adoption of an increase in the water benefit levy by $ 16 . 00 frcm $ 64 . 00 to $ 80 . 00 per unit having been presented by the Town Clerk , the Supervisor opened the public hearing . As no one present wished to speak , the Supervisor closed the public hearing . Town Board Minutes 21 November 7 , 1991 Councilman Liguori asked , when was the last increase . Supervisor. Raffensperger replied , in 1989 . It was raised $ 10 . 00 . RESOLUTION N0 , 269 Motion by Councilman Niklas ; seconded by Councilman Liguori WHEREAS , the current water benefit levy for the Town of Ithaca used for the purposes of calculating the water and seer benefit assessment is $64 . 00 per unit , and WHEREAS , said water benefit was established in November of 1988 , and WHEREAS , the cost of providing the water services and funding the additions to the water systems have increased since 1988 , NOW THEREFORE IT IS RESOLVED , that the Town Board of the Town of Ithaca hereby approves an increase in the water benefit charge from $ 64 . 00 per unit of water assessment to $ 80 . 00 , and IT IS FUXYHER RESOLVED , that said increase assessment be the basis for determining the water and sewer benefit assessment roll for the year 1992 . Any time one of our roads intersect with a State or County Road it is their responsibility to place the traffic control device . He went on to say that in addition to Whitetail Drive , Teton Court and Saranac Way , a traffic control device was needed on the corner of Birchwood Drive South and Pinewood Drive . APPOINTMa\IT OF BUILDING INSPECTOR/ ZONING OFFICER AS ISSUING AGENT FOR FIREWORKS PERMITS Andrew Frost stated that Ithaca College , for New Year ' s Eve will be having a one hundred year celebration and will be having a massive fireworks display at mid-night . The New York State Codes Bureau advises treat it would be appropriate for the Building Inspector to be the permit issuing official . RESOLUTION N09 273 Motion by Councilman Klein , seconded by Councilman Whitcomb , WHEREAS , the Town Board heretofore appointed the Town Clerk as the permit authority for the issuance of permits for public displays of fireworks pursuant to Section 405 of the Penal Law, and WHEREAS , the duties relating to such permit include enforcing the provisions of the Penal Law as well as any conditions that may be imposed on, the permit , and Wf,IEREA.S , pouch enforcement activities are normally conducted by the Town ' s Building Inspector and Zoning Enforcement Officer , and WHEREAS , it would be more efficient for the permit authority and the enforcement authority to be the same individual or department , NOW THEREFORE IT IS RESOLVED , that the resolution previously adopted appointing the Town Clerk of the Town of Ithaca as permit authority for the issuance of permits for public displays of fireworks pursuant to Section 405 of the New York State Penal Law be and the same hereby is rescinded and repealed , and IT IS FURTHER RESOLVED , that the Building Inspector and Zoning Enforcement Officer of the Town of Ithaca be and such officer is hereby designated as the "permit authority " pursuant to Section 405 of the New York State Penal Law for the purposes of issuing permits for public displays of fireworks to occur within the Town of Ithaca , and IT IS FUI:MM RESOLVED , that in the absence of the Building Inspector and Zoning Enforcement Officer , the Assistant Building Town Board Minutes 23 November 7 , 1991 Inspector and Zoning Enforcement Officer be and such officer hereby is authorized to issue such permits for the public displays of fireworks , and IT IS FURTHER RESOLVED , that in reviewing applications for permits for public. displays of fireworks , the Building Inspector and Zoning Enforcem .,it Officer may require , in addition to the information , documents and other items to facilitate the complete and competent review of the proposed application , and IT IS FURE- ER RESOLVED , that the permit issuing authority hereby is authorized to impose such reasonable conditions as may be necessary in order to protect the public , the neighborhood , and the area from any significant adverse effects that might result from the display of fireworks . PUBLIC HEARING TO CONSIDER APPROVAL OF 1992 TOWN OF ITHACA PRELIMINARY BUDGET Proof of :posting and publication of a notice to consider approval of 1992 Town of Ithaca Preliminary Budget having been presented by the Town Clerk , the Supervisor opened the public hearing . As no one in the public wished to speak , the Supervisor closed the public hearing . The Supervisor noted a change in Water and Sewer Capital Projects between the Tentative and Preliminary Budget . The estimated revenues have been increased . On page 6 you will see the line item , City of Ithaca Youth Bureau , which prompted the change . The Tentative Budget showed an estimate , the actual contractual amount came in at $ 168 , 885 . The Human Services Coalition budget was $50 . 00 less , therefore , this line item was reduced by that amount . On page 14 , in the Water Budget , a clerical error put 504 more units on our water and sewer units . On page 15 , Tank Security Improvements and Pump Station Improvements have been reduced by $ 20 , 000 . On page 17 , the same applies to the Sewer Budget and on the next page the Northeast Sewer Rehab has been reduced by the same amount . On page 23 , we received revised assessed value figures , :;o that the tax rate for general fund has increased from $ 1 . 100 to $ 1 . 111 . The Fire Tax rate has gone from $ 2 . 033 to $ 2 . 049 . They want to close on at least one of the lots to develop some revenue so that they can pay the contractor who is developing the project . No building permits can be issued until the road has been accepted . Town Attorney Barney remarked that he had drafted an agreement where basically they agreed to complete the road to certain specifications , with security determined by the Town Engineer and based on that we have accepted title to the road . Councilman Liguori stated that he had received a telephone call today and there were a couple of items that Carl Sgrecci had asked him to clarify . It appeared to him that the agreement , as drafted , will require him to plow the road all winter long . They are going to sell a lot but there is no point in plowing the road unless the person who is going to buy a lot wants entry for some reason or other . HE! asked for clarification . Town Attorney Barney replied , the agreement provides that they maintain the road and that they will plow it until they have completed the road . Councilman Liguori asked if the agreement could say as need ? Town Attorney Barney replied if that is what you want , he did not think that: was a problem . Councilman Liguori added , they thought that every time there was a snow storm they had to go out there an plow it . Highway Superintendent McConnell remarked , that he thought they should as the Town was accepting it as being taken over as a public right-of-rvray . If someone wants to go look at those lands , even in the winter , and they want to travel that road they are open to do its If it is not plowed , the contract also says we are waiving liability for any damage , so it ' s their liability . They should feel obligated to keep it open to public travel which is what he is asking foil . Councilman Liguori replied let me point out again from a practical point of view, they are negotiating with only one party and that party is not going to build until spring . They don ' t feel that they ought to have to go out there every time there is a snow storm , the entire winter , and plow the road . Highway Superintendent McConnell replied that what he was saying VMS that they ought to feel obligated because they are going to be liable for it and it is a public right-of-way . It would be just like him saying he didn ' t want to go out and plow because the storm isn ' t bad enough and there is only one person living on that road and he isn ' t going to go this way or that . He understood that no one live: there but if they are opening it for a public right-of-way then it is open to the public . Town Attorney Barney replied , we can handle that a little differently by simply not accepting title until the end of February . Councilman Niklas asked if it would be possible to accept title when and if someone buys . Town Attorney Barney replied , the problem is the people are , at some point: , going to want a building permit . We could say that they will plow it and keep it open once a building permit has been issued . Town Board Minutes 25 November 7 , 1991 Town Engineer Walker remarked , they have to have a public road there or the agreement is void . Councilmani Liguori replied once scnebody owns that lot , if they want it plowed they have a right to ask him to plow it . He just doesn ' t want it to be a must that he has to keep it open . Councilman Niklas remarked , we can ' t give special acceptions to people . If we are accepting the road , it seemed to him that it was their obligation to maintain it . Town Attorney Barney replied , we have taken roads in the past under these circumstances . We have not demanded them to be fully completed „ Town Supervisor Raffensperger remarked , so the conclusion about this particular item of the agreement is that it will remain as is and that -they are to be expected to plow and keep it open because it is a Town road and the Town doesn ' t want the liability . Councilman Liguori replied , you don ' t have the liability . Isn ' t he putting up a million dollars worth of insurance ? Town Attorney Barney replied yes , we are expecting . . . the agreement calls for him to provide insurance . But the fact that he is putting up insurance doesn ' t necessarily mean . . . the best way to avoid liability is not to have the accident in the first place . If we can arrange it so there is a reduced likelihood of an accident and that means keeping the road reasonably passable , then he felt the Town was better off . He felt this was the way the Town should be going because they were really doing it as a favor to them to take it now going into a winter season . If they want us to do that favor it seemed to him they should be prepared to take care of the road in a way that minimizes either one being involved in a law suit . Supervisor Raffensperger asked if there was any reason why the road could not be posted as closed for no winter maintenance . Town Attorney Barney felt this could be done . Supervisor Raffensperger suggested that the Board go ahead and accept the road with the kinds of conditions the Town Attorney has in the agreement and with the understanding that they are to maintain it . Then we could look into the possibility of posting it as a seasonal road which would releave them of that responsibility . Councilman. Liguori remarked that he thought the problem was that we must have given him the impression that he had to keep it plowed all the time . We are dealing with people here . RESOLUTION N0 . 275 Motion by Councilman Niklas ; seconded by Councilman Liguori , WHEREAS , with respect to the proposed Shalebrook Subdivision , Town of Ithaca Tax Parcel No . 27- 1- 11 . 2 , located at 1138 Trumansburg Road , the Town of Ithaca Planning Board , acting as Lead Agency in the Environmental review of this Unlisted Action , has made a negative determination of environmental significance for this action , and WHEREAS , the Town Board has , on July 9 , 1990 , accepted the location of roads and utilities for the proposed Shalebrook Subdivision , and Town Board Minutes 26 November 7 , 1991 WHEREAS , -the Planning Board granted Final Subdivision Approval for Phase I-P, of the "Shalebrook " subdivision on November 6 , 1990 , conditioned upon approval of the final drainage design and other construction details by the Town Engineer , modifications of the deed restrictions as requested by the Town Attorney , and conveyance of the strip of land between lots 10 and 11 to the Town of Ithaca in fee simple instead of in easement form , and WHEREAS , the Shalebrook Development Corp . , has substantially completed construction of Perry Lane , culverts , storm drainage improvements and water and sewer mains , except for final pavement of Perry Lane , and WHEREAS , preliminary inspection has been performed by the Town Engineer and Town Highway Superintendent on Perry Lane , and a final inspection of the drainage , water main and sanitary sewer has been completed by the Town Engineer , NOW THERE]FOR IT IS RESOLVED , that the Town Board of the Town of Ithaca hereby accepts said Perry Lane as a Town Highway , the length being 1000 linear feet from the center of Bundy Road to the center of the cul de-sac , and FURTHER BE IT RESOLVED , that it be subject to the following condition_; The Agreement be executed for final completion in a form satisfactory to the Town Supervisor and the Town Attorney . MODIFICATIONS OF WHITETAIL DRIVE Town Engineer Dan Walker remarked that a couple of week ago we received a. call from Mr . Hallberg who was laying out the last phase of the Deer Run subdivision which is Whitetail Drive . The subdivision that was approved by the Planning Board and the road location that was accepted back in ' 89 by the Town Board had a bulge in it and an island . In the process of doing the layout they found a grove a mature maples that had to be removed . They want to save the trees so we walked the area and eliminated the island which was a very unpopular element . He felt this was a very minor modification to the subdivision . The Planning Board did not have a problem with the modification but will have a formal hearing at the next Planning Board meeting and then take a vote . PUBLIC HEARING TO CONSIDER APPROVAL OF THE 1992 SOUTHERN CAYUGA LAKE INTERMUNICIPAL WATER COMMISSION Town Board Minutes 27 November 7 , 1991 Proof of posting and publication of a notice of public hearing to consider ,approval of the 1992 Southern Cayuga Lake Intermunicipal Water Commission having been presented by the Town Clerk , the Supervisor opened the public hearing . As no one wished to speak , the Supervisor closed the public hearing . Supervisor Raffensperger stated that there have been no changes to the SCLIVk" budget since the Temporary Budget was presented last month .
