YEAR END MEETING
December 31 , 1990
At the Year End Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Hall , 126 East Seneca
Street , Ithaca , New York , there were :

REPORT OF 'DOWN OFFICIALS
Town Supervisor ' s Report
Town Supervisor Shirley Raffensperger stated that she had made a
comparison of the 1991 tax rates in Tompkins County and she thought
it was important to assess where the Town of Ithaca stands in
comparison with the other Towns in Tompkins County . She felt it
was important for people to realize that much of the distribution
of increase has to do with reassessment as opposed to any action
the Town took as far as taxes are concerned . She went on to say
that it was customary at the Year End Meeting for the Supervisor to
review socu2 of the major activities the past year . The Supervisor
went on to say that 1990 was a year of many initiatives with Town
Board members and staff taking major responsibility for the success
of these activities . The Town Board in addition to the customary
Town committees and representation on intermunicipal boards
established a Comprehensive Planning Committee and an Environmental
Advisory Council . The CAC and numerous subcommittees have set the
ground work for a comprehensive plan for the Town of Ithaca and
plans to complete the first phase of that work in mid 1991 . The
Environmental Management Committee responded to a request from the
Town Planning Board and has completed a Six Mile Creek Valley
report for their ' s and the public ' s information . A CAC
environmental review committee reviews development applications and
other CAC committees are working on components of the master plan .
She noted that each of the committees plan progress reports for the
first of the year along with work plans for 1991 . The Town
Supervisor went on to say that the Codes & Ordinance Committee has
been most active presenting to the Boards a number of revisions to

our Zoning Ordinance with additional revisions on their and our
agenda for the coming year .
Supervisor Raffensperger noted that the Town came into this year
absent a Town Engineer , that position has been filled by Dan
Walker , Scott McConnell was appointed Highway Superintendent and
with Dan has set up a program of mutual aid and cooperation that
has already paid substantial dividend in efficiency and cost
savings to the Town . She went on to say that 1990 was a difficult
budget year for the Town of Ithaca with a substantial short fall in
budgeted :revenues . Sales tax revenues were over $ 145 , 000 short ,
State Aid cuts added to the budgetary problems . The state of the
general economy as it will effect sales tax revenues and New York
State ' s budget problems will necessitate careful monitoring of the
Town ' s budget during the coming year . The 1991 budget was
reorganiZed , as required by Audit and Control . While difficult , it
was necessary and establishes a more equitable system for the
future . Other activities of the Town during 1990 included the
enactment and implementation of a development review fee system and
a substantial improvement in the system of handling developmnt
applications .
The Supervisor went on to say , with Audit and Control approval ,
engineering services and bond anticipation notes were obtained for
the 1989 Water and Sewer capital projects . A portion of that
project i:) under construction and the remainder of that project
will go out to bid early in 1991 . An improved system to monitor
capital expenditures has been put in place . The Trumansburg Road
sewer agreement was finalized , an amendment to our fire contract
was negotiated , two new fire stations have opened in the Town of
Ithaca . Contracts for youth services , the services of the planning
consultant , etc . , were completed as were revisions to the Personnel
Manual . Many responsibilities , some from the past , more looking to
the future! remain to be dealt with . The Town Board will look at
draft priorities for 1991 next week and she looked forward to Town
Board and staff input during that process . Finally , she stated
that she would like to thank all the members of the Town Board for
their active participation in the affairs of the Town this year and
for the unfailing and good humored cooperation they have given her .
As a long time Town Board member she had been aware of the fine
level of :services that the Town staff provides to Town residents
but it was not until this year that she came to appreciate fully
the level of confidence and commitment they bring to their jobs .
She stated that she was most appreciative of their and the Boards
support and help and she looked forward to working will all in
1991 .
Nancy Fuller remarked that all appreciated the Supervisor ' s
compliments to the Town staff . She stated that she did not want to
speak for the entire staff but she was sure that she did . She went
on to say that it has been a pleasure working with the Supervisor ,
as a new Supervisor . She had been through two Supervisors whom she
had enjoyed very much and she has particularly enjoyed Supervisor
Raffensperger ' s tenure . You have come in with remarkable ease . It
has been particularly fun to have the Supervisor around a lot .
There were a lot of concerns , she stated that she could tell the
Supervisor ,, about having the boss around . However , speaking for
herself , she appreciated having the Supervisor accessible . We look
forward to 1991 and hopefully many more years so that you will be
up there with the eight , ten whatever number of years of our
previous Supervisors .
Town Engineer ' s Report
Town Board Minutes 3 December 31 , 1990
Town Engineer Dan Walker stated that this month has been fairly
busy , we have Troy Road under construction and almost all of our
water main has been replaced . We have finalized the plans and
specifications for the West Hill water and sewer projects and
expect to go out to bid on February 1 with construction to start
late this winter or early in the spring . We are in the final
design phases of the Inlet Valley Water and Sewer Project and have
had a very comprehensive design review with the consultant and
found some things that needed to be revised . We expect to get
those out to bid by March 1st with construction to start April or
May first . The Engineering Department has been working with the
Planning .staff to prepare a base map for the comprehensive plan .
The Town .Engineer stated that they were working with the City to
tie up loose ends on the water and sewer agreements . One major
project that is being done with Cornell University and the Town of
Dryden is the Route 366 water main extension and he felt they were
close to getting an agreement for the Town Board to look at . He
stated that he was starting to get into the final plans of a sewer
inventory system and plan to do a very comprehensive inventory of
the problEm areas and also water where there are major brakes . He
noted that. Cornell was preparing the final draft proposal for GEIS
and they hopefully will present that to the Planning Board in
January . Ithaca College is in the initial stages of their
comprehensive plan and sometime in the spring we will be involved
in a GEIS process , also . As an end of the year rap up , it has
been , for him , a very interesting and exciting nine months . It ' s a
very nice Town to work for and he has enjoyed working with the
Board and the Supervisor , the staff has been extremely helpful .
Highway Superintendent ' s Report
Highway Superintendent Scott McConnell stated that the first page
of his annual report covered the general costs and the amount of
work and then the report is broken down by job and the individual
costs . Page six is a cost per vehicle and page seven is a summary
and the last page is a graph showing the amount of work done by the
Highway Department . He also noted the annual report of the Parks
and Open Space Manager highlighting the work they have done this
year and the work they plan on doing in 1991 which hopefully is the
South Hill. Trail . He went on to note that December has been a
quiet month with only a little bit of snow . They are trying to
finish up .Park Lane , the drainage work is in the ground and almost
completed .
Acting Town Planner ' s Report
Acting Ton Planner George Frantz reported that the Board had a
copy of the Planning Board ' s monthly report . Essentially we have
continued to work on the comprehensive plan with Susan Beeners
working on the mapping in cooperation with the Engineering
Department . In-house he has been working on a tax parcel base map
which is basically editing a map prepared by Stuart Brown earlier
this summer . There has been very little project review by the
Planning Board the past month , three subdivisions of three lots or
less with no public improvements involved . We have completed a
report on the development review fees and escrow system . Mr .
Frantz stated that they have also been working on signs which
property owners can post on their properties to alert the public of
potential Planning Board action . The major task of his the last
month has been answering phone calls and meeting with members of
the public who have cone in and expressed interest on the Six Mile
Creek Valley report . He noted that they had begun working on the
South Hill Recreation Trail project again and he had been meeting
with City staff to clarify what they need in order to clear the way

for a building permit for the portion that is in the City and some
additional minor - ivork on easements . In the coming months he will
be coordinating the project with both Rich Schock and Scott
McConnell and hopefully they can begin this summer .
REPORT OF TOWN COMMITTEES
Conservation Advisory Council
Councilman Whitcomb stated that the CAC has not met since the last
Town Board meeting but a couple of the committees have met and
right now they were looking forward to the public presentation on
the Six Mile Creek plan in January .
Codes and Ordinance Committee
Councilman Niklas reported that the Town Planning Board in December
reviewed three of the proposals for the Zoning Ordinance which
included exempting subdivisions from the the current regulations in
Section 77 regarding fill and grading , and related occupancy in a
mobile hone park districts and the third concerns occupancy in
buildings . These three suggestions that will be made to the Town
Board will probably be on the January agenda . Codes and Ordinances
has considered and is considering some rather significant and
extensive modifications to the special permit aspects of the
current Zoning Ordinance and he hoped these would get to the Town
Board fairly soon . They are also discussing the suggestion from
the CAC , regarding a conservation district . He stated that he and
Councilwoman Valentino had promised the COC that they would pole ,
unofficially , members of the Town Board and we tried to reach as
many as we could , concerning the Board ' s thoughts about the
conservation district proposal . He felt it was safe to say that
the consensus of the Board members that were reached , there seemed
to be some concern with regards to the number of dwelling units and
it was felt that perhaps a better way of looking at this would be a
formula based on contiguous properties in sites that would be
considered to be encompassed within this conservation district . He
asked the Town Attorney about the legalities of sane kind of a
formula for density and/or the particular situation of the
properties being considered in this conservation district . He
asked the Town Attorney to pursue that . Also , we have in our
folders a document with regard to the Town Planning Board reviewing
the sunset period for permits . They have made a number of
suggestions3 and suggest that those suggestions be given to Codes
and Ordinance . He stated that he had read the documents and
remembers historically that a similar suggestion was made by our
now Town Supervisor , that we have some kind of limit period as to
whether or not construction or development on sites is permitted
after the approval of those developments and he thought the period
was eighteen months . He stated that he did not know what the COC
will say about the eighteen months . Councilman Niklas stated that
he would lake to end his report by saying that he has enjoyed very
much serving with the members of Codes and Ordinance , the staff ,
the Town Attorney and the representative from Planning staff and
the Building Inspector .
Councilman Klein questioned , CDC will be looking at the sunset law ,
he imagined that eighteen months would be one of the more
controversial items . He felt eighteen months was very much on the
short side „
Councilman Niklas replied that he could not say what COC will say
about the eighteen months . But he felt discussion of the
particular: right now was very premature as the request has not

even reached the COC . It has only been recommended by the Planning
Board ,
Town Attorney Barney remarked that the Town did have a sunset
provision in place in regard to variances and rezoning . We do not
have it in respect to site plan , subdivisions .
Councilman Liguori stated that he agreed with Councilman Klein that
eighteen months was too short of a period of time . As he recalled
it the comment was that land uses might change within that period
of time and it seemed to him highly unlikely that land use was
going to change within a period of eighteen months . That was
stated as the reason it ought to be whatever it is and he felt it
should be a longer period of time . Subdivisions are not really
moving that fast in terms of lot development and he felt the Board
needed to be careful and recognize that lots are not selling that
fast .
Councilman Klein remarked that he was thinking in terms of getting
financing together and getting documents prepared , there is just so
much time involved that it just struck him that eighteen months was
an unrealistic time period .
Councilman. Niklas asked Councilman Klein if he would care to give a
more realistic time period .
Councilman Klein replied , probably sanewhere between two and three
years . But as Councilman Niklas had Harrison Rue on his committee
he felt Mi.' . Rue would know what a more typical time period would
be .
Comprehensive Planning Committee
Councilman Klein reported that the December 11th meeting was
reasonably brief and basically it was to review documents prepared
by the staff . Most notably was the goals and objectives section
which has been substantially written by John Cyzmanski , it was
Chapter 5 it is now Chapter 3 . It was generally felt this was a
significant improvement over earlier chapters , it was shorter , more
concise . The comments were do back to John last Friday . We are
slipping a bit but we are making forward progress .
PUBLIC HEARING TO CONSIDER AMENDING THE ZONING ORDINANCE REGARDING
DESIGNATIai OF CHAIR OF THE ZONING BOARD OF APPEALS TO CONFORM WITH
TOWN LAW
Proof of posting and publication of a notice of public hearing to
consider amnding the Zoning Ordinance regarding designation of
Chair of -the Zoning Board of Appeals to conform with Town Law
having been presented by the Town Clerk , the Supervisor opened the
public hearing .
Town Attorney John Barney stated that for sane reason or other , our
Zoning Ordinance when it was drafted a number of years ago provided
that the Chair of the Zoning Board of Appeals was elected by the
members of the Zoning Board of Appeals . Town Law in Section 267
provides for the Chairman to be designated by the Town Board . The
Town Board could , if they so choose , elect to supersede the Town
Law but his concern , right now , was that we have two inconsistent
provisions ,, the Zoning Ordinance saying one thing and Town Law
saying sanething else . In view of the fact that the Town Board
does designate the Chairman of the Planning Board it seemed
appropriate to bring the Zoning Ordinance in conformity with State
1.
Law and this is what is the proposed local law does .

Motion by Councilman Niklas ; seconded by Councilman Whitcomb ,
LOCAL LAW # 15 - 1990
A LOCAL LAW AMENDING , THE ZONING ORDINANCE REGARDING DESIGNATION OF
CHAIR OF THE ZONING BOARD OF APPEALS TO CONFORM WITH TOWN LAW
The Zoning Ordinance of the Town of Ithaca as readopted , amended
and revised effective February 26 , 1968 , and subsequently amended ,
be further amended as follows .
1 . Article XIV , Section 77 , subdivision 2 , is amended by deleting
the first sentence thereof and inserting instead the following .
"The Town Board shall designate the Chairman of the Board of
Zoning Appeals . The Board of Zoning Appeals shall choose its
own Vice-chairman who shall preside in the absence of the
Chairman . "
29 This local law shall take effect upon its publication as
required by law .

Local Law No . 15 - 1990 was thereupon declared duly adopted .
TOWN COMMITTEE REPORTS
Youth Services
Councilwoman Valentino reported that they have had a slow start
last year looking into the idea of a Town youth board but they did
have a meeting in December and now have a commitment from the
County for staff to work with them . She felt that this was what
was needed to help them along .
Ethics Committee
Councilwoman Valentino reported that the Ethics Committee is
waiting to hear back from the State as they have sent the proposal
to them and asked for their cotmnents .

Town Atto:mey ' s Report
Town Attorney Barney stated that he wanted to second some of the
things that Nancy Fuller had said and also to commend the Town on
the positions they have taken . He felt he had sat through an
excess of 75 meetings and he was always impressed at the quality of
work that all of the bodies do and the quality of discussion . It
is impressive because he stated that he does sit on other boards
outside of the Town . It is always a delight to work with the Town
and while there are , on occasions , differences of opinion one gets
the sense that they are based on strong feelings about issues but
not personalities . He thought that the actions that the Town has
taken , as far as litigation , have an indication of the wisdom of
the Board ' s actions because to date whenever we go to court the
Judge agrees with your action . He felt that was a reflection on
the choices the Town was making and the way they are making the
choices . He stated that he would also like to think it was the
help the Town was getting from the Town Attorney ' s office . Lastly ,
he stated that he would like to say that it has been a pleasure
working with Supervisor Raffensperger and that he had the chance of
working with Noel Desch for about three years before he left office
and you develop a rather close relationship with the Supervisor on
a day to clay basis . He went on to say that he was sure Supervisor
Raffensperger , even though she was kind enough to express it ,
certainly had some reservations shifting gears and working with an
attorney that worked quite close with the previous Supervisor . He
stated that he never mentioned this to Supervisor Raffensperger but
he had some of the same reservations from time to time . But over
the course of the year he came to really respect the Town
Supervisor and admire the way that she stepped into a position and
has handled that position on all levels . He went on to thank the
Supervisor for letting him work with her this year .
PUBLIC HEARING TO CONSIDER ESTABLISHING COMPENSATION FOR TOWN OF
ITHACA PLANNING BOARD AND ZONING BOARD OF APPEALS MEMBERS
Proof of posting and publication of a notice to consider
establishing compensation for Town of Ithaca Planning Board and
Zoning Board of Appeals members having been presented by the Town
Clerk , the Supervisor opened the public hearing .
Supervisor Raffensperger remarked that this was noted in Audit &
Control ' s report and suggested that the way in which the Town had
been compensating our Planning Board and Zoning Board of Appeals
members needed improvement and that we needed to have a local law
to do this . She noted that there is no change in what the Board is
proposing -to do , Planning Board members and Zoning Board of Appeals
members have always been compensated in the fashion that we are
proposing . It is just to bring us into Audit & Control ' s favor .
The Supervisor noted that the Town Attorney did have some concerns
about the Town doing it as a local law and the Board members have
in their folders a memo from the Town Attorney about it . She
stated that she did redraw the resolution that you have to reflect
that this is being done today as a resolution and not as a local
law and if we decide to go the route of a local law we will do that
in February .
As no one present wished to speak , the Supervisor closed the public
hearing .
Town Attorney John Barney stated that he had spoken . to the
gentleman at Audit and Control because he was a little bit puzzled
when he read the law saying there ought to be a local law saying
YOU can orLly compensate on this basis and when they tell him he
could argu(; he knew they were a bit hesitant about the opinion . It

is unclear , even in their mind , that you necessarily have to have a
local law but the auditors have to operate under the opinions that
have been issued by the Ccupt:roller and he did issue an opinion in
1979 saying you must have a local law if you are going to
compensate on any basis other than a straight salary .
Councilman Niklas asked what were the disadvantages , if any , to
having a local law .
Town Attoey Barney replied , none that he knew of if it was
phrased generically enough so that it did not have to be changed
every time the compensation is changed .
RESOLUTION NO . 238
Motion by Councilman Niklas ; seconded by Councilwonan Valentino ,
WHEREAS , the Town Board of the Town of Ithaca has provided for
compensation of Planning Board and Zoning Board of Appeals members
since 1967 , and
WHEREAS , that ccnipensation was set on a per meeting basis in 1976 ,
and
WHEREAS , the Report of Examination , 1989 , Office of the State
Comptroller , notes that a local law must be enacted in order to
provide compensation of such board members on a per meeting basis ,
and
WHEREAS , the Attorney for the Town has advised that such a local
law may not be necessary and recommends that compensation on a per
meeting basis , if that is the Town Board ' s desire , be set pending
adoption of a local law ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca does set conpensation for members of the Town of Ithaca
Planning Board and Board of Zoning Appeals at $ 50 per scheduled
meeting , attended by the member , and at $ 55 per scheduled meeting
attended for the Chairperson of the Planning Board and the
Chairperson of the Board of Zoning Appeals , and
FURTHER RESOLVED , that the Assistant Budget Officer notify Board
members of Audit and Control ' s finding that such compensation is
subject to Federal and State withholdings and reporting
requirements .

Supervisor Raffensperger stated that she did want to explain why
this was on the agenda , we also have another vacancy on the Zoning
Board of Appeals and at this point we have had only one applicant .
She stated that she was concerned that we go into the new year with
such a small board , with bearly a quorum .

Motion by Supervisor Raffensperger ; seconded by Councilman Klein ,
RESOLVED , that the Town Board of the Town of Ithaca hereby approve
the reappointment of Mrs . Joan G . Reuning to the Town of Ithaca
Zoning Board of Appeals for a five-year term commencing January 1 ,
1991 and expiring December 31 , 1996 .

RESOLVED , that the Town Board of the Town of Ithaca hereby approve

Supervisor Raffensperger noted that the amount in the Purchases of
Services Agreement is the same amount that was included in the

Councilwoman Valentino remarked that the City had sent her the
information they had requested and the figures had been justified .

Linda Nobles , Assistant Budget Officer stated that this was really
a balancing process if we have over extended in any one line item .
So we usually move monies from areas where there is a surplus to
areas where is a deficit . There were a couple of items that were
not budgeted for or not budgeted for sufficiently . We stay within
the funds .

BUDGET TRANSFERS
Councilman Klein noted that the Planning Department was getting
about $ 16 , 000 , he asked which items ran over?
Linda Nobles replied that money for CAC activities had not been
budgeted , there was about $ 2 , 000 activities and other expenditures
which are listed under a miscellaneous item at $ 6 , 500 . Part of
that she believed was the survey .
Councilman Niklas remarked that there was still about $ 2 , 500 not
accounted for , at least in terms of why .
Linda Nobles noted that the $ 10 , 332 is a personal services item
which is actual salaries and reflects the number of temporaries we
have had and some shifts in the staffing .
Supervisor Raffensperger noted that the expenditures were all
authorized but the budget transfers were not made at that time .
Councilman Whitcomb remarked , you said around $ 2 , 000 for CAC
activities , is that all that you were able to allocate to the CAC?
Mrs . Nobler replied that those were the changes that she was given
by the Planning Department . She stated that she did not know what

they were actually , submitting to the State in terms of
reimbursement .
George Frantz remarked that this year he had been submitting hours ,
the hours that he has devoted to the CAC and related work up to the
third quarter .
Councilman. Whitcomb remarked that same of Ron Brand ' s time could be
allocated to this .
Supervisor Raffensperger replied that she thought it had been . She
went on to say that she thought what this was , was an amount where
there was no category , no present category to plug in the CAC
expenses .

1991 PLANNING AIDES
George Frantz stated that this aid would sort of be taking the

hire someone through the summer and then one for the fall .

WHEREAS , Henry Aron was appointed to the Town Planning Board
effective November 4 , 1976 and served as its Chairman from January
1 , 1979 through December 31 , 1980 , and
WHEREAS , on January 1 , 1981 Henry was appointed to the Town Zoning
Board of Appeals and on January 1 , 1982 designated Chairman of the
Board in which capacity he served until December 31 , 1990 , and
WHEREAS , for more than thirteen years Henry served the Town of
Ithaca and its people with great distinction . Henry was always
well informed about the matters coming before him conducted his
meetings as Chairperson in a fair but expeditious manner , was
unfailing in providing adequate opportunities for applicants and
public alike to be heard , and exercised his matchless wisdom and
judgement with great perspicacity in deciding the matters entrusted
to the Boards he served ,
