SPECIAL BOARD MEETING
August 18 , 1986
At a Special Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 126 :East
Seneca Street , Ithaca , New York , at 5 : 30 P .M . , on the 18th day of
August , 1986 , there were :

PLEDGE OF ALLEGIANCE
The Supervisor led the assemblage in the Pledge of Allegiance .
REPORT OF TOWN OFFICIALS
Supervisor ' s Report
Building Inspector/ zoning Officer
Supervisor Desch stated that the Board would like to welcome Andy
Frost as the new Town Building Inspector/ Zoning Officer . He noted
that Andy was attending his first Town Board meeting and is already
finding out how busy life in Town Hall is . He stated that he hoped
the Town Board members would make a point of stopping by at Andy ' s
office and that he knew the staff had made him feel at home
already .
Fire Service Development
Supervisor Desch stated that the committee was rapidly working
toward a conclusion on the matter of whether or not the City and
the Town will continue a contractual relationship for fire service .
The areas where agreement seem to have occurred are substantial but
there is a very significant gap between the City ' s expectation of
the Towns contribution and the amount that the Town is justified in
paying . Weekly meetings seem to be likely .
Niderkorn Study
Supervisor Desch noted that he was pleased that all three
Participating bodies have now signed onto the plan for the
• Niederkorn study of the Route 96 alternatives . The results , he was
confident , will provide some of the critical information needed to
get this severe problem resolved . The design hearing has now been
Postponed until April 1987 ,
1987 Budget
The budget development phase is moving along on schedule with the
exception of fire protection and Federal Revenue Sharing . On the
latter , we may simply have to hold off as part of the budget review
until something more definitive is in place . If we receive , in
1987 and beyond , a similar amount to the current $ 84 , 000

appropriation we should consider a major part of our share of the
debt service for two new fire stations . If we form our own
department the funds could also be utilized for fire equipment .
The Supervisor went on to say that it was too early to discuss tax
rates but it appears there will be no need for a water rate
increase for the seventh year .
Town Engineer ' s Re port
Water and Sewer Extensions
Town Engineer Lawrence Fabbroni informed the Town Board that they
would be receiving his written report at the end of the week . The
• Engineer reported that the field surveys for water and sewer
extensions to Trumansburg Road , Woolf Lane , Grove Road , DuBois
Road , Indian Creek Road and Taughannock Boulevard were virtually
completed and that he would be presenting his report at the
September Board meeting .
Forest Home Drive
The Town Engineer reported that discussions had been held with
Cornell on Forest Home Drive . Plans are for the project to be
completed by the end of October .
Water Tanks
Town Engineer Fabbroni reported that the Pine Tree Road water tank
had been painted . He went on to say that problems had developed
with the Hungerford Hill Water Tank as the sand foundation under
the floor is wet . Mr . Fabbroni reported that he has asked a
consulting firm from Chester , Pennsylvania to come in and check
over the problem . This of course , is holding up the painting . The
Engineer went on to say that there was a little more pitting in the
Pine Road and Hungerford Hill Road tanks than we expected .
The Town Engineer went on to report that LaFayette Construction
Company are finishing the final phases of Phase II water
extensions . Also , negotiations with NYSEG on the Park Lane
Extension are continuing . Brick is going up on the outside and
piping on the inside of the Wastewater Treatment Facility . The
Engineer stated that the project will be well along come December ,
however , it will not be ready for operation in December .
Councilman Bartholf stated that he felt the drainage problem on
Compton Road had been satisfactorily resolved as he heard no
complaints after the big rain last Friday night .
Town Engineer Fabbroni noted that he checked on the Northeast
retention pond during the storm and found it working very well . It
filled to two-thirds of its capacity .
Highway Superintendent ' s Report
Forest Home Drive
• Highway Superintendent Robert Parkin reported that the highway
crews had been working on the Forest Herne Drive project . The wall
is 75 % complete . The gabions on the Forest Home Drive walkway were
finished last week . He went on to say that hopefully the repaving
and surface treatment would take about two weeks . The
Superintendent noted that the wash area needs a little more work .
Superintendent Parkin noted that the highway crew started paving
today . Sand Bank Road will be paved after Burns Road is completed .
Town Board 4 August 18 , 1986
TRANSFER OF FUNDS
RESOLUTION NO .
Motion by Councilman Cramer , seconded by Councilman Bartholf ,
WHEREAS , approved grant money under the Federal-Aid Highway Act for
the Burns Road project will be forthcoming for this project , and
WHEREAS , application has been made in the amount of $ 52 , 110 . 61 for
work completed from December 1 , 1985 to June 30 , 1986 on said
project ,
• NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby authorize the Burns Road Capital Project transfer
necessary funds from 1984 Sewer Improvement Capital Project to
ensure continuation of work on the Burns Road project , such
transfer to be repaid upon receipt of grant money .
Councilman Cramer requested that in the future , the Board should be
advised of the accounts from which the transfers will be taken and
the account to which it will be transferred to .

NEW YORK STATE MAGISTRATES ' ASSOCIATION CONFERENCE
RESOLUTION N0 .
Motion by Supervisor Desch ; seconded by Councilman McPeak ,
WHEREAS , the 77th Annual Conference of the New York State
Magistrates ' Association will be held October 19 through October
22 , 1986 , and
WHEREAS , all certified setting judges who attend will be reimbursed
by the State for one day and one night lodging up to $ 75 . 00 ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby authorize Justice Warren Blye and Court Clerk Pat
Punger to attend the 77th Annual Conference of the New York State
Magistrates ' Association to be held October 19 through October 22 ,
1986 at the Nevele Hotel , Ellenville , New York .

ANNUAL CONFERENCE OF HIGHWAY SUPERINTENDENTS
RESOLUTION NO .
Motion by Supervisor Desch ; seconded by Councilman McPeak ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorize Highway Superintendent Robert Parkin to attend the 57th
Annual Conference of Highway Superintendent ' s at Swan Lake , New
York , September 23 , 24 , 25 , and 26 , 1986 .

EDGEWOOD SUBDIVISION
Town Board 1 5 August 18 , 1986
EDGEWOOD COVENANTS AND RESTRICTIONS
1 . SUBJECT TO an easement for use and enjoyment for the benefit
of the owners of lots numbered and of Edgewood
Subdivision , to that portion of the above described premises shown
as "Open Space Easement " on a certain "Map of Edgewood Subdivision ,
Town of Ithaca , Tompkins County , New York " dated July , 1986 ,
made by Hunt Engineers and Surveyors , P . C . , a copy of which was
recorded , 1986 in the office of the Tompkins County Clerk in
Vault Box 0 Such open space easement shall be graded and
planted with meadow grasses . No building of any nature shall be
constructed in said open space easement .
2 . SUBJECT TO an easement for the benefit of lot number of
• Edgewood Subdivision for the maintenance of a certain party wall ,
said party wall being a free-standing eight inch masonary wall
located on the boundary of the above described premises . Said
party wall shall not be altered , extended , added to , or used for
support in any way . By acceptance of this deed , the grantee
covenants that , if it becomes necessary or desirable to repair or
rebuild the whole or any part of said wall , the expense of repair
or rebuilding shall be borne equally by the Grantee and the owner
of lot number of Edgewood Subdivision . Any repair or
rebuilding of the wall shall be on the same location as the
original portion repaired or rebuilt , and of the same size , and of
the same or similar material and of the same quality as that used
in the existing wall .
3 . No addition or improvement to the dwelling presently located
on the premises shall be constructed which is more than 27 feet in
width or which increases the area of the existing dwelling on the
premises by more than twenty five percent , and any addition or
improvement may not be closer at any point than five feet from the
property line on which the above mentioned party wall is located ,
or closer than seventeen feet to the opposite property line of the
above described premises .
4 . SUBJECT TO an easement of access and maintenance for the
benefit of lot numbered of Edgewood Subdivision , for the
purpose of maintenance , rebuilding , or repair of the dwelling
located on lot of Edgewood Subidvision , on a strip of land
five feet in width along the boundary of the above
described premises and abutting the dwelling located on said lot
number of Edgewood Subdivision , but excluding from said
easement any land within the confines of the exterior walls of the
building on the above described premises .
5 . By acceptance of this deed , the Grantee covenants to maintain
his driveway improvements in a usable , neat and uniform manner , so
that the overall appearance of said driveway improvements is that
of one driveway , the cost of improvements or repairs there of to be
shared equally with lot of Edgewood Subdivision ,
69 The easements , covenants , conditions , limitations and
restrictions contained herein shall constitute covenants which run
• with the land and shall be binding upon the grantee herein and all
other persons and parties claiming through the grantee herein and
for the benefit of and limitation upon all future owners of said
land and premises , and the grantee , covenants that it will include
all such covenants and restrictions in any subsequent deed .
Supervisor Desch asked Town Planner Susan Beeners if the Planning
Board had recommended that the Town Board adopt the Edgewood
Covenants and Restrictions ?
Town Planner Beeners replied , yes .

Supervisor Desch then asked if the covenants contained all the
restrictions ?
Ms . Beeners responded , yes .
Mr . Weisburd explained Item No . 2 in the Covenants noting that each
of the two family houses are connected by a party wall . No . 3 will
insure that there will be no encroachment on another persons
property . No . 4 allows a person access to do maintenance on their
portion of their property . No . 5 refers to the shared driveways .
No . 6 notes that the covenants is included in all deeds .
Supervisor Desch asked if the houses were two family houses ,
something like duplexes ?
• Mr . Weiburd responded you could have one owner for the two units .
Town Engineer Fabbroni added , except you could have two owners .
Councilwoman Raffensperger asked how many acres of land was
involved?
Town Planner Susan Beeners responded , about seven acres in the
cluster section plus seven acres of open space .
Mr . Weisburd stated that the City of Ithaca had approached him
about buying seven acres of land .
Councilwoman Raffensperger asked if the Planning Board had put
restrictions on the color of the outside walls ?
Mr . Weisburd responded , the design of the project calls for
different colors of vinal siding with white trim . He went on to
say that the project was not conceived as a one color project but
different colors for each independent units .
Supervisor Desch questioned , then each of the four units will have
two different colors ?
Mr . Weisburd responded , yes .
RESOLUTION NO .
Motion by Councilman MCPeak , seconded by Supervisor Desch ,
WHEREAS
1 . The Planning Board on June 24 , 1986 granted Preliminary
Subdivision Approval , subject to certain conditions , for the
subdivision of lands zoned R15 and R30 on the south side of
Slaterville Road between 1503 Slaterville Road and 1513 Slaterville
Road , Town of Ithaca Tax Parcel No . 6-58- 1-32 . 2 , such project to
include a proposed clustered development of ten two-family
dwellings .
29 The Planning Board on August 5 , 1986 approved the "Preliminary
Revision of Edgewood Site Plan " , by Housecraft Builders , Inc . ,
dated July 24 , 1986 .
3 . The Planning Board on August 5 , 1986 recommended that the Town
Board approve the draft covenants and restrictions as presented ,
reviewed , and revised by the Planning Board on August 5 , 1986 .
4 . The Town Board has reviewed "Edgewood Covenants and
Restrictions " revised August 15 , 1986 , which incorporate those
revisions recommended by the Planning Board on August 5 , 1986 .

NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca approve and hereby does approve the "Edgewood Covenants and
Restrictions " , revised August 15 , 1986 , subject to the review and
approval of the Town Attorney .

SET DATE FOR PUBLIC HEARING TO REZONE LANDS OF PAUL A . JACOBS
Supervisor Desch asked Town Planner Susan Beeners if she felt
comfortable in setting the date for the public hearing?
• Susan Beeners responded , yes . The Planning Board has referred the
proposal to the Town Board ,
Supervisor Desch questioned if the Town Board would be lead agent?
Ms . Beeners responded , yes .
The Supervisor then asked if the SEQR review would be the long form
assessment?
The Town Planner responded , yes .
RESOLUTION NO .
Motion by Supervisor Desch , seconded by Councilman McPeak ,
RESOLVED , that the Town Board of the Town of Ithaca will meet and
conduct a public hearing at 8 : 00 P . M . , on September 8 , 1986 , to
consider the rezoning of the lands of Paul A . Jacobs from Residence
District R30 to Residence District R5 (Mobile Home Park District) ,
located at 136- 46 Seven Mile Drive , Town of Ithaca Tax Parcel No .
6-33-2-2 and a portion of Town of Ithaca Tax Parcel No . 6-33-2-1 ,

FURTHER BE IT RESOLVED , that the public hearing will be held at the

Councilman McPeak asked if there was any way of holding the refunds
for people who are delinquent in paying their taxes and then
applying the money toward the taxes instead of refunding the money
now?

Supervisor Desch responded probably not legally . Delinquent water
and sewer bills are put on the tax bills . The Town receives their
tax money before the County receives any tax money .

TOWN OF ITHACA WARRANT

Motion by Councilman Cramer ; seconded by Supervisor Desch ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorize the payment of $ 577 . 00 be made to Richard Perry , 1138
Trumansburg Road , Ithaca , New York for work in connection with the
extension of water and sewer on the Trumansburg Road .

AWARD OF BIDS - DEMOLITION OF KNIGHT ' S SLAUGHTERHOUSE
Town Engineer Lawrence Fabbroni noted that engineering fees had not
been included in the $ 12 , 870 figure .
Councilwoman Raffensperger questioned , why take the money out of
Revenue Sharing if we are going to get the money back?
Supervisor Desch responded , we will be getting it back after the
judgement is satisfied .

WHEREAS , on August 18 , 1986 , bids were received for demolition and
related work at the "Old Knight ' s Meat Market " owned by Bernard C .
Stuhr , for the Town of Ithaca , New York , and
• WHEREAS , the Town Board has ordered demolition of the ruins known

DRAINAGE PROBLEMS ON KAY STREET , BLACKSTONE AVENUE AND ORCHARD
STREET AREAS
Supervisor Desch noted the subject of tonights discussion was the
resolving of drainage problems on Kay Street , Blackstone Avenue ,
Orchard Street and Roat Street ,
Town Engineer Fabbroni stated that the staff had started looking at
the drainage problems a year ago . The people in this area like
grass to the edge of the road and , therefore , it is a difficult to
solve and still keep the grass to the road . He then presented the
following report :
Kay Street , Blackstone Avenue
Orchard Street and Roat Street
DRAINAGE IMPROVEMENT ALTERNATIVES
1 . Re-establish Roadside Ditches
This alternative of open ditches is the most straightforward
and accessible for future maintenance . It would physically
mean re-establishing open ditches graded to existing waterways
or new catch basins where appropriate . Existing driveway
culverts , where damaged or corroded , would be replaced to the
grade of ditch at the owner ' s expense ( typical costs : 15 " _
$ 125 ; 18 ' _ $ 135 ) . Highway crossings would be replaced by
the Town . This may improve situations where house footer
drains have been covered over by grass areas having filled in
former ditches . However , ice jams , spring debris , etc . , could
lead to temporary blockages that will never remedy marginal
grades from house to ditch completely . The obvious
disadvantage to this norm found throughout the Town is that
there will be open ditches where everyone is now accustomed to
lawns up to the road ' s edge . The entire cost , with the
expection of individual driveway culverts requiring
replacement , would be borne by the Town as a cost of
establishing positive drainage in the process of repaving .
• Exclusive of paving , this drainage effort is estimated at
$ 14 , 000 of in-house expense .
20 Establish Subsurface Roadside Weeper Drains
This alternative would leave existing conditions nearly as is ,
while installing subsurface perforated drains on both sides of
the road and correcting any deficient driveway culvert
conditions ( at owner ' s expense typically as in " 1 " , above) .
This alternative would provide subsurface drainage of the
highway and lawn areas traditionally damp or puddled . Because

the trench is backfilled with gravel , it may provide a
below-ground outlet for footer drain but , again , marginal
grades from house to drain or gravel bed would undoubtedly
back up during high ground water levels . There would be less
of an ability to drain surface areas in times of peak rainfall
or snowmelt than alternatives " 1 " or 11311
, so short duration
surface ponding as present is likely ; the difference , being
drainage , will occur quickly to subsurface drain thereafter .
This system is less subject to freezing . The entire cost ,
with the expection of individual driveway culverts requiring
replacement , would be borne by the Town as a cost of
establishing positive drainage in the process of repaving .
Exclusive of paving , this drainage effort is estimated at
• $ 15 , 000 out-of-pocket , and , $ 10 , 000 of in-house expense .
3 . Construct Stormwater System including Subdrains and Catch
Basins
This alternative is the alternative that will positively drain
surface and subsurface waters , both normally and in most peak
storms (exclusive of events like 7 / 11 / 86 and 8 / 15 / 86 ) . The
worst flooding events would subside in an hour ' s time , but the
marginal footer drains would be in jeopardy to backflow during
such events . This system is very expensive and would involve
formation of a drainage district and construction by capital
project . The time involved to put all the funding , hearing ,
design , and bidding elements together would see this project
effected at the earliest in 1987 . The cost is roughly
$ 170 , 500 , or $ 2 , 375 per 100-foot lot , which might be amortized
at about $ 200-$ 250 per 100-foot per year . There are many
physical advantages to storm sewers that costs have prohibited
being an alternative in the Town whose benefits far enough
outweight the costs to be viable . This would be the first
drainage district and is really up to the voice of the people
through actions of the Town Board to determine if the
shortcomings of alternatives " 1 " or " 2 " are intolerable .
Town Engineer Lawrence Fabbroni remarked that option number one was
the most expedient and easiest to remedy , however , it will change
the look of the road . Also , this option is the least expensive
with the Town bearing two-thirds of the cost , time wise , about
$ 14 , 000 of in-house equipment and labor .
A man in attendance asked how effective would ditches be ?
Town Engineer Lawrence Fabbroni responded , very effective .
Freezing conditions are the only problems with open ditches .
However , we can steam out driveway culverts if they freeze . He
went on to say the the balance of the northeast have open ditches
and they work very well .
The man then questioned , we are not taking about ditches with water
standing in them , are we ?
Town Engineer Fabbroni responded , after a rain like we had last
• Friday night you might see a continuing flow for several days .
The man then asked about driveway heaving in the winter .
Town Engineer Fabbroni responded , if the driveway culverts are
embedded in gravel they will not heave as much as they would with
clay fill . In clay they won ' t return to normal , in gravel they
will .
The Town Engineer went on to note that option number two would
drain the road as well as the yards . This option would improve the

quality of standing water puddles . However , it will not deal with
the footer problems . There is no cure-all for footer drainage .
The only positive way to solve this problem is with sump pumps with
check valves so that they will not backflow . Nine out of ten
problems is with grade to ditch which is so level that it flow
backwards .
The Engineer went on to say that number three is a full blown storm
system which would cost $30 . 00 a foot to install . He went on to
say that there was no utopic solution . He warned the residents
present that they might be looking at an increase in their taxes at
the level of one-half of their present taxes .
• David Wexler , 209 Roat Street stated that he lived on the corner of
Blackstone and Roat . He went on to say that he took a walk around
the area and did not see any place where there were water problems .
He asked who had water problems ? Mr . Wexler stated that he would
like to see the petition .
Town Engineer Fabbroni responded that a petition had been received
from Kay Street residents .
Mr . Wexler remaked that Blackstone Avenue does not have water
problems as the soil is sandy . He went on „ to say that the problems
may be the individuals own problems . Blackstone Avenue and Roat
Street do not have problems with water .
Dale Brown , 114 Kay Street referring to option two asked , with a
weeper system do you need ditches ?
Town Engineer Fabbroni responded , you need swale not ditches .
Rodney Tobey , 111 Kay Street remarked that the water needs to be
removed from the road in order to preserve the blacktop . He then
asked if it would be necessary to go deeper with the ditches ?
Town Engineer Fabbroni responded , we want to go two feet deep so
that we can put the driveway culverts down as far as possible with
a gravel bed , so there will be less heaving .
Fred Kulhawy , 113 Orchard Street stated that he had lived on
Orchard Street for eight years . He then asked , where is the
problem? What is the nature of the problem? Mr . Kulhawy went on
to say that a lot of places were not graded correctly , in the first
place . He stated that he did not see why this was a Town problem .
Town Engineer Fabbroni responded that the problems were isolated .
There have been a number of complaints at the end of Kay Street .
There were problems at the end of Roat Street to Hanshaw Road .
Supervisor Desch asked the residents of Kay Street if they had a
preference ?
Rodney Tobey responded , ditches .
• Betty Muka , 113 Kay Street stated that she had no problems with
water , however , at 116 Kay Street the water was eating the road
away .
A man in attendance remarked that water runs across the street
between the Bierman ' s and Jack Burns property . He stated that he
though something was clogged up .
Mary Earle stated that her parents live at 112 Kay Street and that
every time it rains there is flooding . The ditch in the roadway
has collapsed .
Town Board 15 August 18 , 1986
Mrs . Muka remarked that the big culvert around the bend may be
clogged .
Peter Kahn , 111 Blackstone Avenue stated that he had no water
problems . Mr . Kahn went on to say that his house was built
twenty-five years ago and there has never been any water in his
basement . Mr . Kahn stated that he was shocked when he received a
letter from the Town regarding the water problems , as he never
knew , he said that we had water problems . He went on to say that
he was concerned that any changes would mess up the area .
Robert Fiske , 204 Roat Street added that his basement was always
dry . Mr . Fiske went on to say that the extension of water and
• sewer lines were a joke . We have more errosion where the water and
sewer lines were extended then any place else .
David Wexler asked , why was Roat Street added? What is the logic
• of bringing Roat Street into the Kay Street drainage problem?
Town Engineer Fabbroni responded , we are in the process of repaving
the area and would like to try and improve the drainage before the
repaving .
David Wexler then remarked that he had lived at 209 Roat Street for
ten years with no water problems . Mr . Wexler asked that the homes
with drainage and water problems be identified and then identify
the individual problems , don ' t access all taxpayers for solving
individual problems . He again stated that he had lived on Roat
Street for ten years and that Roat Street was the most beautiful
area in the whole Town , lets not make it look like the rest of the
Town .
John Ross , 113 Roat Street stated that he was outside during Friday
nights storm . There was a river running down Roat Street to Warren
Road . Mr . Ross stated that he shoveled out two wheel barrows of
stone that washed into his driveway . The golf course looked like
the Niagara River was running through it .
Everett Morse , 112 Blackstone Avenue stated that he had lived there
since 1965 . There are no ditches in front of the houses on Roat or
Blackstone and the water drains off nicely , there is no need for a
ditch .
Fred Kulhawy , 113 Orchard Street remarked that everyone has unique
little problems . You can ' t change Mother Nature . There are little
fingers of sand and little fingers of clay . The builders want a
standard design for drainage which do not take into account these
fingers of different soil which effect drainage . However , this is
not the Town ' s fault .
Edwin Roberts , 106 Roat Street stated that the drainage pipe under
• the road at Roat and Orchard should be replaced as water collects
there and does not drain . The stream , in carrying silt , has raised
the water level . Digging ditches along the street is not going to
solve the problem .
• A man in attendance remarked that more consideration should be
given to the creek .
Town Engineer Fabbroni remarked that the County controls the stream
and , therefore , is involved with the drainage on Hanshaw Road .
Supervisor Desch remarked that the Town should get the County
involved in the drainage .
David Wexler stated that he would like to know what was next?
Town Board 16 August 18 , 1986
Supervisor Desch responded , we will be back to you before we
proceed with any paving and that paving would not be done until the
Board gets a clear handle on what the residents of Kay Street want .
PUBLIC HEARING TO ADOPT A LOCAL LAW TO AMEND THE ZONING ORDINANCE
WITH RESPECT TO THE PROPOSED DESIGNATION OF CERTAIN LANDS OF
TOMPKINS COUNTY , ALSO KNOWN AS THE BIGGS COMPLEX , PRESENTLY ZONED
RESIDENCE DISTRICT R30 , AS A SPECIAL LAND USE DISTRICT (LIMITED
MIXED USE) , LOCATED AT 1283 and 1287 TRUMANSBURG ROAD AND ON INDIAN
CREEK ROAD , TOWN OF ITHACA TAX PARCEL NO . 6-24-3-2 . 2 , TOMPKINS
COUNTY , OWNER
• Proof of posting and publication of a public hearing to consider
the adoption of a local law to amend the Zoning Ordinance with
respect to the proposed designation of certain lands of Tompkins
County , also known as the Biggs Complex , presently zoned Residence
• District R30 , as a Special Land Use District (Limited Mixed Use) ,
located at 1283 and 1287 Trumansburg Road , and on Indian Creek
Road , Town of Ithaca Tax Parcel No . 6-24-3-2 . 2 , Tompkins County ,
Owner , having been presented by the Town Clerk , the Supervisor
opened the Public Hearing .
Frank Liguori , Commissioner of Planning for Tompkins County
reported that the County had appeared before the Zoning Board of
Appeals and had received approval to rent out a portion of the
building not being used by the County to Oddessy Research . He went
on to say that the County hopes the property can be rezoned to a
Mixed Use Zone so that it will not be necessary for the County to
appear before the ZBA everytime they wish to rent a section to the
private sector . Parcels to be considered for the Mixed Use Zoning
include the "H " Building , the old hospital complex , the free
standing house and the surrounding land for parking , as needed . He
noted that the new access road would be located by the present flag
pole .
Supervisor Desch noted that the Board members have the
Environmental Assessment form with the following comments by the
Town Planner .
IMPACT ON AIR
7 . No significant adverse impact is expected from what might be
defined as high-technology light industrial uses , as such uses and
their performance standards would be subject to review as they were
proposed . Certain general thresholds as to performance have been
included in the proposal . A variance of Local Law No . 2 , 1984
would be required for proposed uses involving product assembly .
• IMPACT ON TRANSPORTATION
14 . The project will have a small to moderate impact on
transportation systems . Ongoing transportation improvements are
• expected to mitigate any potentially significant impact .
IMPACT ON GROWTH AND CHARACTER OF COMMUNITY OR NEIGHBORHOOD
18 . The site will be the base for up to 400 employees as proposed .
Most relocation is expected to result from the relocation of County
Offices . Private sector uses and employees are not specific at
this time but can more probably be expected to represent new
businesses than the real potential of major relocation of existing

firms . Any further building development within the proposed zone
would be subject to further environmental review .
19 . There has been some public opposition to the move of certain
County offices . This is regarded as a separate County
administrative matter . The project proposal at hand is for mixed
private /public adaptive reuse in any combination but for a
specified existing building square footage , and review is directed
at any impacts which might result from this mixed use zoning scale .
Secondary impacts of specific government service location must be
dealt with by the lead agent or government providing the service .
Supervisor Desch asked if there were any questions ?
• Dooley Kiefer , 629 Highland Road responded that the Planning Board
recommendation to the Town Board seems inappropriate in complying
with SEQR which was passed with the intent that a municipality
• would be presented with entire plans for a proposed project . She
went on to say that the plan that the County has put before the
Town is a plan which is incomplete and , therefore , the Town cannot
do an adequate review .
Mrs . Kiefer went on to site Part II , Number 13 - Impact on Open
Space and Recreation . She stated that this cannot be answered yes
or no . If the question must be answered , then it must be answered
yes .
Mrs . Kiefer stated that if there is induced growth , either on or
off the site then a separate SEQR review must be completed for
future growth .
Frank Liguori responded that the Board should take into
consideration the fact that the buildings been been there since
19359 They have been used since then for these types of
activities . There will be no change in activities for these
buildings . The amount of activity is not significant . There are
no current activities , nor have there been any activity or
discussions of planned activity for the vacant land .
Mrs . Kiefer stated that she was not sure if the Board had a correct
and complete SEAR . She went on to say that as lead agent , the
Board must decide if they have enough information . Mrs . Kiefer
noted Part II , number 18 - Impact on Growth and Character of
Community of Neighborhood - she remarked that she did not see how
this could be answered no . This is an example of the form not
being used correctly . The form has errors and before the Town
Board can go ahead and make a decision , the form needs to be
correct . She then questioned the coordinated review which was
filled out by the County .
Supervisor Desch responded that number 53 in the long form spells
• it out in detail .
Mrs . Kiefer questioned trips per day . This was based on a list of
County employees and Oddessey Research employes , no research was
done to estimate traffic for the next 20 years . Mrs . Kiefer stated
that it was the applicants duty to provide the best estimates
possible .
Frank Liguori stated that he resented Mrs . Kiefer ' s remark that a
study was not done . Mr . Liguori stated that we did our best
estimate . He asked Mrs . Kiefer how she could say that the County
has not done a traffic analyses , it ' s listed in the SEQR .
Mrs . Kiefer responded the traffic count is accurate for County
Offices but not accurate for SEQR .
Town Board 18 August 18 , 1986
Mrs . Kiefer questioned the acreage to be rezoned .
Frank Liguori responded 22 . 2 acres . The areas marked P-9 , P-8A ,
P-7A , P4 , P-4 , and P-3 which includes the "H " Building , old
hospital building , house and flag pole area plus other land needed
for future parking .
Mrs . Kiefer remarked that the parcels that are not specifically
designated should be deleted .
Town Engineer Fabbroni remarked that the topography of the area
makes these areas open space .
• Mr . Liguori remarked that P-8A and P-9 would serve the existing
buildings with parking and open space . Within a year we are likely
to be expanding the parking which is located on P- 8A . Any further
development would probably require site plan approval . He then
• asked what possible good it would do to take it off?
Mrs . Kiefer responded that R-30 was more restrictive . Since the
County owns the buildings , under the rezoning the County could use
the land for what ever they wished .
The Supervisor closed the public hearing .
INFORMATIONAL PUBLIC HEARING TO CONSIDER THE JUDD FALLS ROAD
PROJECT CONSISTING OF RECURBING AND REPAVING OF JUDD FALLS ROAD IN
CONJUNCTION WITH THE CONSTRUCTION OF A WALKWAY AND NARROWING OF THE
PAVEMENT TO ONE LANE (ONE.T Y TRAFFIC FROM FOREST HOME DRIVE TO
JUGHANDLE)
The Town Supervisor asked the public if there were any questions
about the proposal that everyone was already familiar with .
The President of the Forest Homeowners Association questioned why
the Town had advertised for bids for granite curbing to be
installed on Judd Falls Road before the proposal had even been
presented to the public ? He went on to say that he felt the
bidding was premature until the Forest Home Community had a chance
to study the proposal . He then asked the Town Board to defer any
action on the proposal until after September 5th , when the Forest
Homeowners Association would be meeting to discuss the proposal .
The Town Board members are invited to attend the meeting .
Supervisor Desch asked if the Association would have a concensus of
what the neighborhood desired by September 8 ?
The President of the Forest Homeowners Association responded yes .
Supervisor Desch then read the following letter dated August 15 ,
• 1986 from Ruth Mahr and Rosemary and Joel Silbey :
"We understand that the Town Board will consider a one-way traffic
plan on Judd Falls Road at its next meeting .
• Unfortunately , both of us will be out of town at that time . If we
were able to attend the meeting , we would speak strongly in favor
of such a plan . We would do so for all the reasons that make up
the record of traffic problems in Forest Home and which do not need
to be rehearsed here . Although we believe that the traffic
situation will only be finally resolved by other means , a one-way
system promises to alleviate our problem to some degree .
Town Board 19 August 18 , 1986
As two of the families most affected by the traffic and by the
introduction of a one-way system , we wish to have our opinions
placed before the members of the Town Board .
Thank you for conveying our sentiment to the other members . "
Town Engineer Fabbroni stated that the repaving of Judd Falls Road
had been deferred until this year because the curbing needed to be
replaced . He went on to say that there has been a lot of
discussions about needed traffic improvements in Forest Home . We
have had repeated requests for a pedestrian walkway . If a walkway
were to be installed , it became apparent that it would be necessary
to put the Judd Falls Road walkway either on the small front yards
• or out in the street . There was disatisfaction , in the past , over
making the bridges one-way . The proposal to be considered tonight
is to take the two block section of Judd Falls Road from the
Jughandle to the end of Judd Falls Road , make it one-way south , put
• in new curbing with a five foot walkway . A five foot walkway on
one side of the street would add two foot to the lawns on the other
side of the street . Local people leaving their homes to go to the
south would have to go around the block in order to get home . In
order to go north , they would need to go around the block upon
leaving . The Silbey ' s and Ruth Mahr would have to go around the
block coming and going . The Town Engineer went on to say that the
people most impacted with the one-way traffic were contacted . Some
of the people in the impacted neighborhood contacted other people .
Everybody along the improvement area wanted the improvement . The
Engineer went on to say that the prime construction season is while
everybody is away . It becomes difficult when you have to bid . If
we had put the bidding off until September then it would be
impossible to get the construction completed this year . The
project , if approved , will be constructed between September 1 and
September 15 , with the road back in service by the end of
September .
Andrew McElwee , 123 Judd Falls Road noted that one point the Town
Engineer glossed over was the difficulty of getting down the end of
Judd Falls when it was slippery .
Town Engineer Fabbroni responded that the slope at the end of Judd
Falls Road would be shaved down so that the slope was not so steep .
Liese Bronfenbrenner , 108 McIntyre Road asked how the Ithaca City
School District felt about school buses that use this route if Judd
Falls Road is made one-way?
Town Engineer Fabbroni responded that the School District would
have to work out this problem .
Alan McAdams , 2 The Byway remarked that this proposal would put all
the cars past his house . He remarked that the Jughandle could not
• handle all the traffic . Mr . McAdams went on to say that he felt it
was high handed to put a job out to bid before the project has been
approved by the Forest Homeowners Association . Mr . McAdams
suggested the Board consider trying the one-way scheme for six
• months on a trial basis before something permanent was done and a
lot of money was spent . You could start the experiment any time .
Just put in temporary markers , a temporary walkway and let it go
through a winter , then decide if the one-way should be made
permanent .
Joel Bostick , 6 The Byway stated that he was most chagrined at the
way things have developed . He questioned how are all of the people
going to get up the hill ? That approach on Forest Home Drive from
the west is the most difficult way to approach the hill . Also , you
are creating a traffic situation that has never existed there

before . Mr . Bostick went on to say that he concurred with the
logic of a test period but also not to put the one-way in final
without solving the other parts of Forest Home ' s traffic problem .
Jane Bates , 140 Forest Home Drive remarked about people need to
make a wide swing in order to make the turn on to Judd Falls Road .
The proposal does not address the problem of not being able to walk
on Judd Falls Road because of the wide swing .
Robert Cook , Director of the Cornell Plantations stated that he was
looking at the proposal in a positive way . He went on to say that
he expects a lot more traffic would go through the Plantations on
the section between the Jughandle and Caldwell Road and that he was
• afraid someone would get hurt . He stated that he felt the
experimental approach would be the best way to go . Mr . Cook
remarked that taking a left turn and going up the hill was
dangerous now without additional traffic .
• Shirley Egan , Counsel for Cornell University stated that she had
been on vacation and had only heard about the proposal last week .
Also , most of. the people at Cornell who would be involved in such a
proposal were also on vacation . Ms . Egan went on to say that there
would be a number of questions to be answered as soon as the proper
people return from vacation . She suggested that the road not be
narrowed permanently until the one-way proposal has been tested .
Ms . Egan went on to say that because of liability , Cornell might
need to close a road or install a booth .
A man in attendance remarked that he felt the improvement would be
very beneficial . Walking along a five foot path with two way
traffic would be very hazardous unless the road is made one-way .
Town Engineer Fabbroni remarked again that the bridges would remain
two-way , if they were made one-way the only way then to get out of
the middle of Forest Home would be to make Forest Home Drive
one-way and that ' s not wanted .
A lady in attendance remarked that she favored the testing theory .
Don ' t make Judd Falls Road permanently one way until you study the
traffic pattern of a period of nine months to one year .
George Bayer , 216 Forest Home Drive stated that he endorsed a trial
concept . Put in signs and posts to keep traffic in the proper
lanes . He went on to say that especially with winter approaching
it will be a good opportunity to try the proposal and not cost much
money .
Arthur Bloom , 118 Judd Falls Road questioned where the drainage
will go that now enters his driveway and turns to ice in the
winter . He stated that he was not in favor of the proposal if it
will not help the drainage problem .
• Supervisor Desch asked for a show of hands from those present in
favor of a nine months trial period through the winter .
• The show of hands was very favorable for a nine month trial period
through the winter .
Supervisor Desch remarked that it was clear that if a walkway was
installed on Judd Falls Road it would be necessary to make the road
one-way .
William Goldsmith , 117 Judd Falls Road remarked , if you do
experiment , make sure you have it marked sufficiently .

PUBLIC HEARING TO CONSIDER THE NEED AND LOCATION OF AN ACCESS ROAD
TO TOMPKINS CU49JNITY HOSPITAL AND ADJACENT PROPERTIES , A PUBLIC
PRWECT , PRIOR TO ACQUISITION OF THE REAL PROPERTY REQUIRED FOR THE
PROJECT
Proof of posting and publication of a public hearing to consider
the need and location of an access road to Tompkins Community
Hospital and adjacent properties , a public project , prior to
acquisition of the real property required for the project having
been presented by the Town Clerk , the Supervisor opened the public
hearing .
Gerald Hall , son of Mrs . Glady Hall , 1307 Trumansburg Road , owner
• of the property stated that he was opposed to the roadway being
placed on his mother ' s property . Mr . Hall went on to say that
there was plenty of land around the hospital that could be used
without taking their land and besides the area you are proposing to
take is prime farming land .
Town Engineer Fabbroni responded that the main idea in considering
the land in question was to plan , in an orderly way , for traffic
circulation . Also , the road will benefit the Hall ' s if they ever
decide to sub-divide their land .
Mr . Hall responded that he did not want to donate this piece of
property , its the best piece of land we have . Mr . Hall remarked
that they did not want to sacrifice any of their land . He then
suggested that the proposed road be brought up the old railroad
bed .
Town Engineer Fabbroni responded that the electrical substation
would then have to be relocated . You are talking about a cost of
$ 65 , 000 .
Mr . Hall then suggested that the road be located below the
hospital .
Mr . Frank Liguori responded that locating the road below the
hospital would not work .
Mr . Hall stated that he wants to farm his land , he does not want to
sub-divide any part of his land . Mr . Hall went on to say that
everytime a road so may feet wide is built , two to two and one-half
more feet of land is always taken above the amount that is supposed
to be taken .
Dooley Kiefer remarked that the road is called an access road . Is
it only an access road to the hospital ?
Town Engineer Fabbroni responded no . If it only went to one place
it would be a private road .
The Board reviewed the Short Environmental Assessment Form ,
Supervisor Desch closed the public hearing .
Councilman Cramer asked the Town Planner Susan Beeners if the land
was zoned R-30 or Agricultural ?
Ms . Beeners responded that she thought the land was zoned R-30 .

Motion by Councilman McPeak ; seconded by Councilwoman Howell ,
Town Board 22 August 18 , 1986
RESOLVED , that the Town Board of the Town of Ithaca hereby declare ,
after a review of the Short Environmental Assessment Form , a
negative declaration on the access road proposed for the vicinity
of the Tompkins Community Hospital .
(Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary
voting Aye . Nays - none ) .
JUDD FALLS ROAD ONE-WAY PROPOSAL
Supervisor Desch instructed the Staff to come back to the September
8th Town Board meeting with a proposal to implement the one-way
traffic proposal for Judd Falls Road on a temporary trial basis .
Councilwoman Raffensperger remarked that she was concerned with the
liability of the walkway . She asked how the Town was going to
protect the pedestrians ?
Town Engineer Fabbroni responded that he would install planters
along the walkway , allowing for mail trucks to get to the
mailboxes .
LOCAL LAW TO AMEND THE ZONING ORDINANCE WITH REPSECT TO THE
PROPOSED DESIGNATION OF CERTAIN LANDS OF TOMPKINS COUNTY , ALSO
KNOWN AS THE BIGGS COMPLEX , PRESENTLY ZONED RESIDENCE DISTRICT R30 ,
AS A SPECIAL LAND USE DISTRICT (LIMITED MIXED USE) , LOCATED AT 1283
AND 1287 TRUMANSBURG ROAD AND ON INDIAN CREEK ROAD , TOWN OF ITHACA
TAX PARCEL NO . 6-24-3-2 . 2 , TOMPKINS COUNTY , OWNER
Councilwoman Raffensperger questioned Light Industrial Use ,
Town Planner Susan Beeners responded that a form of Light
Industrial Use language was used in the former version . The
Planning Board was opposed to anything mentioning Light Industrial .
Councilwoman Raffensperger asked the Town Planner to explain her
number 7 comment - No significant adverse impact is expected from
what might be defined as high-technology light industrial uses , as
such uses and their performance standards would be subject to
review as they were proposed . Certain general thresholds as to
performance have been included in the proposal . A variance of
Local Law No . 2 , 1984 would be required for proposed uses involving
product assembly .
Frank Liguori , County Planner responded to Councilwoman
Raffensperger ' s question . He stated that the Town Zoning Ordinance
does not recognize the activity that a computer chip manufacturing
company would generate , except in a Light Industrial Zone . This is
now mute , as this is no longer a proposed activity for the vacant
former hospital property .

RESOLVED , by the Town Board of the Town of Ithaca that after
reviewing the Environmental Assessment Form for the proposed
rezoning of the Biggs Complex at the old hospital site , a negative

were chosen .

A LOCAL LAW TO AMEND THE ZONING ORDINANCE TO PROVIDE A SPECIAL LAND
USE DISTRICT (LIMITED MIXED USE) AT THE BIGGS COMPLEX OWNED By
TOMPKINS COUNTY
The Zoning Ordinance of the Town of Ithaca as re-adopted , amended
and revised effective February 26 , 1968 , be further amended as
follows :
1 . Article II , Section 1 , of the Town of Ithaca Zoning Ordinance
be and hereby is amended by adding to the permissible districts
itemized in said section a district designated as "Special Land Use
District No . 3 " .
20 The uses permitted in this Special Land Use District No . 3
are :
(a ) Any use permitted in an R9 , R15 , R30 , or Multiple
Residence District .
(b) Any use permitted in an Agricultural District .
(c ) Any use permitted in an A , B , or (Restaurant use only)
Business District ,
3 . Notwithstanding the foregoing , no uses otherwise permitted
shall be allowed in such district if the uses produce offensive
noise , odors , smoke , fumes , vibration , glare , electronic
interference , radiation , or if the use involves substances or
devices that may cause harm due to their hazardous nature . No uses
shall be permitted if not pursuant to and consistent with a unified
plan for the entire Special Land Use District as the same may be
initially approved by the Planning Board and subsequently amended
with the approval of the Planning Board ,
4 . Any use in this district shall be governed by all of the
requirements , including sideyards , setbacks , building coverage ,
accessory uses , and similar requirements , of the most restrictive
district (other than this Special Land Use District (Limited Mixed
Use) ) in which such use is permitted by other terms of this
ordinance , except that the number of parking places required shall

be the number presently provided unless the Planning Board , in its
discretion , determines parking is inadequate in which event the
number of parking places shall be increased to the number
designated by the Planning Board up to the maximum that would
otherwise be required by the most restrictive districts for which
each use would be governed but for the existence of this Special
Land Use District ,
5 . In addition to the requirements and restrictions imposed by
any other district , there shall be no new construction in the
Special Land Use District unless and until all of the requirements
of this ordinance have been complied with and , in addition , the
following requirements to the extent not required by other
provisions of this ordinance :
( a) The exterior design , specifications , and plans for the
buildings and other improvements to be constructed on the
premises and the development of the grounds and
construction of all outside facilities including lighting
and signs shall have been shown on a final site plan
approved by the Planning Board , and any construction
thereafter shall be in accordance with said site plan as
finally approved . In determining whether or not to
approve the site plan , the Planning Board may employ the
same considerations it would employ in approving a site
plan pursuant to Sections 46 and 78 of this ordinance .
(b) Building permits shall be required for any construction ,
including construction of signs and outdoor lighting
facilities . Such permits shall not be issued until the
Planning Board has approved the design and specifications
therefore .
( c ) No further construction will occur until a new access
roadway has been built by Tompkins County from station
10+00 west of and through parcel P4 as shown on the map
referred to in Schedule A to this local law to connect to
the two-way driveway presently extending from the
southeast corner of parcel P3 as shown on said map to
Indian Creek Road according to a mutually agreeable
location and specifications acceptable to the Town Board
of the Town of Ithaca , and until utility easements to
serve properties to the north and west of lands of
Tompkins County be granted for water and sewer extensions
from existing on-site utility locations and more
specifically to the former Gilcher property and to Indian
Creek Road at locations and upon terms and specifications
satisfactory to the Town Board . -
(d) No new construction and no additional occupancy of the
existing buildings in this Special Land Use District
shall be permitted if the Planning Board , in its
discretion , determines that present arrangements for
on-site parking are inadequate until sufficient on-site
parking spaces are provided in an amount required by the
Planning Board up to the maximum required by the most
restrictive districts for which each use would be
governed but for the existence of this Special Land Use
District .
(e ) Any construction for which a permit is granted shall
comply with all applicable laws , codes , ordinances , rules
and regulations .
6 . The area emcompassed and rezoned in accordance with this Local
Law to Special Land Use District No . 3 is described on Schedule A

to this Local Law . The Official Zoning Map of the Town of Ithaca
is hereby amended by adding such district at the location
described .
7 . In the event that any portion of the law is declared invalid
by a court of competent jurisdiction , the validity of the remaining
portions shall not be affected by such declaration of invalidity .
80 This law shall take effect 20 days after its adoption or the
date it is filed in the Office of the Secretary of State of the
State of New York , whichever is later .

Minimum two years ' experience in landscaping , woodland management ,
and general carpentry , and familiarity with all equipment and
safety measurers related to these areas . Ability to supervise
short-term temporary youth workers . Class III truck driving
license and basic experience with heavy equipment operation (e . g . ,
loader , backhoe) helpful .
