AGENDA ITEM #2 Report of Tompkins County Legislature
Councilman Stein addressed the Board reporting that both the Town and the County
have promised residents that we would look at the speeding and safety issues on Pine
Tree Road and he suggested that the County Highway Department collaborate with the
Town and meet to develop ideas and suggestions to propose measures to address the
issues at either or all the State and County and Town levels. Mr. Goodman stated that
the Public Works Committee is discussing the neighborhood’s request for a reduction in
speed at its next meeting and he has received a lot of emails in support of it.
AGENDA ITEM #3 Report of Ithaca Common Council None
AGENDA ITEM #4 Persons to be Heard and Board Comments
Persons to be Hear
Bill Olms (?) from the Forest Home Improvement Association speaking in support of
the Town entering into an agreement for the use of the parcel of land on Forest Home
Drive for recreational use. He stated that the Association has a working group set up to
assist the Town in obtaining grants or helping with cleanup and in general exploring
ideas and opportunities to enhance the park. He reiterated that there is strong support
in the neighborhood for the park.
A gentleman (?) distributed a handout (Attachment #1 Small Park Proposal) detailing
ideas from the Forest Home Improvement Association for improving the property.
Danny Novak spoke in favor of obtaining use of the park noting that residents
currently garden there and it is a great opportunity for the community.
Board Comments
Mr. Engman reported that he attended the dedication for the Holly Creek Townhouses
and he was very impressed with the houses which are in the $100-$125K range and they

are LEED certified. He also reported that he and Nick Goldsmith talked to
representatives of the Black Oak wind power group and wanted the Board to start
thinking about the possibility of buying wind energy or investing in the project working
towards reducing our carbon footprint and reaching our carbon reduction goals which
we set at 30% by 2020. Black Oak believes they will be building by next year and they
have completed their initial offering of shares with the public offering coming next year.
AGENDA ITEM #5 Discuss and consider approval of a license agreement for a
portion of real property on Forest Home Drive for the Forest Home Park
SEQR (Attachment #2)
Mr. Engman noted that after the last discussion by the Board and the comments
regarding the agreement, he contacted Cornell and they thought the agreement allowed
the Town to do everything it needs to do should we accept the property. One of the
questions was about storing gasoline for lawn maintenance equipment and their
response was that this section would not limit storage of landscaping type equipment
and their answer concerning our comments regarding the pruning of trees and shrubs
was that they would simply like the Town to consult Plantations because they do have a
few specimen trees there that they would like to coordinate on. Mr. Engman went on to
say that he also asked them what “educational purposes” means and although they
were not overly clear, they said “anything related to or in support of the University’s
teaching and research mission”. Mr. Engman was concerned about what happens with
the 2-year cancellation clause and what would happen if the college decided to sell the
property and that was clarified by Ms. Brock who said that even if the Town is notified
within 30 days that there is an offer on the land and the Town declines to buy it, the
lease continues with the current owners for 2 years. He asked Ms. Brock to confirm that
the license agreement was solid and she did.
He thought we have gotten as much clarity as we are going to get and he put it on the
agenda to make a decision. He noted that this has been on the table for over 5 years and
it is time to make a decision.
Mr. Engman brought the Board’s attention to the proposed SEQR which was placed on
their desks today. A motion to accept the SEQR was made by Mr. Goodman, seconded
by Pat Leary for discussion.
Mr. DePaolo asked why the Board was taking this up tonight when there is an item on
the Public Works Committee’s Agenda for tomorrow regarding park maintenance costs
which was one of the areas of interest discussed the last time this topic came up. He
wondered if we would be better served taking this up after that meeting.
Ms. Hunter noted that at that last meeting she had also asked that we have something
in writing from the nearby church to allow for parking for other residents outside the

community to use the park and she had also asked about the possibility of an Adopt-
the-Park agreement with the Forest Home community since all of their communications
indicate their willingness to take on some responsibilities for maintenance but nothing
is spelt out. She wanted to have a clear sense of what the costs would be and a
conversation with the Forest Home community about how they could help defray those
costs. It seems that they are not willing to do the mowing and that is the biggest cost to
the Town. She felt that the costs to the rest of the Ithaca community be as low as
possible.
Mr. Engman responded that the President of the Forest Home Improvement
Association has approached the chapel and the initial response was positive but they
have to talk to their Board of Trustees. In terms of a park adoption, the only type of
program the Town has now is an Adopt-a-Park program geered towards cleanup and
the Association has agreed to do that. The Adopt-a-Park policy should be reviewed and
changed but it only addresses clean-up at this point. He thought we should develop a
policy that allows for beautification and maintenance and other things and extend it to
Adopt-a-Trail also.
Mr. Engman went on to address the concerns regarding costs, stating that this is the
first time anyone has brought up the subject of costs in relation to any park we have
taken on and he didn’t know why we are treating this one differently from every other
park we have taken on. We have always assumed that if it is good for the community
we will figure out a way to maintain it. This is no different from any of the other 30 odd
parks we have. As for parking, not all our neighborhood parks have parking and any
number of them are used mainly by the residents in the neighborhood surrounding
them and of course they can be used by others, but there isn’t necessarily a parking lot
provided for them. He was perplexed as to why there are different standards being
applied to this park that are not applied to other parks we have adopted in the past. He
ended by saying that it is time to decide if it is good for the community or not and if it is
good for the community then accept it and work towards fixing the problems. Some
problems can not be solved in advance.
Mr. DePaolo responded that it was his assumption that this cost analysis would happen
for all future parks and it just happens to be now and it is purely coincidental and does
not have to do with this park per se. He went on to say that in regards to parking, it
was his recollection that there is no roadside parking whereas a lot of other parks do
have at least roadside parking. It essentially becomes a community park instead of a
town park and those things have to be considered and we should consider the costs and
revisit this in two weeks.
Ms. Hunter added that she felt this was different from other parks because other parks
are given to us through our Planning process and is ours forever where this is not being
given to us, we are just assuming responsibility for it for a period of time subject to

cancellation. She felt there were differences between other Town Parks and it would
benefit us to work out the cost issues and revise the Adopt-the-Park policy.
Mr. Goodman asked about the discussion with the chapel and how many spaces are
there? Mr. Engman answered that there are maybe 10-15 cars on non-Sundays and
agreed that it is a difficult area for parking. He went on to say that we have a lot of
neighborhood parks that are not destination parks and noted that we have other 99-year
leases with Cornell for other Town parks such as the waterfront park on East Shore
Drive and the East Hill Trail, so this proposal is not unique.
Mr. Goodman asked about the small parking space used for maintenance of the pump
station and whether that could be designated as handicapped parking and Mr. Weber
noted that we wouldn’t want to encourage parking there as it is a confusing and
sometime treacherous area now and Mr. Bates added that if we do label it as
handicapped the area would have to be improved.
Mr. Goodman asked about the fence that Mr. Weber was concerned about at the last
meeting. Mr. Weber reiterated his concerns about conditions pertaining to the fence
and the trees and keeping it in a certain condition. He felt we should get the park in the
state that they are expecting it to remain in. Mr. Engman thought that these are the
types of things that are worked out as you go forward and he could envision Rich
getting with Plantations and discussing the trees and working it out, as for the fence, it
doesn’t have to stay; the town and the community could decide it should be bushes or
nothing there. We have never gone to such lengths and details for any other park.
TB Resolution No. 2012 - 183: SEQR Determination regarding a license agreement
for the use of a portion of property along Forest Home Drive
WHEREAS the Town wishes to enter into a license agreement for the use of a portion of
property located along Forest Home Drive for passive recreation and
WHEREAS this is an Unlisted Action for which the Town of Ithaca Town Board is
acting as lead agency in an environmental review with respect to entering into the
license agreement to ensure the continued use of the property for its residents and
WHEREAS the Town Board has discussed the proposed license agreement and
accepted as adequate a Short Environmental Assessment Form Part I and Part II
prepared and submitted by Town staff.
NOW THEREFORE BE IT
RESOLVED That the Ithaca Town Board hereby makes a negative determination of
environmental significance in accordance with Article 8 of the Environmental

Conservation Law and 6 NYCRR Part 617 New York State Environmental Quality
Review for the above referenced action as proposed, based on the information in the
EAF Part I and for the reasons set forth in the EAF Part II.

Approval of Agreement (Attachment #3)
The resolution to accept the license agreement was moved and seconded for discussion.
Mr. DePaolo stated that he thought this park was different in that it is essentially a park
now and the costs are being borne by the college instead of the Town and the enactment
of the stream setback law will keep it as it is because it limits the options for building or
developing it. He questioned whether the ability to beautify the parcel was worth the
cost and the liability when the area in question is surrounded by one of the best natural
areas in the community in Cornell Plantations.
Mr. Goodman spoke, saying that he understands that the Town is taking on extra costs
but values the access we have and technically it is Cornell’s property they could stop
that. He also values the community’s interest in trying to make this a nice place in the
center of their neighborhood. He felt that it was worthwhile to at costs and ways to
reduce them but that in general any time we can get some prime land under our control
that is a good thing.
Mr. Levine spoke saying that he agreed with both sides presented, but the agreement
does give us the option to get out with 30 days notice, so we can get out if it becomes
undesirable for any reason such as it stays the same at it is, or causes a liability etc. He
thought we should take Cornell up on the offer and see how it goes.
Ms. Hunter responded that there are some simple and basic questions and is our due
diligence to get those answered before we sign this agreement. She did not think it
would take a lot of time and this could be moved to a later time.
TB Resolution No. 2012 - 184: Authorization to enter into a license agreement with
Cornell University for a portion of real property located on Forest Home Drive
WHEREAS, the Town Board has discussed the opportunity to enter into a license
agreement with Cornell University for the use of a portion of real property located on
Forest Home Drive for public recreational purposes and
WHEREAS, the Town Board, Attorney for the Town and Highway
Superintendant have reviewed the license agreement and

WHEREAS, the Town Board believes that the use of this parcel of land would be
a welcomed addition of passive recreational park land for the Town and its residents;
NOW, THEREFORE, BE IT
RESOLVED, that said land be acquired for, and held as, passive recreation park
lands for the benefit of the residents of the Town of Ithaca subject to the terms as to use
of the property as set forth in the license agreement and
BE IT FURTHER RESOLVED, that the Town Board hereby approves entering
into said license agreement and authorizes the Town Supervisor to execute same.

AGENDA ITEM #6 Consider referral of a development concept and rezoning
request on Five Mile Drive to the Planning Committee

Ms. Susan Cosentini presented her basic concept for an eco-friendly development as
outlined in the memo from Ms. Ritter (Attachment #3)
Comments and Questions from the Board
Mr. DePaolo stated that taken as a microcosm it is great, but there are no sidewalks and
there is no bus service so despite the best of intentions, it might still be auto-centric.
Most of the discussion and comments centered around affordability and transportation
issues and how that would tie this area to the job-centers. There are connections in
concept to the Black Diamond Trail and possibly a bridge across the inlet but those are
in no way firm and can’t be counted on.
Mr. Engman noted that the density she is envisioning is not as dense as the Comp Plan
in we are working on envisions and Ms. Cosentini said that she started the preliminary
plans going by its current zoning, but she was absolutely open to higher density.
Ms. Leary and Mr. Levine talked about affordability, noting that there are several
lower-income housing projects but nothing for the person who is truly median income;
a lot of $300 houses out there but no $200K.

Mr. Weber suggested that Ms. Cosentini talk to NYS DOT about working in their rights-
of-ways and the access road as well as emergency access etc.
Ms. Ritter added that this lot is currently LDR but is immediately adjacent to MDR and
near the Glenside neighborhood which is HDR. Different clustering or planned
development zone options will need to be discussed.
Mr. Goodman stated for the record that he would be abstaining from voting due to a
conflict of interest in that he is providing legal services to Ms. Cosentini with her
current project.
No changes to the draft resolution as presented.
TB Resolution No. 2012 - 185: Referral of a development concept and rezoning
request for a parcel on Five Mile Drive to the Planning Committee for review and
comments
Whereas Susan Cosentini of New Earth Living appeared before the Board to present a
development concept on Five Mile Drive which may require a rezoning request
Now therefore be it
Resolved that the Town Board hereby refers said development concept to the Town
Planning Committee for review and comments.

the Town of Ithaca Water Rate and Sewer Rents
Mr. Engman opened the public hearing at 6:47p.m. There was no one wishing to

TB Resolution No. 2012 - 186: Increasing Sewer Rents in the Town of Ithaca Sewer
Improvement Area and Increasing Water Rates Chargeable to Consumers of Water in
the Town of Ithaca
WHEREAS, the Town Board of the Town of Ithaca wishes to revise the sewer rent and
water rate schedules for the Town of Ithaca Sewer Improvement Area and the Town of
Ithaca Water Improvement Area; and

WHEREAS, a public hearing, duly advertised and posted as required by law, was held
at 215 North Tioga Street, Ithaca, New York on the 15 day of October 2012, and the
th
public was permitted an opportunity to be heard on the proposed increases; and
WHEREAS, pursuant to the New York State Environmental Quality Review Act
(“SEQRA”) and its implementing regulations at 6 NYCRR Part 617, it has been
determined by the Town Board that adoption of the proposed resolution is a Type II
action because it constitutes “routine or continuing agency administration and
management, not including new programs or major reordering of priorities that may
affect the environment,” and thus this action is not subject to review under SEQRA;
Now, therefore, be it
RESOLVED, that the Town Board of the Town of Ithaca hereby establishes and imposes
the following:
(1) Effective January 1, 2013 there is hereby imposed a sewer rent payable by all
users connected to the Town-wide sewer system at a rate of $4.20 per 1,000 gallons of
water consumed.
(2) In addition, and notwithstanding the foregoing rate structure, there shall be a
minimum base charge for regular quarterly bills sent on or after January 1, 2013 in the
amount of $33.60, which minimum charge is based on 8,000 gallons of usage, regardless
of whether that amount is actually used.
(3) Multiple housing and mobile home parks of over two dwelling units, using a
master water meter, will be computed as follows: The quarterly master water meter
reading will be divided by the number of dwelling units and the sewer rent charge will
be figured on this number as if the unit was individually metered. The sewer rent will
then be multiplied by the number of units on the master water meter and this will be
the billing rendered and the amount payable. If the calculation of the water consumed
per dwelling unit is less than the amount that would be permitted before exceeding the
minimum sewer rent set forth above, then the billing will be calculated by multiplying
the number of units served by the master water meter times the minimum sewer rent
set forth above.
(4) The charges set forth above shall be effective with respect to bills rendered on or
after the effective dates set forth above, even if the measurement is for consumption
prior to the above effective dates (i.e., any bill rendered on or after January 1, 2013, shall
be calculated at the 2013 rate even if the sewer use occurred prior to January 1, 2013).
(5) In the event a property is connected to public sewer, but is not connected to a
water meter, the sewer rent shall be based upon estimated water consumption as

reasonably determined by the Director of Public Works based upon recognized
methods of estimating typical consumption for the type of facility involved (e.g., gallons
per day per bedroom).
FURTHER RESOLVED, that the Town Board of the Town of Ithaca hereby establishes a
water rate of $5.84 per 1,000 gallons of water consumed with the following water rate
schedule:
WATER RATE SCHEDULE
Effective January 1, 2013
The rate charged for water consumption shall be $5.84 per 1,000 gallons of water
consumed. The foregoing rate will be the rate charged for all regular quarterly bills sent
on or after January 1, 2013. Actual or base consumption may occur prior to January 1,
2013.
Notwithstanding the foregoing rates, the following minimum base charges shall be
applicable to the meter size indicated below for regular quarterly bills issued on or after
January 1, 2013. The table below also shows the amount of water consumption that is
permitted before the minimum base charge would be exceeded:

Multiple Housing and mobile home parks of over 2 dwelling units, using a master

number of units on the master meter and this will be the billing rendered. If the
calculation of the water consumed per dwelling unit is less than the allowable
consumption for a three-quarter inch meter, then the billing will be calculated by
multiplying the number of units on the master meter times the minimum charge for a
three-quarter inch meter.
The water application fee for each new application for water service shall be the charges
for new water connections charged by the Southern Cayuga Lake Intermunicipal Water
Commission including application fees, meter charges, service tap fees, inspection fees,
accessory materials, installation costs, and any other fee or cost charged by the Southern
Cayuga Lake Intermunicipal Water Commission for connecting new water services.
An annual charge for each fire protection main serving a fire suppression system will be
billed along with the first quarterly water bill of the calendar year. The annual charge
for this service shall be $20.00 per diameter inch of the pipe supplying the fire
suppression system or such other amount as is charged by the Southern Cayuga Lake
Intermunicipal Water Commission for such systems. The pipe supplying the fire
suppression system is the pipe needed to supply the fire suppression system, installed
downstream of the system control valve.
In addition to any other charges due to the Southern Cayuga Lake
Intermunicipal Water Commission or the Town, there shall also be due to the Town a
charge of $25 for disconnecting and a charge of $25 for reconnecting water service
where water service has been disconnected pursuant to Town Code § 261-4 for failure to
pay water rates or other charges.

AGENDA ITEM #8 5:45 p.m. Public Hearing regarding Town of Ithaca
Preliminary Budget for 2013
Mr. Engman opened the public hearing at 6:52p.m. There was no one wishing to
address the board on this item and the hearing was closed.
Draft resolution was moved and seconded for discussion.
Mr. DePaolo asked again about the shift of duties from supervisor to deputy supervisor
which he assumed would be extra work involved with sheparding zoning ordinance
from start to finish and he wanted to hear more on how that is going to take shape.

Mr. Engman reiterated his comments from the last meeting saying that he thought that
zoning is better handled by Mr. Goodman and coverage for one full day off. Mr.
DePaolo asked what Mr. Goodman’s role would be in the zoning laws and Mr.
Goodman responded that he would be putting in more time, approximately 16 hours a
week and that time would be used working with Planning staff, COC and the Town
Board to develop the new zoning associated with the Comp Plan. Mr. DePaolo went on
to say that he assumed that after a 3-4 year comp process that the town would entertain
hiring a professional to help with the crafting of what is shaping up to be a rather novel
zoning ordinance and while he assumes that staff is going to be involved in any
scenario, he wondered if we would be better served and end up with a more
expeditious and comprehensive outcome if we consider hiring somebody who has been
through this a number of times and that is why this is a budget item and he is
discussing it here. Mr. Engman responded that we did hire a planner partially with the
idea that he had the knowledge and expertise for that and we have budgeted for a
shurette so we are not ignoring staff or consultants and we need a direct link between
the town board and the staff. Staff would take the lead but it seems logical to use Mr.
Goodman’s experience and expertise from his private practice and EcoVillage and other
similar developments. Mr. DePaolo’s response was don’t we have an existing
committee structure that provides ample exposure for Bill in any scenario to handle
zoning either through Planning Committee, Codes and Ordinances or a combination of
both? He said didn’t understand the flow chart because it seems it exists already
without this shift. Mr. Engman responded that there is a lot of behind the scenes work
on a lot of different issues that takes place and the committee is basically a venue where
a lot of the policy decisions are made, but the day to day nitty-gritty has been done by
him and that is what he is shifting. They all take talking, investigating and contacting
other people and interactions with adjacent municipalities; this all takes time and effort.
Mr. DePaolo thought it still sounded nebulous and he wanted an answer in plain
English what Bill would be going in the organizational pyramid. Does Bill come in and
dedicate 2 hours to zoning, or does he come in and make a call here or there, or what
does it actually mean? We have 4 people in Planning plus support staff. Mr. Engman
said that Bill would be playing the same role he would be and there is a lot of stuff that
he works on that does not fit on regular reports. There are meetings he attends to keep
up with what is going on in the community and it is a combination of administration
and public policy development.
Mr. Goodman added that he sees himself spending time looking at form based zoning
working with and researching with Mr. Tasman and drafting items before they go to
committee. Also, if we find it is too big of a job to do in-house, we could talk about
hiring an outside expert, although he did not see us needing that as soon as 2013. Ms.
Ritter added that it depends on when we finish the Comp Plan but Mr. Tasman is not
going to write our zoning ordinance, it will be planning staff and we may need experts
and consultants. She felt we could do design standards and tweaking of our current

zoning but there are certain aspects that while we can do a lot of the writing, we will
need guidance from outside.
Ms. Hunter asked what the role of the committees will be in the new zoning
development process. Will the COC rand PC review ordinance as it emerges or to
develop a full-scale ordinance and then bring that to committee for review? Mr.
Engman said he has not arrived at an approach and there is a lot of stuff to get through
in the next year as the Comp Plan is completed and the next steps are fleshed out an we
need to make sure everyone is included. Ms. Hunter wanted to make sure that we
formulate the procedure and timeline for the SEQR process. Ms. Ritter thought we
would be able to start the next step once the draft Comp Plan is submitted to the Town
Board.
Mr. Engman asked if there were any more questions regarding the 2013 budget.
Ms. Hunter stated that she was uncomfortable adopting the budget tonight since our
website still lists a budget meeting in November. She felt it was confusing to the public
and we have mixed meetings this year and last where in previous years, we have kept
budget and regular items separate. Mr. Engman responded that we schedule the
second budget meeting in case we need it, but it is more for the board than the public.
We sometimes cancel meetings if we have no business for them. He added that we
need to see if there are any questions that will necessitate having another meeting.
Ms. Hunter had questions about capital projects and bonding and the materials that Mr.
Solvig prepared. She wondered if by bundling our projects for bonding, do we wait
until the projects have been bid and awarded prior to going out for bond or not? Mr.
Solvig said ideally we would wait, but do not have to if it is advantageous for us to go
ahead prior. She asked if the Board could still comment on projects that are slated or
have gone out to bond and he responded yes.
Ms. Hunter asked Mr. Weber about the salt storage barn and whether we have
specifications and Mr. Weber responded that we do not, but he had distribute an
engineer’s estimate on the job. Mr. Weber explained the estimate and needs of the
building. Other municipalities who have done similar buildings and did not reinforce
the walls and floor, have said they regret that. She asked if we could use the building
for something else, and Mr. Weber responded that we do not have room on the lot to
leave it. He is hoping that we will be able to re-use some of the existing concrete which
will bring down the estimated costs, but we will not know until we start demolition.
Mr. DePaolo asked about the Coddington Road water main replacement and Mr.
Weber’s comments about frequent breaks. He was concerned that we are spending
money to fix something before the county redoes the road. Mr. Weber responded that
the County is 3-5 years out on redoing the road and we spend a lot of money now fixing
breaks as they happen which also inconveniences residents and costs more because they

have to be done right then. Mr. Weber thought we average 3-4 breaks a year right now
and it will only get worse and there is no guarantee that the county will do the road in
the 3-5 years they are saying now.
Ms. Hunter asked about the 5 year capital improvement program that lists projects and
capital expenditures and asked if by adopting this budget, the board was approving
everything listed. Mr. Engman responded that we are not; the list was included for
information but each expenditure comes up each year for discussion and approval by
the budget committee first and then the full board.
Ms. Hunter spoke about having some way to evaluate the capital expenditures and
going forward having some criteria to evaluate and project out the life of our assets.
Mr. Engman talked about the process now of staff making suggestions which go to the
department head, which goes to either the budget or public works committee for review
and recommendation to the town board. He thought we have done a very good job at
long-range planning as evidenced by our not borrowing anywhere near what we are
allowed. Mr. Weber added that we base our replacement schedule on the life of the
facility, maintenance history, etc. Ms. Hunter requested that it would be nice for the
board to understand the story behind the capital expenditures because they are
approving the funding. Discussion followed on ways this could be done and staff are
working on it.
Mr. DePaolo asked Mr. Solvig about his handout and it looks like it spikes and then
levels. Mr. Solvig responded that it is difficult to say because some things may not be
identified and this schedule is based on what we have identified today on the estimated
costs we have today. Are we assuming that we are borrowing more now to take
advantage of circumstances or will we continue to borrow at this level? Mr. Solvig said
that we can’t really know because we won’t know what emergencies or failures might
happen and what the rate climate will be. Ms. Hunter asked about the affect on the tax
rate and Mr. Solvig explained his handout on which he broke out the affect on the tax
rate by fund and capital project. (Attachment #4) All projections are based on factors
right now – assessments – costs- interest rates.
Mr. Engman noted that we have the motion on the floor to accept the preliminary
budget as the final budget. Ms. Hunter asked that we do not advertise multiple budget
meetings.

NYS Rte 96 to the entrance of Cayuga Medical Center, matching the existing length and
width, and other related ancillary facilities, and
WHEREAS: The Director of Public Works has reviewed the bids and qualifications of
the bidders and has recommended that the low bid of $219,767.00 for the total project
made by Bothar Construction, 170 East Service Road, Binghamton, NY 13901, is a
qualified bid, and
WHEREAS: At the October 17, 2011, Town Board meeting, the Town Board adopted a
2012 Ithaca Town Budget which included monies for the construction of improvements
to Harris B Dates Drive identifying the maximum amount of $250,000.00 to be
expended by the Town of Ithaca for this improvement, and
WHEREAS, at its regular meeting on October 15, 2012, the Town Board has determined
approval, construction and implementation of the Improvement are a Type II Action

implementation of the Improvement are not subject to review under SEQRA;

Ms. Drake explained the status and work done in both the Personnel and Employee
Relation Committees. This is a fluid program which is made to be that way because job
descriptions change and a classification system is never going to be perfect.
Mr. DePaolo asked if we had to have a point system and Ms. Drake responded that we
did not, but this is a practice that will help us be organized and systematic in looking at
all the positions in the town and taking out any discrimination, favoritism and really

based on the job descriptions and classifying them against each other in an organized
hierarchical system and then the wage system that goes with it is an additional piece.
You could do this without wages. Mr. DePaolo asked how seniority or performance
plays into this and Ms. Drake responded that it doesn’t; the person does not play into
this part at all. This is position based. Mr. Goodman added that a lot of this ties into
civil service and we do not have a lot of control over. Mr. DePaolo asked if it was an
aggregate point total that a person needs, or do you have to satisfy each area? Ms.
Drake used the example of a civil engineer. A Civil Engineer requires a Bachelors
degree plus 2 years of experience; it does not require a PE which is their license. We
have someone who has their PE, which is good for the town of ithaca, but we don’t pay
them any more for that because we are not utilizing their license. She also explained
that there a three levels or opportunities of meeting the minimum qualifications with
flexible ways that include experience and college etc.

Town Boardroom layout – Mr. Engman explained that we would like to try an
experiment because right now we share the space and chairs have to be flipped at least
twice a week and by using one direction, we will also gain a lot of space. Also, the court
is reviewed by the New York State Unified Court System (NYSUCS) and continually
gets marked down for security inadequacy because the chairs are singular and could be
thrown. The NYSUCS like at least three bound together. The idea is to move the
horseshoe to the other end, in front of the Bench but they will be able to move off to the
side on court days. Discussion followed.

^ ^ Small Park Proposal
The Forest Home Improvement Association (FHIA), on behalf of Forest
Home residents, has requested that the Town of Ithaca accept the Cornell
Plantations' offer of a long-term lease on the small park along Forest
Home drive, adjacent to the intersection with Pleasant Grove rd.
Many visitors to the neighborhood, in addition to residents, regularly walk
or jog through the area, and would appreciate having access to open space
along this section of Forest Home drive, especially given that there is no
sidewalk along that portion of the road. The small park would also become
the only nearby open space owned by the Town of Ithaca. Because it is at a
lower elevation, the parcel appears quite small when viewed from across
the street, but in reality it is large enough to permit a variety of uses.
Earlier this year, a working group was established within the FHIA to
consider ideas for future uses and changes to the layout of the small park.
There has been discussion of various ideas for improving the park's
accessibility and utility as both a natural area and staging ground for
community events. The following, while not a formal FHIA proposal,
f ^ represents the current state of discussion within the small park working
' ^ group.
The park is envisioned as a mixed-use area with the sections at each end
maintained as they are now, regularly mowed and available for block
parties and other outdoor gatherings; the central portion would be planted
and maintained as a natural area with winding paths and benches. For the
natural area, the goal is to create a space similar to Cornell Plantation's
Mundy Wildflower Garden, although the community would prefer paths of
finely crushed stone rather than gravel, for ease of walking and wheelchair
accessibility.
Regarding changes and additions to the current layout of the park, this
proposal is under consideration (several items reference the attached map):
1) Any space set aside for parking be confined to the current
"footprint" of the graveled area nearest the intersection (already
used on occasion by utility vehicles (see area marked "P" on
attached map of the small park), and no trees be removed to
facilitate parking
2) A tasteful sign be placed near the entrance to the parking area (see
"S" on map), welcoming visitors to the park, and a street sign be
i ^ mounted below this "welcome" sign, indicating that Forest Home
i * drive continues around the comer to the south (currently many
drivers incorrectly assume that Pleasant Grove rd. continues on the
south side of the intersection, leading some to make use of the
driveways of nearby houses in order to turn their cars around)
3) A low, tasteful fence similar to the existing split-rail border fence be
considered for the area along the northwest edge of the park, where
there is currently access to a short, but steep drop down to Fall
Creek (everywhere else, access to the stream is largely blocked by
dense vegetation, but we would like to maintain this particular area
as a lookout and it might benefit from the additional safety that a
fence could provide)
4) The split-rail fence now running along the border between the park
and Forest Home drive be repaired where it is falling down and
planted with native flowers and/or vines on the park side of the
fence (some local volunteer effort is available to do this, with the
Town's consent)
5) For pedestrian access, an opening be created in the border fence
across from 208 Forest Home drive, where the parkland is already
elevated to nearer the height of the road as a result of past work
done at the site
6) Residents of homes across the street from the park be able to plant
> flowers or otherwise beautify the areas immediately surrounding
their mailboxes, which are located in the grassy strip between the
border fence and the road, without those plantings being destroyed
when the Town mows along the edge of Forest Home drive (since
the mowers must avoid collisions with the mailboxes themselves,
it should be possible for them to avoid the areas around them)
7) The park area between the parking space, south to the northernmost
crab apple tree (just under one-third of the total park area above the
wooded slope leading down to Fall Creek; see left area marked
"O" on map) be maintained in its current form, existing trees and
mowed grass; we request that the Town take responsibility for
mowing, perhaps to be coordinated with the regular mowing of the
grassy strip between the fence and Forest Home drive
8) South of the above, ending just past the southernmost crab apple
tree (about half of the total park area above the slope; see central
area marked "Natural Area" on map) be planted with some
combination of additional native trees and other native plantings,
with winding crushed stone paths and benches (some local
volunteer effort is available for placing and maintaining the
plantings)
9) The southernmost portion of the park (about one-sixth of the total
park area above the slope; see right area marked "O" on map) be
maintained in its current form, existing trees and mowed grass (as
in item 8. above, with mowing performed by the Tovm)
10) The sloping portion of the park leading down to Fall Creek be
maintained in its current form (trees and shrubs; some local
volunteer effort is available to manually remove invasive species)
There is willingness among some Forest Home residents to assume
responsibility for planting native plants in the proposed natural area, and
perform regular cleanup, light pruning of dead limbs on trees/bushes, and
manual (non-herbicide) removal of invasive species. Maintenance could
be done through the Adopt-a-Park program or as an addition to currently-
scheduled neighborhood cleanup days.
The community is interested in pursuing various options for grants to help
cover any costs associated with the setup or maintenance of the park.

The Forest Home Improvement Association (FHIA) is pleased to submit a proposal in

Our understanding is that the Cornell Plantations is interested in leasing the vacant land at
this location to the Town of Ithaca. Forest Home endorses the concept of the lease, and is
enthusiastic about creating a small park in that location.
Forest Home residents have a variety of ideas and visions for the proposed park—some of
which are touched on very briefly in the proposal. The breadth and number of ideas
residents submitted to the FHIA clearly demonstrates a high level of support for creating a
small park.
With submission of this proposal, the FHIA envisions two interrelated next steps:
• First, we hope the Town of Ithaca will seriously explore the possibility of leasing the
land under discussion from the Cornell Plantations.
^ • Secondly, assuming the lease happens, we hope the Town of Ithaca will engage the
residents of Forest Home in creative conversation and discussion about features
desired in the small park. The FHIA is more than willing to support an opportunity
for community feedback and discussion with the Town by circulating
announcements, securing a venue for discussion, etc.

Proposal for Forest Home Park
Proposal: Accept a long-term lease from the Cornell Plantations for the vacant parcel at the intersection
of Pleasant Grove Rd. and Forest Home Dr., and create a small park there.
Background: At the October 2011 Forest Home Improvement Association Annual Meeting, Ithaca Town
Supervisor and Forest Home resident Herb Engman indicated that Cornell Plantations is interested in
offering a long-term lease to the Town of Ithaca for the vacant land at the corner of Forest Home Drive
and Pleasant Grove Road. Herb indicated a Forest Home proposal for using the land might usefully
contribute to the Town's thinking about whether or not to accept the lease from Cornell.
Accordingly, a working group from Forest Home came up with several ideas for how the community
might use the parcel. Subsequently, Herb told us that it would be best if Forest Home put forth a single
concept, to make it easier for the Town to consider the lease offer. A basic proposal was prepared and
offered to the community of Forest Home for comment. The proposal offered to the Town, below,
attempts to balance and be inclusive of a variety of community comments that reflect the many
approaches and uses individuals envision.
Proposed concept: Create a small park with these features:
Benches situated to enjoy a view of the creek and also placed in other locations.
A break in the existing fence to make it clear that the area is intended for use.
Natural, native, low-maintenance landscaping.*
Paths.*
An open area for occasional Forest Home gatherings.* Note: because there are concerns about
the impact of Stream Setback legislation on maintaining an open area that requires mowing and
because we need to balance the need for an open area with naturalistic plantings, careful
decisions about type of grass{es) and discussion about mowing vs. not mowing is suggested.
Attention to accessibility for wheelchairs, strollers, and people who use aids like walkers and
canes: at least some benches situated so that a wheelchair or stroller can be roll up next to
them.
*Landscaping, path materials, and open-area materials and maintenance plans should satisfy a variety of
interests: accessibility; views; a naturalistic, low-maintenance setting and the flexibility to use the park
for gatherings, play, gardening and walking as well as for individual enjoyment and as a wildlife habitat.
Next step: Because the proposed small park has sparked interest among Forest Home residents and
because there are a variety of visions. Forest Home requests design consultations with the Town in the
event a park is approved for the parcel. The Forest Home Improvement Association is available to assist

THIS AGREEMENT made this day of 2012, by and between
Cornell University, c/o Real Estate Department, Box DH, Ithaca, New York 14853, hereinafter
called "Cornell," and the Town of Ithaca, c/o Town Hall, 215 N. Tioga Street, Ithaca, New York
14850, hereinafter called the "Town."
WITNESSETH:
WHEREAS, Cornell owns certain real property located on Forest Home Drive in the Town
of Ithaca (Tax Map Parcel No. 66-4-2); and
WHEREAS, the Town would like to use a portion of said real property for public
recreational purposes; and
WHEREAS, in consideration of the Town's willingness to assume maintenance
responsibilities, Cornell is willing to grant permission for such use upon the terms and conditions
contained herein.
NOW, THEREFORE, the parties agree as follows:
1. Grant: Cornell hereby grants to the Town the right to use, occupy, and maintain that
portion of Town of Ithaca Tax Map Parcel no. 66-4-2 bounded by Forest Home Drive to the north
and east, the lands of Sidle (R.O.) to the south, and the top of the east bank of Fall Creek,
(hereinafter the "Premises"), for use as a Town park. The Premises are more particularly shown on
Survey Map Showing A Portion of the Lands of Cornell University Located On Forest Home Drive,
Town of Ithaca, Tompkins County, New York, prepared by T.G. Miller P.C. and dated September
23, 2011, which map is attached hereto as Exhibit A.
2. Term and Commencement: The term of this License shall be ninety-nine (99) years,
unless sooner terminated as hereinafter provided, commencing upon the date of this Agreement.
3. Condition and Warranties: The Premises are vacant and shall be licensed to the
Town in as-is condition. Comell warrants that it has no actual or suspected knowledge of the past or
current presence of storage tanks on or under the Premises, nor of a release or threatened release of
hazardous substances or wastes on or under the Premises, as such substances and wastes are defined
by applicable federal, state or local environmental laws. Comell further warrants it has no actual or
suspected knowledge of any violations of any federal, state or local environmental laws relating to
the Premises.
4. Compliance: Town will comply with all applicable federal, state, and local laws
and ordinances, and rules and regulations of any duly constituted authority, with respect to the use or
occupancy of Premises by Town, its successors and assigns, including, but not limited to,
environmental laws such as the Resource Conservation and Recovery Act (RCRA), National
Environmental Policy Act (NEPA), the Clean Water Act (CWA), the Clean Air Act (CAA), Toxic
Substances Control Act (TSCA), the Federal Insecticide, Fungicide and Rodenticide Act, and the
Endangered Species Act.
Town shall procure and maintain in force during the term all permits, authorizations, and
licenses necessary for Town's use or operation of the Premises or any portion thereof (including,
without limitation, the making, placing, maintaining or altering of the Improvements or any portion
thereof). Cornell agrees, upon the Town's request, to cooperate with the Town in obtaining such
permits, authorizations, and licenses.
5. Use: Town covenants that neither it nor any assignee nor any sublicensee will (a) use
or permit to be used any part of the Premises for any dangerous or noxious trade or business, (b) use
or store any hazardous or toxic substances at the Premises, or (c) permit any objectionable noise,
smoke, dust, or odors or other nuisance to be maintained at the Premises, or (d) use any chemicals
that may negatively impact soil or water quality on the parcel or in the adjacent waterway.
The Town shall not dispose of any debris on the Premises or any adjacent land of Cornell and
shall not permit others to do so. The Town shall be responsible for the policing of the same and
keeping the area reasonably clean.
6. Improvements: The Town shall be free to place or construct any removable, non-
powered improvements for passive use of the Premises including, without limitation, picnic tables,
park benches, trash receptacles, or other similar structures and equipment. Any other improvements
(including without limitation gazebos, shelters, or utility installations) shall require the prior written
consent of Cornell in each instance, which consent shall not be unreasonably withheld or delayed.
In the event that Cornell exercises its right of early termination pursuant to Section 14 below,
it shall compensate Town for the unamortized value of Town's authorized improvements (excluding
sidewalks) that cannot be relocated, provided that all such improvements shall depreciate on a
straight line basis (without interest) over a ten (10) year period from the date of their installation, \
such that their value at the end of the tenth year is deemed to be zero.
Any such improvements installed by the Town shall be maintained in a good working order
at the Town's expense.
Upon the expiration or sooner termination of this License, the Town shall remove any
improvements it has placed on the Premises and shall leave the same in substantially the same
condition as when they were delivered to the Town. Any improvements left on the Premises after
the date of termination shall become the property of Cornell.
7. Restrictions on Premises: The Premises are bordered by Cornell Plantations. In
order to protect and maintain the integrity of the Plantations natural areas, the following
standards and restrictions shall be in effect during the term of the License:
a. The Town may not plant, introduce, or maintain on the Premises or the
adjacent property of Cornell any of the species defined as invasive by the Tompkins County
Environmental Management Council (TCEMC) or by Cornell Plantations. The current list
prepared by Cornell Plantations is attached hereto as Exhibit B. Updated lists will be provided to
the Town from time to time by Comell Plantations or as published by Tompkins County.
b. The Town shall not cut any trees or damage any plants on the Premises or
any adjacent property of Comell without Comell's prior written consent, except that the Town
may cut or trim trees or remove other obstacles as necessary to maintain safe access along Forest
Home Drive upon prior notice to Comell and the Town may remove, cut and/or control invasive

plants listed in Exhibit B. Notwithstanding the above, where the Town must act immediately to
assure public safety, the Town may cut or trim trees or remove other obstacles as necessary to
maintain safe access along Forest Home Drive, or may remove a hazardous condition on the
Premises, without prior notice to Cornell, and the Town may remove any obstacles that block
immediate access to the Premises without prior notice to Cornell, provided that the Town
provides Cornell with notice as soon as reasonably practicable thereafter.
c. No fiiel tanks may be installed underground on the Premises.
d. This License is subject to the public right-of-way and easements shown on
Exhibit A and any other easements of record. The public's rights to use Forest Home Drive, and
the Town's rights pursuant to its right-of-way and easements on or under the Premises, are not
affected or restricted by the terms of this License.
8 Licensor's Access to Premises: Comell reserves the right to access the Premises (or
to authorize others to do so) at any time in order to maintain its other property, including (without
limitation) cutting or removing hazard trees or invasive species in the area between the Premises and
the water line; or to maintain facilities in existing easements. Comell agrees to provide Town with
reasonable prior notice of such access, except in emergency situations. Comell agrees to promptly
remove any debris from the Premises following such access and to regrade and reseed the Premises
as necessary.
9. No Transfer: The Town may not transfer or assign this License to any third party
without the prior written consent of Comell.
10. Taxes: The Town agrees to pay any and all taxes, assessments, or similar charges,
which may be imposed against the Premises by reason of this Agreement, or the Town's use of said
Premises, such as increased taxes due to Town improvements or use. Comell will pay all other
taxes, assessments, or similar charges, if any.
11. Indemnification:
(a) The Town will indemnify Comell and its directors officers, employees and
agents against, and will defend and hold them harmless from, any claim, demand, action, suit,
liability, or judgment whatsoever (including without limitation reasonable investigatory and legal
costs) arising out of (i) the use or occupancy of the licensed premises by the Town, its agents,
employees, contractors, or invitees, including the public, except to the extent such claims, etc., arise
from the negligence or willful misconduct of Comell, its employees, contractors, agents or invitees,
or (ii) the Town's noncompliance with or violation of any applicable federal, state or local
environmental law related to the Premises.
(b) Cornell will indemnify the Town and its elected officials, public officers,
employees and agents against, and will defend and hold them harmless from, any claim, demand,
action, suit, liability, or judgment whatsoever (including without limitation reasonable investigatory
and legal costs) arising out of (i) the use or occupancy of the licensed premises by Comell, its agents,
employees, contractors or invitees, except to the extent such claims, etc., arise from the negligence
or willful misconduct of the Town, its employees, contractors, agents or invitees (including the
public), or (ii) Comell's noncompliance with or violation of any applicable federal, state or local
environmental law related to the Premises (including, but not limited to, violations of law related to
facilities or environmental conditions at, on, from, under or in the Premises that are in existence prior
to the date of this Agreement, regardless of when the environmental conditions become known or
when releases from the facilities occur).
... ' '12. Maintenance'. The Town agrees, at its expense, to maintain the Premises m good
order and repair, comparable to the standard of care used to maintain any other Town park.
13. No Rent: This License is provided to the Town without any charge to, or rent
payable by, the Town throughout its term.
14. Default'. In addition to any other remedies at law, in the event of the refusal or failure
of the Town to comply with any of the foregoing undertakings, Cornell may upon thirty (30) days
written notice speci^ng the default and providing opportunity to cure, and thereafter if not cured,
terminate this License, and the Town agrees that in such event and upon demand it will immediately
remove from and cease to use or occupy the Premises. If the default is not capable of cure within
thirty (30) days, Cornell may terminate this License if after written notice the Town has not
undertaken all actions necessary to begin curing the default within thirty (30) days and/or thereafter
does not diligently pursue such actions until a cure is achieved.
15. Early Termination'. The Town may terminate this License upon thirty (30) days
written notice to Cornell at any time, for any reason. Cornell may terminate this License upon two
(2) years prior written notice to the Town should it need the property back for educational puiposes.
16. RiQht of First Refusal. During the term of this License, before Cornell may sell the
Premises to a third party, Cornell shall first offer the Town the right to purchase the Premises on the
same terms and conditions as are offered by the third party. The Town shall have thirty (30) days
during which to accept said offer. If the Town does not accept said offer within said period, Cornell ^
shall be free to accept the third-party offer. If Cornell does not enter into an agreement with the third
party on said terms and conditions and close the transaction within ninety (90) days of its acceptance
of the third-party offer, Cornell's right to sell the Premises to the third party shall expire and the
procedure described in this section shall again be applicable.
17. Notices'. Any notice hereunder shall be hand delivered or sent by certified or
registered mail, return receipt requested, or by commercial express delivery service such as Federal

18. Binding Effect: This Agreement shall be binding up the parties hereto and their
respective successors and assigns.
19. Entire Agreement: This Agreement constitutes the entire agreement between the
parties and supersedes any and all prior written or oral agreements, negotiations or imderstandings,
existing between the parties. This Agreement may be amended only by written instrument signed by
each party.

Months of Augns^September Board Report
October 15,2012 Town Board Meeting
Roads:
Ditching and shoulder maintenance was performed on roads to be surface-treated in
the Northeast.
Shoulders were installed on Seven Mile Drive prior to surface-treating.
Surface-treatment was completed the week of August 6-10.
Roadside and easement mowing continued.
A drainage swale at the end of Roat Street was re-established and hydro-seeded.
Brush and tree trimming was performed throughout the Town.
Hot patching and crosswalk painting was performed.
We assisted the State with cleaning of Coy Glen Creek drop structure. Gravel was
stockpiled at Public Works for screening and processing.
We assisted the Towns of Ulysses, Lansing, and Newfield with trucking and milling
on several projects.
Surplus equipment was prepared for the auction and delivered to the auction site in
Lansing.
Site work on the pole barn addition and annex addition was completed prior to the
contractor starting construction work.
New stop signs and stop bars were installed on Salem Drive following a request from
the neighborhood.
Reconstruction project at Harris B. Dates Drive began the last week in August.
Interviews for a full-time Laborer position were held September 6*^ with the selection
of Richard Dickens who started September 17^"^.
Storm damaged trees were cleaned up and chipped.
Gabion stone and various grades of gravel were hauled in for stockpiling.
A bucket truck service was hired to assist our crew with hazardous tree removals at
various roads, parks, trails, and water tank sites.
Various components of our annual employee training requirements were completed
September
A catch basin at the comer of Forest Home Drive and Judd Falls Road was repaired.
Exit interviews for summer seasonal Laborers and the first group of 25-week seasonal
Laborers were performed. Starting October 1®^, only three 25-week Laborers remain.
Sewer:

Parks, Trails, and Preserves:
• Regular grounds maintenance and weekly site inspections were performed.
• The annual Employee's Appreciation Picnic was held at the Tutelo Park pavilion on -
August 3^^. The newly installed pervious pavement walkway around the sides of the
structure proved to be a great success.
• New park and trail identification signs were installed at Hungerford Heights and
Tudor Parks and also at the Juniper Drive entrance to South Hill Trail.
• The parking lot at Grandview Park was surface-treated.
• Installation of the new playgroimd at Tutelo Park began.
• Rental of Valentino Field and the Tutelo pavilion continued during this period.
• The extended drought has led to an unusually high rate of tree mortality at many of
our park and open space sites. We continue to regularly remove any of these tress
which pose an eminent hazard to the public.
• Cornell's P.O.S.T. volunteers assisted our park crew with the installation of Fibar
mulch at our new playgroimd in Tareyton Park. This structure is now open for use.
• A repair to the Warren Road Walkway was required where settling occurred due to
excavation for water service.
Water.
• A leaking water valve was repaired on Schickle Road.
Lawn repairs at Ridgecrest and Hungerford water tanks were done once the ,
contractor's were finished.
Several leaking water services on Hanshaw Road were repaired and lawns were
reseeded.
Water main repairs were completed at Clover Lane, 642 Coddington Road, Pleasant
Grove Road, and across from 636 Coddington Road.
Fifty new hydrant markers with reflective tape were installed.
Site restoration began at the new Northview tank. The main was excavated so Bolton
Point could install a 1" tap and service line.
A total of 238 Dig Safely New York mark-outs were completed.
Weekly pump station checks were completed.
A plugged sewer at the intersection of Park Lane and Slaterville Road was cleared.
I.T.T. Flygt performed some sewer pump repairs at East Shore Drive pump station.
They also assisted us with preventive maintenance at several other pump stations.
A sewer plug was repaired at 1065 Taughannock Boulevard using the Sewer Jet.
Sewer line easements were mowed.
A new pump was installed at the East Shore Sewer Pump Station.
Engineering:
• Inspected 23 simple SWPPPs.
• Oversaw seven full SWPPPs.
• Project Management and Job Inspection for:
o Northview water tank replacement
o New Pole Bam - Public Works
o Annex Extension / Addition - Public Works
o Harris B. Dates Drive
o Tutelo Park Playground
• Survey, design, work for 2012 maintenance projects:
o East Shore Park pavement repair and drainage
o Prepared design altematives for the King Road drainage
• Completed constmction on Penny Lane water main and Hungerford Hill water tank

• Assisted Bolton Point with design of transmission main replacement.
• Development:
o Inspection of new sanitary sewer at Ecovillage TREE
o Gave green infrastructure tour to members of Stormwater Coalition Planning
Boards
• Managed the work program for two summer intems which included inspections,
surveying, data collection, performing pavement condition surveys, scanning existing
facility plans, curb cards, hydraulic investigation for South Hill Trail culvert pipes.
• Attended Planning Board meetings
• Attended E & O Meetings at Bolton Point
