REPORT OF TOWN OFFICIALS Supervisor ' s Report August Town Board Meeting Supervisor Desch suggested that the August Town Board meeting be held on July 28 , beginning at 5 : 30 P .M . Neiderkorn Study Supervisor Desch noted that the Neiderkorn Study on the proposed Route 96 realignment had been tabled by CcMion Council , CHIP ' S The Supervisor stated that he had received a letter from the State DOT indicating that the Town of Ithaca will be receiving their full allotment under the CHIP ' S Program , Benefit Assessment • The Supervisor noted that the Water Commission had apporved the benefit assessment . He went on to say to the Town of Ithaca ' s rate drops slightly every year while the Town of Lansing and the Village of Lansing ' s rate increases . Town Engineer ' s Report Water and Sewer Town Engineer Lawrence Fabbroni highlighted his report to the Board (copy attached to the official minutes ) . Town Engineer Fabbroni noted that he had mailed letters of award for the repainting of the FLANNING AND ENGINEERING REPORT Lawrence P . Fabbroni , P . E . LPF/ nmf 7 / 7 / 86 I Town Board 2 July 7 , 1986 Hungerford and Pine Tree Road tanks . He noted that the contractor was not sure if the repainting would be done this year . The Town Engineer went on to say that LaFayette Pipeline was doing cleanup of the Phase II water extensions . The summer crews were surveying for new water and sewer extensions , doing level runs and base lines . Mr . Fabbroni stated that he and Bob Flumerfelt would be preparing the feasibility study . Parks The Town Engineer went on to say that the first contingent of Parks summer workers had been hired and have begun the heavy maintenance of the facilities . Burns Road Burns Road is virtually canpleted , except for blacktoppinq_ . The State is allowing us to use Phase I money for the project . Hospital Access Road The Town Engineer stated that sane details of the plan needed to be changed , after talks were held . He noted that staff was doing double time to get the project ready . Forest Herne Drive The City is installing the gabions and drainage pipe . The Town is working on the other end of the road on the washout . Safety equipment is being purchased . Cornell University has moved the wires on the poles and are planning their part of the project, Park Lane The Engineer stated that a number of discussions had been held with NYSEG , the developer and the Supervisor . The County has allocated a small amount of money toward the drainage project . Supervisor Desch stated that he expected NYSEG to contribute the cost of relocating the gas line as they will be picking up approximately sixty new custaners . Supervisor Desch asked who would be paving Forest Herne Drive between Martha Van Rensselaer and the Town line ? Town Engineer Fabbroni responded , this is a swing item . One of us , the City , Town or Cornell , will make up their third of the project there . Judd Falls Road The Town Engineer went on to say that the design of Judd Falls Road is almost completed . After talking to key property owners , the design seems to be satisfactory . He stated that Andy McElwee had been very helpful . Drainage Town Engineer Fabbroni stated that he had net with the people on Compton Road and that he feels we have a satisfactory drainage plan and the project can now proceed . He noted that the key landowner , Matychak , had agreed to having the creek on his property reshaped . • Also , we are in the process of designing and making minor improvements with the catch basin on Honness Lane , Sewage Treatment Plant Town Engineer Fabbroni reported that contract 1 was completed . Working on canpleting contracts 2 , 3 , and 4 , etc . Contract 7 is proceeding as well as can be expected , two vaults had to be redone . Councilman Cramer asked if the problem with the Allison pumps had been corrected? Town Board 3 July 17 , 1986 Town Engineer Fabbroni responded not completely . We are having to pump through restrictions in the existing system now, won ' t have these problems when we are on line . Councilman Cramer noted that the Engineer ' s Report did riot say anything about Sand Bank Road , The Town Engineer remarked that the County had sent the Town a letter saying the road was completed . We looked at the road the next morning after it had poured and the washouts were very bad . We are looking for additional fill now . The Town and the County will proceed together to complete the work but both are under other pressures and , therefore , this is not a number one priority . Supervisor Desch asked how many yards of fill was needed? Town Engineer Fabbroni responded , approximately 1 , 000 yards . Councilman Cramer asked if it was possible to open Sand Bank Read to property owners ? Town Engineer Fabbroni responded that he and Bill Mobbs had talked about this . We can open it by September , even if the road is not complelely finished . Councilman Cramer asked who would be responsible for the liability if the road is open before it is completed? Supervisor Desch responded , if the County says to open the road , we will tell them that they are opening it on their liability . Councilwoman Raffensperger asked if the Town Board would be receiving the alternatives for Phase III of Burns Road for reviewing? Town Engineer Fabbroni responded yes . He went on to say that somebody told him that two properties , in the area , were up for sale . The old design for Burns Road is about twenty years old and would cut one of the properties , he spoke of , in half . If they are for sale , this could provide the Town the opportunity to erase a major concern about the old design . Councilman Cramer asked what Phase III was ? Town Engineer Fabbroni responded , the south end of Burns Road where it meets with King Road . This phase is one of the 1986 Objectives . Councilwoman Raffensperger remarked that it would be interesting to have the actual cost figures for Phase I and II to compare against the budgeted figures . Councilman Cramer asked where the money to pave Burns Road would be coming from? Town Engineer Fabbroni responded , we will be using the remainder of • the State money . Councilman Cramer then questioned if the road would not be allowed to settle before paving began? Town Engineer Fabbroni responded that there was very little settling in Phase I . Also , April was dry enough so that we were able to get more work done than we anticipated , j f r� i i Town Board 4 July 7 , 1986 Town Engineer Fabbroni responded that he hoped to be able to have everything ready for a public informational meeting on the Judd Falls Road Improvement Project at the July 28th Board meeting . RESOLUTION NO . Motion by Supervisor Desch ; seconded by Councilman Cramer , RESOLVED , that the Town Board of the Town of Ithaca will meet and conduct a Public Informational Meeting on the proposed Judd Falls Road Improvement Project at 7 : 00 P .M . , on July 28 , 1986 , at the Town Hall , 126 East Seneca Street , Ithaca , New York , and • FURTHER BE IT RESOLVED , that the advertisement for said public informational meeting be placed in a box add in the Ithaca Journal . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none) . PERSONNEL COMMITTEE REPORT The Personnel Committee met last week and looked into the grievance filed with the Personnel Committee . The two parties involved have met and decided on a solution to their problems . The solution being satisfactory to both parties . A meeting will be held on Tuesday to discuss the applications received for the Zoning Officer/Building Inspector position and hopefully interviews will begin shortly . The Personnel Committee will also be looking into staffing needs for the Engineering/Planning Department , CHARGING A FEE FOR CHECKS RETURNED FOR INSUFFICIENT FUNDS RESOLUTION NO . Motion by Councilman Cramer ; seconded by Councilman McPeak , WHEREAS , on occasion checks rendered for payment of water and sewer rents are returned to the Town of Ithaca for reason of insufficient funds , NOW THEREFORE BE IT RESOLVED , that the following procedure be employed for collection of such checks : ( 1 ) Send notice to maker of check requesting cash payment for check . If maker responds within ten ( 10 ) days there will be no additional returned check fee charged . ( 2 ) If maker of said check does not respond within ten ( 10 ) days of date of written notice , then the amount of water and sewer charges plus penalty and a $ 10 . 00 returned check charge be rebilled to the water and sewer account for which payment was originally made . • AND FURTHER BE IT RESOLVED , that the Town Clerk be authorized to include in the annual tax levy , unpaid water and sewer rents that were rebilled due to uncollected insufficient funds check ( s ) including the $ 10 . 00 fee charged thereon . ROUTE 96 HOSPITAL TRAFFIC LIGHT Town Board 5 July 7 , 1986 Town Engineer Lawrence Fabbroni stated that he felt the State would be more receptive as the road will tie into a Town road where before it tied into a private road . RESOLUTION NO . Motion by Councilman Bartholf ; seconded by Councilwoman Raffensperger , WHEREAS , the Town Board has endorsed a Hospital access circulation plan to control access to existing and proposed uses in the hospital area such that after construction , a Town highway will extend from the existing State Route 96 Hospital intersection to • Indian Creek Road in such a way as to be compatible with any proposed State Route 96 plans , and WHEREAS , accident and volume records indicate an immediate urgency and warrant installation of a traffic light at the State Route 96 - Hospital entrance intersection , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca that in conjunction with the Community Hospital and Tompkins County the New York State Department of Transportation be requested to immediately study the need for installing a traffic light at State Route 96 - Hospital entrance intersection and upon verifying justification for same be requested to install same as soon as possible . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . REFUND ON BENEFIT ASSESSMENT RESOLUTION NO . Motion by Supervisor Desch ; seconded by Councilwoman Howell , WHEREAS , Agriculture and Markets Law, Article 25 AA , Section 305 , states that no benefit assessments or special ad valoreum levies may be imposed on land used primarily for agricultural production within an agricultural district on the basis of frontage , acreage , or value , except a lot not exceeding one-half acre surrounding any dwelling or non-farming structure located on said land unless such benefit assessment or ad valorem levies are imposed prior to the formation of the agricultural district , and WHEREAS , the area containing the farm of Richard Perry , 1138 Trumansburg Road , Tax Parcel No . 27-1-11 . 2 was originally established as Agricultural District # 6 , on February 13 , 1979 , ( it has now been combined with Agricultural District # 2 and the entire district is now known as Agricultural District # 2 ) , and WHEREAS , on th 1986 Town and County Taxes , Mr . Perry was charged 23 . 2 units of water and 23 . 2 units of sewer , and • WHEREAS , under the Agricultural District classification , Mr . Perry should have been charged 12 . 2 units of water and 10 . 5 units of sewer and should be refunded the difference , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorize a refund of $ 594 . 00 for ( 11 units ) water and $ 635 . 00 for ( 12 . 7 units ) sewer , total refund of $ 1 , 229 . 00 be paid to Richard Perry , 1138 Trumansburg Road , Ithaca , New York . Town Board 6 July 7 , 1986 (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . APPOINTMENT OF PARKS MANAGER RESOLUTION NO . Motion by Councilman Cramer ; seconded by Councilwoman Howell , WHEREAS , the selection committee for the Parks & Open Space Manager position have interviewed various candidates for the position , and • WHEREAS , Richard H . Schoch meets the requirements of the position and additionally has worked extensively within the Town of Ithaca parks , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca that Richard H . Schoch be permanently appointed Parks & open Space Manager , effective July 7 , 1986 , at an annual salary of $ 19 , 5009000 (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . REFUND ON WATER ACCOUNTS I RESOLUTION NO Motion by Councilman Cramer ; seconded by Councilman McPeak , WHEREAS , a meter reading error was made on the December 1 , 1985 water bill at St . Catherine Church , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorize a refund of $ 133 . 62 for water and $ 22 . 72 for water surcharge , total refund of $ 156 . 34 be made to St . Catherine Church , St . Catherine Circle , Ithaca , New York , Account Number 184-0203966 . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . RESOLUTION N0 . Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger , WHEREAS , on June 11 , 1986 a payment was made on the June water bill for the property at 310 Salem Drive , and WHEREAS , a second payment was made on June 23 , 1986 along with a special reading payment , • NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorize a refund of $ 18 . 58 for water , $ 3 . 17 for water surcharge and $ 3 . 63 penalty , total refund of $ 25 . 38 be made to Ruth M . Klippstein , 90220 Greenwood Drive , Leaburg , Oregon , Account Number 187-0218028 . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . REPORT OF HIGHWAY COMMITTEE Town Board 7 July 7 , 1986 Councilman Cramer state that the Highway Committee had held many meetings to examine the procedures . They had then spent many hours analyzing the functions , work activities plus the number of hours required to do the tasks . Councilman Cramer went on to say that the Committee had to justify the need for additional personnel and with vacations you see a real need to take the leap from eight men to ten men . Therefore , the Committee makes the recommendation that the Highway Department go fram an eight man department to a ten man department to provide the necessary services for the projected work load . Councilman Cramer highlighted the written report ( copy attached to the official minutes ) . Councilman Cramer noted the decrease in • vacation days because of the younger men being employed which is due to the retirement of senior employees . Councilman Cramer went on to say that the 10-Year Equipment Replacement Chart shows the cost , per piece of equipment , each calender year . The Committee is recommending that in 1989 a power broom be added to the equipment . The Town is presently using the power broom owned by the Village of Cayuga Heights , Councilman Cramer noted that the last three pages of the report were a rough projection of the 10-Year Paving Program . He noted there was less work today then ten years ago because the highway crew was doing better work . Town Engineer Fabbroni remarked that hopefully in six years we can give you breathing room in the paving budget . Supervisor Desch reminded the Committee that they should include the new roads , such as Abby and Penny . He then questioned why Burns Road was not in the paving schedule . Town Engineer Fabbroni responded that Burns Road shouldn ' t need paving for twelve years which would , therefore , be out of this cycle . The Highway Ccmmitte presented the following summary : "After a complete study of highway tasks to be performed on an annual cycle , it was determined fram total manhours , seasonal peaks , employee task profiles , and lost time that ten ( 10 ) full-time highway employees are necessary to safe and efficient delivery of public services and to meeting the needs of the Town of Ithaca . At least two full-time temporary seasonal employees , or more , are required to meet the peaked special project priorities of the Town Board , as well as to enable activities to be sustained through heavy vacation periods and during extended illness or injury absences . In evaluating the results of the preventive maintenance and equipment replaement program of the last six years , it was clear that new dump trucks and plows used to obsolenscence are the critical units in the Town fleet . Accordingly , the Ten-Year Replacement Plan was updated to prioritize immediate back-up and • replacement units for the dump units . The desirability of a shoulder machine , ten-wheeler dump , and small sweeper or crane were discussed , but the long-range uncertainty of sustaining special project activities suggests that renting such equipment is more economical for the foreseeable future . Continuing structural stability of highway resurfacing under the Ten-Year Repaving Plan instituted in 1980 exhibits the success and benefits of updating the program for another ten-year increment . While major collectors and arterials will still receive high Town Board 8 July 749 1986 priority for repaving , several new subdivision collectors will require paving over oil and stone treatment to be cost-effective . " Supervisor Desch commended the Committee on the excellent report . Councilwoman Raffensperger asked if the Committee had costed out the additional manpower and equipment? Supervisor Desch responded that the Board would not see a hugh increase in the budget this year . Town Engineer Fabbroni added , you had already budgeted money for Roy Casterline and Leon Poelvoorde and after they both retired , • replacements were hired at a lower salary . RECORDING SECRETARY FOR ZONING BOARD OF APPEALS RESOLUTION NO . Motion by Councilwoman Raffensperger ; seconded by Councilman Cramer , WHEREAS , the Zoning Board of Appeals has recommended the appointment of Beatrice Lincoln as Recording Secretary for the meetings of the Zoning Board of Appeals , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby approves the appointment of Beatrice Lincoln as Recording Secretary to the Zoning Board of Appeals . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and ]Geary voting Aye . Nays - none ) . REIMBURSEMENT FOR RECORDING SECRETARY TO PLANNING BOARD AND ZONING BOARD OF APPEALS Supervisor Desch noted that currently the Secretary is receiving $ 40 . 00 per meeting . The Personnel Committee has recommend $ 10 . 00 for transcribing . Town Attorney Barney noted that for a three and one-half hour meeting it takes nine to ten hours to transcribe the minutes . Town Engineer Fabbroni added , you can figure on two hours to transcribe for every hour the meeting takes . Supervisor Desch responded that the Board must take a look at the length of the minutes and the amount of detail . He went on to say that he felt the minutes could be shortened . Councilman Cramer suggested that a fee could be paid for pages , similar to the payment for thesis . • Town Engineer Fabbroni responded that anything less than $ 70 . 00 per meeting , you are going to run into problems . A qualified person should be paid $ 7 . 00 per hour , for a six hour meeting you will spend twelve hours transcribing . Councilwoman Raffensperger commented that if we aren ' t able to get someone to do the job for $50 . 00 we may need to reevaluate . Supervisor Desch remarked that there were plenty of grad student wives who would be happy to do the job for $50 . 00 . I Town Board 9 July 7 , 1986 Town Engineer Fabbroni remarked that starting the meetings at 7 : 00 P .M . , with three meetings a month was a lot of time and work . He went on to say that he had tried to phase Manpower in , to do the minutes , at $ 8 . 00 per hour . Anything less and they loose interest . Councilwoman Raffensperger remarked that the Chairman of the Planning Board had assured the Personnel Committee that the meetings would end by 10 : 00 P .M . Supervisor Desch stated that the Personnel Committee was going to look at the whole question of another secretarial person for the Engineering Department . • Town Attorney Barney remarked that he was concerned about his secretary working from 9 : 00 to 5 : 00 , attend a three hour meeting , then five to six hours transcribing the minutes . He suggested the Board consider $ 35 . 00 for the meeting plus a per hour transcribing fee . RESOLUTION NO . Motion by Councilman Cramer ; seconded by Councilman Bartholf , RESOLVED , that the Town Board of the Town of Ithaca hereby authorize the payment of $50 . 00 for the Recording Secretary for the Zoning Board of Appeals and the Planning Board . Payment to include attendance at the meetings and transcribing minutes . Councilwoman Leary stated that she could not vote for anything that is exploitative .
