REGULAR BOARD MEETING
May 12 , 1986
At a Regular Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 126 East
Seneca Street , Ithaca , New York , at 5 : 30 P .M . , on the 12th day of
May , 1986 , there were :

The Supervisor led the assemblage in the Pledge of Allegiance .
REPORT OF TOWN OFFICIALS
Supervisor ' s Report
Wastewater Treatement Plant Bonds
Supervisor Desch stated that he was pleased to report that the Town
received excellent bids on the $ 2 . 83 million bond issue . The low
bid was 6 . 8 % on the 20 year issue . We also preserved our Aa
rating . The City on their issue received three tie bids at 6 . 875% ,
the bidder with the higher premium winning . He went on to say that
by rolling in our small water and sewer projects we were able to
get the best possible rate on that debt also . We have a resolution
indicating that all interest earnings will be applied to the debt
retirement , that needs to be considered at this meeting . We are
also about to begin discussions on the new rate structure for the
• plant . Our first meeting is Thursday , this week .
Truck Traffic Restrictions
Supervisor Desch noted that the Town had a request to restrict
through truck traffic on Honness Lane . In discussions with Town
Engineer Larry Fabbroni it is clear that we need an integrated plan
for the Town as a whole before we decide on a specific street .
This is then a suggested objective that will be developed over the
next six months so that one year from now we will potentially have
a plan in place .

Agenda Item Update
The Supervisor stated that in addition to the interest resolution ,
he wish to call the Boards attention to several changes that have
occurred , due to activities , this past week .
Item # 8 The Planning Board is still deliberating on the
College View Mobile Home expansion so we will hold off on setting
the hearing date until our next meeting .
Item # 17 West Hill Planning Study . This is a land use
proposal from Tom Niederkorn that is not quite ready . He stated
that he expected to have a formal proposal for the June meeting .
• Item # 22 The Supervisor suggested that the Board consider
referring Mr . Kenerson ' s name to the Planning Board for their
recommendation .
Town Engineer ' s Report
Supervisor Desch noted that the Town Engineer was out of Town
attending a conference , however , Board members had copies of the
Engineer ' s Report ( copy attached to the minutes ) , and that Susan
Beeners and Robert Parkin were here , if there were any questions .
Supervisor Desch added that the Sewage Treatment Plant project was
running fairly smoothly . Bongiovanni , the Segment I General
Contractor had slowed his operation down a bit but we are confident
the pace will pick up again .
BUDGET AMENDMENTS
RESOLUTION NO .
Motion by Councilman Bartholf ; seconded by Councilwoman Howell ,
WHEREAS , traffic counting procedures are performed from time to
time , by the Town , in the Village of Cayuga Heights at Village
request ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby establishes an appropriation account for traffic
safety in the Townwide Fund , such account to be known as A3310 . 400 ,
Traffic Safety with a budget of $500 to be transferred from
Townwide General Fund Contingency A1990 . 400 , and
WHEREAS , due to the increased cost of insurance for the Town of
Ithaca ,
BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the following budgetary transfer : transfer of $43 , 000
from Fund Balance for Townwide General Fund to appropriation
account A1910 . 400 Unallocated Insurance , and
• FURTHER BE IT RESOLVED , that the Town Board of the Town of Ithaca
hereby authorizes the following interfund transfer from the Federal
Revenue Sharing Fund to the Water Fund to allow for all
expenditures relative to the painting and cathodic protection of
the Pine Tree Road Water Tank and Hungerford Hill Water Tank to be
accounted for in one fund namely , the Water Fund : transfer from
Federal Revenue Sharing Fund CF1990 . 400 Water System Contingency
$25 , 000 and CF8340 . 400 Water Tank Painting/Maintenance $ 11 , 931 . 02
to Water Fund F8340 . 481 Tank Painting/Maintence , and

BE IT FURTHER RESOLVED , that the Town Board of the Town of Ithaca
authorize the following budgetary amendments to appropriate funds
for the Town ' s portion of employee disability insurance . transfer

Disability Insurance ; transfer $ 150 from Part-Town General Fund

RESOLVED , that the Town Board of the Town of Ithaca hereby appoint
Councilwoman Raffensperger and Councilwoman Leary to serve on the
Local Board of Assessment Review for the Town of Ithaca on
Wednesday , May 14 , 1986 , from 3 : 00 P .M . , to 6 : 00 P . M .

AWARD BIDS FOR HUNGERFORD HILL AND PINE TREE ROAD TANKS
Bids were received from Broome Industrial Construction , Inc . , of

Service of Interlaken , New York in the amount of $62 , 000 and
Spensieri Painting Company , Inc . , of Syracuse , New York in the
amount of $ 70 , 095 .

WHEREAS , on May 7 , 1986 , bids were received for the repainting of
the Town of Ithaca Hungerford and Pine Tree Road Water Storage
Tanks , for the Town of Ithaca , New York , and
WHEREAS , the Town Board has carefully considered the Engineer ' s
Report on these bids and has adopted a Budget for said project ,
NOW THEREFORE BE IT RESOLVED , that the award be made of contracts
for repainting to the following :

Highway Superintendent Robert Parkin stated that he had look at the
proposed vehicle , a 1987 Plymouth Horizon , and found it to be
acceptable .
RESOLUTION NO
Motion by Councilwcenan Howell , seconded by Councilman Bartholf ,
WHEREAS , bids for a new 1987 four door sedan were authorized to be
taken by the Town Board , and
WHEREAS , bids were opened May 12 , 1986 , with the attached results
showing proposals with a low bid of $ 5 , 799 , suhmi.tted by Key
Motors , Inc . , 320 Elmira Road , Ithaca , New York ,
NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of
Ithaca that the Town Board award the bid to Key Motors , Inc . , in
the low amount of $ 5 , 799 . 00 .

PERSONS TO BE HEARD
Robert Earle , 112 Kay Street stated that he had been in contact
with the residents of Kay Street and all agreed that a petition
should be presented to the Town requesting that their street be
plowed in the winter but that no salt or cindering should be done
on Kay Street as they have an ongoing problem in the spring with
great hugh clouds of dust . A sweeper is used on the road each
spring , however , it does not get all of the dust . Mr . Earle went

on to say that because Kay Street is a cul-de-sac and a level road ,
salt and cinders are not needed , however , the intersection should
be salted and cindered so that people do not slide into Hanshaw
Road ,
Supervisor Desch then read the following memorandum which was
presented to the Board .
" Same Kay Street property owner have indicated that they plan to
attend the May meeting of the Town of Ithaca to express in person
their dismay over the condition of the road .
As you are no doubt well aware , there is a lot of dust each spring
• and this year Kay Street is not much better than a dirt road . When
one ccmrpares the condition of Kay Street with another street in the
area , say Brandywine , one can easily see vastly different surface
conditions . It is hard to find a street in worse shape than ours
anywhere here in the northeast .
It has been suggested that we petition the Town to skip the
salt-and-dirt routine and just plow away the snow . This would work
anywhere on the street except the area at the foot of Kay Street
where it meets Hanshaw Road . That "Full Stop" area should probably
get the full treatment . As for the rest of the street , though ,
there is less need for salt and dirt . In any cul-de-sac such as
ours traffic is usually light and fairly slow , and in this one the
roadway is quite level .
Since you are among the affected residents , your opinion is
important . If you disagree with the ideas express here , please say
so and/or give us your feelings in the space below . It is hoped
that you will find it convenient to do so by Sunday the 11th of
May , and/or to attend the meeting of the Town Board on Monday , May
12 , 1986 at 5 : 30 P . M . , in the Town Office at 126 East Seneca
Street . "
The petition was signed by 23 residents with an added comment by
one of the residents : " If this road must be "cindered" in the
winter , a real effort should be made to remove same come spring .
For the last several years so much dirt and cinders remain that
clouds of dust are raised every time a car passes down the road . "
Town Highway Superintendent Robert Parkin responded that he felt
the residents should check with the Town Attorney on the legalities
of their request as he felt the residents might need to assume the
liability on the road if an accident occurred and the road had not
been cindered . He went on to say that nine or ten years ago the
road was resurfaced with cold mix and that it was now grinding away
and contributing to the problem . He felt that resurfacing with a
hot mix , scheduled for this summer , should help . He stated that he
would be willing to try keep the amount of cindering down to as low
as possible .
PRESENTATION OF WATER AND SEWER PETITIONS FOR WEST HILL
• Henry Aron , 106 Woolf Lane presented to the Town Board the
following petitions :
"We , the undersigned request the Town of Ithaca to extend the Water
and Sewer service to our properties . This request includes , but is
not limited to the following areas : from 1290 Tr unansburg Road to
the Town of Ithaca Town Line , Woolf Lane , Du Boise Road , Orchard
Hill Development , Indian Creek Road and Happy Lane . "

Mr . Aron stated that the petitions contain 204 signatures . He also
noted the three developments that are proposed for the area : Bruce
Babcock ' s property on Trm ansburg Road , Orchard Hill Development
off DuBois Road and Ciachi & Autio subdivision on Grove Road and
Woolf Lane of twenty proposed lots .
Tim Ciaschi added that only two or three people in the area did not
want to sign and it was not because they did not want the water and
sewer , they were against development of the area .
Supervisor Desch stated that the Board had already authorized the
field work that would need to be done in anticipation of a
favorable response with the petitions .
Henry Aron went on to note that the water table in the area was
very low and that most wells in the area are producing no more than
one-half to one gallon per minute . Also , the private sewer systems
were rapidly breaking down as the soil is clay , therefore , a system
will not average more than fifteen years . There is a tremendous
amount of expenditure to replace a system .
Supervisor Desch stated that he did not think the Board was
interested in extending water and sewer to help development of
commercial land . He then thanked Mr . Aron for appearing before the
Board , noting that he could appreciate the hard work that was
necessary to obtain this amount of signatures .
Town Clerk Jean Swartwood , a resident of the area requesting the
extension of water and sewer , responded that the request for the
extension of water and sewer to the area was in response to the
desperate need for the service by the residents and not in response
to any request for the extension of the services by Bruce Babcock .
Mrs . Swartwood noted that because of the amount of land and the
possible development , then and only then , had Mr . Babcock had been
asked if he were interested in signing the petition .
Supervisor Desch stated that the residents would be hearing from
the Board in the fall .
REPORT OF COUNTY BOARD OF REPRESENTATIVES
County Board of Representative Beverly Livesay reported that the
County is in the process of creating a purchasing department and
that perhaps the various Towns in the County might be interested in
purchasing their supplies through this department . She went on to
state that for instance , highway departments would be able to save
money through the large purchasing of supplies .
DEVELOPMENT OF DRAINAGE MASTER PLAN
Supervisor Desch stated that he had proposed the possibility of
hiring a consultant to complete a integrated overall Drainage
Master Plan which is critically needed . He went on to say that
• Town Engineer Larry Fabbroni is confident that he will be able to
find summer help who can handle the project and that the work can
be completed in-house by February of 1987 .
The Supervisor presented the following memo from the Town Engineer :
"As discussed with Noel , over the years we have developed extensive
background data for a Drainage Master Plan . With the manpower
assembled through Cornell Tradition and staff expertise , together
with Board reviews , a completion date of February 1987 is quite
achievable by staff if this project is allowed to be done in-house .

SPECIFICATIONS FOR THE DEMOLITION OF KNIGHT ' S SLAUGHTERHOUSE
Interim Town Planner Susan Beeners stated that there are two
alternatives to accomplish the demolition , complete demolition of
the structures and the floors or retaining a portion of the floor ,
which might see some future use .
Councilwoman Raffensperger asked if the Town would advertise for
each of the alternatives ?
Supervisor Desch responded , yes .
Councilman Cramer asked if the structure was made of cinder block ?
Ms . Beeners responded , cinder block with some wood in the original
structure .
Interim Planner Susan Beeners questioned if the Board would be
comfortable in allowing the staff to modify the extent of flooring
to be retained? She went on to say that the wood frame building
has some sections of flooring that should be saved ( the cellarways
will need to be s6aled off) .
Councilwoman Raffensperger asked how many additional feet of
flooring are you talking about?
• Ms . Beeners responded , 7 , 500 feet .
Town Attorney Barney reminded the Board that their role was to put
this property in a safe condition .
Supervisor Desch remarked that he wouldn ' t want to have to go in
later and remove the flooring .

WHEREAS , Bernard C . Stuhr , owner of Town of Ithaca Tax Parcel No .
6-31-2-5 , has failed to seal off , post , and prohibit access to the
dangerous and unsafe buildings at the former Knight ' s
Slaughterhouse , and
WHEREAS , Mr . Stuhr was served Notice under the Ordinance Regulating
Unsafe Buildings and Collapsed Structures of the Town of Ithaca ,
with no removal or repair of the buildings or structures in
question having been begun within the required sixty days of
Notice , and
WHEREAS , the Town Board of the Town of Ithaca authorized a survey
of the premises and accepted a survey report which determined the
said buildings and structures to be in an unsafe and dangerous
condition , and
WHEREAS , said Town Board , by resolution dated August 12 , 1985 ,
authorized the Town Building Inspector to post a signed copy of the
aforementioned survey report , and authorized the Town Attorney to
take appropriate legal action to demolish said buildings and
structures ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby approves and does approve the Scope of Work as
described below for the demolition and removal of the unsafe
buildings and structures and other waste materials and rubbish at

2 . Work shall include the demolition of all structures with the
following alternative work items related to flooring :
a ) ALTERNATIVE A - Demolition of all flooring , and the
filling of all cellarways and holes with a suitable
grandular material to be specified by the Town
Engineer .
b) ALTERNATIVE B - Demolition of all flooring , and the
filling of all cellarways and holes , except with the
retention of up to approximately 17 , 500 square feet
of concrete slab flooring and with the sealing shut
of any cellarways or holes which may be within the
specified floor retention area with reinforced
concrete slab , keyed into the existing flooring .
• 3 . All work shall include the removal from the site of all
demolished structural and architectural materials , abandoned
cars , and other rubbish and waste materials . None of these
materials may be buried on the site , except that granular
flooring may be spread and compacted in an area excavated as a
result of demolition to a finished depth of no less than one
foot and covered with soil to restore ground level .
4 . All work shall include restoration of the ground level of the
site by filling all excavated areas with soil/granular

Town Board members , in their packet of materials , received the
following memo from Susan Beeners addressed to "Potential Involved
Agencies , Proposed Five Mile Drive Area Rezoning " :
• The Town of Ithaca is proposing to rezone lands in the vicinity of
Five Mile Drive . The proposed rezoning is a Type I action under
Town of Ithaca Local Law No . 3 - 1980 . Pursuant to this Law, it is
recommended that the Town of Ithaca Town Board be the Lead Agency .
It is requested that potentially involved agencies , as listed below
comment on the above Lead Agency designation before the May 20th
Town Planning Board meeting . A preliminary draft generic
environmental impact statement , as prepared by planning and
engineering staff , and under review by the Town Planning Board , is
enclosed .

With the aid of maps , Interim Town Planner Susan Beeners showed the
Town Board the proposed areas to be rezoned . Proposed is the
expansion of the existing Multiple Residence District to include
one adjacent property which contains a multiunit dwelling . On the
east side of Five Mile Drive north of Coy Glen Creek , all property
which can be served by existing public utilities shall be zoned
• Residential R15 . All properties on the west side of Five Mile
Drive north of the Coy Glen intersection , currently zoned
Residential R15 and served by public utilities , shall be unchanged .
All remaining property with the exception of the Multiple Residence
District , as expanded , shall be rezoned Residential R30 . Ms .
Beeners went on to say that there are some potential non-conforming
uses if rezoned . She noted that if public utiltities become
available , additional areas could be considered for rezoning to
R- 15 .

Supervisor Desch noted that the railroad siding was the reason the
area was zoned Light Industrial . Also , acreage in the flood plain
can be developed but it ' s very costly .
Susan Beeners noted that the loss of the Industrial Use Zone will
be mitigated by land which could be developed into Industrial Use
Zones in other parts of the Town .
Councilwoman Leary questioned , "did you say the proposed rezoning
would be in the Flood Plain , is that good" 7
Ms . Beeners responded , any development of Flood Plain land is
costly . Most of this land is not very accessible to public roads ,
• therefore , the best use of the land is to remain as open space .
Supervisor Desch noted that large acreage was taken up by the
cemetery , the Bernard Stuhr property and Coy Glen .
Councilman Cramer asked if there were any developers who were
pushing to have this area rezoned . He noted that he could see a
potential spillover from the City ' s Cherry Street development .
Supervisor Desch responded that the great interest is from the
owners of developed residential properties .
Councilwaman Raffensperger questioned , some areas zoned Multiple
Residence will be increased slightly to refect their current use ?
Susan Beeners responded yes , Fidler Lane plus the area across the
street should be brought into consistent zone designation .
Supervisor Desch noted that the rezoning of the Five Mile Drive
area would be coming before the Planning Board on May 20th . He
noted that the Town Board would have two things to consider at the
their public hearing , the environmental review and the rezoning .

Michael Stamm , Executive Director and Kenneth Walker , Board member
of the Taapkins County Area Development , Inc . , stated they were in
the process of visiting Town Boards in the County to let them know
what the Tompkins County Area Development was doing . Mr . Stamm
went on to say that in the past they had spent their time on
tracking a major industry , trying to get them to locate in the

area Recently , they have been spending their time on retaining
present businesses and creating new small businesses . We are also
sending Board members out to find out what problems businesses are
encountering . Mr . Stamm continued , noting that the agency is a
clearing house for federal and state funding programs and will help
individuals obtain state and federal funding .
Mr . Stamm noted that the agency was in the process of putting on
the computer , all available land and businesses . He asked Board
members to let them know of any available land or businesses .
Supervisor Desch responded that their agency could have a great
input in helping pin point land that should be zoned industrial .
Supervisor Desch suggested they work closely with Susan Beeners .
He then thanked both Mr . Stamm and Mr . Walker for coming to the
meeting .

Supervisor Desch stated that this item relates to what he made
reference to earlier , the restriction of truck traffic on all
streets in the Town of Ithaca .
Councilwoman Raffensperger noted that she understood Ivar Jonson
was to build a road thru to the Slaterville Road . She went on to
say that she was getting calls as early as 6 : 00 A . M . , to 8 : 20 P . M . ,
from residents of the area because of deliveries to the
construction site .
Town Building Inspector Lewis Cartee noted that Mr . Jonson would be
installing the sewer line within the next sixty days at which time ,
all utilities would be in . He went on to say that he did not get
the feeling that Mr . Jonson intended to extend the road to Route
79 .
Councilwoman Raffensperger , referred the the Planning Board minutes
of March 4 , 1986 , regarding the Restrictive Covenants , "No building
permits shall be issued until the design for the entrance of the
project on State Route 79 has been approved by the Regional
Engineer of the New York State Department of Transportation " .
Also , she understood that a freestanding wood-burning stove had
been installed . Again , referring to the Restrictive Covenants ,
noted that "All attached dwelling units will provide in the deeds
that wood-burning , coal-burning , or freestanding stoves are
prohibited" .
Supervisor Desch stated that Tompkins County Highway trucks were
using Honness Lane to reach their highway project , along with
construction traffic , there is not doubt traffic has increased
drastically on Honness Lane . The Supervisor noted that as for the
issuance of building permits for the Jonson subdivision , conditions
did not prohibit the issuance of one building permit , however , the
issuance of the others is questionable .
County Representative Beverly Livesay stated that she would check
into the reason the County Highway Department was using Honness
• Lane .
Councilwoman Raffensperger noted that when she visited the area ,
the truck traffic was construction traffic .
Councilman Cramer stated that he was called to Honness Lane at 3 : 00
A .M . , and found twenty cargo vans moving very slowly , loaded with
coal for Cornell University . He went on to say that apparently the
coal trucks alternate their routes , using Town , County and City
routes to reach Cornell .

RESOLVED , that the Town Board of the Town of Ithaca , acting on the
recommendation of the Personnel Committee , hereby appoints Susan
Beeners as Town Planner for the Town of Ithaca at a salary of
$ 21 , 000 per year , effective this date .

LAND ACQUISITION
RESOLUTION N0 .
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
WHEREAS , an appraisal of lands needed to construct the Hospital
Access Road has been conducted by Edward Austin and found to be
complete and acceptable to the Town ,
NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of
Ithaca , that the Town Supervisor is hereby authorized to offer to
purchase from Gladys Hall , the lands required , and
• FURTHER RESOLVED , that if the offer is rejected , a detailed
appraisal appropriate to an eminent domain action be prepared and
the Town Attoney proceed to commence such action in accordance with
all applicable laws governing such a public taking .

NEIDERKORN PROPOSAL
Town Board 18 May 12 , 1986
Supervisor Desch stated that the proposal is a joint Town , County
and City effort to get the facts on a number of Route 96 issues
that are not likely to be included in the NYSDOT report . He went
on to say that he had volunteered the Town ' s picking up half of the
cost , however , there is a possibility the County may participate
financially also . He expects Mr . Liguori to set up a meeting to
review this proposal .
