SPECIAL BOARD MEETING
December 31 , 1985
At a Special Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 126 East
Seneca Street , Ithaca , New York , at 10 : 00 A .M . , on the 31st day of
December 1985 , there were :

The Supervisor led the assemblage in the Pledge of Allegiance .
REPORT OF TOWN OFFICIALS
Deputy Supervisor
Supervisor Desch appointed Councilman McPeak as Deputy Supervisor
for the Town of Ithaca .
Supervisor Desch stated that Town Engineer Lawrence Fabbroni would
not be here today because of illness in the family .
• APPROVE YEAR END RECORDS
• Building Inspector
Building Inspector Lewis Cartee stated that his year end report
would not be presented today as the report had not been typed ,
however , he would give a verbal report . He went on to say that in
the Town of Ithaca , 204 Building Permits had been issued . Total
construction cost of twenty million dollars . This figure is up
from last year due to increased construction at Ithaca College ,
Cornell University , Walter Wiggins project and new home
construction .
Town Board 2 December 31 , 1985
Building Inspector Cartee also reported that the Town of Ulysses
had issued 48 Building Permits for fourteen new homes at a
construction cost of one million plus dollars . The Village of
Trumansburg , since May 12th , had issued 18 Building Permits for
four new homes at a construction cost of five hundred thousand
dollars .
Councilman Cramer questioned , of the fourteen permits issued in the
Town of Ulysses , were any for new hcros in Jacksonville?
Building Inspector Cartee responded , yes .
Councilman Cramer asked if there were any restrictions because of
• the water supply?
Building Inspector Cartee responded no . One home had to drill two
wells .

RESOLUTION NO . 261
Motion by Councilman Cramer ; seconded by Councilman McPeak ,
RESOLVED , that the Town Board of the Town of Ithaca having received
the accounts and records of Town Clerk Jean Swartwood for the year
1985 , hereby approves the same , a copy of said accounts and records
being made a part of the Town records .

and records being made a part of the Town records .

TOWN JUSTICE
Town Board 3 December 31 , 1985
COUNTY REPRESENTATIVES
County Representative Mary Call stated that the Department of
Social Services was required to hold public hearings and obtain
public input , therefore , they had prepared a slide show to be shown
to Town Boards . She went on to say that she hoped the Town of
Ithaca would be interested in having the Director , Mary Pat Dolan
present the slide show at either the January or February meeting .
The Supervisor directed the Town Clerk to contact the Director and
invite her to present the slide show at the January meeting .
Representative Call noted that the three County Representatives
• would be alternating their attendance at the Town Board meetings .

Motion by Supervisor Desch ; seconded by Councilman Cramer ,
RESOLVED , by the Town Board of the Town of Ithaca that the bonds
for the following Town Officials and Town employees , in the

BAN SALE
Supervisor Desch noted that he had meant to report , at the start of
the meeting , results of the bid opening on bond anticipation notes
in New York City . He went on to say that on the day the bids were
opened , there was a great deal of discussion about tax reforms and
the banks got skiddish . The City and Town rate is 5 . 340 . Both the
City and the Town received six bids . The Tanpkins County Trust
• Company took a million dollars worth of City and Town BAN ' s at
5 . 23 % . Five million in Town BAN ' s were sold to Manufacturers
Hanover at 5 . 34% .

RESOLVED , by the Town Board of the Town of Ithaca that the Tompkins
County Trust Company and Norstar Bank be and the same hereby are
designated as depositories for all monies coming into the hands of
Town Board 4 December 31 , 1985

HIGHWAY PAY SCALE
RESOLUTION NO , 268
Motion by Councilman Cramer ; seconded by Councilwoman
• Raffensperger ,
WHEREAS , the Highway Superintendent and the Town Engineer have
• reviewed supervisory responsibilities , and employee performance ,
among other measures of accomplishment of the Highway Department ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby establishes the range of regular hourly pay rates for
the Town of Ithaca Highway Department ranging from a minimum of
$ 6 . 00 per hour to a maximum of $ 10 . 50 per hour for the year 1986 .

APPRECIATION FOR COUNCILMAN KUGLER
RESOLUTION N0 . 269
Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger ,
In recognition of over six year of distinguished service and
unselfish contribution to the welfare of the Town of Ithaca . . . .
WHEREAS , in November of 1979 , George was elected by the people of
the Town of Ithaca to the first of two consecutive terms as a
member of the Town Board , after having been appointed to fill the
• vacancy on June 25 , 1979 , and
WHEREAS , during his career of public service with the Town , Mr .
Kugler pursued municipal affairs diligently and with a special
• interest and concern for our community ' s zoning enforcement and
water and sewer services . As Chairman of the Operating Committee
of the Southern Cayuga Lake Intermunicipal Water Commission , George
was instrumental in many improvements in the Commission system , and
WHEREAS , Mr . Kugler as Deputy Supervisor provided extensive
assistance to the Supervisor during his absence ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca , on behalf of the people of the Town of Ithaca , express our
appreciation for the dedication , wisdom and statesmanship which
George Kugler has provided us .

• RESOLUTION NO , 271
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
WHEREAS , the Town of Ithaca Planning Board recommends the
reappointment of Mcntgomery May as Chairman of the Planning Board ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby approves the reappointment of Montgomery May as
Chairman of the Town of Ithaca Planning Board for the year 1986 .

PLANNING SEMINAR
RESOLUTION NO . 272
Motion by Supervisor Desch ; seconded by Councilwoman Howell ,
WHEREAS , the New York Land Institute has planned two Spring 1986
Conferences , and
• WHEREAS , Peter Lovi , Town Planner has expressed an interest in
attending these conferences ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
• Ithaca hereby authorize Peter Lovi to attend the Planning , Zoning
and Land Development Seminar on Friday , January 10 , 1986 , in White
Plains , New York , registration fee of $ 60 . 00 ,
AND FURTHER BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby further authorize the Town Planner to attend the
State Environmental Quality Review Act Seminar on Friday , January
24 , 1986 , at Albany , New York , registration fee of $ 75 . 00 .

CORNELL TRADITION PROGRAM
RESOLUTION NO , 273
Motion by Supervisor Desch , seconded by Councilwoman Raffensperger ,
WHEREAS , the Town Board approved the hiring of Laura Bittar as a
Technical Aide in Engineering for the Summer of 1985 under The
Cornell Tradition Program , by Resolution , on May 13 , 1985 , and
WHEREAS , Laura Bittar proved to be a valuable asset to the
Engineering Department of the Town of Ithaca and is available for
work during the month of January 1986 ,
NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of
Ithaca to hire Laura Bittar as a Technical Aide in Engineering for
the month of January 1986 , commencing January 6 , 1986 , at $ 5 . 50 per
hour , under Account No . CF5112 . 2 .

• SATELLITE DISHES
• Supervisor Desch stated that he would like to propose that the
Board consider the adoption of the local law on Satellite Dishes ,
the discussion at the December meeting to serve as the basis for
adoption at the January meeting . He went on to say that there were
some administrative problems which he felt could be solved . The
Supervisor noted concerns expressed by the people on West Hill
about not being able to place the satellite dishes in their front
yard .

' Councilwoman Raffensperger stated that she did not feel that
satellite dishes should be allowed within fifteen feet of a side
yard lot line .
Supervisor Desch stated that in order to have a satellite dish
work , as a practical matter , you would not want to place it in a
side yard because of the potential for obstructions being placed in
the neighbors side yard . He went on to say there is always the
possibility of the neighbors planting trees to visually obstruct
the satellite and this would effect the satellite operation . The
Supervisor went on to say that with accessory buildings you don ' t
care if somebody plants bushes but with satellites , bushes would
end their use . However , front yards are a different thing .
• Councilwoman Raffensperger stated that she had the same concern
with back yards as side yards when back yards are abutting .
Councilwoman Raffensperger went on to say that people have the
• option of going to the Zoning Board of Appeals for a variance .
Councilman Cramer agreed , saying that with the permit process in
place , individual situations can be handled on an individual basis .

REVIEW OF ENVIROIN]ENTAL ASSESSMENT FORM ON THE REZONING OF 7 . 1
ACRES AT 92149 925-35 MFI=L STREET , TAX PARCEL NOS , 60-1 -3 AND
60 -1-4 , OWNED BY WILLIAM S . DOWNING , FROM RESIDENTIAL DISTRICT R-30

The Town Board reviewed the Environmental Assessment Form.
Supervisor Desch questioned item # 11 in the Environmental
Assessment Form, noting that the number of proposed dwelling units
in the first phase was listed as 18 units and the second phase as
20 units . He questioned if the second phase should not be 2
instead of 20 ?
• Both Town Attorney John Barney and Planning Board Chairman
Montgomery May responded that the figure in the second phase should
be 2 with a total of 20 units .
• Councilwoman Raffensperger remarked that the Planning Board had
recommended the area be rezoned to R-15 , she noted that she had not
seen any minutes or any other information pertaining to the
Planning Boards decision .
Planning Board Chairman Montgomery May responded that the R-15
zoning decision was unanimous .
The question was asked if the drainage would include Homestead
Circle?
Montgomery May responded that the drainage did not include
Homestead Circle .
Councilwoman Raffensperger asked what about the water from the
other side of Pine Tree Road and Mitchell Street that goes through
the Cornell University property ?
Supervisor Desch responded that the culvert picks up about one-half
of the water from the Ellis Hollow Elderly Housing , some of East
Hill Plaza parking lot then down the south side of Mitchell Street .
He went on to say that the storm water on the south side of Ellis
Hollow Road used to cross to the North side , meandering through
Ellis Hollow Housing then cut back across at the intersection .
The County cut a ditch , now the water comes straight instead of
meandering .
Councilwoman Howell asked if some of the water from Snyder Hill was
picked up at this point?
Supervisor Desch responded no . Water comes down Snyder Hill Road
to Pine Tree Road then cuts across under Pine Tree Road to a deep
Swale . He went on to say that this was a natural cut off even if
it looks like it runs to the intersection .

from Residence R-30 to Residence R-15 having been presented by the
Town Clerk , the Supervisor opened the public hearing .
Supervisor Desch stated that the Planning Board considered the
rezoning and recommended that the area be rezoned to R-15 . The
Supervisor went on to say that the Planning Board will review the
Town Board 9 December 31 , 1985
site plan if the Town Board approves the rezoning . He noted that
in most cases , the rezoning has been automatic were water and sewer
are available . He noted a recent example being forty parcels on
South Hill which have been served with water and sewer for many
years but were never rezoned until recently .
William Downing stated that rezoning to Residence R-9 would allow
him to build thirty units . This proposal , to rezone to R- 15 , will
allow only twenty units . He went on to say that he was still
working with the Planning Board to develop the plans for twenty
units .
Mrs . Genia Albrecht , 119 Clover Lane stated that she was the
• closest house next to the rezoning . The area is a charming place
for bike paths and bird watchers , etc . The development will spoil
the area for many people who like to walk around the area . She
went on to say that she regrets that this has to happen , just can ' t
• stop people from building . Who is going to come in and who is
going to have money , who is going to exploit the area ? Mrs .
Albrecht stated that she was against this project and that she
spoke for the residents of Clover Lane : She again asked who is
going to come and live there? What are the size of the buildings?
Is the area going to be exploited with little buildings ?
Supervisor Desch responded that Mrs . Albrecht should attend the
Planning Board meeting and ask these questions .
William Downing responded that it is yet to be decided how many
units will be built on each side . Mr . Downing went on to say that
if the people on Clover Lane were so concerned about preserving the
area they should have bought the property when it was for sale .
Mrs . Albrecht remarked that she did not feel Mr . Downings statement
was very nice .
Mr . Downing went on to say that each unit will contain 1 , 700 square
feet and will sell for $ 100 , 000 . He noted that the units are
permanent units , not for students and not for rental . The idea is
to make a handsome community .
Mrs . Albrecht responded that Cornell University has so many wealthy
students that they would be financially able to purchase these
units .
Mr . Downing responded that he intended to have strict regulations
against renting. Noting concern of the neighborhood , he stated
that because of the railroad track , there would be a great buffer
for the people on Clover Lane ,
Mrs . Albrecht went on to say that her house was the redwood house
and that she could hear noises from the railroad bed . Mrs .
Albrecht stated that the railroad bed is used in the evening by
• people drinking , etc . , and several times they have had to ask
Cornell to monitor the activities . Mrs . Albrecht noted that people
who can buy houses are not always people who will take care of the
• environment .
As no one else present wished to speak , the Supervisor closed the
public hearing .
RESOLUTION NO . 276
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
Town Board 10 December 31 , 1985
RESOLVED , that the Town Board of the Town of Ithaca hereby
determines a negative declaration of environmental , significance on
the Environmental Assessment Forth review for the rezoning from R-30
to R-15 of 7 . 1 acres of land at 921 , 925-35 Mitchell Street , Tax
Parcel Nos . 60-1-3 and 60-1 -4 owned by William S . Dawning , and
FURTHER BE IT RESOLVED , that the Town of Ithaca Planning Board be
designated as lead agent on the site specific environmental review .
Councilman Cramer questioned Item #2 in the Environmental Review ,
Supervisor Desch stated that the record should show that Item # 11 ,
should show Phase 2 as two units , not twenty units .

Parcel Nos . 60-1-3 and 60-1 -4 , owned by William S . Deming , from
Residential District R-30 to Residence District R- 15 ,
Supervisor Desch called for a roll call vote .

Councilman Cramer stated that he felt the Town Board should thank
the Town staff , the Planning Board staff , the Town Justices and
staff and the Town legal staff for their dedicated services this
