Seneca Street , Ithaca , New York , at 5 : 30 P . M . , on the 12th day of

SURVEY REPORT ON KNIGHT ' S SLAUGHTER HOUSE
Supervisor Desch reported that there was an added item to the
Agenda , that being a report on the condition of Knight ' s Slaughter
House ,

Of the condition of the three structures . He also presented the
following Survey Report which will be . signed by himself and the

SURVEY REPORT
TO
ITHACA TOM BOARD
Town Board 2 August 12 , 1985
We , the undersigned , have visited the site owned by Bernard C .
Stuhr , Town of Ithaca Tax Parcel # 6 -31 -2-5 on June 19 , 1985 to
inspect the existing building formerly "Knight ' s Slaughter House" .
The deteriorated structures are of concrete block construction with
steel girders and wood rafters . Hoofing material seems to have
been of a built-up type . The ground floor is a concrete slab with
partial basement areas . There are some second floor areas of wood
construction .
Approximately 80% of the roof area has collapsed as a result of
deteriorated structural members and apparent fire or fires . Many
of the masonry walls have been destroyed by the elements and/or
® vandalism. The structures are no longer able to be secured , and
are dangerous and unsafe in their present condition .
It is our opinion that these buildings cannot be repaired
satisfactorily , therefore , demolition is reconmended .

Councilman Cramer asked what the time frame would be for
demolition ?
Town Attorney John Barney responded it will take thirty to sixty
days to get a court order .
RESOLUTION N0 , 148
Motion by Supervisor Desch ; seconded by Councilman Bartholf ,
RESOLVED , that the Town Board of the Town of Ithaca hereby accepts
the Survey Report on the Bernard C . Stuhr property , Tax Parcel
N0 . 6 -31-2-5 , formerly "Knight ' s Slaughter House" as presented by J .
Victor Bagnardi , Architect and Lewis D . Cartee , Town of Ithaca
Building Inspector , and
FURTHER BE IT RESOLVED , that the Building Inspector be authorized
and directed to post a signed copy of the Survey Report , such
notice to state the compensation of the surveyors , on the Bernard
C . Stuhr property , Tax Parcel No . 6 -31 -2 -5 , and the Town Attorney
be authorized to take appropriate legal action to demolish said
buildings .

Supervisor ' s Report
1986 Budget
® Supervisor Desch stated that worksheets have been distributed to
the staff and are to be returned by September 3 . He went on to say
that since the Tentative Budget must be presented by October 5 , he
would like to suggest that the Board schedule the presentation for
Monday , September 30 , with the hearings to be scheduled for the
Thursday after Election Day, November 7 .

Town Board 3 August 12 , 1985
The Supervisor went on to say that he had an inquiry as to the
handicapped accessibility of the Town Court Room . It seems that a
physically handicapped person wished to observe Town Court .
Supervisor Desch went on to say that in the past we have indicated
that Town Court would be moved in the event a case involved a
handicapped person . Infact , quite often the Town Board Room is
used for Court functions . This is an item we will need to consider
in our assessment program .
September Newsletter
Supervisor Desch stated that he would be starting to form the Fall
Newsletter , which he suggested be released in October , once the
® Tentative Budget has been presented so that our constituents will
know what programs and costs we have in mind . Board members and
staff should think of pressing items that might be included . For
example , we have a vacancy on the Human Services Coalition now that
Ann Schwarting has left the area .
Another possibility would be an election district map , although he
stated that he was not sure , at that scale , if we could make it
readable enough .
Town Engineer ' s Report
Water Extensions
Town Engineer Lawrence Fabbroni reported that the last month had
been quite full and that he would try to highlight the happenings .
He went on to say that two months ago , the Board approved the
extension of water and sewer on the Slaterville Road and Snyder
Hill Road . The boring machine got stuck halfway under the
Slaterville Road and we had to open cut the road . We ran into
overtime trying to complete the open cutting in one day . The
Highway Department helped out , which minimized the cost .
The Town Engineer went on to say that they ran into problems with
the water extension to Hickory Place . The water main was not where
it was supposed to be . The main was finally located but the trench
involved shelf rock excavation . The contractor asked to be
relieved from being required to dig in the shelf of rock . We were
able to get Mancini & Sons with their hydraulic hammer and with
ours and Bolton Points backhoes on the job , we were able to get the
area open . It should be ready for hook up this week . The Engineer
went on to say that for some reason , the lines were never extended
across the road and that now he was really running into problems .
Heating and Cooling System for Town Hall Rear
Mr . Fabbroni stated that the heaters upstairs in Engineering had
cone to the end of their life . He stated that he would be
developing a budget and design for replacement of the upstairs and
downstairs ( Board Room ) heaters .
® Town Supervisor Desch asked if replacement project would be ready
to put into the 1986 budget?
Town Engineer Fabbroni responded that there should be enough
revenue sharing money left over for replacement of the heaters this
fall .
Hospital Project
Town Engineer Fabbroni reported that the hospital architects are
having some problems with the roadway as it interacts with the
Town Board 4 August 12 , 1985
power station . Talks with the landowner ended negatively . We may
need to consider emuni.nent domain .
Town Supervisor Desch asked how many feet from the house will the
road be ?
Town Engineer Fabbroni responded , the road will be seven to eight
hundred feet from the house . The land is currently being farmed .
Supervisor Desch questioned who should pursue the condemnation
proceedings ?
Town Engineer Fabbroni responded , the Town as this will be a Town
® road .
Supervisor Desch asked if this problem would hold up the first
phase?
The Town Engineer responded yes , but there are things the hospital
can do temporarily .
Park Lane Extension
The design on the Park Lane Extension has been completed . We will
now go back to Frandsen and Quicks for their acceptance of the
details . Also , we will need NYSEG ' s approval to move a gas line .
Wastewater Treatment Plant
Town Engineer Fabbroni went on to report that a lot of things were
happening at the sewage treatment plant project . The laying of the
pipe under the railroad tracks have been completed and the open
cutting of Route 13 is almost canplete . We have had a lot of
discussions with the contractor on the bricks , proper fitting of
tanks cn the concrete bases , etc . The outfall project is virtually
complete .
Paving
Town Engineer Fabbroni went on to say that because of questions on
curbing , widening and walks , he proposed the paving of Judd Falls
Road and Blackstone Avenue be delayed until spring . We will be
talking with the people in each area and then will bring back to
the Board the ideas that come out of these meetings .
ATnIIM BID ON GABIONS
Town Engineer Fabbroni reported that one bid had been received
today in the amount of $10 , 719 . 90. for gabions for the rebuilding of
the supporting wall along Forest Home Drive in the area of Flat
Rock and to keep Fall Creek within its banks . The bid came in
under what was felt would be a fair bid .
Supervisor Desch asked how long it would take to get delivery of
® the gabions ?
Town Highway Superintendent Parkin responded , they should be
delivered in a month or less .
RESOLUTION NO . 149
Motion by Councilman Kugler , seconded by Supervisor Desch ,
RESOLVED , that the Town Board of the Town of Ithaca hereby ratify
the advertising for bids of the gabions for the Fall Creek Project
Town Board 5 August 12 , 1985
on the authority of the Town Supervisor , August 12 , 1985 at 3 : 00
P . M . , and
FURTHER BE IT RESOLVED , that the bid be awarded to Chomung Supply
Company of Elmira , New York , in the amount of $ 10 , 719 . 90 .

voting Aye . Nays - none) .
Report of Town Clerk
Town Clerk Jean Swartwood reported that John Feller and his wife
Bernice , who have been the Town ' s voting machine custodians , as
well as the City of Ithaca ' s for several years have resigned . The
City and Town have again agreed to share the services .
Mrs . Swartwood went on to say that as she was sure the Board
already knew that we are required by law to have two custodians ,
one from each of the major parties . The Democratic party chose
Michael J . Moseley , 361 Snyder Hill Road , a carpenter . The
Republican party left it up to Joe Rundle , City Clerk and herself
to find a good person and one they felt they could comfortably work
with . She went on to say that they had agreed on the hiring of
Claude Colleyacme , 312 Esty Street , a retired plumber and City
Plumbing Inspector . Both men , because of their mechanical
abilities in their lines of work , should be well suited for the
job .
The Town Clerk noted that all new custodians are required to attend
a two day training school . She stated that she had made
reservations for them to attend school on August 22nd and 23rd at
Automatic Voting Machine in Jamestown , New York .
The cost of the school is $80 . 00 per person . As they are required ,
by Automatic Voting Machine , to be there the day before , there will
be two nights lodging for each man at the Holiday Irm ( on the
special government rate) of $47 . 00 per night plus meals and
mileage . The Town of Ithaca will be reimbursed by the City of
Ithaca for half of all expenses incurred .
The Town Clerk added a post note , that she wished to inform the
Board that there had been a great increase in marriage licenses
since the law was changed eliminating the blood test .
RESOLUTION N0 , 150
Motion by Councilwoman Raffensperger ; seconded by Councilwoman
Howell ,
W[E9?EA.S , due to the resignation of John and Bernice Feller , voting
machine custodians for the Town of Ithaca and the City of Ithaca ,
it has become necessary to appoint two new persons , and
WHEREAS , it is required that new custodians attend a training
school ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby authorizes Michael J . Moseley and Claude Colleyacme
to attend the training school of Automatic Voting Machine in
Jamestown , New York , August 21 , 22 and 23 , and
Town Board 6 August 12 , 1985
FURTHER BE IT RESOLVED , that the costs incurred in attending said
school namely , the tuition of $ 80 . 00 per person , lodging at $ 47 . 00
per night , per person , meals and mileage be paid by the Town of
Ithaca , the Town of Ithaca to be reimbursed one-half of the total
cost by the City of Ithaca .

REPORT OF COUNTY REPRESENTATIVES
County Representative Mary Call stated that each County
Representative had received a copy of a letter Supervisor Desch
sent to County Chairman Harris Dates , dated July 10 , 19850,
regarding the stop sign at Mitchell Street . She went on to say
that the Planning Committee had met and discussed the stop sign .
She then stated that she was interested in hearing any comments or
observations the Board members might have . Mrs . Call went on to
say that Harris Dates will ask Bill Mobbs to pursue the matter with
Larry Fabbroni .
Supervisor Desch stated that either the stop sign at Mitchell
Street should be removed or a stop sign should be placed on Ellis
Hollow Road , making the intersection a three-way stop .
Councilwoman Howell stated that she had received a lot of
complaints . People going east on Mitchell Street , stop for the
stop sign and expect cars coming west on Ellis Hollow Road to also
stop . Either the stop sign on Mitchell Street must be eliminated
or a stop sign installed on Ellis Hollow Road . She went on to say
that she was surprised there had not been a bad accident before
this .
Councilman Kugler remarked that it did not seem a logical place for
a stogy sign .
Supervisor Desch added that it appears there are a significant
number of violators not stopping for the stop sign .
Mary Call again said that she would pursue the matter with the
County by asking Bill Mobbs to pursue the matter with Larry
Fabbroni ,
Beverly Livesay , County Representative , stated that she had only
one thing to add and that was that the stop sign has helped with
traffic turning out of Judd Falls Road and has also helped people
to get out of Pine Tree Road because they are not so much in
competition with the gas station .
Supervisor Desch remarked that it leaves cars on Judd Falls Road
vulnerable , they see a car stop on Mitchell Street stopping and
decide it is okay to pull out and forget about watching Ellis
Hollow load traffic .
Beverly Livesay remarked that many cars turn onto Judd Falls Road
instead of going down Mitchell Street . A corner that has been so
bad has been helped by the stop sign . She went on to say that a
stop sign on Ellis Hollow Road would help . Also , there should be
lower speed limits for the whole area ..
FINANCIAL REPORT
RESOLUTION NO . 151
Town Board 7 August 12 , 1985
Motion by Councilman Cramer , seconded by Councilman McPeak ,
RESOLVED , that the Town Board of the Town of Ithaca hereby accepts
the Financial Report for the month ending July 31 , 1985 .

voting Aye . Nays - none) .
BUDGET AMENDMENTS
RESOLUTION NO , 152
Motion by Councilman Cramer ; seconded by Councilman McPeak ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorize the transfer of $ 3 , 900 from General Fund Part-Town
Contingency B1990 . 4 to General Fund Part- Town Group Health
Insurance B9060 . 8 to cover the cost of health insurance payment for
the remainder of 1985 , and
FURTHER BE IT RESOLVED , that $2 , 000 be appropriated from the
General Fund Town�Wide Fund Balance and transferred to expenditure

PLANNING BOARD BY-LAWS AND POLICIES
Supervisor Desch stated that he felt a few minor changes should be
made to Article III , Section 3 and Article IX . He asked the Board
if they had any changes ,
Councilwoman Raffensperger referring to Article IV , Section 3
stated that she felt the period of time allowed for the Planning
Board to consider nominations , make their reoommendations and for
Town Board appointment was a very short period .
Town Attorney Barney remarked that he thought the Town Board had
the right to appoint the Chairman . He went on to say that the
Planning Board should appoint an acting Chairman from its own
members who shall serve until the Town Board appoints a Chairman .
Town Attorney Barney , referring to Article II , Section 2 , stated
that he wondered if it was necessary to recite what the Planning
Board does . He went on to say that if the Legislature passed a
bill allowing the Planning Board another duty , our Planning Board
could not perform this new duty because it was not listed . He
again stated that he did not feel there was a need to recite what
the Planning Board does . We leave ourselves open to someone coming
along and claiming that the Planning Board did not have the power
to make a particular decision .
Councilwoman Raffensperger questioning the Town Planner , asked if
there wasn ' t a subcommittee that worked on drawing up the By-Laws ?
Town Planner Lovi responded , yes .
Councilwoman Raffensperger stated that if the Town Board was
proposing to delete whole sections , then she felt the subcommittee
should meet again with the Town Attorney .
Town Board 8 August 12 , 1985
The Town Attorney remarked that he was not sure the Town Board
needed to adopt the By-Laws and Policies .
Town Planner Lovi responded that the Planning Board felt there was
a need for the Town Board to set certain policies .
Councilman Cramer stated that the felt the section on Policies
should be updated .
Town Planner Lovi remarked that when the Policies were put
together , staff recommended that no notices be sent . He went on to
say that in his opinion , it is mischief . Why stop at 200 ' , why not
2501 ? You open a door for someone to say why 200 ' .
Supervisor Desch responded that it might help to add the words " and
to officers of neighborhood organizations " .
Town Plannner Lovi responded that he did not think this was the way
to go and that he still thought that notices should not be sent .
However , if the Town Board wants to set specific guidelines , this
would be helpful .
Supervisor Desch stated that he would rather error on being too
liberal with announcements rather than cutting it to the minimum .
Town Engineer Fabbroni asked the Town Attorney if it was okay for
the Town to go one step further than the law requires ?
Town Attorney Barney responded that the language could be beefed up
by saying that nothing here alters statutory requirements .
Councilwoman Raffensperger concurred that as a courtsey , we should
add notification to neighborhood associations .
Town Planner Lovi raised the possibility of asking neighborhood
associations to register with the Town .
SET DATE FOR PUBLIC HEARING TO CONSIDER REVISION TO ZONING
ORDINANCE CONCERNING MODIFICATION OF RESTRICTIONS ON BUILDING FLOOR
AREA
Town Planner Peter Lovi presented the following Resolution on
Residential Floor Area :
RESOLVED , that the Town Board of the Town of Ithaca amend and
hereby does amend the Zoning Ordinance of the Town of Ithaca as
follows :
10 Article III , Section 4 , Number 2 ; Article IV , Section 11 ,
Numbers 2 ; and Article V, Section 18 , Numbers 2 , are
amended as follows :
2 . Two-Family Dwelling . In addition to a single person
or one family in each dwelling unit , each dwelling
unit may be occupied by no more than one additional
individual .
Town Planner Lovi went on to say that the Zoning Ordinance
restricts the floor area in all three districts . The Zoning Board
of Appeals has consistently granted variances and allowed side by
side duplexes to be built . He also noted that the Residential
Occupancy in the three districts are contradictory . One person may
be a family , the three sections are inconsistant . He went on to

say that the amendments were not an increase in population , only a
change in peoples perspective of a family .
Mr . Lovi then went through the Short Environmental Assessment Form
and the diagrams which represent the maximum lot coverage which is
permitted under the Zoning Ordinance . (Copy attached to the
minutes ) . He noted that under the present Zoning Ordinance , a
person could build a 3 , 000 square foot basement and a first floor
of the same dimention . However , they would not be permitted to
build , under the present Ordinance , a duplex side by side , each
side being 1 , 500 square feet .
Councilwoman Raffensperger questioned a side by side duplex with
each side having 1 , 500 square feet for a basement , 1 , 500 feet on
the first floor , she went on to note that a second floor of 1 , 500
feet could be added to the first floor , you would have an increase
in density .
Peter Lovi responded that is right . We could have a variation in
density .
Supervisor Desch remarked that you would be more likely to have two
4 , 500 units than one - 3 , 000 unit . He went on to say that he
though the Town would see a shift in bulk appearance of the
structures above ground .
Town Engineer Fabbroni stated that the Town Planner was trying to
make a valid appeal for something the Zoning Board of Appeals has
been granting variances for .
Councilwoman Raffensperger stated that she was curious as to how
many variances had been granted .

Councilwoman Raffensperger stated that she had difficulty with a
proposal that would approve duplexes being built in every district
in the Town .
Town Planner Lovi questioned , when the Town Board makes a law , and
another Board ( ZBA ) disagrees with the Town Board decision and
grants a variance , can ' t the Town Board do something about it ?
® Town Engineer Fabbroni added , every request they have had for a
variance , for a duplex , the Zoning Board of Appeals has granted .
Supervisor Desch suggested that perhaps the Zoning Ordinance should
be amended to clarify the sections on duplexes .
Councilwoman Raffensperger stated that duplexes have certain kinds
of impacts that are not found in conventional housing , therefore ,
certain requirements , such as larger lots are required .
Town Planner Lovi remarked that standards were needed .
No action was taken on this agenda item .
PUBLIC HEARING TO CONSIDER THE REZONING OF PROPERTIES ON SOUTH HILL
FROM RESIDENCE DISTRICT R30 TO RESIDENCE DISTRICT R15
Proof of posting and publication notice of a Public Hearing to
consider the rezoning of properties on South Hill from Residence
District R30 to Residence District R15 having been presented by the
Town Clerk , the Supervisor opened the public hearing .
DRAFT RESOLUTION
WAS :
1 . The comprehensive planning policy of the Town of Ithaca has
been to provide for the subdivision of land that is zoned
residential at a density consistent with the availability of

prepare an amendment and deliver it to Mr . Barney . Mr . Barney
reported he had not heard from Mr . Mazza . Therefore , no public
hearing date could be set .

Town Planner Lovi presented the following resolution on Residential

That the Town Board of the Town of Ithaca amend and hereby does
amend the Zoning Ordinance of the Town of Ithaca as follows :
1 . "Family" is defined as " . . . two or more persons related by
blood , marriage , or adoption " .
20 "Unrelated persons " are defined as " two or more persons
unrelated by blood , marriage , or adoption" .
39 Article III , Section 4 , Numbers 2 and 2a ; Article IV , Section
11 , Numbers 2 and 2a ; and Article V , Section 18 , Numbers 2 and
2a , are deleted and the use regulations are amended and
renumbered as follows *
10 One-Family Dwelling . In addition to a single person or
one family , such dwelling may be occupied by not more
than two boarders , roamers , lodgers or other occupants .
29 Two-Family dwelling , provided that the second dwelling
unit shall not exceed 50% of the floor area excluding the
basement of the primary dwelling except where the second
dwelling unit is constructed entirely within the
basement , it may exceed 50 % . In addition to a single
ARk person or one family in each dwelling unit , each dwelling
unit may be occupied by no more than one additional
individual .
4 . Article VI , Section 26 , is amended to read as follows :
Use Regulations . In Multiple Residence Districts no building
shall be erected or extended and no land or building or part
thereof shall be used for other than any of the following
purposes :

Town Attorney John Barney questioned if the Board wanted to allow
four unrelated persons or to stay with the three now permitted in
the Zoning Ordinance .
® Councilwoman Raffensperger suggested that the Zoning Ordinance
contain a statement , as it now currently does in the R-9 District ,
stating that the dwelling may be occupied by more than the
occupants permitted , by special permit of the Board of Appeals .
Supervisor Desch remarked that he felt the consensus of the Board
was to allow three and not four persons .
Councilman Cramer questioned , are there tremendous economic
pressures to push us to four ? He went on to say that he did not
see it .
Town Engineer Fabbroni remarked that a boni fide family could be
one person .
Town Planner Lovi stated that the amendment would allow four
unrelated persons . It would allow two unmarried people in one unit
and two unmarried people in the other unit .
Councilwoman Raffensperger reminded the Board that the Town ' s
definition of a family had problems in court .
Town Attorney Barney responded that the way the Zoning Ordinance
was written , seven people were allowed . He went on to say that a
good example was the court case involving- Rocco Lucente ,
Councilman Cramer stated that he would like some statistical
information regarding cases that have been before the Zoning Board
of Appeals . He went on to say that he could not make a
determination , without statistical information, as to whether three
or four persons should be allowed .

the 1985 - Upstate Fall Historians Meeting in Watertown , New York ,

REZONING OF PROPERTIES ON SOUTH HILL FROM RESIDENCE DISTRICT R30 TO
AOL RESIDENCE DISTRICT R15
As several persons interested in the rezoning appeared at the Board
Meeting after the scheduled time for the public hearing, Supervisor
Desch informed them that the Town Board had already held the
hearing and had decided to adjourn the hearing until September ,
however , if anyone present wished to speak the Board would be happy
to hear them , at this time .
He then went on to inform those present , that the rezoning was
proposed because public water and sewer had been extended to this
area and , therefore , there was no longer a need for larger sized
lot to accomodate septic tanks and wells . He went on to note that
in the R30 District a lot with 200 ' frontage which allowed one
house , if rezoned to R15 , could now be divided into two lots of
100 ' each and another house could be built .
Rose Gostanian , Danby Road stated that the people in the Town
should all be informed of the zoning change . People should know
the effect the rezoning will have on their school taxes , police and
fire protection . If you add another house , you add another three
children going to school which will increase your school taxes .
She went on to note that even though she did not have property in
the area that was being rezoned , she felt that she should have been
notified .
Supervisor Desch responded that he was not sure that three addition
children would adversely effect the school taxes , as the
assessement of an additional house would help the tax rate .
Mrs . Howard Merson , 123 Rich Road asked why the Town was
redistricting?
Town Planner Peter Lovi responded , that the size of the lots are
related to public utilities . He went on to say that if you do not
have public utilities you need larger lots to handle a well and
septic system . R-30 District require the largest lots and are
normally rezoned to R- 15 when public water and sewer is installed .
This resolution catches up with the rezoning of property where
water and sewer are available .
Mrs . Merson asked if this was also a change in the use of the land?
Town Planner Lovi responded , no .
Herbert Mcnkemeyer , 1059 Danby Road asked if this was a new way of
doing rezoning , by resolution? He went on to say that usually the
Town rezones by local law . He then asked if the Town wasn' t
supposed to have a map of the area ? He went on to say that people
don ' t know where or what land is being rezoned . He then asked
about the. location of Ithaca College land .

Article VIII , Section 44 , are amended to include the phrase
" from the street right-of-way line " , in order to clarify the
required front yard dimension .
2 . That an appropriate diagram be included in the definitions
which illustrates all required yard terminology .

repaginated , where necessary , in order to facilitate convenient use
by the public .

For groups over 100 persons , a security deposit is required which
shall be equal to , or in addition to, the fee amount .

(b) Groups over 100 persons - special event coverage as in
( a) plus $ 1 , 000 . 00 excess liability .
4 . Other Requirements
In case of events which are of more than two hours duration , the
permit applicant shall furnish at his own cost and expense portable
toilet facilities sufficient for the size of the user group , where
toilet facilities are not already available .
SECTION IV
Permit Issuance
( 6 ) Coddington Road Playfield
Arrangements for use of the Coddington Road Playfield are to be
made through the Coddington Road Community Center . Town permit
applications for use of this playfield shall be obtained from the
Center , and the Center shall indicate by signature of its
designated agent on the permit application if such use is an
activity of the Center . Use of the playfield which is sponsored by
the Center shall be exempt from the fee and security deposit
requirements described in Section V .
Ms . Beeners went on to say that at the time of the adoption of
Local Law No . 1 , - 1982 , a fee schedule was not adopted . She noted
that Tawas Parks do not have facilities for large groups and this is

why the fee schedule is so high , to encourage small neighborhood
groups . Ms . Beeners went on to say that Section 4 , item number 6
was added for the benefit of the Coddington Road Community Center .
People who wish to use the playfields will apply to the Center for
permission . The Center will have their own permits and may have
their own fee schedule to include toilet facilities and barbeque
facilities .
Supervisor Desch responded that he felt the signature of the
designated agent for the Center should be in the form of a
certification . The Town needs to know if the activity planned is a
Center activity .
Councilman Cramer questioned Section 5 , subsection 4 , does this
® relate only to Town of Ithaca parks ?
Supervisor Desch responded , Local Law No . 1 - 1982 , relates to Town
of Ithaca parks only .
Councilman Cramer questioned Section 5 , subsection number 1 (Fee
Schedule ) . He stated that he felt the number 31 should be
increased to 40 , ( 40 -75 ) noting that baseball teams , with parents ,
total more than 31 .
Councilwoman Raffensperger responded that forty persons in a
neighborhood park would be a lot of people .

Motion by Councilman Cramer ; seconded by Councilman Kugler ,
RESOLVED , that the Town Board of the Town of Ithaca will meet and
conduct a public hearing at the Town Hall , 126 East Seneca Street ,
Ithaca , New York , at 8 : 00 P . M . , on September 9 , 1985 , to consider
mending Local Law No . 1 - 1982 , to include a fee schedule ,
security deposit and other requirements .

WATER FISSION RULES AND REGULATION REVISIONS
Supervisor Desch asked the Board members if they had any specific
problems with the proposed changes . He went on to say that the
only change he wished to make was the change that he proposed to
the Commission at its meeting today . That being on page 69A
( addition underlined ) . SCLIWC ' s responsibility for its water
system end at and include the municipal take-off point from the
transmission main . The municipal take-off point is defined as the
first outlet valve off the transmission main subject to Burdick
Hill Road tank pressure .

RESOLVED , that the Town Board of the Town of Ithaca hereby approves

PLANNING REPORT : Slaterville Road Highway Plan

Project Description : The area reviewed in this ' report is -the
south side of Slaterville Road , from the City of Ithaca Uile to
the property line of Commonland Community ( see map attached ) T
This area is developed with 13 houses fronting on Slaterville
Road and one house sited on a rear lot . The area is Toned R15
for a distance of 500 feet from the road , the remaining lazed to
the City of Ithaca watershed boundary being zoned R30 . Tile area
is served with public water and Sewer .
Problem Stat ':nent : As the attached diagram 1 1. l. ustrates , the
frontage lot _ ( shaded parcels ) comprise a small portion of the
total develc �� ble land in this area . There are approximately 45
acres of open , undeveloped land from the Commonland property to
the City of Ithaca line . More than 31 acres of this total are
owned by three landowners .

The planning conce.i_- rt is that if additional frontage construction
is permitted alortcj Slaterville Road wllt.hout concern for the
preservation of acwcess to the remaining lands , a large arnount of
landlocked property will be created.
Analysis : There are three open areas where a road intersection
with Slaterville Road could be located . All th.r. ee of -these
openings are in excess of the 60 foot minimum .required for Town
rights - of -way . The Town Board has , through the Instrument of the
Highway Map , the opportunity to preserve access -to the rear
acreage . The amendment of the Town Highway Map to include one or
more Highway corridors in this areas would prohibit landowners
from constructing new buildings which would compromise the
eventual development of the planning area .
Recommendation : That Town Planning and Engineering staff be
directed to draft amendments to the Highway Map showing one or
more highway corridors in this planning area .
