REGULAR BOARD MEETING
January 7 , 1985
At a Regular Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , held at the Town Offices at 126 East Seneca
Street , Ithaca , New York , at 5 : 30 P .M . , on the 7th day of January ,
1985 , there were :

REPORT OF TOWN OFFICIALS
Supervisor ' s Report
Billboards
Supervisor Desch stated that perhaps the Board had read , as he had ,
the Ithaca Journal article on the judges decision in favor of the
City of Ithaca . He went on to say that as we have discussed , it
now seems appropriate for us to service notice of violation of our
Sign Law , since the grace period for removal has expired .
® Therefore , he stated that he would appoint Councilman Cramer and
Councilman McPeak to serve on a committee with Building Inspector
Lewis Cartee , the Town Attorney and himself to recommend our cource
of action in this matter .
Dog Control
Supervisor Desch went on to say that you will notice we have an
additional item on the agenda , the matter of the Dog Contract . The
new proposal involves a monthly payout so that the cash flow

available to the SPCA is better and the County is not directly
involved . This would give us a better handle on the contract which
will cost more than we collect until the dog enumeration is
completed . He asked the Board members to please read the contract
so that it can be dealt with , as time permits , later on in the
meeting .
UDC
The Supervisor stated that the Town has been asked to assume
responsibility for the building code inspection on the Maple Avenue
Housing Facility , by UDC . This is another example of federal
functions being passed down to local governments . He went on to
® say that we will be assessing what this means in terms of time
commitment .
Highway Superintendent ' s Report
Town Engineer Larry Fabbroni presented Highway Superintendent
Robert Parkin ' s 1984 Annual Report . (Copy attached to the
minutes ) . He noted that trucks 1 , 2 and 3 were the heavy equipment
trucks , therefore , their repairs cost were larger . He also noted ,
for the Boards information , the $ 9 , 108 . 27 equipment cost for 1983 ,
which amounted to a major enginer overall for truck # 3 . He noted
that all three trucks were approaching replacement time and that he
and the Highway Superintendent would be coming before the Board
with a proposal , at a later date .
Town Engineer ' s Report
Town Engineer Lawrence Fabbroni reported that the Board would
receive his written report in a couple of weeks . He went on to say
that his mood was basically one of optimism for 1985 . The water
and sewer extension in Phase I were completed within budget .
$ 100 , 000 for sewer and $ 200 , 000 for water . Phase II contracts are
about to be signed , $ 340 , 000 range plus contingencies . The people
on West Hill who have had problems are now seeing them being
solved , the same is true with portions of Elm Street and West Haven
Road ,
Supervisor Desch asked if the contractor is still talking about a
March 1st start of construction ?
Town Engineer Fabbroni responded , the contractor is talking
whatever the weather permits . They figure it will take 90 days to
complete .
He went on to say that the "Parks " have cleaned up their act and
can now be maintained with the available work force . The South ,
Southwest and West portions of the Comprehensive Plan need to be
completed .
The Town Engineer then showed the construction progress of the
® Burns Road project and the Bundy Road water and sewer extensions on
the VCR machine .
REPORT OF COUNTY BOARD OF REPRESENTATIVES
County Representative Mary Call reported that Gist Freeman , Beverly
Livesay and herself would again share Town responsibilities . She
went on to say that as everyone knows , the old hospital did not
sell in 1984 , hopefully it can be sold in 1985 .

JANITOR POSITION
Supervisor Desch that he had only a foot note to add to the
Resolution , we have seen a great deal of progress on Stanley ' s
part . His training period has been a good investment .
RESOLUTION NO , 1
Motion by Councilwoman Howell , seconded by Councilman McPeak ,
WHEREAS , Stanley Schrier has successfully ccupleted his period of
probation and training as a janitor with the Town since July 1984 ,
with a satisfactory or above average attitude toward employees and
® the public , skills and dedication to work effort , punctuality ,
performance with minimal direction , and respect of authority , and
WHEREAS , Stanley Schrier has served the Town in various temporary
full-time positions for a cululative total of nine months ,
NCW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby hires Stanley Schrier as a permanent janitor at the
hourly rate of $3 . 60 per hour , with full employee benefits , for the
year 1985 .

Supervisor Desch appointed Councilwoman Raffensperger and
Councilman Kugler to meet with the Town Clerk and himself on the
redistricting . The committee will report to the full Board at the
February meeting, if possible .

1985 SPCA CONTRACT
Supervisor Desch noted that the 1985 contract with the SPCA had
been received . The County will no longer be administrator for the
funds , the SPCA will receive their funds directly from the Town .
He went on to say that the SPCA had requested $ 10 , 248 for 1985 , for
their services .
Town Clerk Jean Swartwood noted that in 1984 , she had paid the
County Budget Officer $ 2 , 156 . 20 for dog licenses and $ 3 , 334 . 30 for
the SPCA Contract . Also , $ 1 , 001 . 00 was put aside , separately , for
enumeration . Adding all three amounts together , we would still be
short $ 3 , 756 . 50 of the requested figure ( using 1984 figures ) .
Supervisor Desch went on to say that we have not done an
enumeration in several years , and the SPCA assumes we will pick up
25 % more dogs than presently licensed . He noted that the local
license fee in the County ranges from $ 4 . 00 to $ 1 . 00 in the City .
The Town of Ithaca is currently charging $ 3 . 00 , and he did not
propose this be increased for fear people would then be less
inclined to license their dogs .
® Supervisor Desch suggested that the contract be signed as of
February 1st as this would cut one month ' s payment .
Councilwoman Raffensperger , referring the the Addendum , noted that
she did not recall the Town having routine patrolling in the past .
Supervisor Desch responded , no we did not have routine patrolling
in the past and will so note again this year in the Addendum .
Town Board 5 January 7 , 1985
Town Engineer Fabbroni noted that in the past , when he did the
enumeration the Town only added about 10 % more dogs .
PUBLIC HEARING - LOCAL LAW RELATING TO FLOOD DAMAGE PROTECTION
Proof of posting and publication notice of a Public Hearing to
consider the adoption of a local law relating to Flood Damage
Protection having been presented by the Town Clerk , the Supervisor
opened the public hearing .
Supervisor Desch noted that NYSDEC had sent the Town a model law
which is basically the same as we already had .
® Town Attorney James Buyoucos stated that the Town Clerk had
combined the model law with the law he had written for the Village
of Groton . Codes & Ordinance Committee had sent the proposed law
to him for his review . He went on to say that he had decided the
proposed law received from NYSDEC should be the one the Town should
use . He stated that he planned to insert some provisions , such as
the Building Inspector may issue permits with conditions . The law
must refer to a standards to give the Building Inspector guidance .
Also , if someone get a permit then three months later a stream
changes or regulations change the Building Inspector should be
allowed to give the persons an extension , taking into consideration
on going regulations . He stated that he would have the new model
law with additional provisions ready for review within the next few
days .
RESOLUTION NO . 3
Motion by Supervisor Desch ; seconded by Councilman McPeak ,
RESOLVED , that the Town Board of the Town of Ithaca will meet and
conduct a public hearing at 7 : 00 P . M. , on February 11 , 1985 , at the
Town Hall , 126 East Seneca Street , Ithaca , New York , to consider
the adoption of a local law relating to Flood Damage Protection .

CONTINUED DISCUSSION - SPCA CONTRACT
Supervisor Desch stated that if the Board was in agreement , he
would propose that the contract with the SPCA begin on February 1 ,
1985 , with the ending date for 1985 being December 31 , 1985 . This
will allow us to deduct the January payment .
Town Attorney Buyoucos noted that the SPCA was asking people if
they owned their own home or are are you a tenant . He went on to
say that this was an invasion of privacy .
Supervisor Desch stated that an article should be included in the
April Newsletter regarding the proposed enumeration .

Markets Law , by and between the Tompkins County SOCIETY FOR THE
PREVENTION OF CRUELTY TO ANIMALS , a not - for - profit corporation
created and existing under and by virtue of the laws of the State
of New York , having its office and principal place of business at
1640 Hanshaw Road in the Town of Dryden , County of Tompkins , State
of New York , party of the first part , and the following municipal
corporation of the State of New York :

WITNESSETH :
ARTICLE I . The party of the first part , in consideration
of the payment to it by the party of the second part of certain
monies to . be paid in the manner and at the times hereinafter
. particularly described , hereby covenants and agrees that :
1 . ( a ) The party of the first part , through its duly ap -
pointed agents and employees , within the corporate limits of the
party of the second part , will carry out the duties and responsi -

the State of New York , will enforce the provisions of quarantine
orders enacted pursuant to sections 122 and 123 of the Agriculture
and Markets Law of the State of New York whenever such orders are
in effect in the County ; will , pursuant to Section 115 of the Agri
culture and Markets Law , provide and maintain a shelter or pound
for seized dogs and for lost , strayed , or homeless dogs ; will
humanely destroy or dispose of , pursuant to and as provided for in
Section 118 of the Agriculture and Markets Law , seized dogs not
redeemed as provided in Article VII of said law , and it will
properly care for such animals ' in such shelter , which shall be
at all times during the term hereof be under the care of a compe -
tent employee and shall be open to the public daily , legal holiday
excepted , Monday through Saturday from 12 : 30 p . m . to 5 : 30 p . m . .
( or such other reasonable times as agreed by the parties ) . The
SPCA reserves the right to change the open hours of the shelter ,
. if reasonably necessary .
( c ) The party of the first part will enforce the provisions
of any dog control laws of the party of the second part , including

the issuance of appearance tickets where called for within their
corporate limits (when employees are on duty , pursuant to number
2 of this Article ) by responding to requests for service and pa -
trolling by humane officers at agreed - upon times .
20. Party of the first part shall employ two humane officers
The hours of the humane officers shall be determined by the party
of the first part . Hours of road patrol and response to requests
for service to this contract shall be from ' 8 : 00 a . m , to 5 : 00 p . m . ,
Monday through Friday , and 4 : 00 a . m . to 5 : 00 p . m . Saturday and
Sunday , or the equivalent , in the territory of the party of the
second part for dog control , carrying out the duties 'required-
pursuant to this contract during its entire term . In addition ,
there will be emergency service provided on a 24 - hour basis , seven
days a week (illustrative emergencies are sick , injured , and vi -
cious dogs no present owner ) ,
3 , . Party of the first part shall shall provide such further
services as the party of the second part shall , for a separate and
additional consideration , agree to perform .
ARTICLE II , The parties' agree that the following sums shall
be paid to the party of the first part for performance of the term
of this contract :
The party of the second part shall . pay to the party of the
first part a total of $ 10248 as ' follows : $ 854 per month for the
months of January , 1985 through December , 1985 inclusive . Such .
installments are to be made to the party of the first part no late

than the 10th of the month when due . In the event that the party
of the second part shall fail to make monthly payments pursuant to
this paragraph , the party of the first part may , at its option ,
give notice that unless payment is brought to date within thirty
. ( 30 ) days of such notice , service may be withheld from such
party .
ARTICLE III . This agreement shall commence as of January
1 , 1985 , and shall continue through December 31 , . 19850
ARTICLE IV . The party of the first part shall implement a
system to allow the party of the second part , upon request , to do an
audit of services performed .

Addendum to 1985 dog control contract between
Tompkins County Society for Prevention of Cruelty to Animals and
Town of ITFIACA
The following provisions will apply to the enforcement of the contract
and will bind the Tompkins County Society for Prevention of Cruelty to
Animals , Inc , the party of the first part during the duration of the
contract while. servicing the Town of Ithaca , the party of
the second part .
1 . The party of the first part will respond to all requests for dog-related
services from residents of the party of the second part unless some forms
of service are specifically excluded by the party of the sec&nd part .

2 . The party of the first part will enforce all provisions of the NYs
Agriculture and Markets law , Article 7 , and all provision of the local
dog law of the party of the second part unless some provisions are

PURCHASE OF PAPER SHREDDER
Councilman Bartholf reported on research regarding the purchase of
a paper shredder for Town use .
He reported that his alternate suggestion was to take the waste
paper to the landfill in Spencer , New York , once or twice a year
instead of purchasing a costly paper shredder .
Councilman Bartholf stated that his survey showed that it was
clearly cheaper to transport the material to the landfill then to
purchase a paper shredder .
® The Town Board members agreed that the use of the highway truck to
transport paper materials to the landfill would be cheaper than the
purchase a paper shredder .
PUBLIC HEARING - PROPOSED INCREASE IN EXEMPTIONS FROM REAL PROPERTY
TAX PERMITTED UNDER CHAPTER 525 OF THE NEW YORK LEGISLATURES LAWS
OF 1984
Proof of posting and publication notice of a Public Hearing to
consider a proposed increase in exemptions from Real Property Tax ,
Town Board 7 January 7 , 1985
permitted under Chapter 525 of the New York Legislatures Laws of
1984 , and to consider whether the Town Board should take no action
or to adopt either of two proposed local laws by reducing the
maximum exemption permitted by the Laws of New York State having
been presented by the Town Clerk , the Supervisor opened the public
hearing .
Supervisor Desch asked if anyone wished to address the Board ?
Duane Wilcox , 135 Simsbury Drive , stated that he was convinced that
the Town Board should not give any more than they are now giving .
He went on to say that he was not against government giving tax
breaks to World War I and II veterans , but he did not think the
® remainder of the war time veterans need this kind of exemption . He
noted that his neighbor served in the Korean War , he was not in a
danger zone . He received training and traveled around the world .
Ex-diplomats , Peace Corp and missionary volunteers are in just as
much danger . Defense is a national function , not a local function .
What is needed for the veterans is job training and medical
assistance . There is a time and place to be loose with resources ,
but not in the Town of Ithaca with a proposed 10 to 15 % increase
expected in school taxes . Mr . Wilcox went on to say that it was
outragous that state lawmakers , in an election year , would pass
this type of legislation and put this kind of a burden on local
government . It ' s time to stop this kind of program .
Louis Michael , 116 Compton Road , asked if Mr . Wilcox was a
taxpayer ?
Mr . Wilcox responded that he was a taxpayer in the Town of Ithaca .
Larry Rosenberg , 38 Dove Drive , stated that he agreed 90 % with what
Mr . Wilcox had said . He asked the Board to keep the exertion that
is in effect now , but do not increase it .
Louis Michael stated that he was a veteran but that he did not
believe the Town shout put any more burden on Senior Citizens with
fixed incomes . Also , a lot of people who own property are being
layed off and will be unable to pay their taxes . He suggested that
the Board consider a head tax like the State of Pennsylvania has ,
and do away with County , Town and School taxes .
As no one else wished to speak , the Supervisor closed the public
hearing .
Supervisor Desch noted that the main problem the Town has is that
it forces us to make decisions now on the 1986 budget which will
not come up for discussion until September . Also , as Mr . Michael
suggests , we have no way of knowing about future State and local
problems .

hours ?
® Councilwoman Raffensperger responded that this was not part of the
original proposal .
Supervisor Desch remarked that restrictions could be make later ,
this is the first step .
Councilman McPeak remarked that many times a driving range is part
of a golf course .
Town Planner Peter Lovi responded that currently golf courses were
not permitted in this zone .

Local Law No . 2 - 1985 , was thereupon declared duly adopted .
Supervisor Desch asked the Board if they were satisfied with the
number two in regards to the number of additional persons not
residing on the premises who may be employed there .
As neither the Board members nor any of the public wished to speak
for or against proposed Local Law No . 3 - 1985 , the Supervisor
closed the public hearing .

A LOCAL LAW AMMING ARTICLE IV , SECTION 12 , NUMBER 1 , OF THE TOWN
OF ITHACA ZONING ORDINANCE
Article IV , Section 12 , Nuuber 1 is amended to read as follows :
Office of a resident doctor , dentist, musician , engineer , teacher ,
lawyer , artist , architect or member of other recognized profession
where such office is part of the residence building provided that
no more thatn two ( 2 ) additional persons not residing on the
premises may be employed .
Supervisor Desch called for a roll call vote .

A LOCAL LAW PROVIDING FOR SPECIAL APPROVAL AND SITE PLAN REVIEW OF
SPECIFIED USES IN RESIDENTIAL DISTRICTS ACCORDING TO THE TOWN OF
® ITHACA ZONING ORDINANCE
I . Article III , Section 41 Number 3 ; Article IV , Section 11 ,
Number 3 ; and Article V , Section 18 , Number 3 be revised as
follows :
3 . Churches or other places of worship , convent and parish
house by special approval of the Board of Appeals in
accordance with Section 77 , Number 7 . The application
shall then be referred to the Planning Board and no
building permit shall be issued unless the proposed

structure is in accordance with a site plan approved
pursuant to the provisions of Article IX .
II . Article III , Section 4 , Number 5 ; Article IV , Section 11 ,
Number 5 ; and Article V , Section 18 , Number 5 be revised as
follows :
Publicly awned park or playground including accessory
buildings and improvements by special approval of the Board
of Appeals in accordance with Section 77 , Number 7 . The
application shall then be referred to the Planning Board and
no building permit shall be issued unless the proposed
structure is in accordance with a site plan approved pursuant
® to the provisions of Article IX .
III . Article III , Section 4 , Number 6 ; Article IV , Section 11 ,
Number 6 ; and Article V , Section 18 , Number 6 be revised as
follows :
6 . Fire station or other public building necessary to the
protection of or the servicing of a neighborhood by
special approval of the Board of Appeals pursuant to
Section 77 , Number 7 . The application shall then be
referred to the Planning Board and no building permit
shall be issued unless the proposed structure is in
accordance with a site plan approved pursuant to the
provisions of Article IX .
IV . Article III , Section 4 , Number 7 ; Article IV , Section 11 ,
Number 7 ; and Article V , Section 18 , Number 7 be revised as
follows :
7 . Golf courses , except a driving range , or a miniture golf
course by special approval of the Board of Appeals in
accordance with Section 77 , Number 7 . The application
shall then be referred to the Planning Board and no
building permit shall be issued unless the proposed
structure is in accordance with a site plan approved
pursuant to the provisions of Article IX .
