REGULAR BOARD MEETING
June 11 , 1984
At a Regular Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 126 East
Seneca Street , Ithaca , New York , at 5 : 30 P . M . , on the 11th day of
June , 1984 , there were :

REPORT OF TOWN OFFICIALS
Supervisor ' s Report
Six Mile Creek Lead Agency Status
Supervisor Desch reported that at its meeting on April 6 , the City
Cc mlon Council determined that the City shall be the lead agency on
recommendations 1 and 2 having to do with access and usage of the
area below the 60 ' dam . This is contrary to our recannendations
resulting from our special meeting on May 31 . A compromise of
sorts has been proposed by the City in terms of the Town being lead
agency for any access in the Town . Peter Lovi can give us the
details . We still have the option of objecting to the lead agency
designation .
Sewer Project Status
The Supervisor went on to report that the recent shakiness of the
banking industry has caused us a great deal of mid course
correction in assuring that we have proper security on the
investment portfolio for the $ 12 , 500 , 000 . For proper security , we
ended up with the purchase of Treasury Bills for a portion of the
investment at about 9 . 75 % yield and the remaining amount at 11 . 35 % ,
so that our net profit on interest during the first year will be
about $230 , 000 . All of this , thanks primarily to the work of
Dominic Cafferillo .

Town Board 2 June 11 , 1984
On Friday , June 1 , the City and the SJS certified the awardability
of the low bids subject to DEC approval and the acceptability of
the MBE plan of the contractors . The preconstruction meeting is
tentatively scheduled for June 27 and the groundbreaking at 11 : 00
A .M . , on July 9 .
Water & Sewer Improvement
Supervisor Desch went on to report that we now have approval of our
1984 -85 water and sewer improvements from the State Comptroller .
The Town Engineer is finishing up the easements so that we will
very soon be able to get the 1984 portion out to bid .
Elected Officials Salary Survey
One of the objectives we established this year was to do as
thorough an evaluation , as possible , on our elected officials
salaries . We did a state wide survey and were pleased to have
received about 70 responses . Shirley Raffensperger spearheaded the
effort , including a distribution of the forms at the Association of
Towns Meeting in New York City and a very fine tabulation of the
results .
An analyses of those Towns who responded , with population between
15 , 000 and 20 , 000 shows that we are way on the low side . In the
case of the Supervisor , our salary of $ 8 , 400 works out to be about
$ . 52 /person whereas the average is about $ . 70 /person , which means
that the Supervisor ' s salary should be about $ 14 , 000 . In the case
of the Town Board members , our salary of $ 2 , 100 works out to about
$ . 13 /person and the average in the group is about $ . 22/person or
$ 3 , 500 per year .
He went on to say that he believed the Supervisor ' s salary should
be increased to $10 , 500 and the Town Board to $ 2 , 750 , if the 1985
budget can handle the increase without tax rate problems , which I
believe it can . The number and types of decisions we are called
upon to make such as the sewer plant , SEQR matters with Cornell ,
etc . , in the corporate world would ccnunand a much larger salary .
He proposed that the matter be reported in the July Newsletter and
take the comments which follow into account .
Town Engineer ' s Report
Town Engineer Lawrence Fabbroni presented to the Board a written
report of last months activities . (Copy attached to the minutes ) .
He noted that the highlights were the Burns Road project and the
water and sewer projects . He noted that the reception of the
homeowners , on Bundy Road , in granting easements have been very
good , as the people want the water and sewer . He went on to say
that in his eyes , the next 90 days would be the most exciting days
he will ever see .
® Highway Superintendent ' s Report
A written report , in his absense , by Highway Superintendent Robert
Parkin showed that the Spring Clean-up took 412 days . Road brooning
has been completed . Cross walks and stop bars painted . Installed
150 ' of culvert pipe for residents . It took two men two days to
haul approximately 600 tons of creek gravel from Lower Enfield
State Park . Stone Quarry Road drainage project is 50o cxenpleted .
Started Eastern Heights shoulder repairs . Started roadside mowing .
Four temporary help have been hired .

No County Representatives were present at the meeting .
SET DATE FOR PUBLIC HEARING - SEWER USE LOCAL IAW
RESOLUTION NO . 91
Motion by Supervisor Desch , seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca will meet and
conduct a public hearing at 6 : 30 P . M. , cn July 9 , 1984 , at the Town
® Hall to consider the adoption of a Local Law governing Sewer Use .

voting Aye . Nays - none ) .
FIRE CONTRACT WITH CITY OF ITHACA
Supervisor Desch reported that he , Town Attorney James Buyoucos and
Robert Boothroyd of Boothroyd Agency had met last week to discuss
the fire contract . The proposed revisions are listed below :
Paragraph 6b
Now that we have an addendum to the main agreement we know what the
dollar figure is per Joe Spano ' s letter dated April 3 , 1984 . The
paragraph should read :
1985 - 16 . 71 % of the actual 1983 expenditures by and for the Ithaca
City Fire Department . The Towns share has been calculated at
$ 319 , 889 . Capital expenditure reimbursement for the fire hose
purchased by the City will be under separate agreement .
Paragraph 6d
The Town Board believes a termination notice requirement of 7 days
is unreasonable . We suggest a 90 day notice requirement with
interest payable to the City of any period beyond 30 days .
Paragraph 7
The consideration described in paragraph 6 shall include all
services which the City is required to furnish the Town under this
agreement .
Paragraph 8
The insurance matter is of major importance to both parties in this
contract . We have discussed the matter with our insurance agent
and offer the following wording :
The City shall hold the Town harmless for all claims by third
® parties with regard to personal injury , wrongful death and property
damage arising out of negligence of the City , its officers or
agents for answering such calls in the Town . The City shall
provide adequate insurance coverage to indemnify the City and the
Town , its officers or agents against all claims for injuries to
persons and property including any action for wrongful deaths that
occur during the period of the contract , defined in paragraph 5 .
The Town shall be named as an additional insured in the City policy
and a copy of such policy shall be delivered to the Town . The Town
agrees to pay for any additional premiums which the City shall be
required to pay by addition of the Town as insured . In 1984 , the

.premium for the Town being named insured is $ In 1985 , the
premium , if greater than the 1984 amount , will be negotiated by the
parties . If there is disagreement between the parties as to the
1985 premium , the matter shall be submitted to arbitration by a
panel of three persons , each party to choose one person and the two
persons chosen will select a third person . The decision shall be
binding on both parties . Arbitrators shall be skilled in matters
relating to public liability insurance coverage and the costs of
such coverage . The cost of arbitration shall be shared equally be
the parties .
Paragraph 9
Add at the end of the paragraph :
"Provided that this provision shall not be deemed to abrogate to
modify any provision of this agreement . "
Paragraph 10
Add at the end of the first sentence the words as follows .
"Subject to the provisions of paragraph 8 and further subject to
the understanding that the City shall use accepted standards in the
performance of its firefighting and EMT services provided under
this agreement . The City shall use due care in carrying out its
obligations under this agreement . "
INSPECTION CONTRACT WITH THE TOWN OF LmySSES
Supervisor Desch reported that the contract with the Town of
Ulysses for inspection services by the Building Inspector is not
ready at this time .
SET DATE FOR PUBLIC HEARING - REZONING OF "LA TOURELLE" OWNED By
WALTER J . WIGGINS
RESOLUTION NO , 92
Motion by Supervisor Desch ; seconded by Councilman Kugler ,
RESOLVED , that the Town Board of the Town of Ithaca will meet and
conduct a public hearing on July 9 , 1984 at 6 : 45 P . M . , to consider
amending the Zoning Ordinance to permit "La Tourelle " a bed and
breakfast style hotel in an R-30 District , Tax Parcel No ,
6 -36 -1 -4 . 2 , 1152 Danby Road , owned by Walter J . Wiggins .

voting Aye . Nays - none ) .
Councilman Cramer asked if the Town Board could have the plans on
"La Tourelle " before the meeting?
Town Engineer Fabbroni suggested that the Board members stop at
Town Hall and see the plans as they cannot be reduced and still be
readable .
SET DATE FOR PUBLIC HEARING - AMEND TOWN HIGHWAY MASTER PLAN
Supervisor Desch suggested that the Board look at the whole
Eastern Heights area inconjunction with their consideration to
amend the Town Highway Master Plan . We should determine if the

circulation proposed by Pine Tree Associates is adequate for this
proposal as well as the rest of the area .
RESOLUTION NO . 93
Motion by Supervisor Desch , seconded by Councilwoman Raffensperger ,
WHEREAS , the Town of Ithaca Planning Board has reviewed a sketch
plan for the subdivision of a portion of the lands formerly owned
by John Marion on East Hill , now identified as Pine Tree
Associates , and
WHEREAS , the proposed streets in the subdivision proposed by Pine
® Tree Associates do not match the highway circulation layout
required by the Town Highway Master Plan , and
WHEREAS , the Town Planning Board recommends that the circulation
proposed in the Pine Tree Associates subdivision plan is adequate
to meet the circulation needs of the subdivision and the
neighboring areas and , therefore , recommends that the Highway
Master Plan be revised to permit further consideration of the
subdivision as proposed ,
NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of
Ithaca that a Public Hearing will be held at 7 : 00 P . M . , on July 9 ,
1984 , to consider revisions to the Town Highway Master Plan within
the Pine Tree Associates subdivision consisting of the elimination
of access from the subdivision to Pine Tree Road and access from
the Pine Tree Associates subdivision to the Frandsen subdivision ,
and
FURTHER RESOLVED , that the proposed subdivision layout will be
shown on a tax-map-size plan of the entire area of the Town between
the Dryden Town Line , Pine Tree Road , Snyder Hill Road , and
Slaterville Road and , further , that such plan will also show the
circulation routes currently required by the Town Highway Master
Plan , and , further , that such plan is to be posted in the Board
Room at Town Hall no less than seven ( 7 ) days prior to the Public
Hearing .

APPOINT E,TIT OF PART-TIME ASSISTANT ENGINEER
The Town Supervisor stated that he would like to thank Larry
Fabbroni for bringing this to a head so early . With the
reomyrendation to hire Mr . Flumerfelt we won ' t have to bring
someone up to speed , as he will be able to help Larry and the Town
immediately .
RESOLUTION N0 , 94
Motion by Councilman Cramer ; seconded by Councilman Kugler ,
® WHEREAS , the Town Board has given its consent that the Town
Engineer of the Town of Ithaca serve in the role of Municipal
Engineer for the duration of the Grant process associated with the
Construction Phase of the new Wastewater Treatment Plant (WWTP) ,
provided adequate engineering support is available at the Town
Offices in his or her absence to carry out the duties required of
such role , and
WHEREAS , the Town Board has directed that candidates be interviewed
for the position of Assistant Town Engineer , and

WHEREAS , the Town Engineer interviewed and screened seven qualified
candidates referring two to interview by a committee of the Town
Board ,
NOW 'T'HEREFORE BE IT RESOLVED , by the Town Board of the Town of
Ithaca to employ Robert R . Flumerfelt , P . E . , as Assistant Town
Engineer , on a half-time basis , at a salary of $ 18 , 000 . 00 plus
benefits , excluding health coverage , with the understanding that ,
subject to additional needs created by more than half-time absence
of the Town Engineer for contract administration duties and Mr .
Flumerfelt ' s availability , the basis and corresponding renumeration
may be increased from time to time up to the limit of the Town
Engineer ' s parallel commitment to the WWTP project , such employment
® to be effective immediately .

DESIGNATION OF HISTORIC LANDMARKS - CORNELL AG QUADRANGLE
Supervisor Desch stated that a proposal has been advanced to
nominate as historic landmarks , a group of building in the Ag
Guadrangle which were erected during the first decade of Cornell .
The City of Ithaca was notified of the application , however , the
Town was not as it was thought at the time , that none of the
buildings to be designated were in the Town of Ithaca .
He went on to say that at the next Town Board meeting , we might ask
if there are any objections to the designation from Cornell or Town
residents . We won ' t waive our rights until after the next Board
meeting .
AGREEMENT TO SPEND TOWN HIGHWAY FUNDS
Town Engineer Fabbroni stated that he and the Highway
Superintendent have carefully gone over the proposal . The proposal
is a little different then the 10-Year Plan because we could see
some different need . The proposal is tilted to more oil and stone .
Next year we will get back to paving 2 miles of roads and 5 miles
of oil and stone .
Councilwoman Howell mentioned the sluce on the side of Winthrop
Drive after repaving was completed . People are afraid of the deep
culvert with no guard rails

PERSONS TO BE HEARD
Roberta Chiesa , 159 Bundy Road , stated that there were three houses
on the south side of Bundy Road that were not being included in the
sewer extensions and that she and Mr . Chiesa were before the Board
to ask that the sewer line be extended to include these houses .
Supervisor Desch responded that it would be two or three years
before it would be possible to extend the sewer line to include the
three houses in question .
Mr . Chiesa stated that his sewer system needed replacing now . He
would need to spend $ 2 , 500 to $ 3 , 000 to replace his septic system
now, only to have the sewer line extended in a short time and then
he would be required to hook up to the public sewer within ten
years . He stated that this would be too costly for him. He asked
the Board to consider looking for the necessary money to extend the
line now.
Supervisor Desch responded that the legal requirements to get
approval from the Comptroller at this time would put the project
back a minimum of six months . He suggested a better way would be
to wait and see if the bids come in lower than we anticipate , then
we would have a better chance of getting the approval of the
Comptroller .
Town Engineer Fabbroni added that there is a lot of exploratory
work to be done on the Hospital sewer , and , therefore , we may have
more money than we expect to have .
Mrs . Chiesa asked why all of the houses below 160 Bundy Road were
not included in the original proposal ?
® Supervisor Desch responded that the cost of extending the sewer to
these three houses made the cost of the improvement too high and
all of the Town of Ithaca would have had to pay a higher benefit
assessment . He went on to say that the Town wanted to go further
with the water lines . He suggested that Mr . and Mrs . Chiesa have
their neighbors write to him requesting the lire extension .
Mr . Chiesa again reminded that Board that something must be done
this year .

Supervisor Desch added that quite often the Health Department will
waiver the replacement requirement if public sewers are imminent .
Councilwoman Raffensperger asked when the bids were due on the
project ?
Town Engineer Fabbroni responded , we hope to open the bids on July
16 .
Councilman Cramer added that the property owners should get their
neighbors to write to the Supervisor by the middle of July . This
will give them and the Town time to consider how to handle the
problem .
® Donald Lowe representing the U . S . Chamber of Commerce addressed
the Board , stated that he was here tonight to urge the Town of
Ithaca to join the U . S . Chamber . He noted that the Chamber has
3 , 000 Congressional Action Committees that are located in every
congressional district nationwide with Chamber members lobbying
Congress when a vote that affects business is close .
Supervisor Desch asked Mr . Lowe if other municipalities in the
County had joined ? What about the State as a whole ? He asked Mr .
Lowe to get back to him with the answers . He then stated that no
action would be taken on the request to join the U . S . Chamber of
Commerce this evening .
REVIEW OF PARKS AND OPEN SPACE PRELIMINARY PROPOSALS
Susan Beeners stated that in 1975 , the Town of Ithaca Park and Open
Space Plan was adopted as the comprehensive planning guide for Town
park and open space development . At that time , a $ 130 , 000 capital
reserve fund was established for the planning , design and
construction of park and open space sites proposed in the Plan .
The Plan was revised in June , 1977 following further park and open
space planning and design development , and the refinement of
specific site plans .
This Plan update represents further development of concepts and
objectives established in the Comprehensive Park and Open Space
Plan .
In preparation for this Plan update , an inventory of open space and
recreational facilities in the Ithaca area was conducted , and short
and long range recreational and open space needs were assessed .
Methods included field investigations , input from neighborhood
groups and other residents , discussions with users of existing
parks , and aerial photograph mapping and analysis .
Based on community needs and on the pattern of land use and open
space that was identified in inventory and analysis , an open space
system of parks , bikeways and recreational trails , and conservation
® open space is proposed that can guide future land use and
development . Site selection criteria and proposed phasing are
based on the Comprehensive Park and Open Space Plan , which remains
the key guide for the Town Park and Open Space Program .
James Ridell questioned what portion of the population would use
the bikeway . He questioned the need for bikeways .
Susan Beeners responded that she felt there was a definite need for
bikeways .

Mr . Ridell responded that he would like to see the data that
substantiates this .
A representative of a local runners club stated that he ran 2 , 000
miles a year at that he was shocked at the extent of paving that
was proposed . Paving will destroy this beautiful trail .
Ruth Mahr , 103 Judd Falls Road stated that something was needed to
carry people as there were no shoulders on Judd Falls Road . She
went on to say that she hoped something was planned for the Fall
Creek area also . Route 366 was a problem for pedestrians trying to
cross and that something was needed to allow people on the East
side to get to the South side . She complimented Susan Beeners for
® her work in developing a plan and the Town Board for the financing .
Mr . Ridell remarked that he would like to know where the money was
coming from . He went on to say that the taxpayers don ' t have a
chance to vote on items like this .
Mr . Ridell asked how much the Town was spending each year on
vandalism?
Town Engineer Fabbroni responded that the Town spent about $ 1 , 000 a
year .
Ronald Simpson , Chairman of the Department of Recreation at Ithaca
College stated that he would like to see the abandoned railway on
South Hill retained in its present state and used as a
jogging/hiking trail . It is presently used rather extensively as a
jogging/hiking trail and this demand would easily justify its being
preserved for that purpose . If a hard surface bikeway were
developed on the existing right of way perhaps a soft surface
material could be used to the side of the bikeway for jogging .
Mr . Simpson went on to say that he doubted that the entire bikeway
system, as proposed for South Hill was actually needed . He stated
that he was a bike rider and that he felt the Town already had too
many bikeways . The ten miles of shoulder along the Danby Road to
the Tioga County line is an excellent existing resource for biking
and the additional section of bikeway proposed for the Ithaca
College campus should more than provide for bikeway needs in this
area .
Supervisor Desch stated that anyone who had comments on the
proposed bikeways should write to the Board .
PUBLIC HEARING - LOCAL LAW GOVERNING UNSAFE BUILDINGS
Proof of posting and publication notice of a public hearing to
consider the adoption of a Local Law governing unsafe buildings
having been presented by the Town Clerk , the Supervisor opened the
public hearing .
Supervisor Desch noted that the Board members each had a copy of
® the old existing law which regulates Unsafe Buildings and Collapsed
Structures . He suggested that the hearing be adjourned until the
Board had the opportunity to assess the need for a new local law .
RESOLUTION NO , 96
Motion by Supervisor Desch ; seconded by Councilwoman Howell ,
RESOLVED , that the Town Board of the Town of Ithaca hereby adjourns
the public hearing to consider the adoption of a Local Law
Town Board 10 June 11 , 1984
governing Unsafe Building and to consider said law at a later , more
appropriate time .

CONSIDER ENVIRONMEN'T'AL ASSESSMENT FORM ON NEW ZONING LAW
Supervisor Desch remarked that he did not find any inconsistences
or serious problems in the EAF .
Councilman Cramer noted that there were no references to the
® proposed Institutional Zones ,
Town Planner Peter Lovi asked Councilman Cramer is he felt the zone
would have a major impact on the environment ?
Councilman Cramer answered , yes .
Councilwoman Raffensperger asked if there had been major changes ?
Supervisor Desch responded that there have been some changes .
Councilwoman Raffensperger stated that she was not sure how item
# 3 , on page 4 below a family - "An increased emphasis on impacts
rather than uses as the primary basis for environmental regulation
and zoning classification " fits into the new Zoning Law.
Peter Lovi responded , gives you more freedom than a specific list .
A permitted used could have a higher impact than a non-permitted
use .
Councilwoman Raffensperger questioned why the EAF on the Zoning Law
was being considered now?
Mr . Lovi responded , because it came on the agenda again .
Supervisor Desch remarked that we could let the EAF set on the
table until the Zoning Law is completed if the Board so wishes .
The Board agreed to let the EAF rest until the Zoning Law is
completed .
SET DATE FOR PUBLIC HEARING - FORMAL PRESENTATION OF FINAL FLOOD
MAPS
RESOLUTION NO . 97
Motion by Supervisor Desch ; seconded by Councilman Bartholf ,
RESOLVED , that the Town Board of the Town of Ithaca will meet and
conduct a public hearing on July 9 , 1984 at 7 :30 P . M . , to consider
the formal presentation of the Final Flood Maps .

SUg4ER WORK FORCE
Town Engineer Fabbroni stated that what he was really asking the
Board was to amend the resolution adopted at the May 7 , 1984 Town
Board meeting to give him an umbrella type resolution to enable him
to fill the positions needed to complete the summer work schedule .

RESOLVED , that the Town Board of the Town of Ithaca hereby amends

BOLTON POINT WARRANTS
RESOLUTION NO , 100
Motion by Supervisor Desch ; seconded by Councilman Kugler ,
RESOLVED , that the Bolton Point Warrants dated June 11 , 1984 , in
the Operating Account are hereby approved , in the amount of
$ 72 , 703 . 03 after review and upon the recommendation of the Southern
Cayuga Lake Intermunicipal Water Commission , they are in order for
payment .

® SIX MILE CREEK
Supervisor Desch stated that there has been some activity on Six
Mile Creek . The resolution passed by the City is in line with our
position . He went on to say that Circle Greenway will be operating
the trails . Circle Greenway prefers that the Town ' s access be
closer to the City ' s , somewhere in the Honness Lane area . They are
asking the City Attorney to enter into negotiations with the two
property owners , Mr . Guidi and Mrs . Baker to allow access . The
site plans for the land of Guidi and Baker will have to come before
Town Board 12 June 11 , 1984
the Plannning Board , then the Town can act as lead agent on the
work to be done in the Town .
The Supervisor went on to say that he was concerned with the
extension of trails to Potter ' s Falls .
He stated that the Board could accept the City as lead agent on
items 1 and 2 or the Board could object to the City being lead
agent . The City is in a difficult position because of litigation ,
signage and the need for a gorge ranger .
Councilwoman Howell noted that the City knows the Town is
concerned . Don ' t you think the City will come to the Town ?
® Councilwoman Raffensperger responded , you are never sure .
