Tompkins County , New York , held at the Town Offices at 126 East
Seneca Street , Ithaca , New York , at 5 : 30 P .M . , on the 9th day of

PLEDCE OF ALLEGIANCE
® The Supervisor led the assemblage in the Pledge of Allegiance .
INSURANCE PRESENTATION
Robert Boothroyd , Boothroyd Agency presented to the Board a
breakdown of the insurance coverage ( copy attached ) . Mr . Boothroyd
went on to say that there have been only minimal changes in the
insurance since 1973 except for new trucks purchased , Workers '
Compensation because of higher payroll and the Public Officials
insurance , which increase the premium only a small amount . He

stated that for $ 50 . 00 more a year , a floater policy could be
written on the actual cost to replace equipment at todays
replacement costs . However , equipment must not be more than ten
years old . If the equipment is over ten years old then
replacement coverage goes back to the casual cost value . Also ,
this will apply only to off the road vehicles .
Supervisor Desch stated that he felt there was a consensus among
the Town Board members to go with this added insurance .
Mr . Boothroyd stated that eleven million for fiscal damage
(property ) for liability is now being carried . The Public
Officials Public Liability Insurance of two million dollar covers
Town Board members both as individuals and as a Board . Mr .
® Boothroyd went on to remind the Board that there is no coverage
beyond fire insurance for the pump stations , but to further cover
them would cost $ 2 , 500 a year which he did not feel was worth the
added premium considering the small risk involved .
The Supervisor thanked Mr . Boothroyd for his presentation .
RESOLUTION NO , 1
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes Building Inspector Lewis Cartee to attend the Ninth
Annual Building Officials Educational Conference in Rochester , New
York , April 16 , 17 , 18 , 1984 .

REPORT OF TOWN OFFICIALS
Supervisor ' s Report
Supervisor Desch reported that the EPA Grant Offer is expected in
the second quarter of 1984 . The SJS will be meeting next Monday at
which time they will consider approving the drawings and
specifications on the first segment . The Board of Public Works
will be meeting on the 11th of January , at which time they will
approve the Segment I drawings . It is expected that DEC and EPA
will take 30 days to approve the first segment .
The Supervisor went on to say that EPA should issue the grant offer
scmewhere around the end of February or the first of March . DEC
and EPA gave their approval to release the documents for bidding
before the grant offer is received , as long as the bid opening is
® not held before the grant offer is received. The month of May
looks achievable for opening of bids . We still do not have in
writing the advance approval , however , we should be receiving it
this week .
Supervisor Desch noted that a fair amount of time will be needed to
review the water and sewer improvements . A public hearing will be
held in February to authorize the borrowing . He went on to say
that it would be necessary to have an adjourned meeting on either
the 19th or 20th of January .
RESOLUTION NO , 2
Motion by Supervisor Desch ; seconded by Councilman Kugler ,
Town Board 3 January 9 , 1984
RESOLVED , that the Town Board of the Town of Ithaca hereby set the
date of January 19 , 1984 , at twelve noon for an adjourned Town
Board Meeting for the purpose of considering 1984 water and sewer
improvement .
(Desch , Kugler , Raffensperger , Cramer , McPeak , Howell and Bartholf
voting Aye . Nays - none) .
Town Engineer ' s Report
Town Engineer Lawrence Fabbroni presented , to the Board , his Annual
Engineering and Planning Report for 1983 ( copy attached to
minutes ) . He noted that his report was self explanatory . He went
on to say that the extension of sewers to other areas will be
contingent upon what it will take for the main . Parks are in
summary form in his report . The complete Parks Report is available
® for detailed information . Mr . Fabbroni stated that he hoped in
1984 that we can adopt several of the Ordinances that we have been
working on . A new look is needed on a Housing Code ,
Highway Superintendent Report
Highway Superintendent Robert Parkin then presented his 1983 Annual
Report of the Town Highway Superintendent ( copy attached to the
minutes ) . He explained that the tonage of salt and sand used was
down slightly because of the milder winter . Surface treatment was
up quite a bit from 19821P mileage and numbers remains the same .
Most of the crushed gravel and bank run was used on the Stone
Quarry Road , paving prpject as were the culverts . Linestone was
for the bikeways . Fuel use is up , mileage and hours of vehicle and
equiprent usage are higher . Overtime hours are down because of the
mild winter .
Building Inspector ' s Report
Building Inspector Lewis Cartee presented his Year End Report ( copy
attached to minutes ) . Mr . Cartee stated that this was a good year
for us , as construction was up from the previous year . He went on
to say that the New York State Fire and Building Construction Code
was in place .
Supervisor Desch stated that there was some question of inspections
at Cornell University , Ithaca College and the public schools . We
will have discussions , later on , on enforcing the code . The
Supervisor asked the Board Members to go through the list of
Complaints/ Investigations then a discussion on further action will
be held at a later time .
® Councilwoman Raffensperger asked what was encompassed in the cases
that are marked "Resolved" , did they go the to Zoning Board of
Appeals ?
® Building Inspector Cartee responded , they were either resolved by
going through my office or the Zoning Board of Appeals .
LAKE SHORE WEST
Stewart Knowlton , representative for the Lake Shore West Project ,
stated that the Lake Shore West Development was sponsored by the
ITD Investment Group from Stamford , Connecticut , who own a large
number of properties . This will be the second of this type of
project , the other one being in Concord , New Hampshire .

( A) MUNICIPAL PROJECTS ' STATUS
( 1 ) COMPLETED :
a . Transit
The Northeast Transit System ended its fourth twelve month
period having carried over 86 , 830 passengers . This 170
ridership increase was largely due to sustained expanded
all -day service first initiated in September 1981 . Thus
far, the fifth calendar year of operation shows ridership
figures 50 over the comparable Fall period of the fourth
year . This modest increase suggests that the level of use
may have topped out for the service provided and economies
of travel of the day . Night service is offered on the NET
transit runs as part of the TOMTRAN umbrella. Three
administrative options for long range operation by private
carrier, Cornell , or the City are presently being
considered by the NET Committee in conjunctioon with grant
application for a new transit vehicle . Increased State
subsidy levels have enabled the municipal participants
local match to remain at the same maximum for the fifth
straight year .
The Hospital transit continues to carry a steady ridership
of 40 , 000 annually . Accounting systems have been modified
to reflect State subsidies , Section 18 funds , and other
income to the system . As a result , local subsidies of
City , Town , and County are more accurately reported
through billing now semi -annual .
- East Ithaca Transit carried over 62 , 250 passengers in the
third year of its operation with local subsidies again
being minimized by State subsidies .
- New service to and from Downtown Ithaca and Cornell
University , with stops at East Hill Plaza and Ellis Hollow
Apartments via Ellis Hollow Road , will begin January 1984 ,
Work on a comprehensive plan of services in the Town has
begun .
Discussions continue with Cornell , County , City , and
private operators to keep a focus on integrated transit
services while utilizing most efficient methiods of
delivery at the least cost .
b . Sewers
Survey of the location and condition of Hospital Sewer
line from City line to Hospital grounds was completed .
- Staff support to SJS Committee including attendance at
design progress meetings at Stearns & Wheler , attendance
at SJS meetings , review of pre- industrial treatment survey
and legal consultant proposal , review of design and
specifications for Outfall project and Treatment Plant ,
technical briefing for policymakers on funding priorities ,
attending Priority List sessions , reviewing Engineers '
agreements , technical backup for Advanced Wastewater
Treatment reviews with DEC and EPA .
Continued surveillance of County study of - six solid waste
disposal sites for feasibility of landfill operations .
Ccn,pletion of School District connection . to Town Sewer
System along with payment agreement execution ,

Assisted Town Clerk in Townwide unit review, update, and
answering Tax Bill questions on same .
c . Town Hall and Town Barn
Town Hall front yard wrought iron fencing installed and
improvements completed .
State completed energy audit of Town Hall and Town Barn .
Results are not too useful as payback criteria is one year
and the Town had completed the obvious improvements
already .
Study of insulation of Town Barn completed with results
Pointing to conservation measures .
Town Hall draperies purchased and installed . Carpeting in
Clerk and Bookkeeping areas purchased and installed .
Attic floor insulation completed , Town6Hall .
Computer system enhanced with black box , software
purchase , legal tray and dot matrix printer order .
d . Parks
Completed agreements with Hilker for Northview Park, with
Lucente for Salem Park, with Goldberg for Snyder Hill
Park , and with Warren Estate for Forest Home Walkway .
- Completed one () F three playstructures ( Tareyton ) .
Completed revised master plan for Eastern Heights Park .
Effected regular summer maintenance of existing sites .
Expanded bikeway -walkway system in East Ithaca to Game
Farm Road .
Posted Park Use Law temporary signs .
- Completed walkway at Sandra Place ,
Drafted 1984 proposals for budget review by Committee . .
Completed SBA planting after grant preparation, design,
bidding , and material purchase .
- Seeded Eastern Heights Park and constructed sled hills .
Completed Bikeway Agreement with City and State for ' Inlet

e . Transportation
Continued review, as representative on Mayor ' s Design

, of Route 96 traffic data and assessment of
design alternatives and modifications being developed by

Completed Safer Off -System Improvements on Stone Quarry
Road , including three culvert crossings , a Gab ion
retaining wall , guard rails , and storm sewers .
Forest Home 1 -way study concluded with Town Board opting
for a moratorium on all small improvements until East
Ithaca Circulation improvements are pursued more earnestly
by the County .
Reviewed three speed recommendations with State .
Completed F/EIS and preliminary design, including
City / Town agreement for land swap, of Burns Road
relocation .

Working with local residents in ' Pine Tree Road / Slaterville
Road area with regard to drainage improvements on ' Old

- Received $ 1 , 000 grant from County to match for further
construction of Fall Creek retaining wall .

Replaced driveway culverts as requested or seen necessary ,
particularly Stone Quarry Road , Honness Lane , Blackstone
Avenue , and Renwick Heights .
Repaired washout in Cascadilla Creek .
Removed gravel from Fall Creek for improvements .

Obtained final acceptance of Townwide Water Study by Town
Board including 1984 recommendations .

Codes & Ordinances
The primary charge to this committee shall be a compilation of all
of the various local and state codes affecting activities within
the Town of Ithaca . This activity is already underway and shall
encompass the new State Fire Code .
Simultaneously and in conjunction with staff , the development of a
local process pertaining to wetland protection, etc . , will be a
critical effort .
Parks
The Parks Committee has already prepared an ambitious program for
1984 . The review of the Open Space Plan is a critical element but
of equal importance is the following :
Should a small capital reserve fund be set up for parks on a
Town-wide basis to replace the existing fund which will be depleted
in 1984 or 1985 ? The Town-wide fund would permit work to be done
at the former Cayuga Heights School .
Personnel
In terms of Corrmittee work there are two elements that are of
primary importance :
( 1 ) Complete survey of elected Officials salary
( 2 ) Develop performance evaluation procedure
The salary survey will be done in conjunction with the Association
of Towns at the Annual Meeting . We will prepare the form and
gather as much of the data as possible at the Annual Meeting . Bill
Sanford has offered to help with announcements , distribution of
forms at registration and perhaps final distribution of survey
results .
Safety & Highways
This is a new combined committee to focus on not only the fire
contracts but also the capabilities and practices of the Highway
Department . In the fire protection arena , vie need to develop a
parallel plan to serve the Town in the event negotiations with the
City of Ithaca fail . This w i l l need to be done . early in 1984 and
include total needs such as facilities , equipment and personnel .
The negotiating . team with the City will include Noel Desch , David
Jennings ( as long as he can ) , Gloria Howell , Peter Lovi , and on
special occasions Marc Cramer and Montgomery May .

In the Highway Safety area , the Town Engineer and Highway
Superintendent have set as a very high priority , an operations
review of the Highway Department . Support from a small committee
comprised of Robert Bartholf and Montgomery May will bring a level
of expertise that will be highly supportive of the efforts of
staff . One element of this work will be the evaluation of the
10 -Year Highway Machinery Replacement Plan which is sufficiently
through the implementation stage to determine its adequacy,
direction and success .

Town Board 4 January 9 , 1984
Mr . Knowlton went on to say that the Group plans to take the old
hospital , as it exists today, and convert it to one bedroom and two
bedroom apartments , with all support functions on 35 acres . He
stated that the Group had wanted a total of 50 acres , but because
of the County ' s limit of 35 acres it will be necessary for them to
make an additional bid for the remaining 15 acres , hoping to
acquire the D Wing .
Mr . Knowlton stated that the Tudor Style of the exterior will be
kept as is as the building has been kept in good repair . Phase II
of the project will provide an additional 100 apartments and Phase
III , 125 Town House apartments and a three hole golf course . We
will be making arrangements with a nursing home for care of our
people and hopefully in the future we will have our own nursing
hone , thus making the project a Life Use Facility . All of the
facilities will be interlocked to the main office through a push
button system with someone there at all times to respond to
emergencies . Camiunity type dining with three or four entrees on
the menu .
Mr . Knowlton went on to say that the response to the survey they
did was great and , therefore , there is a need to proceed with the
rezoning . Presently the area is zoned R-30 and it needs to be
rezoned Multi-Residence . Also , a mixed use zone will be needed , as
we plan to have a bank , barber shop , gift shop , etc . , type shops in
the basement of the main building where the emergency roan was
located .
Mr . Knowlton went on to say that in a Multi-Residence zone , parking
is needed at the rate of 1 1 / 3 per unit , these people primarily
have less than one car per unit . With a total of 340 units we
propose to provide parking for 300 cars . The main entrance , into
the ccnplex , will be via Trumansburg Road and DuBois Road to Indian
Creek Road .
Supervisor Desch asked Mr . Knowlton if he was seeking rezoning of
all 50 acres to Multi-Residence ?
Mr . Knowlton responded yes , then we will come in , in phases , as
needed .
Councilman Bartholf asked how close the property line goes to Route
89 ?
Mr . Knowlton responded that he guessed about 400 ' from the railroad
tracks .
Councilman McPeak asked if the units would be purchased like
condo ' s , for life ?
Mr . Knowlton responded , that one would buy a unit , have life use .
The people will pay X number of dollars a month which will include
food , etc . However , every unit will have a small kitchen .
Supervisor Desch thanked Mr . Knowlton for his presentation .
ANW10qI' TO NO PARKING ORDINANCE - EASTERN HEIGHTS AREA
Proof of posting and publication notice of amendment to the No
Parking Ordinance to prohibit parking in the Eastern Heights Area
having been presented by the Town Clerk , the Supervisor opened the
public hearing .
Supervisor Desch noted that he has a recommendation from Town
Engineer Fabbroni in the form of a memo dated January 9 , 19840

"After reviewing the parking history, available off-street parking ,
and parking problems in the Eastern Heights Subdivision with Town
Planner Peter Lovi and Town Highway Superintendent Robert Parkin ,
prohibition of parking is recommended on the following Town Highway
segments :
1 ) On both sides of Sharlene Drive from Snyder Hill Road to
Eastern Heights Drive .
2 ) On both sides of Eastern Heights Drive from future Town
highway Nancy Street to Sharlene Drive .
As there has not been a persistent problem with parking in other
® interior areas of the Eastern Heights Subdivision , it was felt a
general prohibition would be a nuisance to the residents who on
occasion might have a number of guests whose vehicles could not be
accommodated in generally limited and sloped off-street parking
® areas . Also , a positive way of dealing with provisions for parking
of residents in the new Zoning Law may be to require one space per
vehicle in the garage or driveway or in other than required lot
areas outside of the highway boundaries or rights of way . "
Ann Schwarting stated that she felt people believed it was okay to
park on the shoulders because it was always done in the past .
Robert Schwarting asked haw will signs be posted?
Supervisor Desch responded , every so many feet .
Supervisor Desch closed the hearing as no one present wished to
speak for or against the amendment .

RESOLVED , that the Town Board of the Town of Ithaca hereby amend
the Town of Ithaca No Parking Ordinance to include the prohibition
Of parking on both sides of Sharlene Drive from Snyder Hill Road to
Eastern Heights Drive and on both sides of Eastern Heights Drive
from future Town highway Nancy Street to Sharlene Drive between
1 : 00 A. M. and 6 : 00 A . M .

now. I have called DOT and if it is different , I will let you

HIGHWAY FACILITY INSULATION REPORT
Town Engineer Fabbroni reported that he has a 34 page report
prepared by one of the part-time employees , if anyone wished to
look at its Insulating the main garage area and shell would not be
® cost effective , also condensation was going to become a problem no
matter what we insulated with . On rainy days or cold days when the
men are working inside , the building will be heated , other times
the best policy is to turn back the thermostat . The decision was
made , however , to insulate over the office area .

REZONING - PROPERTY OF WAL'T'ER J . & JOYCE WIGGINS
Proof of posting and publication notice of a Public Hearing on the
rezoning of the property of Walter J . & Joyce Wiggins , Parcel No .
36-1 -4 . 2 , 20 . 4 acres at 1152 Danby Road from R- 30 to Multiple
Residence having been presented by the Town Clerk , the Supervisor
opened the public hearing .
Mr . Wiggins stated that he proposed to build on 60 acres a country
type inn for transits who wish to stay a day or so , or as long as
they choose , in a country setting . The inn will be patterned on
the bed and breakfast concept with dining rooms only for the
guests . Twenty acres need to be rezoned to meet this need .
® Mr . Wiggins went on to say that there was a need to expand the
restaurant , especially the kitchen area . He also noted that he was
considering the possibility of including an indoor tennis court .
People come to Ithaca to spend a weekend , then stay longer when
they find there are tennis courts , swinming pool and access to a
State Park close by .
Mr . Wiggins noted that historically the land has always been zoned
R-30 and has not been developed very fast . What we are asking is
campatable to the neighborhood . There have been no objections from
the neighbors .
Evan Mcnkemeyer stated that he had a concern with the 170 acres to
the south that was zoned multi-family . There is potential for a
2 , 229 unit development in this area .
Town Planner Peter Lovi read the following resolution adopted by
the Planning Board at their December 6 , 1983 meeting :
RESOLVED , that the Town of Ithaca Planning Board rec miend and
hereby does recommend to the Town Board that a 20 . 4 acre portion of
the lands of Walter J . and Joyce Wiggins , fronting on Danby Road ,
and known as 1152 Danby Road , said 20 . 4 acres being a portion of
Town of Ithaca Tax Parcel No . 6 -36-1 -4 . 2 containing approximately
55 . 19 acres , be rezoned from Residence District R-30 to Multiple
Residence District as requested by Walter J . and Joyce Wiggins and
as specifically set forth on Map entitled -- " Site Plan , the
Chateau" -- prepared by William Downing Associates Architects ,
dated 11 / 15/ 83 , revised 12/ 5 / 83 , drawn by K . D . G . , Project Number
83-568 , Scale 1 " = 1001 , with said Map having been reviewed by
said Planning Board at Public Hearing , this date , December 6 , 1983 ,
and with said Planning Board having found that :
10 There is a need for the proposed use in the proposed location .
2 . The existing and probable future character of the neighborhood
in which the use is to be located will not be adversely
® affected .
3 . The proposed change is in accordance with a comprehensive plan
of development of the Town , and
® FURTHER RESOLVED , that , in the event the proposed use , as shown on
the above-cited Map , is determined by the applicants , Walter J . and
Joyce Wiggins , to be undesirable , they can use the Phase I portion
therof, i . e . , 21 studio-type apartments , as apartment dwellings .
As no one else wished to heard , the Supervisor closed the public
hearing .
Town Board 10 January 9 , 1984
Councilman Cramer remarked that the nature of the project might
suggest that it falls into the category of commercial not multiple
residence . Why was a business zone not considered ?
Mr . Wiggins responded that the Town Planner had suggest a Multiple
Residence zone .
Town Engineer Fabbroni responded that if the area were zoned
commercial there would be no control down the line . The East Hill
Plaza is a good example , there were many things that could not be
controlled after the plaza was built .
Mr . Lovi added , you get into a business zone , you loose control .
It was purely a judgemental call on my part .
Mr . Wiggins again stated that a bed and breakfast country inn is
what we want , but if it shouldn ' t , for some reason continue to be
this we can convert the units to apartments . Mr . Wiggins went on
to say that the Town could make contract zoning with him to do
something .
Town Attorney Buyoucos asked Mr . Wiggins if he would feel better if
this was a contract zone ?
Mr . Wiggins responded that he was happy with it if the Board is
comfortable with it , either way he was flexible .
Supervisor Desch asked what the tennis courts would do to parking?
Mr . Wiggins responded , not much , only eight people can play .
Councilwoman Raffensperger asked if the restaurant was now
operating under a variance?
Town Engineer Fabbroni responded , yes .
Councilwoman Raffensperger questioned the size of each unit .
Mr . Wiggins responded , 15 x 24 .
Councilwoman Raffensperger stated that she felt the Town Board
should look at the EAF again . She noted that the EAF should have
shown a number under the proposed dwelling units and asked the Town
Planner if this had been changed on the EAF ?
Mr . Lovi responded , no .
Councilwoman Raffensperger questions # 11 (Number of proposed units )
which lists 20 - 80 .
Mr . Lovi responded that it shoud be no more than 20 .
® Supervisor Desch questioned # 10 (number of buildings ) , where did
the number 56 come from?
Peter Lovi responded these are proposed future homes , not in this
phase .
Councilman Cramer questioned why is it in here ?
Mr . Lovi responded , because this is the whole proposal , the EAF was
done on the whole proposal , not piecemeal .
Councilwoman Raffensperger responded , we don ' t have enough
information to judge the whole project . We were prepared to rezone
the area for a bed and breakfast for 20 units not 80 units .
Town Board 11 January 9 , 1984
Supervisor Desch stated that he did not have a problem with
rezoning the 20 acre unit bed and breakfast area , however , he did
have a problem with rezoning the remainder of the property with no
solid proposal for develognent .
Councilman Cramer noted that the EAF lists a natural gorge , where
is it?
Mr . Wiggins responded that it was to the left of his property .
Councilwoman Raffensperger remarked that she saw a lot of
inconsistencies in the EAF .
Supervisor Desch noted that any action taken tonight on the EAF
could be continguent upon the EAF being changed to reflect the 20
acres to be rezoned and then let any later proposals stand on their
own .

Motion by Supervisor Desch ; seconded by Councilman Bartholf ,
RESOLVED , that the Town Board of the Town of Ithaca hereby accepts ,
subject to acceptable revision , the EAF on the rezoning proposal of
Walter J . and Joyce Wiggins , 20 acre parcel at 1152 Danby Road ,
Parcel No . 36-1-4 . 2 .
(Desch , Kugler , Cramer , McPeak , Howell and Bartholf voting Aye .
Nays - Raffensperger ) .
Councilwoman Raffensperger noted that she voted no because it was
evident that the EAF was not made for the Town Board and is left
over from the Planning Board ,
Supervisor Desch stated that the procedure was routinely reviewed
and probably should have been made available to the Board .
Councilwoman Raffensperger added , and in correct form .
RESOLUTION NO , 14

Motion by Supervisor Desch , seconded by Councilman McPeak ,
RESOLVED, that the Town Board of the Town of Ithaca hereby approves
the rezoning from R- 30 to Multiple Residence for the 20 . 4 acre
portion of lands of Walter J . and Joyce Wiggins at 1152 Danby Road ,
Tax Parcel No . 36-2-4 . 2 .
Councilman Cramer suggested that the Board should wait on the
rezoning until they receive a letter clarifying the proposal , from
Mr . Wiggins .
Supervisor Desch responded that if the nature of the changes were
great then it would be okay to wait , but they are not . It ' s only a
matter of recording correctly .
Supervisor Desch called for a roll call vote .
