SPECIAL TOWN BOARD MEETING
December 30 , 1983
At a Special Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 126 East
Seneca Street , Ithaca , New York , at 10 : 30 A .M . , on the 30th day of
December , 1983 , there were :
® PRESENT : Noel Desch , Supervisor
George Kugler , Councilman

The Supervisor led the assemblage in the Pledge of Allegiance .
REPORT OF TOWN OFFICIALS
Supervisor ' s Report
Supervisor Desch stated that 'he would have committee appointments
ready for the January Board meeting . Hopefully there will not be
too mach for the Codes & Ordinance committee this year . However ,
there is a new set of regulations on Wet Lands Management and it
may be necessary to modify our local law .
The Supervisor stated that he would like to thank the staff for the
team effort that has developed among them . This is very helpful ,
and without a full time supervisor , the team effort makes it
enjoyable for everybody . The follow through that the staff did ,
even on small items was great . He went on to say that our
operations are small but the caliber of work is excellent . Even
the taxes are being put in the mail today . Everyone adopts well to
® situations that ccme up unexpectedly .
Town Engineer ' s Report
Town Engineer Fabbroni informed the Board that they would be
receiving his written report at the January meeting .
The Town Engineer noted that the Northeast Transit contract between
Swartout and Ferris and the County has been approved . Northeast
Transit increased their ridership from 85 , 000 to 90 , 000 . He noted
Town Board 2 December 30 , 1983
that there would not be an East Ithaca Transit in 1984 , as Cornell
has made application to run the service on their own .
Supervisor Desch asked if there had been any new discussion on
parking lots ?
Town Engineer Fabbroni responded that a new parking lot was being
considered in the East Hill Plaza . The lot size being considered
would hold between 200 and 300 cars . He stated that their was a
drive to get people to use the free lots closer to where they live
instead of driving all across town .
Councilwoman Raffensperger asked if the parking lot would require a
® rezoning?
Town Engineer Fabbroni responded , probably not . This is a tough
question , how does parking related to the Zoning Ordinance .
Councilman Cramer asked if there would be shelters in the parking
lot ?
Town Engineer Fabbroni responded , probably .
Councilman Cramer stated that he heard on the radio a report by
Bernard Carpenter about an extension of the bus service to East
Hill Plaza ,
Town Engineer Fabbroni responded that there would be no revenues
nor no expenses for the Town . The City accrued surplus fund and
with operating subsidy , it puts then in a favorable position to
expand services and complete the route - East Hill Plaza , Nate ' s
Floral Estates , etc . It should help the East Hill Plaza and the
Ellis Hollow Elderly Housing . This service will not conflict with
Cornell ' s service and provides for a transfer at East Hill Plaza to
East Hill .
Supervisor Desch asked if this help Eastwood Commons ?
Town Engineer Fabbroni responded no . There is a limited clientel ,
only about two or three people who want public transportation . If
Cornell should locate a parking lot in the East Hill Plaza , they
could extend their bus service , but you would still have to
transfer to go downtown .
Highway Superintendent ' s Report
Highway Superintendent Robert Parkin noted we have had quite a bit
of winter weather since the last meeting , therefore , there has been
a considerable amount of cindering and plowing . He went on to say
that there had been a problem with one of the culverts on Stone
Quarry Road which was full of leaves and branches . It took about
three days to clean it out . Superintendent Parkin stated that they
had installed another culvert on Stone Quarry Road and may need to
repave .
Superintendent Parkin went on to report that Truck # 3 was back but
smoking quite bad . We will take it back to the garage after the
holidays .
The Superintendent stated that he was going to move Bert Dean into
the foremans spot and Art Westmiller into the mechanics position .
Hopefully we will be able to implement this by the first of the
year .

Motion by Supervisor Desch , seconded by Councilman McPeak ,
RESOLVED , that the Town Board of the Town of Ithaca having received
the accounts of the Receiver of Taxes for the year 1983 , hereby
approves the same , a copy of said accounts being made a part of the
Town records .
(Desch , Kugler , Raffensperger , Cramer , McPeak , and Kiefer voting
Aye . Nays - none ) .

RESOLUTION NO . 209
Motion by Councilman Cramer , seconded by Councilwoman
Raffensperger ,
RESOLVED , that the Town Board of the Town of Ithaca having received
the accounts of the Town Clerk for the year 1983 , hereby approves
the same , a copy of said accounts being made a part of the Town
records .

Motion by Councilman McPeak , seconded by Councilman Kugler ,

establishes , for the Town Highway Department , a salary scale
ranging from a minimum of $ 4 . 80 per hour to a maximum of $ 9 . 55 per
hour for the Highway employees for the year 1984 .

Supervisor Desch stated that it was necessary to amend the 1984
Budget to dovetail with the Chart of Accounts . There are not
changes in the totals . He went on to say that we would end up with
more flexibility . In approving this budget amendment we can
interchange within accounts , subject to Board approval .
RESOLUTION NO . 216
Motion by Supervisor Desch , seconded by Councilman McPeak ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorize the amendments to the 1984 budget . which will dovetail
with the Chart of Accounts ( copy attached to the official minutes ) .

RESOLUTION OF APPRECIATION FOR COUNCILWOMAN KIEFER
RESOLUTION NO . 217
Motion by Supervisor Desch ; seconded by Councilman McPeak ,
WHEREAS , Mrs . Dooley Kiefer was elected to the Ithaca Town Board in
® November of 1980 , and served the people of the Town of Ithaca with
distinction for three years , and
WHEREAS , during her career of public service with the Town , Mrs .
Kiefer pursued municipal affairs diligently and with a special
interest and concern for our ccmmunity ' s environmental protection ,
land use considerations , and the various codes and ordinances which
serve as essential tools to assist in the proper direction of the
Town , and
Town Board 6 December 30 , 1983
WHEREAS , Mrs . Kiefer provided extensive assistance in the conplex
and time consuming task of updating our Cable TV Franchise ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca , on behalf of the people of the Town of Ithaca , express our
appreciation for the dedication , wisdom and statesmanship which
Dooley has provided us .

LUCENTE PROPOSAL - SAPSUCKER WOODS ROAD
® Supervisor Desch stated that the Town Attorney , because of the
litigation on occupancy in 1974 , felt Mr . Lucente ' s proposal should
be reviewed briefly by this Board first . He went on to say that
the Board does not have a concrete proposal before them . He then
asked if there was anything about the existing proposal that the
Board felt they should consider before the Planning Board looks at
the proposal ?
Councilwoman Raffensperger stated that the Guidelines say that a
proposal goes to the Planning Board before it comes to the Town
Board . She went on to say that she was trying to figure out why we
did not proceed this way . We can either not take the Planning
Boards recommendations or we can modify .
Mr . Lucente stated that he was considering selling the buildings
with owner plus rental property in each building .
Town Planner Peter Lovi remarked that it would be more helpful if
the Town Board would tell the Planning Board up front what they
wanted for conditions .
Councilwoman Raffensperger stated that the Board did not have
enough information to make a decision .
Supervisor Desch stated that he was not sure it would be
appropriate to make a decision even if we had enough information .
Also , before it cones back to this Board we should know if the new
fire code has been complied with .
Councilwoman Raffensperger stated that she was interested in
knowing the actual occupancy opposed to the proposed occupancy .
She went on to say that she did not want to know theory , that she
wanted actual figures from the Planning Board ,
Town Planner Lovi responded that Mr . Lucente could have the same
number of people . He stated that how the density is structured is
more important . You can ' t control the numbers , you can control the
units .
Supervisor Desch suggested that the process should go the normal
route and that he felt the Town Board would like to see a
® recommendation from the Planning Board before proceeding .
APPOINTMENT TO TOMPKINS COUNTY ENVIRONMENTAL MANAGEMENT COUNCIL
RESOLUTION NO . 218
Motion by Supervisor Desch , seconded by Councilwoman Raffensperger ,
RESOLVED , that the Town Board of the Town of Ithaca hereby approves
the appointment of Richard Fischer , 135 Pine Tree Road as the Town
Town Board 7 December 30 , 1983
of Ithaca Representative on the Tompkins County Environmental
Management Council for the year 1984 .

FIRE CONTRACT WITH THE CITY OF ITHACA
Supervisor Desch stated that the Town should dovetail into the
contract all of our concerns . We should incorporate our concerns
for a fire station on South Hill and West Hill because this
agreement may be the foundation for a long term agreement . Perhaps
® we will need to have another agreement , something like the sewer
agreement .
Montgomery May stated that the Fire Commissioners will not accept a
contract which includes any buildings .
Councilman Cramer asked what the timetable was for fire stations ?
Supervisor Desch asked Councilman Cramer what he proposed?
Councilman Cramer responded , 1985 .
Supervisor Desch asked the Board if they agreed? All present
agreed with the 1985 date .
Montgomery May noted that the only one who can call for mutual aid
is another fire carpany . If something happens in the City and all
fire trucks go to the City fire , the Town could not call for mutual
aid if there was a fire in the Town .
Councilman Cramer asked , what about a situation like Buffalo had ,
were they had a fire truck burned up , would the Town need to take
on the replacement burden?
Supervisor Desch responded that the insurance would pay for the
replacement of the truck but the Town would be affected by the
increase in insurance costs .
The Supervisor went on to say that the proposed contract is for two
years rather than one year . If all the concerns and problems can
be worked out and if the City accepts our conditions , then we will
okay the two year contract , if not we are willing to accept only a
one year contract . Also , we are not interested in being a part of
the clean up of the Fire Safety building and site .
PERMANENT EMPLOYMENT FOR THREE PART-TIME EMPLOYEES
RESOLUTION NO . 219
Motion by Councilwoman Raffensperger , seconded by Councilman
Kugler ,
WHEREAS , the Town Board has budgeted for a full time equivalent for
a park maintenance worker-foreman fran park maintenance part-town
funds and park construction capital reserve funds , and
WHEREAS , Richard Schoch has been employed because of his unique
combination of educational training and experience with landscape
materials and of construction skills to be temporary full-time
foreman of the park operations since June 1982 ,

NOW THEREFORE BE IT RESOLVED , that Richard Schoch be appointed to a
full time salaried position as Park Maintenance Foreman/Worker
effective January 1 , 1984 , with full benefits at $ 14 , 560 per year
( equivalent to $ 8 . 00 per hour , 35 hours per week) and with a twelve
month probationary period with evaluations and continuing
employment to occur on or about June 1 , 1984 and December 1 , 1984 .

WHEREAS , an opening will occur in the Highway Department staff of
the Town of Ithaca on or about September 1 , 1984 , when Roy
Casterline , a 30 year employee of the Town , retires , and
WHEREAS , Larry Stanton , a temporary park maintenance worker who has
served the Town full-time for two and one-half years , will end work
for Parks December 31 , 1983 , and
WHEREAS , funds are available through Safer Off System work , Burns
Road , drainage , and park projects expected to be performed by the
Highway Department in 1984 ,
NOW THEREFORE BE IT RESOLVED , that Larry Stanton be hired as a Town
of Ithaca Highway employee as Highway Laborer full-time effective
January 1 , 1984 , with full benefits at $ 4 . 80 per hour and with a
twelve month probationary period with evaluations on continuing

SAFETY DEPOSIT BOX
RESOLUTION NO . 223
Motion by Supervisor Desch , seconded by Councilman McPeak ,
RESOLVED , that the securities , papers and properties of the Town ,
until further ordered , be deposited , in its name , in a safety
deposit box in the First Bank and Trust Company of Ithaca in the
City of Ithaca , New York , and that access thereto be and the same
is direct to be had from time to time , by Supervisor Noel Desch ,
Town Clerk Jean Swartwood , Town Engineer Lawrence Fabbroni , and
Town Planner Peter Lovi , officers of the Town , are hereby severally
authorized to sign any agreement in the name of this Company with
First Bank and Trust Company of Ithaca to afford such access and to
permit removal of the contents of such box , and that upon such
access being given to all or any of the persons herein mentioned ,
no further responsibility shall attach to the First Bank of Ithaca
until written notice of the revocation of this resolution by the
Town Board , and that a copy of this resolution , certified by the

SUBDIVISION REGULATIONS
Supervisor Desch stated that it would be necessary to hold work
sessions , starting in January , in order to complete the subdivision
regulations . He suggested that the Board meet once a week for a
two hour session . He asked the Board members to be thinking about
what day would be best and what hours with a decision to be made at
the January meeting . Suggested was 3 : 30 P . M . to 5 : 30 P . M . , or 4 : 00
P .M . to 6 : 00 P .M .

RESOLVED , that the Town Board of the Town of Ithaca hereby appoint

independent auditors for the Town ' s books for the year 1984 .
