SPECIAL TOWN BOARD MEETING
November 21 , 1983
At a Special Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 126 East
Seneca Street , Ithaca , New York , at 7 : 30 P . M . , on the 21st day of
November , 1983 , there were :

PLEDGE OF ALLEGIANCE
The Supervisor led the assemblage in the Pledge of Allegiance .
PUBLIC HEARING TO CONSIDER THE PROPOSED AMIIMMENT TO THE TOWN ' S
CABLE TELEVISION FRANCHISE WITH AMERICAN COMMUNITY CABIMSION ,
INC .
Proof of posting and publication of the notice of a public hearing
to consider the proposed amendment to the Town ' s Cable Television
Franchise with American Community Cablevision , Inc . , having been
presented by the Town Clerk , the Supervisor opened the public
hearing .
Supervisor Desch read the following statement :
"On April 1 ( 7 ) months ago) the Town of Ithaca was officially
notified by ATC of a schedule of rate increases . During the
ensuing period the TV Cable Committee , appointed by the Town Board
met approximately 25 ' times to review , not only the financial
aspects of the franchise , but all of the provisions . A
representative of the Town Attorney ' s office attended virtually all
of the sessions and has spent in total more than 50 hours on the
subject . Most of the meetings were also attended by the Manager of
ATC .
Extensive review by the full Board has also taken place through the
review of the wording of the special Newsletter supplement . The
public information hearing held on a Special Board meeting on
October 3rd and the detailed review of the entire franchise on
October 19 at a second Special Board meeting .
The cable company has provided all information that could be
reasonably expected , in fact , far beyond the data required . That
information has been made available to the Board . The current
draft was made available to Board members in November . It reflects
the changes approved earlier by consensus . In the cover memo ,

Board members were asked to bring any errors to the attention of
the Supervisor prior to this evenings hearing .
Other than the following matters and any public input at this
hearing , the terms of the franchise , therefore , have been resolved :
( 1 ) Duration , i . e . , 5 or 10 years .
( 2 ) Franchise Fee ,
( 3 ) Security and Special Fund .
( 4 ) Rate Approval .
® ( 5 ) Insurance .
( 6 ) Augmented Service and line extension . "
As there was no one present to speak for or against the proposed
franchise , the Supervisor closed the public hearing .
Considerable discussion was held on the above topics .
RESOLUTION NO . 185
Motion by Supervisor Desch , seconded by Councilman Kugler ,
RESOLVED , that the Town Board of the Town of Ithaca hereby approves
the amendments to the Town ' s Cable Television Franchise with
American Community Cablevision , Inc . ( copy of complete franchise
in file ) .
Supervisor Desch called for a roll call vote .

REBUILT ENGINE FOR HIGHWAY TRUCK NO . 3
RESOLUTION NO , 186
Motion by Supervisor Desch , seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorize the expenditure of $ 8 , 000 to replace the engine in truck
® # 3 .

voting Aye . Nays - none ) .
PAYROLL SERVICES
RESOLUTION NO , 187
Motionb by Supervisor Desch , seconded by Councilman Kugler ,
Town Board 3 November 21 , 1983
RESOLVED , by the Town Board of the Town of Ithaca that the Tarnpkins
County Trust Company be contracted for one year to do the payroll
for the Town of Ithaca at a fee of $ 650 plus $ 200 , 20 % of which
will be shared by the Southern Cayuga Lake Intermunicipal Water
Ccnu fission .
Councilwoman Raffensperger questioned why the functions could not
be handled in-house .
(Desch , Kugler , Raffensperger , Cramer , McPeak , Kiefer and Bartholf
voting Aye . Nays - none ) .
