May 9 , 1983
At a Regular Meeting of the Town Board of the Town of
Ithaca , Tompkins County , New York , held at the Town Offices
at 121 East Seneca Street , Ithaca , New York , at 5 : 30 P . M . ,
on the 9th day of May , 1983 , there were :

The Supervisor led the assemblage in the Pledge of
Allegiance .
REPORT OF TOWN OFFICIALS
Supervisor ' s Report
Sales Tax Projections
Supervisor Desch stated , as you perhaps noted in the Ithaca
Journal last week , the Sales Tax figures for
' 82 quarter showed about a 16 % increase in sales over
December 181 in the area outside the City . He noted that
® this was a promising indicator that economic recovery really
started earlier in our community than statewide .
Sewage Treatment Plant Project
® The Supervisor explained that this is the month that the new
priority list for 1984 is developed . Following the recent
inspection of the existing plant , by DEC officials , and a
number of conversations with the persons doing the ratings ,
we are hopeful that our priority rating will sufficiently
improve to secure funding during the coming year .
Also , there is a matter relating to one of the easements
that we should discuss in executive session at a later point
in the meeting .

Coddington Road Community Center
Supervisor Desch stated that he had been informally alerted
that the Center may officially close its doors in the very
near future . This means that the building and the land
revert to the Town , in which event , we will need to
determine its future use . The Supervisor stated that he
proposes that the Town establish a committee to study the
future of the facility and report to the Town Board its
recommendation at an appropriate time in the future . The
® committee would consist of the following :
Chairman Planning Board or his designee
Chairman Parks & Recreation Committee or her designee
® Chairman of Safety Committee or his designee
A neighbor
Town Planner
President of CRCC or designee
The committee would pick the Chairperson .
He went on to say that in the event the property is declared
surplus , by the Town , the disposal would be subject to
permissive referendum and he stated that he imagined the
Town would auction the sale , should it come to that .
Summer Employment
Supervisor Desch went on to say that the Town Engineer will
outline an overall proposal for summer employment involving
a combination of Cornell Work Study , CETA and County Youth
project funding .
Forest Home One -Way Proposal
The Supervisor noted that so far , the Town has received
about six responses to the Newsletter . Although these
Particular responses are , in the main , negative , there are
both some positive suggestions and misunderstanding as to
the impact . The Town Engineer will put together a map
showing the origin of persons responding to the Newsletter
and at the June meeting , there will be a full discussion of
the alternatives suggested in the comments . He went on to
say that , however , there will not be time at tonights
meeting to have any indepth review of these proposals .
Town Engineer ' - Re ort
® Transit
Town Engineer Lawrence Fabbroni reported the April ridership
on Northeast Transit was over 8 , 000 . This is about a 40 %
® increase over the year before . East Ithaca Transit
ridership figures showed 6 , 000 , off 1 / 4 to 1 / 3 from a year
ago . He went on to say that this relates to Cornell moving
the Credit Union and some accounting functions on to C
.property . ornell
Draina e Improvements
The Town Engineer stated the he had submitted , to the
County , a five phase projection for Eastern Heights drainage
improvements , including bank protection . Also , a five phase
projection ' for the Fall Creek area , including dredging and
building of retaining walls in the Flat Rock area . He went
on to say that the Dam has filled to a level of six to eight
feet over where it was when it was cleaned before . The
budget proposals are on a matching basis with the Town share
slated at $ 10 , 000 . If the County had budgeted $ 50 ,, 000 to
56010001 then he stated he would bring he
g proposal to the

Board , but with it being only $ 101, 000 , and this amount
already budgeted , he saw a need to only mention this to the
Board . He went on to say that perhaps the County will see
the need , next year , for more money for this kind of a
project .
Parks
Pair . Fabbroni noted that the play structures for the parks
are being prepackaged . When it get dry enough , we will
grade and seed the parks , hopefully we can start next week .
Later on in the Agenda , we have a resolution for summer
® help .
Highway Superintendent ' s Report
Stone Quarry Road
Highway Superintendent Robert Parkin reported that they are
busy working on a Safer Off System Project for Stone Quarry
Road . Also , brooming is one - half completed in the Eastern
Heights area . We haven ' t gotten to the worse areas yet ,
however ..
Spring Clean - Up
Mr . Parkin went on to say that Spring Clean - Up Day ended up
to be Spring Clean - Up Week . Also , because of the weather
there was some plowing and cindering .
Councilman Jennings asked if the shovel that is being used
on Stone Quarry Road belongs to the town ?
Superintendent Parkin responded , no it is rented .
Councilman Jennings stated that he had assumed it was rented
and then asked if the railroad hump was going to be removed ?
Supervisor Desch responded , yes but not right away .
Removing it will be a big engineering problem . Probably
dovetail the removal with the bikeway project . Not sure
what the solution is .
Councilman Jennings remarked that he had driven up Stone
Quarry Road during a rain storm and noted that the water was
running down the road because the shoulders were built up so
high .
Cable TV Committee
® Councilwoman Kiefer reported that the Cable Committee will
have their first meeting May 10th at ll : 00 a . m . , and will
meet again at noon on May 17th , Martin Sheridan , General
Manager of ACC has taken the County model TV Franchise and
added modifications and the new State rules . ACC would like
to take some language out of the contract so they can change
chanels . ACC is also changing their policy on renting
converters .
Mr . Kiefer went on to say that on May 10th the City of
Ithaca will be holding a franchise meeting . Ivy Parrish ,
Rate Analysis for ACC in Denver will be attending the
meeting to answer financial questions

Codes & Ordinance Committee
Councilman Cramer stated that the Committee has reviewed the
Unsafe Buildings Law . If necessary , the Committee will meet
again for review and the law should be ready for the Town
Board at either the June or July Board meeting .
Parks and Recreation Committee
® Councilwoman Raffensperger reported that the Committee had
met on April 28th to revise the 1983 budget and discuss the
need for summer help for the park program . The bottom line
is the same , the intent is to provide needed flexibility in
the 1983 work program , acknowledging the role that the
weather , the availability of the Highway crew , CETA and
other labor sources . All budget items concerning recreation
ways are combined and would include the Lehigh Valley
Railroad work and allow work in Forest Home , the Northeast ,
walkways in various parks , etc . , to proceed as circumstances
permit .

RESOLUTION NO , 48
Motion by Supervisor Desch ; seconded by Councilman Kugler ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
approves the revised Parks Reserve Fund Budget as noted
above .

Jennings voting Aye . Nays - none ) .

SUMMER HELP
Town Engineer Fabbroni stated that the resolution the Board
members have on Summer Help is self explanatory as it lists
the projects we hope to accomplish and the personnel needed
to accomplish the work . If 24 workers are hired , we will
need help with payroll , etc . The resolution is open ended
because we are working with three programs , Cornell
Work / Study Summer Program , Tompkins County CETA Temporary
® Employment and Tompkins County Summer Youth Worker Program ,
County Representative Mary Call stated that the County would
subsidize $ 1 . 00 per hour for up to 15 hours per week for 6
weeks , starting June 27 and ending September 2 . She went on
to say that it was recommended , not a requirement , that the
Town not hire the same people they employeed last year .
RESOLUTION NO , 49
Motion by Councilman Kugler ; seconded by Councilman McPeak ,
WHEREAS , the Town Board has budgeted funds in 1983 for
planning , design , and / or construction of the Burns Road
relocation , Stone Quarry Road safety improvements and
rehabilitation , water distribution sytem improvements ,
insulation of the Highway Maintenance Facility , exploratory
repair of the " Hospital " trunk sewer main , drainage system
repairs , parks construction and maintenance , and
WHEREAS , existing staff should be supplemented with
temporary summer help to most effectively use in - house
skills , training , or supervisory abilities to progress with
the above special projects in parallel with daily tasks by
ideally providing a four -person park maintenance crew , a
four -person park landscaping and construction crew , two
office clerks , one systems analyst , and
WHEREAS , the Cornell Work / Study Summer Program , Tompkins
County CETA Temporary Employment , and Tompkins County Summer
Youth Worker Program are the three programs through which
these temporary manpower needs have most efficiently been
met in the past ;
NOW THEREFORE BE IT RESOLVED , that the Town Board of the
Town of Ithaca approves the hiring of up to three surveying
aides , two flag persons , three park maintenance workers ,
three park construction aides , two office clerks , and one
® system analyst as temporary summer employees to augment
existing staff from one or all of the programs above
mentioned , for all or a portion of the time between June 6 ,
® 1983 through September 9 , 1983 ; for salaries ranging from
$ 2 . 00 per hour up to $ 6 . 00 per hour depending on abilities
and funding programs , and
BE IT FURTHER RESOLVED , that a temporary truck driver be
hired at a rate not to exceed $ 5 . 75 per hour for the period
from June 6 through September 30 to substitute for
vacationing highway employees .

Jennings voting Aye . Nays - none ) .
County Representative Mary Call asked how many Summer Youth
Workers do you plan to hire ?
Town Engineer Fabbroni responded that the Town could use up
to 24 . However , it depends on how many Cornell Work / Study
students are hired , this would reduce the number of Summer
Youth Workers .

EAST ITHACA BIKEWAY BRIDGES
Town Engineer Fabbroni stated - that the Staff had been asked
to expedite the bridges on the East Ithaca Bikeway project .
Bridge # 1 is across Judd Falls Road , Bridge # 2 is over
Cascadilla Creek . Both bridges are quite solid , however ,
Bridge # 2 will need about $ 300 in deck fill .
Susan Beeners presented drawings of proposed fencing . She
stated that the possibility of people climbing over the
fencing or throwing stones over the bridge was taken into
consideration .

Supervisor Desch asked the width was over the bridgeso,
Susan Beeners explained that Bridge # 1 was 10 ' wide and
Bridge # 2. was 6 ' to 8 ' wide . She noted that there was
adequate room to turn a bicyle around or brake , before going
over -the bridges . 20 ' of fencing will be carried across the
bridge .
Nis . Beeners went on to say that a suggestion had been made
that solid boards be used across the bridge , however , she
felt the bridges should be kept open to discourage vandals .
Councilman Jennings asked if the bridge across the roadway
situated so that the fence can be put back for enough so
that kids will not fall off ?
Ms . Beeners responded that because of the rivets , the fence
will have to be centered .
Councilman Jennings asked if chain fence would be less
climbable ?
Susan Beeners responded that she though chain invites
distruction .
Councilman Kugler remarked that Agway has prefab fittings
and are able to stretch the fence .
Councilwoman Raffensperger remarked that chain link fence
was not as easy to climb as ordinary fence .
RESOLUTION NO . 50
® Motion by Councilman Jennings ; seconded by Supervisor Desch ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the purchase of ( Alternate B ) chain link panels
®
with -wood posts ( 4 ' ht . ) at a price of $ 2 , 2 .94 . 00
# 1 and $ 1 , 147 . 00 for Bridge # 2 . for
( Desch , Kugler , Raffensperger , Cramer , McPeak , Kiefer and
Jennings voting Aye . Nays - none ) .
Councilman McPeak remarked that the schools use a fence with
a twister like on top .
Susan Beeners explained this was chain link fence welded on
pipe and twisted around .

Town Board Minutes - 7 - May 9 , 1983
Public Safety Committee and Youth Committee
Councilman Jennings reported that the Public Safety ,
Committee had held at meeting with the Fire Chief , Larry
Fabbroni , Peter Lovi and himself on April 20th . Good
progress was made in looking at the potential contract and
agreement . He noted that they were moving ahead toward a
Joint Fire District with the City and Town and that he was
encouraged by the meeting . He expected , within the next
week , to receive a copy of the draft of their
® recommendations for the joint project. with the City and
Town .
Councilman Jennings went on to say that it seemed reasonable
to expect that the Town would need to consider building and
funding a fire station on South Hill . Special legislation
will need to be passed to allow a joint fire district with
the City . He stated that he would like to write a letter to
each Board member explaining the criteria of building a
station on South Hill ,
Councilman Jennings noted that youth employment will be
handled by the Human Services instead of the Youth Bureau ,
Councilman Kugler stated that he noticed there was
consideration to modernize the Tin Can ,
Councilman Jennings stated that he did not understand why
the City does not use Marcles Flat . He noted that the
County Youth Bureau has already moved to the Biggs Complex ,
Personnel Committee
Supervisor. Desch reported that the Personnel Committee had
met and the fruits of their labors are list as Item 11 on
tonights agenda .
REPORT OF COUNTY REPRESENTATIVES
County Representative Mary Call stated that her main topic
for the evening was the Summer Youth Employment and this
topic has already been covered .

Supervisor Desch asked the Representatives when the Public
Safety Committee would be discussing the proposed placement
of the jail in the area of the Biggs Complex ,
Both Beverly Livesay and Mary Call responded that they
haven ' t received the report .
PHASE I OF WATER & SEWER IMPROVEMENTS
Supervisor Desch stated that at some future date , the Board
should approve Stearns & Whelers report on water and sewer
improvements . He went on to say that it seemed sensible to
move forward and do the design in - house . The date of
January 1st seemed feasible to both Larry and myself .
Obviously , the cost to do the work in - house will be cheaper
than letting it out to consultants , except for the need to
purchase a Theodolite , which will allow two people to do the
survey instead of three or more .
Councilwoman Kiefer stated that in September , the Supervisor
handed out a list of priorities . She asked the Supervisor
which of the improvements on the May 1983 list were not on
the September 1982 list .

Supervisor Desch responded that he did not know .
Councilwoman Raffensperger noted that the Bundy Road area
was listed " C " before , now they have moved up on the list .
Supervisor Desch responded that he had moved Bundy Road up
the list because of the response from a petition being
circulated for West Haven Road , Elm Street and Bundy Road .
We should be able to extend the water line to Bundy Road in
® Phase II along with West Haven Road and Elm Street . He went
on to say that the situation on Snyder Hill is quite similar
to the problem with the main on West Hill ,
Councilman Kiefer stated that she thought the PRV on King . ,...
Road had a higher priority than Bundy Road ?
Supervisor Desch responded that there was enough money in
the package and that he was confident both projects could be
completed . We will put the figure in when we borrow the
money .
Councilwoman Kiefer asked how much will be saved by doing
the work in - house ?
Supervisor Desch responded , about 100 .
Councilwoman Kiefer asked if Bolton Point employees would be
involved in the project ?
Supervisor Desch responded , minimal involvement in
connection with the PRV on King Road and the Ridgecrest
Tank ,
The Supervisor went on to say that the sewer project would
be put together and bid all together .
Councilwoman Raffensperger asked Supervisor Desch if he was
looking for approval of the design or funding . She went on
to remind the Supervisor that we the Glenside area , who have
talked with us before .
Supervisor Desch responded that the situation in Glenside is
a little better . He stated that he was asking for
authorization to commit the staff to continue with the
design .

Councilwoman Kiefer asked how the Theodolite would be used
® in .- conjunction with the East Ithaca Transit ,
Supervisor Desch responded that the Theodolite is a modern
day transit surveying instrument which electronically
® measures distance .
Town Engineer Fabbroni also noted that it can also be used
if any future development comes along .
PURCHASE OF THEODOLITE
Town Engineer Fabbroni stated that the current Girley
Transit is a useful device , however , it is more kin to
working with a junky calculator . The modern day transit

will give a ranage of � 1 , 000 to 1 , 500 feet before you loose
the numbers . With the bear bones staff we have , two people
can operate the Theodolite . We expect to be able to do four
times the amount of work with the Theodolite than with the
Girley Transit . The staff has talked about a Theodolite for
two years , however , we were waiting for an opportunity to
justify the need for one . In the meantime , the prices have
lowered because more people are producing them . It took
three to four weeks to do the Coddington Road surveying , and
it could have been completed in one week with the new
® surveying equipment .
RESOLUTION N0 . _ 51
Motion by Councilman Cramer ; seconded by Councilman Kugler ,
WHEREAS , the Town Board has authorized the staff to proceed
with the design of the Phase I Water and Sewer Improvements
on an in - house basis , and
WHEREAS , the Town Board recognizes the need to coordinate
this work with the many other priorities already identified
as parks , highways , other public works objectives for the
current year , and
WHEREAS , a substantial portion of the in - house design
involves field work such as route alignment strip surveys ,
etc , and
WHEREAS , there is extensive field survey work associated
with the Burns Road realignment and the East Ithaca
Connector ,
NOW THEREFORE BE IT RESOLVED , that the Town Board hereby
authorizes the acquisition of a total station ( Theodolite
With EDM , attached or unibody ) with minimum specifications
as attached or equal at a cost not to exceed $ 8 , 400 to
enable the staff to accurately and effeciently accomplish
the field survey work on these projects with the folowing
allocation of costs :
a FRS Burns Road Project
a FRS East Ithaca Circulation Project
a Water Fund
a Sewer Fund

RESOLUTION NO , 52
Motion by Supervisor Desch ; seconded b Councilman lman Jennings ,
RESOLVED , that the Town Board of the Town of Ithaca hereby I
authorizes the staff to proceed with the design work for
Phase I of the Water and Sewer Improvements , including any
necessary field work , and
FURTHER BE IT RESOLVED , that the Town Board authorizes the
design work on Phase I of the Water and Sewer Improvements
with the understanding that there is no commitment to fund
or construct the project .

RESOLUTION NO . 53
Motion by Councilman Jennings ; seconded by Councilman
McPeak ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes a refund in the amount of $ 44 . 41 be paid to Frank
A . Signorelli , 916 East Shore Drive , Ithaca , New York , by
® reason of an overpayment on a Special Reading bill . Account
No . 175 - 0167644 , and
® FURTHER BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby authorizes a refund in the amount of $ 12 . 15 to
be paid to Scott Perra , 15 Hillcrest Drive , Ithaca , New
York , by reason of a mistake being made in the calculations
of the Special Reading bill of February 3 , 1983 . Account
No . 163 - 01118220

JOINT SCOPING SESSION ON SUBDIVISION REGULAITIONS
Proof of posting and publication notice of a Public Hearing
on a Joint Scoping Session on Subdivision Regulations having
been presented by the Town Clerk , the Supervisor opened the
public hearing .
Town Planner Peter Lovi stated that as lead agency , the Town
Board will prepare the Environmental Impact Statement . He
then distributed a model EIS Form . Also , a copy of letter
from Patrick M . Snyder , Associate Environmental Analyst , New
York State Department of Environmental Conservation , dated
April 25 , 1983 , and Joseph M . Powers , Regional Director ,
Region 3 , New York State Department of Transportation , dated
April 26 , 1983 . ( Copies attached to the gfficial minutes ) .
Mr . Lovi went on to say that most of the questions on the
Environmental Assessment Form , . dated February 14 , 1983 , were
on design and construction and , therefore , marked N / A .
Councilwoman Kiefer questioned Page 4 , number 29 of the
Subdivision Regulations , asking if there will be a map
showing rock depth ?
® Peter Lovi responded that there will be a list of the
environmentally sensitive areas .
® Councilwoman Kiefer questioned if the listing would be
included in Section 38 as well as Section 41 ? .
Mr . Lovi responded yes .
The Town Planner noted that Page 61 Section 53 , will not
allow future developers from getting off the hook in filling
out an EIS .
Town Engineer Fabbroni reported that Jon Andersson , Tompkins
County Health Department called today to report that he
would have no particular input in the scoping session .
No one from the public wished to speak , therefore , the
Supervisor declared the public hearing on the scoping
session closed . Stating that the Planning Board will
proceed with the draft Environmental Impact Statement with
regard to subidivison regulations and then sent them to the
Codes & Ordinance Committee for review .

Thank you for your letter of April 12 , 1983 concerning a scoping meeting
for the SEQR review of the proposed subdivision regulations . We have review -
ed the proposed regulations and the only environmental impacts that we can
envision at this time would be beneficial impacts . I doubt if anyone from
our department will be present at the meeting . However , if you have general
questions about SEQR in the future , we would be happy to be of assistance .

Re : Revision of Present Sub -
division Regulations
I wish to thank you for allowing us to review and comment on the proposed
revisions to the Subdivision Regulations for the Town of Ithaca . At this
time , we have no comments to offer and will not be attending the " scoping `
session on May 9 , 1983 •
As previously noted , we are interested in any new developments adjacent
to State highways which will access on the highway and/or will significantly
affect the highway usage and traffic patterns . We would appreciate being
informed early in the process when these developments are proposed .

Town . Board Minutes - 11 - May 9 , 1983
Councilwoman Kiefer asked anyone with concerns regarding
this issue could appear . before the Codes & Ordinance
Committee and express their concerns ?
Councilwoman Kiefer asked how a gnetic EIS can Be done
before the subdivision regulations are adopted ?
Supervisor . Desch responded that the zones have been set and
the map has been approved- after having had many public
hearings .
Councilwoman Kiefer stated that her reasons for concern was
that the final approval of zones has not been approved .
® Supervisor Desch responded that . many hearings have been
held , development of any type has been set , we are now
looking at the administrative angle .
Peter Grossman , Town Attorney , remarked that the subdivision
regulations have not been drawn in a vacuum .
Councilwoman Kiefer asked if the Zoning Map would be
attached to the EIS and will it be included in both ?
Supervisor Desch reponded , if you can describe in one
paragraph the difference .
Councilwoman Kiefer noted that some areas are fully
developed , so the map can be blanked out .
MULTI - USE RECREATIONAL AND PUBLIC WORKS CORRIDOR
Supervisor Desch stated that the agreement between the New
York State Office of Parks , Recreation , and Historic
Preservation , the City of Ithaca and the Town of Ithaca was
a very complex agreement . The Parks will buy the land and
the Town and City will provide the public works . The Town
being responsibe for the portion from Stone Quarry Road to
Buttermilk Falls .
Councilwoman Kiefer asked if the Master Plan would be
presented to the Town Board for adoption ?
Town Engineer Fabbroni responded that he expected the Board
would see the Master Plan at the end of this year or the
beginning of next year . He went on to say that the State ,
® intone of their meetings , agreed to the agreement worked out
with the City and Town staff . He noted that the State has
always been interested in building this bikeway . Private
easements had stopped them .
® Councilwoman Kiefer again said she did not understand the
Master Plan . Does it go to the Planning Board or the Town j
Board ?

Supervisor Desch responded that it probably would go the to
Parks Committee ,
Town Engineer Fabbroni added , the process could be very
involved or very simple . He noted that there will need to
be a rededication because of the drainage problems to the
City .
Councilwoman Raffensperger added , we will need to hold a
public hearing at the Town Board level .

Councilman Jennings stated that he noted the absence of any
kind of cooperation on liability insurance .
Supervisor Desch stated that the State of New York will own
the property . The Town and City will provide the use and
maintenance and the insurance will have to involve all
parties .
Councilman Jennings noted that most items were spelled out ,
the insurance wasn ' t and it seems important .
® Town Attorney Peter Grossman stated that he had only a
chance to look briefly at the Agreement , but he questioned
who would partrol ?
Supervisor Desch responded , the Sheriff Department or the
Park Police ,
Attorney Grossman stated that the Board might anticipate
difficulty in patrolling by private property because of
inaccessibility .
Supervisor Desch responded , that the Board might wish to
look at the Park Ordinance ,
Town Engineer Fabbroni suggested that the word control be
substituted for patrol in Section 16 ,
RESOLUTION NO , 54
Motion by Supervisor Desch ; seconded by Councilwoman
Raffensperger ,
WHEREAS , the Joint Development Project for a Multi -use
Recreational and Public Works Corridor at Ithaca , New York
( hereinafter called the CORRIDOR ) is a cooperative
development by the New York State Office of Parks ,
Recreation , and Historic Preservation ( PARKS ) , the City of
Ithaca ( the CITY ) , and the Town of Ithaca ( the TOWN ) , and
WHEREAS , said CORRIDOR is predicated on the concept that
joint development of certain lands in the CITY and TOWN ,
described generally as lying within the Ithaca Flood Control
Channel right - of -way and within the discontinued railroad
right - of -way of the Ithaca Branch of Consolidated Rail
Corporation , will complement and enhance the ability of
PARKS , the CITY and TOWN to provide recreation opportunities
® and public works improvements to Ithaca area residents and
visitors , and
WHEREAS , it is the intent of the parties hereto that the
® design , development , and use of such multi - use CORRIDOR be
unified and coordinated through continuing voluntary
tripartite consultation , plan view , and cooperation by the
parties without infringing on the autonomy of any of them ,
and

WHEREAS , each of the parties has interest in the use and
enjoyment of property within their respective legal
jurisdictions , including property severally owned by them or
to which they hold certain rights in and near the CORRIDOR ;
NOW THEREFORE, it is mutually understood and agreed to by
the parties hereto that :

1 . PARKS shall , without cost to the CITY or TOWN ,
acquire ownership of a discontinued portion of the
Consolidated Rail Corporation Ithaca Branch right - of -way
commencing at Milepost 304 . 32 ( Stone Quarry Road ) and
continuing to Milepost 306 ( Knights Crossing ) in the City
and Town of Ithaca .
2 . The CITY and / or the TOWN shall assist PARKS by
acquiring permission from owners of private property through
which the CORRIDOR passes , for access to such property by
® all parties for the purpose of developing and maintaining
the pedestrian / bicycle path , and for its continuing
recreational use by the public from the State Street bridge
® to Knights Crossing ,
3 . PARKS shall prepare a master plan for development
of a pedestrian and bicyle path within the CORRIDOR , to link
existing and proposed recreational facilities through or
adjacent to which the CORRIDOR passes , and providing the
opportunity for connecting spur - routes to residential areas
of the CITY and TOWN . The CITY and / or TOWN may add public
work . facilities to said master plan as deemed necessary ,
subject to the mutual agreement of the parties hereto .
4 . PARKS , CITY and TOWN shall make every reasonable
effort to coordinate the planning , design , and construction
of the initial recreational and public works improvements
within the CORRIDOR so that when completed , no major changes
in the character of the CORRIDOR may be expected for an
extended period , to allow the natural and planned
landscaping to become established and mature . Such planning
and design may be based on a phased program to implement the
various components , in accordance with the master plan , when
needed , or , as resources permit .
5 . When , and if , additional improvements within or
related to the CORRIDOR and its uses are determined to be
necessary , such improvements shall be made in accordance
with this memorandum as it may be amended by mutual
agreement between the parties hereto .
6 . In the event that other uses or facilities are
proposed for the CORRIDOR , other than those contemplated in
the master plan , such changes shall be subject to the mutual
agreement between the parties hereto .
7 . Where private property may be affected by such
development and use of the CORRIDOR to a greater extent than
® would be the case in the absence of this project , the
parties shall expend their best effort to notify and inform
owners of property within or adjacent to their separate
jurisdictions concerning the project and the safeguards
® which will be present to protect property . Such notice
shall be made in a timely manner prior to official adoption
of the master plan in order to permit property owners
adequate opportunity for comment on the proposed project.j
Such notice and comment period may be combined with any 1
environmental review or other public informational
procedures followed in planning and implementing the
project , as appropriate .
89 PARKS shall act as the lead agency in any
environmental review and evaluation of the pedestrian and
bicycle project required or conducted , and shall perform
such function at no cost to the CITY or TOWN . The CITY or
TOWN shall perform a similar function for any spur
extensions of the path , or for any public work facilities
related to the CORRIDOR .

9 . PARKS shall construct and landscape a pedestrian
and bicycle path within the CORRIDOR , in accordance with the
master plan ; providing a continuous link between its
facilities and Allan H . Treman State Marine_ Park and
Buttermilk Falls State Park . Such path shall incorporate
existing CITY bike paths within Cass Park . Where the path
requires extensions across CITY or TOWN lands in Cass Park
or along the Flood Channel , such construction shall be
accomplished without cost to the CITY or TOWN . The path
® shall , to the greatest extent possible , be separate from
existing vehicular traffic -ways .
10 . The CITY and TOWN shall use their best efforts to
provide connecting spur -routes serving residential areas
within their respective jurisdictions , in order to increase
recreational opportunities available to the public and to
promote fuller use and enjoyment of the major recreational
facilities served , for example , a spur - route on the
right - of -way between Buttermilk Falls State Park and South
Aurora Street . In the event such path is emplaced prior to
construction of any public -works - related improvements
comtemplated by the TOWN or CITY for this portion of the
CORRIDOR , the party responsible for construction of such
improvements shall be responsible for ensuring that the path
is protected from damage resulting from such construction ,
or is restored as necessary , and , such party shall provide
such insurance as may be required by PARKS against personal
injury or property damage associated with such construction
on PARKS lands within the CORRIDOR .
11 . The CITY and TOWN shall design and construct such
public works improvements in the corridor as they determine
necessary to protect and upgrade property within their
jurisdictions , subject to mutual agreement by the parties
hereto .
12 . The CITY and TOWN shall be responsible for normal
maintenance and repair of portions of the pedestrian / bicycle
path between Allan H . Treman State Marine Park and
Buttermilk Falls State Park , within their respective
municipal jurisdictions , and shall have unrestricted access
to any part of the CORRIDOR for such purpose . PARKS shall
be reponsible for major maintenance and repair of drainage
structures and bridges necessary thereto .
13 . Collection and removal of trash and rubbish shall
be the responsibility of the party normally responsible for
® maintenance of sections of the CORRIDOR within their
jurisdictions . Such routine maintenance shall be performed
frequently enough to keep the CORRIDOR and , more
particularly , the path free of unsightly - and potentially
® dangerous materials , and also shall serve to reassure the

owners of private property which the CORRIDOR crosses or
abuts that their interests ~ are being protected by the
parties to this agreement .
14 . The CITY and TOWN shall be responsible for
maintenance and repair of any public works facilities
constructed by them within the CORRIDOR , and shall have
unrestricted access to any part of the CORRIDOR for such
purpose .
15 . Emergency repairs to any of the improvements
constructed within the CORRIDOR shall be made by the party
having responsibility therefor in the most timely and
efficient manner necessary to protect the public and the
value of the improvement , and the costs of . such repairs
shall be paid by the party having responsibility , as
appropriate .

169 Routine police control of the CORRIDOR shall be
accomplished by the public safety - authorities normally .
acting within the respective jurisdictions ; emergency police
and fire service shall be provided in accordance with
existing service agreements .
17 . The parties reserve the right to control the
public ' s use of these sections of the CORRIDOR within their
respective jurisdictions as necessary and appropriate to
ensure user safety and enjoyment , and to safeguard the
® rights of the owners and residents of adjacent private
property . Where such controls might severely restrict
recreational use of the CORRIDOR or recreation facilities
which it serves , the parties shall consult in an attempt to
find ways to achieve a desirable degree of control without
negative effects on the intended public use .
18 . The parties hereto agree to meet annually to
review the progress of the project and program related to
the corridor .
FURTHER BE IT RESOLVED , that the Joint Development Project
for a Multi - Use Recreational and Public Works Corridor is
subject to review by the Town Attorney .

LISA LANE DEVELOPER ESCROW ACCOUNT
Town Engineer Fabbroni stated when the Planning Board
approved the Lisa Lane Subdivision , a stipulation of the
subdivision approval was that Sherry Place was to be
extended as a road off Lisa Lane and to be renamed Lisa
Place . The developer intended to sell lots . He - went on to
say that the Village of Cayuga Heights secured $ 7 , 00.0 for
their part of the road and he felt the Town should get
something also to insure the road being completed to the
Town ' s satisfaction . Mr . Fabbroni stated that John Barney
had suggested that the escrow agreement should give the Town
unlimited access to the money if the road is not finished by
September 15 , 1983 , and also the agreement would be much
stronger if Buyoucos , Barney , Grossman and Roth acted as
escrow agent .
RESOLUTION NO . 55
® Motion by Councilman Jennings ; seconded by Councilwoman
Kiefer ,
® WHEREAS , it is necessary to construct approximately 155 feet
of roadway within the Town of Ithaca known as Lisa Place
( formerly Sherry Place ) , and
WHEREAS , Lisa Place is principally being constructed to
serve six lots approved for development within the Village
of Cayuga Heights , and
WHEREAS , all nine lots previously developed within the Town
of Ithaca front on the apporved highway Lisa Lane , and
WHEREAS , the value of the work to be completed is
approximately $ 1 , 300 , and
WHEREAS , Ivar Jonson , developer , has agreed to deposit
$ 2 , 000 in a Cash Escrow Account in the name of " Buyoucos ,
Barney , Grossman & Roth Escrow Agents " for the immediate
draw on demand by the Town of Ithaca in the case of
non - performance by the developer , non -performance to be the

failure of the developer or his agents to complete by or
before September 15 , 1983 , construction of the roadway
extension in accordance and compliance with Town Highway
specifications as provided to the developer by the Town
Engineer ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the
Town of Ithaca accepts the terms . of the agreement calling
for the completion of the Town of Ithaca portion of Lisa
Place to Town Highway specifications by September 15 , 1983 ,
® and the creation of the Cash Escrow Account in the name . of
" Buyoucos , Barney , Grossman & Roth Escrow Agents " to insure
timely completion and be it
FURTHER BE IT RESOLVED , that an abstract of title covering
*the roadway which is the subject of this agreement be
.presented to the Town by July 8 , 1983 , and be it
FURTHER RESOLVED , that such abstract of title shall at
developer ' s cost be updated at developer ' s expense to the
date of recordation of the deed of the roadway for the Town
and upon such recordation such abstract shall become the
property of the Town , and be it
FURTHER RESOLVED , that in the event that the Town shall
incur expenses for construction , legal fees or any other
costs related to the extension of Lisa Place as described
above , such costs shall be recovered by the Town from the
Cash Escrow Account or as a charge added to the taxes for
this parcel or other parcels owned by Ivar Jonson ,
developer , within the Town of Ithaca , and be it
FURTHER RESOLVED , that since the highway to be constructed
is not necessary to serve as a public road for Town
properties already built , the Town Board will accept Lisa
Place and the deed thereto once the highway and the deed
have been accepted and approved by the Town Highway
Superintendent , Town Engineer and Town Attorney .

ASSISTANT BUDGET OFFICER POSITION
Councilman McPeak asked if the person filling the position
Of Assistant Budget Officer needed to be a resident of the
Town of Ithaca ?
Supervisor Desch answered , no .
® Councilwoman Raffensperger noted that the Agenda item for
the Personnel Committee listed the position as Supervisor ' s
Bookkeeper . How different is this position now from the
Comptroller position you discussed a few years ago ?
Supervisor Desch responded that a Comptroller would sign
checks , etc . , the position of Assistant Budget Officer will
not able to si
signatory . gn checks , only the Supervisor is
Councilwoman Raffensperger stated that she did not
understand management of administrative functions , please
explain this to the Board .

Supervisor Desch responded that he had a struggle in
deciding what to call the position . The person would be in
charge of day to day management of the finances , develop a
personnel manual . The administrative management of the Town
records is mandated to the Town Clerk , this person could
assist the Town Clerk ,
Councilman Jennings , in conjunction with the salary for the
new position , he remarked on the salaries of the Town Board
members which have not been raised for several years .

® Motion by Supervisor Desch ; seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the advertisement and hiring of a person to fill
the position of Assistant Budget Officer .

SEWER PROJECT BOND RESOLUTION
Supervisor Desch noted that the adoption of the Bond
Resolution was the last step in the process . Adopting the
Bond Resolution means the Town can go ahead and borrow the
money when the grant is approved .
At a Regular meeting of the Town Board of the Town of
Ithaca , Tompkins County , New York , held at 126 East Seneca
Street , in Ithaca , New York , in said Town , on May 9 , 1983 ,
at 5 : 30 o ' clock P . M . , Prevailing Time .

RESOLUTION NO . 57
A RESOLUTION AUTHORIZING THE ISSUANCE OF $ 15 , 395 , 810 SERIAL
BONDS OF THE TOWN OF ITHACA , TOMPKINS COUNTY , NEW YORK , TO
PAY THE 'TOWN OF ITHACA - ITHACA AREA WASTEWATER TREATMENT
IMPROVEMENT AREA ' S SHARE OF THE COST OF THE CONSTRUCTION OF
THE ITHACA AREA WASTEWATER TREATMENT PLANT PROJECT FOR THE
TOWN OF ITHACA . - ITHACA AREA WASTEWATER PLANT IMPROVEMENT
AREA OF SAID TOWN .
WHEREAS , by proceedings heretofore duly had and taken , the
Town Board of the Town of Ithaca , Tompkins County , New York ,
has established the Town of Ithaca - Ithaca Area Wastewater
Treatment Plant Improvement Area , pursuant to the provisions
of Article 12 - C of the Town Law and more particularly an
order dated July 26 , 1982 , and has authorized the providing I

of a wastewater treatment system to be constructed and owned
jointly by the City of Ithaca , the Town of Dryden and the
Town of Ithaca , pursuant to an intermunicipal agreement
heretofore entered into pusuant to the provisions of Article
5 - G of the General Municipal Law ;

WHEREAS , it is now desired to authorize the issuance by the
Town of Ithaca of its serial bonds to pay said Town of
Ithaca - Ithaca Area Wastewater Treatment Improvement Area ' s
share of the cost of said joint project , NOW , THEREFORE ,
® BE IT RESOLVED , by the Town Board of the Town of Ithaca ,
Tompkins County , New York , as follows :
® Section 1 . For the specific object or purpose of paying the
Town of Ithaca - Ithaca Area Wastewater Treatment
Improvement Area ' s share of the cost of the construction of
a new 10 , 000 , 000 gallon per day activated sludge treatment
plant to achieve secondary treatment and phosphorous
removal , primary and secondary settling tanks , aeration
basins , phosphorous stripper tanks , septic storage tanks ,
gravity thickeners , primary and secondary digestors , sludge
dewatering equipment , a new administration building and
chlorine building , approximately 6 , 300 feet of 48 and
36 - inch outfall sewer and 20 6 - inch ports , and improvements
incidential thereto , and original furnishings , equipment ,
machinery and apparatus , and appurtenant facilities required
in connection therewith , including any necessary
acquisitions in land and rights in land together with
certain additional incidental expenses occasioned by reason
of the intermunicipal agreement heretofore entered into
pursuant to the provisions of Article 5 - G of the General .
Municipal Law providing for the construction and ownership
of the aforedescribed wastewater treatment system by the
City of Ithaca , the Town of Dryden and the Town of Ithaca ,
on behalf of the Town of Ithaca - Improvement Area
Wastewater Treatment Plant Improvement Area , including
payment to the City of Ithaca for certain STEP II design
costs , payment to the City of Ithaca for the acquisition of
certain rights in land currently owned by City and payment
of certain ineligible costs , there are hereby authorized to
be issued $ 15 , 395 , 810 serial bonds , of the Town of Ithaca ,
Tompkins County , New York , pursuant to the provisions of the
Local Fianance Law ,
Section 2 . The maximum estimated cost of the aforesaid
specific object or purpose is hereby determined to be
$ 36 , 461 , 094 , and the plan for the financing thereof is as
® follows :
a ) By the issuance of the aforesaid $ 15 , 395 , 810 serial
® bonds of the Town of Ithaca , Tompkins County , New York ;
provided , however , that the amount of such serial bonds
ultimately to be issued shall be reduced by the amount of
any Federal and / or State grant ' s in aid received by the Town
of Ithaca for such improvement ;
b ) By the. expenditure of $ 20 , 680 , 200 by the City of
Ithaca , Tompkins County , New York ; and
c ) By the expenditure of $ 385 , 084 by the Town of
Dryden , Tompkins County , New York ,
Section 3 . It is hereby determined that the period of
probable usefulness of the aforesaid specific object or
purpose is forty years , pursuant to subdivision 4 of
paragraph a of Section 11 . 00 of the Local Finance Law . It
is hereby further determined that the maximum maturity of
the serial bonds herein authorized will exceed five years .

Section 4 . Subject to the provisions of the Local Finance
Law , the power to authorize the issuance of and to sell bond
anticipation notes in anticipation of the issuance and sale
of the serial bonds herein authorized , including renewals of
such notes , is hereby delegated to the Supervisor , the chief
fiscal officer . Such notes shall be of such terms , form and
contents , and shall be sold in such manner , as may be
prescribed by said Supervisor , consistent with the
provisions of the Local Finance Law .
® Section 5 . The faith and credit of said Town of Ithaca ,
Tompkins County , New York , are hereby irrevocably pledged to
the payment of the principal of and interest on such bonds
as the same respectively become due and payable . To the
extent monies are not available from sewer rents collected
for the aforedescribed improvement , there shall be annually
apportioned and assessed upon the several lots and parcels
of land within said Town of Ithaca - Ithaca Area Wastewater
Treatment Improvement Area which the Town Board shall
determine and specify to be especially benefited by the
improvement , an amount sufficient to pay the principal and
interest on said bonds as the same become due , but if not
paid from such source , all the taxable real property in said
Town shall be subject to the levy of ad valorem taxes
without limitation as to rate or amount sufficient to pay
the principal of and interest on said bonds as the same
shall become due .
Section 6 . The validity of such bonds and bond anticipation
notes may be contested only if :
1 ) Such obligations are authorized for an object or
purpose for which said Town is not authorized to expend
money , or
2 ) The provisions of law which should be complied with
at the date of publication of this , resolution are not
substantially complied with ,
and an action , suit or proceeding contesting such validity
is commenced within twenty day after the date of such
publication or
3 ) Such obligations are authorized in violation of the
provisions of the Constitution .
Section 7 . This resolution , which shall take effect
immediately shall be published in full in the Ithaca
Journal , the official newspaper , together with a notice of
the Town Clerk in substantiall the form - - -
Y provided in Section
81 . 00 of the Local Finance Law .
® The question of the adoption of the foregoing resolution was
duly put to a vote on roll call which resulted as follows :

OLD HOSPITAL COMPLEX
Councilwoman Kiefer stated that she would like to introduce ,
to the Board , the following resolution . She went on to say
that she had received many comments against the move and the
resolution is in response to these comments .
WHEREAS , the Town of Ithaca , with a population of 16 , 022 , is
the largest Town in Tompkins County , and
® WHEREAS , the City of Ithaca serves well as the geographic
focus of the Town of Ithaca , and
WHEREAS , it is the responsibility of the Town Board of the
® Town of Ithaca to be concerned about the health and welfare
of the Town ' s residents ,
THEREFORE , BE IT RESOLVED that the Town Board of the Town of
Ithaca recommends against moving the County Social Services
Agencies away from the City of Ithac to the old hospital
complex in the northwest . portion of the County , as not being
in the best interests of the majority of Town residents .
Supervisor Desch questioned what was ment by the statement
that Ithaca serves well as the geographic focus of the Town
of Ithaca ?
Councilwoman Kiefer responded that the City of Ithaca was .
the geographic center of . the County . The Ithaca Town Hall
is here , isn ' t it .
Town Engineer Fabbroni questioned if the Town wanted to
inject themselves in this complicated subject when public
transportation can get people out to this area .
Supervisor Desch asked Councilwoman Kiefer where the
comments had originated ?
Councilwoman Kiefer responded that she had received comments
against the move from people she came in contact with at
public gatherings , meetings and also it was common grocery
store talk .
Councilman Jennings noted that the Youth Bureau had not been
hurt by the move to the old hospital complex .
Councilwoman Raffensperger stated that the Board had decided
previously , to wait until the Blue Ribbon Committee of the
® County made a recommendation before the Town Board made a
recommendation .
Supervisor Desch stated that he was having a problem getting
® involved with County problems . We need to know commitment ,
by the County , to provide more bus service and more pick up
points before making a decision .
Town Engineer Fabbroni stated that he felt the problem of
moving services was something the City and County could work
out by themselves .
Councilwoman Raffensperger responded that the Town also has
people involved who need to be protected .
Supervisor Desch suggested that a box advertisement could be
put in the Ithaca Journal asking for input from Town
residents .

Motion by Supervisor Desch ; seconded by Councilman Kugler ,
Town Board Minutes - 21 - May 9 , 1983
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the placement of a box advertisement in the
Ithaca Journal requesting Town residents input into the
moving of County services to the old hospital complex , and
BE IT RESOLVED , that the box advertisement mention the
moving of the Office of the Aging plus Social Services , and
FURTHER BE IT RESOLVED , that any action , by the Town Board , V
on the proposed resolution be tabled until the June 13 , 1983
