Town Board Minutes - 4 - January 10 , 1983
Representative Call responded yes , the County Board understands .
, However , the issue will still go to the Planning and Public Works
committe first , then back to the County Board ,
PERSONS TO BE HEARD
George Maylin and Charlote Brahm , owners of the property at 676
Coddington Road asked the Board fora refund on the water and sewer
benefit charges . Mr . Maylin stated that of the total acreage , 11
acres cannot be developed . Also , because there is a NYSEG
® right- of -way through the property .
Supervisor Desch advised Mr . Maylin to pay his taxes in full , so
® that there would be no penalty , then write a letter to the Town
Board stating his reasons for requesting the refund , the Board
would then consider the matter after the engineering staff had a
chance to . examine the units charged .
PUBLIC WORKS COMMITTE REPORT
Councilwoman Raffensperger , Chairman of the 1982 Public Works
Committee , handed in the Annual Report and asked Borad members to
read it over and consider the recommendations for 1983 contained in
it with respect to the 1983 Committee designations and work plans .
TOWN ENGINEER ' S ANNUAL REPORT
Supervisor Desch noted that Town Engineer Larry Fabbroni was on
vacation , and that the Planner , Peter Lovi , was absent ; therefore ,
he suggested that the Town Board . read through the list of items and
asked for discussion .
Mass Transit
Councilman Cramer asked if the Village of Lansing was considering
expanding the bus service to include the new YMCA ?
Both Supervior Desch and Councilwoman Raffensperger answered yes .
Councilman McPeak asked about a young peoples rate ?
Councilwoman Raffensperger responded that there has been discussion
on the possibility of a discount ticket book with cut rates at off
hours .
Water and Sewer
Supervisor Desch asked the Board to think about putting together a
® . package of water and sewer upgradings . He noted that need to
replace the sewer and water lines to the hospital , stating that if I
the design documents were ready , we might find ourselves in line
for a federal grant .
Councilwoman Raffensperger questioned infra - structure repairs with
the Town / County / Hospital ?
Supervisor Desch responded , joint funding would be alright to look
into , if we are not opening a further Pandora ' s box .
Supervisor Desch stated that he had already talked to Frank Liguori
and Larry Fabbroni . Mr . Liguori felt that the application for a
federal grant would need to emphasize a strong position that
hundreds of jobs would be added .

Solid Waste
Councilwoman Kiefer asked if the Multi - County Solid Waste Committee
had discussed the septage and landfill questions ?
Councilman Kugler responsed that no information had come his way .
Representative Call added that it appears land fill is it for now .
Frank Liguori as much as said so .
Councilwoman Kiefer asked if the Multi - County Committee was to meet
again ?
Neither Supervisor Desch nor Councilman Kugler knew ,
Representative Call said she would check .
® Transportation
Councilwoman Raffensperger reported that the Parks and Open Space
Committee plans to take the old Bikeway Plan , go over it and come
up with a new revised plan .
Representative Call asked about the One -Way Traffic Plan for Forest
Home .
Supervisor Desch stated that one -way was being considered going
north down Caldwell Road by the filter plant and one way up Judd
Fails Road . If the one - way plan is feasible , it would be tried for
six month to a year . The Forest Home Association is now studying
the plan and will make their recommendations ,
Further discussion took place on the list of ongoing projects ,
including sewer system repairs in accordance with the SSES , East
Ithaca Circulation , statutory traffic ordinance , etc .
SPECIFICATIONS - FOUR WHEEL DRIVE TRUCK WITH SNOW PLOW
Supervisor Desch stated that this item would be considered at the
Janury 24th or February 7th meeting , as the Highway Superintendent
and Town Engineer have not reviewed the specifications .
Councilman Cramer asked if we must specify " Cummins engine " ?
Superintendent Parkin said yes , so that parts would be
interchangeable .
Councilman McPeak asked if we could specify ' U . S . Made " ?
Supervisor Desch said that is not permissible .
Councilman Jennings asked why specify axles as " manufacturers own "
when there are about three who specialize in such axles ?
Councilman . Cramer asked the Highway Superintendent why the
specifications call for a genuine four -wheel drive ?
Superintendent Parkin responded that with a geniune four -wheel
drive , you turn on a
not work this way , switch and all wheels work , other designs do
Councilman Jennings asked
" if there was any . way to change the word
genuine " to another word . He felt the work genuine causes
confusion .
Supervisor Desch asked Councilman Jennings and Councilman Kugler ,
along with Highway Superintendent Robert Parkin and Town Engineer
. Larry Fabbroni , to check the County Highway Department vehicles and
take a ride . so that they are familiar with the various . types of
trucks and to refine the specifications as appropriate .

ANNUAL REPORT
Supervisor ' s Report
Supervisor Desch reported that the Town Board would be reviewing ,
in some detail , the progress made on the 1982 objectives later in
the meeting , but there were several comments that he would like to
make with reference to the activities of the past year .
Our staff brought the new computer on line with exceptional speed
and minimal trauma early in the year and the heavy use attests to
our success , not only in the area of word processing but budget and
financial report preparation . . During the coming year we will no
doubt find yet undiscovered uses for the data base management
system , including in particular the tracking of the myriad of
® statistical data such as benefit units , building permits , licenses
of var_ i. ous kinds , also as we draft new legislation and regulations i
our ability to process changes , incorporate new concepts ,
feed back to various boards , users , etc . , has already been provide
®
enhanced ,
The Sewer Plant Financial Plan approval was a massive
administrative task which even with the word processor required
extensive staff research . The record breaking approval response by
the State Comptroller , two weeks instead of six months , attests to
the effectiveness of our staff effort and should give us a leg up
on consideration of our project for the $ 31 , 5001000 State and
Federal Grant . However , the price we paid was not getting the new
Zoning Law adopted . In July and August there was a conscious
decision to invest legal time in the Wastewater Treatment Plant
application rather then the Zoning Ordinance . This was a

assessment that we had to make . and the Supervisor stated at the
was sure it was a proper assessment .

Mr . Desch went on to say that July 1 , 1983 has now been set as the
target date for adoption of the new Zoning Law . He stated that he
has already directed the staff to input the current draft into the
word processor so that any changes can be processed quickly and
effectively .
Keeping the tax increase down to 2 . 19 % for 1983 without
compromising our major programs in the areas of highways , water ,
sewer , parks , administration , etc . , is the paramount accomplishment
and one of which the Town Board should be very proud . Program
investments made during the past several years are helping us avoid
the severe deferred maintenance problems being experienced by other
communities .
® Carrying over from last year is the need. to settle fire station
locations and protection costs .
Finally , there is one seemingly small accomplishment that is
Particularly noteworthy in the spectrum of the overall work of the
Town and that is the extension of the water line approximately one
mile or. Coddington Road . This project was accomplished on
schedule , below budget and involved a very rapid response by the
Town to a very critical need . In most other Towns , the process of
forming districts , etc . , would have meant at least the delay of one
year in the project , something that would have been intolerable to
these residents and property owners who were experiencing failed or
contaminated private water supplies . Moreover , this project was
accomplished without any borrowing ,
Now , he stated that he would like to call the Board ' s attention to
several other matters not specifically referenced on the agenda .
( 1 ) Appointment of the official delegate to the Association of
Towns meeting . As the first resolution of 1983 , he , therefore ,

Motion by Supervisor Desch ; seconded by Councilman Cramer , �
RESOLVED , that the Town Board of the Town of Ithaca hereby appoints
the Town Supervisor as the official delegate of the Town of Ithaca
at the 50th Annual Meeting of the Association of Towns ,
( Desch , Kugler , Cramer , Raffensperger , McPeak , Kiefer and Jennings
voting Aye . Nays - none ) .
( 2 ) Supervisor Desch went on to say that the Town Board members
have the revised draft of the contract with the SPCA for Do
Control services for 1983 , There are no substantive changes from
1982 in service or cost , The Town in 1983 will need to make
arrangements for the bi - annual enumeration . He asked the Board to
kindly review this so we can consider adoption later in the
meeting ,
( 3 ) There are a number of matters that suggest the need to adjourn
this meeting until January 24 . For example , we have the King Road
zoning matter , the parking restriction in Fire Lanes , the Public
Officers Local Law that he wished to keep pushing forword with , so
he asked the Board to think about their schedules to see what the
best time for an adjourned session would be .

Finally , a brief comment on the Commonland decision . It continues
to be clear to me that we have a very competent and dedicated
planning and legal staff and Planning Board . Our policy of
assuring proper support , authority and resources to these Boards
and staff and avoiding then temptation to interfere with their
activities is critical to the broad success of our planning
process . As we start the New Year , it is particularly appropriate
to express our appreciation for the dedicated service they provide
the people of the Town .
® Councilwoman Raffensperger asken when , now that the judge had
rendered a decision , the Planning Board would again take up
Commonland ?
® Supervisor Desch said that the Planning Board ' s January

meeting has consideration and final approval on the agenda .
ANNUAL REPORT OF TOWN HIGHWAY SUPERINTENDENT
Highway Superintendent Robert Parkin presented his annual report
for the year 1982 ( copy attached to official minutes ) . He then
highlighted parts of his report , noting that there was a 9 %
reduction.,,- in. the amount salt used during 1981 , due to the mild
winter plus t_s the effort to reduce the amount of salt used , whenever ""
possible . Total amount of miles of roads paved was down from 1981 ,
while surface treated with oil and stone is up slightly . Road
mileage and number remain the same as 1981 , 39 . 76 miles of roads
and 111 roads .
He went on to say that the gallons of oil used for paving and
surface treatment was less than in 1981 , because in 1981 the
bikeways paths were treated , also 4 mile more road surface was
treated . Mr . Parkin noted that there was a big jump in the amount
of crushed limestone purchased , limestone was used extensively on
Valley View Road and the bikeways . The amount of culvert pipe
installed , both on Town roads and for private residents , is up
slightly from last year . The amount of gasoline and diesel fuel
used remains fairly close to the amount consumed in 1981 . Overtime
hours were lower than 1981 , due to the mild weather . The amount of
money received from Tompkins County for snow plowing increased only
$ 60 . 60 from 1981 .
Superintendent Parkin reported that equipment repair costs remained
stable on most of the equipment . The exceptions being $ 4 , 577 . 16 to
replace two differentials on the 1973 Brockway truck , $ 2 , 267 . 94 for
a clutch on the 1971 Ford L - 8000Truck , $ 1 , 401 . 25 for pins and
bushings on the 1978 CAT 930 Loader and $ 1 , 008 . 93 for a clutch on
the 1974 Case Backhoe . * He went on to report that the vehicle miles
were up about 13 , 000 , however , the total hours remained close to
average . He noted that the mileage was up on all equipment .
REPORT OF COUNTY BOARD OF REPRESENTATIVES
Representative Mary Call reported that Harris Dates had been
reelected Chairman of the Board of Representatives . The committee
assignments for the coming year have not been set up yet . She went
on to say the Biggs Complex discussions had been put on hold for
the holidays . Chairman Dates had received the Town ' s letter on the
East Ithaca Connector and the letter has been referred to the
Planning and Public Works Committee ,
Councilwoman Kiefer asked if the County Board understood that the
Town Board wants the County Boards comments , not Planning & Public
Works , and not the Planning Commissioner ?

Councilwoman Raffensperger asked if there were any vendors in
Tompkins County ?
Mr . Parkin answered no , the closest vendor is in Horseheads .
SPCA CONTRACT
Supervisor Desch stated that the Town would soon be doing an
enumeration . The Town Clerk was checking into parties who would be
® interested . He went on to say that the Town has the financing and
would be able to . finance an excellent enumeration .
Councilwoman Kiefer asked who set the hours for patrolling ?
® Supervisor Desch responded that the SPCA set their own hours .
RESOLUTION NO , 2
Motion by Supervisor Desch ; seconded by Councilman Jennings ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the Supervisor to execute the 1983 Dog Contract with the
Tompkins County SPCA , including the : addendum attached , wherein the
Town of Ithaca will retain $ 2 . 00 per dog license fee .
( Desch , Kugler , Raffensperger , Cramer , McPeak , Kiefer and Jennings
voting Aye . Nays - none ) .
Councilwoman Raffensperger asked about procedure Town residents
should follow when dog dies . It was explained that on the back
side of the copy of the license there are instructions about whom
to notify . Councilwoman Raffensperger suggested putting the
information into the Town Newsletter , perhaps yearly .
PUBLIC HEARING - DEFENSE OF PUBLIC OFFICERS
Proof of posting and publication notice of a Public Hearing to
consider a local law on the Defense of Public Officer having been
presented by the Town Clerk , the Supervisor ops ened the Public
Hearing ,
Town Attorney James Buyoucos stated that he has made some changes
already in the proposed local law and he plans on making more
changes .

3 . If there is a conflict which prevents the Town Attorney from
acting on behalf of the Town , an outside attorney will be hired .
An outside attorney would be an independent contractor and ,
therfore , is not covered under the policy , however , any attorney
before he takes a case would make sure he was covered by his own
insurance .
4 . There is exclusion in the policy for dishonesty . The insurance
company stated the it was not in a position to interpret
dishonesty .
5 . With respect to punitive damages ( in civil rights cases ) the
Insurance Company policy remains silent , however , New York State
Law says punitive damages are not insurable .
® 6 . With respect to cancellation or non - renewal of the
Town has the option of policy , the
P purchasing a 12 month extension period for a
20o additional premium , ( approximately $ 600 ) ; this would cover the
Town . while a new policy is sought . Mr . Buyoucos advised the Board
to take the 20 % option .
Councilwoman Kiefer asked how will you know which cases will be
covered by insurance ?
AvIr . Buyoucos answered , a letter will have to be sent to the
Insurance Company , each time , asking them if they will cover and
defend the case .
Attorney Buyoucos stated he will have a revised draft for the Town
Board next week .

REFUND - OVERPAYMENT OF WATER BILL

Motion by Supervisor Desch ; seconded by Councilman Kugler ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes a refund in the amount of $ 45 . 16 to be paid to Hasan
Padansee , 103 Skyvue Road , Ithaca' , New York , by reason that a
Special Reading was taken on November 22 , 1982 , after the December
bills were processed . The computer bill was mailed to the old
owner and forwarded by the Post Office . The new owner paid the
Special Reading Bill instead of forwarding it to the old owner .
The old owner paid the computer bill also . Account No .

REPORT OF CODES & ORDINANCE COMMITTEE
Councilman Cramer , Chairman , reported that the draft ordinance on
regulating parking in fire lanes has been received from the Town
Planner and will be distributed to the committee this week . A
committee meeting has been scheduled for January 24th .
Association of Towns Meeting
There are proposals to be voted on ; the Town Clerk will make copies
and distribute them for future discussion .

TOWN ATTORNEY REPORT
® Town Attorney James Buyoucos stated that on Friday , he attended the
Land Institute Seminar in Albany . He noted that quite a few state
persons were in attendance . Mr . Buyoucos stated that he brought up
the problem of the Open Meetings Law and the pressures it has
® created on planning boards , town boards and zoning boards of
appeals and how it hampers frank discussion . He stated that he did
not understand why the Association of Towns does not address this
problem . He went on to say that the public is not benign public ,
some are competitors and the possibilities of law suits are rising .
The la�� was passed to keep the public informed , now the law is
being used beyond the purpose of the law . Most attorneys . agree
something must be done .
Supervisor Desch asked if there was any activity through the
Municipal Attorney group to take action on the Open Meeting Law
problem ?
Mr . Buyoucos answered no , no one can take the time . The
Association of Towns has the time .
Councilwoman Raffensperger asked if the subject was ever on the
T '= " y ' s Agenda at the Association of Towns ?

Planning and Zoning meetings , when I attend the Association of
Towns meeting .
Supervisor Desch asked Councilwoman Kiefer if she had attended this
seminar ?
Councilwoman Kiefer answered " no " that Peter Lovi had not contacted
her , she asked for a report on the seminar from Mr . Lovi at the
next meeting .
® Attorney Buyoucos offered to report . He . said SEQR is a maturing
law and experience with it is changing . There are three sets of
actors : DEC , the Department of State interpretations , and the
® specialists who big cases and projects . It is hard to say where
the law is now - - is it only to look at small points , but the
project goes forward ?
Councilwoman Raffensperger asked if that means there are now
project which can ' t go forward , what does " intregity " mean ?
Councilwoman Kiefer suggests it just means " to make less mad . "
Attorney Buyoucos concurs .

® LAty1PRICIDE CONTROL
Councilwoman Kiefer question if the Bolton Point staff had met and
discussed their comments on lampricide control ?
® Supervisor Desch stated that the staff had met and discussed the
lampricide issue . He referred to a letter from Jon Anderson
( Tompkins County Health Department ) which incorporates staff
concurrence . They have been in contact with the authorities in
Watkins Glen . There is no evidence of any contaminates in the
water at the intake at Watkins Glen , The Commission has gone on
record that DEC must provide sufficient levels of monitoring at the
Bolton. Point intake . At Seneca Lake , DEC notified people with
private water supplies before chemicals were added to the lake . It
is DEC ' s responsibility to notify the people around Cayuga Lake .
Councilwoman Kiefer asked if Bolton Point used a charcoal filter ?
Supervisor Desch responded , yes plus a sand filter .
Councilwoman Kiefer asked which chemical was used in Seneca Lake ?
Supervisor Desch responded the same as is proposed for use in
Salmon Creek ,
Councilwoman Kiefer noted that the results of the Cornell Study
will not be ready for several months .
RECORDS
Councilwoman Kiefer noted that she had an article from the Canadian
Public Archives on the deacidification process invented by Dr .
Richard D . Smith . Books can be restored to their youthful vigour
for a cost of about $ 4 . 00 . She felt the Town , at sometime , might
be interested , and asked that the Town Historian be alerted to this
way of preserving records .
