REPORT OF TOWN OFFICIALS
SUPERVISOR ' S REPORT
Supervisor Desch reported that there have been a number of major
developments of interest: to the Town since our last meeting .
The visit of the State Fire expert , Mr . Proper , and the Saturday
morning discussions on February 20th were very productive .
Although the findings have not been forwarded to us yet , in
w).- iting , it is quite evident that better coverage is critically
needed in South Hill and West Hill areas of the Town . The
criteria involves a three minute response , fire hall to site .
Although the current state legislation makes it very difficult ,
if not impossible , to put together a joint package with the City ,
it still may make sense from a taxpayers cost standpoint to do
so . It is fortunate that we have saved at least one year in _
achieving the stage we how have attained . We can go from here
with solid planning criteria with the City. . Our planning staff ,
Planning Board and Public Safety_ Committee have and will be
involved .
Town Board Minutes - 2 - March 8 , 1982
The Special Joint Subcommittee had its first meeting on February
15th , and began the process of identifying the tasks to be
accomplished , leading up to the Step III construction. . There
may be a possibility of getting construction of the outfall under
way t. It, year . This has the advantage of accomplishing significant
work prior to the end of the debt exclusion period and possibly
insuring maximum federal and state funding for an identifiable
major segment .
Renewed discussions are underway with the County concerning
arrangements for the treatment of septage at • the new plant .
I was appointed Chairman of the Committee and I look forward to
a great deal of productivity from what will prove to be a hard
working committee .
Last year we started the program to replace " Welcome to the Town
of Ithaca " signs . We did the ones on State roads coming into
the Town . There are nine left to be done on County Roads as
follows : Ellis Hollow Road , Coddington Road , Snyder Hill Road ,
Troy Road , Bostwick Road , Bundy Road , Hayts Road and DuBois Road .
This is a budgetary item so no formal resolution is necessary ,
so this is for your information .
I attended a Community Leaders breakfast , sponsored by the banks
this morning . . This is a gathering of City , Town , Ithaca College ,
Cornell University and industrial leaders to discuss items of
mutual interest and share ideas for the future . Subjects
discussed included Route 96 , volunteer firemen , student aid ,
the future of Challenge Industries , health care costs and the
East Ithaca Connector ,
Our IBM display writer system is here and training sessions are
underway . I find the staff all very enthusiastic about learning
the use of the new system .
Discussions with the Town legal staff continue on the matter of
a local law for indemnification of public officers and I expect
we will be in a position to have a . public hearing on the matter
in the next .. two to three months . I expect to be able to recommend
to you the addition of the errors and omissions insurance we
discussed last month , early in the fall when we know our current
years fiscal condition .
We filed the Supervisor ' s Annual Report on time . - March lst .
This is the detailed fiscal . report of revenues and expenditures
of the Town last year . You are welcome to look at it at your
leisure in the Town Hall , but I hope you will not ask for a copy
for it is voluminous . All major accounts had positive balances
so that our appropriation for unexpended balances for use in 1982
budget was sound . We are well within the total fund balances
available .
The comparable report for the Commission was also filed .
TOWN ENGINEER ' S REPORT
Tom Engineer Lawrence Fabbroni stated that in the last month ,
over 8 , 000 passengers were carried on the Northeast and East
Ithaca Transit systems . He also stated that the committee was
in the process of adding one hour , at night , to the Northeast
Transit schedule , as the one weakness in the system was
that it :'was 45 minutes too early .
"The paper work is being completed for the Safer - Off System :
Plans are being prepared along with cost estimates for recen -
struction . of Stone Quarry Road .

He went on to say that the Park Committee and the Codes and
Ordinance Committee was working on the Park Ordinance . Also ,
subdivision regulations are under going further study .
There is nothing new to report on the flood work . We may have
an opportunity for help , through the Army Reserve Heavy
Equipment Service .
Councilwoman Raffensperger asked , am I right in assuming any
change in rate on transit will come to the Board ?
Town Engineer Fabbroni answered , if you are asking about
Northeast Transit , the Planners came up with the budget . The
contract was written , the fare structure was not discussed .
A substantial change would go to the public , however , this was
not considered a substantial. change .
. Councilwoman Raffensperger stated that she had no problem. wi_ th
the 40 � fare . However , she felt that as no one participant was
subsidizing the project , therefore , no one participant has the
right to set the fare .
Mr . Fabbroni answered , it the fare increase had been substantial
then Cornell and this Board would have been involved .
Councilwoman Raffensperger stated that at the time the transit
system was initiated , the Town Board felt it had the right to
participate in all fare settings .
HIGHWAY SUPERINTENDENT ' S REPORT
Highway Superintendent Robert Parkin noted that the department '
has been doing . a lot of cindering and plowing lately . Also
hauling salt and. sand for stockpiling .
Removing of ice to keep the ditches open and thawing of culverts .
Also some . patching of holes during warm days .
The Highway Superintendent went on to report that Charles Caywood
is retiring after 18 years of service -to the Town . Mr . Caywood
is asking for four weeks paid vacation . Mr . Caywood ' s official
:� ¢� tirement was February 10 , 1982 , however , Mr . Parkin stated
that he intended to keep Mr . Caywood working until he reaches
the maximum allowed under Social Security or the New York State
Retirement system . He should reach this point about mid - April
or the first part of May .
The Highway Superintendent stated that he was looking for a
replacement for Mr . Caywood . He recommended that Charles
Hurlburt , now in a laborer classification , be reclassified
to Motor Operator and replace Mr . Caywood . , He then recommended
that he be allowed to find a person to fill the vacancy in the
laborer classification with a salary range of from $ 4 . 50 to
$ 6 . 00 .
RESOLUTION NO . 32
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
approved the promotion of Charles Hurlburt to Motor Equipment
Operator at a salary of $ 7 . 90 per hour , effective upon the
date of Charles Caywood ' s retirement .

RESOLUTION N0 , 33
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
approves the :Miring of a person to fill the Laborer Classification
position at a salary range of from $ 4 . 50 to $ 6 . 00 per hour
effective on the date of the transfer of Mr . , Charles Hurlburt
from this position to the position of Motor Equipment Operator .

voting Aye . Nays - none ) .
TOWN ATTORNEY ' S REPORT
Town Attorney James V . Buyoucos reported that he had met with
the Planning Board to discuss the adoption of their proposed
By - Laws . He has also made suggestions to be discussed on the
subdivision regulations which will be submitted to the Town
Board for approval .
He went on to say that the Planning Board has no more power than
Section 27 of Town Law permits , along with any powers granted it
by the Town Board . The By - Laws are largely procedural , in strict
accord with the law . He noted that he would be meeting with
Edward Mazza sometime next month .
COUNTY BOARD OF REPRESENTATIVES
Gust Freeman remarked to Town Engineer Fabbroni that it was his
understanding; that Mr . Fabbroni and County Planner Frank Liguori
were working with the Soil Conservation on the flood damage . Was
there more damage than SCS expected ?
Supervisor Desch answered yes . Damage was from Flat Rock clown
several hundred feet . The present road is very vulnerable to
further flood damage .
Mr . Freeman noted that the Hospital Use Committee today gave
Dr . I-lunchmeyer approval to proceed with his planned office
building . The Doctors will be required to put in a new sewer
line to the Towns specifications .
The County Representative stated that he was interested in the
fire response time for West Hill . He asked if there was any .:
decision yet on putting a fire station on County land ?
Supervisor Desch answered no , we are waiting for the report and
in the process of scheduling site planning sessions with the City.
Mr . Freeman noted that somebody is interested in all the land
and suggested that if the Town was interested in land for a.
fire station they should let someone at the County know .
Councilman Jennings asked the Highway Superintendent about the
use of more cinders . He questioned if the same road were being
covered twice ?
The Highway Superintendent stated that the truck were being
loaded differently . For instance , clear salt for Stone Quarry
Road was loaded first then the salt and cinder mix next .
Stone Quarry Road was then salted first .
CINDER SPREADER
Supervisor Desch stated that very few complaints had been received ,

however , he had received many very positive comments inregard to
our new policy of only salting intersections . He recommended
that the Town hold off on purchasing an additional cinder
spreader and truck , even though the 10 = Year MachinerylReplacement
Plan schedules the acquisition in 1982 . We should ask for
comments from the taxpayers regarding their views and problems
with the new policy . ,
The Supervisor went on to say that next year the four - wheel
drive snow plow will need to be replaced and if the Town only
replaces a cinder spreader the savings can be applied toward
the purchase of the four - wheel drive snow plow .
Town Attorney James Buyoucos stated that he wished to remind
the Board Members and staff that if they received anything in
writing stating that the Town has not been taking care of
a persons road , they must give a copy of the letter to the
Town Clerk , Town Supervisor and Town Highway Superintendent .
LIGHTING CONTRACTS
Supervisor Desch stated that the lighting contracts for the Town
at large , Renwick Heights , Eastwood Commons , Glenside , Forest
Home and Clover Lane need to be renewed Charges included in
the contract are facility charge , energy charge and fuel
adjustment .charge .
The Supervisor noted that he had gone through each contract. to
see what effect the new rates would have on the budget . The
worse increase being the fuel adjustment . However , he felt: the
Town would come out in excellent shape in each lighting district .
He also noted that the Town had not added very many lights to
the original Town wide lighting contract .
Councilman McPeak asked if the Town was able to take advantage
of the ' night rate ?
Supervisor Desch answered that the contracts do not appear to
provide for this .
Councilman Kugler stated that Ithaca College had considered light -
ing without a contract with NYSEG and had found . it would cost them.
several times more than contracting with NYSEG . NYSEG has all
the necessary equipment for repairing and installing equipment
and the college would need . to purchase identical equipment to
perform the same service .
Supervisor Desch stated that he felt lighting was inexpensive
insurance for the Town .

Motion by Supervisor Desch ; seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
autho ,.Y.izes the Supervisor to execute a five year contract with
New Y :• ' State Electric and Gas for Street Lighting for the
Town of Ithaca at large .

Councilwoman Kiefer stated that she thought it would be appropriate
for the Town to write a letter to the Public Service Commissi_ cn
stating these adjustments in electric rates were bad for municipal-
governments ,
The five year contract was questioned as it ' s being an
appropriate time .

Supervisor Desch noted that there was a penalty for removing;
lighting equipment .

Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the Supervisor to execute a five year contract with
New York State Electric and Gas for Street Lighting for the
Eastwood Commons Lighting District .

voting Aye . Nays - none ) .
RESOLUTION NO . 36
Motion by Councilman Kugler ; Seconded by Councilman McPeak ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the Supervisor to execute a five year contract with
New York State Electric and Gas for Street Lighting for the
Renwick Heights Lighting District .

voting Aye . Nays none ) .
RESOLUTION NO . 37

RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the Supervisor to execute a five year contract with
New York State Electric and Gas for Street Lighting for the .
Glenside Lighting District .

Clover Lane Lighting District .

PERSONS TO BE HEARD
Gust Freeman remarked that he felt the Town wide lighting was a
real plus for the Town .
�— STREET LIGHTING - ROUTE 366 and JUDD FALLS ROAD INTERSECTION
Town Engineer Fabbroni stated that the State had made improvements
to the Route 366 - Judd Falls Road Intersection and asked the
Town to remove the lights . The Town felt lights on this inter -
section were necessary for safety . NYSEG made a proposal for
lighting the intersection . which has been reviewed by State
officials , who --now. , feel , for safety , lights are necessary at
this intersection . ( Copy of proposal and map attached to
official minutes ) .
Supervisor Desch noted that Cornell University was not interested
in having a light installed at the Graphic Arts Building driveway .
Councilwoman Raffensperger stated that she was glad the Town had
been talking to the State about this intersection , however , she
stated that she did not think anything would help this inter -
section .
Supervisor Desch asked whether. the ;Boardti-71ahed , : to; ; ao }on ; record
as expressing concerns as to the safety of this intersection .
RESOLUTION NO . 40
Motion by . Councilwoman Raffensperger ; seconded by Councilman
Jennings ,
RESOLVED , WHEREAS , New York State Department of Transportation
( NYSDOT ) has rebuilt the State Route 366 - Judd Falls intersection ,
and
WHEREAS , NYSDOT has endorsed a proposal from NYSEG to add two
400 watt mercury vapor lamps to properly light this high
hazard location at an estimated increased cost of $ 325 . 82 ,
annually , and
VHEREAS , the Town of Ithaca ' s present policy provides for the
installation and maintenance , at Town expense , of lights at
intersections of public highways throughout the Town of Ithaca ,
NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of
Ithaca , that two 400 - watt mercury vapor units be installed , as
recommended in Mr . G . J . Messmer ' s letter of November 19 , 1. 981 ,
to Supervisor Desch , and . such other . . conditions and for such
term as the Supervisor shall deem expedient and proper , provided
that such provisions are not inconsistent with Section 64 , Sub -
division 19 of the Town Law .

ENGINEER ' S REPORT
WATER MAIN CONSTRUCTION
CODDINGTON ROAD
TOWN OF ITHACA , TOMPKINS COUNTY , NEW YORK
The construction of 3900 feet of new 8 -inch ductile iron transmission main to
serve 27 existing structures on Coddington Road is presently being planned as an
addition to the Town of Ithaca water facilities. The additional pipe will provide water
service to 26 dwellings and one small apartment complex. The water main extension
will serve an estimated 110 people. The average and maximum daily water
consumption is estimated to be 7 , 000 and 10 , 000 gallons per day , respectively.
A minimum free residual chlorine of 0.2 milligrams per liter will be maintained in
the piping through the chlorination of -supplied water. A normal service pressure of
60 psi will be maintained through the new piping , and a fire flow of 500 gallons per
minute at 20 psi will be available in the area. Fire hydrants will be located at
approximately 750 -foot intervals.

Our recommendation is to add three 400 watt mercury vapor units as follows ; .

2) New 400 -watt on pole 7rll , east of the bridge ,
3) New 400 -fratt , new wood pole on southwest corner of entry to C . U . Graphic
Arts bldg , approx . 125 ' from Rte . 366 .
The estimated increased costs to the Town would be X488 . 73 per year -
Please let us , know if NYDOT will approve of this plan so we can begin
making the arrangements we discussed . -

PUBLIC HEARING TO CONSIDER THE
EXTENSION OF THE CODDINGTON ROAD WATER MAIN
Proof of posting and publication notice of a Public Hearing to
consider the extension of the Coddington Road Water Main , having
been presented by the Town Clerk , the Supervisor opened the
public hearing .
Supervisor Desch stated that the need for public water beyond the
existing main on Coddington Road has been expressed by a number
of property owners for . two or three years . We thought about
combining the extension with the Stone Quarry Road Project , 'but
that would have meant raising the benefit rate above the $ 23 . 00
per unit .
n June 1981 , the Town received a petition and a number of letters
many property owners on Coddington Road , The problem involves
contaminated wells , inadequate supply , even during the wet summers
of the past two years .
Little could be done until a source of funds could be identified .
However , the Town Board in . July 1981 , authorized the hiring of
consulting engineers to develop an assessment of system needs
throughout the Town . The first phase of this study involved the
preliminary design of the Coddington Road water main extension .
In November 1981 , the Town Board , following public hearings on
the 1982 budget authorized the appropriation of $ 60 , 000 of
Federal Revenue Sharing Funds for the water study and the
Coddington Road water line . In the water fund budget , $ 60 , 000
of surplus funds was set aside to create the $ 100 , 000 budget for .
this project . In allocating Revenue Sharing Funds , the Town

Board recognized the critical priority involved with this water
need . Very few Towns in New York State could do this because
very few Towns have a Townwide improvement area . The water
improvement will benefit the entire Town , not only through improved
health conditions , fire protection , but overall property values .
The only other available alternative would have been to form a
water district . If such were the case , the annual costs to
properties adjacent to the line on both sides of the road would
be almost prohibitive , i . e . , $ 300 / unit : . Also , the process to .
obtain approval of State Audit and Control would extend the
schedule for the project at least one year and there is always
the possibility , at such unit costs , that approval would be
denied .
So this is an outline of the history of our deliberations to
date .
It is our desire to extend the main as far as the intersection of
Fast King Road , a distance of 3 , 900 feet . We will extend the
main this far if the bids will allow us to do so , within the
$ 100 , 000 budget . The minimum that we will be authorized to build ,
under the current resolution , will be 3 , 250 feet : This should be
a safe range with the bidding climate we expect this early ill
the spring construction season . If bids exceed the unit costs ,
such that we could only build less than 3 , 250 feet , the Town Board
would consider an amendment to the authorizing resolution in which
case , a 30 to 60 day delay in the project would occur . However ,
we would have to ask ourselves whether such costs would be in our
best interest to support .
The bids will include separate items for water services under the
road and within the right - of - way . Again , it may be necessary for
the property owners to pay for house services to the main . I:n
our view , the most important thing is to get as much main in the
ground as possible and to serve those properties in critical need .
There will be no requirement or deadline for property owners to
connect to the system providing in the case of rental properties ,
that well tests are adequate .
What will it cost for service ? On your tax bill in January of
each year you will be assessed a benefit assessment charge of
$ 52 / unit . This is made up of $ 23 . 00 to retire remaining debt
on the existing distribution systems , in other words , the mains ,
reservoirs , and pump stations to get the water to you . $ 29 / unit
is to retire debt on the water supply and treatment systen.> ,
Bolton Point intake , pump stations , treatment plant , reservoirs
and transmission mains .
Water usage is billed quarterly and the average family spends
$ 140 per year for water usage .
Your house internal plumbing will be inspected and must comply
with code . and be approved by the Bolton Point plumbing inspector .
Unlike the City , it is not necessary to have the work done by a
licensed plumber . The cost of such work can only be determined
by you , in consort with a plumbing contractor .
The cost of your house service will be $ 8 - 12 / foot , not including
rocks , if you have a contractor do the job for a 3 / 4 " service
with 54 " cover , the minimum necessary for our climate .
The water permit fee will be $ 150 for the meter , plumbing
inspection and water tap .
The water main is to be located along the east side of the road
to minimize the amount of rock to be encountered . This will
make it easier for the majority of customers to connect .

When bids come in , in early April , we will put together a con -
struction budget and let you know in the April Town Newsletter
what our decisions are . And , if and when as the project proceeds ,
we also will write to let you know the schedule for hook ups .
Our decision tonight is subject to a permissive referendum for
30 days , which will parallel the bid period . Persons objecting
to the project can petition the Town for a referendum . It will
take 5 % of the number of voters voting in the last gubernatorial
election to call for a referendum . This is approximately 150
signatures .
DeForest Heffron , 699 Coddington Road stated that it was hard for
him to be for or against the extension , because under the 3 , 250
feet extension it will end before it gets to his house . He asked
if the Town expected the bids to come in under budget so that the
water main could be extended ?
Supervisor Desch answered that when Stone Quarry Road bids came
in , they were under budget . This is why we are. trying to get the
bids out early , before the construction season begins . If the
bids come in at the budget figure , the line will only be extended
to 689 Coddington Road , however , if they come in under . budget. we
may be able to go all the way to King Road . We will just have . to
wait and see , the Town cannot take on anymore debt load at this
time .
Louise Mudrak , 693 Coddington Road stated that she was speaking
to the Board as a dehydrated resident . She went on to say that
when they bought the house last spring , the previous owner had
said there was sufficient water . However , she and her husband
had to make frequent trips to Buttermilk Falls to shower . Now
they have a baby .
She went on to say that after starting the petition to extend
the water up Coddington Road , she was very disappointed to find
the water line would stop one house short of her house . Mrs .
Mudrak stated that she had waited in good faith for the water .
She now feels a sense of despiration to think that they must now
sink several thousands of dollars into a well and then find in
two years that the water lines will be extended .
Mrs . Mudrak then read a letter from Michael and Dawn Visnyei ,
who were unable to attend the meeting at they were in Florida on
vacation . Mr . and Mrs . Visnyei requested that the water Line be
extended to the original destination , the corner of King Road .

Debra Vialet , 669 Coddington Road asked when would she be able
to hook on the water line , as her water is not safe ?
Supervisor . Desch answered that the Town planned on opening the
bids in April , just past the 30 day Permissive Referendum waiting
period . The bids would be awarded shortly thereafter . We hope to
begin the construction in May , and wl*_ th : about . :two . months :fo.r con -
struction , the main . cduld possib.l.y be :ready ' . f.or use in July .
Mrs . Mudrak asked if the line would be looped ?
Town. Engineer. Fabbroni answered that there would be afire hydrant
at the end of the main .
Mr . Heffron asked if the Town would be willing to forego the Towns .
• share of the cost to put in the laterals and instead use the money
to extend the main ? He went on to say that he knew all of the
people here tonight are more interested in getting the water ,
than anything else .
Town Attorney James Buyoucos stated that he wished to go on record ,

that the Town Board had worked hard . and in good faith , to get
the extension . done in proper sequence . If the bids should come
in high , and there is any doubt , the Town Board is not obliged
to extend the water . The Board cannot go beyond the. $ 100 , 000 .
He went on to say that there is no way tonight to know how the
bids will come in and how far the line will be extended. As the
bids come in , the Town . Board may find a way to extend the lines
eventhough the bids may come in over the $ 100 , 000 , however , this
lays with the Town . Board and it is there decision . He went on
to warn the people present th :�,. t they cannot rely on the : : fact ' that
you won ' t have to drill a well .
Mr . Buyoucos noted that the supply lines are the decision of the
Town Board and it cannot be said tonight that the Town will put
in the supply lines . The Town Board adopted the resolution on
the basis of the engineer ' s report which apparently says 3 , 250
feet can be built . A determination will. be made based upon
the evidence . He went on to say that the time for construction
cannot be guaranteed .
Town Attorney Buyoucos stated that petition_. forms =_ for. _. a _., permis. sive
referendum must be geared to the law . The necessary forms are
ready and can be obtained from the Town Clerk ,
Carol Carr , 674 Coddington Road asked how long do the residents
have before they must hook up to the water ?
Supervisor Desch answered that there is no specified time for
hooking up . However , apartment owners with polluted well are
something different .
Supervisor Desch closed the public hearing .

At a meeting of the Town Board of the Town of Ithaca held at
the Tom Offices at 126 East Seneca Street , Tompkins County ,
New York , on the 8th day of March , 1982 , at 7 : 00 p . m . :

WHEREAS , a map , plan and report relating to the establishment of
a water improvement in a portion of the Coddington Road area of
the Town pursuant to the provisions of Article 12C of the Town
Law to be constructed and financed as a Town Water Improvement ,
prepared by Stearns & Wheler , competent engineers , duly licensed
by the State of New York , in such manner and detail as has been
requested and approved by the Town Board of the Town of Ithaca ,
have been duly filed with the Town Clerk of the Town of Ithaca
and in accordance with the requirements of Article 12C of the
Town Law , and
WHEREAS , an order was duly adopted by the Town Board of the Town
of Ithaca on February 22 , 1982 , setting forth the following :
( 1 ) the filing of said map , plan and report , and ( 2 ) the proposed
improvements , and ( 3 ) a description of the area in which the
proposed improvement will be located and a statement as the

benefitted area , the description and boundaries of the aforesaid
areas being set forth in Schedule A , and ( 4 ) the maximum amount
proposed to be expended for said improvement and the acquisition
of all necessary easements is $ 100 , 000 , and ( 5 ) . the proposed
method of financing , and ( 6 ) the fact that the map , plan and
report describing the same are on file in the Town Clerk ' s Office
for public inspection , and also setting forth any and all other
matters required by law to be stated , and setting March 8 , 1982
at 7 : 00 p . m . , on that day , as the time , and the Town Offices in
the City of Ithaca , New York , as . the place where the said Torn
Board would meet to consider said map , . plan and report , and to
hear all persons interested in the subject thereof concerning; the
same , and to take such action thereon as the Town Board shall_
determine to take as may be authorized or required by law , and
WHEREAS , such Order was duly published and posted as required
by law , . and
WHEREAS , a hearing on said matter was duly held by said Town
Board on the 8th day of March , 1982 beginning at 7 : 00 p . m . , of
that day , at the Town Offices in said Town , and the Town Board
having heard all persons who wished to be heard and the matter
of the improvement having been fully discussed ,
NOW , upon the evidence given upon the statement in support of
said improvement made at such hearing ,
IT IS RESOLVED AND DETERMINED AS FOLLOWS :
( 1 ) That the notice of hearing was posted and published
as required by law and is otherwise sufficient .
( 2 ) That it is in the public interest to make such water-
improvement .
( 3 ) That the area benefitted is the entire area of the
Town of Ithaca lying within the boundaries of the Town but not
including the land lying within the boundaries of the Village
of Cayuga Heights , being the only Village in the Town :
( 4 ) That all property benefitted by the water improvement
is included within the benefitted area as described above .
( 5 ) . That the area within which the said improvement will
be constructed and a description of the boundaries of the
benefitted area are substantially described in Schedule A , appended
hereto , and made a part hereof .
IT IS FURTHER RESOLVED AND ORDERED , that the establishment and
construction of said water improvement , as set forth . in said
map , plan , and report , and as more particularly described and
limited in Schedule A , be approved , and the necessary . easements
and lands , if any are required , be acquired , at the maximum
estimated cost set forth above , upon the required funds being
provided and made available for such purpose .
IT IS FURTHER RESOLVED AND ORDERED , that the cost of the water
improvement , including , without limitation , construction costs ,
cost of acquisition of lands and easements , if any are required. ,
legal and engineering fees , and other expenses , shall be borne
entirely by the benefitted area which is the area of the Town
outside of any Village in said Town , and such expenses shall be
apportioned and assessed upon and collected , in the first instance ,
from lots and parcels of land in just proportion to the benefit
.conferred upon the same as determined by the Town Board , but
subject to the following provisions :
1 . INSTALLATION OF SUPPLY LINES CONNECTING . THE PROPERTIES
TO THE WATER MAIN IN THE HIGHWAY . Supply lines connecting the

water main with the properties in the area in which this main
will be constructed shall be installed , maintained and repaired
on application for a permit by the property owners either by
or under the supervision of the Town , -- and the cost of such
installation , connection with the water main and maintenance
will be at the property owners expense unless the Town Board
by resolution provides that the portion of a supply line which
lies within the highway right - of - way will be installed ,
maintained and repaired by or under the supervision of the
Town , either wholly at the expense of the property owners , or .
wholly at the expense of the Town , or partly at the expense of
the Town and partly at the expense of the property owners , as
the ':Gown Board may by resolution or local law provide .
THIS RESOLUTION IS SUBJECT ( 1 ) TO A PERMISSIVE REFERENDUM , and
( 2 ) to the Town obtaining such permits and approvals which may
be required for constructing the water improvement , including
without limiting the generality of the foregoing approval from
the County of Tompkins or other public agency for performing any
work within the highway boundaries , and ( 3 ) compliance by the
Town with all other applicable laws , requirements , rules and
regulations . The Supervisor is authorized to take all action
and execute all documents required to accomplish all the fore --
go .;.ng .
The adoption of the foregoing resolution , determination and
_ order was moved by and seconded respectively by Supervisor
Desch AND Councilman Jennings put to a vote and , upon roll call ,
the vote was as follows :

DESCRIPTION OF TOWN WATER IMPROVEMENT
( CODDINGTON ROAD EXTENSION 2 )
1 . LOCATION AND BOUNDARIES OF PROPOSED IMPROVEMENT .
a ) The proposed improvement begins at the terminus of the
existing water main as it is now located in the westerly side
of Coddingtoni Road where the land now or formerly of Earle and
Thelma Bodine ( Tax Parcel 40 - 1 - 9 . 2 ) are located ; the proposed
water main. will run east to a point in the easterly side of
Coddington Road ; then it will run south in the easterly side of
the road about 3 , 250 feet to a point about 650 feet north from
East King Road . For a more particular description the public is
referred to the map , plan and report on file in the Town Clerk ' s
Office .
b ) However , the water main , as part of this improvement ,
may , at the descretion of the Town Board , be extended further
south on the Coddington Road but in no event beyond the north
line of East King Road extended to the east , if the Town Board

determines by resolution that the cost of such extension , based
on a bid submitted by a successful bidder , will enable the Town
to construct this additional extension .
2 . DETERMINATION OF BENEFITTED AREA .

Town ( outside of the Village of Cayuga Heights ) is the benefi. tted
area , this determination is in accordance with Town Water and.

Motion by Councilman Kugler ; seconded by Councilman Cramer ,
WHEREAS , protection of health and supply of water needs have been
identified along Coddington Road from the end of the existing
water main to East King Road from Health Department reports and
petitions submitted by residents , and
WHEREAS , the Town Board selected Stearns & Wheler Engineers &
Scientists of Cazenovia to prepare a feasibility study , plans
and specifications for a water main extension , and
WHEREAS , the Town Board has adopted an order establishing the
maximum expenditure of $ 100 , 000 for said water main improvement ,
NOW THEREFORE BE . IT RESOLVED , that the Town Board of the Town of
Ithaca authorizes the Supervisor to advertise for sealed bids .
for the construction of the Coddington Road Water Improvement ,
and
FURTHER BE IT RESOLVED , that the bid opening for said project
shall be scheduled as soon as practicable in accordance . with
requirements of law , and .
BE IT FURTHER RESOLVED , that contract documents be delivered for
review and inspection to Town Officials promptly following the
adoption of this resolution and in order that they be available
for bidders .
