HomeMy WebLinkAboutTB Minutes 1982-02-22 TOWN OF ITHACA SPECIAL BOARD MEETING , February 22 , 1982 At a Special Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices at 126 East Seneca Street , Ithaca , New York , at 12 : 00 noon , on the 22nd day of February , 1982 , there were : PRESENT : Noel Desch , Supervisor George Kugler , Councilman Shirley Raffensperger , Councilwoman Henry McPeak , Councilman Dooley Kiefer , Councilwoman David Jennings , Councilman ABSENT : Marc Cramer , Councilman ALSO PRESENT : James V . Buyoucos , Town Attorney Lawrence Fabbroni , Town Engineer PLEDGE, OF ALLEGIANCE The Supervisor led the assemblage in the Pledge of Allegiance . EXTENSION OF CODDINGTON ROAD WATER MAIN Supervisor Desch noted that all Board Members had received a copy of the proposed Notice of Public Hearing along with Schedule A and the engineers report . ( Copy attached to the official minutes ) . The Supervisor went on to say that the engineers report on the test borings showed that adequate cover over the main where it crosses Coddington Road can be achieved for frost protection . We may not be able to afford to run many service lines within the right - of - way , but will know more ` hen the bids are opened . The engineers report shows 3 , 900 feet of water main , however , . Schedule A only shows 3 , 250 feet . The -additional 650 feet will be added if the bids come in within the alloted monies , Councilman Kugler noted that the open cut method of crossing the highway was being proposed . Supervisor Desch stated that most County Highways , for service crossings , are usually done this way , ' although their policy is not consistant . RESOLUTION N0 , 31 Motion by Councilman McPeak ; seconded by, Councilwoman Raffensperger , _ EXTENSION OF CODDINGTON ROAD [,LATER MAIN ( EXTENSION N0 . 2 ) IN THE MATTER OF THE CONSTRUCTION AND FINANCING OF A WATER IMPROVE - MEAT EXTENDING THE EXISTING WATER MAIN SOUTHERLY ALONG A PORTION OF . CODDINGTON ROAD AS PART OF THE TOWNWIDE WATER IMPROVEMENT PURSUANT TO ARTICLE 12C OF THE TOWN LAW . r 1 . WHEREAS , a map , plan and report have been prepared by an Engineer duly licensed by New York State showing the proposed water extension improvement in the • Coddington Road area , the general plan .for such improvement , and a report describing the improvement Town Board Minutes - 2 February 22 , 1982 and its proposed method of operation , and the boundaries and location of the area of the Town within which the improvement will be located , which documents are now filed in the Town Clerk ' s Office for public inspection , and 2 . WHEREAS , the location of the proposed water improvement and the boundaries of the benefitted area are decribed in the annexed Schedule A , which is incorporated in and made a part of this resolution , and 3 . WHEREAS , the proposed improvements consist of the construction of a water main , hydrants , valves , fitting , and other appurtenances and facilities substantially along the easterly side of Coddington Road so that the water main will be extended southerly from its present terminus to furnish municipal water to the properties in the above described area , it being understood that the extension is only a partial extension to the south , as described in Schedule A , and is not intended to run the complete length of Coddington Road in the Town ( see Schedule A5 , and 4 . WHEREAS , said map shows the above described improvement , facilities , together with the location and general description of all public works required , including lands and easement , if any , to . be � acquired , and 5 . WHEREAS , the maximum amount proposed to be expended for said improvement and for the acquisition of the necessary lands and easements , if any are required , is $ 100 , 000 , and 6 . WHEREAS , ( a ) the proposed method of financing the cost of the improvement will be from current funds iri the amount of $ 100 , 000 which have been appropriated by the Town Board and ( b ) the proposed method of apportionment of the costs of the improve - ment will be from revenues obtained , in the first instance , ( i ) by assessments levied , on all parcels of land in the entire area of the Town of Ithaca ( outside of the Village of he Heights ) to the extent such lots are bene fitted , and ( ii ) as the Town Board shall otherwise determine , pursuant to the provisions of Section 209 - q , Article 12C of the Town Law , it is ORDERED , that the Town Board of the Town of Ithaca shall meet and hold a public hearing at the Town Offices at 126 East Seneca Street , Ithaca , New York , in said Town , on the 8th day of March , 1982 , at 7 : 00 p . m . , on that day , to consider . said map , plan and report , and the construction and establishment :` of the proposed improvement , and to hear all persons interested in the subject thereof concerning the same . and to take such action thereon as is required or authorized by law . SCHEDULE A DESCRIPTION OF TOWN WATER IMPROVEMENT. ( CODDINGTON ROAD EXTENSION 2 ) 1 . LOCATION AND BOUNDARIES OF PROPOSED IMPROVEMENT . The proposed improvement begins at the terminus o the existing water main as it is now located in the westerly side of Coddington Road where the lands now or formerly of Earle and Thelma Bodine ( Tax Parcel 40 - 1 - 9 . 2 ) are located ; the proposed water main will run east to a point in the easterly side of Coddington Road ; then it will run south in the easterly side of the road about 3 , 250 feet to a point about 650 feet north from East King Road . For a more particular description the public is referred to the map , plan and report on file in the Town Clerk ' s Office . If costs permit , which may be determined after construction bids have been received the water main , if the Town Board by resolution so determines , will be extended further south on Coddington Road but in no event beyond the north line of East Town Board Minutes - 3 - February 22 , 1982 King Road , 2 . DETERMINATION OF BENEFITTED AREA . In accordance with Town Water and Sewer Improvement po i� cy , it will be determined by the Town Board that the entire area of the Town ( outside the Village of Cayuga Heights ) is the benefitted area . 3 . INSTALLATION OF SUPPLY LINES . Supply lines connecting the water main with the adjacent properties shall be installed and repaired on application for a permit by the property owner , either by or under the supervision of the Town , and the costs of connection with the water main will be at the property owners expense unless the Town Board by resolution provides that the portion of a supply line which lies within the highway right - of - way will be installed , maintained and repaired by the Town and the charges and costs thereof allocated and collected from property owners in such manner as the Town Board by resolution shall direct . ( Desch , Kugler , Raffensperger , McPeak , Jennings and. . Kiefer voting Aye . Nays - none ) . REPORT ON CLOSED SCHOOL BUILDINGS Councilman McPeak reported that a four hour - meeting has been held on the disposal of the closed school buildings . He reported that a small computer company was interested in Purchasing the West Hill School , however , the residents of the nei. ghborhood do not want light industry in the area . The company is not interested in the Danby School . A bid by a group of handicapped persons for Glenside School has been received . The school needs a new roof and the possibility of " In Lieu of Taxes " , to the Town of Ulysses was discussed . A decision on the offers will not be made for a while . He also noted that -the School District was not interested . in leasing as they do not want to become landlords . Councilwoman Raffens ,p :.-, rger asked who will . decide the fate .. of of the buildings ? Councilman McPeak stated that the School Board will make the final decision . Councilwoman Raffensperger stated that Mr . Flack, at the Association of Town Meeting , had suggested that school building closings should be included in . the SEQR Law .
