HomeMy WebLinkAboutTB Minutes 1981-05-27 TOWN OF ITHACA ADJOURNED BOARD MEETING May 27 , 1981 At a Adjourned Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices at 126 East Seneca . Street , Ithaca , New York , at 7 : 00 P . M . , on the 27th day of May , 1981 , there were PRESENT : Noel Desch , Supervisor - George Kugler , Councilman Shirley Raffensperger , Councilwoman Marc Cramer , Councilman Henry McPeak , Councilman Dooley Kiefer , Councilwoman ABSENT : Victor Del Rosso , Councilman ALSO PRESENT : Lawrence Fabbroni , Town Engineer PLEDGE OF ALLEGIANCE The Supervisor led the assemblage in the Pledge of Allegiance . .LOCAL BOARD OF ASSESSMENT REVIEW Supervisor Desch announced that the Board needs to appoint two Council- persons to the Local Board of Assessment Review for the Town of Ithaca . The Town of Ithaca ' s review is scheduled for Wednesday , June 10 , 1981 from 3 : 00 to 7 : 00 P . M . The Supervisor stated that basically the Board members would be accessable to any persons having a complaint about the recent update in their assessment . Councilman Cramer stated that he would be happy to volunteer to set on the Board again . Councilman McPeak also volunteered to sit on the Board . RESOLUTION N0 , 75 Motion by Supervisor Desch ; seconded by Councilman Kugler , RESOLVED , that the Town Board of the Town of Ithaca hereby appoints Councilmen Cramer and McPeak to sit on the Local Board of Assessment Review for the Town of Ithaca on June 10 , 1981 from 3 : 00 P . M . to 7 : 00 P . M . , at the County Assessment Department . ( Desch , Kugler , Raffensperger , Cramer McPeak and Kiefer voting Aye . Nays - none ) . POSTPONEMENT OF SEWER CONNECTION REQUIREMENTS Supervisor Desch read a letter from Charles R . Pettis , III , of 332 Forest Home Drive , requesting an extension to time before being required to hookup to the municipal sewers , as he had spent a considerable amount of money upgrading his system and wished to recoup his investment . Supervisor Desch asked the Town Engineer if the ] health Department had check Mr . Pettis ' system ? Town " Engineer Fabbroni answered no . Supervisor Desch asked she Town Engineer_ to pursue the matter and report to the Board at a later. date . Town Board Minutes - 2 - May 27 , 1981 ELECTION DISTRICT 4 Supervisor Desch read a letter that will be sent to those voters . in District # 4 who will be moved into District .# 5 ( copy attached to official minutes ) . RESOLUTION NO . 76 Motion by Councilman Cramer ; seconded by Councilwoman Raffensperger , RESOLVED , that the Town Board of the Town of Ithaca accepts the conceptual proposal to transfer 110 registered voters in Town. of Ithaca Election District #4 to District # 5 , and FURTHER BE IT RESOLVED , that the Supervisor mail a letter to each registered voter informing them of the change in their voting district . ( Desch , Kugler , Raffensperger , Cramer , McPeak and Kiefer voting aye . Nays - none ) . PUBLIC HEARING TO CONSIDER THE ADOPTION OF PROPOSIED AMEND14ENTS TO THE ZONING ORDINANCE Proof of posting and publication notice of a Public Hearing to consider the adoption of proposed amendments to the Zoning Ordinance having been presented by the Town Clerk , the Supervisor opened the Public Hearing , Supervisor Desch stated that the Subcommittee had been working on the problems with the Tnstitutional Use Zones , P - 1 and P - 2 zones . They have been working with Cornell to develop a mechanism that f Cornell and Ithaca College can function under P Zones are proposed to recognize the status of the main campus at Cornell University and Ithaca College . P - 1 zones provide a site plan review . for construction in this zone . P - ?_ zones require 200 feet setback , where adjacent to a residential zone . ' He further noted that Business 3 zones were created for motels and hotels . The Subcommittee will bring their recommendations on P - 1 , P - 2 and Business 3 zones to the June 8th meeting . Mr . Herbert Monkemeyer asked if a B - 2 zone required a greater distance requirement , from the highway , than a B - 1 ? Town Engineer Fabbroni stated that the requirements were the same . He stated that a B - 3 zone relates to motels and boat marinas . Supervisor Desch stated that he had received a letter. today asking the Board to consider the rezoning of the Alfred Eddy property on the Elmira Road . He stated that the matter will not be .addressed tonight , but may be taken up in the near future if the Board decides to hear it , or it may be referred to the Planning Board . The Supervisor noted that this was a special case and not part of the rezoning of the town as is now being addressed by the new proposed Zoning Law , Shirley Egan questioned the possibility of changing the horse barns to a P - 1 . Councilwoman Kiefer asked why the Vet Virus Lab was in a P . I. zone ? Supervisor Desch responded , saying the determination of a P - 1 zone was made on the fact that it is educational in use and a permanent construction . Permanent construction being forty years or greater life expectancy . This distinguishes a permanent building from a. temporary building . Town Board Minutes - 3 - May 27 , 1981 P - 2 zones basically matches the existing R- 30 zones except some uses were removed . An example would be cemetaries . Supervisor Desch stated that in the last discussions with Cornell relating to thresholds , the Subcommittee failed to come up with a sensible plan for the size of thresholds ; that would not burden Cornell or the Town . Mrs . Egan asked , what does the City do about thresholds ? Supervisor Desch noted that the Town requirements may be more strict than those imposed by the City . Mrs . Egan stated that she felt the first thing to be accomplished was a workable figure for the threshold area . She suggest that all interested parties should put on their thinkingcaps . She noted an example , if the college wished to add a twenty foot bay to a green house and the building were only 200 '• from the :neatest property line , a special permit would be needed . She felt that Cornell would not be allowed to utilize their property , most of the time , without a special permit . and then by the grace of the Board . Mrs . Egan asked would a building in . a P - 2 zone need a special permit ? Supervisor Desch answered no . Councilwoman Raffensperger noted there was a problem determining how permissive was the special permit process . Mrs . Egan stated that she would like to take all the information received tonight back to various people at Cornell to get their imput . She would return with their recommendations for the June 8th meeting . She felt the Subcommittee should meet again to get Cornell ' s interpretation of the P - 2 zone . Councilwoman Kiefer stated that she hoped the Town Attorney would have a chance to look over the legal language before the June 8th meeting and that his recommendations could be given to the Board Members before the meeting . Councilwoman Kiefer asked Mrs . Egan how many expansion projects go on in a year and how many were by special permit ? Mrs . Egan stated that she did not know , however , she would ask . She noted that new buildings were a different matter than adding a bay to an existing green house . Supervisor Desch noted that a permit was required in all other parts of the Town . Mr . Herbert Monkemeyer stated that he would like the northeast section of his property included in a B - 2 zone . He would like to develop the area for high class tenants . National Cash and a high class business were interested in locating on his property . He is ready to bring in an application for a new business in this area . They are proposing to locate their headquarters here . A B - 1 zone would create a problem for him . He further stated that he felt his property was made for a B - 2 zone . Mr . Monkemeyer said if his property were included in a B - 1 zone , that the new company might not be interested in locating their headquarters * in Ithaca . Also , NCR was interested in erecting a building for storage , which fits into a B - 2 category . Mr . Monkemeyer went on to say he felt the new industry would be great for the Town of Ithaca . The land has great potential with its green areas , which can be made very nice . Town Board Minutes - 4 - May 27 , 1981 Supervisor Desch stated that one word Mr . Monkemeyer used confused him , that being industry . Mr . Monkemeyer responded that he was not talking about a factory . Supervisor Desch suggested to Mr . Monkemeyer that he make application now to the Planning Board so that approval could be . obtained before the new Zoning Law becomes law . Councilwoman Raffensperger wondered if making this area a B - 2 zone would be setting a preced .e. .nt . that would not require other land owners to follow through a full process for rezoning . Supervisor Desch asked the Board what their pleasure was ? The Board then decided that the Monkemeyer land should be zoned B - 2 . Town Engineer Fabbroni asked for the Board ' s comments , on zoning , before the meetings so that he is not cross examined during the meeting . Supervisor Desch .asked the Board to get their comments to the Town Attorney so that so that the Zoning Law can be put in full swing before the June 8 meeting. Councilwoman Raffensperger asked if the Town Attorney would give the Board a legal opinion on the meaning of a special permit . . RESOLUTION NO . 77 Motion by . Supervisor Desch ; seconded by Councilwoman Raffensperger , RESOLVED , that the Town Board of the Town of Ithaca will meet and conduct a public hearing on June 8 , 1981 , at 7 : 00 P . M . , at . the Town Hall , 126 East Seneca Street , Ithaca , New York , to further consider the adoption of amendments to the Zoning Law . ( Desch , Kugler , Raffensperger , Cramer , McPeak and Kiefer voting Aye . Nays - none ) . ADJOURNMENT The meeting. was duly adjourned . i -own C rk
