REGULAR BOARD MEETING
May 11 , 1981
At a Regular Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 126 East
Seneca Street , Ithaca , New York , at 5 : 30 P . M . , on the 11th day
of May , 1981 there were

The Supervisor led the assemblage in the Pledge of Allegiance .
REPORT OF TOWN OFFICIALS
SUPERVISOR
Supervisor Desch noted that the new census figures will reduce the
Town of Ithacas share of the sales tax , namely the non city portion
from 30 . 7 % to 25 . 5% due to the faster . growth primarly in Lansing .
The overall revenue seems to be up considerably according to first
quarter figures but it is currently unknown whether major readjust
ments will be forthcoming . In terms of budgeting , we purposely
avoid taking the sales tax into account , in relation to Town tax
rate , since figures of credit are not known until after the Town
budget is approved each year . In the. past two years , such sales
tax credits have brought about a zero County tax rate .
In December 1979 , when the Tompkins County Trust Company moved to
their new building , they expanded their computer capability . On
the old computer the Water Commission Business Manager manually
deducted the Town of Ithaca surcharge to determine the amount of
the quarterly payment due the Commission . Without our knowledge ,
the programmer rewrote the program and made the deduction auto -
matic , so that for five quarters we had an underpayment to the
Commission by the amount of the surcharge . This adds up to
$ 48 , 685 . 73 due the Commission . The problem was discovered by
Connie Allen Business Manager of the Commission as she reconciled
the computer print out through the laborious process of checking
the components of the payment individually . The most recent quarter
was determined by taking the automatic deduction into account .
You may recall in October 1980 , the Water Commission. through a
Town Board Minutes . 2 May 11 , 1981
similiar reconciliation of accounts , found that the Town of Ithaca
overpaid the Commission during the period up to early 1978 by
$ 50 , 537 . 24 . We and the Commission agreed , by resolution , that the
Town would be reimbursed over a 5 year period beginning in 1983 ,
at the rate of about $ 10 , 000 per year .
The computer change has accomplished most of the reimbursement
already and the Commission agreed at its audit meeting today to
pay the remainder of dollars next . month . The surplus is , therefore ,
available to operate and maintain the Town of Ithaca water system
and will enable us to proceed with the painting of the Ridgecrest
Tank without a short term. note . . We may also wish to borrow from
this fund to retain a . consultant to proceed with the water system
feasibility program outlined last fall , particularly in anticipation
of the drought forecast . There may also be a state water assistance
program available if we - can have plans ready .
The Supervisor went on to say , we .established an objective to
respond to the Board of Elections request to decrease the size of
District . 4 since the registration exceeds 1000 . The current
dilemma facing the County on reapportionment may make it unwise
to take formal action this year . The easiest solution would be to
add the area north of Fall Creek to District 5 . This would not
change the area of representation for our County Representatives
unless reapportionment changes other County election districts in
the Town ,
TOWN ENGINEER
Town Engineer Larry Fabbroni stated that a number of meetings have
been held with the City on the sewer project , however , no further
progress has been made to report on at this meeting .
Northeast Transit will provide the same service as last summer ,
however , as costs have increased , the Town Engineer stated that
he was asking the Town Board to approve the expenditure of $ 1 , 000 ,
the Town ' s share . He further noted that there was a deficit of
$ 2 , 000 to be shared by all municipalities . He suggested that the
surplus be left in the account and not returned to the municipalities .
Councilman Del Rosso asked what was the total amount of the deficit ,
$ 7 , 400 ?
The Town Engineer answered yes , $ 7 , 400 instead of the projected
$ 5 ) 400 *
Councilman Del Rosso asked the Town Engineer if he realized this
was a 40 % increase ?
Mr . Fabbroni stated that all the money allocated was not used last
year , we have always had money left over .
RESOLUTION NO . 63
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby approves
the continuation of the Northeast Transit Summer Program , and
FURTHER BE IT RESOLVED , that the Town Board approves the expenditure
of $ 1 , 000 as the Town ' s share to continue this service , and
FURTHER BE IT RESOLVED , that the Town Board approves the retention
of the Town ' s share of the $ 4 , 500 surplus , by the City of Ithaca :

Town Board Minutes - 3 - May 11 , 1981
Supervisor Desch stated that the East Ithaca Connector General
Committee would be meeting a week from today to consider acceptance
of the report . After this , the report will be presented to the
Town Board . Cornell Trustees will be looking at the report at
their May 29th meeting .
The Town Engineer noted that the pump for the Cliff Street Pump
Station should be arriving around June 1st . The contractor hopes
to perform all remaining work simultaneously . The Town Engineer
stated that at this point , he was comfortable with having the work
performed in June , because of the drop off in consumption during
this month .
Supervisor Desch stated that for sometime there has been a deficiency
in the quality of water service provided for the residents of the
Renwick Heights area . However , the cost of installing new lines
was prohibitive . Now , an individual desires to develop three lots
and is willing to share in the cost ,- of .upgrading the system .
The Town Engineer noted that the area is serviced by 4 " mains and
6 " mains . The immediate area in question , is serviced by a stretch
of 4 " , 2 ' and 1 " lines. . None of these sizes are particularly good .
The Town would like the old galvanized mains replaced . The Town
is willing to spend $ 5 , 000 to tie all this together , if the man
interested in developing the lots would install the 6 " main .
Mr . Fabbroni further noted that he felt this was a fair trade - off ,
with the developer installing the 6 " line and the Town installing
fire hydrants .
Councilman Del Rosso asked where the water to supply these mains
come from?
Town Engineeer answered , about four different zones .
Councilman Del Rosso asked if this area was originally supplied
by the City ?
Town Engineer Fabbroni and Supervisor Desch both answered yes .
Town Engineer Fabbroni recommended that the Town agree to pay up
to $ 5 , 000 , this amount not including the cost of the fire hydrants .
Councilman Cramer asked if this would be an added cost to the
property owners on Renwick ? -
Supervisor Desch said no , the . people in this area have been paying
the same amount as other areas , however , without proper protection .
Supervisor Desch stated that a concurrence by the Board was needed
to proceed .
Councilwoman Raffensperger if the Board was setting a precedence
that they could live happily with in the future ?
Councilman McPeak felt the Board could be happy with this decision ,
as long as future requests were along this line .
RESOLUTION NO . 64
Motion by Councilman Del Rosso ; seconded by Councilman McPeak,
RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes
the expenditure of monies , not to exceed $ 5, 000 , to upgrade the Town
water system in the Renwick Heights area , in conjunction with the
development of three lots .

voting Aye . Nays - none ) .

Town Engineer. -.:.Larry . Fabbroni stated that the Ridgecrest Water Tank
is only in the first stages of pitting . As a result , the tank
will only require sand blasting and three coats of paint . Bids
will be out next week and awarded at the June meeting .
Councilman Del Rosso asked how long the Ridgecrest Tank had been
in operation ?
Town Engineer said 13years , with no cathodic protection .
The Town Engineer noted that the soil tests for the Dewitt Park
had been completed . He also noted that Mr . Cline was there when
the tests were being conducted and that Mr . Cline seemed satisfied
with the results . Mr . Fabbroni stated that he hoped to have a
report ready for the June Town Board Meeting .
Supervisor Desch asked who would prepare the contract with the
school district ?
Mr . Fabbroni said the staff would prepare the contract and then
have the Town Attorney review i_ t . Then a meeting would be held
with the Parks Committee . He further noted that an agreement
would be needed with the School Board ,
Councilman Cramer asked if the fields were used in the summer ?
The . Town Engineer said the fields were in bad shape and only
lightly used.
Supervisor Desch asked about Chief McEwen ' s concern regarding
the fence ?
The Town Engineer stated that the problem was with the us:e of
the property as a school and that the school should provide the
necessary fencing .
Councilwoman Raffensperger stated that the Parks Committee
recommended that the fencing problem be referred to. the School
District ,
HIGHWAY SUPERINTENDENT
Highway Superintendent Robert Parkin reported the Spring Clean - up
tool: three and a half days to complete . Usually it takes one and
a half days .
The Town of Ithaca entrance signs have been ordered . The signs
will be green and white with the words "Welcome - to the Town . of
Ithaca , Zoning Enforced '. ' . The State will install the signs on
their roads .
He went on to say he had received his Omni . He had been checking
the mileage and found he was getting 22 to 23 miles per gallon
around town .
The highway- crew has started brooming in the northeast section of
town along with cleaning ditches . Also , they have been working
on the landscaping at Bolton Point ,
Mr . Parkin noted that it looked like a 15 % increase in the price
of hot mix , this year .
Councilwoman Raffensperger asked about patching• Judd Falls Road ?
Superintendent Parkin stated that the hot patch plant opened a
week ago , so work will soon begin .
TOWN HIGHWAY COMMITTEE
Town Board Minutes - 5 - May 11 , 1981
Councilman Kugler reported that a Highway Cost Survey form had been
organized by Robert Parkin , Larry Fabbroni and himself . , The forms
and letters have been sent to forty Towns . As of today , he had
received fourteen responses .
COUNTY SOLID WASTE COMMITTEE
Councilman Kugler stated that the Engineer ' s Review Report was
received . It provided the necessary information for the Committee ' s
review of the background information and market study of the Biggs
Complex on the coal fired boilers conversion to gas .
He further stated that he was invited to attend the Four County
Solid Waste Meeting . Cornell University is now burning pellets
on a test basis . Eight pounds of pellets mixed with coal produce
a more efficient burning boiler than burning just plain coal .
Councilman McPeak asked if the pellets and coal were mixed on a
50 - 50 basis ?
Councilman Kugler said less than 50% .
Councilman Kugler stated that the pellets were produced in Maryland .
Three sites are being considered locally to manufacture the pellets
in this area . Any surplus pellets not used by Cornell , would be
. used by Watkins Salt Company . He further noted that there has been
no experience with storage of the pellets for a period longer than
two to three months .
COUNTY CABLE C0114ISSION
Councilwoman Kiefer stated that she attended a meeting of the
Commission in April . Another meeting has been scheduled for
July . The April meeting was not publicized , therefore , the public
was not in attendance .
Mrs . Kiefer noted that the new manager , Bradley Dusto addressed
questions regarding billings and complaints regarding the answering
of their telephones .
A new apparatus called a Parental Trap is available and the Manager
agreed to order a supply , if enough people are interested . There
is a $ 25 . 00 one time charge for the Trap , which will allow parents
to lockout Home Box Office ,
Supervisor Desch asked Councilwoman Kiefer to compose a letter for
his signature , requesting Mr . Dusto order and make available to all
interested people , the Parental Trap .
County Representative ' Freeman asked about the possibility of
extending new lines ?
Mrs . Kiefer stated that the company intends to carry out extensions , .
however , no time table for doing same has been set .
Supervisor Desch stated that he felt the time was coming to address
this problem .
Councilman McPeak asked if there was any discussion regarding the
replacement of older cable ?
Councilwoman Kiefer stated that some places were worse than the
Toj,rn of Ithaca and will be replaced first .
COUNTY REPRESENTATIVES
Town of Ithaca - 6 - May 11 , 1981
Beverly Livesay reported that the East Ithaca Bus midday service
is very successful , however , no numbers are available at this
time . . All bus runs will be reviewed in June .
She noted that the Biggs Complex is still hanging fire . _ Several
self - imposed deadlines have passed . Also , a committee on the
reapportionment has been appointed .
Gust Freeman reported that the Bottle Resolution was passed today
by the County Board of Representatives by a . 10 to 4 vote . The
Board will now recommend its passage by the State .
He noted that the elevator for the County Court House is in the
design stages . Also , the County has recinded their contract with
the local ambulance services . The Board felt a commercial
ambulance service would allow them to negotiate for flexible
prices .
DISCONTINUANCE OF HUDSON STREET EXTENSION AS A TOWN HIGHWAY
. Supervisor Desch read a letter from Peter Grossman regarding the
discontinuance of Hudson Street Extension . ( Copy attached to the
official minutes ) .
Supervisor Desch noted that the Highway Superintendent has completed
and filed his Statement of Findings and has signed the proposed
Order for execution . Also , the past resolution of the Town ' s intent
to abandon the property has . been filed .
RESOLUTION NO . 65
Motion by ' Supervisor Desch ; seconded by Councilman Del Rosso ,
RESOLVED , that the Town Board of the Town of Ithaca , in accordance
with the provisions of Section 171 of the Highway Law of the State
of New York , consent to the discontinuance of the town highway known
as the Hudson Street Extension in the Town of Ithaca , Tompkins.
County , New York , and release to Therm , . Inc . said road .

voting . Aye . Nays - none ) .
TOWN HALL ELECTRICAL EQUIPMENT
Supervisor Desch stated that an electrical inspection of the building
had been requested for the safety of the employees and the public .
There is a dynamic inflow of public into the building because of
the Justice Courts , Board meeting and public meetings being held
here . The building is vulnerable to fire as the attic is open .. and
the old part is a frame construction .
Supervisor Desch suggested that the Board consider installing a
fire alarm system .
Councilman McPeak spoke about sealing off the attic and installing
smoke detectors .
Councilman Kugler noted that smoke detectors were usually recommended
for dead areas .
Councilman Del Rosso questioned the possibility of installing
sprinklers in the building .
PESOLUTION NO , 66
Motion by Councilman Del Rosso ; seconded by Councilman McPeak ,
Town Board Minutes - 7 - May 11 , 1981
RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes
the Supervisor to obtain prices for the installation of a fire alarm
system for the entire Town Hall .

PERSONS TO BE HEARD
County Representative Gust Freeman stated that he would like to
thank Highway Superintendent Robert Parkin and Building Inspector .
Lewis Cartee for their quick responses when ever there is a' problem
in the Town .
County Representative Beverly Livesay noted that a person wishing
to use the Town ' s wheel chair ramp would find it difficult as usually
there is a car parked in the parking spot needed to approach the
ramp .
Supervisor Desch indicated that a sign denoting the parking spot
as an access to the handicapped would be installed .
REVISIONS TO THE TOWN HIGH14AY MAP
Town Engineer Larry Fabbroni noted that the revisions to the Town
Highway Map would be referred to the Town Board , at a later date ,
for their approval .
REFUND ON SPECIAL WATER AND SEWER BENEFIT ASSESSMENT
RESOLUTION NO . 67
Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger ,
RESOLVED , that a refund in the amount of $ 52 . 00 for one unit of
water benefit assessment and $ 50 . 00 for one unit of sewer benefit
assessment totalling $ 102 . 00 , be made to Leslie D . and Margaret S .
Sisson , 210 Forest Home Drive ( Tax Parcel No . 6'6 - 2 - 13 ) due to the
fact that the premises are now being used as a single dwelling
by the owner .

APPROVAL OF DEMOCRATIC AND REPUBLICIAN ELECTION INSPECTORS
Supervisor Desch noted that the Town has only received the list of
Republician Election Inspectors .

RESOLVED , that the Town Board of the Town of Ithaca hereby approves

ROADS TO BE ABANDONED OR ACCEPTED
Highway Superintendent Robert Parkin stated that . by June 15 , he must
file with the State , an Inventory of Roads . Hudson Street Extension
will be removed , King Road , West will be turned over to the Town
as soon as a clear title is received from the State . Strawberry Hill
Road will be added to the list if the Town - has the deed by June .
The Town Engineer will check with John Barney to ascertain the
status of the deed .
Verification on the deeds to Summerhill and Lis. a . .Lane ,will .be
completed and action will be taken at the June meeting .
RENEWAL OF BOND ANTICIPATION NOTE FOR FIVE AREA SEWER . IMPROVEMENT
Councilman Del Rosso stated. that he felt the bank was taking advantage .
of the Town and perhaps the Town should shop around for a better
interest rate .
RESOLUTION NO . 69
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the Supervisor to execute the renewal of Bond
Anticipation Note Number 4 for the Five Area Sewer Improvement
for a one year period beginning June 9 , 1981 , in the amount of
$ 470 , 000 , at a tentative interest rate of 92% .

voting Aye . Nays - none ) .
POSTPONEMENT OF SEWER CONNECTION REQUIREMENTS
Supervisor Desch stated that he had received . a letter from
Mr . & Mrs . George Pierro , 1549 requesting an extension of time
before being required to hook up to the sewer and also requested
the Town to extend the sewer line to -meet their property line .
Councilman Kugler asked if they were the last people on the line ?
Town Engineer Fabbroni stated they were the last people on the. line and
he felt the line should be brought to their property line .

RESOLUTION N0 . 70
Motion by Supervisor Desch ; seconded by Councilman Del Rosso ,
RESOLVED , that the Town Board of the Town of Ithaca hereby grants
an extension of one year to Mr . & Mrs . George Pierro of 1549
Slaterville Road before being required to hook up their property
to the municipal sewer lines .
( Desch , Kugler , Raffensperger , Del Rosso , Cramer , McPeak and
Kiefer voting Aye . Nays - none ) .
TEMPORARY SUMMER HELP
Town Engineer Fabbroni stated that Peter Lovi was about 80% completed
with the Records Management project and he estimated another 200
hours would be needed to complete the project .
Also , as it is impossible for Michael Ocello to complete by himself ,
the remaining work needed to complete the survey and design work
needed to finish the Parks Project , he was requesting an interim
approval for funds to pay work study students Susan Beeners and
Richard Schock and authorization to execute a contract with Cornell
in the amount of $ 1 , 200 on a 50 - 50 basis .
The CETA Program is uncertain at this time , he noted . However , he
stated that he was asking for a blanket authorization for 1200 man .
hours at $ 4 . 50 per hour .
Supervisor Desch noted that the 1200 man hours was a budget item ,
and that authorization was needed so that the summer work schedule
could be planned .
Councilman Del Rosso asked the Town Engineer how the part - time help
was supervised ?
The Town Engineer responded , saying they were supervised by . the
work study students or the Highway personnel .
RESOLUTION NO . 71
Motion by Councilwoman Raffensperger ; seconded by Councilman
Kulger ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the expenditure of funds in the amount of $ 1 , 500 ,
calculated at approximately 200 hours times $ 7 . 50 per hour ,
for the continuation of the Records Management Project by
Peter M . Lovi , and
FURTIIER RESOLVES , that the Town Board approves the execution
of the contract with Cornell University in the amount of
$ 1 , 2. 00 on a 50% - 50 % basis , for two work study students ,
namely Susan Beener and Richard Schock , plus $ 385 for Ms . .
Beener and $ 770 for Mr . Schock , this amount to be used in
the interim in conjunction with the contract . Ms . Beener_
to be paid for approximately 70 hours at the rate of $ 5 . 00
to $ 5 : 50 per hour and Mr . Schock to be paid for approximately
14-9 hours at the rate of $ 5 . 00 to $ 5 . 50 per hour . The
additional amounts to be paid from the ToxAm of Ithaca Budget,
and

FURTHER BE IT RESOLVED , that the Town Board authorizes the
expenditure of $ 5 , 400 for 1200 man hours at approximately I
$ 4 . 50 to $ 5 . 50 per hour . This amount to be expended from
the Park Reserve Fund and to be dispensed with at the
descretion of the Town Engineer .

PUBLIC HEARING TO CONSIDER THE ADOPTION
OF PROPOSED AMENDMENTS TO THE ZONING ORDINANCE
Proof of posting. and publication notice of a Public Hearing to
consider the adoption. of proposed amendments to the Zoning Ordinance
having been presented by the Town Clerk , the Supervisor opened the
Public Hearing .
Supervisor Desch reported that at the April 28 meeting , the Board
appointed a Subcommittee to look into specific situations and then
report back to the Board . Listed below are the list of t13e sub -
committees recommendations .
All parcels involving proposed changes from more intensive Industrial. ,
Commercial , or Multiple - Family zoning to Residential or Agricultural zoning -
or from Residential or Agricultural zoning to more intensive Industrial ,
Commercial , or Multiple - Family zoning were examined . Several categories
evolved as an overall framework for the actions herein recommended .
1 ) In the case of properties rezoned with or without specific site pi A=
considered on which no development has occurred , and where comprehensive
public works , such as utilities , highways , and drainage , exist to support
such activities , the new zoning designation would match the old zoning as
nearly as possible . These zoning designations would be kept in these
designations for . a five - year period , at which time the zoning would
revert to the designation closest to the zoning existing before the
original zoning action in question . This means the following changes
will be added to the present map : .

Mr . Herbert Monkemeyer asked when the proposed changes would be
passed . He further stated that he came to the meeting tonight
expecting to be in one zone and then finds out , only tonight ,
that he is now in a B - 1 zone .
Mr . Monkemeyer stated that he did not understand the reasoning .
What if he had not attended the meeting tonight , he would not have
knocm of the proposed change . He further stated that he had a
development proposed for the area in question , and would not want
the change in zoning to interfere with his negotiations . He stated
that a zoning change could stop one of the finest projects that
has ever been proposed for this area .
Evan Monkemeyer asked if there was an existing zoning map ?
Supervisor Desch answered yes .
Evan Monkemeyer asked if the map was . scaled ?
Supervisor Desch answered no , no meets and bounds were required .
Mrs . Grey asked for a definition of the requirements and restrictions
of a Business 3 zone .
Supervisor Desch stated that a description of a Business 3 zone
will be prepared .
Supervisor Desch noted that two areas were zoned Heavy Industrial ,
and that junk yards have been removed . They will be permitted
only by special permit .
Supervisor Desch stated that under the existing zoning ordinance ,
most of Cornell ' s property is included under the R- 30 zone . It
was felt that it was in the Towns best interest to be in a position
to understand Cornells activities and not be to exc'ess. i:vely . restrictive
therefore , a P zone wi ll :: .be Ins.tirtuted .
The residential neighborhoods must be protected , however , from
encroachment by the college . The P - 1 zone involves most of the
block of Cornell property . This zone does not restrict side yard
and height .. The P - 2 zone is more restrictive , imposing height ,
side yard and parking restrictions . A 500 foot buffer zone is .
proposed for the P - 2 zone .
Shirley Egan stated that both Cornell University and the Town were
. interest in establishing a buffer zone , however , she felt 500 feet
was inappropriate . She suggested that 50 feet would be a more
appropriate figure .
Mrs . Egan stated that she felt there was no objection on Cornells
. part to the R- 30 zone , if the definition of the R - 30 zones remained
the same . She further noted that she felt it would take two to
three months to solve all the problems of the P zones . She urged
the board to take its time , saying if its worth doing at a1T , it
worth doing right . Mrs . Egan stated that 500 feet was a lot of
their land , and that Cornell might not be able to add a wing on
a. dormitory .
Mrs . Egan went on to say that the Boards could see the light at
the end of the tunnel and she could understand. why they would be
anxious to adopt the law . She appealed to the good sense of the
Board to look out for Cornell ' s interests . All residential zones
have permitted Cornell development . Residential districts have
been coming up to Cornell land , not Cornell coming up to them .
Sh.e . further noted that Cornell had been here longer. than most
residents .
Mrs . Egan added that Cornell has a lot of people who are ready
and able to help . They are willing to do anything you want done .
She pleaded with the Board not to leave Cornell with a band - aid
solution to zoning needs .

Supervisor Desch stated that protection was needed for both the
property owners and Cornell . He further noted that the Forest
Home area was a good example • of an area with severe problems .
Problem areas like Forest Home can develop and , therefore , the
perspective of this must be kept in mind . Supervisor Desch
agreeded that the Board would take Mrs . Egans comments into
consideration before finalizing the law .
Councilwoman Kiefer asked if Cornell was voluntering to . draft
something ?
Mrs . Egan stated that Cornell was willing to offer more than the .
average taxpayer . They are willing to work together . Cornell
is willing to shoulder the burden . However , Cornell need constant
feedback so that they do not end up in left field .
Supervisor Desch stated that the Subcommittee would . take a look
at the P - 1 and P - 2 zones inregard to the buffer zone and decide
how best to formalize a policy .

RESOLVED , that the Town Board of the Town of Ithaca will meet and
conduct a public hearing on May 27 , 1981 , at 7 : OO P . M . , ' at the
Town Hall , 126 East Seneca Street , Ithaca , New York , to further
consider the adoption of amendments to the Zoning Law .
