REFUNDS ON 1981 TAXES Supervisor Desch noted that Daniel 0 . and Letty J . Slagle , of 125 West Haven Road were billed , in error , for benefit sewer units on their 1981 taxes . Further , Mr . Mildred Keiffer of 253 Stone Quarry Road by resolution of the Town Board on May 12 , 1980 was granted a re - duction on the water benefit assessment . However , through an error ® they were not reduced on the 1981 tax roll . RESOLUTION NO . 1 Motion by Supervisor Desch ; seconded by Councilman Del Rosso ., RESOLVED , WHEREAS Daniel 0 , and Letty J . Slagle were billed and have paid $ 100 . 00 for sewer along with 1981 taxes , and WHEREAS , the Town of Ithaca Water and Sewer Benefit Formula states that a property such as the Slagle ' s , 125 West Haven Road , should be classified as undeveloped acreage served by sewer only within 1 , 000 feet of the main at 1 / 6 unit per acre or . l units for this property in particular , NOW THEREFORE , BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes that 1 . 9 x $ 50 or $ 95 . 00 be refunded to the Slagles for 1 . 9 unites overcharged . Town Board Minutes - 2 - January 120 1981 ( Desch , McPeak , Del Rosso , Raffensperger , Cramer , Kugler and Kiefer voting Aye . Nays - none ) . RESOLUTION NO . 2 Motion by Supervisor Desch ; seconded by Councilman Del Rosso , RESOLVED , WHEREAS the Town Board by resolution of May 12 , 1980 , agreed to reduce water benefit assessment for 253 Stone Quarry Road from 5 . 8 units to 3 units , and WHEREAS , such change was not made in preparing 1981 tax bills , and . WHEREAS , Mrs .. " ,Mildred Keiffer has paid her 1981 tax bill . in full , noting the above error , NOW THEREFORE , BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes that 2 . 8 x $ 50 or . $ 140 . 00 be refunded to Mrs . REPORT OF TOWN OFFICIALS Supervisor's Report Supervisor Desch stated that he would like to welcome Dooley Kiefer to the Ithaca Town Board . I am confident you will find the Ithaca Town Board a most rewarding experience . We look forward to a continued excellent working relationship as . a . team in 1981 . We have a busy agenda for the year and it will take extensive participation by the entire board to get the job done . We are writing another chapter on the matter of our long overdue finar reimbursement for the Five Area Sewer Project . Larry Fabbroni had a call requesting yet another piece of information - a statement of our user charge structure which we submitted in late 1977 , a necessity in order to get construction money ! What makes this more frustrating is that we were told on November 25th. that everything was in order and - we would receive payment in three to four weeks . . Our patience has run out , so I met with Sam MacNeil on Saturday and gave him the pertinent information so that he could pursue the matter We will not be meeting again until after the East Ithaca . bus run is scheduled to start operation on January 26 . The County Board has approved their allocation , as of today , and authorized a $ . 35 fare to be designated in the contract . The people in East Ithaca area making every effort to get the publicity out to give us the best possible chance of succeeding on this pilot program . I , therefore , ask for your authorization to execute the contract that will be prepared over the next two weeks , providing the fare is $ . 35 , our total share is $ 7 , 000 for the year , Cornell administers the accounting and the subcommittee presents a status report by June 1 , RESOLUTION NO , 3 Motion by Councilwoman Raffensperger ; seconded by Councilman Cramer , RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the Supervisor to execute a contract for the East Ithaca bus run for the budgeted amount of $ 7 , 000 , and FURTIOER BE IT RESOLVED , that the execution of said contract be continguent upon the fare being $ . 35 , that Cornell University administers the accounting and that the subcommittee present a status 1980 ANNUAL REPORT OF THE TOWN HIGHWAY SUPERINTENDENT , ROBERT E . Nays - none ) . Supervisor Desch continued his report by saying that we note in one of the Town Bulletins that Federal Revenue sharing was. approved by _ Congress but not yet signed by the President . However , checks are to be mailed on January 8th directly to each municipality . We have . not received ours yet , nor do we have any guidelines . In the event that we do receive . one , we will put it in a CD until the guidelines are received and we know what use hearing , etc . . , are necessary . I have written to the Vice . President of Cornell and Ithaca College to urge them to respond with their commitment to work with us to bring into balance their contribution for fire service in relation to the needs we are asked to provide . I would , therefore , suggest that we adjourn this meeting on a day to day basis so that we can consider setting a public hearing at our February 9th meeting on the matter of assessing for false alarms , extra levels of service , etc . - Councilman McPeak asked who defines false alarm , etc . Supervisor Desch responded that the City keeps a log . He further noted that he felt this log was a powerful incentive in the negotiations with Cornell University and Ithaca College , Town Engineer ' s Report Town Engineer Larry Fabbroni stated that as the weather has not been very good lately , not too much has been completed on the Cliff - Street Pump Station . A decision has been made to install a second pump capable of meeting foreseeable demands for water on West Hill . In the next few weeks , the Board will be asked to authorize this change order . The Town Engineer felt the change order would only add up to a $ 2 , 500 to $ 3 , 000 difference for a matched pump . Mr . Fabbroni noted that considerable staff effort and time has been spent on a technical study for the East Ithaca Circulation improvements in regard to future - corridors and the ' need for same . The staff is also working on Town of Ithaca water system maps with the Bolton Point staff , park deeds and titles . Highway Superintendent ' s Report ® Highway Superintendent Robert Parkin presented his . 1980 Annual Report '. ( copy attached to these minutes ) . Mr . Parkin reported on projects completed in 1980 . The conversion of the Town Highway Facility to natural gas has been completed , along with the salt storage shed . The fuel oil tank has now been converted to unleaded gasoline . Work has been completed on the ladies room . Also , the truck load limit signs were installed in the Forest Home area , along with the signs on the bikeways . The men worked on such projects as the bikeways , parks , cleaning ditches and brush cutting during the year . The Highway Superintendent stated that he was asking for the Boards approval to advertise for bids on a new car for his use . Repairs on the present car are now getting rather costly . Councilman Cramer asked the Superintendent what size car was he looking for ? Town Board Minutes . - 4 - January 12 , 1981 Mr . Parkin responded by saying about the same size that I now have . Councilman Kugler asked Mr . Parkin if he was interested in front wheel drive ? Mr . Parkin responded definitely yes . Mr . Parkin noted that he would also like Board approval to purchase two radio units . One to be installed in the new # 10 pick up ; the other in his vehicle . RESOLUTION NO . 4 ® Motion by Councilman Kugler ; seconded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the Highway , Superintendent to advertise for bids for a new vehicle for his use , purchase of said vehicle being budgeted in the 1981 Budget , and FURTHER BE IT . RESOLVED , that the Town Board authorizes the purchase of two additional radio units to be installed in the # 10 pick up and the Highway Superintendent ' s vehicle. ( Desch , McPeak, Del Rosso ,. Raffensperger , Cramer , Kugler and Kiefer voting Aye . Nays - none ) REPORT OF COUNTY OFFICIALS County Representative Beverly Livesay reported that the fare , as noted by Supervisor Desch , for the East Ithaca Transit System route , has been set at $ . 35 . She further noted that discussions were underway as to who will be the County Representative on the East Ithaca Circulation Improvements Committee . . A resolution adopted by the County stated that the Chairman of the Board or a designated member would serve as a member of the Committee . Supervisor Desch stated that he would talk to Harris Dates regarding this matter . f Mrs . Livesay stated that she felt there was a definite need for the municipalities to work together . ASSOCIATION OF TOWNS MEETING Supervisor Desch reported that Councilwoman Kiefer , Planning Board Chairman Montgomery May , Town Clerk Jean Swartwood and he would represent the Town of Ithaca at the Association of Towns Meeting in New York City , February 15th , 16th , 17th and 18th . He further stated that the banquet was very expensive and that he could not justify spending that amount of money . Therefore , he would not be attending the banquet . RESOLUTION NO , 5 Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger. , RESOLVED , that the Town Board of the Town of Ithaca does hereby certify that the Torn Board of the aforesaid Town has duly desig - nated the Town of Ithaca Supervisor Noel Desch as the person named to attend the Annual Business Session of the Association of Towns of the State of New York , to be held at New York City , on February 18th , 1981 , and to cast the vote of the aforesaid Town , pursuant to Section 6 of Article III of the Constitution and By - Laws of said Assoclat. ion . 1 . Party of the first part will lease kennel space pursuant to Section 115 of the Agriculture and Markets Law , will maintain the shelter or pound for seized dogs and for lost , strayed or homeless dogs ; Will humanely destroy or dispose : . of , pursuant to and as provided in Section 118 of the Agriculture and Markets Law , seized dogs not redeemed as provided in Article 7 . of such law , and it will properly care for all animals in such shelter , which shall . at times during the terra hereof . be under the care and charge of a competent employee and shall be open to . the public daily , legal holidays excepted , Mondays through Fridays from 1 : OO P . M . to 5 : 30 P . M . and Saterdays ff;om 1 : 00 P . M . to 3 : 30 P . M . The. above will be done under the direction and supervision of the Dog Control Officer. , 20 Party of the first art will open the kennel for emergency service on a twenty- four ( 24 hour basis , seven ( 7 ) days per week for emergencies such as sick , injured and vicious animals . 3 . Party of the first part will provide counter space and a full time desk person to assist the warden and handle the base re . neater radio . The desk Derson and kennel personel will also assist in showing dogs for adoption_ . 4 . Party of the first part will provide care , housing:, and transportation for non - dog control under seperate contract with Tompkins County for $ 20 , 000 . 5 . Three New vehicles will be provided , including repeater radios , . all necessary catch equipment , and . cages . All gqs , oil , maintainance9 insurance , and radio repair wii The contract would provide all the services which you now have for enforcing Art . 7 . These services and pound space would cost the towns $ 15 , 680 . In addition the towns would appoint three wardens or more accurately one warden and two denuties . The andicipa- ted saleries are a totle of 4,* 33 , 000 . of which a deputy or . c11 , 000 would be paid for by the City of Ithaca . The total cost to the towns would be $ 65 , 6$0 as opposed to over $ 70 , 000 for the S . P . C . A . proposed contract . Under this proposal the coverage would be Approximately twice that proposed in the . S . P . C . A . cotract . With this proposal the towns have far more say in the type coverages they want over and above the Art . 7 requirements . An additional benefit would be approximately .$1 , 700 returned to . the _towns in the form of dog adoption revenues ( 470 dogs at $ 10 . 00Jdog7 ` now retained by the S . P . C . A . Nays - none ) . Supervisor Desch . requested that each Board member look over the proposed 1981 Legislative Program and inform him of their opinions . on the resolutions . to be presented to the voting delegates . DOG CONTROL SERVICES Willis Hilker presented his alternate proposal :for Dog Control ( a copy attached to these minutes ) . ® Mr . Hilker proposes to provide kennel space , maintain shelters for dogs , disposal of dogs , seizer of dogs , and a competent staff to care for dogs housed in the kennel . In addition , he will provide desk service full time . and three vehicles equiped with radios , cages , etc . Mr . Hilker feels that he will be able to provide all services that are provided in our present contract and all of the requirements of Ag and Markets , . and save the Town $ 7 , 000 . Supervisor Desch asked Mr . Hilker if he would be presenting his proposal to the County ? Mr . Hilker said he had scheduled a meeting with Jim Mason , Supervisor Desch asked Mr . Hilker what space he would lease for kennels ? Mr . Hilker responded that he had a place on Route 366 in Varna in mind for leasing . - - Councilman. Del Rosso asked Mr . Hilker if he was setting this up as a private enterprise and would he provide competant people on the staff ? Mr . Hilker answered yes . A *veterinarian will be at the facility three times a week and more if necessary . Also , Cornell University veterinary students would be hired as staff personnel . Councilman Del Rosso - asked if there were any records of calls to the Town ? Supervisor Desch said no . - Councilman Del Rosso said we should obtain these figures , as we need to know the cost per case . Supervisor Desch noted that in the past two years the number of complaints have gone down to almost zero . When he first became Supervisor he was receiving more dog complaint calls than anything ® else . Supervisor Desch asked Mr . Hilker if he was prepared to take an enumeration of the dogs in the Town of Ithaca ? Mr . Hilker stated that he felt there were problems with the enumeration and this was why he did not include it in the proposed contract , however , lie did intend to do the enumeration . In fact , he felt- the dog wardens would have time during the regular working hours , along with their regular duties , to take the enumeration . "However , if this schedule does not work , something else would be worked out . Councilwoman Raffensperger asked if dog control could be put on. t:he agenda for some future meeting , when Mr . Supervisor Desch presented the Committee Charges and Objectives for 1981 . - Committee Charges Highway & Safety The primary charge of this Committee for 1981 , will be the completion , by 1982 budget preparation time ( 8 / 1 ) , of a : comparative survey of highway department costs with Toms of comparable size , density , population , etc . The review will include a refinement of the 10 year highway repair program and the 10 year equipment replacement program to ensure that the funding levels are proper and that the planning cycle v ill. result in the most cost effective allocation of Town resources . Where possible , the highway maintenance program will consider improvements in safety , such as guard rails , signage and widening of shoulders . Such considerations will recognize increasing interest in jogging , bicycling , etc . Fire and Youth These two primary functions are combined in one Committee since the City representatives , for the most part , are the same for both functions . In 1981 , the Committee shall Pursue _ the following efforts : - - Fire . 1 . Complete details of 3 year fire contract with the City . 2 . Complete conceptual plan for new fire stations on South Hill and [,Test Hill . 3 . Secure proper in lieu ` of payments for fire service from Ithaca College and Cornell . 4 . He noted : 7 , 7the . ha . ard problems of holding snow and wind blowing the trees over onto the road . The Committee will limit its efforts to a feasibility study . Councilman McPeak asked what were hazardous Building Codes ? Supervisor Desch responded , buildings that are dilapidated . . Councilwoman Raffensperger noted that all Zoning Ordinances must have a Solar Access Ordinance. and that the State says you must- take this into consideration . ® Supervisor Desch stated the Solar Access must be included in the Zoning Ordinance before it is finally adopted . The Guidelines just arrived today , and after the Town Engineer has a chance to review them , we will be able to tell more . ® . Supervisor Desch noted that the old railroad track between Aurora SL" reet and Buttermilk Park can be utilized for drainage , as well as for a bikeway . Supervisor Desch further noted that the load capacity of the bridge on Burns Road had dropped to a three ton ratingO There ar. e . traffic problems because of the blind curve . Also , the intersection with Slaterville Road is very dangerous . The Supervisor noted that a local law should be considered this year , which would enable the Town Board to utilize Town funds to defend local officials . The Solid Waste Facility should be added to the Planning Studies projects on the 1981 Objectives . The Supervisor stated this project will not be an easy one , it will take a lot of time and planning . Councilman George Kugler is the Town representative on the Solid Waste Committee . Councilwoman Kiefer stated that she ' would be interested in serving on this committee , should a vacancy occur . RESOLUTION N0 . 8 Motion by Supervisor Desch ; seconded by Councilman Kugler , RESOLVED , that the Town Board of the Town of Ithaca hereby approves the 1981 Objectives as presented by Supervisor Desch , and FURTHER BE IT RESOLVED , that Solar Access and the : Solid Waste Facility be added to the list of 1981 Objectives . RESOLUTION NO . 9 Motion by Supervisor Desch ; seconded by Councilman Cramer , RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the Committee Charges as presented by the Town Supervisor . ( Desch , McPeak , Del Rosso , Raffensperger , Cramer , Kugler and Kiefer voting Aye . Nays - none ) . PUBLIC HEARING TO CONSIDER THE APPROACH TO BE USED TO BUILD , OPERATE AND MAINTAIN THE NEW $ 30 MILLION WASTEWATER TREATMENT FACILITY . Proof of posting and publication of notice of Public Hearing to consider the approach to be used to build , operate and maintain the new $ 30 Million Wastewater Treatment Facility having been pz -� sented by the Town Clerk , the Supervisor opened the public hearing . Town Board Minutes - 11 - January 12 , 1981 Supervisor Desch stated that he was proposing that the Board consider Scheme III for the new Wastewater Treatment Facility . And that he was seeking authorization from the Board to write the City proposing the facility be jointly owned but operated by the City . The Supervisor further noted that Step II work cannot proceed until a decision is made on how the plant will be owned and maintained . Town Engineer Fabbroni explained Scheme III , saying the plant when " built would have reserve capacity to supply the future needs of the municipalities , In Scheme III , everybody pays a fixed portion over. the life time of the bonds , for this fixed initial capacity . The remainder , or spare capacity , would be split up on a proposed basis initially . The Town would pay on a scheduled basis , every year for its share . ® Anentity would be reimbursed , every year , for what a municipality had paid for spare capacity ', for the portion , of that spare capacity needed by another entity . Therefore , . Supervisor Desch noted that a municipality would be penalized if their system is not in good shape before the facility is put in operation . Also , the annual operating costs will be on usage , if a system leaks a municipality would pay more annually . If the system is not in repair , it may cause them to pay more . He further noted that he felt it is likely the City ' s usage would not expand appreciably , however , he felt the Town would use its own spare capacity , in the future . Depending on growth and where it occurs , and how it relates to sewer use , Torn Engineer Fabbroni noted that under Scheme II you could be carried by the other parties , therefore , this led to Scheme III . Supervisor Desch stated the system could be operated under the advisory approach or joint ownership approach . Supervisor Desch asked how the Board felt on the issue . Councilman Kugler stated that he felt timing was a very important issue . The Town must take a stand . Supervisor Desch stated that he did not want the Town to be put in the position that they cannot make up their mind . If a Sewer Board is formed , an intermunicipal agreement must be drawn up . The Sewer Board will have to address the problem of the City ' s present sewer system . Beverly Livesay asked about the septage disposal portion and who would pay ? Supervisor Desch stated the County has local share of capital fund . Also , a disposal fee will be charged . Mrs . Livesay asked who would represent the County ? ® Supervisor Desch answered Frank Liguori . Councilwoman Kiefer asked about Scheme I and II . Saying she was not opposed to Scheme III , however , she was just not persuaded Scheme III was better . She further stated that she had no figures to substantiate that a joint operation would cost less than a system run by the City . She asked if there were any documents ? Supervisor Desch stated that the City ' s accounting system does not allow a breakdown in figures . He further stated that experience was the best teacher . To have a voice in the operation , the Town would beable to . pinpoint costs and where they belonged . The City does not breakdown the different categories . Town Board Minutes - 12 - January 12 , 1981 Town Engineer Fabbroni noted that the Town has never received any information to substantiate the rate and half water increase . Joint ownership would require accountability . The Town can take steps if not accountable under joint ownership . Supervisor Desch noted that the City increased the water rate , however , they decreased the sewer rate . He considered this a political move . In a joint ownership , the Town would have a say in the final decision . Councilwoman Raffensperger noted that this proposal is not the end of the road , a lot more compromises may be - ,appropriate before finalization . RESOLUTION NO . 10 ® Motion by Councilwoman Raffensperger ; seconded by Councilman Cramer , RESOLVED WHEREAS , the City of Ithaca and the Towns of Ithaca and Dryden formed a joint Sewer System Planning Committee in March 1978 , to develop at least two alternatives for the ownership and operation of the new Wastewater Treatment Facility serving a major portion of the greater Ithaca area , and WHEREAS , the Sewer System Planning Committee , following in depth study and negotiations , has presented two alternatives for con - sideration by the governing bodies of the three municipalities , NOW THEREFORE BE IT RESOLVED , that the Common Council of the City of Ithaca and the Town Boards of Dryden and Ithaca accept the joint ownership alternative proposed by the Sewer System Planning Committee including the Scheme III Plan for the allocation of the debt for the new plant , providing further , that the City of Ithaca through its Department of Public Works shall operate the plant , and BE IT FURTHER RESOLVED , that a joint Sewer Board is hereby formed consisting of 4 members appointed by the Common Council of the City of Ithaca , 2 members appointed by the Ithaca Town Board and 1 member by the Dryden Town Board . Of the members so appointed , at least one member from each municipality shall be an elected official from the governing body of the appointing municipality , except that at least two members from the City of Ithaca shall be elected officials from the governing body . The voting method shall be as recommended in the SSPC proposal , BE IT FURTHER RESOLVED , that the Step II grant be accepted in the name of the City of Ithaca as grantee and the firm of Stearns and Wheler be designated as the engineers . Nays - none ) , PUBLIC INFORMATIONAL HEARING TO CONSIDER THE ADOPTION OF PROPOSED AMENDMENTS TO THE ZONING ORDINANCE Town Board Minutes - 13 - January 12 , 1981 Proof of posting and publication of notice of Informational Public Hearing to consider the adoption of proposed amendments to the Zoning Ordinance having been presented by the Town Clerk , the Supervisor opened the Informational Public Hearing . _ Town Attorney James Buyoucos stated that prior to 1970 , there was a wide definition of a family . So broad that that the inevitable happened , it went to court . The decision was upheld in the lower court , however , that decision was reversed in the Appellate Division . Following the euphoria of the 1960 ' s , when the establishment was questioned , it became clear that a change was necessary . Mr . Buyoucos noted that he made a decision on a family . That being , that a family ® was one or more persons related by blood or marriage . A 1974 Supreme Court decision held that this notion of a family was traditional . One further provision noted that two persons who maintain a common cooking facility was a family . He further noted that the 1974 Supreme Court decision took a re - strictive definition stating that a family is defined as a . group of people related by blood , marriage or adoption , living together and cooking together . Councilwoman Raffensperger noted that she did not understand the phrase living and cooking together in order to establish a family . Why cooking together ? Mr . Buyoucos stated that he took the words out of the U . S . Supreme Court decision . He felt the cooking together was to get away from the idea of a rooming house . . Councilwoman Kiefer asked if there was a definition of a single housekeeping unit ? Attorney Buyoucos responded no . One kitchen in a house which is central for a family . Supervisor Desch asked about the number of unrelated persons . Mr . Buyoucos stated if the owner does not occupy the house , only rent it , then four unrelated persons can occupy the house . Mrs . Ann Pendleton asked if there was a definition of a one family unit ? Mr . Buyoucos answered , a dwelling designed for one family , no structure size . Beverly Livesay questioned owner occupied restrictions . ® James Buyoucos noted that in every case the reason for problems were the owner wants to put more people in a house because of economics . Mr . Cotts questioned , the new Zoning Ordinance now increases the number of people ? Mr . ,Buyoucos answered yes , by one . Mr . Buyoucos further stated that with the community and the number of people going on sabbatic and then renting their property , a provision will have to be made in the Zoning Ordinance for a special permit to accomodate more occupancy under these conditions . Mr . Cotts asked , if a family consists of a married couple ( owner ) how many more people could live there ? Town Board Minutes - 14 - .January 12 , 1981 Mr . Buyoucos answered three in a one - family house , four in a two - family house . Mr . Cotts then asked how do you count the unrelated , if two are _ married ? Mr . Buyoucos answered , by common sense . ® Nancy Fuller noted that the occupancy of the home , by the owner , was the key to the extra persons . Beverly Livesay questioned a single family home owned by a married couple with another couple and child occupying the residence . Is this permitted Under Article IV of the Zoning Ordinance ? The Town Attorney answered yes , Supervisor Desch asked for the reason regarding the change of four unrelated persons to three unrelated persons in owner occupied two - family dwelling . Mr . Fabbroni stated the figure was changed to three because four would encourage persons to change a dining room into another bedroom . Mr . Cotts asked if the definition of a family , as stated on page four of the 'Zoning Ordinance was still to be used ? Mr . Fabbroni stated the definition had changed a little . It closes doors and puts in cooking restrictions on unrelated persons . Town Attorney Buyoucos felt that the definition of a two family dwelling needs refining . Richard Pendleton asked where children come in ? Mr . Buyoucos said children were exempt . Mr . Zaitlin asked about two family units built with two water and two electric meters . This would be an indication of a two family house by the number of meters . Mr . Buyoucos answered , what if you build a house , then add an apartment . He felt this was not a good indication , as the owner could have only one meter installed initially , then pay the utilities on the apartment . Mr . Fabbroni noted that the problem was , does the Town want one family districts . If so , then one family districts should be established . Mr . Pendleton noted that two houses are built at the same time , one house has two meters for electricity the other only one . There are no set patterns on meters . Mr . Cotts felt that if the two separate livings units were identifiable , the question of separate meters did not bother him . RESOLUTION NO . 12 Motion by Supervisor Desch ; seconded by Councilman Del Rosso , RESOLVED , that the Town. Board of the Town of Ithaca hereby establishes a date for the public hearing on the consideration of the adoption of the proposed amendments to the Zoning Ordinance until February 9 , 1981 , at 7 : 00 P . M . Town Board Minutes - 15 - January 12 , 1981 ( Desch , McPeak , Del Rosso , Raffensperger , Cramer , Kugler and Kiefer voting Aye . Nays - none ) . Councilwoman Raffensperger felt the Zoning Ordinance needs to be written in more understandable language , as she noted some of the definitions were difficult to understand . Mr . Buyoucos felt the Board should come to definite conclusions on the questionable areas before holding public hearings . CLOVER LANE LIGHTING DISTRICT Supervisor Desch noted that the Town had received a request from the residents of the Clover Lane area noting interest in the creation of a two light lighting district . Swartwood Town Clerk Proposed Statements for 1981 Legislative Program State Shared Revenue : The State Legislature and the Governor should immedi- ately take action to restore State Shared Revenue allocations to local - government to the full amount of 81'. of total state tax revenues in compliance with Section 54 of the State Finance Law . Reviving State Sewer 0 ' & Psi Aid : This aid program has . been totally eliminated , and the full 0 & M cost rests on the local taxpayer . The state should re-establish an equitable formula in aid of the 0 & t•: costs of these treatment plants and inter- . ceptorse More Equitable Toc,_t :33g,A�°sy Aid : It is . obvious that a total revamping of the state highway aid program is essentialo Until this is implemented , the _.present Town Highway . Improvement Program (THIP ) , meager as it is , should be extended for at least a three or five-year period . Revise OSHA : The effective date of the new State OSHA , law should be delayed until proper studies of safety hazards are completed , safety performance . standards are devised and adequate state aid for compliance are provided . Resolving Real Property Assessment Problems : The court mandate of " full value" assessment and the Legislature ' s failure to develop appropriate solutions . have left local assessing units in the difficult - dilemma of not knowing what course of . action to take . Tax shifts from ccmmercial properties to residential ones are feared . Disparity in taxes paid by owners of similar properties located in differ- ent tax districts is unfair and should be cured . The courts 'should not be required to solve these problems . It is not desired that the state furnish solutions , either . The state should , however , furnish guidelines for uniform standards of assessment . In helping to achieve the implementation of such uniform standards , the state should provide aid up to 50% of the cost of revaluations and mainten- ance . Assessing units which have paid for revaluation programs should be similarly aided retroactively . Opposin Bir_ding Arbitration : The temporary provision. for binding interest arbitration of labor disputes between local municipalities and paid police and firemen should not la. extended beyond July 1 , 1981 , nor should this . on.rous con- cept be extended to disputes in the public sector with otter categories of local public employees . Redefining "Surervi .� ory" Personnel : The present definition, of "management- . confidential" in the Taylor Law should be broadened so that the public - employer would be able to designate those public employees which are clearly managerial in nature . Limitation . on Taxes Por Purchases of Toc•.m Hi hway Ec,uipnent : Highway Law , § 271 now limits the amount of money a town may raise by tax in any one year for the purchase of town highway equipment . Either Highway Law , § 271 should be repealed or . the basic limitation raised to a realistic amount in the light of present day inflated costs . 'own Board Role in Village Incorporation and DisK9616tion : Under existing law , a village may be incorporated and dissolved without meaningful town board participation . Legislation should be enacted giving town boards authority to determine overall public interest in any proposed village incorporation and dissolution . ` 2 Elimiriatori 'of = Sate Mandates : It has been estimated . that over '. 5 , 000 state man- dates on local government appear " on the books " today ; i . e . OSHA , SEQR , mandatory . training of peace officers , binding arbitration , real property tax exemptions , etc . Action should be taken for the systematic reduction or . elimination of un essential . mandates ; state funding be provided for any new ones imposed by the state on local governments .` Prohibiting Non-Returnable Beverage Containers : The use of. non-returnable beverage containers has expanded in recent years and contributes substantially ' ' ' to the littering of our streets and public - places . The removal and disposal of theselcofitainers is :- a 'costly . local effort . - - The adoption of statewide legislation "prohibiting the use of non-returnable beverage containers is strongly recommended . Taxation of Leased State Lands : The development of a comprehensive policy I. = = on taxation .- of state-owned lands , including lands leased to private persons , is dl : essential : Flexibility in Civil Service Appointments : The Civil Service Law presently requires - the - appointment and promotion of public employees from the first three eligible candidates on any approved list after examination . Local units should be authorized to appoint and promote personnel .from the first 10 on any approved 41 1 Mandatory - Fiscal Analysis : Currentiy , when state legislators consider pro- . posed legislation imposing new local expenses, they have no knowledge of local fiscal impact of . such . legislation . They vote on these measures blindly which could ' have I' ll a substantial impact on local expenditures or revenue . A local fiscal impact analysis should accompany all legislation . 'Agency Shop Fee Deduction : The present provisions of the Civil Service Law authorize local government employers to negotiate agency shop .fee deduction with _ their municipal employees . ' This provision expires October 1 , 1981 . There is no justification in having this item a mandatory object of negotiation . The agency ' shop ' concept' should be left as an optional negotiable item and not mandated . across = the board for all local governments. Town Court Fees : Town courts provide litigants ready access . to judicial process at reasonable cost . — These courts perform important functions as part IN of our state ' s unified court system . The fees remitted to . towns by the state . for processing cases involving violation of state laws have not been increased in over 40 years . Such tees should noon be increased to offset higher costs and to alleviate the burden from the real property taxpayer . sIII. IF
