At a Regular Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held on the 8th day of September , 1980 , at 5 : 30 p . m . , at the Town of Ithaca Offices at 126 East Seneca . Street , Ithaca , New York , there were PRESENT : Noel Desch , Supervisor George Kugler , Councilman Shirley Raffensperger ; Councilwoman Catherine Valentino , Councilwoman Marc Cramer , Councilman Henry McPeak , Councilman ALSO PRESENT : James Buyoucos , Town Attorney Lawrence Fabbroni , Town Engineer Robert Parkin , Town Superintendent Gust Freeman , County Board of Representatives Dooley Kiefer , 629 Highland Road Robert Kennerson , 1465 Mecklenburg Road Otto Schoenfeld , Gaslight Village Ivor Jonson , 111 North Plain Street Gertrude Bergen , 127 Pine Tree Road Edward Bergen , 127 Pine Tree Road Representatives of the Media : Claudia Montague , WHCU Donna Kessler , WTKO PLEDGE OF ALLEGIANCE The Supervisor led the assemblage in the Pledge of Allegiance . Supervisor Desch noted that a Public Hearing on the Tentative Budget must be held before October 5 . TENTATIVE BUDGET RESOLUTION N0 , 147 Motion by Sup ervisor .Desch- ; . . . seconded , ,by _,Counci woman -ualeiition , RESOLVED , that the Town Board of the Town of Ithaca will conduct a public hearing on October 2 , 1980 , at 7 : 00 P . M . , at the Town Offices at 126 East Seneca Street , Ithaca , New York , ; with regard to the Tentative Budget for the Southern Cayuga Lake Intermunicipal Water Commission , and RESOLVED , that the Town Board of the Town of Ithaca will conduct a public hearing on October 2 , 1980 , at 7 : 30 P . M . , at the Town Offices i at 126 East Seneca Street , Ithaca , New York , with regard to the Tentative Budget for the Town of Ithaca , and BE IT FURTHER RESOLVED , that the Town Board of the Town of Ithaca will conduct a public hearing on October 2 , 1980 , beginning at 8 : 15 P . M . , and then every five minutes thereafter , at the Town Offices at 126 East Seneca Street , Ithaca , New York with regard to the Special Districts . ( Desch , Kugler , Raffensperger , Valentino , Cramer and McPeak voting Aye . Nays - none ) . Town Board Minutes - 2 - September 8 , 1980 TOWN ENGINEER REPORT Town Engineer Lawrence Fabbroni noted that the bids on the Cliff Street Pump Station will be opened tomarrow , September 9 , 1980 . An addendum has been added to the original contract . Supervisor Desch noted that because of the increase usage by Statler , West and the Hospital , the flow to the West Hill area is limited to the 6 " line . The line is working to its capacity . The existing 6 " line should be reinforced with a new 8 " line running up Bundy Road , across and down Hayts Road to the water tank . Critical is the cost plus routing of the line . The Town could take advantage of servicing several customers along the route . In the past , the Town has not extended water and sewer lines to undeveloped areas . He asked the Town Board to think about this expansion , he felt a figure of a quarter million would be necessary to complete this project . He further noted that this was a sleeping giant , no longer five years off . Councilman Cramer asked about water service to the West Haven Road area ? Supervisor Desch noted that another water tank would be needed if water were extended to the West Haven area . Town Engineer Fabbroni noted the Town Hall rehabilitation was progressing . The ramp is almost completed . The railings will be installed , as soon as work on the ramp is completed . Weather stripping and painting of the trim has begun . The Board should see a drastic change in the appearance by next Board meeting . Plans. are being . - finalized to cut the door opening between " the , Town . Clerk ' s -_ office and _ the :lfront _ office , . along with the window to the Town Clerk ' s office , which will be cut through where the bulletin board is located . The Town Engineer reported on the new Northeast Transit route . The route is different from last year , with Hasbrouck and Pleasant Grove Apartments being the basic additions , along with some modifications . Supervisor Desch noted that the bus now stops in Forest Home . He asked the Town Engineer to consider permenant marked , bus stops in the area . Councilman McPeak asked about the Forest Home route covering the new Morse Chain development . Town Engineer Fabbroni noted that the bus now goes past Morse Chain once . . Councilman McPeak asked if the route could be scheduled to coincide with their work schedule ? Councilman Cramer asked about a stop at the airport ? Mr . Fabbroni was uncertain as to the extent the parties involved in the Transit system would increase the route . He felt that this was an area that they would have to set down and discuss . Right now , bus riders are able to ride to Lansing , North and then required to walk the rest of the way . He further noted , that the limousine , service , and a drop of in their function , - in conflict with the Transit System , has only be-en . discussed and not explained in great detail . He further noted that a meeting on the East Ithaca Transit service had been held . They came back with concrete proposals . On being Town Board Minutes - 37 September 8 , 1980 service to the East Hill Plaza . There are other alternatives being discussed . Supervisor Desch asked if there was any way to get a definite figure on cost , because of the budget ? Town Engineer Fabbroni felt that everything was falling into place rapidly , and a definate figure would be available before budget . Councilman Cramer asked if there was anyway possible to apply for a federal grant . Town Engineer Fabbroni noted that the application has been filed , and is number 76 on the priority list . He felt there was a good chance of the grant being approved . County Representative Freeman noted that Frank Liguori feel the grant will be approved . Coucilwoman Raffensperger wondered what was happening to the Park and Ride Runs ? She noted that not much discussion , on this project , was being held . Town Engineer Fabbroni noted that the hospital , East Hill Plaza and .- the Highway Facility were logical sites for the Park and Ride . However , he noted that he had not followed through on this project . Mr . Fabbroni also noted that the Sewer System Evaluation is nearly completed , with only a very few feet left to be tested . The Town Engineer further noted that the Summer . . CETA Program has been terminated . The older crew is brush cutting and painting on the inside of the Town Hall . Councilman Cramer asked if the board room would be painted or paneled ? Mr . Fabbroni responded that the board room would be painted . HIGHWAY SUPERINTENDENT REPORT Highway Superintendent Robert Parkin reported that the crews . -have been cutting brush and patching roads . They have a mile of surface treating to finish . The Highway Superintendent noted that approval should be received in the next three weeks , for the Town , on the State Emergency Bond . Some Towns have received their approval already . Councilwoman Raffensperger noted that the second leg of the East Ithaca Bikeway is being used by trucks . She requested that baracades be installed to stop trucks from entering . The Highway Superintendent noted that he had filed his inventory of highway machinery , tools and equipment with the Town Clerk . ( Copy attached ) . The Superintendent noted that David Wexler of 209 Roat Street , Ithaca , New York never made the road cut that he anticipated would be necessary , therefore , the $ 100 . 00 deposit should be refunded to him . RESOLUTION NO . 148 Motion by Supervisor Desch ; seconded by Councilman Cramer , RESOLVED , that the Town Board of the' - Town of Ithaca hereby authorizes the refund of $ 100 . 00 deposit , for . . a . road cut , to .- Davidi .Wexler of ; Town Board Minutes - 4 - September 8 , 1980 209 Roat Street , Ithaca , New York . ( Desch , Kugler , Raffensperger , Valentino , McPeak and Cramer voting Aye . Nays - none ) , Councilman Cramer asked if ; a ,.- depreciation allowance was taken each year on the fixed assets ? Supervisor Desch noted that a depreciation . - schedule of 1% was taken each year . COUNTY BOARD OF REPRESENTATIVES REPORT County Representative Gust Freeman reported the County is considering the consolidation of all Ag Districts into one Ag District . The cost of administering only one district would save considerable money . He spoke on the problem of deer at the airport . and the cost of fencing in this large an area . 90 % of the funds to build the fence would have to come from the people who use the airport . If there are any ADAP Funds left over , construction funding then could become available after the first of the year . Supervisor Desch asked if the Village of Lansing had changed their hunting laws yet ? County Representative Freeman responded by saying no , however , the Village of Lansing will hold a public hearing on the hunting issue . Mr . Freeman reported that the attendance figures for the Expo totaled 14 , 000 plus , with no major complaints . The Fair Association is now negotiating with the State for use of the site next year . Town Engineer Fabbroni noted that the Summerhill project was 95 % completed . All apartments have been rented . Landscaping , to complete the project , will start in 15 to 20 days . Mr . Maurice Dusky is concerned that the .Elderly Housing project could become flooded . Mr . Fabbroni noted that he had assured Mr . Dusky that the original plans would take care of any flooding problems . However , Mr . Dusky felt the filling of the land would increase the water holding areas . Supervisor Desch asked County Representative Freeman to discuss again , the drainage problem with Bill Mobbs , of the Tompkins County Health Department , BUILDING INSPECTOR REPORT Lewis Cartee , Building Inspector reported that in August of 1980 , eleven building permits were issued for a total construction cost of $ 87 , 851 . Fees. collected by the Town amounted to $ 55 . 00 . In comparison to August 1979 when 10 permits were issued for a total construction cost of $ 237 , 100 . Fees collected by the Town amounted to $ 157 . 50 . Councilman Cramer asked the Building Inspector about the new car wash at the East Hill Plaza , and did he anticipate any problems ? The Building Inspector responded , he expected no problems . Councilman Cramer asked about fire ponds on West Hill , and did Mr . Cartee wish to submit a proposal to the Planning Board and the Zoning Town Board Minutes - 5 - September 8 , 1980 Board , regarding these ponds ? Building Inspector Cartee noted that he had no thoughts regarding the ponds . TOWN ATTORNEY Town Attorney James Buyoucos stated that Councilwoman Raffensperger had given him a proposal on Park use . He had made some quick comments , and would go over the proposal with Mrs . Raffensperger then it could be passed by the Board . Supervisor Desch stated that a control of hours was needed , however , a good start has been made on the ordinance . PLANNING BOARD RULES AND REGULATIONS Supervisor Desch stated that there have been concerns over the past years regarding an attendance policy . Also , there should be an approach to what the Town Board would like . ( Copy attached to minutes ) . Town Attorney Buyoucos noted that the offices , terms and sessions should be established by the Town Board . He further noted that the Vice Chairman should carry on the duties in the absence of the Chairman . If there is no Chairman , the Town Board should appoint a new Chairman . Planning Board members should be appointed by the Town Board . The Planning Board may submit names for membership . County Representative Freeman asked what was the procedure for obtaining new members . Supervisor Desch stated that a vacancy was announced at the Planning Board '. and Town -Board . An item is usually included in the Newsletter . He further noted that the Board did not want to get too elaborate . The selection of members should not be a mandated process by the Town Board , should be encouraged by the Town Board . APPOINTMENT TO ZONING BOARD OF APPEALS Supervisor Desch noted that Peter Francese will continue on the Board until the end of the year . An appointment will be made at the Audit Meeting , INTERSECTION LIGHTING Supervisor Desch stated that the Town had a policy on street lighting . RESOLUTION N0 . 149 Motion by Supervisor Desch ; seconded by Councilwoman Valentino , RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the Supervisor to execute a contract with the New York State Electric 5 and Gas Corporation to locate a pole at the entrance to the Town Highway Department and the intersection of Lisa Lane and Texas Lane . REGISTERY OF SIGN PERMITS Supervisor Desch noted that at the time the Sign Ordinance was adopted , it was felt that it would be a good idea to have of registery of signs . Supervisor Desch questioned billboards ? Councilwoman Raffensperger stated that billboard are not legal . RESOLUTION NO . 150 Motion by Councilman Cramer ; seconded by Councilman McPeak , RESOLVED , WHEREAS , the Town of Ithaca Sign Law , Local Law No . 6 - 1980 , provides that the lawful use of signs existing at the date of adoption of said Law may be continued even though such sign does not conform to the provisions therein , and WHEREAS , said Sign Law also provides that at such time when a legal non - conforming sign is in need of alteration , replacement or substantial repair, as determined by the Enforcement Official , such sign shall be made to come into conformance with said Law or to be removed , NOW THEREFORE. BE IT RESOLVED , by the Town Board of the Town of Ithaca that within six months of the effective date of the Town. of Ithaca Sign Law , Local Law No . 6 - 1980 , the Enforcement Official shall have complied a registry of all lawful signs existing prior to the adoption of , or created by , said Law . The Enforcement Official shall inspect each such sign annually and determine whether the sign is in conformance with Section 8 . 05 of the Town of Ithaca Sign Law , Local Law No . 6 - 19800 ( Desch , Kugler , Raffensperger , Valentino , Cramer and McPeak voting Aye . Nays - none ) . YOUTH BUREAU APPOINTMENT Supervisor Desch stated that he had received a letter from Bruce Silvey requesting his name be considered for the appointment to the City of Ithaca Youth Bureau . Councilman Cramer felt that more time should be spent on the appointment so that a person with more background in this field would be appointed to fill the vacancy . RESOLUTION N0 , 151 Motion by Councilwoman Raffensperger ; seconded by Councilwoman Valentino , RESOLVED , that the Town Board of the Town of Ithaca hereby appoints Bruce Silvey to fill the vacancy on the City of Ithaca Youth Bureau as the Town of Ithaca Representative . ( Desch , Kugler , Raffensperger , Valentino and McPeak voting Aye . Nays - Cramer ) . PUBLIC HEARING TO CONSIDER MODIFICATIONS TO THE TOWN OF ITHACA BENEFIT FORMULA ORDINANCE Proof of posting and publication of notice of public hearing to consider modifications to the Town of Ithaca Benefit Formula Ordinance having been presented by the Town Clerk , the Supervisor opened the hearing . Town Board Minutes - 7 - September 8 , 1980 Supervisor Desch stated that over the past few years there has been considerable discussion regarding changing the Benefit Formula assessment . Gust Freeman asked if the Town would go back and take of the units already assessed ? Supervisor Desch said no . Otto Schoenfeld referred to the Sewer and Water provision by developers . He noted that developers were already dealing with $ 50 . 00 and $ 52 . 00 assessments . I think it is unreasonable . In my case , over the years I have at my expense , installed nearly four miles of water and sewe mains and an equal amount of laterials . I have not sold the property , however , I must continue to pay the assessment on my taxes . Mr . Schoenfeld went on to say , how far can you go ? If the Town continues to assess these costs , they will have to be included in the cost when the property is sold . Councilman Cramer asked what about development in the northeast ? Mr . Supervisor Desch stated that NYS DEC has pointed out the short comings in the Sewer Use Ordinance which was patterned abter recommendations from the National Waster Association . He further noted that there was a need to make the necessary changes now , and any payments which were forthcoming would not be made until the necessary changes in the Ordinance have been made . He went on to say that DEC had recommended general aspects that need to be covered . Town Attorney Buyoucos asked why DEC did not write the law and then ask the Towns to adopt it . CONSIDERATION OF ADJUSTMENT ON WATER CONSUMPTION Supervisor Desch stated that Tom ' Law had purchased a house at 229 Coddington Road and discovered an old water bill which had never been paid . Mr . Law feels he is entitled to a refund of 120 units . Supervisor Desch went on to say that there was really no way to determine the amount owned by Mr . Law until a meter reading is taken . Supervisor Desch stated that he would research the matter further and report back to the Board at a later date . INFORMATIONAL HEARING ON EAST ITHACA CIRCULATION IMPROVEMENTS Supervisor Desch stated that meetings have been held with Cornell in an attempt to pin down areas which encounter traffic problems and also a corridor to handle this traffic . Supervisor Desch stated that an informational hearing should be held to let the public know what progress has been made . FIVE YEAR PLAN FOR WATER AND SEWER IMPROVEMENTS Supervisor Desch stated that the Town Board should consider a plan of action to cover the next five years for extending water and sewer to different areas of the Town . These improvements should be built into the budget . He went on to say that on the water side , the 6 " line which serves the hospital , Statler , West and the old hospital . The Cliff Street Pump Station is now running twenty - one hours a day and is no longer able to push enough surplus water to this area . Also , a number of small improvements need to be made along the Danby Road . A loop line should be driven under the Danby Road to loop the Danby Road Tank by NCR to provide better fire protection . Interest in obtaining sewer has been expressed along the East Shore Drive . He asked if there was a need in the next five years for a sewer package and asked to Board to consider all the possibilities . FIRE SERVICE CONTRACT Supervisor Desch stated that a number of meetings have been held with the City of Ithaca on the fire contract . Supervisor Desch went on to say that most of the property in the Town of Ithaca is located within a three mile limit of the City . City property owners are benefitting most as all , City and Town , pay the same rate on assessed value . He went on to say that he felt a fire station should be located on west hill by the hospital . and another one on east hill and that if the Town intended to consider another contract with the City , this should be made a part of the agreement . The Supervisor went on to say that there should be a continued effort on the part of the Town to investigate the feasibility of a Town Fire Department , however , he felt this was not feasible by the 1981 budget . He then suggested that a Town Fire Department Committee be established to investigate all possibilities .
