TOWN BOARD MEETING
July 25 , 1980 - 5 : 15 P . M . .
At a Special Meeting of the Town Board of the Town of Ithaca , Tompkins
County , New York , held on the 25th day of July , 1980 , at 5 : 15 p . m . ,
at the Town of Ithaca Offices at 126 East Seneca Street , Ithaca , New
York , there were

PLEDGE OF ALLEGIANCE
The Deputy Supervisor led the assemblage in the Pledge of Allegiance .
Town Attorneys James Buyoucos and John Barney stated they were attending
the Board meeting to represent their client , Mr . Norbert H . Schickel .
PUBLIC HEARING TO CONSIDER THE ADOPTION OF A LOCAL LAW
REGARDING A CHANGE - IN REAL PROPERTY TAX EXEMPTION FOR
THE ELDERLY
Proof of posting and publication of notices of public hearing to
consider the adoption of a local law regarding a change in Real Property
Tax Exemption for the Elderly in the Town of Ithaca , having been
presented by the Town Clerk and noted that the Public Hearing was held
within seven days under emergency conditions and permitted to do same
' by Local Law No . 1 , 1965 , with five members of the Board present , the
Deputy Supervisor opened the hearing .
® Deputy Supervisor Kugler read the proposed local law .
The Deputy Su ervisor noted that in 1971 , Local Law No . 1 , was adopted
permitting a p$ 5 , 000 income eligibility for persons over 65 . In 1977 ,
Local Law No . 2 , raised the income eligibility to $ 7 , 200 . He further
noted that the Town was notified July 15 , 1980 , of the amendment to
Real Property Tax Law allowing municipalities to raise to $ 9 , 200 the
income eligibility . The exemption applications must be filed by
August 1 , 1980 , therefore , time was pressing for a quick adaption , if
the Town of Ithaca elderly were to receive a tax exemption this year .
Councilman Del Rosso questioned why the proposal was Local Law No . 5 ,
and not an amendment ?
Town Attorney Buyoucos stated that amendments are done by a Local Law .
It amends a previous law .

Councilman Del Rosso asked if Local Law No . 2 comes off the books ?
Town Attorney Buyoucos said no . A law stays on the books and is then
amended by another local law .
As no one else wished to be heard , the Deputy Supervisor closed the
hearing .
LOCAL LAW NO . 5 - 1980
Motion by Councilman Cramer ; seconded by Councilman Del Rosso ,
® LOCAL LAW N0 . 5 - 1980
A LOCAL LAW WHICH PROVIDES FOR A TAX EXEMPTION OF REAL PROPERTY
OWNED BY PERSONS 65 YEARS OF AGE OR OVER
SECTION I
This law is enacted pursuant to the provisions of Section 467 of the
Real Property Tax Law as amended by Chapter 816 of the Laws of 1980 .
SECTION II
Pursuant to the provisions of Section 467 of the Real Property Tax
Law , Section 2 of the Town of Ithaca Local Law No . 2 of 1977 , is
hereby amended to raise the income limitation provided therein to
$ 9 , 200 . .
SECTION III
This Local Law shall not apply to any taxes assessed prior to the
effective date of adoption .
SECTION IV
This Local Law shall become effective immediately .
Deputy Supervisor Kugler called for a roll call vote .
Councilman Cramer Voting Aye .
Councilman Del Rosso Voting Aye .
Councilman McPeak Voting Aye .
Councilwoman Valentino Voting Aye .
Deputy Supervisor Kugler Voting Aye .
Local Law No . 5 - 1980 , was thereupon declared duly adopted .
Deputy Supervisor Kugler noted that Local Law No . 5 - 1980 , was on
the desks of the Council , seven days prior to the passing of this
Local Law .
Town Engineer Larry Fabbroni stated that he has two items to be
brought before the Board .
STRAWBERRY HILL LANE
Town Engineer Fabbroni reported that Eastwood Commons Development
Company wishes to post a $ 1 , 000 bond for a 170 ' long and 50 ' wide

right - of -way on Strawberry Hill Lane . Oil and stone work still need
to be completed .
Town Attorney Buyoucos asked if there were any easements ?
Town Engineer Fabbroni stated that the water , gas and sewer line have
all previously been buried .
RESOLUTION NO . 128
® Motion by Councilman Cramer ; seconded by Councilwoman Valentino ,
RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes
the Deputy Supervisor to execute an agreement with the Eastwood Commons
® Development Corporation accepting an extension to Strawberry Hill Lane
as a Town road , and
BE IT FURTHER RESOLVED , that said road shall extend 170 ' beyond the
terminous of the existing Strawberry Hill Road , said road to be 50 '
wide , and
FURTHER BE IT RESOLVED , that Eastwood Commons Development Corporation
agrees to deposit a $ 1 , 000 bond for security and to complete the
extended road to the Town ' s specifications .

none ) .
STORM WINDOWS - TOWN HALL
The Town Engineer noted that his second item concerned storm windows .
Giordano Construction and Supply Company of Ithaca has proposed to
install , with all necessary caulking being done , 33 baked white enamel ,
triple track storm windows on the old part of the Town Hall . The
$ roposed price quote by Giordano Construction and Supply Company is
2 , 400 . Mr . Fabbroni considered this a very good price .
He further stated that the storm windows were part of the scope of
work planned for the Town Hall ,
Councilman Del Rosso asked what the savings would be in dollar: on
heat ?
Town Engineer Fabbroni stated that he had no figures on heat loss .
The Town Hall has old strom windows now , however , they are loose
and need replacing .
® Deputy Supervisor Kugler stated that heat loss was 50 % less with
storm windows .
Mr . Fabbroni reported that the windows would be installed in con -
® junction with the repainting of the Town Hall .
Town Attorney Buyoucos asked if the bond deposit should be changed ?
Town Engineer Fabbroni answered no , this will not be necessary .
RESOLUTION N0 , 129
Motion by Deputy Supervisor Kugler ; seconded by Councilwoman
Valentino ,
RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes
the expenditure of $ 2 , 400 for 33 baked white enamel triple track
storm windows for the old part of the Town Hall , and
AND BE IT FURTHER RESOLVED , that the expenditure is continguent. upon
the receipt of a written contract for same from the Giordano Construction

and Supply Company of Ithaca , New York .

none ) .
EXECUTIVE SESSION
RESOLUTION NO . 130
® Motion by Councilman Cramer ; seconded by Councilman Del Rosso ,
RESOLVED , that the Town Board of the Town of Ithaca will now retire
®, into executive session to discuss a personnel matter .
® ( Kugler , Del Rosso , Valentino , McPeak and Cramer voting Aye . Nays -
none ) .
RECONVENE - OPEN SESSION
RESOLUTION N0 , 131
Motion by Deputy Supervisor Kugler ; seconded by Councilman Del Rosso ,
RESOLVED , that the Town Board of the Town of Ithaca will now reconvene
into open session to conduct any remaining business of this meeting .
( Kugler , Del Rosso , Valentino , McPeak and Cramer voting Aye . Nays -
none ) .
ADJOURNMENT
