PLEDGE OF ALLEGIANCE
The Supervisor led the assemblage in the Pledge of Allegiance .
YOUTH BUREAU REPORT
Ronald J . Kuhr , Town Representative on the City of Ithaca Youth Board
reported on the activities of the Youth Bureau .
Mr . Kuhr reported that the Human Services Coalition Report showed a
cost of $ 35 . 00 per child . The Town of Dryden has refused to increase
® their contribution . Other municipalities may also refuse to pay . If
the Tom. of Dryden does not pay , no youth from Dryden will be allowed
in the City of Ithaca Youth Bureau activities .
Some essential - programs may have to be dropped . If they are dropped ,
it will have an adverse effect on our youth . Mr . Kuhr stated he did
not know how the Youth Bureau could convince the municipalities to
pay their fair share .
Mr . Kuhr noted that there were so many sports programs available in
this area , perhaps all of the Youth Bureau programs were not needed .
Councilman Cramer stated that he would like a breakdown of the actual
cost per program . Also , a schedule of what programs the Town youth
are participating in .
Supervisor Desch asked what happens if Dryden says no , will the City
cut its budget ?
Mr . Kuhr stated that the Youth Bureau will have $ 8 , 000 less to spend or
fees would have to be increased to offset the difference , or programs

would have to be cut out completely .
Councilwoman Valentino asked if any programs were cut last year ?
Mr . Kuhr said a few program fees were increased , like the men ' s basket -
ball . The fee was adjusted so that the program became self sufficient .
Councilwoman Raffensperger noted that the City Youth Bureau is semi -
county , why not have a basic reorganization with a County Youth Bureau ?
Mr . Kuhr stated that the Youth Bureau does not get County support based
on population . He did not know if it was possible to get more County
support . He further stated , that he did not see an alternative , however ,
he could not see how the City and Town could support the Towns who will
® not participate .
SIGN APPLICATIONS
What ' s Your Beef
The request of What ' s Your Beef was referred back to the Planning Board
at the May Town Board meeting . The Planning Board met on July 1 , 1980 ,
and recommended approval by the Town Board .
Councilwoman Raffensperger asked if What ' s Your Beef had a permit when
the sign was installed ?
Town Engineer Fabbroni answered yes . What ' s Your Beef was in compliance
when originally installed , however , they released twenty feet of frontage
to " Something New . "
RESOLUTION NO . 111
Motion by Councilman Del Rosso ; seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby approves a
variance for the sign application of What ' s Your Beef at the East Hill
Plaza .
( Desch , Kugler , Raffensperger , McPeak , Del Rosso and Cramer voting
Aye . Nays - Valentino ) .
Orchard Hill
Orchard Hl= sibdividion off Dubois Road has applied for a one year ,
temporary sign . The sign was approved by the Planning Board .
RESOLUTION N0 , 112
Motion by Councilwoman Raffensperger ; seconded by Councilman McPeak ,
RESOLVED , that the Town Board of the Town of Ithaca hereby approves
the sign application of Orchard Hill , off Dubois Road for one year ,
® AND FURTHER BE IT RESOLVED , that the sign not exceed twenty - four
square feet .

Cramer voting Aye . Nays - none ) .
WASTEWATER TREATMENT FACILITY
Supervisor Desch welcomed William La Rose , Project Engineer for
Stearns and Wheler .
Supervisor Desch noted that the Step I phase of the project , a process
in schematic design of the upgrading for the Wastewater Treatment
Facility had been going on for one year . The Environmental Assessment
reports have been completed . Also , public hearings have been held .

Mr . La Rose noted that Frank Liguori , County Planning Commissioner ;
Supervisor Desch , and Councilwoman Raffensperger , along with the City
have been meeting regularly . The Facilities Plan does not address
who owns the facility .
He further stated that the Facilities Plan was delivered to Phil Cox ,
City of Ithaca Engineer , this morning .
He went on to note , the question , what are you required to do ?
Mr . La Rose answered the question by saying , look at land treatment
and spread of effluent on land , or put treated effluent in the lake .
He further noted that the purchase of land , plus pumping to land treat -
ment sites is too expensive . The best way is the discharge of effluent
into Cayuga Lake . A comprehensive study completed earlier by the
County , showed the discharge into Cayuga Lake the best solution .
Inlet discharge from the Wastewater Treatment Facility would necessitate
it being discharged at 2 , 500 feet out into the lake . The ten alternatives
from the Environmental Protection Agency and the State were all checked .
Mr . La Rose noted that the question now was what could be salvaged from
the City Sewer Plant . The south side of the vacuum building will be
saved for another use . If an activated sludge system is built , more
land will be needed .
The plant selection and engineering reports , concluded with the
Environmental Assessement hearing . The Environmental Assessment
Summary with responses and comments collected at the public hearings
were sent to the Department of Environmental Conservation in June .
No response has been received to date . The above material will provide
the Environmental Protection Agency with the necessary information to
determine if an environmental statement is necessary or not .
More interest is being paid to the out fall of the sewer , than any -
thing else . A 54" pipe will be submerged at the bottom of the lake .
Treated effluent will be released at 2 , 500 feet .
The cost of the project is projected to be 29 million dollars in
capital costs . Virtually all of the 29 million is eligible for 75 %
federal aid and 122% state aid .
Mr . La Rose stated that the final reports deal with financing . What
will the homeowner pay ? The Town of Ithaca will have space for
additional customers .
Step II is the Federal Aid Grant for design . The grant will be made
this fall if accepted . Bids might be taken in the spring of 1983 .
Two or three year timetable on construction . Project is scheduled for
completion in 1985 or 1986 .
Mr . La Rose noted that Frank Liguori requested facilities for treatment
of septic tank pumping ( septage ) be included in this study . A decision
® will be made on a dumping station at the plant for septic tank trucks ,
or dumping directly into the plant . Mr . La Rose felt it was better to
stay flexible , at this point , as this works best .
Supervisor Desch noted that the County would pay the initial cost .
The City was concerned with dumping , odor and truck traffic .
Supervisor Desch noted that all of the treatment facility would be
located on the north side of Route 13 , instead of split up , as it
is now .
Henry Aron asked if the tanks would be big enough to take in all of
the sewage for the whole Town of Ithaca ?
Mr . La Rose stated that allowances were made for extra people who wish
to hook up . They are restricted by the Federal government . They were
given norms , but were restricted .

Supervisor Desch noted that there was quite a bit of space capacity .
Attorney Buyoucos asked if the 2 , 500 feet ( end of pipe ) was more or
less north from the shore .
Mr . La Rose answered , northeast of the lighthouse .
Supervisor Desch noted that the designated route was out the walkway
through the bird sanctuary .
Gust Freeman asked what was the depth of the water ?
® Mr . La Rose stated that the depth was seven to nine feet , minimum depth .
® Mr . Freeman asked what depth does the Federal government require ?
Mr . La Rose stated that the depths meet Federal requirements .
Mr . Freeman wondered if the pipe would be far enough out ?
Supervisor Desch stated that the sedimentation should be no problem .
There will also be the additional flow of 8 million gallons of treated
effluent per day .
Town Engineer Fabbroni asked about studies of water at low level of
the lake .
Mr . La Rose stated that the flow comes out the top . The pipe is
buried .
Supervisor Desch noted that there was great concern with the flow
going into the lake .
Mr . Gust Freeman asked if the end of the pipe will be open ?
Supervisor Desch said no .
Gust Freeman then asked if it would add to the silt problem ?
Supervisor Desch stated that the process used would produce no silt .
Mr . La Rose noted that there will be no raw sewage dumped into the lake .
Supervisor Desch thanked Mr . La Rose for attending the meeting and
his presentation .
RESOLUTION N0 . 113
® Motion by Councilwoman Raffensperger ; seconded by Supervisor Desch ,
RESOLVED , WHEREAS , Stearns & Wheler , Civil and Sanitary Engineers , have
prepared a Waste Water Facilities Report for the Planning Area including
the City of Ithaca and portions of the Town of Ithaca and Town of Dryden
under Federal Project No . C - 36 - 1095 , Step I , and
WHEREAS , the engineer ' s recommendations , input from public hearings ,
and review by the Intermunicipal Sewer System Planning Committee have
arrived at a concensus of proceeding to design , and
WHEREAS , an expansion of the existing site on the northwest side of
Route 13 , a treatment ( 3B ) process utilizing air activated sludge and
primary settling processes , sludge treatment by anerobic digestion ,
vacuum filtration and truck disposal to sanitary landfill , outfall
route to Cayuga Lake and depth and location in the lake by Alternate
C , and encorportion of septage treatment facility for Tompkins
County , all as referenced in Volume II of the Waste Water Facilities
Report are key elements of the consensus ,

NOW THEREFORE , BE IT RESOLVED , that the Town Board of the Town of Ithaca
hereby endorses the Waste Water Facilities Report and the beginning of
Step II Design Work with the understanding that major findings of the
archeological study , environmental assessment statement , and SSES yet
to be completed under Step I work may be cause for reconsideration at
the appropriate time .

REPORT OF TOWN OFFICIALS
Supervisor ' s Report
® Local Census Review
The Town staff as the burden of testing the accuracy of the preliminary
census figures . We are concerned because the numbers show a 20 % increase
in housing units but only a 0 . 4% increase in people . The logistics have
been further complicated by the lack of the correct maps and the fact
that only ten days are available for local review . This work has setback
our schedule on the review of the benefit formula somewhat .
Item 16 on the Agenda has to do with the initial approach to the develop -
ment of the 1981 budget . On the revenue side , we can expect significant
losses in three areas ( 1 ) State Revenue Sharing ( $ 20 , 000 ) ; ( 2 ) County
Sales Tax Revenue and ( 3 ) Federal Revenue Sharing . In total , these losses
can cause a significant additional tax burden on the Town , even if the
appropriations do not increase one dollar .
There are a number of things we can do to minimize the impact , namely
reduce spending , and redistribute available reserves . I urge each Town
Board member to thoroughly review the 1980 budget line items to consider
where cuts can be made . For example , we might eliminate the separate
position of Receiver of Taxes , reduce the number of people going to
conferences , reduce the number of Newsletters , eliminate the traffic
control line item . One the reserve fund side , we should think about the
use of a part of the Park Reserve , perhaps for highway machinery or
youth services or mass transit projects . More on this later in the
meeting .
School Closings
Your Town Board has shown considerable restraint in not taking a position
against school closings . There simply was no way in which impact on
Town children could be totally avoided . We believe a compatible use of
the Cayuga Heights school facility will be found . It may mean that our
Polling Place for District 7 will have to be relocated and Town Board
members should be thinking about possible sites .
Traffic Enforcement - Northeast
We have an excellent response to our letter pertaining to the possibility
of contracting with Cayuga Heights for additional coverage in the North -
east . The overwhelming comments are that the constituents do not want
to pay the cost for such service . However , the County Sheriff is now
willing to provide more coverage on a response basis . The next news -
letter should state the Town Board ' s position on this matter , with
regard to the 1981 budget . My recommendation is that we do not contract
with the Village for additional coverage in this area .
Zoning Board of Appeals
Our Chairman , Peter Francese has asked us to begin the process of find -
ing a replacement for him . The pressures of his business make it in -
creasingly difficult to continue this extremely important job . Mr .
Francese will be very difficult to replace . He has done an outstanding
job during his many years of service and has brought a level of
professionalism to our government that we all have come to expect on a
routine basis .
Town Board Minutes - 6 - July 7 , 1980
Town Engineer
Town Engineer Larry Fabbroni noted that the contract with the
Giordano Construction and Supply Company , to paint the Town Hall has
been signed . He would like the Board to take a five minute break
sometime during the meeting to look at sample patches on the building
and then decide which approach should be taken .
Mr . Fabbroni stated that he now has two CETA crews working . A youth
crew of high school kids for eight weeks during the summer . The other
crew is from the permanent unemployed population . They will be
employed on maintaining the grounds around the pump stations , working

on the parks and working on ongoing projects around the Town Hall ,
The Town Engineer further stated that he was working with the Citizens
is Savings Bank in connection with building a ramp for the handicapped
on the west side of the building . The engineering office will become
the Board room and the Board room upstairs will become the engineering
office . The switching of the two rooms will lower the cost of an
access for the handicapped .
Mr . Fabbroni stated that the repainting of the Trumansburg Road water
tank is about finished . Should be filled and ready for use about
Thursday .
Highway Superintendent
Robert Parkin reported that the Highway staff have been cleaning
ditches and installing culverts . The Forest Home area cross walks
have been painted . Also , Stone Quarry and Renwich have been stripped .
The paving of roads in now half completed .
He further noted that the new Dodge pick - up truck had been delivered .
The gas pump for unleaded gas has been installed . The hot mix base
for the salt storage shed has been completed .
Building Inspector
Lewis Cartee , Building Inspector reported that in June of 1980 eleven
building permits were issued for a total construction cost of
$ 384 , 847 . Fees collected by the Town amounted to $ 172 . 50 . In compar -
ison to June 1979 when 20 permits were issued for a total construction
cost of $ 260 , 163 . Fees collected by the Town amounted to $ 187 . 50 .
Supervisor Desch felt that the Town of Ithaca was probably showing
better signs of building starts than other towns .
® Councilwoman Raffensperger asked why the Town collected less fee in
1980 than in 1979 , when the total construction costs were greater
in 1980 ?
Building Inspector Cartee stated that the fees for building permits
were on a sliding scale .
RESOLUTION N0 , 114
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby approves
the minutes of the Town Board meetings of March 19 , April 7 , and
April 21 , 1980 , as presented by the Town Clerk .

Town Board Minutes - 7 - July 7 , 1980
INDUSTRIAL COST RECOVERY SYSTEM
Supervisor Desch stated that the support of the Town Board was needed
incase there was ever a need to develop and Industrial Cost Recovery
System . It also relates to obtaining approval of the Collector Project .
A portion of the new facility must be recovered by industrial users .
The continuing policy of accepting 24 million dollars in Federal and
State aid must tie into the mechanisms of the Industrial Cost Recovery
System .
RESOLUTION N0 , 115
Motion by Supervisor Desch ; seconded by Councilman Kugler ,
RESOLVED , WHEREAS , the sewer collector construction completed under
EPA project Number C - 36 - 1104 does not serve and does not have an
industrial user within the service area of the project , and
WHEREAS , EPA concurs that there is no present requirement to submit
and Industrial Cost Recovery System where no industrial user is
served ,
NOW THEREFORE , BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby is committed to develop an Industrial Cost Recovery
System should an industrial user enter the service area .

NATIONAL FIRE PROTECTION ASSOCIATION
Supervisor Desch noted that the Town had not proceeded with a Fire
Protection Code because of other pressing problems . However , Building
Inspector Cartee has suggested that the Town become a member of the
National Fire Protection Association at $ 50 . 00 per year . The Town
will be able to obtain information on protection of multiple houses ,
ways to minimize arson , etc .

Motion by Councilman Cramer ; seconded by Supervisor Desch ,
RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes
membership in the National Fire Protection Association at a yearly
cost of $ 50 . 00 .

the Town Clerk to attend the Town Clerk Training School to be held
in Syracuse , New York , August 17 , 18 , and 19 , 1980 .

RESOLVED , that the . Town Board of the Town of Ithaca hereby approves
the Republican and Democratic Election Inspectors as recommended by
their respective parties and approved by the Tompkins County Board of
Election ,

ELECTION DISTRICT # 1
Supervisor Desch noted that it has become necessary to move Election
District # 1 from the Herman Biggs Memorial Building . Considerable
amounts of time have been spent to find a suitable location . Lake
Side Nursing Home was convenient for the patients , however , traffic
infront of the Nursing Home along with access in and out and parking
space all ruled against the Nursing Home as a polling place . Cornell
University has been very receptive to the Town using their Statler ,
West facility .
RESOLUTION NO . 119
Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger ,
RESOLVED , that the Town Board of the Town of Ithaca approves the
relocation of Election District # 1 from the Herman Biggs Memorial
Building to the Statler , West .

PUBLIC HEARING TO CONSIDER THE ADOPTION OF A
LOCAL LAW REGULATING SIGNS IN THE TOWN OF ITHACA
Proof of posting and publication of notice of public hearing to
consider the adoption of a local law regulating signs in the Town
of Ithaca having been presented by the Town Clerk , the Supervisor
opened the hearing .
The review of the proposed ordinance included references to imput from
the staff , board members and included among other items , the following
comments :
Town Attorney James Buyoucos felt there was a conflict on page 2 ,
1 . 03 - 2 , the Zoning Ordinance was what was looked to - there seems
to be a weakness .
Page 2 , 103 . 5 needs clarification .
Page 3 , 2 . 01 - 2 and page 11 , 6 . 01 - 2 it was felt that in some ways it
was repitition ( or the two might be combined ) . In other words , one
talks about design , color and placement , the other about lights .
® Page 6 , 302 - 1 , _ the following signs add ( on premises ) , not self -
illuminated . . . . . .
Page 6 , 3 . 02 - 1 ( d ) change churches to house of worship , libraries ,
museums and ( change and to or ) similar institutions .
Page 6 , 3 . 02 - 1 ( c ) change not to exceed 6 square feet to not to exceed
24 square feet .
Set back requirements should be incorporated in the Local Law ,
Page 8 , 4 . 01 - 2 set back requirement forty feet .

RESOLUTION NO . 120
Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger ,
RESOLVED , that the Town Board of the Town of Ithaca hereby adjourns
the public hearing on the proposed local law to regulate signs in the
Town of Ithaca ,
® AND FURTHER BE IT RESOLVED , that the Town Board of the Town of Ithaca
will conduct a public hearing on August 11 , 1980 , at 7 : 00 p . m . , at
the Town Offices at 126 East Seneca Street , Ithaca , New York , with
regard to the proposed local law to regulate signs in the Town of
Ithaca and to consider the adoption of a local law in this regard .

PUBLIC HEARING TO CONSIDER THE ADOPTION OF AN
AMENDMENT TO THE ZONING ORDINANCE REGARDING
THE GENERAL RESTRICTIONS OF THE HEIGHTS OF
BUILDINGS AND STRUCTURES IN THE TOWN OF ITHACA
Proof of posting and publication of notice of public hearing to
consider the adoption of an amendment to the Zoning Ordinance
regarding the general restrictions of the heights of buildings
and structures in the Town of Ithaca having been presented by the
Town Clerk , the Supervisor opened the hearing .
Councilwoman Raffensperger questioned if the height of farm buildings
should not be restricted in Agricultural Districts ,
Supervisor Desch read the proposed amendment to the Zoning Ordinance .
In Agricultural Zones , no residence building or structure shall be
erected , . . . Remove residence building or and add non agricultural .
The sentence now reading - In Agricultural Zones , no non agricultural
structure shall be erected , . . . The last sentence in the first
paragraph is to be removed .
Town Engineer Fabbroni suggested the height limit be set at 30 :feet .
RESOLUTION N0 , 121
Motion by Councilman Del Rosso ; seconded by Councilwoman Raffensperger ,
RESOLVED , in Residential Zones R- 9 , R- 15 , and R - 30 , no building or
structure shall be erected , altered or extended to exceed 30 feet in
height . In Agricultural Zones , no non agricultural structure shall be
erected , altered or extended to exceed 30 feet in height ,
® AND RESOLVED , for purposes of this provision , the height of a structure
shall be measured from the floor in contact with the ground surface ,
AND FURTHER BE IT RESOLVED , that this resolution will amend Article 3 ,
4 , 5 , and 11 of the Zoning Ordinance .

ABANDONMENT OF HUDSON STREET EXTENSION
Supervisor Desch reported that he had received a request from Therm , Inc . ,
asking the Town to turn Hudson Street Extension back to Therm , Inc .
He noted that in 1953 , Hudson Street Extension was made a Town road

Motion by Supervisor Desch ; seconded by Councilwoman Valentino ,
RESOLVED , that the Town Board of the Town of Ithaca will conduct a
public hearing on August 11 , 1980 , at 7 : 30 p . m . , at the Town Offices
at 126 East Seneca Street , Ithaca , New York , to consider the abandon -
ment of Hudson Street Extension and to hear all persons in favor of
or opposed to the abandonment .

CETA TRAINING PROGRAM GRANT
RESOLUTION NO . 123
Motion by . Supervisor Desch ; seconded by Councilwoman Valentino ,
RESOLVED , WHEREAS , the Town Board of the Town of Ithaca has approved
the need for extra manual help , and
WHEREAS , the Town Board of the Town of Ithaca has applied for and
been granted a CETA Training Program Grant from June 16 , 1980 to
September 30 , 1980 ,
AND THEREFORE , BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby approves the hiring of one CETA working Supervisor ,
as of June 30 , 1980 , and
BE IT FURTHER RESOLVED , that the Town Board further approves the
hiring of five CETA Manual Service Workers , as of July 7 , 1980 .

PERSONS TO BE HEARD
Mr . Maurice Dusky , Manager of the Ellis Hollow Road Apartments spoke
to the Board about problems at the housing project . He noted that
Ivar Jonson had promised to plant a screen of shrubs and trees ,
between the two projects . However , Mr . Dusky stated that Mr . Jonson
had not planted any shrubs or trees . His drawing of the project
show a barrier .
Mr . Aron noted that the Planning Board approved the site plans with
the barrier .
Mr . Dusky stated that the road is almost on the culvert and he can
see little room left for plantings .
Mr . Dusky also stated that he was concerned about drainage . Mr . Knowlton
of the East Hill Plaza has allowed land fill to be placed in two areas
which , in the past , have filled with water and allowed a slow run off
in a heavy rain storm . He voiced concern that the Apartments would
become flooded now , in a heavy rain storm .
Supervisor Desch asked Mr . Dusky to send a letter , to him , voicing his
concerns .
Town Engineer Fabbroni noted that two years ago , the County discussed
the possibility of putting in a drainage ditch . If this were done ,
the drainage from Cornell ' s field would be the only area that would
contribute run off to this area .
Mr . Fabbroni indicated that he would delve into the concern with the
Jonson development , and would be monitoring them closely and report his

recommendations to the Town Board .

RESOLVED , that the Bolton Point Warrants dated July 7 , 1980 , in the
Operating Account are hereby approved , in the amount of $ 52 , 982 . 48
after review and upon the recommendation of the Southern Cayuga Lake
Intermunicipal Water Commission , they are in order for payment .

PLANNING BOARD CHAIRMAN
Henry Aron , Chairman of the Planning Board reported that the Planning
Board met on July 1 , 1980 , and approved the following :

RESOLVED , that the Town of Ithaca Planning Board recommend and hereby
does recommend to the Town Board the granting of a variance for and
approval of an additional 12 square feet of signage , reading What ' s
Your Beef , restaurant , East Hill Plaza , as presented to said Planning
Board this date , July 1 , 1980 .

RESOLVED , that the Town of Ithaca Planning Board recommend and hereby
does recommend to the Town Board approval of a sign not to exceed
24 square feet , reading Orchard Hill , A Subdivision of Distinction ,
Ed Austin , Real Estate Broker , 272 - 1440 , together with pictorial matter ,
as a temporary freestanding sign with option to renew at the end of
one year , it being noted that no variance is required for this signage .

RESOLVED , that the Planning Board of the Town of Ithace urge and hereby
does urge the Town Board to continue its negotiations with Tompkins
County. and Cornell University to effect a connector road between Pine
Tree Road and Route 366 and between Route 366 and the Northeast Town of
Ithaca , and that that section between Pine Tree Road and Route 366 be

constructed as soon as possible in order to relieve the present hazards
at the intersections at Pine Tree Road - Ellis Hollow Road - Judd Falls
Road - and the East Hill Plaza Shopping Center , and further , that , if
feasible , the alignment of Pine Tree Road and the connector cross Ellis
Hollow Road east of the Elderly Housing Complex , and
FURTHER RESOLVED , recognizing that under the most favorable conditions ,
such a connector permitting improvement in the traffic patterns in this
area , could not be completed for several years , the Planning Board urges
the Town Board to establish a Committee consisting of two members of
the Planning Board , two members of the Town Board , and the Town
® Engineer , to be charged with recommendations for immediate relief of
the traffic hazards at the Pine Tree Road / Ellis Hollow Road / Judd Falls
Road and East Hill Plaza intersections , such a report to be submitted
® to the Town Board by October 13 , 1980 , and
FURTHER RESOLVED , that the Planning Board urges that the Town Board
should apply immediately to the New York State Department of Trans -
portation for lowering of the speed limit on Pine Tree Road between
intersection with Snyder Hill Road and Ellis Hollow Road from 55 MPH
to 35 MPH , and
FURTHER , the intersection of Judd Falls Road - Ellis Hollow Road -
Pine Tree Road was described as traditionally hazardous by the Town
of Ithaca Planning Board at rezoning hearings in 1968 ( Barnes -
Kenniworth ) and at that time the Planning Board recommended its
immediate improvement . Since 1968 , the development of East Hill
Plaza area , increased residential development in the Town of Ithaca
as well as in neighboring towns , the closing of Cornell Campus to
traffic , and the development of " B " Parking Lot , have resulted in
increased volume of traffic through these intersections .
PUBLIC HEARING TO CONSIDER THE PROPOSED REZONING OF A PORTION
OF LAND PRESENTLY ZONED BUSINESS " D " TO BUSINESS " C " , IN
CONJUNCTION WITH THE PROPOSED REZONING OF A PORTION OF LAND
PRESENTLY ZONED BUSINESS " C " TO BUSINESS " D " , AT EAST HILL PLAZA
Proof of posting and publication of notice of public hearing to
consider the proposed rezoning of a portion of land presently zoned
Business " D " to Business " C " , and in conjunction with the land
presently zoned Business " C " to Business " D " , at the East Hill
Plaza in the Town of Ithaca having been presented by the Town Clerk ,
the Supervisor opened the hearing .
Mr . Stewart Knowlton , Partner in the East Hill Plaza noted that he
had originally proposed a 4 - bay car wash in a Business " D " zone .
However , he now wished to relocate the car wash at the rear of the
Plaza , behind the Depot Restaurant .
He further stated that the Gas Station would remain in Business " D "
zone . A portion by the P & C Store would become Business " D " zone
entirely . The parcel behind the P & C Store including Rite Aid and
half of the liquor store will be changed from Business " C " to Business
" D " . The remainder would become rezoned from Business " D " to Business
" C " . The parcel west of the P & C Store would be modified and rezoned
Business " D " to Business " C " .
Councilwoman Raffensperger asked the Town Engineer if the rezoning
coincides with his understanding of the proposal presented to the
Planning Board ?
Town Engineer Fabbroni answered yes .
Councilwoman Raffensperger stated that the East Hill Civic Association
much preferred the car wash behind the Plaza and also approved the
rezoning . of the portions from Business " C " to Business " D " .
Councilwoman Valentino asked who was responsible for the driveway ?

Mr . Knowlton stated that the Depot Restaurant was responsible for the
driveway .
Supervisor Desch stated that the short form Environmental Assessment
was completed and that there was a negative declaration .
RESOLUTION NO . 126
Motion by Supervisor Desch ; seconded by Councilman Del Rosso ,
RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes
® the rezoning of a portion of lands presently zoned Business " D " to
Business " C " . Parcels No . 6 - 6 - 2 - 2 - 1 . 121 and 6 - 62 - 2 - 12 in conjunction
with the proposed rezoning of a portion of lands presently zoned
® Business " C " to Business " D " , Parcel No . 6 - 62 - 2 - 13 . 2 at East Hill
Plaza , Groff Associates , Stewart Knowlton , Partner , for the purpose
of a 4 - bay car wash to be located behind the P & C Store ,
AND FURTHER BE IT RESOLVED , that the environmental review in accordance
with Town of Ithaca Local Law No . 3 , 1980 , finds no significant en -
vironmental impact will result from the rezoning .

WALKWAY
Mr . Knowlton noted that he was delighted to present to the Town Board
a deed , which he himself recorded , to the walkway behind the Ellis
