HomeMy WebLinkAboutTB Minutes 1980-01-21 � 3 TOWN OF ITHACA ADJOURNED BOARD MEETING January , 21 , 1980 At an Adjourned Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices at 126 East Seneca Street , Ithaca , New York at 7 : 00 p . m . , on the 21st day of January , 1980 , there were PRESENT . Noel Desch , Supervisor Victor Del Rosso , Councilman Shirley Raffensperger , Councilwoman Henry McPeak , Councilman Marc Cramer , Councilman ALSO PRESENT : Catherine A . Valentino Edward L . Bergen Representatives of the Media : Carol Eisenberg , Ithaca Journal ABSENT : George Kugler , Councilman PLEDGE OF ALLEGIANCE The Supervisor led the assemblage in the Pledge of Allegiance . Supervisor Desch expressed his sympathy to Town Engineer Larry Fa-bbroni , on behalf of the Town Board , on the passing of his father . Mr . Fabbroni will be away from the office on occasion during February and , March . TOWN BOARD VACANCY Supervisor Desch stated there were two candidates vying for the vacant seat on the Town Board , Catherine Valentino and David Fernandez . Each have received endorsement from their respective party . Supervisor Desch called for a roll call vote . Councilman McPeak Valentino Councilwoman Raffensperger Fernandez Councilman Cramer Valentino ® Councilman Del Rosso Valentino Supervisor Desch Valentino RESOLUTION NO . 14 , 1980 ® Motion by Supervisor Desch ; seconded by Councilman Cramer , WHEREAS , a vacancy exists on the Town Board due to the resignation of Charles G . McCord , and WHEREAS , Catherine Valentino received the majority of the vote of the Town Board members present , NOW , THEREFORE , BE IT RESOLVED : That Catherine Valentino be appointed to fill the vacancy created by the resignation of Charles G . McCord , through December 31 , 1980 . Town Board Minutes - 2 - January 21 , 1980 A roll call vote resulted as follows : Supervisor Desch Voting Aye Councilman Cramer Voting Aye Councilman Del Rosso Voting Aye Councilman McPeak Voting Aye Councilwoman Raffensperger Voting Nay The resolution was thereupon declared duly adopted . DOG CONTROL CONTRACT WITH VILLAGE OF CAYUGA HEIGHTS Supervisor Desch reviewed the following Dog Control Contract with the Village of Cayuga Heights : AGREEMENT THIS AGREEMENT , made as of the lst day of January , 1980 , pursuant to the provisions of Section 114 of the Agriculture and Markets Law , by and between the Village of Cayuga Heights , a municipal corporation of the State of New York , party of the first part , and the Town of Ithaca , a municipal corporation of the State of New York , party of the second part . WITNESSETH FIRST . That the party of the second part covenants and agrees that : The party of the second part , through its contractual agreement with the County of Tompkins and Tompkins County Society for the Prevention of Cruelty to Animals , will seize and impound dogs within the corporate limits of the party of the first part , whether or not licensed or tagged , not restrained by a . leash while off the owner ' s premises in violation of Village of Cayuga Heights Local Law # 1 - 1978 duly adopted by the party of the first part re - quiring all dogs to be so restrained ; will provide and maintain a shelter or pound for seized dogs and for lost , strayed or home - less dogs ; will humanely destroy or dispose of , pursuant to and as provided in Section 118 of the Agriculture and Markets Law , seized dogs not redeemed as provided in Article 7 of such law and will properly care for all animals in such shelter , which shall at all times during the term hereof be under the care and charge of a competent employee and shall be open to the public daily , legal holidays excepted , Monday through Fridays from 1 : 00 p . m . to 5 : 30 p . m . and Saturdays and Sundays from 1 : 00 p . m . to 3 : 30 p . m . ( or such other reasonable times as agreed by the parties ) . SECOND . The part of the second part to provide seizure and impound - ment service only upon the request of the Police Department of the Village of Cayuga Heights and not furnish any regular patrolling of • the Village , unless so requested , nor perform other duties unless requested to do so by the Police Department . If any complaint is received directly by the party of the second part or the SPCA , such complaint shall be referred to the Cayuga Heights Police Department • for further instructions . THIRD . This agreement shall commence on January 1 , 1980 and shall continue through December 31 , 19800 ( Supervisor Desch read a memo from Town Attorney James V . Buyoucos which suggested the Town add the following fourth paragraph to the contract ) : FOURTH . Notwithstanding any of the foregoing provisions , it is understood that this agreement is entered into by the Town only on the following stipulation : / 36 Town Board Minutes - 3 - January 21 , 1980 a ) The Town has no personnel to provide the enforcement and services required by this agreement . The Town can provide the ser - vices required by this agreement only to the extent that such services are made available and furnished by the County and/or the SPCA , pur - suant to the above referred to contract . If the County and/or the SPCA fail to provide any services required by this agreement , the Town shall not be held liable to anyone for failure to provide such services and the Town' s obligation to provide such services shall cease . IN WITNESS WHEREOF , the parties hereunto have caused their corporate seals to be hereunto affixed and this agreement to be ® signed by their duly authorized officers , the day and year first above written . RESOLUTION N0 . 15 , 1980 ® Motion by Councilman Cramer ; seconded by Councilman McPeak , WHEREAS , the Town Attorney suggests that a fourth paragraph be added to the Dog Control Contract with the Village of Cayuga Heights , and WHEREAS , . it . was agreed by the Town Board that a fourth paragraph be added to the Contract , NOW , THEREFORE , BE IT RESOLVED : That the Supervisor be authorized to sign the Dog -, Conttol. _. Contract with the Village of Cayuga Heights . ( Desch , Cramer , Del Rosso , McPeak , Raffensperger , and Valentino voting Aye . " Nays - none ) The resolution was , therefore , duly adopted . Councilwoman Valentino noted dogs were being picked up without written requests . It was noted that the Agreement between the Towns , City and the SPCA are clearly written regarding the enforce - ment in each municipality . The new law requires filing a complaint in regard to an unlicensed dog ; then they will be picked up . VEHICLE FOR BUILDING INSPECTOR Bids for a new car for the Building Inspector were reviewed . The apparent low bidder was Murphy Chevrolet , Inc . , of Trumansburg , New York , with a bid of $ 3 , 959 . 53 for a 1980 Chevrolet Chevette Scooter . Murphy Chevrolet , Inc . also submitted a lower bid of $ 3 , 881 . 31 for a 1980 Chevrolet Chevette Scooter they have in stock . However , the 1980 Chevrolet Chevette Scooter in stock does not meet specifications , as it is not equipped with a heavy duty battery or ® rear defogger . Also , a non - collusion certificate was not included with the bid . Supervisor Desch recommended the acceptance of the low bid of $ 3 , 881 . 31 from Murphy Chevrolet , Inc . for the Chevrolet Chevette Scooter currently in stock , contingent upon the filing of a non - collusion certificate . Also , that the heavy duty battery and rear defogger are added , at a total cost of the vehicle not to exceed $ 3 , 959 . 53 . Town Board Minutes - 4 - January 21 , 1980 RESOLUTION NO . 16 , 1980 Motion by Councilman Cramer ; seconded by Councilman Del Rosso , WHEREAS , Murphy Chevrolet , Inc . , of Trumansburg , New York , was the apparent * low bidder on a Chevrolet Chevette Scooter , to be used by the Building Inspector , NOW , THEREFORE , BE IT RESOLVED , that the low bid of $ 3 , 881 . 31 received from Murphy Chevrolet , Inc . of Trumansburg , New York , for the Chevrolet Chevette Scooter , in stock , be accepted con - tingent on Murphy Chevrolet , Inc . filing a non - collusion cer - • tificate and the car being modified to include a heavy duty battery and rear defogger , not to exceed the price of $ 3 , 959 . 53 . ( Desch , Cramer , Del Rosso , Raffensperger , Valentino , and McPeak • voting Aye . Nays - none ) . . The resolution was , therefore , duly adopted . RAMP PARKING REIMBURSEMENT The subject of employees parking reimbursement , which was tabled at the January 7 , 1980 meeting was again put forth for discussion . The prices , ranging from $ 17 . 50 to $ 20 . 00 , paid by the employees at the various parking lots were discussed . Councilman Cramer noted the top . floor of the Green Street lot had increased from $ 5 . 00 to $ 7 . 50 per month . Councilman Cramer also noted the City would be willing to give the Town a lower contract price . It was then brought to the Board ' s attention that the employees were not happy with the Green Street lot be - cause of safety and security reasons . RESOLUTION NO . 17 , 1980 A motion was made by Councilwoman Raffensperger ; seconded by Councilwoman Valentino , WHEREAS , the cost of parking for Town employees has increased drastically , NOW , THEREFORE , BE IT RESOLVED , that the employees ' parking reimbursement be increased from $ 10 . 00 to $ 15 . 00 per month for employees utilizing such parking daily , and BE IT FURTHER RESOLVED , that a percentage formula for parking be included in the wage increases for each participating parking employeee in the 1981 Budget . ( Raffensperger , Valentino , Cramer , Desch , Del Rosso and McPeak voting Aye . Nays - none ) The resolution was , therefore , duly adopted . ADJOURNMENT The meeting was duly adjourned . Jean H .
