APPROVAL OF MINUTES - RESOLUTION NO . 99
Councilwoman Raffensperger noted that in the minutes of
April 23 , 1979 with regard to discontinuance and re - instatement
of playgrounds , in both instances the word " City " should be re -
placed by " Youth Bureau " .
Motion by Councilman Powers ; seconded by Councilman McElwee ,
RESOLVED , that the minutes of April 9 , 1979 are hereby approved
as presented by the Town Clerk ; that the minutes of April 23 ,
1979 , as corrected , are hereby approved .

Town Board Minutes - 2 - June 11 , 1979
REPORTS OF TOWN OFFICIALS
Town Supervisor
Supervisor Desch reported that the Department of Transporta -
tion has turned down the Town ' s request to establish a reduced maxi -
mum speed on Pleasant Grove Road ( from 40 miles per hour to 30 miles
per hour ) . Their letter states that their investigation of the matter
has been completed , that speed data - compiled on May 5 , 1979 confirmed
that the present maximum speed is realistic . Their letter states that
the " speed limit on Pleasant Grove Road was . lowered in 1973 to the
existing 40 MPH . The data compiled in our new study compares very
closely to that taken in 1973 . This further justifies the present
limit . It is our policy to neither condone excessive speeding nor
make technical violators out of average motorists driving at speeds
which are reasonable and prudent . "
Supervisor Desch said the Town does not find this decision
acceptable . He distributed to the Board members proposed letter to
Hon . Hugh S . MacNeil , Assemblyman , copy of which is attached to these
minutes . The Board agreed that the DOT ' s decision was not acceptable
and agreed that the letter should be sent to Assemblyman MacNeil .
Mrs . Livesay recommended that this matter should be discussed
with Mr . William Mobbs , Commissioner of Public Works ( Tompkins County ) .
She said her experience indicated that the opinion of the Commissioner
of Public Works of the County carries a lot of weight . It was noted
that in all requests to the Department of Transportation , a copy goes
first to Mr . Mobbs for his comment and it is then forwarded to the
Department of Transportation . The Town does not see the comments
made by Mr . Mobbs . Mrs . Livesay said she doubted if there really is
a State formula and she even questioned whether they do , in fact ,
always make an investigation of the local situation . Supervisor Desch
said they do have a definite formula which is extremely narrow in
terms of its relationship with the traffic engineering aspects and
that they have no broad consideration of the localized situation .
Mr . Fabbroni said that in his view traffic engineering , properly speak -
ing , should include social considerations . He said he felt that the
study made by the Department of Transportation is not complete .
Councilman McElwee asked if the decision of the DOT might
not be appealed . Supervisor Desch said he thoughtl. additionallfacts
may be submitted and inquiry made as . to the thoroughness of the field
review . He noted further that often it takes a full year to get an
official denial .
Supervisor Desch said he was concerned as to whether the
Town Highway Department would be able to get sufficient gasoline
to carry out its necessary responsibilities . He said the Town should
evaluate its storage capacity and its allocation in terms of the things
the Town is doing . He said it may well be that the Town ' s storage
capacity should be increased so that during periods of low State -wide
usage , sufficient gasoline could be stored so that the Town could get
by the " crunch " periods .
Mr . Parkin said an average of 1 , 000 gallons each of diesel
and regular gas is used each month . In special periods ( oiling ,
stoning , plowing ) it runs higher , perhaps up to 2 , 000 gallons .
Mr . Parkin reported that the Town Highway Facility has
sufficient storage capacity fof 2 , 000 gallons of gasoline , 2 , 000
gallons of diesel fuel , and 2 , 000 gallons of heating oil for the
building .

HIGHWAY SUPERINTENDENT
Mr . Parkin reported that they have received the 16 - ton equip -
ment trailer from Rochester Equipment Company ( on June 7 ) . They
have received the bulldozer from Arsenault , which is working out
very well . They have received the radio for the park crew ' s use .
Mr . Parkin said the Highway Department has been hauling
stone into the shop for surface treating , they are doing consider -
able patching - - cold and hot - - in preparation for paving and sur -
face treating roads .
Mr . Parkin submitted a list of Town roads and mileages for
the Board ' s review .
RESOLUTION N0 . 100 , 1979
Motion by Councilman McElwee ; seconded by Councilman Powers ,
RESOLVED , that. this Town Board , after review , hereby approves the
list of Town of Ithaca roads and mileages thereof submitted by the
Highway Superintendent , copy of which list is made a part of the
master copy of these minutes .

Mr . Parkin submitted " Agreement to Spend Town Highway Funds "
and requested that the Board review this and then have it executed
by all Town Board members present . The Board reviewed the list and
found it acceptable .
TOWN ATTORNEY
The Town Attorney said he had several matters to discuss
but would hold them for . an executive session later in the meeting .
PLANNING BOARD CHAIRMAN
Mr . Henry Aron , Planning Board Chairman , read his report
as follows :
" 1 . As I . am sure you are all aware , the Planning Board met on May
15 , 1979 , with all eight of its members in attendance , and granted
Final Subdivision Approval to the Ivar Jonson Development off Texas
Lane , 9 lots in the Town of Ithaca , as follows :
RESOLVED , that the Planning Board of the Town of Ithaca grant , and
hereby does grant , Final Subdivision Approval for a 9 - lot Subdivision
in the Town of Ithaca backlot of Texas Lane and Siena Drive , Town of
Ithaca Tax Parcel No . 6 - 71 - 1 - 9 , as presented by Mr . Ivar Jonson ,
Developer , on map entitled " Map of Ivar. Jonson Sub -Division , Ivar
Jonson , Owner and Developer , off Texas Lane Ext . , Town of Ithaca ,

his presenting to the Town Engineer plans with respect to any holding

of something that would hold water in the case of a large runoff of
water and yet not hold standing water at all times ; and also contingent
upon Lisa Lane being moved westerly six feet from where it is shown
on the said subdivision map , as presented , with hopes of saving the
trees .

Town Board Minutes - 5 - June 11 , 1979
to allow a gallery where artistic works are hung , made by other
than those .residing in the " Art Colony " . Mr . Barney said it was
the recommendation of his firm that the matter be referred to the
Zoning Board of Appeals for a determination on this issue before
the Town Board makes a final determination on rezoning . He said
his office has prepared a proposed resolution for the Board ' s con -
sideration whereby the matter is referred to the Zoning Board of
Appeals for a variance from the Zoning Ordinance . Mr . Barney read
the resolution , and the Board discussed the ramifications of per -
mitting such sales , and acted as follows .
RESOLUTION N0 . 101 , 1979
Motion by Councilman McElwee ; seconded by Councilman Powers ,
. RESOLVED , that the application of Herbert and Evan Monkemeyer for
the rezoning of an area at 1059 Danby Road to a Multiple Residence
District be referred to the Zoning Board of Appeals for an approval
varying the terms of this ordinance so as to permit the display and
sale in the gallery of the existing barn of artistic works of per -
sons other . than the occupants of the building in the rezoned area
and to permit such other varying of the terms of the ordinance as
may be necessary in connection with such application , and FURTHER
RESOLVED , . that upon the completion of the consideration of the
matter by the Zoning Board of Appeals the application be returned
to the Town Board for a final determination .

REPORTS OF COUNTY REPRESENTATIVES
Mr . Gust L . Freeman , County Representative , reported that
Mr . Fabbroni , last Wednesday , addressed the Public Works Committee
of Tompkins County on the matter of Northeast Transit . The County
Budget and Administration Office approved the allocation of funds
and the County Board of Representatives adopted the resolution
approving the expansion of the Northeast Transit bus system . The
only thing lacking now is the City of Ithaca and the Village of
Cayuga Heights Commitment .
Mr . Freeman reported that the Mental Health Board has a
vacancy . Any suggestions for filling this vacancy would be appre -
ciated .
Mrs . Livesay , County Representative , reported on a County
Youth Program saying that the County has augmented its summer CETA
Program with a program funded through Social Services . The require -
ments are that the young people served must be in school - - college
or thereafter , depending on age .
Mrs . Livesay said the Town ought to be more involved with
the Youth Bureau in determining what planning should be developed
in the Town of Ithaca . It is something , she said , that the Town
must deal with ; that it should be looked into next year much earlier
on .
REPORT OF TOWN ENGINEER
Mr . Fabbroni reported that Tallman & Tallman will have a
preliminary report this Friday ( June 15 ) regarding renovations to
the Town Hall . By the next Town Board meeting it should be known
what form the architectural changes will take .
Town Board Minutes - 6 - June 11 , 1979
Mr . Fabbroni requested authorization to bid the Stone
Quarry Road water extension project . He said the revised budget
is not much different than the original budget . It is now $ 241 , 000 ,
up about $ 5 , 000 or $ 6 , 000 from the original project budget . The
plans are now complete , specifications complete ; the Health Depart -
ment is reviewing the plans , and as soon as their review is com -
pleted the project will be ready to go to bid . Mr . Fabbroni said
he had asked Mr . John C . Barney to look over the specifications to
determine whether they are happy with the draft form of the agree -
ment , the performance bond , and the insurance required . Mr . Fabbroni
felt it is time to go to bid and it will be possible to take action
on the bids at the July meeting of the Board .
RESOLUTION N0 . 102 , 1979
Motion by Councilman McElwee , seconded by Councilwoman Raffensperger ,
RESOLVED , that the consulting engineers ( Lozier ) are hereby
authorized to release bid documents on the Stone Quarry Road
water extension project , subject to Health Department approval ,
and the Town Engineer ' s determination that no adverse impact on
the project budget results , and with the understanding that the
bid award cannot be made until the Department of Audit and Control
has approved the financial plan , as set out in the application , and
that under these circumstances the Town Engineer is authorized to
submit the project for bidding at the earliest possible moment .

Matters of timing of the bidding and the award of the bid
in relation to approval of the Department of Audit and Control were
discussed , and no particular problems were envisaged .
Mr . Fabbroni reported that the sewer extension survey has
been completed by Lozier Engineers . They are going ahead with the
design and preliminary " topo " layout of the sewer extensions pro -
posed along Valley View Road , West Haven Road , and Slaterville Road .
Mr . Fabbroni reported that they are ready to go on the
Snyder Hill Road storm sewer project . He said there are a few
logistical problems which he described to the Board .
TOWN PLANNER
Ms . Barbara Restaino reported on the work at the parks .
She said the grass is coming along very well . Most of the ground -
work on the Eastern Heights Park , including grading , has been done .
The weather has been good . Three picnic areas have been prepared ,
as well as the ballfield . They have done as much as possible con -
sidering the slope and the rock . The whole area is much improved
from two months ago . She recommended that all the Board members
and others should make a personal inspection of the park areas .
The project is proceeding smoothly . There have been some problems
with the CETA workers , but that is being worked out with the CETA
. office and things at the present time are pretty well under control .
Ms . Restaino said they will be moving on soon to Northview Road West
park where there will be some drainage problems . A backhoe will
be brought in and the area will be built up . She said that each
park site is a new challenge .

Town Board Minutes - 7 - June 11 , 1979
Mr . Fabbroni reported that the painting of the Danby Road
Tank is nearing completion . By the end of this week it should be
almost completed . Then they will move on to the Sapsucker Woods
Tank . The painters are on strike now , so that the key personnel
are carrying on during the strike . The work , however , is proceed -
ing and the performance portion of the contract has not been affected .
JOB RECLASSIFICATION - SENIOR ACCOUNT
CLERK TYPIST TO ACCOUNT CLERK TYPIST
Supervisor Desch said this item has to do with a correction
involving reclassification of position of Ms . Sally Alario . When
she was hired the position of Account Clerk Typist was created , but
on the authorizing resolution the job was noted as Senior Account
Clerk Typist .
RESOLUTION NO . 1031 1979
RESOLVED , that the Civil Service job classification of Senior
Account Clerk Typist ( now occupied by Ms . Sally Alario ) shall be
changed to Account Clerk Typist to be consistent with Civil Service
records , with the examination taken by Ms . Alario , and with the work
performed by her at this time .

OFFICE FOR THE AGING PRESENTATION
RENEWAL CONTRACT - JULY 1 , 1979 - June 30 , 1980
Beverly Stone , Senior Citizens Council , made a presenta -
tion on behalf of the Office for the Aging regarding the renewal
of a contract with the Town for the Recreation Program for the
Elderly . Supervisor Desch stated that the Town ' s budget process
does not start until August or September . $ 1 , 000 has been budgeted ,
but it is almost impossible for the Town to double that amount
( as in the current request ) until the Town prepares its budget
for 1980 . The Town is committed to the $ 1 , 000 through December 31 ,
1979 . Therefore , the Supervisor suggested that the Senior Citizens
group submit their proposal later in the year for the Board to con -
sider for the calendar year 1980 .
It was agreed , then , that the proposal would be presented
again in August .
SEWER SYSTEM EVALUATION SURVEY
Supervisor Desch noted that each Board member had received
a draft of the " Intermunicipal Agreement to Finance Ithaca Sewer
System Evaluation Survey ( SSES ) " . He said this document now ties
all the loose ends together as far as the various pieces of the work
to be done , including engineering contract costs , and dealing with
improvement to the Cornell University system .
After brief discussion , the Board acted as follows :

Motion by Councilwoman Raffensperger ; seconded by Supervisor Desch ,
RESOLVED , that the Town Board of the Town of Ithaca approve , and
hereby does approve , draft of Intermunicipal Agreement to Finance
Ithaca Sewer System Evaluation Survey ( SSES ) , dated May 23 , 1979 ,
copy of which is attached hereto , together with approval of Appendix
A ( Method of Cost Allocation , Intermunicipal Agreement , Sewer System
Evaluation Survey ( also attached hereto ) .

Town Board Minutes - 8 - June 11 , 1979
AGREEMENT TO SPEND TOWN HIGHWAY FUNDS
Highway Superintendent Parkin submitted to the Board
Agreement to Spend Town Highway Funds ( 1979 ) . The Board reviewed
the agreement and found it in order and acted as follows .
RESOLUTION NO . 1051 1979
Motion by Supervisor Desch ; seconded by Councilman McElwee ,
RESOLVED , that this Board hereby approves the Agreement to Spend
Town Highway Funds , as submitted by the Highway Superintendent ,
for the year 1979 .

Nays - none )
Mr . Parkin noted that the agreement would have to be
executed by the Supervisor and the other Board members .
APPOINTMENT TO TOWN BOARD
Supervisor Desch noted that an appointment must be made
to the Town Board to replace Mr . Gust L . Freeman who has resigned
from the Town Board and who has been appointed a Town of Ithaca
representative on the County Board of Representatives .
Supervisor Desch said a letter has been received from
the Democratic Committee endorsing Mr . Henry Aron . The Supervisor
read the letter of endorsement . The Supervisor noted also that a
Mr . George Kugler , 101 Pineview Terrace , has written the Supervisor
to express interest in being appointed to the Town Board . Mr . Kugler
reports that he has been a resident of the Town for six years and
has been a spokesman for the neighborhood on zoning problems and
feels strongly committed to the Town of Ithaca . Mr . Kugler lived
in Skaneateles, N . Y . where he was active in writing zoning ordi -
nances . At the present time he is Assistant Director of Physical
Plant at Ithaca College . He is involved with estimating , specifi -
cation writing , and providing utility services to the College .
Supervisor Desch said he thought the Town would be proud
to have either of these gentlemen on the Board . He said that Mr .
Aron , in his . view , is doing an outstanding job as . Chairman of the
Planning Board which is a very active and effective Board . The
Supervisor noted also . that there is not a Town Board member at this
time from the South Hill area ( although he , himself , lives in a far
corner of South Hill ) ,
RESOLUTION NO . 106 , 1979
Motion by Supervisor Desch , seconded by Councilman McElwee ,
RESOLVED , that this Town Board appoint , and hereby does appoint ,
Mr . George Kugler , 101 Pineview Terrace , to fill the vacancy created
by the appointment of Mr . Gust L . Freeman to the County Board of
Representatives , such appointment to be through December 31 , 1979 .
Councilwoman Valentino asked if Mr . Kugler had been recom-
mended by a political group . Supervisor Desch said he had been
recommended by the Republican Party . Councilwoman Valentino said
that she had been aware of Mr . Aron ' s candidacy but not of Mr .
Kugler ' s interest . She said she would not like to make a decision
on such short notice . Councilman Powers agreed with this position .
Town Board Minutes - 9 - June 11 , 1979
Councilman Powers said it would not be appropriate to vote on the
motion without at least meeting Mr . Kugler and talking with him .
He said he would find it difficult to vote for someone for a position
on the Board with nothing but a brief letter as guidance . Supervisor
Desch felt the appointment should be made as quickly as possible
since the vacancy has existed for about a month . He did say , how-
ever , upon question from Councilman Powers , that the vacancy could
be allowed to run until election day . He noted a practical problem ,
however , in that designating petitions must be filed in July . Should
no appointment be made at this meeting there could be a time problem
if the appointment were made in July at the July meeting . Supervisor
Desch felt also that the Townspeople should be given an opportunity
to judge the performance of whoever is appointed prior to the elec -
tion in the fall . He said , further , that deferring the appointment
would not be doing a service to the Town since a full Board is re -
quired to property conduct the business of the Town . Councilman
Powers said he was not suggesting that the Board wait until the
July meeting ; that this meeting could be deferred to another meet -
ing this month . There was general agreement that this meeting could
be adjourned to June 25th without adversely affecting the timing .
Councilwoman Raffensperger said there was a motion on the
floor and she called the question . Roll call vote was as follows .

RESOLUTION NO . 107 , 1979
Motion by Councilwoman Raffensperger ,
RESOLVED , that the Town Board appoint , and hereby does appoint ,
Mr . Henry Aron , 106 Woolf Lane , to fill the vacancy created by
the resignation from the Town Board of the Town of Ithaca of Mr .
Gust L . Greeman , who has been appointed to the County Board of
Representatives , such appointment to be through December 31 , 1979 .
The motion failed for lack of a second .
Councilwoman Raffensperger stated that she felt that the
person recommended by - the Ithaca Democratic Party should have been
given the courtesy of being voted upon since he represents almost
half of the voters in the Town of Ithaca . Supervisor Desch said
that Councilwoman Raffensperger ' s statement is noted for the record .
BENEFIT FORMULA REVISION
Supervisor Desch stated that revision of the water and
sewer benefit formula , with regard to developers of subdivisions ,
has been discussed for some time . The Supervisor provided the .
Board . members with a chart of the steps involved in this revision
beginning with " Land Development " and with the following language
to be considered :
" In an approved subdivision where a developer has constructed
an approved water distribution main and /or a sanitary sewer
collector serving part or all of the subdivision , the benefit
on that portion of the subdivision served shall be deter -
mined by the standard provisions herein as if the utility

" It is interesting to note that this Public Hearing was the seventh
meeting .held by the Planning Board in the consideration of this matter ,
with four of the seven meetings , including the last one wherein final
approval was granted , being Public Hearings .
" 2 . At the same meeting , May 15th , the Planning Board held another
Public Hearing to consider Preliminary Subdivision Approval for a
subdivision proposed by the Inlet Valley Land Co - Op , Inc . , of approxi -
mately 98 acres on Calkins . Road . With . no one appearing in opposition
to this proposed development , and after lengthy discussion , the Plan -
ning Board resolved to grant Preliminary Subdivision Approval as fol -
lows :
RESOLVED , that the Planning Board of the Town of Ithaca grant and
hereby does grant preliminary subdivision approval for Inlet Valley
Land Co -Operative , Inc . , 171 Calkins Road , Town of Ithaca Tax Parcel
No . 6 - 33 - 1 - 4 , approximately 98 . 5 acres , as presented on May 15 , 1979 ,
on map entitled , " Final Plat , Inlet Valley Land Cooperative , Inc . ,
Owner : Jerold M . Weisburd , Part of Lot 79 , Town of Ithaca , Tompkins
County , New York , Project No . 1938 , " drawn by Rowell and Associates
P . C . , 111 West Road , Cortland , N . Y . 13045 , subject to the review and
approval of the By -Laws of said Cooperative by the Town Attorney and
subject to the approval of the Town Engineer of drainage and roadway
plans .

MONKEMEYER REZONING - THE ART COLONY
Mr . John C . Barney ( Buyoucos & Barney ) stated that this

A LOCAL LAW FOR CROSS - CONNECTION CONTROL
ARTICLE 1 . PURPOSE '
I
I
The purpose of these regulations is to safeguard potable
water supplies by preventing backflow into public water systems .
The regulations are to be reasonably interpreted . It is
the intent of these regulations to recognize that there are varying
degrees of hazard and to apply the principle that the degree of pro -
tection should be commensurate with the degree of hazard .
ARTICLE 2 . DEFINITIONS
1 . Cross - Connections . The term " cross - connection " as used
in these regulations means any unprotected connection between any
part of a water system used or intended to supply water for drinking
purposes and any source or system containing water or substance that
is not or cannot be approved as equally safe , wholesome , and potable
for human consumption . !
2 . Approved Water Supply . The term " approved water supply "
means any water supply approved by the New York State Department of
Health .

3 . Auxiliary Supply . The term " auxiliary supply " means
any water supply on or available to the premises other than the
approved public water supply .
4 . Vacuum Breaker - Nonpressure Type . A vacuum breaker
which is designed so as not to be subjected to static line pressure .

5 . Vacuum Breaker - Pressure Type . A vacuum breaker designed
to operate under conditions of static line pressure .
6 . Barometric Loop . A loop of pipe rising approximately 35
feet , at its topmost point , above the highest fixture it supplies .
7 . Approved Check Valve . The term " approved check valve "
means a check valve that seats readily and completely . It must be
carefully machined to have free moving parts and assured watertight -
ness . The face of the closure element and valve seat must be bronze
composition , or other non - corrodible material which will seat tightly
under all prevailing conditions of field use . Pins and bushings shall
be of bronze or other non - corrodible , non - sticking material , machined
for easy , dependable operation . The closure element , e . g . clapper ,
shall be internally weighted or otherwise internally equipped to pro -
mote rapid and positive closure in all sizes where this feature is
obtainable .

8 . Approved Double Check Valve Assembly . The term " approved
double check valve assembly " means an assembly of at least two in -
dependently acting check valves , including tightly closing shutoff
valves on each side of the check valve assembly , and suitable leak -
detector drains plus connections available for testing the watertight -
ness of each check valve .
This device must be approved as a complete assembly .

9 . Approved Reduced Pressure Principle Backflow Prevention
Device . The term " approved reduced pressure principle backflow pre -
vention device " means a device incorporating two or more check valves
and an automatically operating differential relief valve located be -
tween the two checks , two shutoff valves , and equipped with necessary
appurtenances for testing . The device shall operate to maintain the
pressure in the zone between the two ch & ck valves , less than the pres -
sure on the public water supply side of the device .

At cessation of normal flow , the pressure between check
valves shall be less than the supply pressure . In case of leakage
. of either check valve , the differential relief valve shall operate
to maintain this reduced pressure by discharging to the atmosphere .
When the inlet pressure is two pounds per square inch or less , the
relief valve shall open to the atmosphere , thereby providing an air
gap in the device . To be approved , these devices must be readily
accessible for maintenance and testing and installed in a location
where no part of the valve will be submerged . The enclosure must
be self - draining , so that the large amount of water which the relief
valve may vent will be disposed of reliably without submergence of
the relief valve .
This device must also be approved as a complete assembly .
10 . Air- Gap Separation . The term " air gap separation " means
a physical break between a supply pipe and a receiving vessel . The
air gap shall be at least double the diameter of the supply pipe ,
measured vertically above the top rim of the vessel , in no case less
than one inch .
11 . Water Supervisor . The term " water supervisor " means the
consumer or a person on% the premises charged with the responsibility
of complete knowledge and understanding of the water supply piping
within the premises and for maintaining the consumer ' s water system
free from cross - connections and other sanitary defects , as required
by regulations and laws .
12 . Certified Backflow Prevention Device Tester - is a person
who is examined annually by the water purveyor , and found competent
for the testing of backflow prevention devices . He shall be provided
with an appropriate identification card which must be renewed annually .
Failure to perform his . duties competently and conscientiously will
result in prompt withdrawal of his certification .

ARTICLE 3 .
PROTECTION OF PUBLIC WATER SYSTEM AT SERVICE CONNECTION
Section I . Where Protection Is Required .
1 . Each service connection from a public water system for
supplying water to premises having an auxiliary water supply
shall be protected against backflow of water from the premises
into the public water system , unless the auxiliary water supply
is approved as an additional source by the water purveyor and
is satisfactory to the public health agency having jurisdiction
with regard to quality and safety .
2 . Each service connection from a public water system for
supplying water to premises , on which any substance is handled
under pressure in such fashion as to permit entry into the
water system , shall be protected against backflow of the water
from the premises into the public system . This shall include
the handling of process waters and waters originating from the
public water supply system which may have been subject to de -
terioration in sanitary or chemical quality .
3 . Each service connection from a public water system for
supplying water to premises on which a substance of unusually
toxic concentration or danger to health is handled in liquid
form , even though it is not under pressure , shall be protected
against backflow of the water from premises intoAthe public
system . Examples are plating factories , using cyanide and
hospitals . This is not intended to apply to normal household
installations .

4 . Backflow prevention devices shall be installed on the
service - connection to any premises that have internal cross -
connections , unless such cross - connections are abated to the
satisfaction of the water purveyor .
It shall be the responsibility of the water user to provide
and maintain these protective devices , and each one must be
of a type acceptable to the State Health Department .
Section II . Type of Protection . The protective device required shall
depend on the degree of hazard as tabulated below .
1 . At the service connection to any premises where there
is an auxiliary water supply handled in a separate piping
system with no known cross - connection , the public water supply
shall be protected by an approved double check valve assembly .
29 At the service connection on any premise on which there
is an auxiliary water supply . where cross - connections are known
to exist which cannot be presently eliminated , the public water
supply system shall be protected by an air gap separation or
an approved reduced pressure principle backflow prevention
device .
3 . At the service connection to any premise on which a sub-
stance that would be objectionable ( but not necessarily hazard -
ous . to health if introduced into the public water supply ) is
handled so as to constitute a cross - connection , the public
water supply shall be protected by an approved double check
valve assembly .
4 . At the service connection to any premise on which a sub -
stance of unusual toxic concentration or danger to health is
or maybe handled ; but not under pressure , the public water
supply shall be protected by an air gap separation or an
approved reduced pressure principle backflow prevention device .
This device shall be located as close as practicable to the
water meter , and all piping between the water meter and receiv -
ing tanks shall be entirely visible .
- 5 . At the service connection to any premise on which any
material dangerous to health , or toxic . substance in toxic
concentration , is or may be handled under pressure , the pub -
lic water supply shall be protected by an air gap separation .
The air gap shall be located as close as practicable to the
water meter , _ and all piping . between the water meter and receiv-
ing tanks shall be entirely visible . If these conditions cannot
reasonably be met , the public water supply shall be protected
with an approved reduced pressure principle backflow prevention
device , . providing the alternative is acceptable to the water
purveyor .
6 . At the service connection to any sewage treatment plant
or sewage pumping station , the public water supply shall be
protected by an air gap separation . The air gap shall be
located as close as practicable to the water meter and all
piping between the water meter and receiving tanks shall be
: entirely . visible . If these conditions cannot be reasonably
a met , the public water supply shall be protected with an approved
' reduced pressure principle backflow prevention device .

Section III . Frequency of Inspection of Protective Devices .
It shall be the - duty of the water user on any premises on
account of which backflow protective devices are installed ,
to have competent inspections made at least once a year , or
more often - in those instances where successive inspections
indicate repeated failure . These devices shall be repaired ,
overhauled or replaced at the expense of the water user when -
ever they are found to be defective . These tests shall be
performed by a qualified backflow prevention device tester ,
and all test results will be provided to the water purveyor
within 72 hours after the test is made .
Records of such tests , repairs , and overhaul shall also
be kept and made vailable to the water purveyor and the
local health department upon request .
ARTICLE 4
PROTECTION OF POTABLE WATER SYSTEM WITHIN PREMISES
Section I . Separate Drinking- Water Systems .
Whenever the plumbing inspector determines that it is not
practical to protect drinking water systems . on .premises '
against entry of water from a source or piping system or f
equipment that cannot be approved as safe or potable for
human use , an entirely separate . drinking water system shall
be installed to supply water at points convenient for con -
sumers .

Section II . Fire Systems .
Water systems for fighting fire , derived from a supply that
cannot be approved as . safe or potable for human use shall ,
wherever practicable , be kept wholly separate from drink -
ing water pipelines and equipment . In cases where the
domestic water system is used for both drinking and fire - '
fighting purposes , approved backflow prevention devices
shall be installed to protect such individual drinking water
lines as are not used for fire - fighting purposes . Any
auxiliary fire - fighting water supply which is not approved -
for potable purposes , but which is so connected that it may I
be introduced into potable water piping during an emergency ,
shall be equipped with an approved automatic chlorination
machine . It . is hereby declared that it is the responsibility
of the person or persons causing the introduction of said un -
approved or unsafe water into the pipelines to see : ( 1 ) that
a procedure be developed and carried out to notify and pro -
tect users of this piping system during the emergency ( 2 )
that special precautions be taken to . disinfect thoroughly
and flush out all pipelines which may become contaminated
before they . are again used to furnish drinking water . In
the event the means of protection of water consumers is by
disinfection of the auxiliary fire - fighting supply , the in -
stallation and its use shall be thoroughly reliable .

The public water supply must be protected against backflow
MN from such dual domestic fire systems , as detailed in Article 3 .
Section III . Process Waters .
Potable water pipelines connected to equipment for industrial
processes or operations shall be protected by a suitable back-
flow prevention device located beyond the last point from
which drinking water may be taken , which device shall . be
provided on the feed line to process piping or equipment .

In the event the particular process liquid is especially
corrosive or apt to prevent reliable action of the backflow
prevention - device , air gap separation shall be provided .
These devices shall be tested by the water user at least
once a year ; or more often in ' - those instances where succes -
sive inspections indicate repeated failure . The devices
shall be repaired , overhauled or replaced whenever they are
found to be defective . . These tests must be performed by a
qualified backflow prevention device tester and records of
tests , repairs , and replacement shall be kept and . made avail -
able to the water purveyor and the health department upon
request .
Section IV . Sewage Treatment Plants and Pumping Stations .
Sewage pumps shall not have priming connections directly
off any drinking water systems . No connections shall exist
between the drinking water system and any other piping , equip -
ment , or tank in any sewage treatment plant or sewage pumping
station .
Section V . Plumbing Connections .
Where the circumstances are such that there is special
danger to health by the backflow of sewage , as from sewers ,
toilets , hospital bedpans and the like , into ' a drinking water
system , a dependable device or devices shall be installed to
prevent such backflow .
The purpose of these regulations is not to transcend- local
plumbing regulations but only to deal with those extraordinary
situations where sewage may be forced or drawn into the drink -
ing water. piping . These regulations do not attempt to elimi -
nate at this time ' the hazards of back - siphonage through flusho -
meter . valves : on : all toilets , but deal with those situations
where the likelihood of vacuum conditions in the drinking
water system is definite and there is special danger to health .
Devices suited toothe purpose . of avoiding back - siphonage from
plumbing fixtures are roof tanks , barometric loops or separate
pressure systems separately piped to supply such fixtures ,
recognized approved vacuum or siphon breaker and other back-
flow protective devices - which have been proved by appropriate
tests to be dependable for destroying the vacuum .
Inasmuch as many of serious hazards of this kind are due
to water supply piping which is too small , thereby causing
vacuum conditions when fixtures are flushed or water is drawn
from the system in other ways , it is recommended that water
supply piping that is too small be enlarged whenever possible .
Section VI . Pier and Dock Hydrants .
Backflow protection by a suitable backflow prevention device
shall be provided on each drinking water pierhead outlet
used for supplying vessels at piers or waterfronts . These
assemblies must be located where they will prevent the return
of any water from the vessel into the drinking water pipeline
or into another adjacent vessel . This will prevent such prac -
tices as connecting the ship fire -pumping 'or sanitary pumping
system with a dock hydrant and thereby pumping contaminated
water into the drinking water system , and thence . to adjacent
vessels or back into the public mains .

Section VII . Marking Safe and Unsafe Water Lines .
Where the premises contain dual or multiple water systems
and piping , the exposed portions of pipelines shall be
painted , banded or marked at sufficient intervals to
distinguish clearly which water is safe and which is not
safe . All outlets from secondary or . other potentially con -
taminated systems shall be posted as being contaminated and
unsafe for drinking purposes . All outlets intended for drink -
ing purposes shall be plainly marked to indicate that fact .
Water Supervisor . The health department and the water pur -
veyor shall be kept informed of the identity of the person
responsible for the water piping on all premises concerned
with these regulations . At each premise where it is neces -
sary in ' the opinion of the water purveyor , a water supervisor
shall . be designated. This water supervisor shall be responsible
for the - installation and use of pipelines and equipment and
for the avoidance of cross - connections .
In the event of contamination or pollution of the drinking
water system due to a cross - connection on the premises , the
local health officer and water purveyor shall be promptly
advised by the person responsible for the water system so
that appropriate measures may be taken to overcome the con -
tamination .
ARTICLE 5
RECOURSE FOR NON - COMPLIANCE
Section I .
No water service connection to any premises shall be in -
stalled or maintained by the water purveyor , unless the
water supply is protected as required by state regulations
and this rule .
Section II .
Service of water to any . premises may be discontinued by
the water purveyor , if a backflow preventive device required
by this rule and regulation is not installed , tested , and
maintained ; if any defect is found in an installed backflow
preventive device ; if it is found that a backflow preventive
device has . been removed or bypassed if' unprotected cross -
connections exist on the premises , and service will not be
restored until such conditions or defects are corrected .

EFFECTIVE DATE
This local law shall take effect immediately .

for the 50 % real estate tax exemption . This change must be made
prior to the taxable status date .

requirements on the matter of backflow prevention . Mr . Buyoucos
said he was satisfied if it is clear that the proposed local law

The truck is a 1978 Dodge which meets the specifications . This
is a used vehicle with 3 , 845 miles . Mr . Fabbroni and Mr . Parkin

Supervisor Desch reported that a letter had been received
from Mr . Richard A . Virgo , 203 Tareyton Drive , regarding the Salem
Drive Abandonment requested by Samuel and Anne Kramer . Mr . Virgo
stated in his letter that. , as a neighboring property owner , he had
an interest in this abandonment and in maintaining a rear access
to Salem Drive . Supervisor Desch had advised Mr . Virgo by letter
on May 15 , 1979 that his request appeared to be a reasonable one
and that he would recommend . this to the Town Board . Supervisor
Desch said it had been indicated that the Virgos would work through
their attorney with the Kramers and develop a plan which would satisfy
both property owners . When this had been done they would notify the
Town Board . The parties involved have not as yet presented a plan
so it is not possible to take action at this time .
VACANCY - ITHACA YOUTH BUREAU
Supervisor Desch reported that there is a vacancy on the
City of Ithaca Youth Bureau and that a Mr . Ronald Kuhr , 324 Siena
Drive , is interested in serving . Councilwoman Raffensperger said
Mr . Kuhr is already serving as an at - large member of the Youth Bureau .

TRAFFIC AND SAFETY MATTER
Mr . Gust L . Freeman reported that he had written a Letter
to the Editor of the Ithaca Journal about publishing list of traffic
violations in the Town of Ithaca . He said he pointed out in his
letter that the Town has been cooperating with the Ithaca Journal
by furnishg the list of violations in the format requested by the
Journal . They have not , however , been consistently printing such
lists . Mr . Freeman said also that so far he had not seen his letter
published .
ITHACA TRANSIT COMMISSION
Mr . Freeman reported that at the last meeting , the Planning
Committee of the Ithaca Transit Commission was instructed to look
into car pooling and collecting points to serve mass transit .
EXECUTIVE SESSION
RESOLUTION NO . 117 , 1979
Motion by Supervisor Desch ; seconded by Councilman McElwee ,
RESOLVED , that this Town Board retire into executive session to
discuss Town of Ithaca procedures with respect to environmental
impact statements and the matter of highway specifications in

RECONVENE
The Town Board reconvened after the discussion in Executive
Session to conduct any further business which might come before the
Board .
HIGHWAY WIDTH SPECIFICATIONS
The Town Attorney having presented to the Town Board ,
in Executive Session , the question regarding the technical require -
ments as to the width of rights of way , asked whether the acceptance
of 50 foot roads would be in conflict with the past policy of the
Town Board in accepting 50 foot roads in certain circumstances ,
especially where the roads were over strips of land reserved in
earlier periods for that purpose . The Town Board instructed him
that this would not be in conflict with past policies . The Town
Board instructed the Town Attorney to prepare a resolution clari -
fying this matter for the record . The Town Attorney prepared such
a resolution and the Town Board acted as follows .

Motion by Councilman McElwee , seconded by Supervisor Desch ,
WHEREAS , the resolution adopted on November 4 , 1965 , pur -
ported to require a right of way 60 feet in width for all new roads
in the Town , but , instead , since that day the Town has accepted
numerous streets 50 feet in width ,
NOW , THEREFORE , IT IS RESOLVED :
That the Town Board will consider , as it has in the past ,
with respect to ,streets in other subdivisions . , the acceptance of
streets with 50 foot rights of way in the Ivar Jonson subdivision
( Valentino , Raffensperger , Powers , McElwee , and Desch voting Aye .

Cost Allocation , Intermunicipal Agreement , Sewer System Evaluation
Survey ( also attached hereto ) .

INTERMUNICIPAL AGREEMENT
TO FINANCE ITHACA SEWER SYSTEM
EVALUATION SURVEY
( SSES )

On the basis of a recommendation from the Sewer System Planning Committee ,
the Town of Ithaca ., the City of Ithaca and the Town of Dryden agree to partici -
pate in the Sewer System Evaluation Study estimated to cost $ 1 , 157 , 000 , allocated
according to percentages shown in Appendix A . ( attached ) The participants are
already engaged in a federally aided wastewater facility planning study of the
City of Ithaca Sewage Treatment Plant ( Environmental Protection Agency , Project
WC - 36 - 1095 ) . As amended , the project is expected to cover additional engineering
and contractual costs consisting of sewer cleaning , internal inspection and minor
sewer rehabilitation as described in the grant application amendment .
The City of Ithaca agrees to provide advance funding for the full 75 % share
of the SSES in anticipation of timely reimbursement by EPA . Each municipality
agrees to reimburse the city for the remaining 25 % share as billed with the antici -
pation that upon receipt of the 12 112 % state share on eligible work at a later date ,
the city will then reimburse the other municipalities for this 12 112 % share .
Engineering Costs
It is agreed that each participant will pay for the portion of such costs based
on the ratio of linear feet of sewer within each municipality to the total linear
feet , including the proportionate share attributed to Cornell University within each
municipality . The estimated cost of this phase is $ 487 , 000 , of which it i- s antici -
pated 75 % would be federally funded , 12 1 / 2 % state funded , and the balance ( 12 112 % )
funded pro rata by the aforementioned municipalities . The participants agree to
Aegotiate jointly with Cornell University for reimbursement of engineering costs
ttributed to the portion of the Cornell system in each municipality . ( Shown in Appendix A )
mneering costs also include administration and force account costs in direct
support of the engineering effort .
Cbhtract Costs
Each participant agrees that contract costs ( sewer cleaning , internal inspection
and minor rehabilitation ) shall be shared on the basis of actual cost for work performed
within their respective municipal boundaries . Such costs are presently estimated to
total $ 670 , 000 - 75% Federally funded , the remaining local - share to be paid as actually
expended within each municipality . The participants further agree to negotiate jointly
an agreement with Cornell University for their fair share of these costs .
City of Ithaca
The City of Ithaca , being grantee to EPA Project # C - 36 - 1095 - a rees that it - will
inform and consult with Towns of Ithaca and Dryden with respect to he engineering
and contractual services to be performed as a part of the SSES within their individual
boundaries , and will seek the approval of the individual towns for any actions pro -
posed to be taken with respect to their respective sewers .
Towns of Ithaca and Dryden
Assuming that the City of Ithaca ' s planning grant is amended to provide for an
ISES , the Towns of Ithaca and Dryden agree individually to reimburse the City of Ithaca
n a timely manner , for their share of both engineering and contract costs , as noted
nder Engineering and Contract Costs .
The parties agree that the method of allocating costs for the SSES in no way
affects the planning and recommendation of at least two alternative methods of eventual
ownership , operation and maintenance of the sewage treatment facility .
Not withstanding the foregoing , it is -the understanding that each municipality ,
including Cornell University , shall in all instances pay their proportionate share
of costs after any federal and state reimbursement are deducted .

RESOLVED , that this Town Board rescind , and hereby does rescind ,
resolution of the Town Board of the Town of Ithaca dated March 31 ,
1977 because it no longer conforms with the current rules and regu -
lations of the State Environmental Quality Review Act .

office of the New York State Department of Transportation con - i
cerning the Town of Ithaca request for a reduced speed zone on
Pleasant Grove Road . i

The denial of our request comes as no surprise for we
recognize that DOT calls such decisions by the book and fails i
to consider extenuating circumstances .

The attached communications from Cornell University
accurately state some of the justification for a 30 mile per
hour limit .

While it is true that the short stretch of between

the Village of Cayuga Heights ( 30 mph limit ) and the entrance to ;
Cornell Parking Lot A is open and straight , it is so short that
drivers are caught by surprise when they come upon the children
crossing at Hasbrouck Apartments and the sharp curve beyond . i
The Town of Ithaca cannot - accept the decision contained
in Mr . Novak ' s letter since only speed consideration entered into
the response . It would be unfortunate if the Town of Ithaca were
forced to pursue the costly course of becoming a suburban Town to i
achieve control of speed limits .

Perhaps the time has come to consider legislation wherein
towns of the first class with population in excess of 10 , 000 ( ? )
and having in - house traffic engineering capability would be
authorized to set speed limits .
We would appreciate your review of this situation and
assistance in achieving a more safe and consistent speed limit
on Pleasant Grove Road . i

The investigation of the above captioned request has been completed by this
Department . Speed data compiled on May 5 , 1979 , confirmed the present
maximum speed as being realistic .
The speed limit on Pleasant Grove Road was lowered in 1973 to the existing
40 MPH . The data compiled in our new study compares very closely to that
taken in 1973 • This further justifies the present limit . It is our policy
to neither condone excessive speeding nor make technical violators out of
average motorists driving at speeds which are reasonable and prudent .
