SUPERVISOR ' S REPORT
" This past month has been one with heavy involvement in
organizational assessment , both in the Town of Ithaca and in the
Southern Cayuga Lake Intermunicipal Water Commission .
" We have three new staff members , namely , Mrs . Jean Swart -
wood , our Town Clerk understudy , Cathy Noyes , Deputy Town Clerk
understudy ; and Connie Allen , Business Manager for the Water Com-
mission .
" I am delighted to report that all three of our new colleagues
are off to a fast start and into their jobs with at least both feet .
This has enabled us to finally dedicate Nancy Fuller to the Engineer -
ing - Planning and Zoning Division on a full time basis , a move which
will meet a most critical need .
Town Board Minutes - 2 - April 9 , 1979
" These re - assessments will enable us to work into the
massive filing program that we have spoken about on many occasions .
We are considering a microfilm program on our ancient documents
which have very little reference . Perhaps the DeWitt Historical
Society will be interested in the originals . We can put the space
to much better usage . All of these considerations relate to the
need for a more efficient layout of our space , particularly on the
matter of circulation , designation of work areas , etc . At the same
time we will assess our needs for office equipment and furnishings .
It now , for example , seems prudent to move to the next generation
of Xerox machine to significantly save staff time and paper . We do
not have enough money in the budget to accomplish this until later
in the year .
" Larry Fabbroni has completed a preliminary analysis of
our telephone needs and will have a report later on in this meet -
ing .
" I am in the process of making a comparative study of
staff salaries . We have several situations where the level of
skill and responsibility are considerably above the current salary .
Such disparities cannot be made up in one year , but we must have a
program to attract and keep the best people commensurate with the
skills and work load required .
" We have been informed that the Town Justice books will
have to be converted to double entry bookkeeping . This , coupled
with the increased Court load , may dictate the need to increase
the clerical support level to this section . I am working with
Justices Blye and Wallenbeck to identify these needs .
" Town Committees . There are a number of new committee
assignments that have an influence on the Town committees we
created last year . Our committee work has also progressed . to
a new dimension in several areas .
" I will lay out the committee assignments as a whole pack -
a#we and then seek the passage of resolutions adopting the committees
individually . First , the new assignments which will take a con -
siderable amount of time .

" The Codes and Ordinances Committee will continue its work
in the development of our major zoning ordinance revision . Work
has been substantially completed on all zones except the residential
zones . A preliminary draft will be ready for public review on August
1 , 1979 . A final date for adoption will not be set until public
comment has been received on the preliminary draft .

" The sign ordinance revision will be ready for adoption on
July 1 , 1979 .
" Mrs . Schultz has been added to the review committee to
assist in the completion of this task .
Parks and Open Space Committee

" The Parks and Open Space Committee will continue the
implementation of Phase I of the neighborhood park plan , consider
further designation of critical environmental areas such as Lick
Brook , evaluate the Coy Glen Park proposal in relation to City
plans for a Southwest Park , evaluate the effectiveness of the
East Ithaca bikeway and reconsider the DeWitt Park plan in the
context of school reorganization plans .
" The Committee will also pursue master plan development
in the protection of open spaces , such as wetlands and further
extension to bicycle paths , jogging trails , etc .
Traffic Control and Transit Committee

" The Traffic Control Committee will continue pursuit of
the proposal to print in the Ithaca Journal , the names and addresses
of traffic violators cited in the Town of Ithaca .
" The Committee will also review proposals for speed limit
changes , parking restrictions , traffic control devices and traffic
survey results . The Chairman of the Committee will also continue
activity with the Northeast Transit Committee and other transit
agencies including evaluation of mass transit activities such as
the hospital bus and additional service opportunities .
Dog Control Committee

" The Dog Control Committee will continue to evaluate the
effectiveness of our Dog Control Law and the contract with the
SPCA . Major progress has been made in the area of service , one
which continues in a state of change during the coming year as the
new State law is implemented .
/ Supervisor Desch at this time asked the Board to adopt
a resolution approving the foregoing committees and the
members thereof . /
Motion by Councilman Del Rosso ; seconded by Supervisor Desch ,
RESOLUTION NO . 53 -A , 1979
RESOLVED , that this Board hereby approves the foregoing committees
and the members thereof as indicated above .

Town Board Minutes - 4 - April 9 , 1979
Sewer System Planning Committee
" We have reached a milestone in the program to upgrade the
Ithaca service area waste water treatment facilities .
" The first meeting of the Sewer System Planning Committee
was held on March 29 , 1979 . We had an active discussion , full
attendance ; major commitments were made toward the cost allocation
for the Sewer System Evaluation Survey and the beginning of a plan
for meeting the primary charge to the Committee . I am encouraged
that we have a Committee which is prepared to do the hard work which
lies ahead in an objective way for the betterment of the total com-
munity . Frank Liguori will be presenting a resolution pertaining
to the designation of the City of Ithaca Plant as the County septage
facility . The present Step I Grant includes the septage problem as
one of the basic items of study , so it is logical to continue the
evaluation in an objective way . The City is concerned about odor
problems associated with the transfer of material from truck to
the treatment process . "
BUILDING INSPECTOR ' S REPORT
Mr . Fabbroni reported that no building permits were issued-
in March of this year , as compared with three permits issued in
March of 1978 , totalling $ 48 , 000 , one for a one - family dwelling
( $ 39 , 000 ) , one for a sun deck ( $ 500 ) , and one for a garage ( $ 8 , 500 ) .
TOWN ENGINEER ' S REPORT
Route 96 . The City of Ithaca has voted to have the State
consider five of the six Route 96 alternatives . This will result
in detailed design plans in both the City and Town portions of the
proposed project . The Town Board of the Town of Ithaca , therefore ,
may have an increasing interest in what happens in the Town portion .
It appears that in approximately 9 - 12 months there will be a hearing
to consider the designs for the proposed Route 96 .
Sapsucker Woods Road and Danby Road Water Tanks . The paint -
ing of these tanks has been bid and contracts are being prepared .
It is anticipated that the painting will start in September on the
Sapsucker Woods tank . The Danby Road tank will be started after
Ithaca College is out of session .
. Route 13 Water Leakage . Mr . Fabbroni reported there may be
a problem with a leaking water line under the Rt . 13 ramp . He said
he would keep the Board advised of actions taken in this matter .
Water Tanks . Mr . Fabbroni reported that this summer the
rest of the water tanks will be emptied to see what condition they
are in . This will be done in conjunction with the Bolton Point
staff .
Caldwell Road . This road will be a major construction job
this summer for the Town Highway Department . The road must be re -
built .
Tudor Road . Some construction will be done at the end of
Tudor; Road to improve the turn . Nancy Street ( a paper street ) might
be legally acquired with the thought in mind of completing the road
and the sub - base . It is 300 feet at the top of the hill and will
require gravel and surface treatment . This work will result in
better access for the people and snow plows at the top of Tudor
Road in the winter time and some area for parking in conjunction
with the park once the ballfield is in . Mr . Fabbroni agreed to
furnish the Board with a formal cost proposal .

Town Board Minutes - 5 April 9 , 1979
Highway Personnel . Mr . Fabbroni reported that one of
the men in the Highway Department has been seriously ill for
over a month . The nature of the illness would seem to indicate
that Bert Dean will not be able to return to work for from three
to six months . A replacement is required .
After some discussion it was agreed this is an appropriate
time to hire an additional . man for the Highway Department as a per -
manent position in the " laborer " category . Therefore , the Board
acted as follows :
RESOLUTION N09 54 , 1979
Motion by Councilman McElwee , seconded by Councilman Del Rosso ,
RESOLVED , that the Highway Superintendent is hereby directed to
hire a person in the " laborer " classification , as a permanent
position , on the basis of a job description which fits the plan
for highway improvements as developed by the Town Engineer .

voting Aye . Nays - none )
Highway Improvement . Mr . Fabbroni stated that highway
improvements must be considered in terms of a 10 - year commitment .
Supervisor Desch said it would , therefore , be necessary for Mr .
Fabbroni to provide figures to the Town Board with respect to
a proposed increase in the paving budget . Mr . Fabbroni agreed
to provide such figures for the first year in " today ' s dollars . "
REPORT OF COUNTY REPRESENTATIVE
Mr . Henry Theisen had no report at this time .
SPRING CLEAN - UP DAY - RESOLUTION NO . 55 , 1979
Motion by Supervisor Desch ; seconded by Councilman McElwee ,
RESOLVED , that Clean - Up Day for the Town of Ithaca for the year
1979 is hereby established as May 7 , 1979 .

CONSIDERATION OF DRAFT PROPOSAL FOR
INTERMUNICIPAL TRANSIT IN THE NORTHEAST
Mr . Fabbroni distributed to the Board members report of
the Northeast Area Transit Study Committee . This report covered
background , how need was determined , routes and timetables , price
structure , intermunicipal and private coordination , equipment ,
management and regulatory constraints , funding sources , costs and
levels of service . Mr . Fabbroni noted that the funding and financ -
ing would probably not be firmed up until June .
COMMITTEE FOR . SENSIBLY ORGANIZED SCHOOLS
Mr . Allan A . Lentini made a presentation on behalf of the
Committee for Sensibly Organized Schools . He furnished the Board
with printed material for their review . Mr . Lentini stated the
Committee ' s position that school reorganization is necessary , but
that it should be accomplished through the development and announce -
ment to the community of a comprehensive reorganization plan and
the application of objective criteria to programs and facilities
in the district ; that only after such criteria are applied to
insure the continuance of educational . programs , the relocation of
as few children as possible , the most economical use of tax dollars ,
that dollar savings projections based on the closing of certain
schools should include financial data on possible future uses of
the schools , should decisions be made about which schools should
remain open .

SOS representatives noted that the vast majority of students
being displaced by the school closings are Town of Ithaca residents .
Mr . Lentini requested that the Ithaca Town Board support
the Committee for Sensibly Organized Schools in what they are try -
ing to do .
Councilman Freeman noted that Mr . Lentini had not addressed
how the closing of neighborhood schools might affect real estate
values . Mr . Lentini said he had discussed this with realtors and
the general feeling is that property values might be depressed for
a while , but that they would rise again . Councilman Freeman inquired
what was to be done with the closed schools . Mr . Lentini said no
determination has been made as yet . Upon question from Councilwoman
Raffensperger , Mr . Lentini said no cost projections have been uncover -
ed which take into account potential use of the schools which may be
closed .
The Board was sympathetic to the aims of the Committee for
Sensibly Organized Schools , and acted as follows :
Motion by Councilwoman Raffensperger ; seconded by Councilman Freeman ,
WHEREAS , our neighborhood schools are an integral and
important component of our community , and
WHEREAS , a major portion of the Ithaca School District is
located within the Town of Ithaca , and
WHEREAS , the Ithaca School Board has scheduled the closing
of neighborhood schools for 1979 - 80 without announcing and explain -
ing an overall comprehensive reorganization plan and rationale for
such closings ,
NOW , THEREFORE , BE IT RESOLVED : ( RESOLUTION NO . 56 , 1979 )
That the Ithaca Town Board supports the position that
school reorganization is necessary , but through the development
and announcement to the community of an overall comprehensive
reorganization plan based on a public process of applying objec -
tive criteria to all programs and facilities in the district . Only
after these criteria are applied in a logical decision process to
insure : ( 1 ) the continuance of educational programs ; ( 2 ) the reloca -
tion of the fewest children throughout each phase of the plan , ( 3 )
the most prudent use of tax dollars , and ( 4 ) that school savings
prcjections for certain schools being considered for closing include
financial data on possible future uses ; should decisions be made
concerning buildings which are to remain open .
BE IT FURTHER RESOLVED :
That the Town Supervisor shall proceed to inform the
School Board of this position .

ACTION PLAN FOR TRAFFIC
CONTROL IN FOREST HOME
Mr . Fabbroni reported that in response to a request from
the Forest Home Improvement Association , he had prepared an action
plan for the improvement of traffic conditions in the Forest Home
community . He presented various suggestions with regard to stop
signs at various intersections and the painting of crosswalks . He
distributed graphics with respect to these suggestions .
Since it was time ( 7 : 00 p . m . ) for the opening of the public
hearing with respect to SEAR , the Supervisor interrupted this dis -
cussion to open the hearing . _

SEQR PROCEDURES , PROPOSED LOCAL
LAW AND ADOPTION OF SHORT FORM
ENVIRONMENTAL ASSESSMENT FORM
Proof of posting and publication of notice of public hear -
ing in the above matters having been presented by the Town Clerk ,
the Supervisor opened the hearing .
ACTION PLAN FOR TRAFFIC
CONTROL IN FOREST HOME ( continued )
Mr . Fabbroni suggested once again that some consideration
be given to his one -way traffic plan on a conceptual basis , not
necessarily specifics at this time . Mr . Herbert Mahr was concerned
that in drawing up a one - way traffic plan , some areas of the com -
munity might be burdened with a heavier traffic load than others .
Mr . Thomas Wolski was concerned that a one - way plan would create
greater speeds moving through the community . In response to a
question by Supervisor Desch , Mr . Mahr said he would have no diffi -
culty , speaking generally , in accepting a one - way scheme , but he
said it would have to be very carefully drawn . Supervisor Desch
also elicited from Mr . Wolski that the Forest Home community is
still very definitely in favor of a by - pass . Supervisor Desch
asked Mr . Wolski whether the Forest Home Improvement Association
would consider it a significant positive step if the Town were to
paint the crosswalks and install the signs that Mr . Fabbroni out -
lined . Mr . Wolski said it would be a positive step , but not a sig -
nificant one . The Association asked for it and appreciates it ,
Mr . Wolski said , but it is not the whole answer .
Mr . Mahr said he was concerned that the Forest Home com-
munity was not receiving the relief from speeding and other traffic
problems that they seek in spite of the fact that people on Judd
Falls Road and Forest Home Drive pay a lot of taxes . He said he
was willing to pay higher taxes if it would provide the relief
sought . He felt that his area was bearing the cost of development
of the whole Town . He referred again to the Town ' s decision not to
hire a Town constable .
.Councilwoman Raffensperger recommended that the Board
review the Traffic Control Committee ' s entire report ( which has
never been done ) and attempt to implement it . This report , she
said , is an attempt to work out a Town - wide system for Town -wide
traffic problems .
Supervisor Desch said he wanted to bring to the attention
of Mr . Wolski and Mr . Mahr that the County Board of Representatives
has been very slow to take action on the proposed road swap which
would enable the Town to put some truck limits on Judd Falls Road .
He said he would appreciate any help they could provide in that
respect . Mr . Fabbroni noted that Judd Falls Road from Forest Home
Drive to Rt . 366 is included in the road - swapping package ; that the
Town is taking more than it is giving .
Supervisor Desch said he felt that moving ahead with pro -
posals made by Mr . Fabbroni would benefit the whole Town in terms
of recognizing that there is a major traffic problem , but not making
an over - commitment in terms of adding to the staff . Sustaining a
police force in the Town of Ithaca would be phenomenal in cost .

PUBLIC HEARING
SEQR PROCEDURES , PROPOSED
LOCAL LAW AND ADOPTION OF SHORT
FORM ENVIRONMENTAL ASSESSMENTIFORM
At this time the Board proceeded with the public hearing
- - which was opened earlier in the meetint ( 7 : 00 p . m . ) .
Supervisor Desch stated that the public hearing has several
facets , the most urgent being the consideration of a short form
Environmental Assessment Form . Such a form would make it possible
for people to come in and request a building permit which could be
issued expeditiously without Having to stand the cost of a major
environmental review ( if a particular house does not warrant it ) .
Supervisor Desch distributed to the Board for review a
sample of such Environmental Assessment Form . This form is the
minimum requirement to comply with the SEQR law .
Mr . Henry Aron felt that a person filling out such a form
would fill it out in his own interest in order to get the building
permit and that his answers to the questions would not necessarily
Pe true . He was concerned about persons knowingly making a false
statement . He further felt that the person filling out the form
would not be qualified to answer the questions or understand what
he was saying " yes " or " no " to .
Mr . Fabbroni said this was possible but that it is not
too likely that his department would not have addressed the prob -
lems by the time a building permit is actually issued . He said
that unless the form is required of everyone , the Town would not
be in compliance with the SEQR regulations . It is , he said , a kind
of thorough , but minimal , way of insuring compliance with SEQR for
every unlisted action . Councilwoman Raffensperger noted that if
the short form is not adopted , it would then be necessary to require
the long form . This form would give a builder an opportunity to
fill out a shorter from . Mr . abbroni felt that with the knowledge
the staff has of the Town there would be no problem making a judg -
ment . He said where the problems would come in would be in filling
out the long form . Councilwoman Valentino felt the short from is a
reasonable way of handling the majority of cases .
Mr . John Barney questioned the language of the form . He
said he would be more comfortable if the form indicated what the
people intended to do and then Mr . Fabbroni would make the judg -
ment . Mr . Fabbroni said this form would be suitable for all routine
matters . Anything more complex would require the long form .
No other persons wishing to be heard , the hearing was closed
and the remainder of matters concerning SEQR will be reviewed at
further meetings .

SHORT FORM ENVIRONMENTAL ASSESSMENT FORM
Motion by Councilman Del Rosso ; seconded by Supervisor Desch ,
RESOLVED , that in order to comply with SEQR regulations , this Town
Board hereby adoptes the short form Environmental Assessment Form
( copy of which is attached to these minutes ) which is to be completed
by persons applying for a building permit in the Town of Ithaca .

PUBLIC HEARING - DOG CONTROL LAW - 7 : 30 P . M .
Proof of posting and publication of notice of public hear -
ing to consider the adoption of a local law amending Local Law No . 1 ,
1976 , and to consider a revised fee schedule in the Town of Ithaca
for licensing dogs , having been presented by the Town Clerk , the
Supervisor opened the hearing .

Mr . John C . Barney said that their office ( Buyoucos & Barney )
had prepared a proposed local law to amend Local Law No . 1 , 1976 ,
but that Mr . Buyoucos ( Town Attorney ) had not yet seen the draft .
Mr . Barney reviewed for the Board how the proposed law differs from
the old law . After discussion , the Board felt that there may still
be some points which require closer scrutiny and it was felt the

" 69 The members of the Planning Board agreed to speak informally
with Mr . Jerry Weisburd , Architect - Builder , who , although not
a part of the Agenda , wished to discuss briefly with the Board
the concept of a Land Co - Op he envisions for the West Hill area
to be known as the Inlet Valley Land Co - Op . The proposal in -
volves a 97 . 1 acre parcel near the Early Bird Farms and fronts
on Calkins Road .
The Planning Board took no action on this proposal except to
state to the developer that they would be willing to place
the proposal on the Agenda for the next regular meeting of
the Board , May 1 , 1979 .
" 7 . A Tentative Outline for Proposed Sign Ordinance , having pre -
viously been distributed to the Planning Board at large by
the Planning Board Sign Ordinance Committee , was discussed in
detail . Minor suggestions were made and the Board agreed that
the Sign Ordinance Committee should develop a proposed Sign
Ordinance in accordance with the Outline presented and the
suggestions made .

IN THE MATTER OF THE ESTABLISHMENT OF A WATER IMPROVEMENT , PURSUANT
TO ARTICLE 12 - C OF THE TOWN LAW , IN THE TOWN OF ITHACA , TOMPKINS
COUNTY , NEW YORK , IN THE STONE QUARRY ROAD AREA , TO BE CONSTRUCTED
AND FINANCED AS A TOWNWIDE WATER IMPROVEMENT .
WHEREAS , a map , plan , and report were prepared by Lozier
Engineers , Inc . , competent engineers , duly licensed by the State
of New York , showing the boundaries of the proposed improvement ,
and a general plan of the proposed water improvement , and a report
of the proposed method of operation ; and
WHEREAS , said map shows all outlets and the terminus and
course of each main drain , together with the location and a general
description of all public works required , including lands and ease -
ments to be acquired ; and
WHEREAS , the boundaries of the benefitted area and/or the
location of the proposed water improvement is described in the
annexed Schedule A ; and
WHEREAS , the improvements proposed are as follows : water
mains , hydrants , valves , and appurtenances and facilities to be
constructed along Stone Quarry Road and West King Road to furnish
municipal water to the properties in the above described area ; and
WHEREAS , the maximum amount proposed to be expended for
said improvement and for the acquisition of the necessary lands
and easements is $ 250 , 000 ; and
WHEREAS , the proposed method of financing and apportioning
the costs of said improvement consists of the issuance of serial
bonds of said Town to mature in annual installments over a period
not exceeding forty years , payable in the first instance from assess -
ments levied on all the lots and parcels of land in the entire area
of the Town of Ithaca ( outside of any village ) which as the Town
Board , pursuant to the provisions of Section 209 - q , Article 12 - C
of the Town Law , shall , in its discretion , provide and determine
to be benefitted by said Town water Improvement , and
WHEREAS , said map , plan and the report describing said

CONCEPTUAL APPROVAL OF ALLOCATION PLAN
FOR THE SEWER SYSTEM EVALUATION SURVEY
Supervisor Desch reported that at the first meeting of
the new joint City - Town Sewer System Planning Committee , the
Stearns & Wheler proposal for allocating cost of the proposed
Sewer System Evaluation Survey was reviewed . Essentially , each
municipality will pay for the cost of that work on the basis of
the size of its part of the system as against the total system .
Supervisor Desch stated that consideration had been given to
allocating cost based on flow contribution . He said , however ,
there are many pitfalls in identifying flow . It appears it will
be necessary to raise the sewer surcharge from 20 to possibly 5 % or
6 % . It is possible that the water surcharge may be reduced . The
initial cost to the Town over a two year period may be as much as
$ 90 , 000 . About half of this will be reimbursed when construction
of the Sewage Treatment Plant upgrading project is under way . The
objective is to eliminate about 2 , 000 , 000 gallons per day of leak -
age ( infiltration ) and 7 , 500 , 000 gallons per day of storm water
( inflow ) from the system thus enabling us to avoid paying for an
unnecessarily large upgraded plant . For example , the present normal
dry weather flow from the system is only about 7 , 000 , 000 gallons per
day .

INTRODUCTION
The Town Board has been aware of a chronic shortage of
ground water in . the Stone Quarry Road area for many years .
Prior to the special district consolidation in 1971 ,
there was no way in which to finance public water service to an
area of relatively low density of development .
The Town water distribution system annual debt load is
now diminishing at a rate which enables us to plan water improve -
ments which will benefit the community - as a whole .

In mid 1978 the Stone Quarry Road neighborhood encouraged
the Town Board to reconsider the extension of water to their area .
At a Town Board meeting held at the National Cash Register Company
plant on September 11 , residents very effectively showed the
seriousness of the problem from the standpoint of health hazards
and diminishing property values .
Subsequently the Town Board wrote to each property owner
to make a thorough assessment of need through a questionnaire . The
response was overwhelmingly - in favor of neighborhood participation
in financing the project even at benefit cost levels in excess of
the current benefit rate .
The Town Board immediately thereafter submitted engineering
study requests for professional services proposals to four selected
consultants . Lozier Engineers was chosen from the three proposals
received on the basis of the approach proposed , familiarity with
the system , and the engineering cost .
In spite of the severe cold weather , the Town engineering
staff completed the line survey , test borings were performed along
the proposed route and the Engineer ' s Report was received by the
Town on March 28 .
A route has been selected to minimize the amount of rock
excavation , enhance the ease of connecting house services and to
save room for future sanitary sewer service .

STATEMENT OF PURPOSE AND NEED
There are a number of needed water projects in the Town
of Ithaca . However , none of the following carries the label of
-.-� emergency improvement as is the case of the Stone Quarry Road
situation :
( 1 ) Replace old East State Street water line which pre -
dates the major improvement accomplished in 1958 .
( 2 ) Construct a reservoir on West Hill to provide optimal
pressure in the Glenside Area and loop service along Coy Glen Road .
( 3 ) Loop the East Shore Drive pressure zone to improve
pressure , system reliability , and ease of maintenance .
( 4 ) Joint extension project with the Town of Dryden to
serve small area accessible to pressure from the Hungerford Hill
tank .
( 5 ) Construct . Elmira Road water system .
PROJECT BUDGET AND FINANCING PLAN
The project budget is based on the consulting engineer ' s
report # 1302 - 3615 , dated April 1979 , Exhibit C , as follows :

The addition of the project contingency will provide an
overall contingency of 13 . 7 % to minimize the need to repeat the

known obstructions such as additional rock , construction staging ,
interest during construction .

The year - end surplus is sufficient to authorize work on
the detailed engineering plans without a short term borrowing to
finance the cost for the engineering .
The project will be financed by a borrowing of $ 250 , 000
with debt retirement to be paid from water benefit surpluses over
a 20 - year period as shown on Exhibits A and B . . No outside sources
of funding are anticipated .

Councilman McElwee asked what the allocation of cost was
based upon . Supervisor Desch said it is based on a measurement
of the footage in each system . The footage percentages are as
follows : The City of Ithaca system has about 66 % of the footage ;
the Town of Ithaca about 23 % ; the Town of Dryden about 3 % , and
Cornell University 8 % . When repairs are made more time will be
spent on the City of Ithaca system . The Town of Ithaca will not
be paying for repair work for the City system .
Supervisor Desch said he would like to have the Board ' s
approval of the concept and authorization to proceed to develop
an agreement with the City of Ithaca . The Board so approved .
SIGN APPROVALS
Mr . Fabbroni recommended that the Town Board approve
application of George Ideman for a sign 33 . 3 sq . ft . denoting
" Tommy ' s Place " at Ide ' s Bowling Lanes , Judd Falls Road , with
the stipulation that the free - standing sign -( ice cream ) at 'the :
former " Cow Bell " be removed . He noted that the Planning Board
has recommended approval . The sign will be lighted . It requires
no variance .

sign is approved it ought to be approved on a continuing basis from
year to year , rather than have the church return each year for an
approval .

Later in the meeting Mr . John C . Barney called the Board ' s
attention to the fact that a closer reading of the Town ' s Sign

that no approval or variance is required . He recommended that the
Board rescind the motion and arrange to have the permit fee returned
to St . Catherine ' s church .

Motion by Councilwoman Raffensperger ; seconded by Councilman Freeman ,
RESOLVED , that Resolution No . 60 , 1979 , approving the application
of St . Catherine of Siena Church to advertise their annual carnival
for a three week period is hereby rescinded since the Town of Ithaca
Sign Ordinance permits such a sign , without a variance , for up to
thirty ( 30 ) days ; it being FURTHER RESOLVED that the sign permit fee
paid by St . Catherine of Siena Church shall be refunded .

Mr . Fabbroni reported that the . request for approval of
the Picture Island sign is now before the Town Board again after
the Planning Board has approved its location on the site plan .
Councilwoman Raffensperger contended , as discussed before ,
that the entire upper structure of the building is a sign under the
Town ' s Sign Ordinance and that it is a non - conforming use . She
stated that the sign area has no other function than to hold the
sign . Councilwoman Raffensperger described the sign as . " the
ugliest thing I have seen in the Town of Ithaca . " She proposed
that Groff Associates come back with a sign that is conforming .
Councilman Del Rosso asked Mr . Fabbroni if the sign con -
forms to the Town ' s Sign Ordinance . Mr . Fabbroni said there is
a difference of opinion as to whether the sign conforms . The top
of the building is not a functional part of the building . Super -
visor Desch said he would prefer to defer action and see if a
more reasonable sign might be presented by the applicant .
It was agreed that the applicant ( Groff Associates ) should
be invited to the next Town Board meeting to discuss the sign . The
applicant should be advised that the opinion has been expressed
that the sign is not a conforming use . Mr . Fabbroni was directed
to convey the message to the applicant .
CONSIDERATION OF BIDS ON NEW 7 - TON BULLDOZER
Mr . Fabbroni reported that eight bids were received on
a new 7 - ton bulldozer , that the low bid was submitted by Arsenault ' s
Tractor Sales , $ 23 , 430 , for a 1979 John Deere 450 - C model which
meets all specifications . Mr . Fabbroni submitted to the Board a
list of all the bids submitted and a description of the equipment
bid upon . He noted that not all of the bids meet specifications .
After brief discussion and consultation with Mr . John C . Barney

of $ 23 , 430 . 00 in accordance with the terms , conditions , and amounts
established in the bid documents , and it is further
RESOLVED , that the Town Highway Superintendent execute
an appropriate contract for such purchase , and it is further
RESOLVED , that the execution of such contract be subject
to the approval of the County Superintendent of Highways pursuant
to Section 142 of the Highway Law , and it is further
RESOLVED , that the Town Board hereby authorizes the pay -
ment to Arsenault ' s Tractor Sales , Inc . of the sum of $ 23 , 430 . 00
in payment of the purchase price for said bulldozer .

CONSIDERATION OF BIDS ON
NEW 15 -TON TRAILER
Mr . Fabbroni reported that nine bids were received on a
15 - ton trailer , that the low bid was one submitted by Rochester
Tractor for a 16 - ton 1979 Centreville Tag - a - Long Trailer Model
105 - 16 , for $ 4 , 750 . 00 . The trailer meets all specifications and
is the type of trailer desired . After review of the bids and dis -
cussion by the Board and consultation with Mr . John C . Barney
( Buyoucos & Barney ) the Board acted as follows .
RESOLUTION NO . 63 , 1979
Motion by Supervisor Desch , seconded by Councilman McElwee ,
WHEREAS , the Town of Ithaca invited bids for purchasing
of one new 15 - Ton Trailer by invitation to bid published March
22 , 1979 , and
WHEREAS , nine bids were received and the results tabulated
as set forth in Schedule A attached to this resolution on April 2 ,
1979 , and
WHEREAS , the apparent low bidder on the net delivered
price and meeting specifications , is Rochester Tractor , Branch
of Batavia Farm Equipment , Inc . , 3894 Buffalo Road , Rochester ,
New York , 14624 , offering a 1979 Centreville Tag - a- Long Trailer
Model 105 - 16 , a 16 -Ton Trailer for a cost of $ 4 , 750 . 00 , and
WHEREAS , all the bid documents for Rochester Tractor are
in order with the equipment offered meeting equipment specifica -
tions ,

PAYBACK TO THE CITY OF ITHACA - CALENDAR YEAR 1978
Supervisor Desch stated that the Town owes the City of
Ithaca for net water received from the areas exclusive of West
Hill the sum of $ 2 , 939 . 63 . The Southern Cayuga Lake Intermunicipal
Water Commission has already authorized the reimbursement to the
Town of Ithaca for that amount . The water users pay the Commission ;
the Commission pays the Town , and the Town pays the City of Ithaca .
RESOLUTION N0 . 64 , 1979
Motion by Councilman Freeman , seconded by Supervisor Desch ,
RESOLVED , that this Town Board hereby authorizes payment of the
sum of $ 2 , 939 . 63 to the City of Ithaca as payment due for net
water consumed in the year 1978 under the terms of the transfer
Agreement dated January 9 , 1978 , between the City of Ithaca and
the Town of Ithaca .

ACCEPTANCE OF STRAWBERRY HILL ROAD
AS A TOWN ROAD FROM EASTWOOD COMMONS DEVELOPMENT
COMPANY
Supervisor Desch reported that Eastwood Commons Development
Company has requested that the Town accept a deed to Strawberry Hill
Road as a Town Road , contingent upon Eastwood Commons Development
Company completing the road in accordance with the terms for accept -
ing roads in the development . They will furnish a $ 1 , 000 . 00 letter
of credit as partial surety for such completion .
Motion by Councilwoman Raffensperger ; seconded by Councilwoman
Valentino ,
RESOLVED , that this Town Board hereby agrees to accept a conveyance
from Eastwood Commons Development Company to the Town of Ithaca of
Strawberry Hill Road as a Town Road , such acceptance being contingent
upon Eastwood Commons Development Company completing said road in
accordance with agreement dated August 28 , 1974 for acceptance of
roads in the Eastwood Commons Development , it being further under -
stood that the Eastwood Commons Development Company will furnish
partial security in the amount of $ 1 , 000 . 00 for the completion of
said road , and the Supervisor is hereby authorized to execute what -
ever documents are required to effect the intent of this resolution .

HOSPITAL BUS RUN - CITY SUMMARY
Councilman Freeman distributed City of Ithaca summary
on the bus run to the Hospital . ( Copy attached to these minutes ) .
He noted that the Town Board should be aware that the bus run is
running $ 1 , 000 a quarter over what was approved ; that the Board
should not be surprised if additional funds are requested for a
continuation of this program in 1980 .
DAVID STOLLER REIMBURSEMENT
1 RESTORATION AT 210 FOREST HOME DRIVE
Mr . Fabbroni reported that in executing an easement with
Mr . David Stoller , 210 Forest Home Drive , the Town agreed to a
performance type of easement whereby the dollar values were put
on certain activities . The Town agreed to a maximum amount of
restoration in the amount of $ 440 . 00 for landscaping , if necessary ,
which might result from the sewer work in Forest Home . Mr . Stoller
has submitted a bill in the amount of $ 83 . 00 . Mr . Fabbroni said
this is a reasonable bill and asked the Board to approve same .
RESOLUTION NO . 69 , 1979
Motion by Councilman McElwee ; seconded by Councilman Freeman ,
RESOLVED , that this Board hereby approves a payment in the amount
of $ 83 . 00 to Mr . David Stoller , 210 Forest Home Drive , Ithaca , New
York , in accordance with the terms of an easement signed with Mr .
Stoller with respect to restoration of his property at 210 Forest
Home Drive .
