At the regular year - end meeting of the Town Board of the Town of
Ithaca , Tompkins County , New York , held at the Town Offices at 126

APPROVAL OF MINUTES
Motion by Supervisor Desch , seconded by Councilman Powers ,
RESOLVED , that the Town Board minutes of September 25 , 1978 , as
presented by the Town Clerk , are hereby approved .

REPORTS OF TOWN OFFICIALS
Supervisor
Cable TV . " After considerable discussion at several meet -
ings , ATC has agreed that they have made a commitment to provide
cable TV to Poole Road ( Drew Subdivision ) without capital construc -
tion cost to the people who live in that area . No time table has
been set at this time , but the installation will probably be made
in 1979 . Mr . Lee agreed to confirm this in writing . "
Tax Exemption of City - Owner Property in the Town of Ithaca .
There are two major parcels of City - owned land in the Town of
Ithaca - - the Tin Can and the Watershed . The City of Ithaca is
concerned over the substantial increase in the taxes on these
properties . Supervisor Desch compared the 1978 tax assessments
and dollar costs on the Tin Can and the Watershed with the 1979
assessments and dollar costs . In 1978 the Tin Can was assessed
for $ 14 , 590 and in 1979 for $ 334 , 200 . Town and County tax in 1978
was $ 151 . 65 , in 1979 , $ 1 , 023 . 18 . The School Tax on the Tin Can in
1978 was $ 561 . 86 and; ' $ 5 , 551 . 06 in 1979 . The assessment ' . on4- the=i+?ater -
� hed1in 1975 was $ 148 , 200 and in 1979 it is $ 1 , 004 , 100 ( which in
itself is low because it is a huge tract of considerable value ) .
Town Board Minutes - 2 - December 29 , 1978
The 1978 Town and County tax is $ 1 , 244 . 95 and in 1979 the tax is
$ 3 , 125 . 92 . The 1977 - 78 School Tax was $ 5 , 707 . 95 and in 1978 - 79
it is up to $ 16 , 678 . 10 . It is understandable that the City is
concerned . The City , it appears , would like to annex these two
areas . The Tin Can is not a large parcel . The Watershed , however ,
is an irregular area which would jut into the Town and annexation
is highly inappropriate , the Supervisor said . It would knife into
the Town and would virtually cut off parts of the Town . Supervisor
Desch reported that he has . advised the Common Council that annexa -
tion is not the appropriate way to deal with this question of taxes .
The Town has gone through a lot of work to get the Town Hall , which
is located in the City of Ithaca , into a tax exempt situation . That
requires State legislation .
Mr . MacNeil said that bills for this exemption ( Town Hall )
were on the legislative books last _year , but because of the elec -
tion year all those bills introduced last year were not acted upon .
Everything must be re - introduced . Mr . MacNeil said he has already
pre - filed for the tax exemption for the Town Hall . Senator Smith
will sponsor the bill in the Senate .
Supervisor Desch said the City of Ithaca and the County
and School District have been cooperative in supporting the Town
in that exemption . If the City of Ithaca were to pursue the same
route with regard to the Tin Can and the Watershed , the Town and
County and School District would quite likely co - endorse the tax
exemptions .
Supervisor Desch said the Town of Ithaca for many years
has provided a 90 % exemption to the City and the City has thereby
saved in the neighborhood of $ 700 , 000 to $ 800 , 000 since the Town
exemption has been in effect . Tax exemption , he said , in his view ,
is a better way to handle this matter than annexation . In the case
of the Watershed , the tax costs can be recovered by passing them on
to the water users . Whether this is being done or not he did not know .
He said , in any event , there is no need to take any position at this
time . He said if the City of Ithaca pursues it further , it will be
something to think about .
REPORT OF COUNTY REPRESENTATIVE
Mr . MacNeil reported that he , Cong. - essman Lee. , and Senator
Smith are organizing a local legislative office in Varna . There
will be a telephone number and a message can be left . He said he would
like to come before the Board periodically to keep them advised as to
what the State is doing and to know what the Town is doing , and com-
municate with each other . There are a lot of intergovernmental acti -
vities . The County has adopted a new Charter . They will be operat -
ing under a new system . On January 2nd a new Chairman of the Board
of Representatives will be selected , followed by a re - organization
meeting . He said he felt the transition would be smooth . He said
he wanted to be able to communicate with the Town , that he would be
at home in Ithaca every week - end .
DESIGNATION OF OFFICIAL NEWSPAPER
Motion by Supervisor Desch , seconded by Councilman Powers ,
RESOLVED , that the Ithaca Journal is hereby designated as the
official newspaper of the Town of Ithaca for the year 1979 .

DESIGNATION OF DEPOSITORIES OF TOWN FUNDS
Motion by Supervisor Desch , seconded by Councilman McElwee ,
RESOLVED , that the Tompkins County Trust Company and the First
National Bank of Ithaca , New York , be and the same hereby are
designated as depositories for all monies coming into the hands
of the Supervisor , the Town Clerk , and the Receiver of Taxes , for
the year 1979 .

APPOINTMENT OF DEPUTY SUPERVISOR FOR 1979
Motion by Supervisor Desch , seconded by Councilman Powers ,

appointed Deputy Supervisor of the Town of Ithaca for the year
1979 .

RESOLUTION TO HIRE CPA FOR AUDIT OF
TOWN RECORDS FOR THE YEAR 1978
Motion by Supervisor Desch ; seconded by Councilman McElwee ,
RESOLVED , that Francis E . Welch be , and he hereby is , appointed
as the Certified Public Accountant who will audit the books and
records of the Town of Ithaca for the year 1978 ; and who will
also prepare a separate report on the Operation and Maintenance
Account of the Southern Cayuga Lake Intermunicipal Water Commission ,
it being understood that the Southern Cayuga Lake Intermunicipal
Water Commission will pay for the additional expense for that por -
tion of the audit which relates to the Southern Cayuga Lake Inter -
Municipal Water Commission .

SCHEDULE OF REGULAR MEETINGS
Supervisor Desch read a proposed schedule of regular meet -
ings for the year 1979 . The proposed schedule met with the approval
of the Board and it acted as follows :
Motion by Supervisor Desch , seconded by Councilman Powers ,
RESOLVED , that the following schedule of meetings dates and times
are hereby adopted for the year 1979 .
( 1 ) All regular meetings of the Town Board are tenta -
tively scheduled for the Town Office at 126 East
Seneca Street , it being understood that if the agenda
preparation effort suggests that facilities of greater
capacity of special neighborhood interest is involved ,
the Board may change the meeting location , time , or
date .
( 2 ) All regular meetings will start at 5 : 30 P . M . and
adjourn no later than 9 : 00 P . M . The adjourned meet -
ing will normally continue at 5 : 30 P . M . the following
' Monday unless more urgent , in which event other arrange -
ments will be made .
Town Board Minutes - 4 - December 29 , 1978
( 3 ) Public hearings will normally be scheduled at or
after 7 : 00 p . m .
( 4 ) Regular meetings will continue to be held the first
Monday after the first Tuesday in each month , primarily
to assure prompt payment of bills .

ADOPTION OF HIGHWAY DEPARTMENT PAY SCALE/
Supervisor Desch noted that Civil Service Law requires the
adoption of the Highway Department pay scale each year .
Motion by Supervisor Desch , seconded by Councilman McElwee ,
RESOLVED , that the pay scale for Town of Ithaca Highway Department
employees is hereby established for the year 1979 at the prevailing
minimum wage per hour at the low end of the scale and at $ 6 . 60 per
hour as the maximum rate per houl .

PUBLIC HEARING - 11 : 30 A . M .
PROPOSED DESIGNATION OF COY GLEN AS A
" CRITICAL AREA OF ENVIRONMENTAL CONCERN "
Proof of posting and publication of notice of public hearing
in the above matter having been presented by the Town Clerk , the
Supervisor opened the hearing .
Supervisor Desch stated that the purpose of the hearing is
to consider the adoption of a resolution designating as a " critical
area " the geographical area of Coy Glen , as designated by the Tompkins
County Environmental Council in its Unique Natural Areas Inventory ,
pursuant to the SEQR , that for the purposes of the proposed resolu -
tion , the designation of " critical area " shall also include the
official adoption of Coy Glen as a " unique natural area " . Further ,
that this designation shall take effect immediately and shall be
filed with the Commissioner of the Department of Environmental Con -
servation .
Councilwoman Valentino inquired why the Town wants to
designate Coy Glen as a critical area . Supervisor Desch said that ,
fundamentally , the action would be a further step to assure that
Coy Glen is preserved as much as possible in its existing natural
condition , irrespective of any other requirement by DEC or in terms
of reclamation as far as the gravel operation is concerned . Any pro -
posed development under the description outlined in the SEQR would
require an environmental impact statement . For example , if it- -were
proposed to build a housing development within the environmentally
sensitive area , this Town Board would then review the proposal and
make a determination as to whether SEQR would require a formal En -
vironmental Impact Statement . The same thing would be true with
respect to the gravel operation .
Councilman McElwee asked if it would apply to the construc -
tion of a single house . Ms . Restaino said it would be open to an
environmental review . The builder would fill out an assessment form
and the Town office would determine from that whether the proposed
construction would be environmentally significant .
Town Board Minutes - 5 - December 29 , 1978
Supervisor Desch said that it depends on the location
of what is proposed to be done . If a person were to propose to
clear - 50 acres of timber on a slope that would probably require
an Environmental Impact Statement and the Town as the lead agency
could require such a statement . If a person wants to build a house
just outside the environmentally sensitive area , that is a different
matter .
Question from the audience : Would this extend to cover
lumbering within that area - - not necessarily clearing for a house - -
but lumbering within that steep slope area ? Supervisor Desch said
that would be hard to say . If a person proposes to do any lumber -
ing in a sensitive area , that person would have to make out an En -
vironmental Impact Statement . Then the Town would look at it , and
if it appears the plan involves selective cutting , properly managed ,
then the Town would probably say it was a reasonable plan and for
the person to proceed with it without a final Environmental Impact
Statement . The questioner in the audience expressed the opinion
that any further cutting at the present time on the south side ,
at least , would be exceedingly hazardous from an erosion standpoint ,
not from the standpoint of removing the timber . Supervisor Desch
stated that the proposed designation would place upon the Town of
Ithaca a monitoring responsibility , but that fortunately , or un -
fortunately , the Town is already involved with monitoring that area
because of the gravel operation , so that would not be a significant
new cost .
Supervisor Desch read a letter dated December 22 , 1978
from James W . Yarnell , Director of Real Estate at Cornell University ,
requesting that the Town postpone action on the proposed designation
until Cornell University has an opportunity to be heard . Supervisor
Desch said that when the - Town established the time and date for the
hearing it did not occur to anyone that Cornell not being in ses -
sion would be a problem , but apparently this is the case . In terms
of timing , the time between today and January 8 , he said , is probably
not extremely crucial . Supervisor Desch said he also had a call
from Ralph Barnard , University attorney , requesting that the Town
not take action at this time , until the University had an opportunity
to be heard .
Mr . Williamson said he wanted his appearance noted , that
he represented Mr . John B . Babcock who owns land to the south of
Coy Glen , that land being under lease to Rumsey - Ithaca . He said
Mr . Babcock was unable to be at the meeting and that he had asked
the firm of Mazza , Williamson , and Clune to appear for him . Mr .
Williamson said they oppose the proposed designation of the area
as a critical area and also as a unique natural area . Their feel -
ing is that it is another move by the Town to prohibit or attempt
to prohibit excavation in the area . Coy Glen , he said , has never
been mined and never will be . He said an extensive hearing has
already been had on this whole issue by the DEC , and that the matter
is further covered under the U . S . Mining Reclamation Act . He said
that he had talked to attorney Truman Powers and that it was Mr .
Powers ' understanding that the minutes of the DEC hearing are not
typed yet , that it will be a long time before a decision is made
by them . Mr . Williamson said that it appeared to him that the
extensive hearings had by DEC are sufficient .
Mr . Williamson asked if there was a map available showing
the actual metes and bounds of the area described . Ms . Restaino
said that a land survey will be done when the weather permits , but
the area described at this meeting is the area designated by the
Tompkins County Environmental Management Council . She said that
in the law it also states that any action which takes place wholly
or partially within or substantially contiguous to any critical
area designated by a local agency . . so that the exact boundary
line is not the most important consideration . What is important
is the impact of the action on the area .

Williamson . " Do you know if it includes the area to the
south where there is currently excavation ? "
Restaino . " Yes , it would , because it is an impact on the
gorge . "
Williamson . " How far south from the center line of Coy
Glen ? "
Restaino . " That would have to be determined by a metes
and bounds survey . "
Desch . " Can you give him an approximate number ? "
Williamson . " We would like to know how far south it goes . "
Restaino . " I would sayd approximately 400 feet from the
center of the creek . "
Williamson . " Would that be the boundary all along Coy
Glen to the south ? "
Restaino . " Yes , it would approximate what was on the
U . S . G . S . map which is the ridge line . I can give you a copy of
this map . "
Supervisor Desch noted that the fact that 400 feet is
included in the designated area does not preclude the excavation
of gravel , but it does require the preparation of an Environmental
Impact Statement . He explained that under SEQR the requirements
to be spelled out in an Environmental Impact Statement are broader
than those requirements which might be set out by the mining law .
It also applies to the other properties in the area which are not
related in a practical way to the extraction of gravel . Therefore ,
he said , it is a broader coverage of environmental questions than
those that might be concerns expressed by the Mining Reclamation Law .
Mr . Williamson said this just makes it that much more
difficult to excavate on this property . He said there was a DEC
hearing under the Mining Reclamation Act and asked if the Town were
going to have DEC make a further study of Type I actions under SEQR .
Supervisor Desch said it will require the Department of Environmental
Conservation to keep the SEQR requirements in mind .
Mr . Williamson stated that whenever any lumber has been
cut down by Mr . Babcock it has always been with the concurrence
of the State Forester . Whenever a tree has been taken down the
State of New York has marked the tree with an " X " and has approved
such cutting . That is the way it has been done , he said , and that
is the way it would be done in the future , since it was his under -
standing that the State requires it .

The person who raised the question about lumbering said
he had no quarrel with the procedure for cutting the trees , but
that his question related to the fact that when permission to cut
is received , it means going in and harvesting the timber and trees
in a critical area from the standpoint of potential erosion problems
as well as affecting the other unique values of the flora and fauna
in the Glen . He said he did not question the technical aspect of
the cutting . Mr . Williamson stated that his client ( Mr . Babcock )
has stated that he loves the Glen ; that nothing is going to happen
in the Glen . Mr . Williamson said : " I can assure this man that Mr .
Babcock will not go in and willy - nilly cut trees . "

Town Board Minutes - 7 - December 29 , 1978
At this point Supervisor Desch proposed that the hearing
be closed and a decision on the matter postponed until the Town ' s
meeting on January 8th , at which time the hearing might be re - opened
and further comment accepted .
Councilman Del Rosso said he would like to know if there
is available any abstract of this particular law that would come
into effect if the Town Board designated this area critical . He
said he would like to know more about what happens should the area
be so designated . He said he thought this action would put a heavy
burden on the property owners to go through all this . He said it
is a legal encroachment and he would like to know what impact the
law would have .
Mr . Williamson said a study would have to be presented
to the Town Board . He said also he would like to reserve his right
to file a written statement with the Town Clerk .
Motion by Supervisor Desch , seconded by Councilman Del Rosso ,
RESOLVED , that this hearing is hereby adjourned to January 8 , 1979
in accordance with a request from Cornell University that they have
a further opportunity to be heard .

REVENUE ANTICIPATION NOTE RENEWAL
BALANCE OF BOLTON POINT DEFICIT
Supervisor Desch stated that the Board must at this time
renew the Revenue Anticipation Note to indicate that the Town is
indebted in the amount of $ 41 , 165 . 04 for the Town of Ithaca ' s
remaining share of the original Bolton Point deficit . Therefore ,
the Board acted as follows :
Motion by Supervisor Desch , seconded by Councilman Powers ,
RESOLVED , that this Town Board hereby authorizes the Supervisor
to execute renewal of a Revenue Anticipation Note in the amount of
$ 41 , 165 . 04 to pay for the remaining balance of the Town of Ithaca ' s
share of the Bolton Point deficit .

and Desch voting Aye . Nays - none )
PARKING REIMBURSEMENT POLICY
Supervisor Desch stated that the City of Ithaca has now
established a new rate schedule for parking in the Seneca Street
and Green Street ramps . He said the Town Board now ought to con -
sider the possibility of changing the Town ' s current policy or re -
affirming it . The new City schedule calls for monthly permits for
off - street parking of $ 15 . 00 per month in any unmetered facility ,
Seneca Street , Lot D , or other , $ 10 . 00 a month for parking anywhere
in the Green Street garage , and $ 5 . 00 per month on the top deck of
the Green Street garage . The Supervisor recommended authorization
for employees to receive $ 10 . 00 per month as a parking reimbursement ,
they to be at liberty to choose where they will park .
Motion by Councilman Del Rosso , seconded by Supervisor Desch ,
RESOLVED , that each Town of Ithaca employee be authorized to
receive a parking reimbursement payment in the amount of $ 10 . 00
per month , conditioned on actual use of a parking facility for
which any payment is expended .

Town Board Minutes - 8 - December 29 , 1978
MILEAGE REIMBURSEMENT
Motion by Supervisor Desch , seconded by Councilman Powers ,
RESOLVED , that the Town of Ithaca mileage reimbursement shall be
increased from 12 cents per mile to 15 cents per mile beginning
January 1 , 1979 .
Councilman Freeman suggested that mileage should only
be paid on other cars when the Town vehicle is not available .
When Mr . Fabbroni is in the office , others in the department
should use the Town vehicle . Supervisor Desch did not think
this would be practical .
The resolution was put to the vote .

REPAINTING OF SAPSUCKER WOODS
AND DANBY ROAD TANKS
Supervisor Desch read letter from Lozier Architects Engineers
dated December 12 , 1978 outlining their proposed budget for the
engineering and inspection work involved in the above matter . They
quoted a price of $ 2 , 800 , the work to be done on a per diem basis
( plus expenses ) with $ 2 , 800 as an estimated maximum .
Supervisor Desch said he recommended approval of this
proposal which appeared to be a reasonable one .
After brief discussion , the Board acted as follows :
RESOLVED , that this Town Board hereby accepts the proposal of
Lozier Architects Engineeers for the engineering and inspection
work connected with the repainting of the Sapsucker Woods Road
and Danby Road tanks on a per diem basis with an estimated maxi -
mum amount of $ 2 , 800 , and authorizes the Town Engineer to execute
letter of acceptance .

APPOINTMENT TO LOCAL BOARD OF ASSESSMENT REVIEW
Motion by Supervisor Desch ; seconded by Councilman Powers ,
RESOLVED , that Councilwoman Valentino and Councilman Freeman be ,
and they hereby are , appointed to the Local Board of Assessment
Review for the year 1979 .

EASTWOOD COMMONS LIGHTING CONTRACT
Supervisor Desch reported that the Town now has in hand
a new contract for the Eastwood Commons Lighting District to
replace the one which began in 1973 and has now expired .
Motion by Supervisor Desch ; seconded by Councilman McElwee ,
RESOLVED , that the written contract submitted by the New York
State Electric & Gas Corporation for lighting the streets and
public places of Eastwood Commons Lighting District , Town of
Ithaca , dated December 31 , 1978 , be , and the same hereby is ,
approved , and a majority of the members elected to this Board
be , and they hereby are , authorized and directed to execute the
same in the name and in behalf of the Town of Ithaca .

LEHIGH VALLEY RAILROAD /EAST ITHACA/
FREEVILLE PREFERENTIAL RIGHTS
Supervisor Desch read a prepared resolution in the above
matter in which the Town of Ithaca urges the Tompkins County Board
of Representatives to proceed with the acquisition of the abandoned
Lehigh Valley Right of Way/East Ithaca - Freeville .
Paul Finger , Environmental Management Council ( Tompkins
County ) said the proposed resolution is a good one . He thought
it would encourage the County to begin to act on this matter .
He felt similar resolutions from other municipalities would be
useful . He urged the Town Board to contact other concerned muni -
cipalities and urge them to make a statement in favor of such
acquisition .
Councilman Del Rosso said the intent of the resolution
is to have the County follow up on this so that one governmental
body works at it .
Motion by Supervisor Desch , seconded by Councilwoman Valentino ,
RESOLVED , that the Town Board of the Town of Ithaca urges the
Tompkins County Board of Representatives , acting for the various
involved municipalities , to proceed with the acquisition of the
abandoned Lehigh Valley Right of Way , East Ithaca - Freeville ;
FURTHER RESOLVED , in the event that Tompkins County does not so
proceed , the Town of Ithaca intends to exercise its preferential
rights and stands ready to make a purchase offer for that portion
of the right - of -way that is in the Town of Ithaca . ( Reference

Town Board Minutes - 10 - December 29 , 1978
Supervisor Desch asked if the Town Board should suggest
to the other municipalities that they formally adopt similar
resolutions . Councilwoman Raffensperger suggested that the Board
wait on that , that it was her understanding that Dryden , the other
most involved municipality , is considering it at the moment . She
said the Village of Freeville has already exercised their rights .
Councilman Powers stated that he would like the record
to show that he abstained based on his conviction that governmental
agencies should generally not buy more property . He felt there is
too much governmentally owned property now - - owned by the State ,
County , and Federal governments .
PEARL S . MILLER ESTATE
ENCROACHMENT MATTER
Mr . Buyoucos , Town Attorney , stated that he had called
the attorney for the Pearl S . Miller Estate and advised him that
the Town Board of the Town of Ithaca would look favorably upon
a permanent lease with adequate conditions so long as the present
building stood within the right of way . Since one of the other
attorneys involved is away on vacation at this time , Mr . Buyoucos
suggested that the matter be adjourned to a later date . The Board
concurred .
RELEASE OF RETAINAGE FOR SERIAL BONDS
STEVER BROTHERS , INC . - FIVE AREA SEWER PROJECT
Supervisor Desch said the Board must consider at this
time release of retainage to Stever Brothers , Inc . for serial
bonds , in accordance with law . He reported that the Tompkins
County Trust Company has advised that the bonds offered have a
current market value of about $ 53 , 000 . Further , there is enough
positive balance in the account by virtue of having received the
latest reimbursement request of approximately $ 120 , 000 to pay this
retainage . There was some concern on the Board that should the
bonds turn out to have a market value of less than the retainage
released , the Town would stand to lose . Supervisor Desch said
that only a short period of time is involved , so that the risk
appeared to be minimal . Mr . Buyoucos inquired whether the Town
Board would be interested in considering making the resolution
contingent upon supplementing the bonds if the market value drops .
Supervisor Desch repeated that he was not concerned because of the
short duration involved for the completion of the work .
Motion by Supervisor Desch , seconded by Councilman McElwee ,
WHEREAS , Section 106 of General Municipal Law makes pro -
vision for the contractor to withdraw the whole or any portion
of the amount retained from payments to the contractor pursuant
to the terms of the contract , upon depositing with the fiscal
officer of the Town bonds of any political subdivision in the
State of New York , of a market value equal to the amount so with -
drawn , and
WHEREAS , Stever Brothers , Inc . has delivered to the Town
through Supervisor Noel Desch , fiscal officer of the Town of Ithaca ,
twelve County of Suffolk Public Improvement ( Serial ) Bonds dated
1966 , each in the maturity amount of $ 5 , 000 , and
WHEREAS , the total current market value of such bonds is
$ 53 , 000 ,

NOW , THEREFORE :
BE IT RESOLVED , that the Town Board of the Town of Ithaca ,
through its Fiscal Officer , accepts such bonds and releases $ 39 , 257 . 80
presently retained for work under EPA Project No . C - 36 - 1104 , and
FURTHER RESOLVED , that any future release of retainage
under these bonds shall be subject to future Town Board action
based on the current market value and total retainage at that
time .

TOWN HALL IMPROVEMENTS
REQUEST FOR PROPOSAL
Supervisor Desch offered the Board for review a draft
letter to five architects requesting a proposal for improvements
to the Town Hall to bring it into compliance with Public Officers
Law , including Chapter 368 ( access for physically handicapped ) ,
modifications to the second floor to improve its usefulness for
public hearings and improved space arrangements as well as improved
acoustics , and modifications to the first floor space arrangements
to improve operational efficiency and a higher quality working en -
vironment .

Councilwoman Raffensperger recalled that the first draft
of the proposal implied that the architects should look into switch -
ing the functions of the first and second floors . Supervisor Desch
said that the present proposal does not preclude that option , but
an examination of the logistical situation does not seem to indicate
a way that works better . Councilwoman Raffensperger suggested the
possibility of having the engineering department upstairs and the
Board room downstairs . Supervisor Desch said access to the back
room ( presently engineering and planning ) without going through the
vault is the problem that must be solved .
Councilman Powers asked what the Town would gain by hiring
an architect to study the modification of the second floor meeting
room . Supervisor Desch said there is a space now totally unused
between the front of the building and the Board meeting room . There
is a possibility of opening up that room like the Board room . Coun -
cilman Powers did not think that many people attended the meetings
to make that necessary . Supervisor Desch said that the Coy Glen
meeting brought in a lot of people as do some of the Planning Board
meetings . Councilman Powers saidit is a question of a sound system .
Supervisor Desch said it was a question of sound ( acoustical ) changes
and layout as well . He said it is not now possible to make a public
presentation which is easily heard by everyone in the room . Council -
man Powers questioned whether the architects are in any better posi -
tion to study the matter than the Town Board members themselves .
Supervisor Desch said this was true in part but that he thought
Councilman Powers was over - focusing on the question of acoustics .
Councilman Powers did not think that was the case .
Supervisor Desch said that the project had to be thought
of as one whole package , not a piecemeal patching up here and there .
Councilman Powers said if it is necessary to open up the room , it
is a question of removal of walls . He did not think a feasibility
study was required for that . Supervisor Desch said that it was
important to consider structure , utilities , and put it out to bid
if it is decided to do it , and then there is the question of who
will build it . Councilman Del Rosso felt that the space needs
should be defined more precisely than indicated in the proposed
draft letter of request to the architects . Supervisor Desch said
he had left the proposal purposely general . He said if it is to
specific , it will preclude opportunities which it might be useful
to pursue . He said he could have indicated square footage require -
ments , but he did not think it made sense . Councilman Del Rosso
said it would make sense if it had been decided whether the offices
were wanted upstairs or downstairs . Supervisor Desch said that was
exactly why he did not put it in . Councilman Powers said he felt
the Board should make some decisions first before the letter goes
to the architects .
Councilman Powers said he had no quarrel with # 1 , the
first request in the proposal ( bringing the building into com=
pliance with the law ) . He said request # 3 includes improving
operational efficiency . He asked what the problem was and who
would benefit from the work . Supervisor Desch said that would
have to be described to the architect during the visit . He said
there is no way to gain efficiency on the ground floor without gain -
ing access to the rear without going through the vault . He said
that anytime anyone wants to see someone in the back room about
zoning or engineering , the Town Clerk is disturbed , the account
clerk typist is disturbed . Councilman Powers thought that was a
question of shifting where people are . He said he could not see
the point of getting an architect in at this point . Supervisor
Desch suggested that a committee might be formed to set this up .
He felt the Town Board should make a decision . Councilwoman
Raffensperger noted that all that is being asked for at this time
is the architect ' s proposal . Councilman Del Rosso said that all

the Supervisor is saying is that the architects are being asked
for a lump sum proposal for their professional services for a
feasibility study , that is how much it will cost to get a study
of these things , the Town is not obligating itself for anything .
Councilman McElwee said he thought the architects are being asked
to spend a considerable amount of time on this estimate . Council -
man Del Rosso said that when somebody wants to sell something he
must put some time into it . Supervisor Desch did not think they
would have to spend more than a day on this proposal . He felt the
Board should have the feasibility study before it was considered
by a committee . The " numbers " should be available from the outside .
Perhaps the proposal will be practical and inexpensive and the Board
could proceed with it . The Supervisor ' s own view was that this kind
of work cannot be done by committee , everybody will come up with a
different idea . Councilman Powers said that staff opinions should
be considered . Councilman Del Rosso suggested that the letter be
re - drafted so that the architects know that they are only being
asked for a feasibility study . After their appraisal , the Board
could then balance that against the time and effort the Board would
put in , and then decide whether the Board should do it or have the
architect do it .
Supervisor Desch agreed to revise the letter in accordance
with their input and the Board can review what comes in and then
make a decision .
DELINQUENT CHARGE REFUNDS
Motion by Supervisor Desch , seconded by Councilman Freeman ,
WHEREAS , delinquent water use charges were placed upon
the 1979 Town and County Tax Bill to be rendered to John C . Burns ,
105 Kay Street , Ithaca , New York , Town of Ithaca Tax Parcel No .
6 - 71 - 1 - 45 , and upon the 1979 Town and County Tax Bill to be ren -
dered to Rocco P . Lucente , 605 Winston Court , Apt . 4 , Ithaca , N . Y . ,
Town of Ithaca Tax Parcel No . 6 - 70 - 4 - 4 , in the amounts of $ 38 . 43
and $ 19 . 53 , respectively , and
WHEREAS , both of said charges have been duly paid , with
penalty ,
NOW , THEREFORE , BE IT RESOLVED :
That upon receipt of payment in full for the 1979 Town
and County Tax , as rendered to John C . Burns , 105 Kay Street , Ithaca ,

DOG CONTROL CONTRACTS
Councilwoman Valentino reported that the Dog Control
Committee had met and discussed proposed contracts with the
County , the Village of Cayuga Heights , and the SPCA having to
do with dog control . Councilwoman Valentino asked if the Board
was interested in pursuing an arrangement which would include
a contract with the County , the Village of Cayuga Heights and
the SPCA . Supervisor Desch said that the answer is that it is
a reasonable Town -wide function for the Town Board to take the
lead role in negotiating such contracts , providing the terms
can be worked out mutually acceptable to the part - Town taxpayer
and the Village of Cayuga Heights taxpayer . The Supervisor said
the Committee had not had the matter under - consideration -- long , .enough
to work out the details . He said , basically , the function of
issuing licenses is a Town -wide function . The function of admini -
stering a dog control law probably ought to be County -wide , with
different levels of service in each municipality . What the Com-
mittee is trying to do is to streamline the administration so
the number of people involved with processing the payments is
minimized . What must be identified , first , is that the Village
taxpayer is paying for the service they ask for and not the tax -
payer outside the Village .

Town Engineer/ Building Inspector , Town Clerk , and Receiver of
Taxes .
Motion by Supervisor Desch ; seconded by Councilman McElwee ,
RESOLVED , that the Town Board , having reviewed the accounts and
records of the Town Justices , the Town Building Inspector and
Town Engineer , the Town Clerk , and the Receiver of Taxes , hereby
approves of same , copies of said accounts - and records being made
a part of these minutes .

RESOLVED , that this Board at this time reconvene into open ses -

BOLTON POINT BOOKKEEPER - SALARY ADJUSTMENT
Motion by Supervisor Desch , seconded by Councilman McElwee ,
RESOLVED , that the salary of Ms . Sylvia Van Skiver , Bolton Point
bookkeeper , be increased from $ 7 , 873 . 00 to $ 8 , 200 . 00 , effective
January 1 , 1979 , and that her salary beginning April 1 , 1979 be
increased to $ 8 , 500 . 00 provided that she assumes the duties of
Recording Secretary to the Southern Cayuga Lake Intermunicipal
Water Commission ( Bolton Point ) .
