SPECIAL BOARD MEETING
September 18 , 1978 - 12 : 00 noon
At a Special Meeting of the Town Board of the Town of Ithaca , Tomp -
kins County , New York , held at the Town Offices at 126 East Seneca
Street , Ithaca New York , on the 18th day of September , 1978 , at
12 : 00 o ' clock noon , there were
PRESENT : Noel Desch , Supervisor
Andrew W . McElwee , Councilman
Catherine Valentino , Councilwoman
Shirley Raffensperger , Councilwoman
Gust L . Freeman , Councilman
ALSO PRESENT : Lawrence P . Fabbroni , Town Engineer
ABSENT . Victor Del Rosso , Councilman
Robert N . Powers , Councilman
Supervisor Desch announced that the purpose of this special
meeting is to approve payment to Stever Brothers ( Estimate # 3 ) .
Mr . Fabbroni said the payment was in order and should be made at
this time to Stever Brothers . Mr . Fabbroni noted that the Town has
not yet received the $ 142 , 000 from the Environmental Protection Agency . '
Motion by Councilman McElwee ; seconded by Councilman Freeman ,
RESOLVED , that payment in the amount of $ 1521191 . 05 ( Estimate No . 3 )
is hereby authorized to Stever Brothers in consideration of the fact
that Stever Brothers ' request for payment is appropriate and that
funds are available in the budget for this item .
( McElwee , Freeman , Valentino , Raffensperger , and Desch voting Aye .
Nays - none )
DISCUSSION OF BUSES
Supervisor Desch inquired about the status of the bus runs
to the Hospital and Ithaca College . Councilman Freeman said he had
two meetings in view , one on September 19 , 1978 with Swarthout &
Ferris at 2 : 00 p . m . and the other with the Village of Lansing at
7 : 30 p . m . . Supervisor Desch stated that he had a call from Anne
Furry , Trustee of the Village of Lansing , and that he had forwarded
her comments on this matter to Mr . Fabbroni . Mrs . Furry needs in -
formation about population , etc . Mr . Fabbroni noted that the Village
of Lansing has not yet committed itself to this bus run . Councilman
Freeman said that Mrs . Furry should attend the meeting on September
19th ; that he would call her about this . Mr . Fabbroni , also , will
be attending this meeting .
Supervisor Desch noted that Donald Lifton , Village of Lansing
Trustee , is calling for a coordinator to handle this bus run matter .
He suggested that Councilman Freeman point out to the Village of
Lansing that they cannot have the most expensive thing without
appropriating sufficient funds . Councilman Freeman said he would
point . that out at the meeting .
Mr . Freeman noted that Route No . 2 with modifications has
been approved by the Town Board up to $ 4 , 000 .. Mr . Fabbroni noted
that proposed Route No . 2 could be the one that goes downtown ; it
would serve the Town a lot better . Route No . 1 goes downtown .
Mr . Fabbroni noted that with regard to the hospital bus run , Council -
man Freeman obviously still has a serious problem , a money problem .
Councilwoman Raffensperger said that the original resolution of
support for the bus run proposal was defeated 14 to 2 by the County
Town Board Minutes - 2 - September 18 , 1978
Planning Board . She said the County Planning Board recommendation
to the County was negative to Ithaca College and the Hospital . Their
basic difficulty was with the amount of money . The County was en -
couraged to look into a zoned bus fare with the hope of reducing the
deficit . Councilwoman Raffensperger at the meeting made the point
that the County put the Hospital on West Hill , and the least they
could do is support a bus run .
Mr . Fabbroni noted that the City of Ithaca perceives the
Town ' s position as rather unrealistic' . He said he had been asked
to go to the Planning and Public Works Committee meeting on Thursday .
Councilman . Freeman stated that the Tompkins County Transit
Commission has gone on record as hoping for support equally from all
participants . He said the Town of Ulysses representative feels that
the Board of Representatives is afraid of taking on a $ 20 , 000 " loser . "
Councilman McElwee said the Hospital run should be a County problem ;
that Ithaca College is not . Supervisor Desch said the City of Ithaca
has been good to the Town and probably should have asked only for
the Hospital run since they have shouldered this burden for years .
Councilman Freeman said the City of Ithaca feels that the Ithaca
College run is important to the City of Ithaca and downtown . Council -
woman Raffensperger said she felt the County Planning Board got the
impression that the whole bus run is only for the benefit of the City
of Ithaca . Councilman Freeman said he was not opposed to the bus
to the Hospital and Ithaca College . Supervisor Desch suggested the
poss - bility of supporting the run to Ithaca College and the Hospital
to the tune of $ 5 , 000 . This might get the matter off dead center .
He said Ithaca College has been subsidizing this run .
COY GLEN GRAVEL EXTRACTION
Councilman McElwee outlined the past history of this
matter . He said there was a court order many years ago to cease
and desist excavation . Then New York State regulations were put
forth and the matter was allowed to ride because it was felt that
New York State regulations would cover it . New York State did not
have money to implement the regulations .
Supervisor Desch noted that this matter will become very
active , that the Town is preparing its response ; that there will
be a meeting at noon on September 19 , and that the Board as a whole
should be prepared to discuss the matter on September 25th .
Mr . Fabbroni stated that Rumsey - Ithaca had a large stock
pile in 1976 and the County needed processed gravel . Rumsey- Ithaca
got the bid and the City of Ithaca used their material for the Elmira
Road project . Another 41500 tons of material showed up processed at
the pit and was sent to City of Ithaca projects . Supervisor Desch
said the Zoning Board of Appeals should have aggressively followed
up on reclamation procedures . Mr . Fabbroni stated that Dennis Colliton
and Bob Bonnell agree that the conveyor belt has been in operation .
Supervisor Desch said an injunction to stop further extraction on
the south side may be the best option .
