A . MUNICIPAL PROJECTS STATUS
( 1 ) COMPLETED :
a . Parks
- A short public relations study of Coy Glen : Preservation Area Report
was prepared and published by Barbara Zimmerman ) Restaino with staff
support .
The Town of Ithaca Comprehensive Park & Open Space Plan first drafted
by Susan Blumenthal in 1975 was updated , illustrated , and published by
Stephen Ossias with staff support . A study of the Lick Brook area was
begun . At this time physical inventory and mapping are complete .
- A ten year park plan of stages of implementation , site acquisition ,
construction costs , sources of funding and cash flow was prepared for
Town Board review .
The park plan for the DeWitt Junior High School site was developed
by Barbara ( Zimmerman ) Restaino and initially refined by the committee
chaired by Mr . Donald Culligan . After public input plans were refined
and costs assigned . The Town of Ithaca , School District , Village of
Cayuga Heights , and Village of Lansing were then approached to endorse
the project and to solicit a commitment on cost sharing . To date the
Town of Ithaca and School Board have endorsed the concept to the extent
of agreeing to $ 30 , 000 shares each as part of the local share matching
an anticipated BOR Grant .
- A conceptual design and site plan was developed for the Eastern
Heights Parkland and reviewed by Planning Board .
b . Transit
- Townwide survey was used by a Cornell Consultant - in - the - Field Student
to prepare a rough draft of ideas for extension of transit services
into the Town of Ithaca .
- Although its scope goes beyond transit , the Town Board has resolved
to join the Greater Ithaca Transportation ' Commission .
Bus service for the elderly continues to be provided Townwide . by the
Office for the Aging through Gadabout .
. c . Sewers
A package of our efforts to obtain funding was prepared for Assemblyman
Lee , Senator Smith , and Congressman McHugh . A meeting was held with EPA
Region II and NYDEC officials in January which established our eligibility ,
established our State priority number , and created a strict timetable
with funding as the end reward .
The Facility Plan , Archeology Study , and Environmental Assessment
Statements were prepared and Plans and Specifications modified by our
consultant with considerable staff input , guidance , and review .
Facility Plan , Environmental Assessment , and Cost Disclosure public
hearings were held in March .
Entire package was submitted for review to DEC on March 15 , 19770
NYDEC forwarded the package after additional changes provided by
consultant and Town staff to EPA about May 30 , 1977 . SHPO also approved
the Archeological Study and forwarded it on prior to that time .
EPA Region II completed technical review of Facility Plan , Plans and
Specifications by the middle of June and while awaiting EAS and Archeo-
logical approvals , a new directive on required densities , studies of
alternative treatment methods , public health need , etc . , came out from
USEPA .
Fortunately , we still met all the criteria and a package consisting of
aerial photographs with overlays , comprehensive sewer plan , comprehen -
sive recreation plan and a narrative - on projections for growth and present

need for sewers was prepared by Town staff and delivered to Region II
EPA in New York in early July .
Additional information was then required which , with the help of the
Tompkins County Health Department and Mr . Arnold of Cornell , was put
together and presented to the representative of EPA Region II when he
visited Ithaca and the sites with Town staff in August .
Grant was awarded on or about September 30 , 1977 .
Materials for signature were received and returned signed in mid -
October , 1977 .
Authorization to proceed with bidding was delayed due to lack of
Federal Wage Rates and was finally given without same in mid - November .
Project bidding period was started December 1 , 1977 .
Easements have been obtained on all but about 10 properties , with only
one condemnation proceeding having been started .
The bonding limit was formally increased from $ 970 , 000 to $ 1 , 200 , 000 ,
although the local share is expected to be less than $ 400 , 000 . The City
and Town negotiated a draft agreement for sewer services with staff
support .
The City and Town formed a selection committee including staff to
screen over 30 consultant proposals for Step 1 work to upgrade the
Wastewater Treatment Plant and evaluate the sewer system it serves .
Staff jointly reviewed all proposals recommending interviews with
O ' Brien and Gere , Stearns and Wheler , and Metcalf and Eddy . Stearns
and Wheler was ultimately chosen .
EPA has approved the choice of consultant and Step 1 budget amounts
and work items to date .
Investigation and repair of services at 131 Salem Drive and 315 Winthrop
Drive .
. d . Town Barn
Staff continually advised the Town consultant and the four contractors
on appropriate courses of action and appropriate change orders .
Staff coordinated Town completion of grading inside and around the
building , installation of fuel tanks and pump island , installation of
septic system including tank and field , installation of outside portion
of building floor drain , and preliminary landscaping with timing
requirements of contractors . Final contract amounts were as follows :

Only the General Contractor remains to be paid a retainage held back
due to extensive leaks in the roof openings .
A maintenance bond was executed with the help of the Town Attorney to
cover questionable concrete work . To date no problems have become
apparent under heavy use .
Preparation of Salt Shed Specifications and Town Board authorization
to bid .
e . Drainage
The problems with drainage along Brandywine and Christopher Lane were
investigated with landowners and solutions discussed with BOCES , School
District , and the Highway Department . As a part of the DeWitt Recrea -
tion site a pond was designed that offers the greatest relief to this
peak runoff problem . Much design data was prepared by staff for presen -
tation to School Board .

Final account of Federally eligible flood work was made with a request
for final inspection and payment of $ 35 , 000+ mailed December 17 , 1977 ,
and received in Albany December 19 , 19770
Mrs . Vatter of East Shore Drive had a flooding problem . Town staff
inventoried the sources of her creek problem primarily from the Village
and gave her a complete list of property owners , an analysis of her
problem , and suggestions for solution .
Installation of storm sewers at 307 and 309 Salem Drive as requested .
f . Surveying
Grade checks for Town Barn floor gravel base , underground exhaust
system , fuel tanks , septic system , and perimeter drainage and road
grades .
Grade checks for Town Highway ditch work .
Grade checks for Sewer repair , easements , and new design .
Grade checks for isolated resident complaints or requests relating
to public service .
g . Highways
Plans and profile of a Town - County preferred Route 96 alternative were '
developed and refined by Town staff and reviewed and endorsed in the
following chronological sequence of public forums : informally by
Planning Board , with the majority of residents in the Town north of the
Hospitals publicly announced Planning Board meeting ; public informal
discussion of Town Board ; Publicly Advertised Information meeting of
Town Board ; Resolution of Town Board ; public presentation at Consensus
Committee meeting ; petition of 97 landowners north of Hospital ; petition
of 60 Physicians and Employees of Professional Building ; Resolution of
support from Paleontological Research Institute ; Resolution of Buildings
and Grounds Committee of Tompkins County Hospital Board of Managers ;
Resolution of full Tompkins County Hospital Board of Managers ;
Resolution of County Planning and Public Works Committee ; Resolution of
County Planning Board ; Resolution of Tompkins County Board of Representa -
tives . Each resolution came after a full staff presentation of the pre -
ferred alternative . The details were then transmitted from staff to NYDOT
in June and NYDOT consultant has been working on details since then .
The biggest question to be answered which will greatly affect the
improvement in the Town , is what the City will do . Through the request
of Supervisor Schwan , Mayor Conley has appointed Lawrence Fabbroni as
an ex officio Town observer on his technical committee to study alter -
natives in the City . Mr . Liguori serves a similar role for the County
on that committee .
The Highway Master Plan was revised removing a stretch of a proposed
new road connecting Pine Tree near East Hill Plaza to Slaterville Road .
Project Applications for improvements on Snyder Hill Road and Sand
Bank Road under the Safer off systems Program were prepared by staff ,
given preliminary approval by County and are under review by State .
Phase 1 of Safer Roads and Pavement Marking Program - for signs was com-
pleted by Highway Department and approved by State Inspector .
h . Traffic
Completion of Traffic Analysis of Judd Falls - Pine Tree Road Corridor
and Five Key Intersections ( East Ithaca Traffic Study ) .
i . Ordinances
A Resolution of Town Board intent to enforce the State Environmental
Quality Review Act was passed . A follow - up Local Law has now been drafted .
j . Applications
A program narrative of tasks and need was submitted by staff after appro
val by Town Board ( 12/ 22 ) for 2 CETA workers to work for 9 months with the
Highway Dept . on Snow Removal and other Special Projects .

Supervisor Desch recommended the following policies for 19780
( 1 ) Questions from the public or media will be addressed to
the Chair rather than to individual Board members or staff .
( 2 ) Appropriateness or inappropriateness or relevance of
question's will be determined by the Chair .
( 3 ) Presentations by individuals or Board members will not
be interrupted by questions from the floor .
( 4 ) seetings will not exceed three hours ( generally ) If
the Agenda is not completed within three hours , the remaining items
will be taken up at the next meeting or at an adjourned meeting .
( 5 ) After discussion of controversial subjects , each 'hoard
member will be asked to state the reason for his vote at the time he
makes it so the public will know where each Board member stands on
the issue . This procedure will not be followed on routine matters .
( 6 ) There will be no smoking during official Board meetings .
Supervisor Desch requested at this point that the Board
adopt a resolution that no smoking will be permitted during official
Board meetings .

Supervisor Desch said this Committee will give top priority
to the completion of the New zoning ordinance . A target date for
adoption , September 1 , 1978 , is recommended. . The Zoning Ordinance
in conceptual form should be available to the Town Board and Planning
Board by April 1 , 1978 .. The preliminary form- of the complete ordi •m
nance ( including Town Attorney review) should be available for Town
Planning Board/Town Hoard review on July 1 , 197x . The: 'cn,* ttee may
wish to involve the Town/Zoning/Planning Boards At other stages of
the development of the ordinance .
Second priority shall ° given to the revision of the Sign
Ordinance to siniplify administration without sacrificing enforceabili

Control Committee which mould kie charged with identifying and evalu -

and shall pursue its objectives with all police agencies . Enforce -
ment alternatives to be explored includ increasing County Sheriff
patrol , part -time Toilm traffic control force , Arid Contracting .with

determination of the prevailing speed in those areas of the Town

of schedule time wise and is within budget ,
•GNKEMEYER PROPOSAL PROPOSED' BUSINESS 11V DISTRICT
Supervisor Desch noted that the proposal of Evan Monkeme,yer
to rezone 30 acres of land to a new Business " F " District is a new
concept in terms of permitted uses in the Town of Ithaca . It is not
a new concept State9 ide or nationally . It is an attempt , he sand ,
to make a commercial development economically feasible and flexible
by combining it with residential use .. I3e said the Board will need
to consider ( 1 ) whether there should be a mix of commercial and resf. �
aaential and ( 2 ) if such a zone is created , what restrictions would
be imposed . I-;rso Bronfenbrenner , Chairwoman of the Planning Board ,
said the Planning Board has had several public hearings on this sub ®
ject , not particularly well attended ° Overall the response has been
favorable . Councilwoman Raffensperger recommended a public informa-
tional hearing . This appeared to be acceptable to the Board , and
it was suggested that a box ad might be put in the Ithaca Journal °

ATC ( Ceracche ) Television Franchise
Supervisor Desch distributed material on the proposed amend -
ment to the TV Franchise with ATC ( Ceracche ) . The revision is being
reviewed by the County Cable Commission , by the Town Board , and - the',
Town Attorney . The Supervisor felt it was appropriate to schedule
a public hearing for the February meeting to consider adoption o - f
the amended franchise .
Motion by Supervisor Desch , seconded by Councilwoman Valentino ,
RESOLVED , that the Town Board will conduct a public hearing on Febru-.
ary 13 , 1978 at 7s30 p . m . to consider the adoption of the amended IV
Cable Franchise Agreement between the Town of Ithaca and ATC ( Cer

Councilwoman Valentino felt the Cable Commission has suf -
ficient information at this time to make a recommendation at the

to areas of low density , etc . Supervisor Desch said he felt ATC
has come forward with a reasonable amendment , and , if necessary , at
the public hearing further modifications might be required .

Councilwoman Raffensperger reported that the Park Committee � .
is making available to Town Board members a list of property owners
in the Coy Glen preservation area . She asked Board members to indi -
cate on the list anyone they would be willing to contact . The Park
Committee will then notify Board me?-hers of a coordinated contact
list and provide materials for contact . She requested that the list
be returned with notations by January 134Ch in order to meet February
target date for Coy Glen acquisition schedule .

has entered into more specific negotiations with Cornell University
and will continue these negotiations with the help of the Toxim Attor �

and implementation of plan for Parks and Open Space Plane scheduled
to be completed by March , 1978 . Such a plan was brought to the Toven.

PERSONS TO RE U..EARD
Mr > Arthur L . Berkey , 128 Christopher Circle , stated he felt
that scheduling half of the Board meetings at 7o. 30 p . m . is a distinct
improvement . He objected , however , to scheduling the other six meet
ings at 5 .* 15 p . m . He stated again his conviction that this is not a
convenient time for the public . He recommender scheduling all the
meetings at 7e30 p . m . if the Board really desired public input .
Supervisor Desch felt the 7o. 30 p . m . schedule is flexible and is a
step in the direction of determining what , in fact , might be the
best meeting time for the majority of the people . If the agendas
are properly structured in advance , at the end of the year the Board
should have a good idea of the best meeting time .
Mr . Berkey said he dirt not see any flexibility in the sched -
ule since the times and places are defined in advance . 10he Super
visor said the flexibility will come in the detail and arrangement
of the agendas . He said his mind is open as to whether 5e15 p . m . or
7 .> 30 p : m . is a better meeting time . That will not be known until
the Town has gone through the process . Ile said he felt the key
question is not the time of the meeting , but the content and organ-
ization of the meeting , and the advance notice of it . He said there
is really no ideal time for all of the people to meet .

school crossing on the west end of Christopher Circle is down .

Mr . Berkey stated that at the December meeting ( 1977 ) ,
Councilman Powers read a statement expressing the position that a
written explanation of the $ 300 , 000 Bolton Point deficit and measures
to prevent future deficits should be instituted . Fe asked what the
Board ' s intention is on this as far as action on getting the explana �
tion and control measures . Supervisor Desch said it is the Commis -
sion ' s intention and this Board ' s intention to honor Councilman PowW
ers ° request , and that he would see that such a report is written
and also to see that the measures that are required to properly con-
trol the funds of the Commission are implemented . Supervisor Desch
said the report would be a Public report , but he could not say at
this time when such a report would be available .

Mr . Rocco Lucente , developer , requested that he be permitted
to change the name of Winston Court and Winston Court Apartments to
Sprucewood Circle and Sprucewood Circle Apartments .
Supervisor Desch wondered how this would benefit the Towne
and there was some question as to whether there are any other streets
of similar name ( Sprucewood ) . Supervisor Desch said such a change
would involve a change in the official street map of the Town . He
felt the people in the area should have an opportunity to be heard
with regard - to the requested change .
Mrs . Livesay said it would be necessary to be careful with
a new name because there are some small streets in Dryden with simi-
lar sounding names . The Fire and Disaster Coordinator and fire de °
partments could be confused in getting to the right location in case
of fire . The naming of streets and roads , she said , must more and
more be considered on a County-wide basis . It was agreed this pro

ENERGY COUSERVATI018 CODE
Supervisor Desch referred to the new State Energy Conservation
Code which requires all structures after January 1 , 1978 to comply
with a very stringent code i.n terms of heat recovery- and insulation .
It requires local administration tocertify compliance . it is a very
complex code . It would if adopted , either a substantial in -'
crease i
n the engi.neerincg staff of the Town or a substantial budget
increase to hire engineers to provide the service . The Supervisor
said he had as an individual submitted comments to the State Building
Council that the Code is no longer appropriate , that the natural rise
in prices for fuels has created a sufficiently powerful incentive so
that buildings will be constructed with sAffi:cient insulation and
adequate heating systems within the current construction coder
and
that the State ' s .'responsibi.l ty should be to modify , if necessary ,
its already prolific construction code to take into account enercry
conservation requirements .

RESOLVED , that this Town Board hereby goes on record in opposition
to the proposed mandatory Energy Conservation Code as written .

Mr . Fabbroni .reported that the two CETA positions the Town
has- applied for were approved at the local 'level and are inow .at the.
State level for approval . It is very likely these will also -be
approved at the State level since the, 5tate generally approves what
has been approved locally .
Bidding on the salt storage building has been delayed so
that the site can be better prepared when drier " weather returns .
Then the whole project can be' administered .-more easily both from
the Highway Department ' s point of view and from the standpoint Q :f
the administration. of the contract .
Highway Superintendent
Mr . Parkin recited for the Town Board certain figures on
fuel , salt and sand used in highway operations since 1974 . The
Supervisor recommended that these figures be put on paper for the
Board ' s benefit .

Planning Board Chairwoman
Mrs . Bronfenbrenner reported that the Planning Board met on
January 3 , 1978 and considered the following .
A proposal to modify the old P & C building on Judd Falls
Road and kitchell Street by George Idemana the owner . Mr . Idei' an
wishes to return the building to its original use as a place of pub-
lic assembly . He wants to improve the facilities and come up to
State standards. To do this he proposes to add 2a feet to the build°
ing for a snag bar and rest rooms . This would be on the Judd Falls
Road side of the building . The Planning Board recommended approval
to the Town Board . The public had no comment at this meeting .
The proposed accessory building for the T & f414 Eonvenience
Foods (Thomas, Bell ) on Elmira Road . The proposal was rejected pend °
ing further study to determine if the structure is actually a build=
ing or an abandoned vehicle and if all statute requirements Have been
met .
