Fabbroni distributed copies of the East Ithaca Traffic Study and reviewed this material with the Board . ( Study attached as part of these minutes . Councilman Desch ';', asked if Mr . Fabbroni felt that were the piece of the crosstown highway to be proceeded with , would it be possible to avoid illprovements on , the intersection of Judd Falls Road and Ellis Hollow Road with all the commercial traffic . Mr . Fabbroni thought this was possible because of the access set -up for the shopping center . Asupart of the `crosstown road , it would be necessary to take turning lanes into consideration where it would cross Ellis Hollow Road , : 11 As to existing intersections , enough traffic would be siphoned off . At this point the Supervisor read a resolution adopted by, the Planning Board on March 1 , 1977 regarding that portion of a proposed road in East Ithaca shown on Town of Ithaca Paighway Plaster A. a said road section running from Slaterville Road to Pine Tree, x:oad through the Blatchley land and land of others . There followed discussion of possible date for public hear - ing on this matter . r- otion by Supervisor Schwan ; seconded by Councilman Desch , RESOLVED , that this Town 'Board will 'conduct a public hearing at 7 .* 00 p . m . on Match 24 , 1977 at the Town Offices to consider dele - tion from the Town of Ithaca Highway raster Plan that section of proposed road on the Town of Ithaca Paster Plan map between Slater - ville Road and Pine Treei,'Road which runs through Blatchley land and others . Schwan , McElwee , Desch , Del Rosso , Powers , Valentino , and Raff_ ens _ perger all voting Aye . Nay - none . The motion was thereupon duly carried . BUSINESS EXEMPTION LAGS Town At . orney Buyoucos reported that his research indicates that the proposed business exemption does not include exemption of service charges and watei use charges or sewer use charges . Mr . Buyoucos noted that the law will go into effect as legislated by the State unless the Board takes some positive action . Councilwoman Raff 'ensperger expressed again her opposition to the proposed exemption! on the grounds that it is not compatible with the To:m ' s planning goals . She said it is not flexible enough to permit local municipalities to achieve their duals . The plan documents of the Town of Ithaca emphasize residential development . She said what the people in the Town of Ithaca want is controlled industrial and commercial development , discriminating development . She sees this law as not in accord with that planning philosophy and opposes it . Councilman Powers asked why she felt the Town does not have the same control' as the Zoning Ordinance now provides . �cilwoman Raffensperger said the proposed exemption encourages develop^tentP it is a positive thing , it provides twc incentives , S "ae said , " I don ' t think it follows the planning goals in the Town of Ithaca to be encouraging commercial and industrial development . I know the amounts are not significant but I think as a matter of policy and planning , it is a significant question . `° Motion by Councilwoman Raffensperger , BE IT RESOLVED by the Town Board of the Town of T .haca as follows Pursuant to the authority of subdivision 7 of section 485 -b of the Real, Property Tax Late , the partial exemption from taxation , special ad valorem levies '+ and service charges provided by such sec - tion 485 -b is hereby repealed insofar as such exemption would have been applicable to eligible Property assessed for Town purposes . There being no second to the motion , it as of no effect . Town Board Minutes - 3 14arch 7 , 1977 Supervisor Schwan said he did not understand how the pro - posed exemption would disturb the Town ' s planning goals . Where is land on South Hill at the intersection of King Road and Danby Road which is zoned commercial and which has never been developed . There is also the Ellis Hollow Road/Judd Falls Road intersection which is zoned commercial . There ' is considerable land adjacent to N&, tloonal Cash Register Company zoned for heavy and light a " can the Elmira Road . Last year the Town of Ithaca built al:n: .a_ no+- ping com- mercial " and what really concerns me is the fa : t that this law -- even though not good enough - - does attempt to stop the erosion of industries in this area . It is nice if you want to keen Ithaca an educational community , but educational institutions don ' t pay taxes . " Councilwoman Raffensperger maintained that planning goals in the Town of Ithaca envisage residential development ; that the Town should , by tax incentives , encourage residential development in areas of the Town where water and sewer is available and where road sys _ ers can support it . Supervisor Schwan noted that jobs must precede resi - dential development . Without new jobs there will not be very much new residential development . Councilwoman Raffensperger felt thr.'` the exemptions already granted by the County and the School b1strkct have already created sufficient stimulus , if that is what it takes to get more development . Councilman Desch said . . " the problem is that if you don ' t have the incentive for industrial and commercial and you continue to erode the base that 'is there , that is going to have an erosion effect on the residential in due time which will be far worse than not doing something to turn around the erosion of the commercial and industrial . " Supervisor Schwan said Cornell Univer - sity construction between 1950 and 1970 was a large part of the Town growth and that coincided with Ithaca College moving into the Town . of Ithaca . The major generator is educational and there is some commercial and some industrial , but it does not appear there will be new educational growth . Councilwoman Raffensperger noted that there is vacant commercial space in the Torun of Ithaca already * that businessmen have said that it is easier to build new and leave the vacant commercial stande She reiterated that this proposed exemp- tion does not fit the Town ' s planning goals . She noted again ( as the Town Attorney has said ) that the legislation is poorly drawn and ambiguous in some respects . Mr . Buyoucos noted the Town has flexibility in that should the exemption be allowed , it may be repealed in future years , �Trse Livesay , County Representative , noted that the Legis - ;. ative Committee of the Board of Representatives is pursuing w7hether the business exemption law should be amended . It has also been discussed with the Chamber of Commerce . Fars . Livesay recom- rte7%Zaed that someone from the Town Board might pursue this with the j._<-2a Committee and with the Chamber of Commerce . It could pursued not merely from the standpoint of amending the legisla - t. : on , but also in the direction of considering whether there are Oetter incentives which can be offered to business or whether there 63. e other things which are unfair to business which are driving them out . Supervisor Schwan noted that it is the business taxes which are driving them out ; New York State is the highest taxing State in the nation . Mrs . Livesay said the County. - Legislative Committee is avail - able and a group effort wo ld be more likely to bear fruit than work- ing only with individual legislators . Since , after the discussion , the Board took no affirmative action with respect to the business exemption legislation , the law as legislated will automatically go into effect as of May 1 , 19770 � 1 Town Board Minutes - 4 - March 7 , 1977 TIATER AND SETTER UNIT CHARGES FOR PROPERTIES WITH APARTIMUS Town Attorney Buyoucos distributed to the Board a draft of a proposed local law in this matter . This led again to a 'long dis- cussion , with a reiteration of opinions and arguments which have appeared in the February and March Meetings . Couneilinuin. Desch said if there are two kitchen units in a dis,-yelling , regurd :A. ess o± who is using them , the demand on the system is twice that of a single f ami - ly . Councilwoman Valentino said , " I cgon ' t really see any sense in passing this law because you are talking about water and sewer bene � fit charges , which are not substantial . People who have this prob- lem can overcome it in simpler ways - - via income tax write -offs , through Social Services , etc . "' Councilwoman Raffensperger said zr . Buyoucos ' purpose and the purpose of the Boar' eras to aet some ° thing on paper which could be voted upon . She inquired , however , why it had to be a local law and not simply a resolution . Mr . Buyoucos said that merely with a resolution , without public hearing , there is no sound basis for assessing penalties or handling infracc tions , or attempts at avoidance , Councilman Desch felt that the only way to bring about removal of benefit assessments for an apartment would be discon - nection and removal of kitchen Plumbing . TrThen that is done the Town could waive the assessment . Councilwoman Raffensperger recom- mended a public hearing so that there would be an indication as to whether or not the Board will support or reject this exemption as in Mr . Buyoucos ' proposed law . Lotion by Councilwoman Raffensperger ; seconded by Councilman Powers , RESOLVED , that this Town Board will conduct a public hearing on April 11 , 1977 at 7000 P . M . to consider the adoption of a local law known as " Refunds , Sewer and Mater Benefit Assessments in Certain Cases . °' Discussion . followed . Councilman Desch said , " If we begin to pass laws on every little irregularity , I think we will have so litany laws on the books we will never have enough staff to admini - ster them . " Councilwoman Raffensperger asked Mr . Buyoucos if he had any real opposition to a resolution rather than a law . r-Ir . Buyoucos said that if a resolution were adopted , including penal - ties., he would not be as sure of his legal ground as if it were a local law . A straw vote was taken , with Councilwoman Raffensperger , Councilman Powers and Councilman IRcElwee in favor of a public hear - ing and Councilman Del Rosso , Councilman Desch , Supervisor Schwan , and Councilwoman Valentino against a public hearing . The resolution was thereupon abandoned . APPLICATION FOR A FEDERAL GRANT FOR THE CONSTRUCTIOII OF NECESSARY SEWAGE TREATMENT TIORsS , UNDER THE FEDERAL WATER POLLUTIO1 CONTROL ACT AT"ENDMENTS OF 1972 ( PL 92 - 500 ) k1re Fabbroni read a draft of a resolution in the above matter and after brief discussion the Board acted as follows .ft i4otion by Councilman McElwee ; seconded by Councilman Powers , I'TIEREAS , the Town of Ithaca , Tompkins County , New York , herein called the g' Applicant `a , after thorough consideration of the various aspects of the problem and study of available data , has hereby determined that the construction of certain works , required for the treatment of sewage , generally described as Sanitary Sewer Extensions to the Toum of Ithaca Sanitary Sewer System , and identi - fied as Project Furiber C° 36 ° 1104 , herein called the " Project is desirable and in the public interest , and to that end it is neces - sary that action preliminary to the construction of said Project be taken immediately ,, and J � Town Board Minutes - 5 V March 7 , 1977 WHEREAS , under the Federal Mater Pollution Control Act Amendments of 1972 ( PL 92 - 500 ) , the United States of America has authorized the making of grants to aid in financing the cost of construction of necessary treatment works to prevent the discharge of untreated or inadequately treated sewage or other waste into any waters and . for the purpose of reports , plans , and spec4sjfications in connection therewith ; and !"MEREAS , the Applicant has examined and duly cransidered said Act , ( PL 92 - 500 ) and the Applicant deems it to be in the pub- lic interest_. and to the ' public benefit to file an application under this Act arid: . ,to authorize other action in connection therewith , NOTI .- THEREFORE , BE IT RESOLVED by the Town Board of the Town of Ithaca , the governing body of said Applicant , as follows . 1 . That the construction of said Project is essential to and is in the best interests of the Applicant , and to the end that said project may be constructed as promptly as practicable it is desirable that action preliminary to the construction thereof be undertaken immediatelya 2 . That Walter J . Schwan , Supervisor of the Town of Ithaca , be hereby authorized to file in behalf of the Applicant an applica - tion ( in the form required by the United States and in conformity with the Act ( PL 92 - 500 ) ) for a grant to be made by the United States to the Applicant to aid in defraying the cost of construc - tion of the sewage treatment works described abovev 3 . That if such grant be made , the Applicant agrees to pay all the remaining cost of the approved Project , over and above the amount of the grant 4 . That if such grant be made the Applicant agrees to make Provision satisfactory to the United States Environmental Protection Agency for assuring proper and efficient operation and maintenance of the treatment works after completion of the construction thereof , 5 . That the said rNalter J . Schwan , Supervisor , is hereby authorized to accept any Federal Grant that may be offeredo to furnish such information and to take such other action as may be necessary to enable the Applicant to qualify for the grant , and 69 That the said Walter J . Schwan , Supervisor , is hereby designated as the authorized representative of the Applicant for the purpose of furnishing to the United States such information , data , and documents pertaining to the application for a grant as ray be required .e and otherwise to act as the authorized represents- Live of the Applicant in connection with this application and in connection with any requirements of any Federal grant which may be made 7 . That Leonard E . Bower , P . E . , be designated Applicant Contact for the purpose of furnishing to the United States such information pertaining to the application for a grant as may be requested by the United States Environmental Protection Agency ; 8 . That Walter in Schwan , Supervisor , be designated as the recipient of State and Federal Construction grants paymentsp 9 . RESOLUTION OF INTENT TO ESTABLISH EQUITABLE SETATAGE TREATMENT USER CHARGE AND INDUSTRIAL COST RECOVERY SYSTE14 RELATING TO S =AREA SETIER PROJECT Supervisor Schwan read draft of proposed resolution in this matter and the Board acted as follows . Motion by Supervisor Schwan seconded by Councilman McElwee , RESOLVED , that the To*.,m of Ithaca will establish an equitable sewage : treatment user charge and. industrial cost recovery system in accord -- ance with provisions of the Pules and Regulations of the Environ- mental Protection , Agency . The question of the adoption of the foregoing resolution was duly put to a vote on roll call , which resulted as follows ° Councilman McElwee , voting Aye . Councilman Powers , voting Aye . Councilwoman Raffensperger , voting .dye . Councilman Del gosso , voting Aye , Councilman Desch , voting Aye . Councilwoman Valentino , , voting Aye . Supervisor Schwan , voting Aye . Nay - none . The resolution was thereupon declared duly adopted . PROPOSED ENGINEERING AGP%EE1-JEkTT FOR STEPS I and II and II T __ 5 -AREA SET L'ER PROJECT Mr . Fabbroni presenters proposed engineering agreement between the Town of Ithaca and Lozier Engineers , Inc . for Steps I , II , and III of the 5 - area seweri project . Fie said it must t.)e approved by riarch 15 , 1977 . It provides the format that the En- vironmental Protection Agency requires for the work already com- pleted for Step I phase plan , Environmental Assessment Statement , and Archeological Study . It also applies to the design costs which the Town has been billed for by Lozier Engineers , Inc . for plans and specifications . It provides for construction surveillance , drawings , and " as builts . " Since it appeared the Town En^ ineer , the Town Attorney , and the Board had some reservations and questions with respect to the proposed agreement , it was agreed that this meeting wculd be adjourned to March 14 , 1977 at 12 : 00 o ° clock noon to provide time for the revision of the contract . i ' Town Board Minutes - 7 - March 7 , 1977 In the meantime, the Town Attorney provided a resolution which will clear the Town with the Environmental Protection agency . Piro Buyoucos read the resolution and the Board acted as follows : Motion by Supervisor Schwano seconded by Councilman McElwee , IN THE MATTER OF TOWN WIDE SEPIER PROTECT ( EPA PROJECT CONTROL NO . C- 36 - 1104 ), RESOLUTION AUTHORIZING PREPARATION 'IOF AGREEMENT WITH PROJECT ENGINEERS WHEREAS , ( I ) the Town Board of the Town of Ithaca has hereto - fore authorized the project for the construction of sanitary sewer mains and appurtenant facilities in the Town of Ithaca and has here - tofore consulted with Lozier Engineers , Inc . , the project engineers , who have prepared certain engineering materials , plans and documents in connection with the project , and WHEREAS , ( II ) application for Federal funds is now being made by the Town of Ithaca which , if granted , will enable the Town to _proceed with the construction of the project , NOW , THEREFORE , . IT IS RESOLVED That the attorney for the Town of Ithaca is directed o t proceed with the preparation of anllagreement covering the services between the Town of Ithaca and Lozier' Engineers , Inc . , as the pro - ject engineers , which agreement is ''„ to be made available and executed by March 15 , 1917o Schwan , McElwee , Deschf Del Rosso , ":Powers , Valentino , and Raffens - perger voting Aye . stay - none . The 14otion was thereupon declared to be carried . PETITION - ROUTE 96 14re Wayne Pollard , 156 Indian Creek Road , presented a peti - tion urging the Town Board to adopt a position favoring the proposed Rt . 96 rural alternatives which connect existing Rt . '96 south of Tompkins County Hospital . They specifically favor a rational combi - nation of Alternatives 2 and 3 which would minimize the impact on facilities in the vicinity of the Hospital . The petition , :according to P2ra Pollard , is signed by 90 % of the residents in the area . He said the petitioners wanted the Boarrd to have the petition prior to the public meeting with respect to Rt . 96 on March 17th . The Supervisor accepted the petition and thanked lair . Pollard for submitting it . SPEED LIMIT OPT PLEASANT GROVE ROAD SOUTH OF THE VILLAGE OF ° CAYUGA 11 EIGI3TS LIMIT Councilwoman Raffensperger presented a petition from a group of residents on Pleasant Grove Road ' ( Hasbrouck Apartments ) , request- ing that the speed limit be lowered, from 40 miles per hour to 30 miles per hour on Pleasant Grove Road south of the Cayuga Heights Village limit . Although the Town Engineer will be requesting area speed limits , the consensus of the Board was there would be no harm in making this specific request . 35� Town Board PIinutes - 3 - March 7 , 1977 Tlotion by Supervisor Schwan , seconded by Councilwoman Raffensperger , RESOLVED , that the Town of Ithaca will make application to the Department of Transportation for the reduction of the speed limit from 40 miles per hour to 30 miles per hour on Pleasant Grove Road south of the Village of Cayuga Heights limit . Schwan , McElwee , Desch ,; Del Rosso , Powers , Valentina , and Raffens - perger voting Aye . May - none . The resolution was thereupon declared duly adopted . CODDINGTON ROAD CO,^.• 4UNITY CENTER STORAGE AREA Councilman McElwee reported that the Coddington Road Com� munity Center wants to build a storage area behind the Center and would like to have the permission of the Board to do so . Motion by Supervisor Schwano seconded by Councilman McElwee , RESOLVED , that this Tovm Board extends permission to the Codding - ton Road Community Center to build ; a cinder block accessory build - ing approximately 12 ft . by 16 ft , with concrete floor and frame roof , to be used as a storage area . Schwan , McElwee , Desch , Del Rosso , ' Powers , Valentino , and Ra£ fens - perger voting Aye . May s none . The resolution was thereupon declared to be duly adopted . RESIGNATION - ZONIWG BOARD OF APPEALS Supervisor Schwan read Pars . Laurene Ripley ' s letter of resignation from the Zoning Board of Appeals ( letter dated Febru- ary 28 , 1977 ) 9 Councilman Powers suggested that the press might give some publicity to the vacancy which thereby now exists on the Zoning Board of Appeals . This might be effective in finding a re- placement . RESIGNATION - YOUTH BUREAU Councilman Powers reported that Robert Julian has resigned as the Town ' s representative on the Youth Bureau for the reason that he is going to return to school full time . ROUTE 96 PLMDII17G REPORT ^Ars . Bronfenbrenner reported on three resolutions adopted by the Planning Board at its meeting on March 1 , 1977 with regard to Rt . 96 , ( 1 ) recorrnending that the Town of Ithaca accept the alternates proposed by New York State- Department of Transportation designated as R- 3 to Station 135 and R- 2 from Station 135 to its juncture with existing Rt . 96co ( 2 ) ' stating to the Town Board of the Town of Ithaca that the Planning Board recommends strongly against the implementation of the Alternate proposed by New York State De - partment of Transportation regarding the proposed relocation of Rt . 96 in the Town of Ithaca designated R- 4 , R- 5 , and R- 6 because ( a ) it would disrupt privately owned property , ( b ) offers poor en- trance into Toy►pki.ns County Hospital , requiring left turns , and ( c ) would require further travel to reach the Hospital ? and ( 3 ) recom- mends to the Town Board of the Town of Ithaca against the three alternates proposed by New York State Department of Transportation regarding proposed relocation of Rt . 96 in the Town of Ithaca desig - nated as R- 4 , R- 5 and P.- 6 because of proposed considerable addition- al length and proposed ,, considerable additional cost of these three alternates and because the additional length and additional cost is not justified since there is no apparent increase in benefits . Town Board Minutes - 9 - March 7 , 1977 TRASH-BURNING ORDIN&NCF. Fire Chief Weaver , by letter , has recommended that the Town Board consider the adoption of an ordinance with regard to open burning of trash and refuse . lAfter some discussion it was agreed that clarification would be '+ sought from the CouO.y as to what their regulations are in this connection on a count1T-wide basis . LEARNING VMB Councilwoman Valentino distributed some "' flyers " with respect to the Learning Tleb and its activities . She reported that last year the Town did not give the Learning Web any money direct but did give them its eligibility . The Learning t47eb no longer receives ApOalachian funds nor United Funds , and receives no help from the School District . Councilwoman Valentino reported that there are a substance tial number of Tocan of Ithaca children who participate in and bene - fit from the Learning Web program . Their total enrollment is 162 children , and 33 are Town of Ithaca , 76 from the City of Ithaca , and the rest from the other towns and villages . The City gives the Learning Toleb $ 2 , 500 . Their get ' eligibility fkom the County but the County does not give them any money directly . Councilwoman Valentino recommended that the Town of Ithaca give them $ 1 ; 200 . 00 of its eligibility which is still if and match that with $ 1 , 200 . 00 actual money . Councilman Powers suggested that the Learn - ing Web should be encouraged to get their funding from one source , the County for example , and have the County put it in their budget . ; This would mean all tovms , cities , '', and villages in Tompkins County would be contributing . He said this would be better than coming to each municipality individually for support . He suggested that our County Representatives ought to work on getting permanent fund - ing at the County level for the Learning t+leb so that individual requests will not be received each ° year . Councilwoman Valentino spoke strongly in support of this program , emphasizing that it is a good program for the children * they are being gainfully employed and they are going on to college . Many parents are enthusiastic about the benefits to their children . Councilwoman Valentino recommended , contracting directly with the Learning lleb rather than through the City of Ithaca . There was discussion as to whether the Town could finance this . It appeared there are provisions in the budget to make it possible . P2otion by Councilwoman Valentino. seconded by Councilman Desch , RESOLVED , that the Toom Board of the Town of Ithaca hereby allo - cates $ 2 , 400 . 00 to the Learning Tleb , representing $ 1 , 200 . 00 of eligibility the Town of Ithaca still has available and $ 11200 . 00 of actual monies , and hereby authorizes transfer of $ 2 , 400 . 00 from contingent - account B1910 . 4 to Joint Youth Project B7320 to imple - ment this allocation of funds , Schwan , McElwee , Desch , Del Rosso , . Powers , Valentino , and Raf_ fens - perger voting Aye . May - none . The resoluIt on was thereupon declared to be duly adopted . 37 Town of Ithaca !March 7 , 1977 TRANSFER OF FUNDS The Supervisor explained to the Board that it was necessary at this time to make certain transfers of funds and thv reasons therefor . No report at this time . Town Engineer . Air . Fabbroni reported that the major pro - ject at the moment- i's the proposed contract with the City of Ithaca for sewage treatment and related services . This should be reviewed by the Board and approved at this time , if possible . Councilman Powers suggested that the Board . members study this and be prepared to take action on it on ?'March 8th . Mr . Fabbroni said the Town should be mainly concerned with the paragraph of " intent " . The remainder of the agreement , he said , is for the most part " nuts and bolts . '° There have been six meet - ings with the City on the proposed agreement . Supervisor Schwan noted that this agreement does not preclude ongoing negotiations as they apply to the $ 15 , 000 , 000 expanded sewage treatment plants that the contract is in no way acceptable for the long haul related to that plant . It appeared the Board was not happy with the 20 -year provision . Nr . Fabbroni noted that he , Supervisor Schwan and Coun- cilman Desch have had five or six meetings with the City of Ithaca and this is the best compromise to date .e that there are provisions in the proposed agreement which insure the Town ' s ability to re - negotiate in the future . Highwa.y ' Superintendent . I-1r . Parkin presented to the Board a list of those people in the Highway Department to call in case of emergency , which list is attached to these minutes . Mr . Parkin . reported on the road signing project . Because of the time taken up with the flood last summer , the Town has been given an extension to the end of this year to complete the road ® signing project . Town Board Minutes - li - March 7 , 1977 14r . Parkin reported he needed a new radio system . He wanted to get it in process in time to be set up in the new Town Highway facility . He suggested an FIJI system similar to the County ° s , but not on the same frequency . He asked the Town Board for approval to proceed with this . Ile thought it would cost between $ 5 , 000 and $ 10 , 000 . Councilman Powers suggested that k1r . Parkin research the matter and see if he could pin down the price a little :Moser than $ 5 , 000 to $ 10000 , and then come back to the Board . �hr . Parkin said he would get more particulars and prices . Councilman Powers gave 11r . Parkin some advice and some recommendations with respect to tyre of equipment , frequencies , etc . , and said he would help if he could . Planning Board Chairwoman . Mrs . Bronfenbrenner reported that the Planning Board met with the Tompkins County planners to discuss the Blatchley " road " and they have no objections to elimina- ting it , but it should be considered in connection with Pine Tree Road as the major feeder . Mrs . Bronfenbrenner reported that k1r . Even Ilonkemeyer pre - sented an extensive development plan for the Monkemeyer property at the corner of Icing Road and Danby Road . Part of that is already zoned commercial , and he plans to ' - put in a shopping center . He wishes to have the whole corner zoned commercial . He wishes to have R- 15 land which surrounds the corner zoned multiple residence . The problem is the present zoning ordinance does not permit mixing commercial and residential . 1-4r . T46nkemeyer is thinking of a differ ® ent concept - - combining commercial and multiple in the same build - ing , putting apartments over stores . t-Trs . Eronfenbrenner described Ur . Monkemeyer ° s plans in some detail . The problem is how to deal with this proposal since the present zoning ordinance does not per - mit it . LIr . Buyoucos said the zoning ordinance would have to be amended . There are 30 acres in the shopping area which Mr . ,lonke - meyer wants re- zoned . This matter will continue to be considered by the Planning Board . TRADING ROADS WITH THE COUNTY T�Ir . Fabbroni asked the Town Board to consider authorizing exchange of the Town portion of Sheffield Road for the County por - tion of Renwick Heights ' Road and the County portion of Judd Falls Road from the end of the granite curb north of the jughandle to Forest Home Drive . These exchanges will result in efficiencies in maintenance , snow plowing , etc . Route 366 and Judd Falls Road split -T Intersection has a high volume left turn weave crossing or intertwined with fast moving Route 366 through movements . The accident potential is very high . The traffic volumes , weaves , speeds , turning movements , and roadway capacity are presently operating at levels just short of - traffic breakdown . 2 . Judd Falls Road and Ellis Hollow Road split T- Intersection also has a high volume left turn weave crossing fast moving Ellis Hollow traffic . Fortunately , the situation though hazardous , is not as critical as " 1 . " above because of a greatly smaller volume along Ellis Hollow Road , 3 . Although there is a predominant through movement along Judd Falls Road and Pine Tree Road from Cornell to Slaterville Road , the magnitude of traffic aside from the awkward arrangements of the intersections " 1 . " and " 2 . " above pose no threat to the capacity or safety of existing roads . 4 . The only short range cost- effective solution to the Route 366 and Judd Falls Road intersection would appear to be closing the north leg of Judd Falls Road and installing a traffic signal at the remaining tee but not without a great amount of local re-routing of traffic, and increasing delay on the ever more congested Route 366 . Making the intersection a cross intersection would appear to be economically unfeasible with Cascadilla Creek as a major obstacle . 5 . The short range solutions to Judd . Falls and Ellis Hollow Roads intersection are either to reconstruct it to cross at one point by realigning Judd - Falls Road to the northeast- or. Pine Tree Road to -the southwest OR relocating the . Pine _ Tree Road to the east so as to further separate the north and south legs and separate the required driver responses by a greater time and space . The first alternative would: be the better if it were not for the long range traffic growth and recommended solutions to follow . 6 . The long range traffic projections and existing magnitude and primary destination ( Cornell ) of traffic suggests that further study of the economics of a new two lane road connecting Route : 366 at Caldwell Road ( and Parking Lot B ) to Ellis Hollow Road at the relocated Pine Tree Road as an alternative to recommenda tions " 4 . " and " 5, . " could be a better long range solution . 7 . The worst long range traffic projections indicate a need for only a two- lane road in the Cornell -Slaterville Road Corridor with capacity much as Pine Tree Road south of Ellis Hollow Road now provides . In view of this , the - fact - that travel characteristics such as car occupancy and transit use could well lessen the pro- jections , dollars from outside sources and locally budgeted are few , the proposed corridor is less than 600 feet from existing Pine Tree Road , County " Crosstown " crossing of Six Mile Creek is extremely expensive with local South Hill opposition , the long range solution to circumferential flow around the Town would seem to be needed twenty- five years in the future and should be planned now east of the Town before development outruns that option , the present alignment of the proposed new road between Pine Tree Road and Slaterville Road should be abandoned from the Master Highway Plan as not sensible for improved local traffic flow and misplaced for long range future demand .
