HomeMy WebLinkAboutTB Minutes 1977-03-04 3 / 4 / 77 ELEMENTS OF AGREEMENT BETWEEN CITY OF ITHACA AND TOWN OF ITHACA FOR SEWAGE TREATMENT AND RELATED SERVICES I . Intent This contract will provide for the designated services within the service area as described for all existing and new sewers in the Town of Ithaca for a 20 -year period . Automatic renewal will occur every five years thereafter but the contract is subject to cancella - tion when either party gives notice one year prior to a termination date . It is recognized that in connection with preparation of the Facility Plan under Federal mandate , there are studies being made of the actual costs of owning and operating the sewage treatment plant and that long range negotiations relating to the same costs are ongoing between the City and Town , both of which when completed will require an expanded or new contract which may change the terms of this contract . Further , upon the results of the cost studies either party may request a re -negotiation of the rate structure of this contract to equitably distribute owning and operating costs to all users . II . Area to be Served The City agrees to treat sewage from all areas of the Town which are not now otherwise routed to other treatment works . The four distinct areas are East Hill , South Hill , Renwick Heights , and West Hill , and described herein so that reference can be made to these areas in the contract without further description . a . East Hill Area bounded North by Cornell University Golf Course , OR , as further delineated by Step I identification of the service area for the upgraded sewage treatment plant project in the Facility Plan , East by the Town line , South by Six Mile Creek , West by the City . b . South Hill Area , triangular in shape , bounded Northeast by Six Mile Creek , South by the Town line , Northwest by Inlet Creek . c . Renwick Heights Area bounded North by Route 13 , East Fy�Village ot Cayuga Heights , South by the City of Ithaca , and West by Lake Cayuga ( OR , as further delineated by Step I identification of the service area for the upgraded sewage treatment plant project in the Facility Plan ) . d . West Hill Area bounded North by the Town line , East by Lake Cayuga , the City and by Inlet Creek , on the South by the Town line , and West by the Town line . Modifications to the service area including service to other municipalities will require the approval of both parties . III . Services to be Provided a . Treatment and disposal of sewage collected in existing or any new Town of Ithaca -owned sewers and originating in the area to be served . b . Any conveyance , including any pumping as necessary , through City . 1 M1 AH r 2 c . Minor maintenance , flushing , cleaning and inspection of Town of Ithaca- owned sewers and appurtenances . do operation , groundskeeping , and minor maintenance of Town of Ithaca - owned pumping stations . e . Billing , collection , accounting of user fees . f . Mapping and records of mains , laterals , and ser - vice connections . City will provide central repository for all maps and records . A copy of all maps will be sent to Town and all records will be available for Town use . g . Inspection of service connections . h . Plumbing inspection ( sewer related plumbing only ) . i . The City will make all taps into sewer lines where lateral stubs are not installed as part of initial sewer construction , under a set fee schedule for Town and private contractors . j . Major maintenance , including replacement of machinery or machine parts , pump removal , over - time employment , emergency sewer repairs , and work generally exceeding two man - hours on any one pump station . IV . Services not Provided a . City as contractor of new collection facilities within the Town . Special contracts between City and Town may be negotiated project by project . b . Repair of sewers and appurtenances . City will notify and Town will promptly repair any collec - tion system components that do not meet performance terms . c . Repair , including painting of pumping stations . City will notify and Town will promptly repair . d . Treatment and disposal of sewage originating outside of, the area to be served unless both the City and Town agree with the owner of such sewage to provide the necessary conveyance , treatment , etc . services . V . Payment for Services a . Treatment and Conveyance ( III a & b ) 1 ) Where water meter exists : 1 / 1 / 2 times the rate charged City users for equivalent services . Charges based on cubic feet of water used .per quarter . 2 ) Where no water meter exists : 1 - 1 / 2 times the mini - mum charged a City user for a 1 " water service . Where evidence exists that an unmetered service generates more sewage than would be covered by a 1 " minimum charge , the City and Town will develop an equitable method of charging for the service . - 3 - b . Minor Maintenance , Flushing , Cleaning , Inspection ( III - c ) and Operation , Groundskeeping , and Minor Maintenance of Pumping Stations ( III - d ) : No additional charge . Water for flushing must be available from Town hydrant for this purpose at no cost to City . Town will pay for power and other utilities . c . Major Maintenance of Town Pumping Stations and Sewers ( III - j ) : At cost of materials plus 10 % . equipment at State rates , and labor plus payroll burden ( not to exceed $ 2 , 500 . 00 without Town approval ) . d . Billing , Collection , and Accounting for User Fees ( III - e ) : No additional cost . Town must supply water meter reading data to City for this purpose . Town retains ultimate responsibility for collection of user fees . Town will reimburse City annually as of October 1 for unpaid user fees . e . Mapping and Records ( III - f ) : No additional charge . f . Inspection of Service Connections ( III -g ) : No additional charge . g . Plumbing Inspection ( III - h ) : No additional charge . VI . Other Terms a . Town must have a plumbing code which provides for elimination of storm water and ground water from sanitary sewers . b . Town plumbing code and /or separate regulations must provide for pre - treatment and/or elimination of materials prohibited by City regulation from entering sanitary sewer system . c . Town must actively pursue a program to eliminate storm and ground water from its sewers . 'I d . City agrees to treat all existing and new sewage generated ` in " Area to be Served " during term of contract . e . Town agrees that all sewage generated within " Area to be Served " will be treated by City under terms of this contract . f . This agreement supersddes all existing agreements between the Town and City for the treatment of sewage . g . Nothing in this contract will affect any existing City of Town contracts with third parties .
