gram � � Anti. °° _Recession/Counter Cyclical Fiscal Assistance to State
and Local Governments . He noted it is nor7 necessary to obligate and
spend certain o :. the func? s already received by the Town of Ithaca . It
is not required to hold a public hearing , but a notice roust be pub -
lished v,7hen the Toim has taken action in this matter stating the
specific purpose for which the funds were spent . The Supervisor
recouuciended using the funds for er;fticloyee payroll , including fringe
benefits for year end December , 1977 . The matter was temporarily
tabled for lack of a quorum , Councilman Powers not having arrive at
the meeting . r1,.7hen Councilman Powers appeared. he was briefed on the
discussion . Thereafter the Board acted as followso
'Motion by Supervisor Schwan , seconded by Councilman Desch ,
?12SOLVEDe that this Town Board hereby authorizes the allocation of
Federal AntiP Recession Funds receiver?. in January $ 6 , 236 . 00 ) and April
J .( `2 , 82 . 00 ) plus accrued interest ( $ 62 . 36 ) for the purpose of paying

in the Operating Account and in the amount of $ 95 , 542 . 6G in the

At this point the Town retired into a work ses ,s ?. on to discuss
the addendum to the contract for the five ° area sewer project .

After the work session the meeting was remopeneda
RAILROAD CROSSING SIGNING PROGRAM
The Supervisor referred to a letter from York State
Department of Transportation dated November 21 . 1 .977 requesting
from the Toum a resolution pernitting the State to enter upon
municipal highways and providing for municipal maintenance of the
completed railroad crossing signing project . Supervisor Schwan
described the requested resolution as `° innocuous " . the result of new
Federal regulations , and he recommended that the Town Board adopt
the resolution requestedo The railroad crossing signing project TP7111
be done partly with State funds and partly with Federal funds . The
Board acted as follows .

t^JHEREAS , the New York State Department of ^raps-oortatior_ 7-1a
proposed a Rail ° Highway Crossing Program Project ,, pursuant to Sectio 4
203 of the Federal Safety Act of 1973 as amended by Section 203 of
the Federal Highway Safety Act of 1976 , and
TnroE .. ^AS , the Mew York State Department of Transportation has
notified this Board of the approval of plans and specifications for
such a Rail � Highway Crossing Program Project , for the Rail �° lIiahulay
Crossings which are under the jurisdiction of the Municipality , and
which project is more completely described as the installation of
railroad warning signs and railroad pavement markings ,, and
WREREA, , the New York State Department of Transportation has
made known its intention to advertise a contract for the above des °
cribed improvement and has requested an agreement from the Board to
the effect that it will permit the State , its agents , and employees
to enter upon the highways , roads , and/or streets under the juris -�
diction of the municipality for the purpose of perfornning the above
described improvement .
NOW , THEzREFORE , BE IT RESOLVNE3D That the Town ?hoard of the
Town of Ithaca duly convened in legal session held on the 22nd day
of December , 1977 , does hereby approve of the above described improve -°
men-'C to be performed on the highways , roads , and/or streets of this
,Municipality and noes hereby agree with the State Department of L"rans �
portation that the authorities will permit the State , its agents , and
e7 % .Oloyees to enter upon the highways , roads , and/or streets of the
r .*..rkicipality for the purposes of carrying out the above described
Raila.sigh*,tyay Crossing Program Project , and IT IS FURTHER
PZSOLVE-D ° That the Town Board of this municipality does
hereby agree with the State Department of Transportation that the
1-fnicipality shall retain jurisdiction over the highways , roads ,
alvid/or streets within the project area and hold harmless the State
of New York for any damage to the property or persons of others due
to the performance of any of the employees or agents of the munici �
�4ality , and IT IS FURTHER
RESOLVED ° That upon completion of the above described I?ait --
Highway Crossing program Project , the municipality will main _ ain the
improvement and the highways , roads , and/or streets so improved in
accordance with the New York State Highway Law and the Federal Nigh®
way Safety Acts of 1973 and 1975 and Federal Standards and criteria
in connection with such project .

the municipality agrees to schedule any hightlyay resurfacing so that
it will not obliterate nere.'iy painted markings , excel ')t as E" e --r..°C' Salt3t�C�
by emergency situations t�Thereby resuLfacina is essential to main
taining proper traffic operations , IT IS FUl'THIESp.

fir . Fabbroni asked for authorization to su'Dstitute other more
r appropriate drafting ecauipment for that originally authorized . Fie
r said he would explore getting these materials under State contract .
The Board authorized him to proceed . The materials requested would
still be within the budget .

13r . Fabbroni brought to the attention of the Board an ad in
the paper about the Emergency Jobs Program ( CETA ) and asked the BoarO
if he might submit a bid . He said he could subunit a hid and if the
Board eventually dceided it did not want to be involved with the pro
gran �_t would simply not hire the people . Mr . Fabbroni was author !.? •T�
ed to proceed .
