Schwan , Supervisor Andrew W . McElwee , Councilman Victor DelRosso , Councilman Noel Desch ., Councilman Robert N . Powers , Councilman Catherine A . Fabbroni handed out a tentative timetable for the sewer project to go to construction . He noted that he has used the worst possible dates . He stated that the hope is to start on certain things on March lst , with May lst as the possible outside date . liMr . Fabbroni ' s memo is as follows : " In order that you might respond to questions on the status of the above project ( Sewer Collector Project ) , the following are the projected steps and timetable leading up to the beginning of construction . 1 . Award of Grant - Completed 2 . Signing of Grant Agreement between Town and EPA by designated representative - Completed 3 . Authorization to Proceed with Bids by EPA - ;, Pending , expected within 2 weeks 4 . Preparation of all Bid Documents to Advertise Bids - 2 weeks 5 . Bidding Period to Receive Bids - 45 days maximum 6 . Recommendation of Consultant and OK by DEC 45 days maximum 7 . Execution of Contracts - 3 weeks maximum 8 . Contractor Start Up and Delivery - 4 weeks " So , if the worst conditions prevail , it could be the lst of May before construction starts . But every effort will be made to move this up to March lst if possible . " Mr . McElwee stated that the important thing is that we get ready to bid . He asked Mr . Fabbroni if we could be at the stage of getting bid documents out within a month . Mr . Fabbroni said yes . Next Mr . Fabbroni stated that the Beacon Hills report will be ready by the December meeting with preliminary ;; assessments of struc - tural condition up there so that this Board can decide whether to go ahead with formal action to go with these buildings or have them torn down . Mr . Buyoucos commented that for the purposes of authorizing to proceed it should be determined what the previous authorizations of Town Board - 2 - November 10 , 1977 this Board authorize - - the Board could say either,, or no . He stated that he likes what Mr . Fabbroni is doing in this matter . Mr . McElwee stated that the Town should proceed as quickly as possible with this . Mr . Desch suggested and it was agreed that the Town Board should have an adjourned meeting on the 21st of Novemberat 5 : 15 p . m . to hear a report from Mr . Fabbroni and proceed with authorization . Mr . Fabbroni continued and stated that he has gotten the figures together on the flood damage . He felt that the Town reimbursement should be something around $ 35 , 000 . 00 which includes things rented , our own men ' s times , equipment and all parts of that work that are eligible . Mr . Fabbroni stated for the Board ' s information that there has been a program come . through to Mr . Parkin and him regarding improvement projects for safety of roads that are not on the Federal Aid system . In short , it eliminates many roads that are in the Town of Ithaca , such as Salem , Stone Quarry , Judd Falls , that are part of the Federal Aid system . Under this other program there is aid for roads not pre - sently under the Federal Aid system . He stated that there is $ 45 , 000 . 00 available to the nine towns in the County . He said that this is hoped to be a five - year program . Mr . Fabbroni reported that he has submitted two projects as preliminary projects - - 1 . Snyder Hill Road - - the storm sewering of the ditch on the portion of the road that exceeds 6% which is about 800 ' from just below Sugarbush Lane to just above the crest of the hill for $ 12 , 700 . 00 . This includes the cost of materials , our ownIments time and . eq.uip - ment time . The Town is reimbursed for 70% 6f the project cost . Mr . Fabbroni commented that the Town could handle this size of project . 2 . Mr . Fabbroni said that the other project he ; submitted for , which he said was the Town ' s second choice , was a guard rail on Sand Bank Road in the amount of $ 18 , 000 . 00 . Mr . Fabbroni noted that the thing to understand is that it does involve time for our own high - way . men , but does . not involve any out of . pocket cost . This is Federal money - - no strings attached , however , you have to maintain what you do under these funds up to ,the Federal standards . He stated that there are certain standards for guard rails , however , it is not a much higher level than what we maintain as our standards Mr . Fabbroni also reported that the Town has received Notice that the Lehigh Valley Railroad. is going to abandon 'their line from Freeville to East Ithaca . This is in addition to their abandonment of their line from Freeville to Cortland . Mr . Fabbroni stated that the Town might want to acquire that land as a land bank for the Town of Ithaca . Supervisor Schwan stated that it is important to know if Cornell is going to go back to coal . He suggested that the Town should work with Cornell in the sense that the University may have to revert back to coal fired boilers . Mr . Schwan commented that perhaps the Town should work with Cornell to keep that line available . Mr . Schwan led a discussion of the significance of Cornell University in the Ithaca community . He also commented upon the precariousness of the Federal energy program . Mrs . Raffensperger stated that the L . V . R . R . Freeville to Cortland section has been abandoned and the County Planning Department has been instructed by the County Board of Representatives to look into acquiring it . She suggested that this Board might want to look into acquiring that section also . Mr . Desch noted that there is a " rankingorder " to picking up these abandoned railroads - - State , County , then Town .ir Mr . Schwan reiterated that if Cornell needs the railroad to bring in coal from Ithaca to wherever they would store it , it was his opinion that the Town should support them in obtaining the railroad . Mrs . Raffensperger commented that the Town better get to the County because they are offering $ 100 an acre . Town Board - 3 - November 10 , 1977 °al S Supervisor Schwan stated that if so authorized he will write a letter to the County and the State Dept . of Transportation on behalf of the Town Board stating that the Town supports the holding of that part of the railroad line open if Cornell needs it to ship coal to their heating plant . Mr . McElwee moved that Supervisor Schwan be so authorized with Mr . Powers seconding such motion . There were seven ayes and the motion passed unanimously . Mrs . Raffensperger commented that even if Cornell is not interested , the Town could land - bank that area . Mr . Schwan pointed out that they tear up the tracks which we do not want to happen . Mrs . Bronfenbrenner stated that the people in Dryden object to this line being abandoned . Mr . Fabbroni contined with his report and stated that a committee of five reviewed the applicants for the part - time, planner position . He stated that it was generally concluded that this ,person would do plan - ning primarily and some of the screening committee felt that some help was needed with engineering . He said that a summation of the result is that it was felt that the Town needs both planning and engineering assis - tance . Mr . Fabbroni stated that he would give up summer help and add $ 1 , 000 . 00 to make a half - time position . He suggested Mrs . Barbara Restaino for half - time planning at a salary of $ 5 , 500 . 00 - $ 6 , 000 . 00 , and Mr . Michael Ocello for part - time engineering at a salary of $ 5 , 500 . 00 - $ 6 , 000 . 00 . In his role as Building Inspector , Mr . Fabbroni reported that in October 1977 permits were issued for two one - family homes and three accessory buildings or .additions for a total of $ 104 , 970 . 00 of improve - ments . This compares with one two - family residence , one one - family , three accessory buildings or additions , and one medical - dental building in October of 1976 for a total of $ 198 , 000 . 00 . Mr . Desch referred back to the highway improvement program which Mr . Fabbroni had discussed - - the " safer off - system " - - and stated that he would recommend that before the Board takes any formal action on accepting the funding , he would like to see al resolution of0what to expect on maintenance . Mr . Fabbroni agreed and stated that that will have to be done . The Town Attorney , Mr . James V . Buyoucos , now reported to the Board on the one recalcitrant homeowner in Forest Home , Calum and Norma Carmichael , 109 McIntyre Place . The Carmichaels ' have refused the Town offer of $ 2 , 000 . 00 in return for an easement to construct the sewer line over a portion of their property . Mr . Buyoucos stated that Tommy Miller will do the needed survey . He also noted that we want precision in our description and further that it should be cleared with Lozier Engineers so that there is certainty about the way it should be done . MOTION by Mr . Andrew McElwee , seconded by Mr . Noel Desch : RESOLVED , that the Town Board of the Town of Ithaca render and hereby does render authorization to the Town Attorney to procure survey of easements , both permanent and temporary , to be acquired from Calum and Norma Carmichael by condemnation . There being no further discussion , the Supervisor called for a vote . Aye - Schwan , McElwee , DelRosso , Desch , Powers , Valentino , Raffensperger . Nay - None . The MOTION was declared to be carried unanimously . Mr . Buyoucos now described to the Board a recent amendment to the Open Meetings Law , Chapter 368 of the Laws of 1977 , effective September 11 1977 . Section 93 ( b ) has been added as follows : " Public bodies shall make or cause to be made all reasonable efforts to ensure that . meetings are held in facilities that permit barrier - free physical access to the physically handicapped , as defined in subdivision five of section fifty of the public buildings law . " As Chairman of the Town Planning Board , Mrs . Liese Bronfenbrenner �i , Town, Board - 4 - November 10 , 1977 � 19 ! tD reported that the Town Planning Board held. regular meetings on Octo - ber 18 and November 1 , 1977 . She reported that at the October 18th meeting an adjourned public hearing was held on the matter of the consideration of the public and private alternatives to providing access to individual lots along undeveloped portions of Kendall Avenue and Pennsylvania Avenue . She stated that a motion recommending to the Town Board that the extension of Kendall Avenue and Pennsylvania Avenue be governed under the Section 200 provisions of Town Law was defeated six to one . Mrs . Bronfenbrenner reported that a motion recommending to the Town Board approval of the extension of both roads to form a loop was passed four to three . Mr . Schwan stated that the matter will be put on the agenda for the December meeting . Mrs . Bronfenbrenner continued and stated that the Planning Board Ad Hoc Committee to study the Iacovelli proposal for a multi - family apartment structure on South Hill met and decided to request that the Planning Board not accept the proposal to rezone the area between Juniper Drive and Pennsylvania Avenue to multi - family . The Committee based their decision upon land use and location . The Committee also stated that no additional traffic should be generated for Coddington Road until that road is improved , and that it isiclear that eventually Juniper Drive would be extended to open up the area for home construc - tion and the disapproval of the Iacovelli request does not change this situation . She noted that . the Planning Board is ; holding a public hear - ing on the Iacovelli proposal on November 15th at 7 : 30 p . m . Mrs . Bronfenbrenner reported that two members of the Planning Board whose terms expire on December 31 , 1977 , would like to continue on the Board and the Planning Board is in full agreement - - Montgomery May ( 7 - year term ) and James Baker ( 5 - year term ) . Mrs . Bronfenbrenner noted that their appointment requires Town Board action . MOTION by Mr . Noel Desch , seconded by Mrs . Shirley Raffensperger : RESOLVED , that the Town Board of the Town of Ithaca appoint and hereby does appoint Mr . Montgomery May and Mr . James Baker to the Town of Ithaca Planning Board for a 7 - year term and a ,, 5 - year term respective - ly , it being that both of their present appointments expire on December 31 , 1977 . There being no further discussion , the Supervisor called for a vote : Aye - Schwan , McElwee , DelRosso , Desch , Powers , Valentino , Raffensperger . Nay - None . The MOTION was declared to be carried unanimously . Mrs . Bronfenbrenner continued and stated that the Monkemeyer pro - posals for mixed use on his land on South Hill at the intersection of Danby and East King Roads were discussed by the " Planning Board informal - ly . She reported that Mr . Fabbroni suggested that Mr . Monkemeyer needs to come up with a planned unit development proposal for the whole area . Mrs . Bronfenbrenner stated that the Town Board and the Planning Board should set a joint meeting of these Boards at this meeting . Mr . Schwan asked the Board members for a suitable date for a working session of the combined Planning Board and Town ,, Board to discuss the Monkemeyer proposals . It was agreed by all that such a joint meeting be scheduled for Tuesday , November 29 , 1977 , at 7 : 30 p . m . Mrs . Bronfenbrenner reported that the Planning Board will discuss the Town Park Plan at its meeting on November 15th , Mrs . Bronfenbrenner stated that the Planning Board members would like to know exactly what the Town Board wants them to do with this plan and / or what action they should take or propose . She commented that the " directions to the Plan - ning Board have been vague . Mrs . Raffensperger stated that all the Town Board has asked for is comments from the Planning Board on the 10 - year Park Plan . Town Board - 5 - November 10 , 1977 ELECTION - NOVEMBER 8 , 19776 The Board members discussed briefly the Election just passed of November 8 , 1977 , whereby Mr . Desch was elected Town Supervisor , Mr . DelRosso was re - elected Town Councilman , and Mr . Gust Freeman was elected Town Councilman . Mr . Warren Blye was re - ,11elected as Town Justice , Mr . Schwan declared his full support of Mr . Desch and pledged that he would be most pleased to aid the Town Board in' any and all matters . REPORT OF THE HIGHWAY SUPERINTENDENT Mr . Parkin stated that he had no report at _. this time . Mr . Desch asked Mr . Parkin how he made out with the paving schedule . Mr . Parkin stated that in between the raindrops , their list has been completed . REPORT OF THE TOWN SUPERVISOR Supervisor Schwan offered his farewell to the Town of Ithaca . He said , " At this point you all know me and what I am - how abrasive I am and how outspoken I am . Those are words that the newspaper has used ; I do not particularly care for them . I think I have done a good job for eight years and the voters who elected me agreed with me . I tried very hard . " " Everybody is his own man and that is especially true of me . I am self - employed and responsible only to myself . It is unique and not very many people can say that . In some ways I , suppose I have been too outspoken . " 'U am very proud of what we did here in eight years and I am very proud that Mr . Desch was elected and I am sure that he will do one heck of a fine job in the future . " " I have learned an awful lot in the last ei1ght years about Town government ; I am confident that you will continue governing very well . I will not watch over your shoulder . I am confident in what I leave behind . The things to do that are left behind and the things that will come to be done will be done . We always did the best we could . You have a heavy load . " " I have learned an awful lot and I have learned it at the tax - payers ' expense . Please call me and I will come and give you what I have , what I know . I will not second guess you ; I have no qualms about your being able to govern on your own . " " Eight years was enough ; it was my own decision ; I am tired . Thank you for the experiences of eight years that were something else . I am a very proud man . Okay ? You helped me enhance ° my reputation in this community . Banks respect me . I can go across that street and talk to those bankers and they respect a man named Walter Schwan because I was honest , forthright , and I never stole a penny . " I have four kids and they know who their old man is - that ' s important . It is important that we raise honest , responsible citizens . " " I hope you always care about the Town of Ithaca as much as I did . " Supervisor - elect Noel Desch replied , " I do ' not think there is any - one who has worked as closely with Walter than I , except for maybe Jim ( Buyoucos ) , particularly over the difficult times we have had bringing Bolton Point into reality . The thing we all fail to recognize is the determination , the effort , given by Walt Schwan' - - and it could only have been done by him because of his interest , determination , ability and integrity . He says he could not have done : it without us , but that is not the case . He did it . " Supervisor Schwan thanked Mr . Desch . PROPOSED LOCAL LAW REGARDING CONSTRUCTIVE NOTICE OF HIGHWAY DEFECTS , Mr . Buyoucos stated that he would like very much to have a resolu - tion authorizing that the Town Clerk take whatever steps are necessary to hold a public hearing on constructive notice of highway defects . Town Board - 6 - November 10 , 1977 MOTION by Mrs . Shirley Raffensperger , seconded by Mr . Andrew McElwee : RESOLVED , that the Town Board of the Town of Ithaca shall hold a Public Hearing on Monday , the 12th day of December , 1977 , at 7 : 00 p . m . for the purpose of hearing public comments on a proposed local law regarding constructive notice of highway defects There being no further discussion , the Supervisor called for a vote . Aye - Schwan , McElwee , DelRosso , Desch , Powers , Valentino , Raffensperger . Nay - None . The MOTION was declared to be carried unanimously . ENCLOSURES IN TAX BILLS Mrs . Raffensperger passed out her ideas on what might be possibili - ties as to the kind of materials that could be compactly enclosed in the Town tax bills when they are mailed out . She commented that she is not sure at this point that it is at all accurate , but it should be sufficient for discussion purposes . Mr . Desch stated that it was his opinion that when you summarize , you are in danger of misinterpretation . He suggested a separate mailing . Mr . Schwan stated that he would like to enclose a sheet showing the amount of sales tax revenue put back into the County - - this reduces the County rate to the Town of Ithaca . Mr . Desch ;commented that he is concerned about the validity of the information . A lengthy discussion followed among the Board members as to the kind of ' information a Town taxpayer might need . Mrs . Raffensperger asked that the Board address the question of whether her suggestion for informational enclosures is a valid proposal or not . Mr . Schwan proposed that the Board consider this matter further on November 21st , ' 1977 . The Board agreed . ANNUAL AUDIT MEETING , TOWN BOARD - DECEMBER 30 , 1977 , 11 : 00 A . M . MOTION by Mr . Walter Schwan , seconded by Mr . Noel Desch : RESOLVED that the Town Board of the Town of Ithaca shall hold its Annual Audit Meeting on Friday , the 30th day of December , 1977 , at 11 : 00 a . m . There being no further discussion , the Supervisor called for a vote . Aye - Schwan , McElwee , DelRosso , Desch , Powers , Valentino , Raffensperger . Nay - None . The MOTION was declared to be carried unanimously . AUTHORIZATION FOR JUSTICE WALLENBECK TO ATTEND JUSTICE SCHOOL MOTION by Mr . Noel Desch , seconded by Mrs . Catherine Valentino : RESOLVED , that the Town Board of the Town of Ithaca authorize and hereby does authorize that Justice Merton Wallenbeck attend Justice School in Syracuse , New York , on the following days : 11 / 18 - 11 / 19 , 1977 ; 11 / 25 - 11 / 26 , 1977 ; 12 / 2 - 12 / 3 , 19776 There being no further discussion , the Supervisor called for a vote . Aye - Schwan , McElwee , DelRosso , Desch , Powers , Valentino , Raffensperger . Nay - None . The MOTION was declared to be carried unanimously . Town Board - 7 - November 10 , 1977 p� PUBLIC HEARING : " FIRE CONTRACT WITH CITY OF ITHACA Proof of posting and publication of notice of public hearing having been presented by the Deputy Town Clerk , to consider the re - newal of a contract with the City of Ithaca , the Supervisor opened the hearing . Since no one appeared to speak for or against the renewal of the contract , ^ the Supervisor closed the hearing , and the Board acted as follows : MOTION by Mr . Andrew McElwee , seconded by Mr . Robert Powers : RESOLVED , that the Town Board of the Town of Ithaca approve and op hereby does approve the renewal of the fire contract with the City of Ithaca in the amount of $ 136 , 500 . 00 for the year 1978 for fire protec - tion in the Town of Ithaca , excepting the following areas : ( a ) the Village of Cayuga Heights , ( b ) the area comprising all the territory lying between the east boundary of the Village of Cayuga Heights and the east boundary of the Town of Ithaca , and ( c ) the Hamlet of Forest Home exclusive of the structure housing the Cornell University Filtration Plant . There being no further discussion , the Supervisor called for a vote . Aye - Schwan , McElwee , DelRosso , Desch , Powers , Valentino , Raffensperger . Nay - None . The MOTION was declared to be carried unanimously . PUBLIC HEARING : FIRE CONTRACT WITH VILLAGE OF CAYUGA HEIGHTS Proof of posting and publication of notice of public hearing in the matter of renewal of contract with the Village of Cayuga Heights for fire protection having been presented by the Deputy Town Clerk , the Supervisor opened the hearing . Since no one appeared to speak for or against the proposed renewal , the Supervisor closed the hearing and the Board acted as follows : MOTION by Mr . Andrew McElwee , seconded by Mr . Robert Powers : RESOLVED , that the contract with the Village of Cayuga Heights and the Town of Ithaca , at the contract price of $ 23 , 000 . 00 , whereby the Village of Cayuga Heights agrees that its Fire Department will furnish fire protection for the year 1978 in the Hamlet of Forest Home and in that portion of the Town north of Forest Home and between the east boundary of Cayuga Heights and the east boundary of the Town of Ithaca , be renewed . There being no further discussion , the Supervisor called for a vote . Aye - Schwan , McElwee , DelRosso , Desch , Powers , Valentino , Raffensperger . Nay - None . The MOTION was declared to be carried unanimously . PUBLIC HEARING: LIGHTING DISTRICTS AND WATER AND SEWER IMPROVEMENTS Proof of posting and publication of notice of public hearing to consider assessment rolls and apportionments for lighting districts and water and sewer improvements having been presented by the Deputy Town Clerk , the Supervisor opened the hearing at 6 : 41 p . m . Supervisor Schwan stated that this involves additional lights other than those at intersections . Mr . Schwan explained the lighting districts budget and the Town of Ithaca policy of lighting intersections only . Mr . Willis Hilker asked who it is that says that these lights are in working order . Mr . Schwan stated that NYSEG maintains the lights . Mr . Hilker reported to the Board that the Burns Road intersection light is out and stated that this is a haphazard way of keeping these things going . He commented that they ( NYSEG ) have their trucks on the road all the time . It was commented that they do not work at night . Mr . Desch stated that it might be worthwhile to write NYSEG a letter . Mrs . Raffensperger agreed and suggested that perhaps the Board could communicate with NYSEG the Town ' s concerns about lights that go out Town ' Board - 8 - November 10 , 1977 ,; after dark . She noted that if the trucks are only out in the daytime , NYSEG may not be aware that a light is not operating properly . Mr . Schwan pointed out that the lighting districts do not relate to intersection lights and asked the Board to refer to page 10 of the preliminary budget before them . There being no further comments from the floor , Supervisor Schwan declared the Public Hearing on the lighting districts closed at 6 : 47 p . m . MOTION by Mr . Andrew McElwee , seconded by Mr . Walter Schwan : RESOLVED , that the Town Board of the Town of Ithaca approve and hereby does approve the assessment rolls and apportionments for the Forest Home Lighting District , the Glenside Lighting District , the Ren - wick Heights Lighting District , and the Eastwood Commons Lighting Dis - trict for the year 1978 and the budgets related thereto . Aye - Schwan , McElwee , DelRosso , Desch , Powers , Valentino , Raffensperger . Nay - None . The MOTION was declared to be carried unanimously . At 6 : 50 p . m . , Supervisor Schwan opened discussion on the water and sewer improvements portion of the above - noted public hearing . Mr . Schwan explained the budget item - - the total revenues , benefit charge , indebtedness and referred the Board to pages 11 , 12 , 13 , 14 , 15 , 16 , and 17 of the preliminary budget before them . Supervisor Schwan noted that the sewer debt is all bonded . Mr . Willis , Hilker asked in reference to the $ 80 . 00 hook- up charge for Bolton Point water , where this revenue is incorporated in the budget . Supervisor Schwan stated that it is not - the money goes to Bolton Point . There followed a discussion of subdivision development and the supplying of water and sewer piping . Mrs . Raffensperger pointed out that on page 17 of the preliminary budget , Summary , it is not clear that Bolton Point is what is meant by " water supply bond payments " . Supervisor Schwan stated that that will be made clear in the adopted budget . Mrs . Raffensperger continued and noted also that there is no relationship ' shown between the Bolton Point benefit levy and the Town levy . Supervisor Schwan stated that another sheet will be added to the final budget . There being no further comments from the floor , Supervisor Schwan declared the Public Hearing on the water and sewer improvements closed at 7 : 06 p . m . MOTION by ; Mr . Walter Schwan , seconded by Mr . Andrew McElwee : RESOLVED , Ithat the Town Board of the Town of Ithaca approve and hereby does approve the assessment rolls and apportionments for the Town of Ithaca water and sewer improvements now operated by the Town as a Town -wide function , for the year 1978 , and the budgets related thereto . There being no further discussion , the Supervisor called for a vote . Aye - Schwan , McElwee , DelRosso , Desch , Powers , Valentino , Raffensperger . Nay - None . The MOTION was declared to be carried unanimously . PUBLIC HEARING : PRELIMINARY BUDGET J Proof of posting and publication having been presented by the Deputy Town Clerk of notice of public hearing on the approval of the Preliminary Budget as the final budget of the Town of Ithaca for the year 1978 , the Supervisor opened the Hearing at 7 : 08 p . m . Supervisor Schwan stated that the Board should consider the Town - Wide budget first , followed by the Part - Town in which the matter of a Town Constable is included for consideration . Supervisor Schwan led the discussion and went over the budget page by page and line by line . Supervisor Schwan explained each item in detail to the public and to the Board . . Town- Board - 9 - November 10 , 1977 There being no one wishing to speak for or against the adoption of the Town - Wide portion of the preliminary budget , that portion of the public hearing was declared to be closed by the Supervisor and the Board acted as follows : , MOTION by Mr° . Andrew McElwee , seconded by Mr . Noel Desch : RESOLVED , that the Town Board of the Town of Ithaca adopt and hereby does adopt the Town - Wide portion of the Preliminary Budget for 1978 as the final Annual Town -Wide Budget for the fiscal year beginning January 1 , 1978 , as amended . There being no further discussion , the Supervisor called for a vote . Aye - Schwan , McElwee , DelRosso , Desch , Powers , Valentino , Raffensperger . Nay - None . The MOTION was declared to be carried unanimously . Turning now to the Part - Town budget , Mr . DelRosso stated that he thought that thelitem shown on Page 5 as " Town Policeman " should be termed " Town Traffic Control " . He stated that he is not sure that the Town should be getting into the police business , and , further , if Town traffic control is needed that is what it should be addressed as . Mr . Willis Hilker stated that he raises strong objections to a policeman - - the Town should utilize what police forces are already available . Mr . Hilker requested that the Town Board delete that figure ( $ 17 , 000 . 00 ) totally from the budget . Mr . Joel Silbey stated that he would take an absolutely opposite position . He stated firmly that the Town needs a traffic control officer . He stated that those townspeople who live in the effected areas are not being protected by the Sheriff nor by the City of Ithaca police . The Town must provide this protection . Mr . Gust Freeman , Councilman - elect , stated that he has knocked on a lot of doors during the campaign and found a great deal of interest in a Town policeman . Mr . Freeman stated that the item is in the budget and it is proposed - he suggested that the item should be left in the budget and should be worked with . Mr . Anthony Schultz , City of Ithaca police officer , stated that he would prefer that the item be termed a " traffic control officer " as opposed to a policeman . He suggested that that would eliminate a pro - blem as to scope of duties . This person , he . said , is not going to be functioning as a peace officer ; the Town wants a traffic control officer . Mr . Hilker stated that it was his understanding that the Town cannot limit the duties of an officer . Mr . DelRosso stated that he did not think that the Town Board has decided on his duties . He stated that this item does not necessarily mean the hiring of a peace officer . Traffic control is the needed item - - this can mean a traffic control officer , signs , stop lights , etc . Mr . Hilker stated that if what Mr . DelRosso has described is the intent of the item , he would be in favor of it . Mr . Silbey commented that highway signs will not do the job , nor will good wishes . Supervisor Schwan stated that he has not heard from anyone that is in favor or a Town policeman . He commented that once the four - way stop was put in on Hanshaw Road and Warren Road , we have had no complaints about speeding . Mr . Schwan suggested that a four - way stop at Pine Tree Road and Honne,ss Lane might prove equally effective . Mrs . Raffensperger stated that she did not think that the problem is as isolated as that . It was her opinion that the whole Town needs some increased visibility of a Town traffic control officer . Mr . Desch stated that he agreed and said that he had heard this all over Town . Mr . DelRosso stated that he thought the question is whether to leave Town - Board - 10 - November 10 , 1977 ` 4 $ 17 , 000 . 00 in thePart - Town budget or not = - not whether the Sheriff can handle the job presently . Mr . McElwee felt that the Town should give the matter a try and then judge how it works . Mrs . Valentino wondered what percentage the Sheriff had estimated would be the time , devoted to actual traffic control . Mr . Schwan stated that the Sheriff had indicated to him that 400 of an officer ' s time would be in actual traffic law enforcement and the rest of the time would be all those other kinds of matters that the Sheriff handles such as noisy disturbances , dogs. , break - ins , etc . Mr . Desch stated that he agreed with Mr . DelRosso - - the Town has a problem and the Town has to deal with it . He said that he thought that $ 17 , 000 . 00 is a sensible figure and further that the people will be involved in traffic control . Mr . DelRosso , stated that he felt he must make it quite clear that he is not advocating a police officer . He stated that he is willing to have the item in the budget , but he is not sitting at this hearing and advocating that the Town hire somebody to run around Town in a car writing traffic tickets . If that is the case it should be left out . Mr . DelRosso stated that he would vote for the item only if it be termed " Town Traffic Control " . Mr . Schultz suggested that one way to handle traffic is through a Sheriff ' s department deputy . He pointed out that the Village of Trumansburg experimented with a deputy in their village and it did not work out for any number of reasons and they went to their own police force . He suggested that it would be well to talk to them and see how they are doing under this situation . Mr . Freeman stated that he too agreed with Mr . DelRosso and added that the problem is there - - the item has to be in the budget and now is the time . Mr . Hilker stated that the only objection he has is that the people may not have an opportunity to get Uack to the Board with input after this meeting since there is no requirement to have a public hearing to spend anything approved in the budget . Mr . Powers stated that there seems to be general agreement that the $ 17 , 000 . 00 should be in the budget and since we are here to discuss the budget and not how each item should be expended we should approve the incorporating of that amount in the budget for traffic control . Mrs . Eva Hoffmann stated that she would like to see this item remain in the budget . Mr . Silbey stated that the people of Forest Home feel very strongly that signs do not work very well . He said that the Town is facing a very serious problem . The Town is a major suburban community . He said that the Town Board cannot just put an item in the budget and then not bother to implement the item . There being no one else wishing to speak for or against the Part - Town preliminary budget and the Town -Wide portion of the budget already having been approved , the Supervisor closed the public hearing on the adoption of the preliminary budget for 1978 as the final budget for 1978 at 7 : 56 p . m . , and the Board acted as follows : MOTION by Mr . Myers : Cornell s 1 y planning the construction of a library storage building in its orchards area about 1200 feet from Dryden Road . Because of values and hazards inherent to its occupancy we must sprinkler the risk . To do so requires a reliable source of water . There is none in the immediate vicinity other than the 16 inch transmission main of the SCLIWC . Since this main is within 500 feet of our proposed site we would like permission to tap in an 8 inch main for fire protection purposes only . I UNEMPLOYMENT INSURANCE - DISCUSSION OF DIRECT PAYMENT OPTION The Board having before them a proposed resolution in the matter of liability of the Town of Ithaca for contribution for unemployment insurance and the' method of making such contributions prepared by the Town Attorney , Supervisor Schwan led the discussion on said proposed resolution . Supervisor Schwan stated that there are two options open to the Town - - 1 . Pay 3 . 770 x $ 6 , 000 for each employee in the Town of Ithaca on a quarterly basis . 2 . The direct payment option which is basically that for every $ 300 earned by an employee in any given quarter the Town is obligated for unemployment ', insurance , except high school students , although in connection with high school students if they are hired for the summer after their graduation and then they cannot get a job , the Town is obligated . Supervisor Schwan suggested that the Town should adopt a resolution electing the direct payment option as it relates to unemployment insurance and compensation because the Town ' s exposure is so small that it is practically„ zero , with the exception of Mr . lBonnell . Town. Board - 13 - November 10 , 1977 7 .b Mr . DelRosso commented that a resolution of adoption of an option could be rescinded . Mr . Schwan agreed as long as Labor Department is notified before the end of the year . MOTION by Mr . Andrew McElwee , seconded . by Mr . Noel Desch : WHEREAS : A . ) The Legislature of the State of New York by Chapter 675 of the Laws of 1977 which become effective January 1 , 1978 has amended the Labor Law of the State of New York relating to unemploy - ment insurance and compensation in many respects , and B . ) A governmental entity is defined in such act as an employer and included in the term governmental entity is a municipal corporation or other governmental subdivision which appears to include the Town of Ithaca and thus makes the Town liable for the payment of contributions as , an employer , and C . ) The act grants a governmental entity the option to elect to make „ payments either as regular periodic contributions or by payments in lieu of contributions as the occasion for them . arises under the aforesaid Act , NOW THEREFORE , it is resolved as follows : Section 1 : The Town of Ithaca elects to become liable for pay - ments in lieu of contributions as of the first day of the calendar year in which liability of the Town commences , such payments to be made in accordance with the provisions of the aforesaid Act . Section 2 : A written notice of this election shall be filed with the Industrial Commissioner in accordance with Section 565 of the Labor Law as' amended by the aforesaid Act . Section 3 . , This Resolution has been adopted on the assumption that the aforesaid Act requires municipalities such as the Town of Ithaca to make contributions for unemployment insurance payments as an employer under the Labor Law . DISCUSSION OF ADOPTION OF RESOLUTION OF OBLIGATION OF FEDERAL REVENUE SHARING FUNDS Supervisor Schwan distributed to the Board members material outlining the Federal Revenue Sharing Funds received , obligated and remaining to be obligated and his recommendations for their obligation . The first part of the discussion centered upon the obligation and spending of Federal Revenue Sharing Funds for the Town Highway Facility , with the Board acting as follows : MOTION by Mr . Walter Schwan , seconded by Mr . Andrew McElwee : RESOLVED , that Federal Revenue Sharing money obligated and spent for entitlement ' periods July . . 1976 through . April 1977 is hereby obligated and spent in the amount of $ 89 , 146 . 00 , including interest accrued , on the Town Highway Facility . The MOTION was declared to be carried unanimously . Town Board - 14 - November 10 , 1977 Supervisor Schwan stated that the Town Board held a public hearing on Revenue Sharing a month ago at which public input was sought and received . Supervisor Schwan referred to the material he had distributed and noted that there are $ 22 , 271 . 00 of the July 1977 entitlement period and $ 22 , 945 . 00 of the October 1977 entitlement period in hand in Certifi - cates of Deposit ' because they could not be obligated . Supervisor Schwan recommended that the projected Federal Revenue Sharing funds be , allocated in the sum of $ 179 , 000 plus interest to Bolton Point for the Borrowing , amounting to approximately $ 185 , 000 . Supervisor Schwan outlined at length the reasons for this recommendation at this time being , in part , underestimation of certain costs involved in running a water system , the New York State budget crunch , the default of New York City in certain cases , interest costs on bonds . Mr . Desch asked if in going this route will the taxpayer of the Town ultimately pay less in terms of interest costs . Supervisor Schwan described in detail the impact of such an allocation of revenue sharing funds upon the Town taxpayer . Mr . Desch commented that in other words , the answer is " y,es " to his question . A discussion followed of the various aspects of revenue anticipation notes and their requirements . Mrs . Raffen' sperger reminded the Board that about two months ago this Board passed the $ 179 , 000 borrowing and at that time was assured that the Bolton Point levy could pay this amount back within two years . Supervisor Schwan agreed that he had so stated the case at that time . Mr . Powers , noted that the Supervisor seems to be suggesting that the Town just forget this $ 179 , 000 and never ask for it back . Supervisor ' Schwan stated that he was saying that for the next five years they ( Bolton Point ) simply will not have it . Mr . Powers asked if the Supervisor were saying that the other municipalities have bought the concept that they are going to have to raise the money without Bolton Point ever paying it back ? The Supervisor indicated that the other municipalities were not unaware of this possibility . Mrs . Raffensperger stated that she did not quite understand how that two months ago the Town Board authorized this $ 179 , 000 borrowing on the basis that it could be paid back from _. the revenues . of Bolton Point and now the Board is told that they are unable to do so . Mr . Powers supposed that two or three months ago was before the Commission put together the budget . Supervisor Schwan stated that that was the case . Mrs . Raffensperger stated that she had seen the Bolton Point budget and saw no place for repayment of the borrowing in it , so she was already curious . Supervisor Schwan stated that the budget was drawn up before the NYSEG increase , for one example , and he stated that in all honesty it may not be worth the paper it is printed , on . Mr . McElwee wondered if there would be any possibility of accumulating water surplus . Supervisor Schwan said " no " - - not at the rate we are getting the bills from Bolton Point - - it is a lot more than the City costs . Supervisor Schwan stated that he firmly believes that the Town should commit enough revenue sharing funds for 1977 , 1978 , and part of 1979 to Bolton Point . He pointed out that the Town of Ithaca is 65 % of the operation . Mr . Powers stated that he missed the informational meeting on revenue sharing that the Board had some time back when the Board approved the use of the revenue sharing funds to buy the Town Hall . He stated that he still agrees with the decision made at that time , but that he w , , Town Board - 15 - November 10 , 1977 did not think it was very well explained to the public . Mr . Powers stated that he was in agreement with Supervisor Schwan , but that he would like to see some means of expressing the way in which the Town Board arrived at this decision , if it should arrive at it . Mr . Powers stated that there are a lot of people who have a lot of things that they want to do with revenue sharing . Mr . Powers said that he thought that the Board should be much more careful in explaining what it is doing . Supervisor Schwan stated that he agreed and suggested that the Town Board could have a public informational meeting on the 12th of December , 1977 , at 8 : 00 p . m . and further suggested that an advertise - ment could be placed in the newspaper requesting public input . Super - visor Schwan stated that he nonetheless must recommend . that the Town Board obligate the July 1977 and October 1977 revenue sharing funds toward the pay - off of the $ 179 , 000 and that the Board obligate the 1978 revenue sharing funds and part of the 1979 revenue sharing funds to pay off this amount . Mr . Desch stated that he thought that the point should be made that the taxpayer will benefit in not having to pay this interest . . Mr . Schwan noted that it must be paid off within two years , Mrs . Raffensperger asked if it were true that there is a $ 25 . 00 charge for a new customer under a required hook- up policy that will increase to $ 250 . 00 ten years from now should they not hook up until that time . She noted that this is separate from the $ 80 . 00 which covers the meter installation process . Supervisor Schwan stated that this increasing charge was considered at one time for customer hook - up ( connection charge ) and discarded , there being no prescribed method for such a charge . Mrs . Raffensperger commented on there seeming to be a financial gain for developers who own undeveloped land to which water and sewer could be available since he only is charged 10 per $ 1 , 000 . She added that she thought at that time that the connection charge would be a better way . Supervisor Schwan stated that he re - read the law and it would appear that there cannot be a connection charge because the Town cannot create any new districts . It appeared that the Board agreed that a public informational meeting to consider the obligation of Federal Revenue Sharing funds would be held on December 12th . BOLTON POINT WARRANTS MOTION by Mr . Noel Desch , seconded by Mrs . Catherine Valentino : RESOLVED , that the Bolton Point warrants dated November 10 , 19771 after review by the Town Board , and upon recommendation by the Southern Cayuga Lake Intermunicipal Water Commission that they are in order for payment , are hereby approved in the total amount of $ 31 , 459 . 03 , being $ 27 , 062 . 34 for 0 & M and $ 4 , 396 . 69 for Construction . McElwee stated that he had been asked by Judge Blye about the improvement he had requested be made to the area in which his desk is situated , that is , a raised dias . The Board agreed that Judge Blye should go ahead with implementing the construction of a dias according to his needs but that the billing for same should be rendered after January 1 , - 1978 . Mr . McElwee also brought up the question of a request from the Highway men for some sort of cover for the voting machines . This matter was unresolved . Mr . McElwee stated on behalf of Mr . Fabbroni that a starting date for the two part - time assistants in Planning and Engineering should be authorized by the Board . The Board members agreed that Mr .
