Councilwoman RaffensDerger said her personal notes with regard
to the Meeting of March 7 , 1977 indicated that after the resolution
( on p . 4 ) to conduct a public hearing to consider the acdotption of a
_-joca. l Lana known as ' Refunds , Sewer and T-later Assessments in Certain
,:rases °' : and the subsequent abandonment of the resolution ;, Councilman
{esch had offered to devise a resolution as a substitute for the
7 •ropose�? local law , till ch would establish a Town policy that citizens
requesting ,a waiver of water and sewer benefit assessments for an
apartment ( based on special circu^ stances ) would be notified of the
Board ' s decision . She said Councilman Desch had suggested that assess •
ments night be waived if the kitchen plumbing were disconnected and.

and that the omission in the minutes should be corrected .

Councilman Desch said he would draft language with regard to
the removal of kitchen facilities for consideration at a subsequent
meeting of the Board .
BIDS ON RADIO COM URIICATIOPI
SYSTEM FOR THE TO.,r.1 HIGHWAY DEPARTN. -TT
kr . Parkin , Highway Superintendent , asked the Board to hold
a special meeting for consideration of bias on a radio communication
system for the Highway Department . The Board agreed and set the date
as September 26 , 1977 at 12 : 00 noon .

Fall Clean y2 Day ° Mr`. Parkin recommended that October 25 r l9
be designated as Fall Clean °Up Day for the Town of Ithaca . The Board
agreed and the Town Clerk was -instructed to have announcements appear
in the Ithaca Journal and on radio . `
InventorX�, of Highway Fcnainment . The Tov�m Board accepted the
Inventory of Hi0h ay machineryo Tools and Equipment As prepared by
Air . Parkin . The said inVentbry is attached to these minutes .
Mr . Parkin recommended the purchase of a new loader in 1978 .
The present loader is about 15 years old . it appeared that funds are
available for this purchase .
Councilwoman Raffens er g er inquired as to the status of paintgy
ing lines and sighing Stone Quarry Road and the signing of Christopher
Circle and mowing of grass ih that area . Mr . Parkin said the striping
has been completed on Stone Quarry Road , that the signs are on order ,
and when received will be §et in place . Signs for Christopher Circle
will be delivered in four to six weeks and will be set in place when
received . The Highway Department is mowing for the second time in
the Christopher Circle area .
Councilwoman Raffensperger inquired about the paving schedule
and the Ellis Hollow Road pedestrian walkway , r .r . Par3 iii' sa10 he has
not done the Ellis Hollow Road pedestrian walkway because of the con-
struction taking place in the area . He said the present condition
of the area would destroy any paving done at this time . He recom�
M=ended putting this off for now and doing it the last thing of the
yelar . Anything put in now would be ` ruined , he said . Councilwoman
zaffensperger said if it is not paved , it will be completely unusable
n the winter . She recommended that `° some kind ` of paving job be
c? one . P2r ,, Parkin said he would do it before the end of the year .

TO LA OJT ROAD ( PENNSYLVANIA AVENUE )
Town Attorney Buyoucos again outlined the. procedural steps
required for extended construction of Pennsylvania Avenue . He then
read the proposed `0 Application for Permission to Acquire Lands " signed
by the Town Iaighway Superintendent . He read also proposed " Resolution
for the Acquisition of Lands for Highway Purposes . 17e noted that
the application carries with it a map of the area ( Schedule A ) and
a list of the na_rles of persons in the area having an interest in this
matter . :?e noted that the Town has an understandinex that the road ,
if constructed , will be constructed at the e��pense of (Millis B . Hilker ,
Developer . This understanding will be formalized in vrriting .

area and hazard from , motorcydies . He said 'young children cannot be

area of the ToTAM . He said the area he lives in is readily accessible
for fire equipment , even in Minter . Rr4 PlArtin Said the area is a
very nice one which is likely to become a slum if the road is built
and housing is developed . He said houses could be built even without
extending the road . A road would create an unfortunate traffic pat ®
tern , he . said .

Councilman NcElwee suggested a cul -de � sac as an alternative .

1, r . Milker said that building in the area and the area itsF-211:
has boomed . But the increase in traffic is to a considerable extent
due to people who are swimming in the dam illegally .
tlr . Berkey asked if there was a rationale for putting the road
in at all . 11r . Buyoucos said that was what they were meeting to deter
mine . Supervisor Schwan said if it is left undeveloped people will
not be able to get mortgages and will not be able to build . At this
?tune , he said , the purpose is to get input from the people who live

Supervisor Schwan suggested proceeding with the authorization ,
�: . ., in the meantime the Town Ir'ngineer could investigate the possibilitq=
o a cul �de ° sac ( as suggested by Councilman r?cElwee ) , and if there is
a reason for putting the road in completely . Councilwoman Raffensper °
qGr said she was having difficulty in judging what percentage of the
People in the area want a road . She said it is difficult to act in
the public interest sunless one knows what percentage of the people
�.7ant the road . Councilman Desch said that until there is a concrete
proposal , it will be hard for the people who live in the area to judge
t•r lether it is in their interest . After there is a definite inite proposal ,
then there should be a public hearing . At this point , Nir . Buyoucos
saidF thent that he recormiended that the Board should not adopt the
proposed resolution . f?ith this resolution the ToUm would be taking
on the cost of the survey . Should the Board adopt this resolution ,
it would be determining that it is in the best interest of the Town
to construct the road and that the Town ISighs,+Tay Superintendent is
authorized to proceed .
In the discussion it developed that even though the road is
not constructed , people could build ( without henenfit of a mortgage ) .
Mr . Buyoucos noted ,, hcwevex , that there is an additional difficulty ,
in that according to T,Jv %n maw a build in? permit shall not issue un -
less the property fronts on an improved highcraay ,

Supervisor Schwan inquired of the Tovm Attorney whether
there was in law a vested interest in the highway because of the old
Ithaca Lana Company subdivision of nearly a hundred years ago . ir .
Buyoucos . said" that when one buys . a lot according to a map such as the
Ithaca Land Company map , if the deedl settinj forth the property shows
a particular lot ; the title is granted .. up to the center of the road ,
but .. subject., to the right of others .to use that road , It means that
other people can : dr.ive over it . Where - is an- implied easement given
to everybody . in ` accordance with the ^ Ithaca L` and Corn. any :lap . That is
general law in the State of Nevr . 'Yokka > If on the other hand , the deed
shows . the property described by metes and bounds , then the owner does
P own to the center of the road o III' 0 ;s why deeds must be looked
at to , determine exactly what they' say . A bank makes a judgment as to
whether or not there is stffidient ' security for its loan .
Mr . Buyoucos said that by adopting the proposed resolution
the . Board . would. be determining t iat the . Superintendent of F` igh*r-lays
may proceed . He has , the " ball " and he can cone hack and say we have
acquired the title . to this roadI. , Councilman' Desch said heAfelt the
Board needed a design document rather than a rough .map It would
show what
is cr * in& to be builte The Board has no such document at
this time , Mr . Buyoucos said tine Board - would - have a survey made by
a surveyor ; showing a0 ft . strip . That is all the Board would have ;,
with land. marks on it so there is a definite indication of! where the,
Ithaca Land Company " subdivision `' is . There might also be . an indication
of tA7ho owns property on either side of the road . Councilman Desch
said he contemplated something considerably more formal than that .
Helen Phillips , Executor Johanna Baker Estate ( Tot #; 35 ) e
252 Pennsylvania Avenue . I want to say something . EIere s how
i this whole egg carton got broken . I owned Lot # 62 bought in 1947
from the Pardo Estate . After my husband died Dominick Capozzi
drilled a well on my lot and I was in debt , and they told me they
would sue me for the well . I was pushed to sell . Capozzi never sur �
veyed the land . When I owned it , it bordered Pennsylvania Avenue .
Our lots were surveyed by Crandall from the Ithaca Land Co . map (my
father ' s estate , my mother ' s , my husband ' s so to speak ) . This Can
ozzi built the house which the Perrys now reside in . Capozzi called
it private and wouldn ' t let anyone go back in there and when you did
go in there they threuT stones at you . I have written letters , talked
to supervisors ( this was in Harry Gordon ` s time ) . There have been
too many " tomorrows " and nobody has ever done anything about it .
`here was no courtesy in answering telephone calls . You cannot get
into the lots . It is narked ` Private Property - Do Not Enter . `r. This
is what Pennsylvania Avenue is and this is where the whole can of
worms is crawling . And that is thel
truth , My address is 252 Pennsyl �
vania Avenue . Tle bought our house in 1940 and I have owned the lot
since 1925 . These lots are in the name of T,7ilbur Baker , Lots 35 and
(my mother ' s lots ) . The Perrys have got it marred " Private " . The
.' uhultz lots was rzy parents ° home , Aly folks bought it in 1920 . I
have lived there ever since then . Howe everybody comes in - - Capozzis ,
Martin , living in what they built and no one has ever surveyed that - ®
they just put the sta'jkes where they want and claim it . And this is
what the wThole can of worms is . I have an abstract and survey ( in

31e to question by RX . Buyoucos ) .
Mr . Buyoucos stated that the Town of Ithaca cannot prevent
anyone from putting up a " Private " sign unless it ( the Town ) acquires
title . 'Ie said that was probably why kir . Gordon could not do anything
for Hrs . F1. ins , since it is not a public road .

road going through . I have a persona reason . Back in 1971 we owned
lots down in there . = .•?rote to Mr . Tee ( Jo oardznan ) asking if we
could build doxc7n there . Mr . Lee said we could not because there is
no road . "

Mr . Buyoucos told Pars . Baker that with regard to any inquiry
made to an attorney and which he has answered , she right :setter speak
to him . He said , however , he would° be glad to discuss the natter w;,. -u1-1
Fir . Lee if Mks . Baker wished .
Pars . Baker said she did not understand cxyhy there was a possi -
bility of a road going through now Thich could not go through in 1971
when she made inquiry .
P-ir . Hilker , by way of reply to JvIr . Martin said he had built
on eight parcels - - nice , single - family residences . They have taken
two lots together to make a propersized lot . He said there is no
slum atmosphere . He said he t7 %ou�;1,1.t that in all cases the houses he
had built had upgraded the neighborhood . He said if the road is not
extended they would have to build on the lots without bank mortgages
( by getting money from other sources ) . Mr . Buyoucos said there was
still the building permit to be considered . Mr . Hilker said his ap -
plications for building Permits were turned down . He described then
as " in llimbo . " Mr . Fabbroni said the permits have been denied be -
cause a permit cannot be issued on a lot that does not front on a
public street , except by variance of the Town Board or the Zoning
Board of Appeals .
Ax . Hilker said essentially their lands in this area are
worthless until the mown has acquired the road . He said they have
agreed to improve the road . They have put quite a bit of money into
the other end of Kendall Avenue , with road base and culverts . I've
agreed with Mr . Martin that people ' are driving down in the area to
swim , but this was going on before , but much more so noes . He said
as long as the Town does not have title , it can do nothing to police
the area . If the Town were to own the property , people could be re ��
quired to keep off . The Sheriff would then have authority to remove
them . Now there is no control .
Mr . 14artin said the area has not been improved at all . it is
crowded . It looked *such nicer before , he said . Mr . Plartin said this
is not a downtown neighborhood . It is a beautiful area . He said
most of the change in the area has been recent and it will have a
Collegetown `° atmosphere . P,8Tr .

complaining . There are others , including Pars . Schultz .
Councilman . Desch said he tl ouc,Thtthere is a lot more to learn
about this mattere Therefore ,
1 -7tion by Councilman Deschs seconded by Councilwoman Paffensperger ,
RESOLVED , that the proposal to extend and improve Pennsylvania Avenue
be referred to the TOTP.m Planning Board who are hereby charged with
the responsibility of investigating the need for such extended and
improved road and of considering the timing of the proposed resolution
to permit the Town Highway Superintendent to take appropriate steps
to acquire lands for the laying out of the said proposed Town high -
wayc
Councilman IvIcEluree asked what the Planning Board could do
for the Town Board . Councilman Desch said they can evaluate traffic
patterns ,; zoning of vacant land , the subject of timing , and whatever
they might find desirable to investigate . Councilwoman Haffensperge
said she t.aould like to see the Planning Board do some kind of survey
of the percentage of people in the area supporting the road and also
look into the irzpact the road would have on the placement of the
houses . Councilman Desch said that were the road to be completed
the situation with respect to drainage would be different ; the drain -

The Supervisor said the Town should also assess its liability
with respect to the payment of water and sewer benefit charges , since
the people who live in this area are paying full water and sewer
benefit charges . Other areas of undeveloped land are being assessed
on an acreage basis rather than frontage . This is the only area
of that total " paper " subdivision that is billed for water and sewer
based on frontage on a road .
After this discussion , the 'Board voted on the motion as
followso ' Desch , Valentino , HcElwed , Paffensperger , and Schwan all
voting Aye. : Mays _ none .
This matter will be an agenda item on October 10 , 1977

The Town_ Clerk reported that Mrs . Elizabeth Fa 'nbroni , 234 Enfield Falls Road , is available to serve as Dock Enumerator for the
Town of Ithaca for 1970 . The Board acted as follows
Motion by Supervisor Schwan ; seconded bi Councilwoir.an Valentino ,
RESOLVED , that misi Elizabeth Fabbroni , 234 Enfield falls Road , is
hereby appointed Dog Entriierator for the Town of Ithaca for the year
1973 .

After discussion , it was agreed that the Dog Enumerator will
distribute a copy of the Dog Control Law to each dog o<rmer at the
time of enumeration . Councilwoman Valentino will discuss with 111r .
Brothers of the SPCA the possibility of designating an individual
as tog warden .

Due to an error in meter reading , the Board acted as follows °

RESOLVED , that a refund of Tr7ater charge in the amount of $ 36 . 25

Due to the fact that information on a special reading and
me re.cioval was not forwarded to the Ithaca office , resulting in

late charge penalty on second quarter 1977 water billing . The two
previous quarters billings having been based on on estimated use ,

ship had been !created in this particular case because of previous
estimated quarterly billingso Wherefore the Board acted as follows .

REVENUE ANTICIPATION NOTE REST OLUTION
Town Attorney Buyoucgs presented a pre ' ared resolution with
regard to the Town of Ithaca ', s . share in the Bolton Point borrowing .
This matter having been discussed before , the Board acted as follows
Motion by Supervisor Schwan' . *, seconded by Councilman. Desch ,
RESOLVED
Section 1 . The Town � oar d of the t''6iirn. of Ithaca hereby
authorizes the issuance of .a . revenue anticipation note or notes in
an aggregate amount not ti exceed $ 18G , 000 . 60e
Section 2 . Such note or notes shaa . ie issued' in anticipation
of the collection and receipt ;. of revenues : other . than real estate
taxes or assessments , specifically revenues „ incluUincg water rants ,
from the sale and distribution of YJeter. . t6 consumers in said munici °
pality , which are due and 'payable in and for the fiscal year 1977 .
Section 3 . The full faith and credit of the Tovtn .of Ithaca
is hereby pledged to the punctual payftent of and. interest on any and
all notes issued pursuant hereto .
Section 4 . The power to authorize the issuance of and to
execute the above notes ; including any ren6wal of such notes , is
hereby delegated to the Chief Fiscal Officer of the Town of Ithaca .
Such notes shall be of such form , contents and terms and shall be
sold in such manner as may be prescribed by said Chief Fiscal Officer ,
but subject to the provisions of this resolution and consistent with
the provisions of the Local Finance : Law .

REPORT OF COUNTY REPRESENTATIVES
sirs . Livesay reported that an insufficient number of appoint®
;.gents have been made to date to the„ County Youth Bureau Board , and
County Representatives are now urging all municipalities to mare their
appointments . The Supervisor said it would be wise initially to have
someone from the Town Bloard represent the Town of Ithaca , for good
reporting and liaison . Councilworian Valentino indicated she was wil -
ling to serve in this capacity , at 'least temporarily .

RESOLVED , that this Town Board hereby appoints Catherine Valentino to
represent the Town of Ithaca on the County Youth Bureau Board , it

Mxs . Livesay reported that the ' Poard of Representatives is
beginning to receive many change orders on the Hospital construction .
She said the building is now about 4a% completed and they are 1,eithin
budget . She did not have a dollar figure on authorized change orders
at hand .
Bars . Livesay said that at the next meeting of the Board of
Representatives they will be asked to accept bids and complete work
on the Airport project . She said any in -put on this matter will be
appreciated . She noted that complaints are beginning to be received
about Airport parking ,
Mrs . Livesay , upon question by the Supervisor , described
different CtTA categories of employment ° OJT training programs ,
temporary employment , jobs of limited duration , ( for example , a park
study ) . Jobs when completed ends CETA employment . She said these
programs are not necessarily " make -work " programs . They represent
legitimate needs .
Supervisor Schwan said his concern was that people hired
under the CETA program may not understand that when the program is
concluded , their jobs are fiftished , ' unless funded in some other way .
Tars . Livesay said it should be made clear to every CUTA employee that
the work may be temporary . She said the program also contemplated
the possibility that a government or business would , after a time
find that the CETA employee was valuable enough or the employment so
changed t'_'_=tat the CETA employee would be retained even after the CETA
program was terminated . It was the hope that the CETA program might
result in more jobs in the community .
Mrs . Livesay said there is another program which is not used
as much as it should be - - the Work Relief Program of the County
Social Services Department - - people who are on income maintenance
are supposed to work if they are employable . If they refuse a job
their payments may be terminated . The Social Services Department
continually needs a source of jobs which they can put people into .
The Supervisor said the County would be advised if job opportunities
arise in the Town of Ithaca .
PROPOSED USE OF REVENUE SHARING

Proof of posting and publication of notice of public hearing
on this natter having been presented by the Town Clerk , the Supervisor
opened the hearing .
The Supervisor said this hearing has to do with the alloca -
tion of Federal Revenue Sharing funds for the Entitlement Period
October 1 , 1977 through September 30 , 1975 . The amount to be alloca -
te;? for that perioo is $ 94 , 132 . 00 . The money will be received in
four eaual payments , roughly every three months . It is now required
that aaproposed use hearing be held prior to the submission , on
October S , 1977 ° of the tentative budget of the Town of Ithaca to
the Town Board . This hearing , today , therefore , meets that require -
ment . The other legal requirements for this hearing have been met .
The actual allocation in the Town budget will be made on
'November 10 , 1977 , after public hearing . The Supervisor noted that
a change in the 'Law niakzes it possible now to use Revenue Sharinq
funds for interest payment ; as well as principal payments . For the
rest , he said , the guidelines are not much different than formerly .
The money can be used for any lawful Town purpose . The Supervisor
asked for public comment regarding the use. of Federal Revenue Shar -
ing funds which will be available ,

intended to use some Revenue Sharing . funds for the seviering project ,
particularly Forest Home . He asked whether since the Town has applied
for a grant for the sewer project , it intends to proceer"i with that

Mr . Berkey said it is terribly important to get a feel for

what they see as . our 'most important , needs . He wondered if the Torm
would share the data , pr6 uced by that survey . ?fir . Fabbroni , Town
Engineer , said the. 1? mary function of the survey, had to do with
transportations The , other portion of the . 'survey ' had to do with 13
categories MM - including police and fire protection , environmental
protection , bikeways , parks , drainage , water and sewer . . The people
had difficulty with this portion of the survey and in many cases did
not respond . It appears they misunderstood the ranking system . AMr .
Fabbroni said the response on the transportation survey was good ,
over 30o . response . Only about 1 , 000 people answered the portion of
the survey having to do Erri_ th the 12 categories . 11 ^ . Berkey indicated
he thought that was considerable in -put and hoped a summary of that
information would become available . It could become the basis for
this and future allocations , he said .
Mrs . Livesay said transportation is a primary need and she
wondered what eras being done in this regard . By transportation she
said she meant to include bicycle and walking paths (modes of trans-
portation ) so people can move about safely . Roads are becoming more
and more congested . With the increased use of bicycles and the in -
crease in the number of joggers , the impediment to getting around by
car is increasing . !zany people , she said , are beginning to be resent°°
ful of bicyclists and baby carriages . She said her children who Maw
cycle a lot are subjected to that . " Roads need to be improved and
there is need for public transit . A transit study was made by Prof .
Arnim H . Mleyburg , she said , and she wondered what the status of that
study was . "Iro Fabbroni said Prof . FKieyburg did a special study , cov �
ering the area from Lansing to Cornell University , but he has never
e ©rnpleted it . The study covers different phases and groups ( socially
and economically deprived , etc . ) and the different modes ( i . e . call a ®
cab , etc . ) . There does not , however , appear to have been any activity
on it in the last two years .
Fars . Livesay felt that some pressure should be exerted to
pry loose some of those studies and that the Town should institute
some studies of its own . She said the Town of Ithaca has two probam
lems , ( l ) movement of its people going to jobs and school and ( 2 )
migrations through the Town from other areas . 14ost of the transporvw
tation is not generated within the Town itself . She said , " It is
people who have to get across the Town to get to what is on the other
side . "
Councilman Desch said that when the Planning Board and Town
Board met in joint session in the spring , the priorities were parks ,
traffic control and drainage , and that at that meeting the group used
some of the survey data compiled by Mrc Fabbroni . In connection with
traffic control , the subject of enforcement of speed regulations was
high on the list of priorities . These priorities are corning through
loud and clear , and should be rated high for the use of Revenue Sham
0 ng funds . Water and sewer extensions to areas not now served was

another . priority group . People on Stone quarry Road have complained
of a lack of water . Another priority grouping , Councilman Desch said ;
is the passage of the new zoning ordinance and revision of the sic. n
ordinance . He said the items here enumerated by him appear to be , in
the minds of members of the Town Board and Planning Board the top
priorities , based on a sense of what the people .want , gathered from
a number of hearings .
Joel Silbey , 105 ;Judd Falls Road . We : feel very strongly ,
my neighbors and myself that traffic control is - : one specific thing
which must be chosen as . tie . first item ° 6 1%lot everybody , however , who
' lives in Forest Home and the . Judd Fails Road area believes there is a
traffic problem `° Councilman' McElwee said . he believed it .
Mr . Silbey suggested'. hiking a Town . Constable , including a
patrol car . He said this would be a beginning .. in solving the Town of
Ithaca ' s major problem . He said Revenue Sharing funds coulu be used
for this and there would be money left over for other things as well .
The Supervisor said the government does nbi: recommend paring any
salary or fringe benefits out - Of ReVende Sharing for the reason that
if Revenue Sharing is terminated , the muAidibality assumes the expense
which must fall on the taxpayers . You must id6k to the end of the
entitlement period , and hope the funds will be continueds otherwise
the cost of the man or men hired wl ]. l become a dart of the Town budget
and will require an increase in the tak rate .
Mrs . ICit Lambert said that Sheriff Howard said he could put
an extra man on the County staff for a specific use of the Town of
Ithaca for under $ 20 , 000 a year . The Mari would be trained and would
have a car' and uniform . If this 'were done with Revenue Sharing funds
and the funds should be terminated , the Town could then either raise
the money from taxes or another source , she said . She said the Town
ought to experiment to find out if this would be a benefit . Super-
visor Schwan said this might succeed if the man is assigned exclusive°
ly to the Town and if he is not cared away on other matters which
would detract from his effectiveness in traffic control .
There was some discussion of costs and the hiring of a con -
stable as against contracting with the Sheriff ' s Department . Traffic
control was discussed , and largely in terms of Forest Home , Pine Tree
Road , and East Ithaca generally . Councilman Desch noted , however ,
that traffic control is not limited , to these areas . There are pockets
of difficult traffic situations throughout the Tocpmn , and this condi -
tion will increase .
Mfrs . 11argaret naksford suggested tying law enforcement in
the Town of Ithaca to other agencies to improve it in the Town . She
said the Sheriff is spread too thino The Cayuga Heights " fuzz " she
said , are probably the most effective group because they have a smal -
ler territory to cover .
MXs . -Eva Hoffmann said she had an impression from Sheriff
r'c 1'arc`l that he thought he had enough people to control traffic in
ItChacao They might be able to do some intensive patrolling in an
a - ea , and then move on to other areas so that people would notice
-Mr.' get a feeling for that . She said the Sheriff depends to a great
on people calling in . If there were enough complaints to sub -
st- antiate the need for more people , he would get more people . He
also said it would be perfectly legal for the Town to contract with
theirs .
Sul:)ervi. sor Schwan said the Town Board is aware that it is
legal . The problem is xrhere the man is going to be located and how
long he will stay in one Place * fle said Cayuga Heights Police Chief
Harlin iticEiyen and Ithaca Police Chief James Berson are of the opinion
that any such person will spend 20 % of his time enforcing speed limits
and the other 80 % taking other binds of calls . The Supervisor did not
feel that one man would be very effective . He felt more than one per -
son would be needed .

? r . Silb ey said he and his neighbors conceiver, the constable
as someone not just confined to one ° area of the Town . He said the
success of law enforcement in the Village of Cayuga Feights rests on
the fact that the people know that there is " someone " there . Ile said
the Town of Ithaca should have whatever number of men is possible , but
that a start should be made . &se said he preferred that it be under
the control of the Town , but , in any event , he believed that just
having a man there , and if it is well publicized that he is there ,
would have a favorable impact on speeders .
Mr . Berkey said he agreed with much of what was said , but
that he had some specific suggestion 's , particularly for the Uortheast .
He recommended taking some main roads leading into Cornell University
area and ektehding the shoulders ok these roads to provide room for
jogging , walking to work , bicycling , etc . He said it is a terrible
safety hazard to ride a bicycle on Marren Road ( partly the drivers °
fault and partly the bicyclists ' fault ) . He said this is a real prob°
lem and that the Town should look into it because if the energy crisis
gets worse , the price of gas will go up , and more people will want .
to ride a bicycle to work . 11r . Berkey mentioned that there are repair
problems on Town roads holes in the roads which need repair .
Slr . Berkey said the dehsity in the Northeast would appear to
warrant a frialmass transportation system . He suggested running a
bus through the heavily populated area of the Ndrtheast . He said ,
however , that costs are so hic�' h . today that the Town should not embark
on any more major projects eiich kill drive the taxes higher . This is
a real concern , he said , for people : on fixed incbines . He emphasized
that the Town should not embark on a program which will result in large
tax increases . Lastly , he said , the Town should look into recreational
facilities in small areas . DeT^Jitt Park has promise , if it is properly
handled . Some money , he said , ( probably $ 30 ~, 000 ) should go into that .
Mr . Berkey hoped the in -put received at this meeting and the
in -put received on Mr . Fabbroni ° s survey will be seriously considered
by the Board .
Councilman McElwee noted that with regard to roads and road
improvements , most of the roads coming into the area are County roads
and that is where a great deal of the complaint should be directed . a
to the County . Dire Fabbroni said there are certain members of the
County Board of Representatives who are receDti,ve to the idea of
cooperating with towns in road improvements . tdrs . Livesay._ said she
I-67ould appreciate some request from the Town for cooperation with the
County in the matter of traffic control and the enforcement of speed

Councilman Desch asked Mr . Berkey if the people who had com-
plained of inadequate road repairs had called the Highway Superin ®
tendent . Mr . Berkey said he had no ; knowledge of that . He did say ,
however , that it should not be difficult for the Highway Superinten =
dent. to ':now when secondary roads need repair .
Mrs . Livesay said she had conversations with the Sheriff and
he says he has enough manpower to p.�ovide all the traffic control the
Town of Ithaca needs . She suggested that the Tovm Board appoint a
Committee of people who are keenly interested in this problem , people
from different areas of the Town , to work with Sheriff Howard to see
if some system can be developed to control traffic . She said the
Sheriff is genuinely interested in helping towns with their problems
if he knows ,that the problems are . This would be an opportunity , she
said , to determine the Sheriff ' s reliability . firs . Livesay said she
was advised that where a municipality contracts for additional traffic
control , that the person so assigned may not withdraw any of the ser -
vices contracted for . The municipality would get 100 % of the time
contracted for . Councilwoman Valentino said it would he necessary to
identify what percentage of the Sheriff ' s calls are currently in the
Town . Firs . Livesay agreed -� � that zt would have to be `' in addition "
to what is currently being furnished .

disagreement about what ,4rras legal and possible , the matter was refers

road would require a, storm sewer to handle the drainage . Re6 said the
Town would be faced with expense of about $ 10 . 00 - a front foot to begin

resurfacing them ; and all the d' her things involved . Supervisor Schwan
said it might be possible to tlrgrk with the County Board ° that they
might fund part of these improvements and the Town might fund wart of
them . Councilman Dosch noted that County/Totim± cooperation has worked
out well on Pine Tree road which was widened and is now much safer .
Supervisor Schwan said there is much " homework " to be done . on
this problem . He said according to Mr . McEwen and IIr . Herson , that
as soon as a Town police force is established or police protection is
contracted for , the man or men hired will immediately start assuming
responsibilities for all the calls now being taken by the Village of
Cayuga freights in the Town of Ithaca , by the County Sheriff , and the
City police , and the Campus Patrol . He said the Town might achieve
" visibility " in the sense that the Man or men are there , but how much
of their tire will be used for traffic control . He said the Village
of Cayuga Heights is not interested in expanding their police force
in order to contract with the Town of Ithaca . There is a legal prob-
lem in that a police protection district cannot be formed under Town
Law , that is , protection for only one section of the Town ( the North
east , for example ) . It appears the only tray is to contract with the
County Sheriff and see hoer it works out . Counciltiroman Raffensperger
reminded that there was discussion of the possibility of asking for
special legislation to make it possible to have a police protection
benefit district . y

excess oa income over expense . He asked if he were to assume this

address the construction fund. . It was agreed among the municipalities

Mrs . Bronferihrenner felt the Town of Ithaca meetings should
be better covered by the Ithaca Jou=naaj that the ^'ovm seems to be
at the " bottom of the heap , °° Councilwoman Raffensperger noted also
that the Ithaca Journal was asked to publicize this meeting on the
use of Revenue Sharing .funds wherein nearly $ 100 , 000 allocation of
Revenue Sharing funds would be discussed . The Ithaca Journal only
managed 4 lines in a most inconspicuous location in the paper , and
then only on Monday , the day of the '' meeting , rather than Friday or
Saturday as promised . The radio stations dick publicize the meeting .
Councilwoman naffensperger , in view , of the responsibilities of munici -
palities under the Open Meetings Law , wondered if the news media did
not have some obligation to male available to the public information
made available to them . Town Attorney Buyoucos said the Town could
not act as a censor of the media . The Town Board can protest . Roe
said the newspapers will say they reserve the right to print what
they see fit to print . They are only obligated to print the public
legal and other notices which the Town pays for . 4r . Buyoucos said
Councilwoman ' s Rafffensperger ° s point , hoVyever , is well taken . He
said the obligations of the newspapers , and their responsibilities ,
and the constraints put upon them have been the subject of controversy
for many years . Councilwonan Raffensperger felt the Town should make
a formal request to see that the Town receives adequate coverage of
its meetings and that important items of business are publicized prior
to the meetings . The Town Board made no formal resolution at this
time . However , the Supervisor said he would be in contact with the
Ithaca Journal on this matter .
PARIN C0111ITTEE REPORT
Councilwoman Pzffensperger reported that the Coy Glen package
and the Park Policy are complete and are at the printers ' . They will
be available for the October 10th meeting . The Lick Brook report is
incomplete . It has been delayed because of the need for some tech -
nical help which was not available during the summer . It will be com®
pleted in the next month or so .
On September 6 the Park Committee discussed provisions of a
tentative development , including possible priority , programming and
cost schedules . Some revisions were made and that revised report
will be available for Town Board members far a work session , perhaps
on September 26th at 12 00 noon . The Planning Board will also be pro ®
vided with copies so they can consider the plan and present their
comments and ideas to the Park Committee .
The Park co^.mittee contemplates asking the Town Board on
October 10th to schec.0 e a public information meeting to Present and
aiscuss with the public the revised , development plan and other park
Plans . `
Tovm Board Ilinutes 15 September 12 , 1977
The Park Committee will attempt to put all the comments to �
gether and present a revised development plan for the Town Board for
a Town Board resolution of intent , which would then become a part of
our Park Policy and could then be included in any -grant request .
Councilwoman Raffensperger said that when the Coy Glen pac;:�
age is received , the Park Committee will contact the residents of the
area . Other Town Board members will be enlisted in that effort .

Councilwoman :?affensperger said that the Park Committee will
attempt to cchtact Cornell University in reaarc� to the Bike Path for
East Ithaca .
The Northeast Devitt Recreation Committee has made some
alterations to the plan for that site in Tesponse to some concerns
o£ local residents . Councilwoman Raffensperger said Mx . Fabbroni
will complete negotiations with the ',, School District on a maintenance
agreement. She said she will discuss with , the DeWitt PTA Boarrd late
in September how they night support this( e fort 'with the School Board .
Regarding . the maintenance contract 111r . Fabbroni said he met with Per .
Paul Butler: and it dirk riot appear there would be any great expense ,
provided the School District will maintain the grass , foliage and
leaf clean -up . The Towri Could maintain the pond on a t,,Yo or three
year clean-up basis and could re - surface the tennis courts when neces -
sary , with another such surface in another five or ten years . The
Town would solicit the token help of the Tillage of Cayuga Heights
to line the tennis courts and the Town of Ithaca would maintain the
fence once it is in place . This appeared to be an acceptable split
of responsibilities between the Totem and the School District . 11r .
Berkey suggested that BOCES might help . He suggested contacting Mr .
Thomas 14ahoney , Director of Education at BOCES .
Councilwoman Raffensperger said the Park Committee has a
tentative request for $ 30 ; 000 from Revenue Sharing for park projects
which she hoped would be considered '. The Park Committee has made a
line budget request this year for on-going studies of $ 3 , 500 , which
approximates the money allocated for this purpose during the year in
bits and pieces .

Lawrence P . Fabbroni , Town Engineer Building Inspector
Easements . Obtained all but one in Forest Home . Expects
to have all Coddington Road and ElmllStreet with only two or three
reMaining in each area . Regarding Slaterville Road , expect to have
most of them by the end of this month . When the Federal grant is re °
ceived , it would seem to be in the west interest of the Tovm to adver �
tise for bids as soon as possible . " September 30 , 1077 is the deadline
for the grant on this five ® area sewer project . The Supervisor agreed
that this is. a favorable time for advertising for bias and bonding
a.nd that tine is of the essence . „
Town HighxATay Facility . I?r . Fabbroni noted that the original
cost estimate InTas P190 , 000 . Change llorders have amounted to an addi �
tional $ 3 , 000 ( which is really quite low ) , compared to the norm .
Change orders sometimes run as high ; as 100 . Mro Fabbroni presented
the Board with an itemized list of expenses ( attached to these min
utes . )

with. respect to this job . VIr . Fabbroni said that the salary on a

He said , however , that for the present at least 20 hours a week might

Mrs . Bronfenbrenner reported that a public hearing was held
to consider the request of Johann Gebauer and others to rezone from
Residence District R-• 15to multiple Residence Districtv that portion
of the Town of Ithaca generally bounded by the City of Ithaca , Ithaca
College , an old railroad right of way back lot east of Coddington Road ,
and the Coddington Road entrance to '"' Ithaca College .
A number of . residents from the neighborhood spoke at the
meeting . A petition , bearing 21 signatures , ' , was presented to the
Board . The petition was in opposition to the zoning change . One
resident , Zrs . McFall of 235 Coddington Roads stated that she did not

know it was illegal to rent to more than ; three . unrelated people at
the time she was cited for violation . it was brought out in the dis �
cussion that Mr . rj ebauer knew that he was it violation of the Zoning
Ordinance when he constructed additional. units , Ntc . Fabbroni , at the
Planning Board meeting , presented a ' map that showed that the majority
of , the dwellings in the area were fancily occupied °
The Planning Board passed , d , " motion denying the proposed . zoning
change . An amendment to the motion stated O " that spot rezoning
by special permit or variances be discouraged . "
Mrs . Bronfenbrenner said a brief discussion of the sign ordi -
nance followed . . A special . committee to re -write the ordinance was
formed , members to be Bob Bonnell 11- onty May , . and Henry Aron . The
Committee members said they would , appreciate in °put from members of
the Town Board about. desired changes for the Sian ordinance .
Mrs . Brontenbr` enner reported. that two m6mbers ` O£ the Planning
Board attended the Town of Dryden Pianhihq Board meeting on August 18
at which the Lucente proposals for additional houses in the Sapsucker
toloods area were discussed . The Dryden board members would like assist"
ance from the Tom of Ithaca in solving the traffic problems at the
intersection of Sapsucker and Hanshaw Roads . Traffic ,. drainage , and
school overcrowding were the main issues of discussion . The under
lying fear seemed to be that the new units would , in fact , become
multiple resident units instead of family homes , as stated in the
request for approval .

needs a new member to replace Bill Reece . The following names have
been suggested to her , she saida Prof . George Cosler of Christopher
Circles Prof . Bernard Stanton of Sandra Place , Arthur or Enid Ruoff
of Texas Lanes and Albert Cappucci of Christopher Lane .

The Board discussed again the problem arising out of request
for construction permits by Mr . Lucente near the Totem of Ithaca line .
=3ineteen units on Meadowbrook accepted by Town of Dryden Planning
Board feed into Toiam of Ithaca sewer . There is concern whether the
Town of Ithaca can take this additional sewer . Councilman Desch recom--
cnde " that the Supervisor write a letter to the Town of Dryden advis -
inc; them that no connection can be made to the Ithaca sewer without
an agreement with the Town of Ithaca .

Supervisor Schwan recommended that the Town Board adopt a
resolution which will authorize thejCounty Treasurer to utilize for
1978 the Town of Ithaca ' s share of Sales Tax to reduce the Town ' s
County taxes outside the Village of Cayuga Heights ,

The Beard discussed the function of the assistant to the
Toirm Engineer . It was the sense of ',ithe Board that the activities
of the assistant to the Town Engineer should be confined to those
functions originally prescribed .
Torun Board Minutes - 19 - September 12 , 1977
The Board discussed the line of authority between the Town
Engineer and the Highway Superintendent . No specific deterrn.ination
was made except that they should work together as closely as possible .
Councilman Desch noted that with all the changes taking place
in state lava and the fact that the Town is becoming involved with BOO
and EPA applications , and the fact that the affairs of the Town are
becoming generally more complex , it would appear there is now a need
for a Town controller . The Board discussed whether this would be
a full or part time job . No specific determination was Made in this
respect at this time . However , it was agreed that Councilman Desch
would prepare a job description and this matter tprill be discussed
again when that description is available .
