Re: NYSERDA Clean Energy Communities Grant
As previously discussed,the Town is eligible for a $50,000 grant from the New York State Energy Research
and Development Authority (NYSERDA) under the Clean Energy Communities(CEC) program.The grant
application is due June 19, 2018. Projects must be started within six months of award notification and be
completed within three years of contract execution.
The attached resolution finalizes the selection of projects that will be proposed in the grant application..
Additional information on these projects is presented below. Please note that listed costs are early
estimates and it is very possible that CEC funding amounts for individual projects will be different than
indicated below, although the total amount of grant funding used ($x0,000) will not change.
1. Electric Vehicle Charging Stations at Town Hall
Estimated total project cost: $x,000
Estimated CEC funding used: $5,000
Purchase and install two electric vehicle charging stations for use by plug-in hybrid electric vehicles and/or
battery electric vehicles in the Town Hall fleet.These charging stations could also be made available to
Town employees, and even the general public, although Town staff has voiced concerns about the latter
which should be addressed first.
2. Plug-in Hybrid Vehicle for Code Department Fleet
Estimated total project cost:$30,000
Estimated CEC funding used: $15,000
Purchase a new plug-in hybrid electric vehicle (P'HEV)for the Town Code Department.Grant money could
be used for just the incremental cost between a conventional vehicle and a PHEV (estimated $5,000) or for
a larger portion of the car cont. Money is already budgeted for two new code cars to be purchased, one
each in 2018 and 2019.
3. Public Works Facility Office Addition Upgrades
Estimated total project cost: Unknown
Estimated CEC funding used: $30,000
Construct the Public Works office addition to comply with the proposed Ithaca Green Building Policy.
Energy improvements could include solar PV, high efficiency space and water heating systems, and/or other
items.Although the GBP is not yet written into law, the Town can use this project to test the proposed
energy standards, from both the developer perspective and the codes/permitting perspective.

TB Resolution 2018-xxx: Authorize proiects for NYSERDA Clean Energy Communities
Grant Funding
Whereas the Town of Ithaca has been designated a Clean Energy Community for
completing 4 of 10 high-impact actions and is now eligible to submit an application for$50,000
of project funding to NYSERDA to support sustainability projects; and
Whereas the three recommended projects will support GHG reduction strategies
identified in the Comprehensive Plan and the Government Energy Action Plan; and
Whereas Town staff has received positive feedback on the three recommended projects
from the Town's CEC grant program contact; now therefore be it
Resolved that the Town Board authorizes Town staff to submit a grant application to
NYSERDA for 1)Electric Vehicle Charging Stations at Town Hall, 2) a Plug-in Hybrid Vehicle
for the Code Department Fleet, and 3) Public Works Facility Office Addition Upgrades, and be it
further
Resolved that the Town Board will accept all grant monies awarded and authorizes the
Town Supervisor to execute any agreements or documents associated with same.

TB Resolution No. 2018 - Setting a Public Hearing regarding a proposed Local
Law to Override the Tax Levy Limit Established in General Municipal Law §3-c
Resolved that the Town Board of the Town of Ithaca will hold a Public Hearing
on July 9, 2018 at 5:30 p.m. regarding adoption of a local law to override the tax levy
limit established in General Municipal Law §3-c, for the fiscal year beginning January 1,
2019 and ending December 31, 2019.
Notice of this public hearing shall be published in the official newspaper not less than 5
days prior to the hearing.

LOCAL LAW NO. FOR THE YEAR 2018
A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED
IN GENERAL MUNICIPAL LAW §3-C
Be it enacted by the Town Board of the Town of Ithaca as follows:
Section 1. Legislative Intent: It is the intent of this local law to override the
limit on the amount of real property taxes that may be levied by the Town of Ithaca,
County of Tompkins pursuant to General Municipal Law §3-c, and to allow the Town of
Ithaca, County of Tompkins to adopt a town budget for (a) town purposes, (b) fire
protection districts, and (c) any other special or improvement district, and Town
improvements provided pursuant to Town Law Article 12-C, governed by the Town
Board for the fiscal year beginning January 1, 2019 and ending December 31, 2019 that
requires a real property tax levy in excess of the "tax levy limit" as defined by General
Municipal Law §3-c.
Section 2. Authority: This local law is adopted pursuant to subdivision 5 of
General Municipal Law §3-c, which expressly authorizes the Town Board to override the
tax levy limit by the adoption of a local law approved by vote of at least sixty percent
(60%)of the Town Board.
Section 3. Tax Levy Limit Override: The Town Board of the Town of Ithaca,
County of Tompkins is hereby authorized to adopt a budget for the fiscal year 2019 that
requires a real property tax levy in excess of the limit specified in General Municipal
Law §3-c.
Section 4. Severability: If any clause, sentence, paragraph, subdivision, or part
of this Local Law or the application thereof to any person, firm or corporation, or
circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or
unconstitutional, such order or judgment shall not affect, impair, or invalidate the
remainder thereof, but shall be confined in its operation to the clause, sentence,
paragraph, subdivision, or part of this Local Law or in its application to the person,
individual, firm or corporation or circumstance, directly involved in the controversy in
which such judgment or order shall be rendered.
Section 5. Effective date: This local law shall take effect immediately upon
filing with the Secretary of State.

RE: Public Hearing/Consideration of Rezoning Tax Parcels#31.-2-6 (Portion of) and
31.-2-28—617 and 619 Five Mile Drive
Enclosed please find materials related to the proposed amendment to Chapter 270 of the Town
of Ithaca Code, Titled "Zoning," regarding rezoning two parcels on Five Mile Drive from Low
Density Residential (LDR) to Medium Density Residential (MDR). The parcels are associated
with the Amabel Subdivision proposal.
The Town Board will consider setting a public hearing for the rezoning at the June 111h meeting.
The proposed public hearing date on July 91h is the same date that the Town Board is tentatively
scheduled to consider acceptance of the Amabel Subdivision Sewage Works Corporation (SWC).
This is subsequent to the Public Works Committee consideration of the SWC at their June
meeting.
The attachments for review and consideration include:

As board members may recall, the Amabel project is a residential subdivision that includes
utilizing Five Mile Drive and Inlet Road for access for the development of 30 new single-family
residential home lots with individual driveways. The project also includes installing
approximately 20 parking spaces, along with lighting, landscaping, and stormwater facilities.
The Amabel project received subdivision approval from the Planning Board on December 15,
2015. This approval expired and the applicant recently received approval for the project on
March 6, 2018.

Whereas, the Town of Ithaca has been a leader in supporting and fighting for the human
rights, dignity, and respect of all people, and
Whereas, Lesbian, Gay,Bisexual, Transgender, Queer/Questioning, Intersex,Asexual+
(LGBTQIA+) residents of the Town of Ithaca have been and continue to be vital to our economic
development, sustainability, and safety across all fields and
Whereas, more LGBTQIA+residents of the Town of Ithaca are living more openly than
ever before, and
Whereas, in passing this law the Town of Ithaca reaffirms its commitment and
responsibility to act to ensure that all its residents are afforded equal opportunity to enjoy a full
