RESOLVED , that the Tompkins County Trust Company , the First National
Bank of Ithaca , New York , and Marine Midland Bank in Ithaca , New
York , be and the same hereby are designated as depositories for all
mczies coming into the hands of the Supervisor , the Town Clerk , and
the Receiver of Taxes , for the year 1977 .

Town Board Minutes - 2 December 31 , 1976
APPOINTMENT OF DEPUTY SUPERVISOR FOR 1977
Motion by Councilman De' schre seconded by Councilman Powers ,
RESOLVED , that Councilman Andrew W . McElwee be appointed Deputy
Supervisor of the Tom of Ithaca for the year 1977 .
Unanimously carried .
- APPOINTr1ENT OF TOLVN OFFICIAL TO REPRESENT
THE TOPRI AT ASSOCIATION OF TOWNS MEETING
Motion by Councilman Del Rosso ; seconded by Councilman McElwee ,
RESOLVED , that this Town Board hereby designates Walter J . Schwan ,
Town Supervisor , to attend the Annual Business Session of the Asso -
ciation of Towns of the State of New York , to be held on February 23 ,
1977 at New York City , and to cast the vote of the aforesaid Town ,
pursuant to Section 6 of Article III of the Constitution and By-Laws
Of said Association .
Unanimously carried .
The Town Board recommended that the Town Engineer , a mentbar
of the Planning Board , and a member of the Zoning Board of Appeals
should attend this meeting if they felt it would be useful .
TOM MEETING DATES FOR 1977
It was remarked that Town meetings scheduled 'to begin at
5 * 00 p . m . were not starting on time . It was suggested that 5x15
P . m . would be more appropriate , since it would give Board members
more of an opportunity to be on time . Councilwoman Raffensperger ,
however , felt that 5 * 00 p . m . or 59. 15 p . mo meetings are too early
for the general public and she suggested consideration of 79. 30 p . m .
She felt the trial period for the later meeting time in March ,
April and May of 1976 was not typical . ( Other Board members had
remarked that the trial of the later meeting time did not seem to
significantly affect attendance . ) Councilman Powers noted that
meetings beginning at 79. 30 p' . m . , which might well last until 119. 00
p . m . or 119. 30 p . m . , were- not convenient for the public . He noted
also that the press and others had reported that the Town of Ithaca
Doard meetings consistently drew a larger attendance than meetings
of other towns which begin at 7e30 p . m . Supervisor Schwan4svggested
that the " run-of - the-mill " items might be scheduled early in the
, meeting and the more important items be reserved for later in the
This suggestion was well received and the Town Clerk was
L'istructed to so arrange the agenda in the future . After this di & -
cussion , the Board acted as follows *
1�41otion by Supervisor Schwano seconded by Councilman McElwee ,
RESOLVED ? that regular ; Town Board meetings shall be held on the
f :Alrst Monday after the first Tuesday in each month , at 5 : 15 p . m . ,
except as the Town Board shall otherwise authorize or as mandated
by Town Law .
The motion wasAuly carried , Councilwoman Raffensperger
having voted against its adoption .
HIGM41AY PAY SCALE FOR 1977
Notion by Supervisor Schwan ; seconded by Councilman Desch ,
RESOLVED , that the Town Board of the Town of Ithaca hereby estab-
lishes for the year 1977 an upper limit of $ 5 . 35 per hour for High-
way Department employees .

Town Board Minutes - 3 - December 31 , 1976
COUNTY/TOM C0111MICATIONS
Supervisor Schwan complained of a breakdown in County/Town
communications , citing the .following examples .
( 1 ) Approval of the new hospital without furnishing the
Town Board with a breakdown of construction costs or the impact the
hospital might have on the Town tax rate ; ( 2 ) no site plans of the
hospital construction were voluntarily made available to the Towne
( 3 ) the Town has received no breakdown on how the Town ' s Blue Shield/
Blue Cross rates will be affected by the new hospital ° ( 4 ) the Town
was not consulted as to the adequacy of the water and sewer system
to serve the new hospital 4p ( 5 ) there was no indication to the Town
that the County had gone to the State Legislature for legislation to
make possible the use of the old hospital for something other than a
hospital ; ( 6 ) the matter of the disposition of sales tax monies .
Mrs . Livesay responded to this catalogue of complaints by
reciting the efforts she has made .* ( 1 ) that in her reports to the
Town Board she advised . of the progress of plans for the hospitals
( 2 ) that she offered to arrange for comeone from the County to cane
in and discuss the plans with the Town Board ; ( 3 ) that she advised
the Town Board of the availability of the plans at the public library
and other places .* ( 4 ) that she had considered ingress and egress on
Rt . 96 as it affect;ithe sewer line and discussed this with Ur . Fab-
broni .
(ItIrs . Holcorlb said this matter was discussed at a joint meet-
ing of the Planning Board and the Town Board on January 6 , 1976 . Mr .
Fabbroni agreed the matter was discussed , but not as to the adequacy
of the water and sewer system . He said with regard_ to the conversion
1 of the old hospital and its relation to Rt . 96 and water and sewer
and sewer service that , it was obvious from the plans that the matter
was not sufficiently considered ; that somewhere along the line com-
munications got lost in the shuffle . )
Supervisor Schwan noted here that his complaints were not
directed at Ors . Livesay personally , but at the County Board of
Representatives .
Mrs . Livesay continued , saying that she had discussed with
Mr . John Murphy , County Budget Administrator , the effect the hospi -
tal might have on the tax rate ; that if the hospital became self -
s :.).pporting it would have no effects that it appeared there would be
no effect on the Town ' s Blue Cross and Blue Shield rates , that it
was her understanding this matter was to be discussed at the IY?urii -
cipal Officials P•Zeeting by Mr . Schultz , but the subject was never
reached ; that she agreed with Mr . Schwan that Mr . Williamson ' s
opinion on the sales tax should have gone out to all the Towns and
Villages , not just to Dryden .
Councilwoman Raffensperger said :"rs . Livesay was to be com-
mended for her faithful attendance at Town Board meetings and for
her efforts to keep the Board apprised of County Board of Repres. en .a-
tives activities .
It was agreed it would be useful for the Town Board to re-
ceive copies of. the minutes of County Board of Representatives mee .*.-
ings and this will be arranged . It was also agreed that members of
the Town Board should attend County Board of Representatives mee; i.n s
on a rotating basis ; and that other County Board of ReAresc-ntativcs
for the Town of Ithaca should rotate with Mrs . Livesay at Town Board
meetings .
Town Board Minutes - 4 - December 31 , 1976
Supervisor Schwan recommended that when a decision on the
disposition or use of the old hospital is made , the Town should be
advised , since it will have an effect on water and sewer systems .
The Town will be concerned with water consumption and the availabili -
ty of sewage treatment . Mrs . Holcomb noted that the Hospital Board
of Managers is looking into that matter in de nth and they are the
group the Town Board should be talking to before the County Board
of Representatives acts . Mrs . Livesay thought a comnittee of the
County Board of Representatives is also working on this matter .
Supervisor Schwan complained of the County policy requiring
boring roads rather than open cutting . He said the boring is much
more expensive , and problems arose in this connection when the Bol -
ton Point water mains were being installed . Ile recommended a meet-
ing of the nine towns and six villages tiith Mr . Howard Stevenson and
a County committee which Mr . Stevenson reports to to discuss this
problem . r-4r . Fabbron ' recommended that when this group gets together
they should also relate the discussion to State policy which appears
to be similar .
P4rs . Livesay suggested it appears to be a duplication to
have a County Highway Department and town highway departments , and
that perhaps there should be a County public works coordinator to
administer the program and apportion monies . Supervisor Schwan
remarked this idea has been advanced and may be a good one , but it
appears each County is different and there is great reluctance in
most quarters to give up anything , or give up local home rule and
right of ownership .
Beyond the recommendations in the foregoing discussion , no
specific program was set forth at this tiMe to correct the communi -
cation problem between Town and County . Mrs . Livesay repeated her
offer to work with Town Board members in dealing with County offi -
cials .
AUDITS OF RECORDS OF TOWN OFFICIALS
The Town Board reviewed the reports of the Town Justices ,
the Town Clerk , and the Building Inspector .
With respect to the reports of the Justices , Councilman
Powers suggested standardization of the reporting form so that the
Board could compare the records . It was agreed that the Justices
would be requested to meet and work out a report form and that each
would use the same form in the future .
Motion by Supervisor Schwan ° seconded by Councilman Desch ,
RESOLVED , that the Town Board having reviewed the accounts and
records of the t<<yo Town Justices , the Town Building Inspector , and
the Town Clerk , hereby approves the same , copies of said accounts
and records being attached hereto and made a part of these minutes .

APPOINTIeLE TT TO LOCAL BOARD OF ASSESSTIENT. REVIEW
Vlotion by Supervisor Schwan seconded by Councilman Desch ,
RESOLVED , that Councilman Powers be appointed to the Local Board of
Assessment Review , the said appointment to include the entire Town
Board should the c-olwYp o inquiry require it .
Unanimously carried .
Town Board Minutes - 5 - December 31 , 1976
TOTIM AUDIT FOR 1976
Motion' by Supervisor Schwan , seconded by Councilman McElwee ,
RESOLVED , that a Certified Public Accountant be hired to prepare an
audit of the Townes financial records for the year 1976.
Unanimously carried .
REPORTS OF TOTPRI OFFICIALS
Lawrence P . Fabbroni . Mr. Fabbroni noted that his report
submitted . today is self � cxplanatory so far as completed and planned
projects are concerned . Insofar as things planned last year and not
completed , he said the !, July 11 flood problems have taken up a great
deal of time and have set back some of last year ' s plans . The flood
brought to the fore and resulted in the solution of some drainage
Problems in Eastern Heights and other areas . It made it possible
for the Town to make certain corrections which the Department of
Environmental Conservation would not normally have allowed , and to
that extent there was some good in the flood . The Town has received
about 85 % funding for what it was required to do in the 90 -day `.Me
limit , roughly $ 23 , 0W -1" o $ 24 , 000 . The Town has expended $ 12 , 000 to
$ 13 , 000 for outside machinery . Therefore , the remainder accounts
for the Town ' s own time and materials . 1, r . Fabbroni said he would
have the totals in January . Almost all the work which the Town had
to complete in 90 days '', has been done except the last part of the
work in Eastern Heights (which was not completed because of the
weather ) .
Mr . Fabbroni reported it appeared the Department of Trans -
portation might grant an area speed limit for the whole area of the
Town north of Slaterville Road and south of the Town line and west
of the Dryden line and any other municipal boundary contiguous therew
to . ' Mr . Fabbroni read „ a letter from the DOT in this regard . lie
suggested the Town night request a 35 mike -per-hour area speed limit
and 30 miles per hour for the residential areas . He thought DOT
might approve this arrangement for Snyder 33111 Road , Hanshaw Road ,
and Pleasant Grove Road. . however , according to their criteria ,
Snyder Mill Road should be 40 mph , Banshaw 45 mph , and Pleasant
Grove Road 40 mph , butlthe Town might get the lower speeds if they
are combined as a package " . An effort will be made to get 30 mph

on all of them and 35 mph on the arterials ,
lira Fabbroni requested authorization to attend the Trans -
portation Research Board Conference which will be held beginning
January 2a , 1977 in ?R?ashington , D . C . The cost will be roughly $ 200
including traveling expenses .
?Motion by Councilman MlcElweeg seconded by Councilman Powers ,
RESOLVED , that Lawrence P . Fabbroni , Town Engineer , is hereby author -
ized to attend the Transportation Research Board Conference to be
held beginning January11124 ; 1977 in Washington , � D . C . , expenses to be
paid by the Town of sthaca .

REPORTS OF TOWN OFFICIALS ( continued )
Barbara Holcomb , Mrs . Holcomb reported that there were
six actions in 1976 where the Planning Board acted on its ocim
authority ,
( 1 ) The 10- lot subdivision , Eddy mill property , on the
old Marshall Farm . It is essentially an approval of the 10 tots
on the periphery of that property with access for future roads and
utilities for the interior land .
( 2 ) Haven Hills Subdivision ( Hilker Construction Co . ) off
Snyder Hill Road .
( 3 ) Approved 'iPhase II , Longhouse , Inc . , Elm Street Exten °
sion .
( 4 ) Approvaliof four frontage lots ( Hans Biesdorf ) where
Mr . Biesdorf was ready to sell off .
( 5 ) . Approval of so - called Giles " subdivision '' ( family
selling of portion ofllarger farm . , but which had reached the point
where approval was needed ) .
( 6 ) Revision ' of second phase of Loenardo Subdivision , off
Danby Road , enlarging °, some lots and lot lines .
Mrs . Holcomb recited a list of matters which had come be -
fore' the Town Board ,
( 1 ) Storage building for Wonderland Motel ( approved ) .
( 2 ) Dr . Harold Purdy ' s site plan ( approved ) .
( 3 ) Re- zoning of lands on Ridgecrest Road area . .
( 4 ) Yengo Restaurant ( denied ) .
( 5 ) Self - service Gasoline Station * ( Bell ' s ) , ( approved ) .
( 6 ) East Ithaca Depot Restaurant -Bar ( approved ) .
Other actions of the Planning Board included investigation
of possible ToxAm barn ', sites , recommendations on the sign ordinance ,
development of Northview West park , Coy Glen Park presentation ,
East Ithaca bikbway between Maple Avenue and Honness Lane .
Mrs . Holcomb noted that some things are still pending ,
and some of them are covered in Piro Fabbroni ' s report . The
Planning Board also spent considerable time on proposals which
for one reason or another were abandoned , proposals for use of
the Judd Falls/Ellis Hollow Road corner , the Liberman marina land ,
r2onkemeyer ' s barn and '' commercial area , Reuning proposal for mul -
tiple residence .
Plrs . Holcomb Presented three names for replacements to
the Planning Board . She recommended that Richard Black ' s term
be filled by Montgomery Play , 1360 'Slaterville Road . Alr . Play has
attended many Planning Board meetings . Mr . May was considered

previously and was not available ; Y�owever , his schedule now makes
him available . She recortmiended also Mr . J . Z,1 . Reece , 311 Salem
Drive , to replace 11au� ice Farris . P-lr . Reece is an engineer at
National Cash Register Company . Tars . Holcomb recommended Francis
Paolangeli , 125 Ridgecrest Road , to complete her term . This could
cover three of the fire replacements needed .
Town Board Minutes 7 - December 31 , 1976
Pars . Holcomb reported that efforts are being made to find
two more members to round out the Planning Board . She said it would
be difficult to find a replacement for Daniel Baker , that is, a per -
son who spends 50 % of his time in agricultural pursuits .

Unanimously carried .
P2rs . Holcomb recommended that a permanent chairman of the
Planning Board ought not be named at this time ,* that this be held

n abeyance until a full Board is in being . Mr . Jonathan Bradley
will act as interim Chairman in the month of January .
There was discussion of procedure '' with respect to a quorum
if an agricultural member of the Planning° Board is not soon avail -
able . The Planning Board was established as an eight -man Board and
it may still be necessary to have five members present to constitute
a quorum , even if an agricultural Member is not named and there re -
sults a seven member Board . It was agreed the ToU..n Attorney would
study this question and " the matter will be placed on the agenda for
the January meeting .
Councilwoman Raffensperger inquired of Mrs . Holcomb whether
the proposed change in the Eastwood Commons development is of such
nature to require approval of the Planning Board . Mrso Holcomb said
that if the site plan were changed or if the concept of four build4
ings were changed , it would be necessary . However , simply redes .ign
ing the interior to meet the desires of an individual buyer would
not recuire any action by the Planning Board . !' ir . Fabbroni agreed
- ° unless the numher of , units was changed .

his understanding that the Charter and Ordinance Committee of the
City of Ithaca had voted against the petition for annexation and

matter , on January 5th .

IN THE MATTER OF THE PETITION FOR ANNEXATION
TO THE CITY OF ITHACA FILED BY ITIIACA ELI-I- MAPLE
ROUSES , INC .
FINDINGS , CONCLUSIONS , RESOLUTION AND ORDER OF 7- E ATION
WHEREAS , a petition was presented to the Town Board of the
Town of Ithaca and the Common Council of the City of Ithaca request-
ing the annexation of a certain ;portion of the territory of the
Town of Ithaca into the City of Ithacae and
WHEREAS , a hearing was held on the 12th day of October ,
1976 , on said petition at which testimony in favor of and in oppo-
sition to said petition was heard - and exhibits were taken ,
NOW , as and for its findings of fact and determination ,
pursuant to General Municipal Law , § 711 , the Town Board of the
Town of Ithaca states ' as follows °
1 . The Town Board of the Town of Ithaca is the governing
board of an affected local government within the definitions in
General 17unicipal Lawy Article 17o the 111uniciaal Annexation Law ,
2 . The territory which is the subject of this annexation
proceeding is locatedentirely in the Town of Ithaca and is des -
cribed in Schedule " A "; to the petition hereinafter referred to .
' 3 . A petition requesting the annexation of certain property
was served upon the Clerk of the Town of Ithaca on the 10th day of
August , 1976 . The petition was signed by Ithaca Elm- Maple Houses ,
Inc . , a housing company formed under the provisions of the Limited
Dividend Housing Law of the State of New York . The petitioner is
the temporary , nominal owner of an apartment complex located in the
area sought to be annexed . A copy of the petition is annexed here-
by as Exhibit " A % Petitioner is exempt from the payment of real
estate taxes but petitioner pays benefit assessments or charges
for improvements such ' as water and sewer and also makes an annual
payment in lieu of taxes .
An amended Certificate of Assessor was served upon the
Clerk of the Town of Ithaca on the . lst day of October , 1976 , a copy
of which is annexed hereto as Exhibit " B " .
50 At the public hearing held herein on the 12th day of
October , 1976 certain written objections to the petition and
amended certificate were presented , a copy of which is annexed
hereto as Exhibit '' C °° .''
6 . The Town Board of the Town of Ithaca hereby sustains
each of said written objections , finding as follows .
( a ) The ,person signing the petition was not qualified
to do so in that the ostensible petitioner , Ithaca Elm-Maple Houses ,
Inc . , lacks authorityto execute the petition . The bases for this
finding are those set forth in written objection 1 ( a ) , ( b ) , and
( c ) , , and include the fact that petitioner is merely a nominee hold -
er of the real estate and is precluded from taking any action with
respect thereto wltmhou' t directions from others , including the hold -
er of the mortgage . Significantly , that mortgage holder , the New
York State Mousing Finance Agency and other public agencies , per ®
sons or corporations , '„ interested in the petitioner ' s operations or
in the financing thereof dial not appear in support of the annexation ,
and did not join in the petition .

( b ) The ' person signing the petition is not qualified
to do so in that it Is not the owner of at least a majority of the
assessed valuation of ; the real property in the area to be annexed .
The deed under which Ithaca Elm-eagle Houses , Inc . , claims ownership
grants title to Ithaca Elm-maple mouses , Inc . , only until the mort-
gage is paid , at which time title reverts to Cornell UTnive. sity ,
Cornell University , the actual owner of the property , did not join
in or sign the petition .
( c ) The person signing the petition is not qualified
to do so in that the real property alleged to be owned by Ithaca
Elm-Maple douses , Inca; , is tax exempt and thus is not to be included
in determining percentages of taxable property in the area sought to
be annexed .
(d ) The petition was irregular in that it failed to
have an accurate Certificate of Assessor stating the percentage of
total valuation which was purportedly owned by petitioner .
7 . By reason I'of differing tax structures in the Town of
Ithaca and the City of'; Ithaca , the annexation of this territory
into the City of Ithaca will result in a decrease in the amount of
funds paid as taxes and in lieu of . taxes to the Ithaca City School
District .
8 . The Town of Ithaca , in 1973 , joined with three other
municipalities in the Southern Cayuga Lake Intermunicipal hater
Commission ( the " Commission " ) to construct an $ 8000 , 000 . 00 water
supply and transmission system. . The project has been recently com-
pleted and indebtedness relating to same incurred . The Town of
Ithaca is responsible for approximately 70 % of that debt . From
the early stages of planning of this intermunicipal project , the
revenues projected from petitioner ° s apartments have been relied
upon in determining the feasibility of the project . The annexation
would result in significant loss of revenues to the Commission
thereby requiring readjustment and significant increases in the
water rates and benefit levies or assessments paid by the remaining
consumers in the municipalities participating in such Commission .
9 . The territory proposed to be annexed contains a major
portion of all publicly subsidized housing presently existing in
the Town o .f Ithaca . The presence of such housing is desirable and
has been ecouraged and supported in the Town of Ithaca .
10 . The annexation of the territory herein would cause sub -
stantial monetary loss ', to the Town of Ithaca which would require
that burdens placed on the remaining tom residents be increased ,
thus placing a greater financial burden upon them . Such financial
loss would be in the form of loss in per capita state aid , water
benefit levies , water use revenues , real estate taxes , payments in
lieu of taxes , and other payments made by residents and property
owners in the territory proposed to be annexed .
11 . Approval of the proposed annexation will cause an in -
crease in tax revenues , per capita aid , and other receipts to the
City of Ithaca . By 1981 , when the first increases in per capita
state aid are realized ' the increase in receipts to the City of
Ithaca will be roughl _y ;; equal to or slightly greater than the loss
incurred by the Torn of Ithaca . Until such time as adjustments are
made in the per capita state aid , the monetary loss to the Town of
Ithaca will be greater than the gain to the City .
12 . At no time has there been a commitment on the part of
the Toiam Board of the Town of Ithaca to the annexation proposed .
Indeed , the Town of Ithaca , since August 17 , 1970 , long prior to
the commencement of construction of petitioner ' s apartments , repeat -
edly expressed opposition and objections to the annexation of the
territory , or parts of :' the territory sought to be annexed .

13 . A principal motivation behind this petition for annexa-
tion is petitioner ° s stated desire to avoid payment of municipal
services which petitioner claims are greater in the Town of Ithaca .
Thus , the proposed annexation is an expedient solution to a problem
perceived by the petitioner , but apparently not of significance to
all the other land owners in the area sought to be annexed . Such
annexation would set a precedent of piecemeal - annexation in response
to the dissatisfaction' of one landowner and will orec '=ude continuity
in municipal planning for the Town of Ithaca , other loyal mtalicil�
palities , and the City of Ithaca . There was no evidence of satis -
factory probative value which showed the extent , if any , to which
petitioner would suffer from an increase of costs or that any such
increases in costs , insofar as they might affect petitioner , could
not or have not been recovered by raising the rents in the petition -
er ' s apartments . Significantly , no other owners of property in the
area sought to be annexed testified in support of annexation , but
two property owners expressed. opposition . If this annexation occurs ,
and costs within the City of Ithaca increase , the ovmer of the propp
erty sought to be annexed or the owner of any other property in such
territory could conceivably apply for re -annexation to the Town and
be granted such annexation . Such process of taking territory away
from one municipality and annexing it to another is destructive of
the orderly procedures and stable territorial integrity which sound
planning , including sound fiscal planning , requires .
14 . The area to be annexed is a piece of land carved out
of the Town of Ithaca , is roughly rectangular in shape and is bound-
ed on three sides by the Town of Ithaca . Less than 30 % of the peri -
meter! of the area sought to be annexed adjoins the City of Ithaca .
The irregular shape of the resulting boundary between the two muni -
cipalities will necessarily impair future planning of the govern-
mental units and make for unnecessary disparities in taxes and ser �
vices between many adjoining neighbors .
15 . Pursuant to General municipal Law , Section 703 , it is
the obligation of the City of Ithaca , if the proposed annexation is
approved , to assume certain proportions of the debt , contract
liabilities and other liabilities of the , Town of Ithaca . By virtue
of the formula set out ' for the assumption of debt and liabilities
in Section 708 , the Town of Ithaca would be significantly injured .
At , present , the monies derived from this area are properly applied
to the varying debts and liabilities of the municipality . However ,
the lady states that the percentage of debt to be assumed is not
the proportion of assessed value in the territory to assessed value
in the Town , but rather the proportion of taxable assessed property
in the territory to taxable assessed property in the Town , the lat -
ter being a much smaller percentage than the former .
Upon the aforestated findings of fact , upon the testimony
and exhibits submitted at the hearing , and after due consideration
of its governing body , " the Town of Ithaca hereby determines and
finds that *
1 . The petition fails to comply with the provisions of
Article 17 of the General Municipal lawp
2 . The proposed annexation of the above described territory
of the Town of Ithaca is not in the interest of the territory pro-
posed to be annexed , the City of Ithaca , the Town of Ithaca , the
Ithaca City School District , the surrounding Townships and Villages
participating in the Southern Cayuga Lake Intermunicipal Commission ,
and is not in the overall public interest .

Supervisor Schwan read letter dated December 23 , 1976 from
the Department of Transportation in this matter , indicating that
the Lehigh Valley Railroad Company ' s request for the release of
preferential rights is invalid because the Ithaca Branch , Ithaca
Yard Tracks , City and Town of Ithaca , is not an abandoned facility
at this time . Therefore , there is no need for Board action .

Town Supervisor . Supervisor Schwan reported that a ` Pack:
age " of material has been put together on the proposed 5 � area seTvjer
project for presentation to DEC and EPA officials at a meeting in
Albany on January 11 . Assemblyman Gary Lee , Senator William Smith ,
Congressman matt McHugh , and Jean Angell are supporting the Town
in its effort to secure 75 % funding for this project .
Buyoucos & Barney . John Co Barney reported that $ 748 . 24
had been collected in ' thf-.A Vincent Franciamone matter . This amount
of money is to be appiled against the fine imposed by Judge Yesawich .
There remains a balance yet to be paid by Mr . Franciamone which he
has promised to pay , a portion on January 1 , 1977 and the remainder
on February 1 , 1977 .

A- AENDMENT TO T01114 BUDGET RE SALES TAX
Supervisor Schwan distributed material prepared ty the
County Budget Office , including information about Sales Tax Credits .
It indicates for the Town of Ithaca a sales tax credit of $ 470 , 039 . 48
for the coming year . The Town of Ithaca does not take this money
in cash but applies it against the County tax rate to lower it .
The Supervisor noted that this $ 470 , 039 . 48 does not show up anywhere
in the Town of Ithaca budget and recommended that the Town amend its
budget to reflect estimated sales tax receipts for the year 1977 .
It does not actually change the budget in dollars and cents , but
does show the credit and how it was applied . Therefore , the Board
acted as follows °

WHEREAS , ( 1 ) the Town of Ithaca has been credited by the
County of Tompkins with the sum of $ 470 , 039 . 48 as its share of
Sales Tax revenues , which sum has been retained by the County of
Tompkins to be applied for the purpose of reduction of the tax rate
of the Town of Ithaca from $ 12 . 810 per thousand to $ 4 °: 424 per thous -
and , and which has not been otherwise appropriated or committed , and
( 2 ) the Town budget , as previously adopted , does not reflect
such credit and disposition of such funds ,
NOW , THEREFORE , it is resolved as follows
Section 1 . The crediting of the above funds is acknowledged .
Section 2 . The Town Supervisor is directed to authorize
the retention of such funds by the Tompkins County Budget Officer
to apply in reduction of the amount to be levied by the County on
taxable property in the Toum of Ithaca , outside the Village of
Cayuga Heights , for state and county purposes .
Section 3 . This resolution confirms all action previously
taken by the Town Board and the Town Supervisor in above respects .

( A ) MUNICIPAL PROJECTS STATUS
( 1 ) Completed :
a . Parks
Tudor Road Park was enlarged '- by Town Highwaymen , a
barbeque pit built and two picnic tables provided for
neighborhood use . Vandalism has proved to be non - existen
over the first year ' s operation . Tables are brought in
and painted for the winter .
A complete Study of the Coy Glen area including a
physical inventory , site analysis , synthesis of various
municipal and private interests , design and development ,
phasing , and recommendations , was done by Dennis
Colliton and Robert Bonnell . The study was approved in
concept so Town Board subcommittee members could make
initial landowner contacts .
Eastern Heights Parkland of about 13 acres was deeded
to the Town to fulfill park commitments of the Eastern
Heights Subdivision .
With the help of Leroy Rogers and Peggy Schwartz of
Cornell Graduate Planning neighborhood input was soli -
cited , site plans developed from topographic and physical
inventories , site plans refined by Planning Board , site
plans open to public comment a second time , phasing
suggested by Planning Board , plans referred to sub -
committee for implementation recommendation after general
approval by Town Board of an active Tareyton Road Site
and a passive Salem Drive Site .
General topographic and physical inventory has been
completed for Eastern Heights parkland .
A committee formed by Donald Culligan of the School
District has met four times to discuss possible uses
and joint development of the DeWitt Junior High School
backlands for safe recreational use . Local input has
so far been gathered from Town of Ithaca Board , R . Gonet
local BOR Grant administrator , the neighborhood and
civic _groups .
b . Transit
Design and performance of a Townwide survey .
Completion of gross compilation of results .
Bus service for the elderly at Ellis Hollow Apts , is now
coordinated by the County Office for the Aging who also
serves the transit needs of other elderly Townwide on a
more limited irregular basis .
C . Sewers
More survey work was done to find technically acceptable
alternatives for landowners from whom easements are
being sought .
With renewal of B . A . N . s at 7 % in March seed money for
five extensions was depleted by increased interest cost )
and eventual prepayments associated with long term
bonding so the extensions were put on the shelf .
Attempts were made through D . E . C . , legislators and
consultants to obtain PL 92 - 500 Federal funding for
sewer collectors with no success to date .
A short extension on Coddington Road was designed , put
to bid , contract awarded , construction supervised , all
in -house , and construction completed .

Check of water and sewer as - builts or redetermination

d . Town Barn
After developing sketches and cost . estimates of about
$ 90 , 000 . 00 to expand the existing Town Highway Barn it
was decided by the Town Board to build a new modern
and functional highway maintenance building for roughly
the $ 90 , 000 . 00 plus the sale value of the existing
facility . A long site selection process was undertaken
incorporating public input , a Bostwick Road site was
surveyed then discarded because of cost and a tight
timetable . A Seven Mile Drive site was chosen , consul -
ting engineer - architects were interviewed and John
S . MacNeill selected . With in-house assistance a topo -
graphic survey was provided the consultant , conceptual
layouts prepared and approved by Town Board , detail
design and specifications drawn up , project bid , bids
totaling $ 213 , 532 . 00 received , contracts executed ,
change orders effecting a revised $ 188 , 897 . 00 total ,
and construction begun .

Octopus Committee for Route 96 has met at - large and in
sub- committee over ten times to discuss alignment of
future Route 96 , design standards , timetable for design
and public input . The FEIS statement on the environment
received final approval . A public hearing was held in
October . City , County , and Town planners and engineers
have been meeting in recent months to discuss specific
alignments and their specific transportation and social
impacts on the local communities .
Safer Roads Demonstration Project for signing was
extended one year for required completion .
h . Drainage
The July floods produced emergency situations throughout
the Town . 24 separate damage survey reports were sur -
veyed with Town employees and ultimately approved
$ 573 . 00 for debris clearance if done immediately after
flood , $ 28 , 554 . 00 for Category B protective measures
if _ completed within 90 days of disaster declaration

( this was extended to 132 days at our request ) , and
$ 16 , 094 . 00 for Category C for repair of road systems
if completed within 450 days of the disaster declaration .
With Town work forces and machinery and rental machinery
the following projects were completed :
1 . Long overdue cleaning of two small rock filled
streamlettes and their entry points into Lake Cayuga .
2 . Removal of gravel deposits from mouth of Coy Glen
and of silt bar from Cayuga Inlet F1ood . Channel .
3 . Removal of gravel deposits from streams crossing
Culver Road and Seven Mile Drive .
4 . Removal of gravel deposits , drainage improvements ,
and removal of site obstacles on Burns Road .
5 . Improving drainage balance of Honness Lane - Pine
Tree Road area by diversion ditch backlot .
66 Major drainage study of East Ithaca above Pine Tree
Road and Slaterville Road . Rough draft of drainage
flows and design alternatives were aired with Town
Board , general property owners , and specific
landowners .
Drainage easements were executed with :

all streams cleaned of debris .
With Town forces and machinery much shoulder damage
has been repaired .
Numerous personal problems were investigated and
for the most part solutions incorporated into actions
discussed above .
h . Bolton Point
Ditch work and repair of a washout were done to protect
the roadway from major damage . Arrangements were made
through the Soil Conservation District to have major
backslope and hillside right of way opposite pumping
station seeded as part of a ten -year research study for
a the price of the mulch and fertilizer . Debris in the
area was removed .
i . Ordinances
New Zoning Ordinance was revised and presented to Town
Planning Board and Town Board for review . Much contro -
versy arose requiring the formation of a sub- committee
to draw up a compromise version before open public
hearings would begin .
A Local Law for the protection of , Freshwater Wetlands
was enacted by the Town Board thus maintaining our home
rule in these cases .
Sign Ordinance amendments and problem areas were recom-
mended and brought to the attention of the Town Board .

Extensive enforcement of this ordinance has been
undertaken by Robert Bonnell with general cooperative
results and progress toward total compliance .
j . Bikeways -Walkways
A bikeway was proposed from Honness Lane to Maple Avenue ,
approved by Planning Board , referred to legal investi -

Town connecting East Hill Plaza and the Ellis Hollow
