Motion by Supervisor Schwank seconded by Councilman McElwee ,
RESOLVED , that the minutes of September 8 , 1975 are hereby
i-' approved as presented .

REPORT OF COUNTY P
RE RESENTATIVES
a!grs . Livesay reported that the County Board of Representa -
tives had approved a second CETA position for the Town of Ithaca .
The first one ( Planning Assistant ) was approved earlier . It would
appear that the Town of Ithaca may hire an Assistant Planning En-
gineer and a Landscape Architect under this program . Since there
appeared to be some misunderstanding as to whether the first posi -
tion had been approved , Mrs . Livesay said she would look into it .
TOWN BOARD MINUTES - 2 - October 13 , 1975
Mrs . Livesay reported that it has been announced that
the loss on the hospital will be about half a million dollars
this year . Among other reasons for the loss are fewer patients
staying for shorter periods of time .
Two meetings twill be held soon : One in Geneva , New York ,
on October 30 having to do with the permit program , under Section
404 of the Pure Waters Act . It has to do with water resources and
land use control . The meeting will be under the direction of the
Army Corps of Engineers . There will be another meeting on Wednes -
day ( October 15. ) in the Court House at 7430 , a presentation by the
Army Corps of Engineers on a study of the Seneca River basin .
Mrs . Livesay reported that the County Budget will be
available on November 10 .
Mrs . Livesay had nothing further to report at this time . .
PUBLIC HEARING - CITY OF ITHACA FIRE CONTRACT
"Motion by Supervisor Schwan ; seconded by Councilman McElweeo
RESOLVED , that a public hearing be held by the Town Board of the
Town of Ithaca at 59. 15 p . m . , November 6 , 1975 , in . the Town of
Ithaca Offices , 126 East Seneca Street , Ithaca , New York , for the
purpose of hearing all persons interested in the renewal of a con-
tract with the City of . Ithaca for fire protection for a one -year
period on the basis of $ 136 , 500 for the year 1976 in the Town of
Ithaca , excepting the following areas , to wite
a ) the Village of Cayuga Heights ,
b ) the area comprising all the territory lying between
the east boundary of the Village of Cayuga Heights
and the east boundary of the Town of Ithaca ,
c ) the Hamlet of Forest Home exclusive of the structure
housing the Cornell University Filtration Plant .
Unanimously carried .
PUBLIC HEARING - FIRE CONTRACT WITH
VILLAGE OF CAYUGA HEIGHTS
Motion by Supervisor Schwan ; seconded by Councilman McElwee ,
RESOLVED , that a public hearing be held by the Town of Ithaca
Board at 5 : 20 p . m , , <tNovember 6 , 1975 in the Town of Ithaca Of -
fices at 126 East Seneca Street , Ithaca , New York , for the pur -
pose of hearing ' all persons interested in the renewal of a con-
tract with the Village of Cayuga Heights for fire protection for
the year 1976 on the basis of $. 19 , 650000 in the Hamlet of Forest
Home and in that portion of the Town to the north of Forest Home
and between the east boundary of the Town of Ithaca .
Unanimously carried .
PUBLIC HEARING - LIGHTING IMPROVEMENT
DISTRICTS AND WATER AND SEWER IMPROVEjumENTS
Motion by Supervisor Schwan , seconded by Councilman McElwee ,
RESOLVED , VHEREAS the Town of Ithaca has prepared assessment
rolls on the parcels of land included in the following :
( 1 ) Forest Home Lighting Special Improvement District ,
( 2 ) Glenside Lighting Special Improvement District ,

( 3 ) Renwick Heights Lighting Special Improvement District .
( 4 ) Eastwood Commons Lighting Special Improvement District .
( 5 ) The Town of Ithaca water and sewer improvements now
' operated by the Town as a Town -wide function and
covering all lands in the Town ; pursuant to Section
209 -r of the TownpLaw ; this assessment roll includes
not only all . the parcels , former' ly included in all
the former water . and sewer districts , but also all
other lands in the . Town of Ithaca outside of the
Village of Cayuga . . Heights ; arid . has approtioned and
assessed upon such parcels of land in proportion
to the amount of benefits the -improvements shall
confer upon the same ._ the costs chargeable to said
districts and said land in the : Town of Ithaca for
the establishment and , construction of the inprove-
ments in said districts , including the water and
'sewer systems therein , which charges are payable
in the year 1976 and , therefore , pursuant to Section
239 of the Town Law , the said Town Board will hold a
public hearing thereon at the Town Offices at 126
East Seneca Street , Ithaca , . New York , on the 6th day
of November , . 1975 , in the order listed above begin-
ning at 5e25 . p . m :o , at which time it will consider
any objections which may be made to said assessment
rolls and apportionments .

PRELIMINARY BUDGET 1976
Motion by Supervisor Schwan ; seconded by Councilman . Desch ,
RESOLVED , that the Town Board hereby prepare and approve as a
Preliminary Budget of this Town for the fiscal year beginning
January 1 , 1976 , the itemized statement of estimated revenues .
and expenditures , as preparedo a copy of which is to be made a
part of these minutes , and
BE IT FURTHER RESOLVED , that the Town Board of the Town of Ithaca
shall ,meet to hold a public hearing at 5 : 30 p , m . on Thursday ,
November 6 , 1975 at the Town Offices , 126 East Seneca Street ,
Ithaca , New York , for the purpose of hearing any person for or
against any item or items therein ; and
BE IT FURTHER RESOLVED , that the Town Clerk shall give notice
of such public hearing in the manner provided in Section 108 of
the Town Law providing that such notice shall be published in the
Ithaca ' Journal at least twice .

COMBINED REGULAR AND BUDGET MEETING
Motion '' by Supervisor Schwan $ seconded by Councilman Desch ,
RESOLVED , that the Town Board of the Town of Ithaca shall hold
a combined regular and budget meeting on November 6 , 1975 , at
5 : 00 p '. m . in the Town Offices , as required by law .
Unanimously carried .
REVIEW OF PRELIMINARY BUDGET
Supervisor Schwan reviewed the Preliminary Budget for 1976
page by page and line by line . Copy of said Preliminary Budget is
made a part of these minutes .

UNITED ' WAY PRESENTATION
If Mr . Robert Kenerson , as part of a United Way presentation ,
ran a film on activities at the Special Childrens °. Center . Mr .
Kenerson noted that 315 children are helped at the Special Chil -
drens ° ' Center and that most of them are from Tompkins County ,
Mr . Kenerson said we ought to be thankful we have something like
this in our community . He noted , further , that BOCES handles
about 450 handicapped children . Some of these even after the
BOCE5 programs will not be able to fend for themselves , but that
Challenge Industries has taken on some of them .
Helen Sullivan , United T°?ay , : spoke briefly :about the - -
various agencies in ' Tompkins County and the - - services they pro -
vide and asked the support_ of all for the United Way .
OFFICE ' FOR THE AGING
Jan Daugherty , Services Coordinator of the Office for
the Aging , distributed material , including background informa -
tion , suggested 1976 objectives , and a letter from Susan Clark ,
Director . She noted that in order to receive funding , the Tomp -
kins County Office for the Aging must submit an Area Plan to the
New York State Office for the Aging each year . The material fur-
nished by her included also a 1976 Mission Statement . She said
they were going to each of the Town and Village Boards hoping
that these bodies will discuss the objectives of the Office for
the Aging and feed back information to them . She urged the Board
members to read the material presented and to talk with people in
their geographical area , particularly the older people in order to
get feed ®back and to see what they think . Mrs . Daugherty asked ,
the Board to place the objectives on the agenda for the November
Board meeting . After the objectives have been presented to the
Tompkins County Board of Representatives for in -put and in-put
has been received from other sources , there will be a series of
public hearings , one before the Board of Representatives and sev-
eral others in the rural areas . It was agreed that Mrs . Daugherty
would advise the Town Clerk of the Town of Ithaca of the hearing
dates "and places .
ACCEPTANCE OF SYCAMORE DRIVE ,
PINEWOOD PLACE , AND BIRCHWOOD DRIVE NORTH
Mr . Rocco Lucente reported that the work on Sycamore
Drive , Pinewood Place , and Birchwood Drive North has been com-
pletediand he requested that the Town accept them as Town roads .
Mr . Fabbroni reported that he had inspected the roads and had
found them totally in compliance with Town specifications . There
was some question as to the correctness of the proposed deed and ,
therefore , the Town Board acted as follows :

Motion by Supervisor Schwan ; seconded by Councilman Del Rosso ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
accepts Sycamore Drive , Pinewood Place , and Birchwood Drive
North Ias Town roads , subject to approval by the Town Attorney
of the deed and the recording of same .
Unanimously carried .
DOG CONTROL ORDINANCE
Motion by Councilman Powers ; seconded by Supervisor Schwan ,
RESOLVED , that the Town Board of the Town of Ithaca shall con °
duct a public - hearing on December 8 , 1975 at 6 : 30 p . m . at the
Town of Ithaca Offices at 126 East Seneca Street , Ithaca , New
York , ° to consider the adoption of a Dog Control Ordinance ( Local
Law No . 1 all 1975 ) , and to hear all persons for or against the
adoption of such local law .
Unanimously carried .
PROPOSED ABANDONMENT OF ROSEMARY LANE
The Town Attorney distributed to the Board a prepared
resolution with respect to the abandonment of Rosemary Lane for
their review and discussion . After brief discussion the Town
Board acted as follows :
Motion by Councilman McElwee ; seconded by Councilman Powers ,
WIEREAS : A . The Town Superintendent of Highways has
requested and recommended the abandonment and discontinuance of
Rosemary Lane , heretofore used as a public street running easter �
ly and westerly between Cayuga Street , a City of Ithaca street ,
on the west , and East Shore Drive , a State highway designated as
Routel34B , on the east , and
B . Said Rosemary Lane runs , for its entire distance ,
through lands of the Ithaca City School District , the said School
District having represented to the Town Board that all lands on
both sides of the street are owned by the School District , and
the records of the County Assessor ' s Office confirming the owner -
ship of all such lands by the School District , and
C . It appearing that no portion of Rosemary Lane is
necessary to connect Cayuga Street and East Shore Drive ( being
the only two existing highways abutting Rosemary Lane ) or to
provide ingress and egress to and from said public streets and
any privately or publicly owned lands other than lands of the
School, District , and .
D . The City School District having requested that Rose -
mary Lane be abandoned and discontinued as a public highway in
its entirety ,

IT IS RESOLVED ,
Section 1 . The Town Board , pursuant to Section 211 -b of
the Highway Law , shall hold a public hearing on the 17th day of
November , 1975 , at 5 : 00 o ° clock p . m . , at the Town Hall at 126
East Seneca Street , in the City of Ithaca , New York , to consider
the adoption of a resolution declaring that Rosemary Lane be aban-
doned and discontinued as a public highway for its entire length , .
i . e . between Cayuga Street and East Shore Drive and that , at
least 30 days prior to such time ( a ) a written description of
Rosemary Lane as hereinabove described shall be filed in the

Town Clerk ' s Office with a written statement attached thereto
that such highway shall be abandoned and ( b ) the Town Clerk
shallllicause notices to be posted in at least three conspicuous
places in the Town of Ithaca setting forth the ' time and place ,
as above stated , where the aforesaid declaration of abandonment
will be made for the purpose .of permitting . any . interested person
to appear for or against the . adoption of such resolution of aban-
donment and ( c ) notice . of such proposed declaration at the time
and place aforesaid shall also be publishe& in . the Ithaca Journal
at least 10 days prior to the aforesaid date , and
Section 2 . Such abandonment and discontinuance shall
be subject . to 'the reservation of an easement over a strip of
land twenty feet in width for the purpose of maintaining , operat -
ing , repairing , reconstructirig , and replacing the existing water
main which runs in an easterly and westerly direction in , along ,
or adjacent to said Rosemary Lane , and appurtenant facilities
thereof ,, the Centerline of - which twenty foot strip of land shall
be the center line of the water, main as now located . Such ease -
ment shall be "reserved for the benefit of said Town , its succes -
sors or assigns , in the ownership or the use of such water main
or any replacement thereof , including any other municipality ,
public authority , agency , or , other governTental unit to which
the right to own , use or ' participate _ in such ownership or use
shall 'be granted`. The fee title to the 20 ft . strip shall be
I by the School District and the School District shall
have the' ' right to use the lands in said strip except that such
use shal not interfere with or- impede the maintenance , operation ,,
repair , replacement or r @construction of said water main , - or
causellinjury or damage to the water . main or its appurtenances .
The Town shall be responsible for the removal of all debris after .
any work has been done by the Town pursuant to the easement .
Section 3 . The School District shall execute or furnish
such documents as the Town Attorney shall require to document
the reservation of the aforesaid easement and the representation
of the School District herein required .

NORTHEAST WALKWAY
Supervisor Schwan reported that a letter dated October 8 ,
1975 had been received from Gabriel N . M g Y eckenber , attorney for
BOCESI submitting a deed from BOCES to the Town of Ithaca convey-
ing the Northeast Walkway , a certified copy of the Resolution of
the BOCES Board authorizing such conveyance and a copy of the
MacDowell survey referred to in the deed . These documents were
delivered pursuant to agreement heretofore reached that the Town
of Ithaca will accept title to the Walkway . The Board acted as
followsa
Motion by Supervisor Schwan ; seconded by Councilman Powers ,
RESOLVED , that . the Town of Ithaca hereby accepts the deed
from BOCES conveying the Northeast Walkway , subject to the Town
Attorney reviewing the deed and approving samea further that if
the Town Attorney finds the deed in order he is instructed to
record same .
Unanimously carried .
CAPITAL RESERVE FUND
Supervisor Schwan reported that there is $ 130 , 000 in
Town-Zti surplus . This represents money put into the Bolton
Point " project together with the Village of Cayuga Heights in
order9to keep the project moving . This money is now part of the
Town-Aide general surplus . Supervisor Schwan recommended that

a public hearing be held in November to consider the establish-
ment of a capital reserve fund in the amount of $ 130 , 000 ° The
category that the fund would be used for is undetermined at this
time . !I, The Supervisor , however , suggested oark6 , and recreation .
The decision on this , however , will be made subsequent to in-put
at the public hearing ° Whatever the project , it must include the
Village of Cayuga Heights because they contribute to the Town -wide
fund . , Matching funds are available from the Federal government .
Money '' received from the Federal government can be used for legal
fees , ; condemnations , and outright acquisitions ° Supervisor Schwan
noted '' that the auditors have recommended that the fund be made
general rather than specific in order to provide greater flexibi -
lity in its use .
Motion by Supervisor Schwan ; seconded by Councilman Powers ,

RESOLVED , that the Town Board of the Town of Ithaca shall conduct
a public hearing on November 17 , 1975 at 5030 p ° m ° to consider
the establishment of a capital reserve fund in the amount of
$ 130 , 0' 00 from Town -wide surplus , the use of the fund to be deter -
minedlafter receiving in-put at the public hearing .

HIRING OF FINANCIAL CONSULTANT TO
PROCESS FHA LOAN FOR . SEWERING PROJECT
Supervisor Schwan . read a proposal dated October 6 , 1975
from Bernard P ° Donegan , Inc . to prepare and submit an application
to Farmers Home Administration for possible low- interest funds for
the proposed five - area sewering project ( $ 970 , 000 ) ° The cost of
the service is $ 2 . , 000 plus out -of-pocket expenses ° Such cost
would be paid out of Town-wide benefit sewer fund which has a
good surplus ,
Motion �lby Councilman Powers ; seconded by Councilman McElwee ,
RESOLVED , that Bernard P ° Donegan , Inc . be hired to prepare and
submit an application to Farmers Home Administration for possible
low- interest funds for the proposed five -area sewering project
( $ 970 , 000 borrowing ) for a fee in the amount of $ 2 , 000 plus out -of -
pocket expenses , as defined in the letter from Bernard P . Donegan ,
Inca dated October 6 , 1975 ,
Unanimously carried .
Supervisor Schwan noted that the plans for the sewering project
are now, under review by the Department of Environmental Conserva -
tion and the Health Department .
P & C FOOD MARKET SIGN
� Mr ° David Norcross , representing P & C , presented for the
Town Board ' s consideration a sketch of proposed new P & C sign for
the P & C Food Market ° The proposed sign is too large , being 200
square feet when the allowable square footage is 136 . Mrs . Holaw
comb reported that the Planning Board on October 7 1975 ( withou thou
quorum ) °, feels that the proposed P & C sign should not be approved

since it is in violation of Section 7 of the requirements ofthe
Sign Ordinance ( Local Law # 1 , 1972 ) 9
Il, Mr ° Norcross said the ro o '
p p sed sign is smaller than the
original one , although still non - conforming by 64 square feet . He
pleadedthat the sign is in good taste , that the larger size was
needed for visibility from the highway , that the sign is not on a
road orlhighway , that identity is important to P & C , that the Town
of Ithaca sign ordinance is rather more strict that the City of
Ithaca ordinance °

After considerable discussion of ways the sign might be
made t'0 conform with the Sign Ordinance , painting , background ,
visibility , hardship on P &C , if any , and possible request for
a variance , the Board acted as follows :
Motion, by Councilman Desch , seconded by Councilman Powers ,
RESOLVED , that this Board hereby , denies the application of P & C
Food Markets , Inc . for . the erection of a sign on the P & C • Food
Marketl,' at Judd Falls Road which does not comply with Section 7 ( a )
of Local Law # 1 - 1972 , to replace the present sign .
Unanimously carried .
It was agreed that Mr . Norcross , on behalf of P & C , would
present a request for a variance on October 15 , 1975 to the Town
Board . '!
FBC SIGN
Mrs H . William Batt , 308 Kline Road , inquired why , in
short ,order , the FBC sign panels should not be coming down , Mr . $
Fabbroni , Town Engineer , noted that the deadline for their removal
is November 1 , 19750
ADOPTION AND AMENDMENT OF
FEDERAL FLOOD PLAIN MAP - PUBLIC FEARING
The Town Clerk having presented proof of posting and pub-
lication of notice of public hearing to consider the adoption of
the Federal Flood Plain Control Map , as amended to include the
Powers '; Reuning , and Mursko properties , Supervisor Schwan opened
the hearing .
Mr . Fabbroni noted that these properties are among the
most vulnerable to flooding of all the land in the Town included
in the " Flood Plain . By inadvertence Powers , Reuning , and Mursko
were not included in the original map . Therefore , they are unable
to secure insurance until they are recognized as part of the flood
lands .
Supervisor Schwan inquired whether anyone wished to be
heard on this matter . No one wishing to be heard the hearing was
closeduand the Board acted as followso
Motion 'liby Councilman Powers , seconded by Supervisor Schwan ,
RESOLVED , that this Board hereby adopts the Federal Flood Plain
Control Map , as amended to include the Powers , Reuning , and Mursko
properties ( Parcels 31 - 2 - 10 , 31 - 2 - 23 , 31 - 2 - 9 , and 31 - 2 - 11 ) as part
of the 'iflood plain control area of the Town of Ithaca , the said
map to ',; be adopted , as amended , as the applicable map for the Town
of Ithaca Zoning Ordinance until such time as more complete data
are available from the Army Corps of Engineers .
Unanimously carried .
SANDRA ;I, PLACE
111 Mr . Fabbroni provided for the Board ' s review reports on
his traffic studies on Sandra Place and the Northeast area . He
indicated 24 -hour machine counts were compiled and morning and
afternoon peak-hour counts were compiled for 10 different inter-
sections in the Northeast area . This information was used to
verify ' the 24 -hour counts as well as to simulate what goes on at
the peak hours both in the morning and afternoon, . After compiling
this information , Mr . Fabbroni said he concentrated on problem
spots . li His recommendations are a part of the material furnished
to the Boards Some of the recommendations should be discussed
with the County Engineer .

Supervisor Schwan thanked Mr . Fabbroni for his excellent
traffic study , but suggested the Board should move on to the
specific agenda item - - Sandra Place .
Mr . Fabbroni then illustrated the traffic pattern on
SandralPlace via map . Mrs . Holcomb reported that the. Planning
Board had tabled the matter of opening Sandra Place or keeping
it closed a year ago until a traffic study was available for the
Northeast . She reported that the Planning Board had heard Mr .
Fabbroni ° s report ; that they had a public hearing on October 7 ,
1975 . !, They had petitions from both sides indicating a division
of opinion : Mrs . Holcomb said the Planning Board recommendation
( informal , since they had no quorum ) was to open Sandra Place
( the original plan ) which was part of the subdivision approved
in 1969 . She said there was a strong expression of opinion on
October' 7 on the Sandra Place matter and at meetings of the North
east , East Ithaca , and Forest Home civic associations that there
was inadequate traffic control and supervision by police in these
areas of the . Town of Ithaca . There was strong feeling about it ,
and Mrs . Holcomb said the Town Board will have to face it . She
said there are speed limits and traffic signs and none are being
observed . She said . the feedback on the controversy over Sandra
Place is that the best service is to make a decision on this prob-
lem .
Mrs . Dykema , 5 Sandra Place , spoke in favor of keeping
SandrafPlaoe closed . She said when Sandra Place became a through
street ° on the map there wash a feeling that Uptown Village Road
would become a through road and would , therefore , combine service
for the residents in Lansing who are living in the three apartment
complexes . At this time Uptown is not a through road , so that
those people who do want to get to Triphammer Road have to go to
WarrenG, Road and down Rt . 13 or they cut through Burleigh Drive .
From the floor it was noted that Mr . Fabbroni ° s report
indicated that not a great amount of traffic flow is involved .
Under the circumstances , it would appear to beda matter of appeas -
ing the residents rather than easing traffic flow . It was felt
that keeping Sandra Place closed would be a safety measure to pro -
tect the children in the area , which is especially a _ problem be -
cause of inadequate police surveillance .
Councilman , Powers asked what was to be gained by opening
SandraPlace . Overall he did not appear to get a satisfactory
answer ' to his question . Mr . Fabbroni , however , noted that it
would promote better internal circulation . Councilman McElwee
stated ;, that keeping Sandra Place closed would help preserve the
residential character of the neighborhood . This statement was

put in ';, lighting and drainage . Councilman Desch noted that if it
is not opened there would be nothing to prevent a future Town Board
from opening it .
It appeared that the overwhelming majority of those pres -
ent wanted Sandra Place to remain closed .

RESOLVED , that this Town Board hereby approves keeping Sandra
Place closed ( 1 ) to preserve the residential character of the
neighborhood , ( 2 ) to promote the safety of the children , in gen-
eral , and in particular when they are walking to and from school ,
and ( 3 )j! for the reason that the traffic studies do not indicate
that it will be of benefit to the Town or to the immediate area
to open Sandra Place .

Mrs . Holcomb noted that in the past plaques have been presto,
sented to former members of the Planning Board and members of the
Zoning, Board of Appeals in appreciation of their services . The
Town Board has already ' spread upon the minutes a resolution of
apprec��iation for Arnold Albrecht , but has not yet prepared the
plaque ifor him . It was agreed the plaque' for Mr . Albrecht should
be prepared as soon as possible and presented to him by Mrs . Hol -
comb .
" Let these minutes record the appreciation of the Town of
Ithaca and this Town Board for the years of service rendered by
Dr . John Lowe and Mr . Robert Scannell to the Town of Ithaca . A
formal'�Iplaque will be prepared for then! and will be presented by
Mrs . Barbara Holcomb , Chairwoman of the Town of Ithaca Planning

CERACCLHE TV PROPOSAL
Supervisor Schwan reported that the Town Board still
receives letters from citizens in outlying areas complaining
that they cannot get a television connection from Ceracche , ex-
cept at a prohibitive cost .
Mr . Walter Wiggins , representing Ceracche TV Corporation ,
said he had in hand two specific complaints , one from Joseph Trinkl ,
111 Vera Circle , and one from Dorothy F . Canfield , 180 Calkins
Road . With regard to Trinkl , Mr . Wiggins said that this extension
will be installed before the end of the year . He said the. homes
on the ;l,, west side of Sheffield Road cannot now be served because
they do not have a franchise in Enfield , but eventually it will
be , feasible and Ceracche will , in response to the Town ' s request ,
proceed with construction . Mr . Wiggins said it takes 20 houses
per mile to meet their existing formula and existing monthly cable
rate .
Mr . Wiggins stated that Mr . Ceracche has calculated for
the Town of Ithaca an extensions cost of $ . 0273 per foot per
month "and suggests extensions will be made on that basis . The
total footage necessary to be covered by the line is added up ,
divided by the number of subscribers , jand multiplied by $ . 0273
to determine the rate . As the number - of subscribers increases
the rate decreases until such time as there are 20 subscribers
per mile . There is no . additional charge above the standard month -
ly charge when there are 20 subscribers per mile . ' From 15 - 19
subscribers the proposed monthly charge is $ 9 . 00 , from 10 to 14 ,
the charge is $ 12 . 00 ; and from 5 - 9 subscribers the charge is $ 24 . 00 .
Ceracche Television , under this proposal , would not be required to
make an installation of cable service for less than five sub -
scribers per mile . A proposal similar to this has been made to
and accepted by the Town of Dryden . Mr . Wiggins said he would
put ,ths oral proposal in written form for the Town Board ' s con -
sideration prior to their next meeting . After Mr . Wiggins ' pre -
sentation , the Board acted as follows °

acche Television Corporation where the number of subscribers may
be less than 20 per mile .

TOWN BOARD MINUTES 11 - October 13 , 1975
BOARD ROOM ACOUSTICS AND ENLARGEMENT
OR RE -ARRANGEMENT OF BOARD ROODS TABLE
There was brief discussion of the need to enlarge or re °
arrange the Board Room table to accommodate two additional Board
members in 1976 . The possibility of having an elevated area for
the Board members to accupy was also noted . It was agreed that
Councilman Powers would look into this matter , and ; in addition ,
he will look into improving the acoustics . It has been reported
that at times people in the audience have difficulty hearing the
proceedings . It was agreed Mr . Powers would be provided with a
scale drawing of the Board room .
REPORTS OF TOWN OFFICIALS
Supervisor Schwan reported that Vincent Franciamone has
appealed Judge Yesawich ° s decision finding ,him in contempt . He
has been given until January 2 , 1976 to perfect an appeal from
the decision or to comply with it .
Mr . Fabbroni , Town Engineer , reported on the following
matters *
Williams Glen Road . Should be virtually completed by the
end of ij the week o,
Five Area Sewering Project . This is now in the hands of
the Department of Environmental Conservation in Syracuse and the
Town i "s trying to move them along .
Building Inspector Report . Building permits were issued
for 0 additions to homes and one office building in September for
$ 276 , 400 as compared to 4 additions and 3 homes for $ 144 , 300 last
year , or , almost double . Certificates of Occupancy ° ° a record
month for an 11CR addition , the remaining 13 apartments of East -
wood Commons , and 2 private homes .
b Beacon Hills . The permits for . Beacon Hills were revoked
in June because a year had expired and insufficient progress had
been made on the project since March of 1974 . Beacon Hills , by
registered letter , were asked to state , within 90 days , how the
project was to be abandoned and the site restored to its original
state 'or how the project would proceed with some additional guar °
antieslin the form of bonds , so if Beacon Hills comes to a second
default the Town could take immediate action to disband the pro
jest so that it does not become an eyesore and public nuisance .
The only response from Beacon Hills was notification that the
Town ° s!!, letter had been passed on to their corporate counsel . The
90 °day', period will expire on October 21 , 1975 . Mr . Fabbroni recom°
mended that at that time the Town proceed ( if no response is re °
ceived,) to ask the Town Attorney to take appropriate action to
jo have the , project disbanded . The Town Attorney will be requested
to mak'ie a recommendation on October 27 , 19750
Lansing Fast Apartments , Lansing East Apartments are
now involve— d- n+bankruptcy proceedings . Per . Fabbroni inspected
the site with Mr . Donald Dixon , New York State Engineer . There
are many electrical , safety , upkeep problems .* Mr . Fabbroni has
made it clear in a letter to Mr . James Kerrigan , Attorney for
Lansing East Apartments - that these matters will be the responsi °
bilityl` of the new owner , whoever it may be . The bank is now
looking for a buyer for this property .

TOWN BOARD MINUTES 12 . October 13 , 1975
Mrs . Holcomb reported that the Planning Board has had
an initial presentation from Paul and Bruce Ridley for site plan
approval for a graphic arts building on their property at Judd
Fallsp, Road between the shopping plaza and the Elderly Housing
development . The area is zoned Commercial . Mrs . Holcomb said
there ° is no formal recommendation from the Planning Board because
they did not hava a quorum ; however , those present at the meeting
did recommend that the Town Board approve the Ridley proposal . ,
Mrs , Holcomb recommended that the Town Board schedule a public
hearing to consider final site plan approval .
Motion by Supervisor Schwan * seconded by Councilman Powers ,
RESOLVED , that the Town board will conduct a public hearing on
October 27 , 1975 at 50000 o ° clock p . m . to consider final site plan
approval of a graphic arts building on property owned by Paul and
BruceiRidley (Parcel No . 6 - 622 --1 . 125 ) at East Hill Plaza on Judd
FallsiRoad , Ithaca , New York, and to . hear all persons for or
against such approval .

Martin , 137 Burleigh Drive , to the Planning Board to replace
Mr . Robert Scannell . Mr . Martin is from the Northeast area of

Mrs . Holcomb stated that the Board action tonight with
regard to Sandra Place points up the fact that in instances where
the Town Board will make the final decision , the public hearing
or hearings ought _ to be at the Town Board level . In the Sandra
Place ''matter the Planning Board , at the Town Board ' s request , did
the investigation and held three public hearings . Mrs . Holcomb
felt the Town Board ought to have had the benefit of the total
discussions had at the hearings held by the Planning Board with
respect to Sandra Place .
